Ordinance 3976ORDINANCE NO.3976 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 4.72.040 OF THE EDMONDS CITY CODE RELATED TO BUSINESS LICENSE FEES AND PENALTIES WHEREAS, the city has an adopted business license program and associated fees and penalties in chapter 4.72 ECC; and WHEREAS, the city expends a disproportionate amount of time and resources to gain compliance from a small minority of businesses that fail to renew their business license in a timely manner; and WHEREAS, the city has explored various options for reducing waste and maximizing resources in the City Clerk's Office and relieving Code Enforcement from excessive referrals relative to City business licenses; and WHEREAS, the city has concluded that amending business license application due dates and penalties for late applications and/or payments is the most efficient and logical way to encourage compliance; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 4.27.040 of the Edmonds City Code, entitled "Fee — Terms — Penalty," is hereby amended to read as follows (new text is shown in underline; deleted text is shown in stfi e gffeug ): 4.72.040 Fee — Terms — Penalty.11, A. Commending January 1, 1977, business licenses required to be obtained pursuant to this chapter, shall be issued on a calendar year basis and shall expire on December 31 st of the year for which they are issued. B. Fees for an annual business license issued hereunder shall be as follows: 1. The fee for an application for a new business license for any business that is not a home occupation, as provided in Chapter ECDC 20.20.010ECDC, to be operated from any real estate within the city of Edmonds shall be $125.00; 2. The fee for an application for a new business license for a new home occupation business, as provided in Chapter ECDC 20.20.010, to be operated from any residential real estate within the city of Edmonds shall be $100.00; 3. The fee for an application for a new business license for any other business conducted for, under contract with or by providing services to any person within the city shall be $50.00; and 4. The fee for an application for an annual renewal of a business license shall be $50.00 for any business operated within the city of Edmonds. C. If any section, subsection, clause, sentence, or phrase of this ordinance should be held invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. Section 3. Effective Date. This ordinance is subject to referendum and shall take effect thirty (30) days after final passage of this ordinance.
