MOTION: COUNCILMAN CARNS.MOVED,-SECONDED BY COUNCILMAN CLEMENT, THAT THE ENGINEERING DEPARTMENT BE ALLOWED TO GO AHEAD WITH THE HIRING PROCESS TO COMPLETE THEIR PROGRAM FOR FY79 AND IF THEY HAVE ANY PROBLEM FUNDING THAT THEY RETURN TO THE COUNCIL. MOTION CARRIED. MOTION: MOTION: APPROVAL IN PRINCIPLE FOR ACCEPTING WASTEWATER FROM WOODWAY PARK IN EDMONDS TREATMENT FACILITY Public Works Director Leif Larson indicated by.memorandum that the Town of Woodway is working on the details of an agreement with Edmonds concerning sewage disposal for Woodway Park, the new development at the north end of Woodway. Pending resolution of the details, the developer was anxious to have approval in principle so that he could proceed with construction of dry sewers during favorable weather conditions. He agreed to absorb all costs should the final agreement not be consummated and he agreed that this approval would be without prejudice. All necessary permits for the portion of the work done in Edmonds would be obtained through normal channels, again without prejudice. Mr. Larson indicated that the logical flow path for sewage disposal would be to the Edmonds Wastewater Treatment Plant and he felt that an agreement eventually would be reached, so he recommended.the approval in principle be granted. COUNCILMAN CARNS MOVED, SECONDED BY COUNCILMAN NORDQUIST, TO GRANT THE APPROVAL IN PRINCIPLE FOR ACCEPTING WASTEWATER FROM WOODWAY PARK IN THE EDMONDS TREATMENT FACILITY. MOTION CARRIED. It was announced that a short Executive Session would follow this meeting regarding the condemna- tion proceedings on the Edmonds Elementary School property. HARRISON, Mayor The regular meeting of the Edmonds City Council was called to order at 7:35 p.m. by Mayor Harve Harrison in the Council Chambers of the Edmonds Civic Center. Resolution 600, recommending approval of proposed amendment to the Zoning Code, Comprehensive Policy Plan, and the Shoreline - Management Master Program to change the permitted uses and development regulations in the CW zone and Shoreline Management Master Program and to add waterfront and walkway designs policies to Section 208 of the Comprehensive Policy Plan. COUNCIL Councilman Clement advised he would be absent September 5 as he will be attending a State Transit Operators Convention at Ocean Shores. 1 1 1 171 2 6 T. • August-29, 1978 - continued MAYOR Mayor Harrison introduced Jim Adams who has been hired as the new Assistant City Engineer. Mayor Harrison asked the City Attorney to report on the General Telephone litigation. Mr. Wallace reported that an opinion had been received from the Court of Appeals ruling in favor of the City of Edmonds on all points raised by General Telephone. He said their only recourse now is to ask the Court of Appeals for reconsideration or ask for discretionary review by the.State Supreme -.Court. He said neither is an appeal of right and only if the court finds that there are issues that should be readdressed would they get reconsideration, and with the Supreme Court only if the question involves constitutionality of major proportions would the Supreme°:'.Court agree to take it. REVIEW OF POLICY PLAN SECTIONS 208 (BEAUTIFICATION AND URBAN DESIGN) AND 209 (NOISE POLLUTION) Community Development Director John LaTourelle initiated the discussion with comments as to how these sections of the Policy Plan are being implemented. He noted that the recently adopted Sign Ordinance has addressed the goals and policies stated for signs. He said the ADB presently is on the line trying to define "residential concept." Further, he noted that the Policy Plan calls for smaller buildings and a close-knit feeling of the downtown area, but that is as far -'as it goes,:so the ADB is in the uncomfortable position of having to determine what these guidelines mean. He said he did not know how to give them guidance. The subject of the Highway 99 area arose and he said there is no simple way to repair what has been done there in the past. It was suggested that sidewalks and trees could improve Highway 99 and even though Edmonds only has jurisdiction of the western half of that area, it was commented that the Lynnwood City Council is most interested in improving their portion. A reference was made to what the City of Everett had done to Colby Ave. which had greatly improved its appearance. It was suggested that perhaps higher buildings could be allowed on Highway 99 in exchange for some of the desirable amenities and that the Policy Plan may need a revised section on the Highway 99 concept. It was suggested that the other necessary • boards should get together on this and there probably could be a Policy Plan change before the Development Control Ordinance is brought forward. Another concern was the BN areas of Five Corners and Westgate and Mr. LaTourelle said the best they could offer was that they are starting to work on the area that probably will affect them most --that of regulations. He said they are contemplating setting up some workshops to go over the Policy Plan areas. In summary, Mr. LaTourelle said some big inroads had been made --the Sign Ordinance, waterfront policies, proposed changes in the water- front zone, and increased activity on the part of the ADB. Regarding Section 209 on Noise Pollution, he said it was simply a matter of enforcement and it takes people and equipment to enforce. He noted that noise is the number one neighborhood complaint. When asked whether noise can be diffused or absorbed, he replied that distance and solid walls are the only effective ways to control noise, and that it is a mistaken theory that trees and bushes will do so. It did not appear that much could be accomplished in this area without additional people and equipment, but it was agreed that when citizens complain there should be a response from the City forces, especially the Police Department. FURTHER CONSIDERATION OF SECONDARY TREATMENT PLANT City Engineer Fred Herzberg said the options regarding the treatment plant were (1) to move the entire plant, or (2) to expand it at the present site; and EPA will pay 75% of what they feel is a cost effective solution to the problem, the State will pay 15%, and the cities and districts involved will pay the balance, Edmonds paying 5%. He said if the decision is to move it from the Dayton to the Pine location an environmental impact statement would be requi°"red, the cost being totally that of Edmonds. He said an environmental impact statement would cost about $10,000. He distributed copies of letters from entities involved, which he said generally recommended keeping the plant where it is and expanding it. Councilman Naughten commented that the neighbors of the plant seem to feel the present site is not offensive, at least as compared to what they feel may be constructed in its place. 'He felt that seemed to be the logical choice and there was general agree- ment. Councilman Gould commented that the existing site could be developed and taken care of MOTION: environmentally'for odor, noise, and visual pollution. COUNCILMAN GOULD MOVED, SECONDED BY COUNCILMAN • NAUGHTEN, THAT THE CITY ADOPT THE SECONDARY TREATMENT PLANT .SITE AS BEING EXPANSION OF THE PRESENT SITE. MOTION CARRIED. Stan Olsen of 16605 74th P1. W. asked to speak and referred to the Metro study being conducted which has shown no deleterious effect from discharge of primary effluent for one-half mile, and he noted that they may get a waiver. Public Works Director Leif Larson responded that if Metro gets a waiver the City of Edmonds will apply for one. Allen deSteiguer of Reid, Middleton & Associates said that the latest information they have is that the EPA will back off of the September deadline and will require a letter of intent, but the guidelines still require best treatment by 1983. Also, he said even if an application is put in there is no guarantee that a waiver will be given. He added that Edmonds was very far down the,last priority list he saw for State funding.
