ORDINANCE NO. 3332
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, ESTABLISHING A SPECIAL SEWER
CONNECTION CHARGE FOR PROPERTIES, RESIDENTIAL
DWELLING UNITS, AND OTHER STRUCTURES
CONNECTING TO SANITARY SEWER IMPROVEMENTS
CONSTRUCTED BY LIDS AND WHICH HAVE NOT BEEN
ASSESSED UNDER THOSE LIDS, AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City of Edmonds has created local improvement districts for the
purpose of constructing sanitary sewer improvements and may create more such districts in the
future, and
WHEREAS, despite the City's best effort to identify those properties that could
potentially connect to the sanitary sewer improvements constructed by such LIDs, there may be
properties connected in the future for which assessments were not levied, and
WHEREAS, in order to ensure that each property connecting to the Edmonds
sanitary sewer system pay its equitable share of the historical costs of the system, the City
Council has determined that a special connection charge should be imposed on those properties
which may hereafter connect to the sanitary sewer improvements constructed by LIDs and which
were not assessed for the same, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. Special Connection Charge. A new Section 7.30.045 is hereby added
to the Edmonds Municipal Code to read as follows:
7.30.045 Special Connection Charge.
In addition to any other charges prescribed by this
Chapter, a special connection charge shall be paid by the owner of
any property, residential dwelling unit, or other structure that may
hereafter connect to the sanitary sewer improvements constructed
by any local improvement district formed by the City and for
which no assessment was imposed or charged under the said LID.
The special connection charge for each property, residential
dwelling unit, or other structure so connected shall be equal to the
amount of the assessment that would have been levied against such
property, residential dwelling unit, or structure under the final
assessment roll of the appropriate LID if the said property,
residential dwelling unit, or other structure had been so assessed,
together with interest thereon at the rate established by the
ordinance authorizing issuance of the bonds for said LID, from the
time of such authorization until the time of connection. The
special connection charge shall be paid in a lump sum prior to
connection to the sanitary sewer. The special connection charge
provided for in this section shall apply only where the debt used to
finance the local improvements has not yet been fully retired
through assessment payments. If such debt has been fully retired
through payment of such assessments, the special connection
charge shall not apply.
Section 2. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance, being the exercise of a power
specifically delegated to the City legislative body, is not subject to referendum, and shall take
effect five (5) days after passage and publication of an approved summary thereof consisting of
the title.
