BONDS FOR OFFICERS

The finance director, city clerk, deputy city
clerk, chief of police and city attorney shall be
bonded and may be so bonded by an individual
bond policy or by a blanket bond policy
including other city employees, naming the
city of Edmonds as its beneficiary and bonding
all covered officers and employees for $5,000
or more for fidelity, for $5,000 or more for
faithful performance, and for $45,000 or more
as an aggregate excess fidelity coverage. The
surety for such bond shall be a surety company
authorized to do business in the state of Wash-
ington, or an unauthorized surety insurer as a
surplus line pursuant to Chapter 48.15 RCW.
Any such bond offered in satisfaction of this
section must be approved by the mayor. [Ord.

2.40.020 Premium payments.
The premium of bonds meeting the require-
ments of this chapter shall be paid by the city
of Edmonds. [Ord. 2317 § 2, 1982].
2.40.030 Refusal to give bond — Vacation
of office.
Upon the failure or refusal of any city
officer to give bond as required by law, and
within a reasonable time, the council shall
have the power to declare his office vacant.

FIREMEN'S RELIEF AND
PENSION SYSTEM

A. There is hereby created the Edmonds
firemen's pension board to consist of the fol-
lowing five members:
1. The mayor, who shall be chairman of
the board;
2. The city clerk;
3. The finance director; and
4. Two regularly employed firemen
elected by secret ballot of the firemen.
B. The first members to be elected by the
firemen shall serve for a term of one and two
years, respectively, and their successors shall
be elected annually for a two-year term. The
two firemen so elected shall, in turn, select a
third fireman who shall serve as an alternate in
the event of absence of one of the regularly
selected firemen. [Ord. 1133 § 1, 1965].
2.50.020 Secretary of board.
The board may select and appoint a secre-
tary who may, but need not be, a member of
the board. [Ord. 1133 § 1, 1965].
2.50.030 Chairman pro tempore.
In case of absence or inability of the chair-
man to act, the board may select a chairman
pro tempore who shall during such absence or
inability perform the duties and exercise the
powers of the chairman. [Ord. 1133 § 1, 1965].

A majority of the members of the board
shall constitute a quorum and have power to
transact business. [Ord. 1133 § 1, 19651.
2.50.050 Meetings and duties.
The board shall hold such meetings and per-
form those duties as prescribed to the board by
the applicable statutes of the state of Washing-
ton, specifically including Chapters 41.16 and
41.18 RCW as may be amended from time to

RESERVE FIRE FIGHTERS' RELIEF
AND PENSIONS ACT

The city of Edmonds fire department may
staff up to 15 "reserve" personnel to supple-
ment the career staff. [Ord. 3245 § 2, 1999;
Ord. 555 § 1, 1946].
2.60.020 Reserves enrolled — Purpose.
All of the reserve members of the city of
Edmonds fire department are hereby enrolled
under the relief and compensation provisions
of the Volunteer Fire Fighters' Relief and Pen-
sions Act of the state of Washington set forth
in Chapter 41.24 RCW for the purpose of pro-
viding protection for the reserves and their
families from death and disability arising in
the performance of their duties as a reserve.

2.60.030 Membership restrictions.
Any member of the reserve staff of the city
of Edmonds fire department may enroll under
the pension provisions of the said Volunteer
Fire Fighters' Relief and Pensions Act for the
purpose of enabling any such reserve so elect-
ing to avail himself/herself of the retirement
provisions of said act. [Ord. 3245 § 4, 1999;
Ord. 555 § 3, 1946].
2.60.040 Annual fees payable by city and
reserves.
The annual fee paid by the city of Edmonds
for each member of its fire department reserve
staff for the purpose of affording the benefits
derived from the state trust fund, and the fees
payable by the reserves where applicable, shall

be paid at those rates prescribed by state law,

The city of Edmonds has elected and does
elect to participate as a member of the state-
wide city employee's retirement system for
pension, relief, disability and retirement for
the employees of the city of Edmonds as pro-
vided by Chapter 41.44 RCW. It is the intent of
this chapter that only regular and full-time
employees and officers of said city shall be
included in said system; provided, however,
that other officers and employees of said city
may be included thereunder solely at the dis-
cretion of the city council; and provided, f ir-
ther, that no elective official shall be included
unless said official so elects and files a written
notice of such election with the board of trust-
ees of said pension system and with the city

2.70.020 Number of employees and
officials included.
The number of employees and officials,
other than elective officials, who shall be
included as members of said pension system is
approximately 30. [Ord. 856 § 2, 1960].
2.70.030 Basis for prior service credit.
The basis for prior service credit shall be
.6667 percent of final compensation known as

Whenever the city shall require the services
of a professional consultant, the responsible
city official or the consultant selection com-
mittee shall advertise the city's particular and
general requirements for professional consul-
tation services, shall interview, evaluate and
select a professional consultant, and shall
negotiate compensation for such services with
the selected professional consultant that is fair
and reasonable to the city; all of which shall be
performed as provided by this chapter. [Ord.

2.80.020 Definitions.
A. "Consultant selection committee" shall
be a five -member committee composed of the
mayor, two members of the city staff chosen
by the mayor and two members of the city
council chosen by the council president.
B. "Letter of interest" means a professional
consultant's statement of interest to compete
for the advertised project, plus a statement of
qualifications and performance data, the con-
tent of which shall be determined at the discre-
tion of the responsible official.

3.04.010 Fund established.
Pursuant to RCW 42.24.120, et seq., there is
hereby created and established a revolving
fund to be known as the "advance travel
expense revolving fund." Such fund shall be
used solely for the purpose of making advance
payments for the necessary travel expenses of
city officials and employees in excess of
$100.00. [Ord. 2188 § 1, 1980].
3.04.020 Appropriation — Replenishment.
There shall be appropriated and transferred
from general fund No. 001 amounts necessary
to sustain a level of $7,000 in the advance
travel expense revolving fund. From time to
time, as the fund is depleted by advance pay-
ments for travel expenses, the fund shall be
replenished by warrant or budgetary transfer
from the appropriate city department in the
amount necessary to maintain said fund bal-

3.04.030 Finance director —
Responsibilities.
The finance director shall be the custodian
of the fund and responsibility for supervising
all transactions thereof. All advances made
from the fund shall be made in accordance

with the rules and regulations prescribed by
the state auditor's office and the rules autho-
rized to be established by this chapter. The
advance travel expense revolving fund shall be
maintained in a bank as a checking account
and advances to officials or employees will be
by check drawn on such account payable to the
official or employee. [Ord. 2188 § 1, 1980].
3.04.040 Request for advance.
Whenever it becomes necessary for an
elected official or employee to travel and incur
expenses in excess of $100.00, that person
may request a reasonable amount of funds in
advance of said expenditure. The request for
advances shall be made on forms prescribed by
the finance director. [Ord. 2188 § 1, 1980].
3.04.050 Travel expense vouchers.
On or before the tenth day following the
close of the authorized travel period for which
expenses have been advanced to any official or
employee, that person shall submit to the
finance director a fully itemized travel expense
voucher for all reimbursable items legally
expended and accompanied by the unex-
pended portion of such advance, if any. Any
advance accounted for in the time and manner
specified herein shall bear interest at the rate of
10 percent per year from the date of default
until paid. No advance of any kind shall be
made to any officer or employee at any time
when that person is delinquent in accounting
for or repaying a prior advance authorized
under this chapter. [Ord. 2188 § 1, 1980].
3.04.060 Lien against funds payable to
officials and employees.
To protect the city from any losses on
account of travel expense advances, the city
shall have a prior lien against and a right to
withhold any and all funds payable or to
become payable by the city to any official or
employee to whom such advance has been
given up to the amount of such advance and
interest at the rate of 10 percent per year until

5.21.010 Purpose.
This chapter is intended to reduce the num-
ber of false requests for emergency assistance
or similar misuse of the 911 emergency
response system which occur within the city
and result in waste of city resources by provid-
ing for corrective administrative action,
including fees and potential discontinuance of
service for repeated violations. [Ord. 3252 § 1,
1999].
5.21.020 Definitions.
The following persons or words used in this
chapter shall be defined as set forth in this sec-
tion:
A. "Person" includes any natural person,
partnership, joint stock company, unincorpo-
rated association of society, or corporation of
any character whatsoever; and
B. "Misuse of the 911 system" is a request
for emergency response when no actual emer-
gency exists and when the caller does not have
a good faith basis to request emergency assis-
tance. This chapter shall not be applicable to
mechanical activations of request for assis-
tance which are dealt with in Chapter 5.20
ECC, nor shall it be interpreted to impose lia-
bility on any person who makes a good faith
request for emergency assistance based on a
reasonable factual basis that an emergency sit-
uation exists. [Ord. 3252 § 1, 1999].
5.21.040
5.21.030 Misuse of the 911 system —
Designated.
It shall be unlawful for any person to misuse
the 911 system. It shall be an affirmative
defense that the person charged has a good
faith, reasonable factual basis for the request.

5.21.040 Misuse of the 911 system — Fees.
A. The city shall impose the following
administrative sanctions upon the request of
the police or fire departments upon misuse of
the emergency medical response system:
1. Upon a first response to a premises at
which a request for emergency assistance has
been made by misuse of the 911 system, notice
of the conditions and requirements of this
chapter shall be given to the person requesting
emergency medical assistance. The notice
shall indicate both penalties imposed by this
chapter and that the city will cease to provide
emergency medical response to any address
following third misuse of the emergency med-
ical response system within a 12 -month
period.
2. If a second response to a premises
occurs as a result of misuse of the 911 system
within a 12 -month period, the person making
such calls shall, within three working days
after notice to do so submit a written report to
the chief of police on a form prescribed by the
city setting forth the reason for the misuse of
the system, the corrective action taken, if any,
and such other information as the chief of
police or his designee may require to deter-
mine the cause for the misuse of the emer-
gency medical response system, any
mitigating circumstances and necessary cor-
rective action which is called for. The chief of
police or his designee shall be authorized to
inspect the factual basis for the misuse of the
emergency medical response system, describe
necessary corrective action and give notice to
the person or persons residing at such address
the conditions and requirements of this chap-
ter. All costs of inspection and corrective

action shall be borne by the resident or resi-
dents of the premises.
3. If three or more responses to a resi-
dence occur within a six-month period based
upon misuse of the 911 system, an administra-
tive fee of $500.00 shall be assessed with
respect to each and every emergency response
which has occurred within the 12 -month
period.
B. Monetary assessments imposed in
accordance with this section shall be paid to
the city clerk within 15 days of the date of
notice. If the assessments are not paid within
this period, the city clerk shall forward the
matter to the city attorney for collection. [Ord.

5.21.050 Notice.
Notice of imposition of any administrative
decision or sanction, including the imposition
of a monetary assessment, shall be given to the
person(s) residing on such premises as well as
the owner of premises as shown on the tax
records of Snohomish County; provided, how-
ever, that with respect to a business premises,
the owner, manager, or chief administrative
agent regularly assigned and/or employed on
the premises at the time of the occurrence of
the deliberate misuse of the 911 system shall
be presumed to be the person to whom notice
shall be given. [Ord. 3252 § 1, 1999].
5.21.060 Penalty.
Unless otherwise provided in this chapter or
by state statute adopted by reference, any per-
son violating any provision of this chapter
shall be punished by fine not to exceed $5,000.
Such penalty shall be in addition to any fee
imposed and/or discontinuation of emergency

5.21.070 Resumption of service.
In the event that any premises is sold or
leased to new persons not responsible for such
violations, the chief of police, upon receipt of
written notification from the residents, shall

lift the administrative order and resume regu-
lar emergency medical or police response in
accordance with standard procedures. [Ord.
