1942-04-07 City Council MinutesMARCH 17th, 1942. The Council met in regular.session with Mayor.Fourtner presiding. The roll -call showed the following Councilmen present:H.A.Chandler, W.C.Hanson, Claude Savage, Walter Hansen, Walter Clausen and �i.T.Jones, R.T.Roseoe.being absebt. -The minutes of the,last meeting were read and approved. On motion the Qouncil adopted the following resolution No.151. WHEREAS, the City Coueil of .the City of .Edmonds on July.15th, 1941 passed a ' resolution setting up funds available for the period April 1, 1941, to-Mar'oh 31, 1943, under the items of Maintenance, Construction and Overhead, and..,._ WHEREAS ,,It is gounf necessary to revise the setup under the above mantionecl item; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City. Council of the City of Edmonds in regular meeting duly assembled as follows: 1. That based upon estimated receipts as aforesaid the following is proposed as the items covering expenditures of said City from the City Street.Fund for the biennium commeoing April 1, 1941, and ending March 31, 1943: Total • maintenance Construction Overhaed Secondary State. That should such receipts exceed the estimate aforesaid, such excess shall be expended by the City in the manner provoded by law, subject to the approval of the Department .of Highways. 3. That the City Clerk be, and is hereby, instructed to forward a copy of this .desolution to the Department of Highways, ADOPTED by the Mayor and City Council March 17th; 1942. A petition was presnted.to the Council requesting that sidewalks and curb and gutters be plastid on First Avenue. North, from, Edmonds., Street to Main. street On motion the City Attorney was instructed.to draw up a Resoltition of .Intentiv e to improve First Avenue.from Edmonds Street to Main street by a side walk and curb and gutter and:a.eurb and gutter on the weft side from,Edmonds street to Main street. , The Chief of Police brought up .the question of parking .of. automibles on Main street from Third Street to Fifth. Street. 'On -motion the. Chief was, instructed to establish parking limites from Third . Avenue` to Fifth 'Avenue .om ,Main street and establish a. stoping place for ,the busses. The oil burner of.the furnace kneeding repairs, on motion mr. Bently was instructed to peke -the necessary repairs. The Street Superintendent requested ,thq Council to furnish a blad for the grader. N:o.151. A.Resolttion declaring the intention of the City Council of the City of Edmonds to improve the East side of First Avenue (Front Street), in said City of Edmonds, from the South line of Edmonds Street to the North line of Main Street by the installation of a five foot concrete sidewalk and con- crete. curb and gutter, and for the improvement of the West side of First Avenue (Front Street•),,in said city, from the South line of Edmonds Street to the North line of Main Street, by the installation of a concrete curb and gutter, and the improvement of the South side of -Edmonds Street from the East line of Firs.t,Avenue (Front Street) to the alley between First Avenue (Front Stree) to the alley between First Avenue (Front Street)' and Second Street by the installation of a five foot concrete sidewalk and con- orete curb and gutter and such other work as may ber-necessary to make a com- plete improvement;.providing that the payment for said improvement be made by special assessment on the property in said Improvement,District under the mode of payment by Bonds for materials used, fixed estimate, and all other expenses, except the cost of labor to be furnisged by Federal funds under the WPA plan of the Federal Government. BE IT RESOLVED BY THE CITY COUNCI: OF THE CITY OF EDMONDS: I. That it is the intention of the City Council of the City of Edmonds, Washington, to improve the East side of First Avenue (Front Street), in said City of Edmonds, from the South line of Edmonds Street to the North line of Main Street by the installation of a five foot concrete sidewalk and con- crete curb and gutter, and for the improvement of the `Jest side of i'irst Avenue (Front Stree#, in said city, from the South line of Edmonds Street to the North line of Main Street, by the installation of'a concrete curb and gitter-, and the improvementof the South side of -Edmonds Street from the East line of First Avenue (Front Stree) to the alley between First Avenue (Front Street) and Second Street by the installation of a five foot concrete sidewalk and concrete curb and gutter and such other work as may be necessary to make a complete improvement. 2. That the cost and expense of -all materials required to make a complete improvement, the fixed estimate and all other -expenses of every kind, except cost of labor contributed by the Federal Government under W2A, shall -be made by special assessment; a Local Improvement District shall be established embracing as near as mL y be all the property specially benefited by such improvement, and such specially benefited property shall be assessed to pay for the entire cost of such improvement; except the cost of labor furnished by the kederal Government under t`iKP 3. All persons who may desire to object to the improvement herein mentioned are hereby notified to appear at the Council Uhambers in the City Hall, in the City of Edmonds, 'Washington, at a meeting of the said Council on the 5th day of May, 1942 at the hour of eight o'clock P. X., of said day, then and there to present their objections thereto, if any they have. The City Enginder of said City of Edmonds is hereby directed to submit to the City Council, at or prior to said 5th day of May, 1942, the estim- ated cost and expense of the improvement, in this resolution mentioned, and a statement of the proportionate amount thereof which shall be borne by the property within the proposed Improvement District; and a statement of the ag�r-egate assessed valuation of the real estate, exclusive of improvements, within said proposed Improvement District according to the valuation last placed upon it for general taxation, together with a diagram or print showing thereon the lots, tracts or parcels of land and other property which will be specially benefited thereby, and the estimated amount of the cost and expense of such improvement to be borne by -each lot, tract, parcel of land, or other property. An Ordinance providing for the improvement of the alley in blocks 70, 75 and 90, Plat of the City of Edmonds, between Maple and Alder Streets from Seventh Street to Tenth Street by the construction of a six-inch combined sanitary and storm lateral sewer along said alley through-Block'70 and.an eight -inch combined sanitary and storm lateral sewer along said.alley through Blocks 75 and 90 and continuing to a _,.junction with the trunk sewer at Seventh and Maple, together with the necessary manholes, catch basins and other appurteneances necessary to make a complete improvement, all in accordance with xesoluti©n No. 151, of the City of,Edmonds; creating.dn Assessment 1istrict; creating a Local Improvement District Fund therefor, and providing that payment for such improvement, except for labor, be:made;by special assessment on said District under the modeof payment by bonds. > rWHEREAS,.by Resolutimn No: 151,.of the City of Edmonds, the City Council of,said-City-has declared its intention to order the improvement as > ab.gve outlined.and doing all other work necessary in connection therewith to make a complete improvement inaceordance with the plans,and spec- ifications prepared by. the City .Engineer, now, therefore, THE CITY OF EDjMONDS. DOES ORDAIN: Section 1: That the alley in Blocks 70, 75 and 90, Plat of the City of Edmonds, between Maple and Alder Streets from Seventh Street to Tenth Street be improved by the construction of a six-inch combined sanitary and storm lateral sewer along said alley through B1ock.70 and an eight -inch combined sanitary and storm. -lateral sewer along said alley through Blocks 75 a.nd90 and continuing to a junction with the trunk sewer.at Seventh and Maple,. together with the necessary manholes, catch basins and other appurtenances to make a complete improvement, all in accordance with the plans.and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the costs and expenses of such improvement shall be borns by and assessed against the property included in the assessment District herein created in accordance with law. .Section 3:. There is hereby established a Local Improvement District. to be called Local Improvement District No. 54, which District shall include the following described property, to wit; Lots 1•and 40 inclusive in Block 90; Lots 1 and 38 inclusive in Block 75, Lots 1 and 40 inclusive in Block 70; all in the Ylat-of the City of Edmonds, Snohomish Counter,, State of Washington. Section 4;. A special fund is hereby created to be called Local Improvement District Fund No. 54, which shall consist in the aggregate of the several amounts assessed, levied and collected on the several lots and parcels of land in said Local Improvement Districe and the proceeds of the sale of the bonds of the said District for the purpose of defraying the costs and expenses of such improvement.' Out -of said fund shall be paid bongs, the interest thereon, and the entire cost of such improvement, except the cost of labor as hereinafter provided. Section 5: The costs and expenses of such improvement shall be defrayed by special assessments payable in ten equal, annual inttallments with interest thereon at the rate of 4 per cent., per Iannum under the mode of payment by bonds, as provided by law and the Ordinances of said city. Bonds bearing interest at the rate of 4 per cent., per annum, payable on or before twelve years fromdate of issue, shall be issued in payment of the costs and expenses of such improvement, or the City of.Edmonds may.,.,at its. -election., sell said bonds and make payment in cash in the manner provided by the Ordinances of said city. Section 6: That the costs and expenses of said improvement to be borns by tnd assessed against the property of the said Assessment District., and for which bonds of said District are to be issued, shall not include the cost of labor upon said improvement,. which labor is to be furnished by Federal funds under the VJPA plan of Ilederal Government. Passed,this.7th day of April 1942. Mayor City Clerk Walter N Nielsen complained about the sidewalk that was put in Y WPA , in. front of his plagk.He put up $20.00 to.help replase it. On motion the Council desided to. have it replased. . a R.H.Doty requested the Council tag establish parking zonec.for'the busses. .On' motion the Councildesided to marks 40, feet .in front of _Swansons drug Store as a parking zone for the `busses. Mr. Townsen requsted permission to connect his sewer with Chas. Bosharts sewer on Fourth Avenue. On,motion the request was granted. D.M..Yost requested the Council'to repased the Siren switch as it is woren out. On motion the request was granted and the Clerk -was instructed to, have it replased.
