Ordinance 4084ORDINANCE NO.4084 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ADOPTING FINDINGS AND CONCLUSIONS AND APPROVING A CHANGE IN ZONING FOR CERTAIN PROPERTY LOCATED AT 9601 EDMONDS WAY FROM WESTGATE MIXED USE (WMU) TO COMMUNITY BUSINESS — EDMONDS WAY (BC-EW); AUTHORIZING AMENDMENT OF THE CITY' S OFFICIAL ZONING MAP; AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE WHEREAS, certain real property located at 9601 Edmonds Way with a Snohomish County tax parcel number of 00937900001000 was rezoned from Community Business — Edmonds Way (BC-EW) to Westgate Mixed Use by Ordinance No. 3993 as part of an area wide rezone that affected a number of different parcels and ownerships; and WHEREAS, the subject property was the only property of the Westgate Mixed Use area wide rezone with a Comprehensive Plan designation of Edmonds Way Corridor; and WHEREAS, applying the WMU zone to the subject property severely limits development potential of the site due to the site's configuration and other constraints; and WHEREAS, the purposes of BC zone specifically note that BC-EW zone is intended "to implement the policies of the Edmonds' comprehensive plan for the Edmonds Way Corridor"; and WHEREAS, rezoning the site back to BC-EW would be more consistent with the City's policies and intent for the Edmonds Way Corridor; and WHEREAS, the City Council has received the recommendation of the Planning Board, which after an open -record public hearing on September 27, 2017, the Planning Board voted to recommend approval of a rezone of the subject property from WMU to BC-EW; and WHEREAS, the City Council reviewed the minutes of the hearing before the Planning Board; and WHEREAS, the City Council reviewed the Planning Division Advisory Report, Findings, Analysis, and Recommendation dated September 22, 2017; and WHEREAS, a closed -record hearing on the Planning Board's recommendation was held by the City Council on October 17, 2017; and WHEREAS, the Edmonds City Council agrees with the Planning Board's analysis that the proposed rezone is in the public interest and satisfies all applicable criteria of Chapter 20.40 of the Edmonds Community Development Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. For its findings and conclusions in support of the rezone effected by this ordinance, the City Council hereby adopts by reference the findings and conclusions contained in the Planning Division Advisory Report, Findings, Analysis and Recommendations dated September 22, 2017 (File No. PLN20170034). Section 2. The certain property located at 9601 Edmonds Way with a Snohomish County tax parcel number of 00937900001000, and shown on the attached zoning map (Attachment A) is hereby rezoned from WMU to BC-EW. Attachment A attached hereto is hereby incorporated by this reference as if herein set forth in full. -2- Section 3. The Development Services Director or designee is hereby authorized and directed to make appropriate amendments to the Edmonds Zoning Map in order to properly designate the rezoned property as Community Business — Edmonds Way (BC-EW) pursuant to Section 2 of this ordinance. Section 4. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
