Ordinance 35260006.90000 WSS /gjz 11/12/04 ORDINANCE NO. 3526 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF EDMONDS CITY CODE SECTION 10.90.020 COMPOSITION OF THE COMMISSION TO ADD AN ADDITIONAL VOTING MEMBER, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the current composition of the seven members of the Edmonds Historic Preservation Commission include six voting members and one ex- officio non - voting member from the City Council, and WHEREAS, the Commission has requested that an additional voting position be added in order that ties can be avoided and also avoiding the need for a super majority of four of the six members of the commission in order to reach a decision, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds City Code Section 10.90.020 (B) Composition of the Commission is hereby amended to read as follows: 10.90.020 Composition of Commission. B. The Commission shall consist of seven voting members and one non - voting, ex officio position to be filled by an Edmonds City Council member. The commission shall include at least two professionals who have experience in identifying, evaluating and protecting historic resources and are selected from among the disciplines of history, architecture, architectural history, historic preservation, planning, cultural anthropology, archeology, cultural geography, American studies, law and/or real estate. Four {WSS585052.DOC;1 /00006.900000/} - 1 - positions shall be filled by citizens of Edmonds with the demonstrated interest in historic preservation. One position shall be filled as recommended by the Edmonds South Snohomish County Historical Society. A commission action that would otherwise be valid shall not be rendered invalid by the temporary vacancy by one or all of the professional positions, unless the Commission action is related to meeting Certified Local Government (CLG) responsibilities cited in the certification agreement between the Mayor and the Historic Preservation officer. Furthermore, in special circumstances, exceptions to the residence requirement of commission members may be granted by the Mayor and City Council in order to obtain representatives from those disciplines. Section 2. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
