The following statutes of the state of Wash- ington are adopted by reference: RCW 70.93.060 Littering 70.54.010 Polluting water supply [Ord. 2531, 1985]. 5.46.030 Repealed by Ord. 2853. 5.46.050 5.46.040 Unlawful possession of library books. A person shall be guilty of unlawful posses- sion of library books if he willfully retains any book, newspaper, magazine, pamphlet, manu- script, recording or other property belonging to or in any public library, reading room or other educational institution for 30 days after notice in writing to return the same, given after the ex- piration of the time that by the rules of such in- stitution such article or other property may be kept. Any person violating this section of the code shall be guilty of a civil infraction and shall be sentenced to a fine not to exceed $500.00. [Ord. 2853 § 39, 1991; Ord. 2531, 1985]. 5.46.050 Use of skateboards, roller skates and similar devices restricted. A. Definitions. For purposes of this section, the following words and phrases shall have the meanings ascribed to them in this section: 1. "Skateboard" means a foot board mounted upon four or more wheels and is usu- ally propelled by the user who sometimes stands, sits, kneels or lays upon the device while it is in motion. 2. "Roller skate" means a pair of shoes, mounted upon wheels and is most often pro- pelled by the user in an upright, standing posi- tion or kneeling. 3. "Coaster" means a foot board mounted upon two or more wheels and con- trolled by an upright steering handle. This device is propelled by the user in usually an upright position. 4. "To operate in a negligent manner" means the operation of one or more of the above-described devices in such a manner as to endanger or be likely to endanger any per- son or property. Examples of operating in a negligent manner include, but are not limited to, failure to obey all traffic control devices and failure to yield right-of-way to pedestrians and/or vehicular traffic. 5. "Arterial" is defined to include those public streets shown and described in the offi- 5-59 (Revised 5/98) 5.46.060 cial street map of Edmonds adopted pursuant to Chapter 18.50 ECDC and incorporated herein by this reference. B. Traffic Regulations. Any person operat- ing a skateboard, roller skates or a coaster shall obey the instructions of official traffic control signals, signs and other devices applicable to vehicles, unless otherwise directed by a police officer. C. Speed. No skateboard, roller skates or coaster shall be ridden in a negligent manner, but shall be operated with reasonable regard for the safety of the operation and other per- sons. D. Prohibited Areas. It is unlawful for any person to operate a skateboard, coaster or sim- ilar device upon any of the following areas: 1. All arterial streets; and/or 2. All sidewalks in the following described areas: a. On 8th Avenue from Bell Street to Maple Street; b. West on Bell Street to 6th Avenue, north to Sprague Street, west to Edmonds Street, then west to the water; c. On Maple Street from 8th Avenue to 5th Avenue, north to Dayton Street, west to 3rd Street, south to Alder Street, west to 2nd Avenue, north to Dayton Street, west to the water; d. The area surrounding the sewer treatment plant between SR 104 and 2nd Ave- nue in the 200 block; and e. The entire area south of Dayton commonly known as Harbor Square and bounded by SR 104 to the east, the Union Oil Marsh to the south and the Burlington North- ern Railroad right-of-way to the west. E. Violation — Penalty. Any person violat- ing any provision of this section shall be guilty of an infraction and shall be punished by the imposition of a monetary penalty of not more than $100.00. Further, the device ridden at the time of violation shall be subject to impound for a period of 10 days. [Ord. 3187 § 1, 1998; Ord. 2846 § 2, 1991]. (Revised 5/98) 5-60 5.46.060 Explosives. A. No person, except the director of labor and industries or the director's authorized agent, the owner, the owner's agent, or a per- son authorized to enter by the owner or owner's agent, or a law enforcement officer acting within his or her official capacity, may enter any explosives manufacture building, magazine or car, vehicle or other common car- rier containing explosives in the city of Edmonds. B. No person shall abandon explosives or improvised devices. Improvised devices include a device which is fabricated with explosives or destructive, lethal, noxious, pyrotechnic, or incendiary chemicals and which is designed to disfigure, destroy, dis- tract, or harass. C. Violation of ECC 5.46.060A or 5.46.060 B is a gross misdemeanor, adopting RCW 70.74.160, RCW 70.74.295 and RCW 9A.20. [Ord. 2945 § 1, 1993]. 5.46.070 Unlawful possession of cigarettes by a minor. A. A person under the age of 18 who pos- sesses cigarettes or tobacco products in a pub- lic place within the city shall be guilty of a civil infraction and for each such offense shall be punished by: 1. A fine not to exceed $50.00; or 2. Participation in a smoking cessation program; or 3. Both. B. This provision will not apply if a person under the age of 18, with parental authoriza- tion, is participating in a controlled purchase as part of a liquor control board, law enforcement or local health department activity. C. Any person who fails to respond to or to appear in court in response to a notice of viola- tion under this chapter shall be deemed to have violated ECC 5.01.045 and be subject to the penalty listed in that section. Edmonds City Code Chapter 5.48 VIOLATIONS BUREAU — BAIL REGULATIONS Sections: 5.48.010 Created. 5.48.020 Establishing bail. 5.48.030 Authority to accept bail. 5.48.040 Authority to accept forfeiture of bail — Consequences. 5.48.050 When person charged may elect to appear before court. 5.48.060 Duties of violations bureau. 5.48.070 Additional duties of violations bureau. 5.48.080 References to "court" and "judge". 5.48.010 Created. There is established a violations bureau to assist the municipal court or courts of limited jurisdiction. The violations bureau shall be in charge of such person or persons and shall be open at such hours as the city council may des- ignate. [Ord. 2531, 1985; Ord. 1481, 1970]. 5.48.020 Establishing bail. The municipal court shall designate the specified offenses under ordinances of this city in respect to which payment of bail may be accepted by the violations bureau in satisfac- tion thereof, and may specify by suitable schedules the amount of such bails for first, second and subsequent offenses; provided such bails are within the limits declared by law or ordinances, and may further specify what number of such offenses shall require appear- ance before the court. The municipal court may also specify by suitable schedule the bail for persons who have failed to appear before the court as required by statute, ordinance or applicable court rule. (Revised 5/98) 5-60.2 Edmonds City Code include such information as required by the director of public works, which may specify places from where pumped within the city of Edmonds, driver's signature, and such other information as the director or his designee may require. The permit shall be displayed by the applicant or his employee at the time the sew- age is pumped into the city system. [Ord. 2144 § 2, 1980]. 6.50.047 Term/fee. Permits shall be valid for a period of three months from date of issue. The fee for the per- mit shall be $125.00. Permits may be renewed by the public works director, or his designee, upon payment of an additional $125.00 fee. [Ord. 2144 § 3, 1980]. 6.50.050 Penalty for violations. Any person or persons violating the provi- sions of this chapter is guilty of a misdemeanor and, upon conviction, shall be punished as set forth in ECC 5.50.020. [Ord. 822 § 5, 1960]. 6.60.020 Chapter 6.60 DISASTER PREPARATION AND COORDINATION Sections: 6.60.010 Purposes. 6.60.020 Definitions. 6.60.030 Emergency operations plan. 6.60.035 Emergency management organization. 6.60.040 Powers and duties of disaster coordinator in preparation for a disaster. 6.60.050 Authority of disaster services coordinator in the event of a disaster. 6.60.060 Violations. 6.60.065 Temporary replacement of the mayor. 6.60.070 Immunity from private liability. 6.60.300 Severability. 6.60.010 Purposes. The purpose of this chapter is to protect the lives and property of the citizens of Edmonds in the event of a disaster through planning, training and organization and by authorizing the. exercise of emergency powers as pre- scribed by RCW 38.52.070. [Ord. 2224 § 1, 1981]. 6.60.020 Definitions. A. Disaster. 1. "Disaster" as used in this chapter shall mean an event or set of circumstances which: a. Demands immediate action to pre- serve public health, protect life, protect public property or to provide relief to any stricken area within the city overtaken by such occur- rences; or b. Reaches such a dimension or degree of destructiveness as to warrant the mayor proclaiming the existence of a disaster or the Governor declaring a state of emergency 6-15 (Revised 5/98) 6.60.030 in accordance with appropriate local and state statute. 2. The proclamation of a disaster by the mayor shall be accompanied simultaneously by: a. A public proclamation posted on the exterior of all city offices, schools and libraries; and b. The prompt effort to serve per- sonal notice to all members of the city council, with service modes to include confirmed tele- phone contact or personal service by city staff. B. "Emergency services coordinating agen- cy (ESCA)" is a local government agency cre- ated pursuant to Chapter 38.52 RCW that provides local disaster management functions for the Edmonds area, including coordination between Edmonds and other agencies and orga- nizations for disaster preparedness and disaster response. [Ord. 3196 § 1, 1998]. 6.60.030 Emergency operations plan. The emergency operations plan, to the extent that it does not conflict with this chap- ter, shall govern disaster preparedness and disaster response in the city of Edmonds. The emergency operations plan and any amend- ments thereto shall be subject to the approval of the mayor and shall immediately take effect upon approval by the mayor. [Ord. 3196 § 2, 1998]. 6.60.035 Emergency management organization. The emergency management organization of the city of Edmonds is created and shall consist of the following: A. The mayor, who shall be the administra- tive head and have direct responsibility for the organization, administration and operation of the emergency management organization for the city of Edmonds and direct responsibility for the disaster operations of departments in the city; B. The disaster coordinator, who shall be appointed by and be subject to the supervision of the mayor and who shall be responsible for (Revised 5/98) 6-16 the administration and operation of the emer- gency management organization, including the issuance of recommendations to the mayor on the amendment and implementation of the emergency operations plan; C. The emergency operations board, which oversees and provides policy recommendation to the city council during disaster and recovery periods and provides direction for the develop- ment and maintenance of the emergency oper- ations plan. The emergency operations board shall oversee the activities of and provide direction to the emergency management com- mittee during major emergencies and disas- ters. The emergency operations board provides policy direction for disaster preparedness and mitigation. The mayor shall serve as chair of the emergency operations board and the disas- ter coordinator shall serve as vice -chair. The remaining membership of the emergency oper- ations board shall be as designated in the emer- gency operations plan; D. The emergency management commit- tee, which provides staff support, direction and expertise in development of the emergency operations plan and all supporting documents. The disaster coordinator shall serve as chair of the committee. The emergency operations plan may also designate the ESCA director as a co- chair of the committee. Other membership in the committee shall be as designated in the emergency operations plan. [Ord. 3196 § 3, 1998]. 6.60.040 Powers and duties of disaster coordinator in preparation for a disaster. Subject to the direction and control of the mayor, the disaster coordinator shall be empowered as follows: A. To have direct responsibility for disaster coordination including, but not limited to, the organization, administration, and operation of the emergency management committee, and the resolution of questions of authority and responsibility arising among the various mem- bers of such organization. Edmonds City Code B. To draft, review, and recommend disas- ter preparedness and mutual aid plans and/or agreements, and such ordinances and resolu- tions as are necessary to implement such plans and agreements. C. To organize and direct the training of the emergency management committee, including practice drills. D. To represent the city in all dealings with public and/or private agencies regarding the provision of disaster services in the event of a disaster. E. To designate buildings and/or premises as shelters for persons and/or property in the event of a disaster. F. To propose rules and regulations on mat- ters reasonably related to the protection of lives and/or property injured or damaged, or likely to be injured or damaged by a disaster. [Ord. 3196 § 4, 1998; Ord. 2224 § 1, 1981]. 6.60.050 Authority of disaster services coordinator in the event of a disaster. Subject to the supervision and control of the mayor, the disaster coordinator shall be empowered during a disaster as follows: A. To obtain vital supplies, equipment, and such other requirements necessary for the pro- tection of life and property and to bind the city for the fair value thereof and if necessary to immediately commandeer the same for public use. These powers may be exercised in the light of the exigencies of an extreme emergency sit- uation without regard to time-consuming pro- cedures and formalities prescribed by law (excepting mandatory constitutional require- ments) including but not limited to budget law limitations, the requirements of competitive bidding, the publication of notices, entering into public works contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the expenditure of public funds. 6.60.065 B. To requisition necessary personnel and/ or material of any city department or agency. C. To require the emergency services of any city officer or employee, and, after the Gover- nor has proclaimed that a disaster exists pursu- ant to RCW 43.06.010, to command the aid of as many citizens of this city as necessary pur- suant to RCW 38.52.110(2); provided, that such persons shall be entitled to all privileges, benefits and immunities as are provided by state law for registered emergency services volunteers as provided in RCW 38.52.310. [Ord. 2224 § 1, 1981]. 6.60.060 Violations. The following offenses shall be punishable as misdemeanors by a fine not to exceed $500.00 and/or by imprisonment not to exceed 90 days. A. No person shall willfully obstruct, hinder or delay any member of the disaster coordination organization in the enforcement of any lawful rule or regulation issued pursu- ant to this chapter, or in the performance of any duty required by this chapter. B. No person shall wear, carry or display, without authority, any means of identification as specified by the State Department of Emer- gency Services and/or which would be likely to mislead a member of the public into believ- ing that such person is a member of the disaster coordinating organization. [Ord. 2224 § 1, 1981]. 6.60.065 Temporary replacement of the mayor. The following elected officials shall, in the order listed, act on behalf of the mayor if he/she is unable to carry out his/her duties, in carrying out the purposes of this chapter or the provisions of the emergency management plan: A. The council president; B. The most senior city councilmember; 6-17 (Revised 5/98) 6.60.070 C. The remaining city councilmembers in order of continuous seniority. [Ord. 3196 § 5, 1998]. 6.60.070 Immunity from private liability. There shall be no liability on the part of any person, partnership, corporation, the state of Washington or any political subdivision thereof who owns or maintains any buildings or premises that have been designated by the city of Edmonds disaster coordinator as a disaster shelter for any injuries sustained by any person while in or upon said building or premises as a result of the condition of said building or premises or as a result of any act or omission, or in any way arising from the des- ignation of such premises as a shelter provided such person has entered, gone upon or into said building or premises for the purpose of seeking refuge therein during a disaster; provided fur- ther, however, that this section shall not apply to the willful acts of such owner or occupant or his or her servants, agents, or employees. This section shall also apply to any practice drill authorized pursuant to this chapter. [Ord. 2224 § 1, 1981]. 6.60.300 Severability. If any section, subsection, sentence, clause, phrase or portion of this chapter is for any rea- son held invalid or unconstitutional by any court of competent jurisdiction, such portions shall be deemed a separate, distinct and inde- pendent provision and such holding shall not affect the validity of the remaining portions of this chapter. [Ord. 2224 § 1, 1981]. (Revised 5/98) 6-18 Edmonds City Code ness establishments other than office buildings and other than industrial or manufacturing, and each such business shall be considered as a sep- arate unit even though two or more may be in the same building. I. In the event there is more than one type of operation in the same building, i.e., a profes- sional office, a retail store, a restaurant, or an apartment, then in that case each separate cat- egory or type shall pay at the rate fixed under that particular category or type. [Ord. 786 § 1, 1959]. 7.30.020 Separate single-family residence meters. Each single-family residence building or structure served by water shall be provided with its own separate water meter. Prior to the time when such additional separate meters can be installed, water rates shall be applicable on the same basis as if the separate meters were actually installed. [Ord. 1449, 1969]. 7.30.030 Water rates — Meter installation charges. A. Variable Rate. In addition to the base rate set forth above, the customer shall be charged 7.30.040 the following rate per 100 cubic feet of water consumed: *Effective 5/15/92 — $1.08 1/01/93 — $1.21 1/01/94 — $1.30 *Applies to billings on or after the effective date. C. Meter Installation Charges. 1. New service line and meter installa- tion charges are fixed as follows: a. 3/4" $550.00 b. 1" $800.00 2. The actual cost of street restoration (with regard to all surface streets) shall be added to any meter installation charge, if appli- cable. 3. When approved by the city engineer, new service lines installed by a developer on a plat shall be credited as follows: a. 3/4" $175.00 b. 1 " $200.00 D. Connection Charge. A connection charge of $200.00 shall be made to each new customer connecting to the city water system, except for the water mains installed under Local Improvement District Nos. 115, 146, and 152. E. All rates set forth in this section shall be exclusive of any applicable taxes. F. Consumption Surcharge. All customers shall pay an additional surcharge in the amount of 5-3/4 percent of the base rate and variable rate for water as set forth in subsections A and B of this section. For customers who are not served by city waterlines but who are connected to city sew- ers, the charges shall be the same as set forth in subsection A of this section and its subpara- graphs. C. These rates do not apply to industries or manufacturing concerns which have industrial wastes. These, together with other activities not covered in this chapter, shall be dealt with on a special basis and have special rates set for the particular business by the water/utility administrative staff, subject to review and approval by the city council. D. All property owners within an area served by a sanitary sewer system in the city of Edmonds are hereby directed and compelled to connect their private drains and sewers to the city system. Failure to do so within 30 days of (Revised 5/98) 7-12 written notice to connect by the city shall sub- ject the property owner to a monthly penalty equal to that charge imposed by subsections A, B, and/or C above. Said penalty shall be billed to the property owner, and they shall be subject to payment, collection and enforcement in all respects as though they were utility customers of the city. All penalties collected shall be con- sidered revenues of the sewer utility system. It is unlawful for any person, firm, corpora- tion, or other organization of any type whatso- ever to take, or allow to be taken, water from the Edmonds water system without a valid per - Edmonds City Code for which both fire protection and other water service for such uses as domestic, commercial, industrial, or manufacturing purposes is sup- plied, there may be two service installations made to the premises: one for fire service only and one for other water service. These service functions may also be combined in a single service connection with the approval of the water division. In the event two separate service connec- tions are installed, the fire protection system so served shall consist of an automatic sprinkler system only, without additional outlets which could normally be used for other than fire sup- pression purposes. [Ord. 1561, 1971]. 7.40.040 Fire service monthly service charges. A. The minimum monthly rates for inspec- tion and maintenance of detector check sys- tems are fixed as follows: - Fire Service or Detector Monthly Meter Size Service Charge 2" $5.00/month 3" $5.00/month 4" $5.00/month 6" $7.50/month 8" $10.00/month 10" $15.00/month Water used through the fire service line for fire suppression purposes and limited testing of the system will normally be furnished with- out any charge in addition to the monthly min- imum charge set forth for fire service meter or detector check meter. B. If a detector check meter proves, or proof is otherwise provided, leakage or unau- thorized usage of water which is not for fire suppression purposes, the customer shall pay for all water used at the applicable metered rate. The rates for water so used are fixed as follows: at the time of first written notice from the city water division the applicable rate shall be the same as the domestic rate for compara- ble size of domestic water meter for unautho- 7.40.050 rized use over 100 cubic feet per month; in the event the unauthorized use again occurs after the period of time specified in the written notice from the water division, the rate shall be double the domestic rate for a comparable size domestic water for such unauthorized use over 100 cubic feet per month. C. References made by this chapter as to existing metered rates shall be to Chapter 7.30 ECC. [Ord. 1561, 1971]. 7.40.050 Violation — Penalty. In addition to all civil rights of collection, liens, shut -offs and other remedies available to the city of Edmonds as prescribed by statute and ordinance for unauthorized use and/or nonpayment of charges, any person, firm, cor- poration or other organization, including any officers, directors and managers thereof, who violate any provision of this chapter shall be guilty of a misdemeanor and subject to penal- ties as set forth in ECC 5.50.020. [Ord. 1561, 1971]. 7-15 (Revised 5/98) 7.50.010 Chapter 7.50 STORMWATER MANAGEMENT UTILITY Sections: 7.50.010 Stormwater management utility created — Responsibilities. 7.50.020 Administrator of utility. 7.50.030 System or plan of stormwater management utility. 7.50.040 Transfer of property to stormwater management utility. 7.50.050 Rates and charges. 7.50.010 Stormwater management utility created — Responsibilities. There is hereby created and established, pur- suant to Chapters 35A.80 and 35.67 RCW, a storm and surface water utility to be known as the "Edmonds Stormwater Management Util- ity." All references to "the utility" in this chap- ter refer to the Edmonds stormwater manage- ment utility. The utility will have primary authority and responsibility for carrying out the city's comprehensive drainage and storm sewer plan, including responsibilities for plan- ning, design, construction, maintenance, ad- ministration, and operation of all city storm and surface water facilities, as well as establishing standards for design, construction, and mainte- nance of improvements on private property where these may affect storm and surface water management. 7.50.020 Administrator of utility. The director of community services shall be ex officio administrator of the utility. 7.50.030 System or plan of stormwater management utility. There is hereby specified and adopted the original system or plan of the stormwater man- agement utility, which shall include all proper- ties, interests, and physical and intangible rights of every nature owned or held by the city, however acquired, insofar as they relate to or (Revised 5/98) 7-16 concern storm or surface water sewage, further including, without limitation, all properties, interests and rights acquired by adverse posses- sion or by prescription, directly or through another, in and to the drainage or storage, or both, of storm or surface waters, or both, through, under, or over lands, watercourses, sloughs, streams, ponds, lakes, and swamps, all beginning in each instance at a point where storm or surface waters first enter the storm and surface water system of the city and ending in each instance at a point where the storm or sur- face waters exit from the storm and surface water system of the city, and in width to the full extent of inundation caused by storm or flood conditions. 7.50.040 Transfer of property to stormwater management utility. The city council expressly finds the value of the above-described original system or plan of storm drainage and surface water facilities, together with funds currently held in the water and sewer fund in the amount of $690,000, is equal to the value of release from primary responsibility therefor insofar as it relates to or concerns storm or surface waters within the city. Accordingly, all of the city's above-men- tioned facilities, including the rights and inter- ests as a part thereof as they relate to or concern storm or surface waters, and the funds in the amount of $690,000 are, for purposes of RCW 43.09.210, hereby transferred to and subject to the administration of the city's stormwater management utility created by this chapter, and all other institutions and departments of the city having primary responsibility therefor within the city are, to the same extent, released from such primary responsibility. Inasmuch as the city now owns all of those facilities, includ- ing the rights and interests as a part thereof and the original system or plan set forth in ECC 7.50.030, there is no estimated cost thereof. 7.50.050 Rates and charges. The following rates shall be charged effec- Edmonds City Code tive on the date shown to the following classes of customers and/or service: A. Single -Family Residential. Effective April 1, 1998, $7.40/bimonthly. B. Multifamily Residential. Effective April 1, 1998, $3.70/ESU/monthly or $7.40/ESU/bi- monthly. C. All Nonresidential Customers. Effective April 1, 1998, $3.70/ESU/monthly. D. An ESU is hereby defined to be the impervious surface area estimated to contrib- ute an amount of runoff which is approxi- mately equal to that created by the average single-family residential parcel. A single-fam- ily residential parcel is one ESU. For all other parcels, one ESU is equivalent to 3,000 square feet of impervious surface area. [Ord. 3195 § 2, 1998]. 7.60.020 Chapter 7.60 COMBINED UTILITY Sections: 7.60.010 Combination of combined water and sewer utility and stormwater management utility. 7.60.020 Separate rates — Accountability. 7.60.010 Combination of combined water and sewer utility and stormwater management utility. The city is maintaining and operating a com- bined water supply and distribution system and sanitary sewage disposal system and, by Chap- ter 7.50 ECC, has created a stormwater man- agement utility. Pursuant to the provisions of RCW 35.67.331, the present combined water and sewer utility, and the stormwater manage- ment utility, together with all additions, exten- sions and betterments thereof at any time made, are hereby combined into a single utility; pro- vided that the accounting procedure for each system shall be kept separate as required by RCW 35.37.010. The combined water, sewer and stormwater management utility of the city, together with all additions, extensions and bet- terments thereof at any time made, shall here- inafter be called the "combined utility." 7.60.020 Separate rates — Accountability. The council declares its intent to establish rates for the combined water and sewer utility and stormwater management utility. In order to better account for the costs of the respective components of the combined utility, the administrative services director is directed to maintain such separate funds and accounting structures as may be necessary to discretely account for the costs, expenses and revenues of each component utility. When the staff makes recommendations for the establishment, increase or decrease in any rate, it is directed to provide supporting data which separately reflects such costs, expenses and revenues for each component utility. 7-17 (Revised 5/98) 7.70.010 Chapter 7.70 SOLID WASTE MANAGEMENT Sections: 7.70.010 Definitions. 7.70.020 Snohomish County system designated. 7.70.030 Unlawful disposal of solid waste. 7.70.040 Interlocal agreement approved. 7.70.010 Definitions. A. "City" means the city of Edmonds, Washington. B. "Comprehensive solid waste manage- ment plan" or "comprehensive plan' means the Snohomish County comprehensive solid waste management plan, including a recycling element, as adopted by Snohomish County Motion No. 90-004, and as amended from time to time. C. "County" means Snohomish County, Washington. D. "Interlocal agreement" means the inter- local agreement regarding solid waste disposal site designation, attached and incorporated herein by this reference. E. "Person' means an individual, firm, association, partnership, political subdivision, government agency, municipality, industry, public or private corporation, or any other entity whatsoever. F. "Solid waste" means solid waste as defined by RCW 70.95.030(16) and WAC 173-304-100(73) with the exception of wastes excluded by WAC 173-304-015. G. "Solid waste handling" means the man- agement, storage, collection, transportation, treatment, utilization, processing, and final disposal of solid wastes, including the recov- ery and recycling of materials from solid wastes, the recovery of energy resources from such wastes or the conversion of the energy in such wastes to more useful forms or combina- tions thereof, and as such term may be modi- fied by amendments to RCW 70.95.030(17). (Revised 5/98) 7-18 H. "System" means all facilities for solid waste handling owned or operated or con- tracted for by the county, and all administra- tive activities related thereto. [Ord. 2763 § 1, 1990]. 7.70.020 Snohomish County system designated. A. All solid waste generated within the cor- porate limits of the city of Edmonds shall be disposed of through the county system as pro- vided for in the comprehensive plan except as otherwise provided in subsection D. B. Snohomish County is authorized to des- ignate disposal sites for the disposal of all solid waste which is generated within the city of Edmonds subject to the applicable laws and regulations of the Snohomish health district and the city if located within the city. C. No solid waste may be diverted from the disposal sites designated by Snohomish County without Snohomish County approval or as provided in the comprehensive plan. D. The provisions of the section shall not apply: 1. To the disposal of solid waste through the waste recycling element of the comprehen- sive plan or any waste reduction or recycling plan approved by the county; 2. To the disposal of hazardous wastes or substances where disposal into the county system is prohibited or where other provisions pursuant to state or federal law are made for the handling of such wastes or substances; 3. Where disposal is otherwise provided for under state or federal law. [Ord. 2763 § 2, 1990]. 7.70.030 Unlawful disposal of solid waste. A. It is unlawful for any person to dispose of any solid waste generated in the city of Edmonds and subject to this chapter unless they comply with the provisions of RCW 70.95.240, 70.95.500 and 70.95.610 which are hereby adopted by reference. Edmonds City Code or portions of streets where appropriate, con- sidering the following factors: 1. The number of vehicles using the street or portion of the street. 2. The speed of vehicles utilizing the street. 3. The width of the street. 4. The time of day the street has been utilized for play. 5. The number of people using the street for play. 6. The danger of accidents occurring as a result of play in the streets. [Ord. 2373, 1983]. 8.32.030 One-way streets and alleys. Upon those streets and parts of streets and in those alleys described in ECC 8.64.010, vehic- ular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and maintained at every intersection where movement in the opposite direction is prohibited, and a vehicle passing around a rotary traffic island shall be driven only to the right of such island. [Ord. 1169 § 31, 1966]. 8.32.040 Railroad trains not to block streets. It is unlawful for the directing officer or the operator of any railroad train to direct the oper- ation of or to operate the same in such a manner as to prevent the use of any street for purposes of travel for a period of time longer than five minutes, except that this provision shall not apply to trains or cars in motion other than those engaged in switching. [Ord. 1169 § 48, 1966]. 8.32.050 Compression brakes prohibited. No person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of any such motor vehicle or any component part thereof. 8.32.060 A. It shall be an affirmative defense to pros- ecution under this section that compression brakes were applied in an emergency and were necessary for the protection of persons and/or property. B. Bona fide emergency vehicles owned by a public entity and equipped and licensed in compliance with state law shall be exempt from the provisions of this section. [Ord. 3186 § 1, 1998; Ord. 1986 § 1, 1978]. 8.32.060 Alcoholic beverages in vehicles. It is a traffic infraction: A. For any person to drink any alcoholic beverage in a motor vehicle when the vehicle is upon a highway; B. For any person to have in his possession while in a motor vehicle upon a highway, a bottle, can, or other receptacle containing alco- holic beverage if the container has been opened or a seal broken or the contents par- tially removed; or C. For the registered owner of a motor vehi- cle, or the driver if the registered owner is not then present in the vehicle, to keep in a motor vehicle when the vehicle is upon a highway, a bottle, can, or other receptacle containing an alcoholic beverage which has been opened or a seal broken or the contents partially removed, unless the container is kept in the trunk of the vehicle or in some other area of the vehicle not normally occupied by the driver or passengers if the vehicle does not have a trunk. A utility compartment or glove compartment is deemed to be within the area occupied by the driver and passengers. This section does not apply to a public con- veyance that has been commercially chartered for group use or to the living quarters of a motor home or camper or, except as otherwise provided by the Edmonds City Code, to any passenger for compensation in a for -hire vehi- cle licensed under city, county, or state law. No person shall drive a motor vehicle over private property in order to avoid compli- ance with a traffic -control device. B.
