Ordinance 37350006.90000 WSS /gjz 5/4/09 ORDINANCE NO. 3735 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE EDMONDS CITY CODE, TITLE 10, TO ADD A NEW CHAPTER 10.75 CITIZENS ECONOMIC DEVELOPMENT COMMISSION, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the Citizens' Levy Review Committee was tasked with reviewing the financial situation of the City of Edmonds and has made a series of recommendations, and WHEREAS, one of the Committee's recommendations was the development of a broad vision and long -term strategies to make the Edmonds fiscal situation sustainable without recurring votes of the public for increased property taxes; WHEREAS, the challenge of revenue in the City of Edmonds is multi - faceted with a long history of policy decisions leading up to the state of the budget in 2009; and WHEREAS, the primary budget problem of the City of Edmonds is one of revenue, not expenses; and WHEREAS, the City Council finds it to be in the public interest to establish an Economic Development Commission in order to take advantage of the large number of highly qualified citizens who are interested in serving their community as it addresses this problem; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: {WSS727625.DOC;1/00006.900000/} - 1 - Section 1. The Edmonds City Code, Title 10, is hereby amended by the adoption of a new Chapter 10.75 Citizens Economic Development Commission to read as follows: Chapter 10.75 Citizens Economic Development Commission 10.75.010 Commission created - Membership. 10.75.020 Officers of commission - Meetings - Forum. 10.75.030 Powers and duties. 10.75.010 Commission created - Membership. A. There is hereby created a Citizens Economic Development Commission consisting of up to 17 members. The members shall be appointed in the following manner. Each Council Member may appoint up to two members. The Mayor may appoint up to three members. In the event that any appointed member fails to attend three consecutive meetings, or is otherwise unable to perform his or her duties, that person may be replaced by the Mayor and Council Member who originally appointed the member. B. The term of appointments shall not exceed two years. The Commission shall serve for a period of about two years until this provision sunsets commencing upon the first meeting of the Commission. The Commission shall sunset and expire December 31, 2010. 10.75.020 Officers of commission - Meetings - Forum. Members of the Commission shall meet and organize by electing from the members of the Commission a chairman and vice - chairman and such other officers as may be determined by the Commission. It shall be the duty of the chairman to preside at all meetings. The vice chairman shall perform this duty in the absence of the chairman. A majority of the filled positions on the Commission shall constitute a quorum for the transaction of business. A majority of the quorum may transact any particular business of the Commission. The regular public meeting of the Board shall be held at such time or place as may be determined by the chairman or a majority of the members of the Commission. Such meetings shall be considered special meetings and notice shall be provided in accordance with City ordinance and state law. {WSS727625.DOC;1/00006.900000/} - 2 - 10.75.030 Powers and duties. A. The Commission is empowered to advise and make recommendations to the Mayor and City Council, and as appropriate to the Planning Commission, Architectural Design Board or other Boards or Commissions of the City on such matters as may be specifically referred to the Commission by the Mayor or City Council including but not limited to: 1. Determining new strategies for economic development within the City of Edmonds; 2. Identifying new sources of revenue for the consideration of the City Council. B. The Commission shall deliver an annual report to the City Council in written and oral form on or about the first meeting in December of every year, and when appropriate, during other times as directed by the Mayor or Council. C. The Edmonds Economic Development Commission may from time to time provide its reports and recommendations regarding strategies for economic development and other matters that will improve commercial viability, tourist development and activity within the City. The Planning Board and Economic Development Commission shall make joint recommendations on such subjects to the City Council on or about the first meeting in December. Section 2. The Edmonds Community Development Code Chapter 10.40 Planning Board is hereby amended by the addition of a new Section 10.40.030 Coordinated report - Citizens Economic Development Commission. 10.40.030 Coordinated report - Citizens Economic Development Commission. In addition to its other duties, the Planning Board shall review and consider strategies for economic development in conjunction with the Citizens Economic Development Commission. Such strategies shall be designed to improve commercial viability, tourism development and activity within the City of Edmonds. The Planning Board and Citizens Economic Development Commission shall report to the City Council on or about its first meeting in December 2009 regarding its joint recommendations. The provisions in this ordinance shall automatically expire and sunset on December 31, 2010 unless sooner repealed or amended by act of the Edmonds City Council. Section 4. Effective Date. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
