Harrison, Mayor Sept 15, 1970 ROLL CALL ` Regular meeting of the Edmonds City Council was called to .order by Mayor Harve Harrison with all councilmen present_ except Kincaid, who was in the hospital for an operation* APPROVAL OF MINUTES Minutes of the meeting of September l,had been posted and mailed, and with no omissions nor corrections, they were approved as written* HEARING:: PETITION FOR ANNEXATION OF MATHAY PROPERTY Hearing on the petition for annexation of the Mathay property,=rth side of 2241h and east of Highway 99, had been continued from the meeting of July 70- City Planner Merlin Logan gave a report on the Planning Commission meeting when they passed their Resolution #338, recommending that these properties north of K-Mart which are presently under the jurisdiction of Snohomish County be rezoned • to CG and RML in the event such properties are annexed to the City. He noted that this recommended zoning would be similar to the present county zoning, except for a slight change in density. He added, however; that efforts should be made to square off the city limit boundaries if possible, and future piecemeal annexations should be discouraged. This was also the opinion of the City Engineer, who when questioned by councilmen, answered that although the City could serve the area with utilities, there was a real objection to annexing small areas, and it was better to round out the boundaries of the city in order to provide adequately planned services. Hearing was opened* Curt Thomson, attorney representing the petitioners, stated that at the July 7 hearing, most of the questions and answers concerning this area had been taken care of. He added that now the Planning Commission has held its hearing and recommended the zoning, and he now felt the annexation request is reasonable and the applicants are willing to accept the zoning as recommended for this. parcel• Councilman Sanborn suggested that perhaps the council should take action on the zoning before taking action on the annexation. Councilman Nelson noted that the concern seemed to be mainly with the size of the area and perhaps the=annexation should be denied and a larger area brought in to'round out the boundaries. Much discussion followed. No one else in the audience wished to comment, and the hearing was closed•. It was moved by Councilman Haines seconded by Councilman Slye that proposed Ordinance #1496 be passed, annexing the Mathay property as descirbed to the City of Edmonds• A roll call vote showed all councilman in favor except Nelson and Tuson, and the motion carried* HEARING: ON PLANNING COMMISSION RESOLUTION #333 • Hearing was held on Planning Commission Resolution #333, proposing revised develop - A ment standards for duplexes and apartments. This had been continued from August 4. City Planner Logan briefly outlined.for the audience the study already_comple.ted=:py the council on this Planning Commission recommendation, and added that since more time was needed to adequately study the proposals on the building changes, he suggested postponing the hearing until this could be done. A motion was made by Councilman Slye, seconded by Councilman Nordquist that this hearing be continued to October 20, and the motion carried. HEARING:: ON PLANNING COMMISSION RESOLUTION #334 Hearing was held on Planning Commission Resolution #334, apartment standards for the elderly. City Planner,Logan explained the Planning Commission allowances for these apartment units since these people do not need the floor area or number of parking spaces which would be required for conventional apartments. It was noted that approximately 15% of the people in Edmonds were on the Social Security rolls, and one estimate was that 300 units in south county could be utilized immediately by qualified occupants. � r Councilman Slye suggested that this hearing be delayed until it could be heard before a full council. It was decided, however, that since there were people in the audience directly concerned with this proposal, that the hearing be held as scheduled. Hearing was then opened*. Howard Wilson, 20112 - 24b N.W., Seattle, spoke of his previous building projects in the City of Edmonds, and of the need here and nbw for housing for the elderlyq He . _-13 added that hip partner, Gordon Hendrickson, had been a member of the Board for Hilltop House in Seattle and was very interested and knowledgeable in regard to the benefits derived from this type of housing. Ray Sherman, retired from FHA, had been hired by Mr. Wilson and Mr. Hendrickson as a consultant. Mr. Hendrickson showed diagrams of the proposed development of the property they planned to use, located on 41h and Howell directly behind the present A & P Store. Capt. Shields mentioned an -article he had read stating that a proposed federal law on zoning for this purpose will over -ride local -zoning laws. Barbara Skinners president of the League of Women Voters, submitted a statemInt which cited the need for this type of housing for the elderly in this area. Herbert Shippen, 1022 Euclid, stated that he was in favor of this provision for the elderly. Councilman then questioned Mr. Ray Sherman regarding the housing and maximum income allowed in order to be eligible. Mr. Sherman also gave a general explanation of the financing of these projects, and invited the council to take a tour of some of these apartments already established in the area to see first hand what a great improvement they are for elderly folk who otherwise might be living under undersirable conditions. Mr. Brooke, who lives`on Howell Way just across from where these apartments might be constructed, had a question concerning the Shepherd house located there. Bill Casper, who is with Coast Mortgage Co., stated that both Mr.,Wilson.and Mr. Hendrickson were prime subjects with a reputation for first class projects, and he was highly in favor of their being allowed to put in this proposed apartment for''the elderly in Edmonds. He added that there are no facilities here for older relatives who wish to live near, but not with, their families, and since°the need is now, he strongly recommended approval. Council asked several questions of Mr. Sherman. Following a great deal of discussion, • a motion was made by Councilman Slye, seconded by Councilman Nordquist�that this hearing be continued to November 3- Motion carried with Councilman Nelson voting against as he stated that he was ready to vote on the question tonight, Several of the,counoilmen planned°to accompany Mr. Sherman -on a tour of accupied units in es- tablished housing for the elderly projects - SECOND READING: PROPOSED ORDINANCE FOR SKIN DIVING REGULATIONS Second reading was held on the proposed ordinance for skin diving regulations, but since the attorney advised that the answer had not been received from his letter to the -Port, it was moved by Councilman Nelson, seconded by Councilman.Tuson that this hearing be continued to the October 6 meeting. Motion carried. SECOND READING: PROPOSED ORDINANCE FOR CONDEMNATION PROCEEDINGS - NINTH AVE. N. Second reading was held on the proposed ordinance for condemnation proceedings against property on Ninth Avenue North.. It was moved by Councilman Haines, seconded by Councilman Slye that proposed Ordinance #1497 be,passed, and the motion carried• CORRESPONDENCE Mayor Harrison read two letters from James Byrd commending the Police and Fire Departments for their action taken during a rescue involving a skindiver at the waterfront. COUNCIL PARTICIPATION Councilman Tuson made a motion, seconded by Councilman Sanborn that September 26, 1970 be set as "Rube Grimstad Day" in the City of Edmonds. Motion carried unanimous- . ly. Councilman Sanborn had a question on a newspaper.article he had read in regard to :federal funds for parking in downtown areas and wanted to be sure that.Edmonds would receive its share of any available monies that the city qualified for. Councilman Tuson had a question on any recent developments regarding the sewer agree - went with Mountlake Terrace. City Engineer Larson reported that Engineer Jim Reid had given the new agreement to Mountlake Terrace and was now preparing some addition- al information Mountlake Terrace had requested. -Councilman Haines commented that Councilman Nordquist was interested in the status of the work at this time on 76b. Councilman Haines also asked.if Mayor Harrison would contact the president of the Meadowdale Community Club, who would like to discuss sale of the club to the City. Councilman Nelson asked if the 91h Avenue property owners would be able to obtain underground wiring estimates from the PUD and Telephone Co. AUDITING OF BILLS A motion was made by Councilman Haines, seconded by Councilman Nelson that voucher #63 in the amount of $2,202.71 to Tri-State Construction, Inc.,for semi-final estimate #4 on watermains and sewers on Bowdoin and Walnut, and voucher #64 in the amount of $678.95 to Dept. of Housing and Urban Development for seventh partial re- payment of advance for College Place joint stormzsewer construction be approved for payment out of 1967 Water -Sewer Revenue Bond Issue. Motion carried. A motion was made by Councilman Haines, seconded by Councilman Nelson that the • following LID bills be approved for payment;; 114 LID #161 - $5.10 to Edmonds City Treasurer for filing fee;; • LID #164 - $6,9o9.00 to Ewing Electric, Inc. for contractor's estimate #5, and the City Clerk be authorized to issue interest bearing warrants to Grande & Co., Inc. in the same amount to cover this bill; LID #167 - $lo,o64.34 to United Pacific Insurance Company for the balance owed the contractor, pursuant to1Attorney's agreement; $12.95 to Edmonds Tribune Review for legal publications; and the City Clerk be authorized to issue an interest bearing warrant to City of Edmonds in the amount of $2,758.32 to cover these bills, which .-is minus the amount of $7,318.97 previously written on warrants to Western Sewer & Construction, Co., and later voided when United Pacific took over following Western's bankruptcy; LID #173 - $101.43 to Norm's Print Shop for pointing bonds and $9.20 to Edmonds Tribune Review for legal publications; LID #176 - $2.00 to Edmonds City Treasurer for filing fee and the City Clerk be authorized to issue an interest bearing warrant to City of Edmonds in the same amount to cover this bill; LID #177 - $450.00 to Reid, Middleton & Associates, Inc. for engineering interim billing A; LID #179 - $1200.00 to James A. Murphy for legal services and the City Clerk be authorized to issue an interest bearing warrant to City of Edmonds in the same amount to cover this bill;; LID #182 - $31.20 to Edmonds Tribune Review for legal publications and the City Clerk be authorized to issue an interest bearing warrant to City of Edmonds in the same amount to cover.. Motion carried.. It was moved by Councilman Haines' seconded by Councilman Tuson that vouchers #11,315 through # 11,473 in the total amount of $206,778.39 be approved and the City Clerk be authorized to issue warrants from the proper funds in payment of these regular monthly bills. Motion carried. CLAIMS FOR DAMAGES A claim for damages was acknowledged from Francis G. Holt, and referred to the City Clerk for processing. Councilman Sanborn suggested that discussion of claims be taken up at a council work meeting. RESOLUTION COMMENDING JONATHAN BROOKS A motion was made by Councilman Tuson,-seconded by Councilman Haines that proposed Resolution #230 be -passed, commending Jonathan Brooks for his services to the City of Edmonds while a member of the Planning Commission and Board of Adjustment. Motion carried. IMPLEMENT NEEDS OF PRIOR REPORT CONCERNING PUBLIC WORKS It was moved by Councilman Nelson, seconded by Councilman Slye that the City Council confirm the proposed plan of organization which establishes a separate Public Works Department and a separate Engineering Department as described on pages 19 and 20 of the Prior Report. Mayor Harrison then listed five reasons why he, the Chief Administrative Officer, and the City Engineer felt that this should not be done; that the Public Works.Department should remain under the responsibility of the City Engineer. There was a great deal of discussion on this matter, and Councilman Slye then withdrew his second to the motion. Councilman Haines then,seconded the motion rAade by Councilman Nelson, and a roll call vote showed Councilmen Nelson and Haines in favor; Sanborn, Tuson and Slye against, and the motion failed to carry. This matter will also be referred to a council work meeting. 0 SET HEARING DATES FOR PLANNING COMMISSION RESOLUTIONS A motion was made by Councilman Nelson, seconded by Councilman Slye that Planning Commission Resolutions #337 and #338 be set for hearing before council on Oct. 6. Motion carried. It was moved by Councilman Nelson, seconded by Councilman Slye that Planning Com- mission Resolutions #339, #340, and #341 also be set for hearing before council on October 6. Motion carried. SET DATE FOR HEARING ON FINAL ASSESSMENT ROLL - LID #164 A motion was made by Councilman Slye, seconded by Councilman Tuson that the final assessment roll hearing for LID #164,-Units 5 & 6 sewers, be set for October 20. Motion carried.. APPROVAL OF MINUTES Minutes of the meeting of September 15 had been posted and mailed, and with no omissions nor corrections, they were approved as written. ORDINANCE TO LEVY TAXES FOR 1971 A motion was made by Councilman Tuson, seconded by Councilman Slye that Ordinance 1498 be passed -levying the general taxes for the City of Edmonds for the fiscal year commencing January 1, 1971- Motion carried. Councilman Sanborn asked that the budget stay within the confines of millage allowed. HEARING:: FINAL ASSESSMENT ROLL - LID # 16 - PAVING FORSYTHE LANE 5% to 61h There was no one in the audience attending this hearing and Councilman Slye was the only interested party. Engineer Larson explained the construction and cost. He explained that the City participation was $31,064.59 instead of $15,912.00 as extimated. The right-of-way acquisition made an appreciable change. Councilman Slye asked about the condition of the sidewalk'and was told by the engineer the sub- contractor would replace the sidewalk in question as soon as he receives his money from the bonding company. Hearing was closed. A motion was made by Councilman Haines, seconded by Councilman Nordquist that Ordinance 1499 be passed approving and confirming the final assessment roll of LID 167. Motion carried with Councilman Slye abstaining. HEARING: ON PLANNING COMMISSION RESOLUTION #337 - RECOMMENDING AMEND- MENT TO ZONING MAP TO REZONE FROM RS-8A TO CG PORTION OF BRANDT PROPERTY ON NORTH SIDE OF LAKE BALLINGER WAY JUST EAST OF PUD R/W. City Planner Merlin Logan explained this property was across from Aurora Village Shopping Center and that this land will be split by the future SR104. He stated that because of limited access it will not be condusive to strip zonging of commercial. He stated that property would be isolated and that the Planning Commission believed it should be zoned commercial. It w4s noted that a rezone would in ne way raise the price of the property to -the state as it has already been appraised by them. This rezone is only being asked for one small corner of the property. • The part to the north remaining after the acquisition by the state is 'not considered in the rezone. It was moved by Councilman Slye, seconded by Councilman Nelson that Ordinance 1500 be passed amending the official zoning map of Edmonds by changing the zoning classification of certain property from single family residential 8,000 square feet to general commercial, pursuant to Planning Commission Resolution No. 337. Motion carried unanimously. HEARING: ON PLANNING COMMISSION RESOLUTION #338 - RECOMMENDING CERTAIN PROPERTIES NORTH OF K-MART WHICH ARE PRESENTLY UNDER JURISDICTION OF SNOHOMISH COUNTY BE REZONED CG AND RML IN EVENT SUCH PROPERTIES ARE ANNEXED TO THE CITY OF EDMONDS. Planner Logan explained that the Planning commission had carried out`a pre -zoning on 7 acres, but that the Mathay property, approximately 2.9 acres was annexed recently. City Attorney Murphy said'the Council does not really havea problem as this condition is not spelled out in the laws. He said that holding hearings on the remaining property would prove nothing as it would be identical to the original hearing. The remaining part of the original 7 acres would be pre -zoned by the City. A motion was made by Councilman Haines, seconded by Councilman Slye that Ordinance 1501 be passed amending official zoning map of the City of Edmonds be adopting the zoning classification for certain property, newly annexed,:to General Commercial and Multiple Residential, Low Density, pursuant to Planning Commission Resolution No. 338. 0
