ORDINANCE NO. 3413
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING CHAPTER 5.27 OF THE
EDMONDS CITY CODE, SPECIFICALLY PROHIBITING THE
SALE, PURCHASE, POSSESSION AND USE OF CONSUMER
FIREWORKS FROM DECEMBER 27, 2002 THROUGH
DECEMBER 31, 2002, AND FIXING A TIME WHEN THE
SAME SHALL BECOME EFFECTIVE.
WHEREAS, the City of Edmonds currently prohibits the sale, possession, use,
transfer, discharge, ignition and explosion of fireworks within the City's jurisdiction; and
WHEREAS, the Washington Legislature has recently revised state law to enlarge
the allowable period for the use and discharge of consumer fireworks; and
WHEREAS, the revised state law authorizes municipalities to, within 60 days of
the law's effective date, adopt ordinances prohibiting such fireworks from December 27, 2002
through December 31, 2002; and
WHEREAS, the Edmonds City Council determines that adoption of such a ban
would serve the public interest; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. Chapter 5.27 of the Edmonds City Code is hereby amended by the
addition of a new Section 5.27.175 Prohibition effective in December 2002 to provide in its
entirety as follows:
5.27.175 Prohibition effective in December 2002.
Notwithstanding any other provision of law, the
prohibitions of this chapter regarding the sale, possession, use,
transfer, discharge, ignition or explosion of fireworks apply with
full force to the period of December 27, 2002 through December
31, 2002.
Section 2. The provisions of this ordinance apply specifically to the period from
December 27, 2002 through December 31, 2002, and shall sunset on January 1, 2003. The City
Clerk accordingly shall direct the code publisher to de- codify ECC 5.27.175 as of said sunset
date. The sunset of this ordinance shall not affect any other provision of Chapter 5.27 ECC,
including but not limited to the prohibition on the sale, possession, use, transfer, discharge,_
ignition or explosion of fireworks contained in ECC 5.27.020.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
