Ordinance 35390006.90000 WSS /gjz 2/22/05 ORDINANCE NO. 3539 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF ECDC 16.50.020 SITE DEVELOPMENT STANDARDS (B)(3) TO CORRECT SCRIVENER'S ERRORS IN ORDINANCE NO. 3518, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, Ordinance No. 3518 was enacted by the City Council of the City of Edmonds based upon the recommendation of its Planning Board as contained in File CDC -2004- 37, and WHEREAS, said recommendation recommended approval of a change to permit properties in the City's Fifth Avenue entrance corridor south of Walnut Street, where the first 60 feet of building as measured from Fifth Avenue consists only of commercial uses, to install residential uses at the rear of the property to provide for a transition to the adjacent residential neighborhood, and WHEREAS, Ordinance No. 3518 contains scrivener's errors incorrectly referencing Main Street rather than Fifth Avenue and replacing the word "commercial" with the word "residential", and WHEREAS, the City Council wishes to correct those errors based upon the original recommendation of the Planning Board and the public hearings held in conjunction with Ordinance No. 3518 in order to conform therewith, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: {WSS593804.DOC;1/00006.900000/} - 1 - Section 1. The Edmonds' Community Development Code Section 16.50.020(B)(3) is hereby amended to read as follows: 16.50.020 Site development standards. B. Ground Floor. 3. With respect to, but only to, property located on the Fifth Avenue entrance corridor, south of Walnut Street, in which the first sixty (60) feet of the building as measured from Fifth Avenue consists only of commercial uses; and with respect to which the subject property shares a property line with a single - family or multi family zoned properties, then multi - family units may be located on the ground floor in such a manner that they face the adjacent residentially zoned property. Section 2. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
