Ordinance 33300006.900000 WSS /gjz 8/18/00 ORDINANCE NO. 3330 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF CHAPTER 3.24 TAXING AND REGULATION OF GAMBLING TO ENACT A NEW SECTION 3.24.015 PROHIBITING CARDROOMS AS COMMERCIAL STIMULANTS, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, pursuant to initiative petition, the City Council of the City of Edmonds enacted Ordinance No. 3328 prohibiting the establishment of social card games as commercial stimulants within the City of Edmonds, and WHEREAS, defects in the structure of said initiative petition have been alleged by persons subject to the coverage of the ordinance, and WHEREAS, the City Council wishes to amend and re -enact a previously established ban on cardrooms and to remove a sunset date established for said ordinance in order to preserve the provisions of that ordinance and maintain a continuous ban on cardrooms within the City in the exercise of the City Council's legislative discretion, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: , Section L. Section 3.24.015 Cardrooms as Commercial Stimulants Prohibited is hereby amended to read as follows: .I {WSS442507.DOC;1 /00006.900000/} - 1 - 3.24.015 Cardrooms as commercial stimulants — prohibited. House banked cardrooms as established under RCW 9.46.0282 and social card games conducted as commercial stimulants shall be prohibited within the City of Edmonds. The terms "cardroom" and "commercial stimulant" shall be defined as provided above in Section 3.24.010. Section 2. A version of this ordinance was enacted by Ordinance No. 3319 with a sunset date. Said sunset date is hereby repealed. The provisions of Section 1 shall be and remain in full force and effect but shall not be implemented unless and until a similar provision enacted by Ordinance No. 3328 in accord with an initiative petition is struck down by action of a court of competent jurisdiction. Section 3. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
