Ordinance 34320006.90000 WSS /gjz 12/6/02 ORDINANCE NO. 3432 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF SECTION 3.20.050 IN ORDER TO CHARGE A BUSINESS AND OCCUPATION TAX UPON PROVIDERS OF SOLID WASTE DISPOSAL SERVICES, REPEALING CHAPTER 4.64, RELATING TO GARBAGE COLLECTION, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City of Edmonds charges various utilities and those providing utility like services to the City of Edmonds a business occupation tax of six percent, and WHEREAS, the City is authorized to imposed such charges with respect to public electric utilities and private persons providing utility or utility -like services pursuant to its authority as a non - charter code city, and WHEREAS, the City currently charges a license fee of $1.00 per customer pursuant to Chapter 4.64 for persons collecting solid waste within the City, and WHEREAS, such charge which has been in effect since 1961 and no longer has parity with the charges levied on other utility providers within the City, and WHEREAS, the City deems it to be in the public interest to levy a business and occupation tax upon solid waste disposal companies operating within the City of Edmonds, at a rate equivalent to that charged other utilities operating within the City, including the City's own sewer utility; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: {WSS532652.DOC;1/00006.900000/} - 1 - Section 1. ECDC Section 3.20.020 Definitions is hereby amended by the addition of a new paragraph D to be inserted with the renumbering of existing paragraphs D, E and F. The new paragraph D shall read as follows: 3.20.020 Definitions. D. "Solid waste hauler" shall mean any person or persons providing solid waste disposal services authorized pursuant to Washington Utilities and Transportation Commission Tariff to dispose of solid waste, garbage, refuse or any similar material within and from the City of Edmonds, or providing such services to City of Edmonds' residents. Section 2. ECC 3.20.050 Occupations subject to tax — amounts is hereby amended by the addition of a new paragraph G to read as follows: 3.20.050 Occupations subject to tax — amounts. G. Solid waste haulers. Any solid waste hauler shall be subject to the tax imposed by this chapter. The solid waste hauler shall pay a tax equal to six percent of the total gross income from the charges derived from solid waste disposal services within the corporate limits of the City during and for the term for which the occupation license is required. Section 3. ECDC Chapter 4.64 Garbage collection is hereby repealed. Section 4. The provisions of Sections 1 and 2 shall be applicable to all charges levied after January 1, 2003. Section 5. Effective Date.
