Ordinance 33260006.900000 WSS/gjz 9/ 13/00 ORDINANCE NO.3326 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF CHAPTER 3.09 TO BROADEN THE PURPOSES OF A CUMULATIVE RESERVE FUND, ESTABLISHING A NEW FUND FOR FIRE DONATIONS, AUTHORIZING THE FINANCE DIRECTOR TO ESTABLISH SUCH FUNDS, ASSIGN NAMES AND NUMBERS CONSISTENT WITH THE STATE BARS SYSTEM, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City Council has previously established a special cumulative reserve fund to provide monies for the purpose of the maintenance, operation and improvements of municipal aid cars within the City, and WHEREAS, technological improvements in fire apparatus have made the term "aid car" obsolete, and WHEREAS, the City Council wishes to establish a new fund for fire donations separate and apart from other contributions to the City, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: {WSS449692.DOC;1/00006.900000/} - 1 - Section 1. The Edmonds City Code Chapter 3.09 Emergency Aid Car Cumulative Reserve Fund is hereby repealed and in its place enacted a new Chapter 3.09 Cumulative Reserve Fund for Fire Apparatus as follows: 3.09.010 Special cumulative reserve fund, fire apparatus. A. There is created a special cumulative reserve fund, fire apparatus to provide monies for the maintenance, operation and acquire apparatus used within the City and to further provide for the training of personnel performing emergency aid services in aid of the operation of such fire apparatus. B. Into such funds shall be paid all monies presently in the custody or control of the Edmonds Firefighters Association, which has been received by them as donations by virtue of the services performed in connection with the operation of emergency aid cars and other fire apparatus. Further, that all such monies transferred to the fund by the City or donations from whatever source paid to the City or any agency connected or affiliated with the City in any way, and intended to be a donation arising out of the use of an emergency aid car or fire apparatus, or for the purpose of continued maintenance, operation or improvement of such type of emergency vehicle services, together with the training of personnel in connection with the use thereof, of the City of Edmonds, shall be held and utilized as provided below. C. Expenditures to the fund shall be solely for the purposes annunciated herein and shall serve no other purposes. All monies in the fund shall be retained there from year to year and shall not be transferred to any other fund or expended for any other purpose. Section 2. The Edmonds City Code is hereby amended by the addition of a new Chapter 3.15 Fire Donation Fund to read as follows: 3.15.010 Fire donation fund. The Administrative Services Director is hereby authorized to create, name and number a new fund for the purpose of receiving donations for or in aid of the cost of operating, maintaining and improving the provision of emergency services related to the suppression of fires and the provision of emergency medical aid and assistance. This fund shall be maintained in such a way that the intent of the donors is honored and to the end that such deduction shall be fully tax deductible in accordance with the laws IWSS449692.DOC;1/00006.900000/1 - 2 - of the United States and the regulations of the Internal Revenue Service. Section 3. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
