his/her own representation with respect to any
such claim or litigation, then all of the provi-
sions of this chapter shall be inapplicable, and
have no force or effect with respect to any such
claim or litigation. [Ord. 2535, 1985].
2.06.070 Reimbursement of incurred
expenses.
A. If the city determines that an official or
employee does not come within the provisions
of this chapter, and a court of competent juris-
diction later determines that such claim does
come within the provisions of this chapter, then
the city shall pay any judgment rendered
against the official or employee and reasonable
attorneys' fees incurred in defending against
the claim. The city shall pay any attorneys' fees
incurred in obtaining the determination that
such claim is covered by the provisions of this
chapter.
B. If the city determines that a claim against
a city official or employee does come within
the provisions of this chapter, and a court of
competent jurisdiction later finds that such
claim does not come within the provisions of
this chapter, then the city shall be reimbursed
for costs or expenses incurred in obtaining the
determination that such claim is not covered by
the provisions of this chapter. [Ord. 2535,

2.06.080 Conflict with provisions of
insurance policies.
Nothing contained in this chapter shall be
construed to modify or amend any provision of
any policy of insurance where any city official
or employee thereof is the named insured. In
the event of any conflict between this chapter
and the provisions of any such policy of insur-
ance, the policy provisions shall be controlling;
provided, however, that nothing contained in
this section shall be deemed to limit or restrict
any employee's or official's right to full cover-
age pursuant to this chapter, it being the intent
of this chapter and section to provide the cov-
erage detailed in this chapter outside and

beyond insurance policies which may be in
effect, while not compromising the terms and
conditions of such policies by any conflicting
provision contained in this chapter. [Ord. 2535,

2.06.090 Pending claims.
The provisions of this chapter shall apply to
any pending claim or lawsuit against an offi-
cial or employee, or any such claim or law suit
hereafter filed, irrespective of the date of the
events or circumstances which are the basis of
such claim or law suit. [Ord. 2535, 19851.

2.10.010 Confirmation process.
A. Whenever a vacancy occurs in one of the
positions listed in this section, the city council
will review the specifications of that position
and revise it as needed before the vacancy is
filled.
B. The mayor or his/her designee will
review all applications and determine the per-
sons with the highest qualifications. Any city
council member, upon request to the mayor,
may review the applications received for the
vacant position.
C. The mayor shall appoint, subject to city
council confirmation, the positions of judge,
hearing examiner, police chief, fire chief, com-
munity services director and administrative

services director. The city council shall inter-
view the top three candidates for each position
prior to the mayor's final selection.
D. The mayor shall appoint, subject to
council confirmation, the positions of city
engineer, planning manager, parks and recre-
ation director, public works director, and
human resources director. The city council
will interview only the person that the mayor
selects for appointment. [Ord. 3171 § 1, 1997;

2.10.020 Director of administrative
services.
There is created the office of director of
administrative services which shall be filled by
appointment by the mayor, subject to confir-
mation by the city council. The director of
administrative services shall serve at the plea-
sure of the mayor and shall be the administra-
tive head of the department of administrative
services. [Ord. 2443, 1984].
2.10.025 Director of administrative
services — Duties.
In addition to other duties assigned by the
mayor, the director of administrative services
shall have the following duties:
A. Under the general direction of the mayor
the director shall plan, organize and direct the
financial, data processing, and record service
functions of the city. In addition, the director
shall:
1. Administer the insurance and risk
management program;
2. Organize and direct the activities of
the administrative services department;
3. Through the division of the account-
ing manager, oversee and direct the mainte-
nance of financial operations;

4. Through the division of data process-
ing and programming, oversee and direct the
maintenance of information processing opera-
tions;
5. Through the division of the city clerk,
oversee and direct the maintenance of record
service operations. In the absence of the city
clerk, any duty prescribed by law to be per-
formed by the clerk shall be performed by the
administrative services director;
6. Approve all selections, transfers, pro-
motions, performance evaluations and termi-
nation of employees assigned to the
department. These functions shall be con-
ducted for and on behalf of the respective divi-
sion managers;
7. Advise the mayor, managerial staff
and city council regarding budget preparation
process, the consequences of fiscal alterna-
tives and the presentation and recommenda-
tion of options in those regards;
8. Assure through his/her function as
insurance and risk manager that risks and
losses are minimized, insurance coverage is
adequate and properties of the city are properly
insured;
9. Approve purchases of materials, ser-
vices and equipment where the cost exceeds
the amount referenced in the city's purchasing
manual and is less than that established for
statutory bidding procedures by state law;
10. Assure the maintenance and opera-
tion of all real properties of the city; and
11. Serve on the Fireman's Pension
Board, the Municipal Employee Benefit Trust
Committee, and other organizations as deter-
mined by the mayor. The director shall main-
tain contact with other jurisdictions and the
private sector in regard to fiscal matters.
B. Any reference made in these ordinances
to duties assigned or the responsibility of the
finance director or treasurer shall be construed
to refer to the director of administrative ser-
vices or his/her designee. [Ord. 2863 § 5, 1992].

2.10.027 Director of community services.
There is hereby created the office of director
of community services which shall be filled by
appointment by the mayor, subject to confir-
mation by the city council. The director of
community services shall serve at the pleasure
of the mayor and shall be the administrative
head of the department of community services,
such department to be comprised of the engi-
neering division planning division and waste-
water treatment plant. [Ord. 3171 § 2, 1997;
Ord. 2863 § 6, 1992; Ord. 2442, 1984].
2.10.028 Director of community services —
Duties.
A. In addition to any other duties assigned
by the mayor, the director of community ser-
vices shall have the following duties:
1. Execute the decisions of the mayor
and city council relating to departmental
responsibilities and provide overall manage-
ment for engineering division, planning divi-
sion and wastewater treatment plant. The
director shall report to the mayor as a member
of a management team that reviews and devel-
ops policies and procedures for the improve-
ment of city operations and functions;
2. Direct overall division operations,
including engineering, the treatment plant and
planning activities;
3. Be ultimately responsible for making
budget proposals and requests and controlling
department expenditures and receipts for the
divisions of the community services depart-
ment;
4. To manage through division manag-
ers the operations of the divisions including
the determination, assignment and supervision
of employee workloads, provision for appro-
priate training, conduct of employee perfor-
mance evaluations of division managers, and
effective recommendation of formal personnel
actions to the mayor including hiring, firing,
disciplinary measures, salary adjustments, and
promotions;

5. Advise the mayor, city council,
department directors, division managers and
others on engineering, planning, wastewater
treatment and related matters;
6. Develop systems, procedures and
practices applicable to the affected functions;
7. Be ultimately responsible for profes-
sional and comprehensive planning and to pro-
pose changes and updates of the
comprehensive policy plan map and commu-
nity development code;
8. Prepare and recommend capital im-
provement programs;
9. Monitor engineering aspects of city
contracts and oversee the preparation of con-
tracts for consulting services or construction;
and
10. Supervise and support the city's
safety program through the divisions which
the director supervises.
B. Any reference made in these ordinances
to duties assigned to or the responsibility of the
director of public works shall be construed to
refer to the director of community services or

2.10.030 Police chief.
Pursuant to the authority of RCW
41.12.050, the position of police chief has been
removed from civil service. The police chief
shall be appointed by the mayor subject to con-
firmation by majority vote of the city council.

2.10.031 Fire chief.
Pursuant to RCW 41.08.050, the position of
fire chief has been removed from civil service.
The fire chief shall be appointed by the mayor

2.10.034 City engineer.
There is created the office of city engineer,
which shall report to the community services
director. This position shall be filled through
the recommendation of the community ser-
vices director and the appointment by the
mayor, subject to confirmation by the city
council and who shall serve at the pleasure of
the mayor. The city engineer shall be in charge
of the engineering division and shall perform
such other duties as may be assigned. [Ord.
2863 § 8, 1992; Ord. 2227 § 3, 1981].
2.10.035 Planning manager.
A. There is created the office of the plan-
ning manager, which shall report to the com-
munity services director. This position shall be
filled through the recommendation of the com-
munity services director and appointment by
the mayor, subject to confirmation by the city
council.
B. The planning manager shall direct the
planning division in addition to such other
duties as may be assigned.
C. The planning manager shall have the
customary duties of the city planner, including
but not limited to advising and making recom-
mendations to the city council, planning advi-
sory board, and such other boards and bodies
within the city of Edmonds requesting and
needing assistance; consulting with and advis-
ing other city officials regarding planning mat-
ters and coordination of the inter -related parts
thereof with primary emphasis on various
comprehensive plans of the city, zoning, plan-
ning and subdivision, comprehensive street
plans, utilities and park development; and such
other matters as from time to time may be
directed by the city council and/or the mayor.

2.10.036 Public works director.
A. There is hereby created the office of the
director of public works which shall report to

2.10.043 Salary.

2.10.044 References to director of
community development.
Wherever references are made in the
Edmonds City Code or any ordinance of the
city to the director of community develop-
ment, said reference shall hereafter be con-
strued to mean the planning department

2.10.050 Parks and recreation director.
A. There is hereby created the office of the
parks and recreation director which shall

direct the parks and recreation department, in
addition to such other duties as may be

2.10.055 Human resources director.
A. There is hereby created the office of the
human resources director which shall report to

B. The human resources director shall plan,
supervise and coordinate all personnel pro-
grams and personnel matters of the city, in
addition to such other duties as may be

2.10.070 Council resource person.
The council resource person shall be a con-
tract employee hired on an annual basis by the
city council. The terms and conditions of
employment for the council resource person as
well as all benefits shall be governed by the
provisions of the contract. The contract shall
provide for the delegation by the mayor of the
direction of this individual to the city council
president. In the event that the mayor elects in
his or her discretion not to delegate that func-
tion, the council reserves the right to immedi-
ately eliminate the position. [Ord. 2870 § 1,

2.10.080 Mayor's executive secretary.
The position of mayor's executive secretary
shall be an at -will position with the executive
secretary serving at the pleasure of the mayor.
The salary for the position is established by the
annual salary ordinance. The terms and condi-
tions of employment as well as job duties
being set forth in a job description developed
by the mayor with the concurrence of the city

2.15.010 Court established.
There is hereby established a municipal
court entitled "The Municipal Court of the city
of Edmonds," hereinafter referred to as
"municipal court," which court shall have
jurisdiction and shall exercise all powers enu-
merated herein and in Chapter 3.50 RCW
together with such other powers and jurisdic-
tion as are generally conferred upon such court
in this state either by common law or by
express statute. [Ord. 2538 § 2, 1985].
2.15.020 Jurisdiction.
The municipal court shall have exclusive
original jurisdiction over traffic infractions
arising under city ordinances and exclusive
original criminal jurisdiction of all violations
of city ordinances duly adopted by the city of
Edmonds. The municipal court shall have orig-
inal jurisdiction of all other actions brought to
enforce or recover license penalties or forfei-

tures declared or given by such ordinances or
by state statutes. The municipal court shall also
have the jurisdiction as conferred by statute.
The municipal court is empowered to forfeit
cash bail or bail bonds and issue execution
thereon; and in general to hear and determine
all causes, civil or criminal, including traffic
infractions, arising under such ordinances and
to pronounce judgment in accordance there-
with. [Ord. 2538 § 2, 1985].
2.15.030 Judges — Appointment —
Qualifications.
A. The municipal judge shall be appointed
by the mayor for a term of four years, subject
to the confirmation by the city council. -The
first judicial appointment to the position of
mayor was effective on January 1, 1986, and
the municipal judge shall serve a four-year
term commencing upon the date of his or her
appointment. The mayor shall endeavor to
make his or her appointment 30 days prior to
the expiration of each judicial term; provided,
however, that if the city council fails to con-
firm a mayoral appointment, the mayor and
city council shall have 60 days commencing
upon either the expiration of the pending judi-
cial term or the failure of the city council to
confirm the mayoral appointment, whichever
shall later occur. In the event that for any rea-
son the mayoral appointment is not confirmed,
the incumbent municipal judge shall hold over
and continue in office until such time as a suc-
cessor is appointed.
B. A person appointed as municipal judge
shall be a citizen of the United States of Amer-
ica and of the state of Washington; and an
attorney admitted to practice law before the
courts of record of the state of Washington.

2.15.040 Salaries and costs.
The salary of the municipal court judge shall
be fixed by ordinance. All costs of operating
the municipal court; including but not limited
to salaries of judges and court employees,

dockets, books of records, forms, furnishings
and supplies, shall be paid wholly out of the
funds of the city. The city shall provide a suit-
able place for holding court and pay all ex-
penses of maintaining it. [Ord. 2538 § 2, 1985].
2.15.050 Municipal court employees.
All employees of the municipal court shall,
for all purposes, be deemed employees of the
city of Edmonds. They shall be appointed by
and serve at the pleasure of the municipal
judge. [Ord. 2538 § 2, 1985].
2.15.060 Judges pro tem.
The mayor shall, in writing, appoint judges
pro tem who shall act in the absence or disabil-
ity of the regular judge of the municipal court,
subsequent to the filing of an affidavit of prej-
udice, or during any period which is otherwise
vacant. The judge pro tem shall be qualified to
hold the position of judge of the municipal
court as provided herein. The judge pro tem
shall receive such compensation as shall be
fixed by ordinance. The term of the appoint-
ment shall be specified in writing but in any
event shall not extend beyond the term of the
appointing mayor. [Ord. 3170 § 2, 1997; Ord.
2538 § 2, 19851.
2.15.070 Judicial vacancy.
Any vacancy in the municipal court due to a
death, disability, or resignation of a municipal
court judge shall be filled by the mayor for the
remainder of the unexpired term. The appoint-
ment shall be subject to confirmation of the
city council. The appointed judge shall be
qualified to hold the position of judge of the
municipal court as provided in this chapter.

2.15.080 Municipal court hours.
The municipal court shall be open and shall
hold such regular and special sessions as may
be prescribed by the municipal court judge;

provided, that the municipal court shall not be
open on nonjudicial days. [Ord. 2538 § 2,

2.15.120 Deferral and suspension of
sentences.
Unless otherwise provided by state law, the
court shall have the following sentencing
authority:
A. After a conviction, the court may defer
sentencing and place the defendant on proba-
tion and prescribe the conditions thereof, but in
no case shall it extend for more than two years
from the date of conviction. During the time of
the deferral, the court may, for good cause
shown, permit a defendant to withdraw the
plea of guilty, permit the defendant to enter a
plea of not guilty, and dismiss the charges.
B. For a period not to exceed two years
after imposition of sentence, the court shall
have continuing jurisdiction and authority to
suspend the execution of all or any part of the
sentence upon stated terms, including install-
ment payment of fines.
C. Deferral of sentence and suspension of
execution of sentence may be revoked if the
defendant violates or fails to carry out any of
the conditions of the deferral or suspension.
Upon the revocation of the deferral or suspen-
sion, the court shall impose the sentence previ-
ously suspended or any unexecuted portion
thereof. In no case shall the court impose a sen-
tence greater than the original sentence, with
credit given for time served and money paid on
fine and costs.
D. Any time before entering an order termi-
nating probation, the court may revoke or
modify its order suspending the imposition or
execution of the sentence. If the ends of justice
will be served and when warranted by the ref-
ormation of the probationer, the court may ter-
minate the period of probation and discharge
the person so held. [Ord. 2538 § 2, 1985].

2.15.140 Complaints.
All criminal prosecutions for the violation
of a city ordinance shall be conducted in the
name of the city and may be upon the com-
plaint of any person. [Ord. 2538 § 2, 1985].
2.15.160 Pleadings, practice and
procedure.
Pleadings, practice and procedure in cases
not governed by statutes or rules specifically
applicable to municipal courts shall, insofar as
applicable, be governed by the statutes and
rules now existing or hereafter adopted gov-
erning pleadings, practice and procedure
applicable to district courts. [Ord. 2538 § 2,
1985].
2.15.180 Case transfers.
A transfer of a case from the municipal court
to either another municipal judge of the same
city or to a judge pro tempore appointed in the
manner prescribed by this chapter shall be
allowed in accordance with RCW 3.66.090 in
all civil and criminal proceedings. [Ord. 2538
§ 2, 19851.
2.15.200 Court seal.
The municipal court shall have a seal which
shall be the vignette of George Washington,
with the words "Seal of The Municipal Court
of Edmonds, State of Washington," surround-
ing the vignette. [Ord. 2538 § 2, 1985].
2.15.210 Removal of judge.
A municipal judge shall be removed only
upon conviction of misconduct or malfeasance
in office, or because of physical or mental dis-
ability rendering the judge incapable of per-
forming the duties of the office. Any vacancy
in the municipal court due to death, disability
or resignation of the municipal court judge
shall be filled by the mayor, for the remainder
of the unexpired term. The appointment shall
be subject to confirmation by the city council.
The appointed judge shall be qualified to hold

the position of judge of the municipal court as
provided in this ordinance and Chapter 3.50
RCW. [Ord. 2538 § 2, 1985].
2.15.220 Civil jury trials.
In all civil cases, the plaintiff or defendant
may demand a jury, which shall consist of six
citizens of the state who shall be impaneled
and sworn as in cases before district courts, or
the trial may be by a judge of the municipal
court; provided, that no jury trial may be held
on a proceeding involving a traffic infraction.
A party requesting a jury shall pay to the court
a fee which shall be the same as that for a jury
in district court. If more than one party
requests a jury, only one jury fee shall be col-
lected by the court. The fee shall be appor-
tioned among the requesting parties. Each
juror shall receive $10.00 for each day in atten-
dance upon the municipal court, and in addi-
tion thereto shall receive mileage at the rate
determined under RCW 43.03.060. [Ord. 2538

2.15.240 Criminal process.
All criminal process issued by the municipal
court shall be in the name of the state of Wash-
ington and run throughout the state, and be
directed to and served by the chief of police,
marshal, or other police officer of any city or
to a sheriff in the state. [Ord. 2538 § 2, 1985].
2.15.260 Revenue — Disposition.
A. Costs in civil and criminal actions may
be imposed as provided in district court. All
fees, costs, except those costs awarded to pre-
vailing parties under RCW 4.84.010 and RCW
36.18.040 or other similar statutes, fines, for-
feitures and other money imposed by any
municipal court for the violation of any munic-
ipal or town ordinances shall be collected by
the court clerk and, together with any other
revenues received by the clerk, shall be depos-
ited with the city or town treasurer as a part of
the general fund of the city or town, or depos-

ited in such other fund of the city or town, or
deposited in such other funds as may be desig-
nated by the laws of the state of Washington.
B. The city treasurer shall remit monthly 32
percent of the money received under this sec-
tion, other than for parking infractions, to the
state treasurer. Money remitted under this sub-
section to the state treasurer shall be deposited
as provided in RCW 43.08.250.
C. The balance of the money received
under this section shall be retained by the city
and deposited as provided by law. [Ord. 2538

elect to participate as a member of the state-
wide city employee's retirement system for
pension, relief, disability and retirement for
the employees of the city of Edmonds as pro-
vided by Chapter 41.44 RCW. It is the intent of
this chapter that only regular and full-time
employees and officers of said city shall be
included in said system; provided, however,
that other officers and employees of said city
may be included thereunder solely at the dis-
cretion of the city council; and provided, fur-
ther, that no elective official shall be included
unless said official so elects and files a written
notice of such election with the board of trust-
ees of said pension system and with the city

Whenever the city shall require the services
of a professional consultant, the responsible
city official or the consultant selection com-
mittee shall advertise the city's particular and
general requirements for professional consul-
tation services, shall interview, evaluate and

3.04.070 Purposes of travel expense
advance.
A travel expense advance shall be consid-
ered as having been made to a city official or
employee to be expended as an agent of the
city and for the city's purposes only, and spe-
cifically to defray necessary cost in the perfor-
mance of official duties. No such advance shall
be considered as a personal loan to such offi-
cial or employee and any expenditure thereof,
other than for official business purposes, shall
be considered a misappropriation of public
funds. [Ord. 2188 § 1, 1980].
3.04.080 Credit cards.
In accordance with the provisions of RCW
43.09.2855 as the same exists or shall hereafter
be amended authorizing political subdivisions
to use credit cards for official government
business, the finance director is hereby autho-
rized to obtain two credit cards from the city's
designated official bank with a limit of $5,000.
One card shall be assigned to the mayor for
expenses relating to city business; provided,
however, that the card shall not be used for the
purchase of goods or services. The other card
shall be assigned to the finance director for
safekeeping and control. The finance director
shall establish a credit card system for city
employees to use the credit card for costs asso-
ciated with registering for lodging. No other
cost or expenses, including actual expenses,
shall be incurred on the card under the finance

ment, and for the purchase of equipment,
materials and supplies to be used in the admin-
istration and operation of the fund. [Ord. 2568,

3.05.020 Administration.
The equipment rental fund shall be adminis-
tered by the administrative services director
under the direction of the mayor. [Ord. 2568,
1986; Ord. 1111 § 2, 1965].
3.05.030 Transfer of departments.
All equipment of all offices and depart-
ments of the city of Edmonds, except the fire
department pumpers and aid cars shall be
transferred to the equipment rental fund, with-
out charge. [Ord. 2568, 1986; Ord. 1111 § 3,
1965].
3.05.040 Placement of money.
Money may be placed in the fund from time
to time by the Edmonds city council. [Ord.

3.05.050 Use of the fund.
The city of Edmonds shall purchase and sell
all equipment, except for the fire department
pumpers and aid cars, by the use of such fund,
subject to the laws governing the purchase and
sale of property. Such equipment shall be
rented for the use of the various offices and
departments of the city and may be rented by
the city to other governmental agencies. [Ord.

3.05.060 Disposition of sale proceeds and
purchases.
The proceeds received by the city from the
sale or rental of such equipment shall be placed
in the equipment rental fund, and the purchase
price of any such equipment or rental pay-
ments made by the city shall be made from
monies available in the fund. [Ord. 2568,

3.05.070 Rental charges — Schedule.
There shall be paid monthly into the equip-
ment rental fund out of the monies available to
the department using any such equipment,
which has not been purchased by that depart-
ment for its own use and out of its own funds,
reasonable rental charges fixed by the city
council of the city of Edmonds by approval of
a schedule submitted at regular meetings of the
city council by the administrative services
director, which schedule shall be sufficient to
cover the maintenance, operation and replace-
ment of said equipment as set forth in ECC
3.05.010 herein, and which shall be revised
from time to time to maintain the schedule so
as to reflect the current and foreseeable needs
of the equipment rental fund. [Ord. 2568,

3.05.080 Accounts and records.
There shall be kept, by those directed by the
administrative services director, such books,
accounts and records as are necessary to con-

trol and report the financial operations of the
equipment rental fund, and shall further subdi-
vide the cash account thereof into two sepa-
rately designated accounts as follows:
A. Account "A", which shall be the "cur-
rent operating account" into which shall be
placed those portions of the charges made to
the various departments or offices of the city of
Edmonds, in accordance with the provisions of
ECC 3.05.070 hereof, which are specifically
billed to provide sufficient monies to pay the
salaries and wages, materials, overhead and
other costs necessary to operate and maintain
all property rented thereto. There shall also be
placed into Account "A" monies which may
from time to time be specifically available
thereto by action of the city council.
B. Account `B", which shall be the "equip-
ment reserve account" into which shall be
placed those portions of the charges made to
the various departments or offices of the city,
in accordance with the provisions of ECC
3.05.070 thereof, which are specifically billed
to provide sufficient monies, having first taken
into consideration the necessary operating and
maintenance costs billed under the preceding
subsection A, to pay the costs of purchasing
new equipment and replacing used equipment
as required to carry out the purpose of the
equipment rental fund. There shall also be
placed in the Account `B" monies which are
derived from the direct sale of any equipment
or other capital assets of the fund and any mon-
ies made specifically available thereto by

3.05.100 Manner of withdrawals and
expenditures.
Any withdrawals or expenditures from the
equipment rental fund shall be made only in
the following manner:
A. Expenditures from Account "A" shall be
made only upon duly approved payrolls and

place of business in the city.
B. No person to whom a license has been
issued, pursuant to this chapter, shall suffer or
allow any other person chargeable with a sep-
arate license to operate under or display his
license, nor shall such other person operate

3.20.200 Unlawful acts — Failure to apply
for license, false returns, etc.
It shall be unlawful for any person liable to
tax hereunder to fail or refuse to make applica-
tion or return for a license or to pay the fee or
tax or installment thereof when due, or for any
person to make any false or fraudulent applica-
tion or return or any false statement or repre-
sentation in or in connection with, any such
application or return, or to aid or abet another
in any attempt to evade payment of the fee or
tax or any part thereof, or for any person to fail
to appear and/or testify in response to sub-
poena issued pursuant hereto, and/or to testify
falsely upon the hearing of any appeal or upon
any investigation of the correctness of a return,
or in any manner to hinder or delay the city or
any of its officers in carrying out the provi-

3.20.210 Penalty for violations.
Any person violating or failing to comply
with any of the provisions of this chapter or
any lawful rule or regulation adopted by the
city clerk pursuant thereto, shall be deemed
guilty of a misdemeanor, and, upon conviction
thereof, shall be punished by a fine in any sum
not to exceed $250.00 or by imprisonment in
the city jail for a term not to exceed 90 days, or
by both such fine and imprisonment. Each and
every day that the violation of this chapter
shall be continued is a separate offense and

3.20.220 Severability.
If any provision or section of this chapter
shall be held void or unconstitutional, all other
parts, provisions and sections of this chapter,

3.34.020 County tax credit.
Pursuant to RCW 67.28.180(2)(a), any
county ordinance or resolution adopted pursu-
ant to Chapter 67.28 RCW shall contain a pro-

this chapter for the purposes of funding a multi -

3.34.070 Penalties.
Any person violating or failing to comply

any rule or regulation adopted by reference
herein, shall be guilty of a misdemeanor and
upon conviction thereof, shall be punished as

3.34.080 Severability.
If any section, subsection, clause, phrase or
word of this chapter or any provision adopted
by reference herein is for any reason held to be
invalid or unconstitutional by a court of com-
petent jurisdiction, such invalidity or unconsti-
tutionality shall not affect the remaining
portions of this chapter or any provision

3.34.090 Effective date of tax.
The tax herein levied shall be effective on
the first day of August, 1978, and shall be col-
lected by the State Department of Revenue and
distributed to the city pursuant to applicable
rules and regulations of said Department of

3.34.100 Lodging tax advisory committee.
An increase in the rate of a tax imposed
under this chapter, repeal of an exemption
from the tax imposed, or change in the use of
revenue received shall be submitted to the
lodging tax advisory committee for review and
comment at least 45 days before final action on
or passage of the proposal by the city council.
The advisory committee shall submit com-
ments on the proposal in a timely manner after
having afforded the public an opportunity for
comment. Such comments may be written or
oral; provided, however, that the advisory
committee shall hold at least one meeting
where the oral comments of the public are
received and considered. The comments of the
committee shall include an analysis of the
extent to which the proposal will accommo-

date activities for tourists or increased tourism,
and the extent to which the proposal will affect
the long-term stability of the fund created pur-
suant to ECC 3.34.060. Failure of the advisory
committee to timely submit, prior to final
action on or passage of the proposal, shall not
prevent the city from acting on the proposal. In
the event the city council, in its sole discretion,
deems it appropriate to amend the proposal, it
is not required by Chapter 67.28 RCW to
resubmit such proposal to the advisory com-

Edmonds, driver's signature, and such other
information as the director or his designee may
require. The permit shall be displayed by the
applicant or his employee at the time the sew-

months from date of issue. The fee for the per-

6.60.010 Purposes.
The purpose of this chapter is to protect the
lives and property of the citizens of Edmonds
in the event of a disaster through planning,
training and organization and by authorizing
the exercise of emergency powers as pre-
scribed by RCW 38.52.070. [Ord. 2224 § 1,

6.60.020 Definitions.
A. "Disaster" means any emergency situa-
tion proclaimed by the Governor to be a disas-
ter, and more particularly described as an
actual or threatened enemy attack, sabotage,
extraordinary fire, flood, storm, epidemic, riot,
earthquake, or other hostile action or natural
calamity, which reaches such a dimension or
degree of destructiveness that it requires the
taking of extraordinary measures to protect the
public health, safety and welfare.
B. "Disaster coordination" means the prep-
aration for and the carrying out of all emer-
gency functions, to prevent, minimize, and
repair damage resulting from a disaster; pro-
vided, however, that this term does not refer to
the functions for which military forces are pri-
marily responsible.

C. "Disaster coordinating organization"
means such organization may include all offic-
ers and employees of the city, all volunteer
forces enrolled to aid the city during a disaster,
and all groups, organizations and persons who
may be enlisted by agreement or by operation
of law, including those persons pressed into
service under the provisions of this chapter.

6.60.030 Disaster coordination duties
delegated.
The duties of the office of disaster coordina-
tor are hereby delegated to the Snohomish
County emergency services coordinating
agency (ESCA). [Ord. 3165 § 4, 1997].
6.60.040 Powers and duties of disaster
coordinator in preparation for a
disaster.
Subject to the direction and control of the
mayor, the disaster coordinator shall be
empowered as follows:
A. To have direct responsibility for disaster
coordination including, but not limited to, the
organization, administration, and operation of
the disaster coordinating organization, and the
resolution of questions of authority and
responsibility arising among the various mem-
bers of such organization.
B. To draft, review, and recommend for
adoption by the city council emergency pre-
paredness and mutual aid plans and/or agree-
ments, and such ordinances and resolutions as
are necessary to implement such plans and
agreements, subject to approval by the state
director of emergency services as provided in
RCW 38.52.070.
C. To organize and direct the training of the
disaster coordinating organization, including
practice drills.
D. To represent the city in all dealings with
public and/or private agencies regarding the
provision of emergency services in the event
of a disaster.
E. To designate buildings and/or premises
as shelters for persons and/or property in the

event of a disaster.
F. To propose rules and regulations on mat-
ters reasonably related to the protection of
lives and/or property injured or damaged, or
likely to be injured or damaged by a disaster,

6.60.050 Authority of disaster services
coordinator in the event of a
disaster.
Subject to the supervision and control of the
mayor, the disaster coordinator shall be
empowered during a disaster as follows:
A. To obtain vital supplies, equipment, and
such other requirements necessary for the pro-
tection of life and property and to bind the city
for the fair value thereof and if necessary to
immediately commandeer the same for public
use. These powers may be exercised in the light
of the exigencies of an extreme emergency sit-
uation without regard to time-consuming pro-
cedures and formalities prescribed by law
(excepting mandatory constitutional require-
ments) including but not limited to budget law
limitations, the requirements of competitive
bidding, the publication of notices, entering
into public works contracts, the incurring of
obligations, the employment of temporary
workers, the rental of equipment, the purchase
of supplies and materials, and the expenditure
of public funds.
B. To requisition necessary personnel and/
or material of any city department or agency.
C. To require the emergency services of any
city officer or employee, and, after the Gover-
nor has proclaimed that a disaster exists pursu-
ant to RCW 43.06.010, to command the aid of
as many citizens of this city as necessary pur-
suant to RCW 38.52.110(2); provided, that
such persons shall be entitled to all privileges,
benefits and immunities as are provided by
state law for registered emergency services
volunteers as provided in RCW 38.52.310.

The state traffic laws regulating the speed of
vehicles shall be applicable upon all streets
within this city, except as this title, as autho-
rized by state law, declares and determined
upon the basis of engineering and traffic inves-
tigation that certain speed regulations shall be
applicable upon specified streets or in certain
areas, in which event it shall be unlawful for
any person to drive a vehicle at a speed in
excess of any speed so declared in this title
when signs are in place giving notice thereof.

8.16.015 Penalty.
Unless otherwise provided in this municipal
code, by state statute adopted by reference, or
by traffic infraction court rules, any person
who violates any provision of this chapter shall
be guilty of a traffic infraction, and shall be

Edmonds City Code
mittees of the commission are not city commit-
tees and shall not transact public business, and
their meetings shall not be considered public
meetings for the purposes of the Open Meeting
and Record Act. Such subcommittees shall
make recommendations only to the sister city
commission. This statement of purpose is not
intended to avoid any requirement of state law
but rather to recognize that such subcommit-
tees and their membership may shift from time
to time, and are groups of interested citizens
working together to promote the activities of
the commission, subject to its approval.
10.60.030 Formal commission structure.
Only those commission members appointed
by the mayor and confirmed by the city council
shall be covered by the city's indemnification
ordinance. One purpose of the commission will
be to promote its activities through broad citi-
zen participation; provided, however, that sub-
committee members and other citizens partici-
pating in the commission functions shall not be
covered by the city's indemnification ordi-
nance nor the city's liability insurance cover-
age. Official activities of the sister city com-
mission shall comply with established city
ordinance procedures and accounting proce-
dures.
10.60.040 Contributions of private funds.
The administrative services director is
hereby authorized and directed to work with
the commission to establish a fund or appropri-
ate subfund or accounting category in order to
segregate private monies contributed to the
city for the purpose of assisting or promoting
the sister city commission effort. The purpose
of this segregation will be to keep and maintain
the private character of these funds in order
that they may be used to entertain and host vis-
iting dignitaries and to do other things which
the city would be otherwise prohibited from
doing with public funds. In all other respects,
the funding of the commission shall be on such
basis as the council shall determine in accor-

dance with its annual budget; provided, how-
ever, it is the intention of the city council that
staff support be provided through the office of
the mayor and that special projects of the com-
mission be funded through its applications to
other interested bodies. For example, the pro-
motion of tourism through Japanese tourists
may trigger application for tourism funds, an
art project may result in applications to the
Edmonds arts commission, and other similar
projects will be funded in accordance with
their merit and the purposes for which other
available funds are provided. The commission
is urged and expected to continue its fund rais-
ing efforts in order to provide a separate source
of private funding for its projects.
10.60.050 Expenditures and other financial
procedures.
Expenditure of all funds shall be expended
in accordance with generally accepted ac-
counting procedures and those procedures es-
tablished by the administrative services direc-
tor and the state auditor; provided, however,
that private funds donated for the purpose of
hosting shall be segregated from public funds.
The commission shall maintain a proper audit
trail for all expenditures and carefully differen-
tiate between public and private funds to the
end that no public monies of the city are spent
on promotional hosting or visiting dignitaries
except in conjunction with public celebrations
and events approved for public expenditure by
the opinion of the State Auditor and Attorney

LODGING TAX

10.70.010 Creation — Conflict of provisions.
A lodging tax advisory committee is hereby
created pursuant to the provisions of Chapter
67.28 RCW. The duties and structure of the
advisory committee shall be interpreted and
applied pursuant to the requirements of Chap-
ter 67.28 RCW as the same exists or is
amended, and, in the event of conflict between
the provisions of this chapter and Chapter 3.34
ECC, and Chapter 67.28 RCW, the state stat-
ute shall control. In the event of ambiguity, all
ambiguity shall be resolved in favor of and in
conformance with the provisions of the state
statute. [Ord. 3166 § 3, 1997].
10.70.020 Membership.
The lodging tax advisory committee shall
consist of five members appointed by the city
council. Committee membership shall consist
of:
A. Two members of representatives of
businesses required to collect tax under this
chapter;
B. Two members who are persons involved
in activities authorized to be funded or sup-
ported by revenues received under this chap-
ter;
C. A fifth representative who shall be an
elected official of the city and who shall chair
the commission;
D. The committee may be enlarged at the
discretion of the city council recognizing there
must always be equal representation from the
tax providers and the tax users as required by
RCW 67.28.1817, as now or hereafter
amended;

E. In addition, the city council may appoint
an additional nonvoting member who is an
elected official of the city and a nonvoting
member who is an elected official of Snohom-
ish County.
Persons eligible for appointment under sub-
section A of this section are not eligible for
appointment under subsection B, and persons
who are eligible under subsection B of this sec-
tion are not eligible for appointment under
subsection A. [Ord. 3166 § 3, 1997].
10.70.030 Duties.
The committee shall provide advice and rec-
ommendations in accordance with the provi-
sions of Chapter 67.28 RCW as the same exists
or is hereafter amended. The city council shall
submit for review and recommendation an
imposition of taxes under this chapter, an
increase in the rate of tax imposed under this
chapter, repeal of an exemption from the tax
imposed under this chapter, or a change in the
use of revenue received under this chapter. The
city council shall submit such items for consid-
eration at least 45 days before its final action
on a passage of a proposal by the city council.
The advisory committee shall receive public
comment on the proposal in accordance with
the provisions of Chapter 3.34 ECC. The fail-
ure of the advisory committee to timely submit
comments before final action on or passage of
the proposal shall not prevent the city council
from acting on such a proposal. In the event
that the city council determines it appropriate
in its sole discretion to amend a proposal fol-
lowing the receipt of comment by the advisory
committee, it is not required to resubmit such
proposal to the advisory committee before act-

10.70.040 Expiration of appointment.
An appointment of each member of the
committee shall expire annually on December
31st. The city council shall review member-
ship annually and shall make such changes as

members as it, in its sole discretion, shall deem
