AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF
EDMONDS COMMUNITY DEVELOPMENT CODE SECTION
17.40.025 NONCONFORMING ACCESSORY DWELLIN 7
UNITS, PARAGRAPH C, REGISTRATION OF ILLEGAL
DWELLING UNITS, TO CLARIFY THAT THE ILLEGAL
ACCESSORY DWELLING UNITS ABATED WITHIN FOUR
YEARS OF THE DATE OF PASSAGE OF ORDINANCE NO.
3300 MAY REGISTER AS ILLEGAL ACCESSORY
DWELLING UNITS, AND FIXING A TIME WHEN THE SAME
SHALL BECOME EFFECTIVE.
WHEREAS, Ordinance No. 3300 established an amnesty period within which
nonconforming and illegal accessory dwelling units existing within the City could register and
for a conditional use permit for an accessory dwelling unit (ADU), and
WHEREAS, it has come to the City Council's attention that illegal ADU's which
would otherwise have been eligible for registration and permitting had been abated at the order
of the City staff and therefore were not in existence at the date of passage of Ordinance No. 3300
and subject to the process which it established, and
WHEREAS, the City Council deems it to be in the public interest to include
illegal, abated structures in its definition of those illegal attached and detached accessory
dwelling units who may register under the provisions of this ordinance, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. The Edmonds Community Development Code, Section 17.40.025
Nonconforming Accessory Dwelling, paragraph C Registration of Illegal Accessory
Dwelling Units is hereby amended to read as follows:
17.40.025 Nonconforming Accessory Dwelling Units
C. Registration of Illegal Accessory Dwelling Units. ADU's
which were not legal uses at the date constructed, may be
registered during the registration period set forth in paragraph A
above. Illegal ADU's which are subject to the registration period
shall include illegal units in existence at the date of passage or
Ordinance No. 3300 as well as illegal ADU's, attached or
detached, which had been abated at the order of the City within the
four -year period preceding passage of Ordinance 3300.
Registration shall be accompanied by the fee established for the
issuance of a conditional use permit for each ADU which such fees
being used to defray the cost of building, fire and other
inspections. The City shall establish an inspection schedule for
ADU's. Certificates of Registration and Permit shall be issued to
the former illegal structure granting the privileges of a legal
nonconforming building subject to the provisions of ECDC
17.40.020 upon certification that the structure is, or has been
brought into compliance with all current provisions of the State
Building Code and City Ordinance.
Section 2. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
