MOTION CARRIED. - REPORT ON BIDS OPENED SEPTEMBER 10 - CONCRETE PIPE AND APPURTENANCES Herb Gilbo, Director of Public Works, reported that the City Clerk opened bids on September loth; and that only one bid was received. The bid was submitted by Associated Sand &,Gravel Company, Inc.; and Mr. Gilbo stated that it was a favorable bid and requested council authorization to accept bid. COUNCILMAN NORDQUIST-MOVED, SECONDED BY COUNCILMAN ANDERSON TO ACCEPT THE LOW BID OF ASSOCIATED SAND'AND GRAVEL FOR THE ABOVE -MENTIONED ITEM, MOTION CARRIED, REQUEST TO CALL"FOR BIDS FOR SALE OF CITY -OWNED VEHICLES Herb Gilbo requested council approval to call.for bids for the sale of two Dodge Polaras and one Ford Station Wagon, COUNCILMAN NORDQUIST MOVED, SECONDED BY COUNCILMAN ANDERSON TO CALL FOR BIDS ON.CITY-OWNED VEHICLES ON THE 3RD OF OCTOBER. MOTION CARRIED, SNOHOMISH COUNTY DISTRICT COURT - INDIGENT DEFENDANTS M.A.A. Ron Whaley reported that he had a recommendation that the city employ the firm of Jones and Young as defense attorneys for indigent.defendants at. the firm's quoted cost of $42.00 per case through the calendar year 1975. He stated that this has become necessary because of a Supreme Court decision handed down approximately two years ago which entitled every person legal MOTION. counsel in any case which might `result in a jail sentence, COUNCILMANGELLERT MOVED, SECONDED BY COUNCILMAN NORDQUIST TO ACCEPT THE RECOMMENDATION OF THE • STAFF IN EMPLOYING THE FIRM OF JONES & YOUNG AS DEFENSE ATTORNEYS FOR INDIGENT DEFENDANTS, MOTION CARRIED, Mr. Whaley recommended that the council study the second portion of the written report as far as the budget is concerned. He suggested that council members could call Chief Foster,. John Wallace or himself for further information. MOTION: COUNCILMAN GELLERT MOVED, SECONDED BY COUNCILMAN WINTERS TO SET THIS MATTER FOR DISCUSSION ON OCTOBER 29TH. MOTION CARRIED, KING-SNOHOMISH'COUNTY MANPOWER CONSORTIUM - AUTHORIZATION FOR MAYOR TO SIGN AMENDED AGREEMENT Ron Whaley reported that in May of 1973 the City entered into an Interlocal Agreement with King and Snohomish Counties for the purpose of being a member of the above organization. On December 28, 1973 the President signed into law the Comprehensive Employment and Training Act (CETA). Subsequent implementation regulations issued by the Department of Labor, necessitates an amendment to the MOTION: initial agreement. He asked authorization for the Mayor to sign this. A MOTION WAS MADE BY COUNCILMAN NORDQUIST AND SECONDED BY COUNCILMAN ANDERSON TO AUTHORIZE THE MAYOR TO SIGN THE AMENDED AGREEMENT. MOTION CARRIED; FINANCIAL STATUS REPORT DISCUSSION Ron Whaley reported briefly on the City Financial Status, A written report had been submitted to the council members; which revealed the the city financial status of the city is looking better than it did two months ago. CLAIMS FOR DAMAGES • Council acknowledged -receipt of a Claim for Damages from C. W. and Martha Anderson. This was referred to the City Clerk's Office for processing. Ron Whaley stated that the cost estimates for Seaview and Sierra Parks had been revised due to a rise in costs. He recommended re -submittal to the IAC. Council concurred in this recommendation. HARVE HARRISON, Mayor September 24, 1974 ROLL CALL The regular meeting of. the Edmonds City Council was called to order -at 7:30 P.M. by Mayor Harve Harrison, with all council members present. APPROVAL OF MINUTES The minutes of the meeting of;September 17th had been posted, mailed and distributed.. Councilman Anderson mentioned that the minutes did not state thet Councilman Nelson's motion to re-oonsider. . . on the first page, was • voted upon and carried. The minutes were then approved as corrected. 182 COUNCIL PARTICIPATION MOTION: MOTION: Councilwoman Shippen asked if appraisals have been received on the Elm Street property. Engineer Larson replied that they were all in, and that he will be bringing them to council for action at a later date. Councilman Welling asked what had been done with regard to writing letters to people who had not connected to sewers. Herb Gilbo reported that -approximately 305 letters had been sent out and that they have had very good results, and that everything should be resolved by the first week in November. Councilman Gellert mentioned a.letter which had been received from a Mr. Ben Spaulding regarding the interception of his son, -while riding a trail bike, by the Edmonds Police Department. Chief Foster briefly explained the circumstances, stating -that there was some mis-communication in the matter. Councilman Gellert mentioned that the bicycle path being conttructed on Olympic View Drive is above street grade and wondered why this is. Engineer Larson stated that they had considered this safer since it will be used for bicycle riders and as a pedestrian walkway. He said that the curbing would be painted white so that there will be a clear line of demarcation between bicycle -pedestrian use and the vehicle use. Mayor Harrison read a letter which had been received from Metro Transit informing the city that the operating costs forcpUblic transportation service provided by Metro to Edmonds by contract will be increased, effective November 1, 1974. Their union contract has not been settled as yet, and therefore, they do not know exactly what the rate change will bes AUDIENCE PARTICIPATION Mrs. Meeks, 511 Walnut, spokeffor a group of her neighbors regarding the establishment of a Conquest Center for the counseling and rehabilitation of persons with drug and alcoholic problems. Mrs. Meeks and several other people had attended the Board of Adjustment Meeting on September 23rd, at which meeting the Conquest Center was granted Conditional Use Permits to operate at 6th and Walnut. Mrs. Meeks and other persons expressed displeasure and concern with this ruling. Attorney Wallace, who had attended the Board of Adjustment Meeting, pointed out.that the Board had used several of the suggestions from the audience as conditions for the issuance of the Conditional Use Permits. There was a great deal of discussion, and a MOTION WAS MADE BY COUNCILMAN GELLERT AND SECONDED BY COUNCILWOMAN SHIPPEN THAT COUNCIL REFER TO THE PLANNING COMMISSION THE EVIEW OF THE CITYCODES WITH REGARD TO SOCIAL REHABILITATION CENTERS AND CONDITIONAL USES. MOTION CARRIED. CORRESPONDENCE The DEputy City Clerk stated that the City Clerk's Office had received a Petition for Street Vacation in the vicinity of Andover Street, which had been signed by four property owners. The City Clerk's Office had checked the petition for both sufficiency and validity of signatures, and asked that council acknowledge receipt of said petition. COUNCILMAN NORDQUIST MOVED, SECONDED BY COUNCILMAN NELSON TO ACKNOWLEDGE RECEIPT OF THE PETITION FOR STREET VACATION AND TO SET NOVEMBER 5TH AS THE DATE FOR HEARING ON SAID PETITION: AND TO INSTRUCT THE ATTORNEY TO PREPARE A RESOLUTION FOR NEXT MEETING SETTING THAT HEARING DATE. MOTION CARRIED. 1 REQUIREMENTS OF SECTION 2089 FEDERAL WATER POLLUTION CONTROL ACT- CONSIDERATION OF DESIGNATING SNO-MET AS DESIGN AGENCY. (PRESENTATION BY GEORGE SHERWIN, COUNTY PLANNING DEPT.) City Engineer Leif Larson, stated that recently the Governor has designated King County Metro as the planning agency for the Green River -Cedar River Area within King County, excluding any of the area that is in Snohomish County. He said -the question now is whether the designation should be applied for by Snohomish County, and what agency should be that planning agency under the 208 Section of PL 9.2-500. Mr. George Sherwin, presented a Section 208 Information Packet, prepared by the Snohomish -County Planning Department, to the Mayor, council and staff. He stated that Thursday night the Metro Council will be presenting to the Association of Cities the issue of requesting the Governor to designate Sno-Met as the representative body for Section 208 within Snohomish County. This information, he said, is being presented so that an intelligent decision can be made as to whether we do or do nbt wish to designate Sno-Met as the representative body. (A copy of this presentation is on file in the City Clerk's Office). Mayor Harrison urged that as many persons as possible attend the Thursday night meeting. STREET USE PERMIT REQUEST BY HOLY ROSARY PARISH FOR INTERCOMMUNICATIONS SYSTEM CROSSING 7TH AVENUE BETWEEN DALEY AND GLEN STREETS. DISCUSSION AND REPORT RE/URBAN'SYSTEM FOR SNOHOMISH COUNTY City Engineer, Leif Larson, presented a resume to the council, which had been prepared by thdoPuget Sound Governmental Conference relative tottbe Federal Aid Highway Act of 1973,.concerning the Federal Aid Urban "FAM" System. Mr. Larson stated that cities with populations over 100,000 or with city -owned and operated transit systems, receive funds directly, so that they establish their own priorities for expending the funds. Mr.'Larson stated that he is uncertain at this time %whether the City of Edmonds would gain by receiving allocations direct based upon state.priorities; or allocations.based upon determinations made by SnoMet, if they were designated as the reviewing authority. He felt that two things should betdetermined first, ie. guidelines for priorities and allocations.in Snohomish County, and the selection of a technical staff to as the Board in determining' the -priorities. After some discussion, the Mayor recommended that this matter be taken under. advisement. APPROVAL OF MINUTES Minutes of the meeting of September 24th had been posted, mailed and distributed. Councilman Gellert stated that he would like the word "related" inserted in front of Conditional Uses in the last line on page 1. The minutes were then approved as corrected. COUNCIL PARTICIPATION Councilman Nelson referred the council to a memo from Rod Garretson regarding the acquisition of the ferry, San Mateo, for placement on the Edmonds waterfront. The vessel would be used as a historical interpretive center. The Washington State Parks Commission would like an indication of interest by the 7th of October, And a completed application by the 14th of October.. Following discussion, a MOTION WAS MADE BY COUNCILMAN'NELSON AND SECONDED BY COUNCILMAN GELLERT THAT THE'COUNCIL AUTHORIZE THE DIRECTOR OF PARKS AND RECREATION, ROD GARRETSON, TO PROCEED WITH COLLECTION OF THE DATA AND FILLING OUT AN APPLICATION FOR THE PROPOSED ACQUISITION OF THE SAN MATEO FERRY, AND PRESENT THAT APPLICATION AND THE FOLLOW-UP DATA AT THE,COUNCIL MEETING NEXT WEEK.. MOTION CARRIED. Councilman Nordquist stated that he had received a letter from Robert Woodruff, Superintendent of Edmonds School District, which suggests that he, the School Board & Edmonds City Council get together at an informal dinner for the purpose of sharing some goals and objectives of both parties. 'Mr. Woodruff suggested either a second or fourth,Monday night for such a meeting. All but two of the council members indicated they would prefer the fourth Monday night. Councilman Anderson asked about the status of the fountain at 5th and Main. Herb Gilbo replied that the pump is being re -built and new lights are being ordered. Councilman Anderson mentioned that he will be absent from the.October 15th meeting. Councilwoman Shippen asked what has transpired with the environmental impact study on 196th. City Planner, Joe Wallis, replied that they have had a response from four firms as to what kind of proposal they can submit for this study. Mr. Wallis said that the cost would be governed by the level of detail requested. He said . the cost will range between $2,500 and $10,000 depending upon that level of detail. Mr. Wallis will prepare an outline for submittal to these firms in order to get a more exact cost figure. r
