[Ord. 2188 § 1, 1980]. 3.04.070 Purposes of travel expense advance. A travel expense advance shall be consid- ered as having been made to a city official or employee to be expended as an agent of the city and for the city's purposes only, and spe- cifically to defray necessary cost in the perfor- mance of official duties. No such advance shall be considered as a personal loan to such offi- cial or employee and any expenditure thereof, other than for official business purposes, shall be considered a misappropriation of public funds. [Ord. 2188 § 1, 1980]. 3.04.080 Credit cards. In accordance with the provisions of RCW 43.09.285 as the same exists or is hereafter amended authorizing political subdivisions to use credit cards for official government busi- ness, the finance director is hereby authorized to obtain credit cards from the city's designated official bank with an individual per -card limit of $2,000 and an aggregate credit limit on all cards of $50,000. The mayor and her designee, the finance director, shall establish rules and procedures regarding the use of credit cards by city employees for costs associated with offi- cial city business. The finance director is authorized to adopt reasonable rules and regulations for the opera- tion and management of the advance travel expense revolving fund and to prepare appro- priate forms for transactions involving such fund. Formerly 3.04.080]. 3.05.040 Chapter 3.05 EQUIPMENT RENTAL FUND Sections: 3.05.010 Created and established. 3.05.020 Administration. 3.05.030 Transfer of departments. 3.05.040 Placement of money. 3.05.050 Use of the fund. 3.05.060 Disposition of sale proceeds and purchases. 3.05.070 Rental charges — Schedule. 3.05.080 Accounts and records. 3.05.100 Manner of withdrawals and expenditures. 3.05.110 Retention of monies. 3.05.010 Created and established. There is hereby created and established a special fund to be known and designated as the "equipment rental fund", to be used as a revolving fund to be expended for salaries, wages, and operations required for the repair, replacement, purchase, and operation of equip- ment, and for the purchase of equipment, materials and supplies to be used in the admin- istration and operation of the fund. [Ord. 2568, 1986; Ord. 1111 § 1, 1965]. 3.05.020 Administration. The equipment rental fund shall be adminis- tered by the administrative services director under the direction of the mayor. [Ord. 2568, 1986; Ord. 1111 § 2, 1965]. 3.05.030 Transfer of departments. All equipment of all offices and departments of the city of Edmonds, except the fire depart- ment pumpers and aid cars shall be transferred to the equipment rental fund, without charge. [Ord. 2568, 1986; Ord. 1111 § 3, 1965]. 3.05.040 Placement of money. Money may be placed in the fund from time to time by the Edmonds city council. [Ord. 2568, 1986; Ord. 1111 § 4, 1965]. 3-7 (Revised 11/99) 3.05.050 3.05.050 Use of the fund. The city of Edmonds shall purchase and sell all equipment, except for the fire department pumpers and aid cars, by the use of such fund, subject to the laws governing the purchase and sale of property. Such equipment shall be rented for the use of the various offices and departments of the city and may be rented by the city to other governmental agencies. [Ord. 2568, 1986; Ord. 1111 § 5, 1965]. 3.05.060 Disposition of sale proceeds and purchases. The proceeds received by the city from the sale or rental of such equipment shall be placed in the equipment rental fund, and the purchase price of any such equipment or rental pay- ments made by the city shall be made from monies available in the fund. [Ord. 2568, 1986; Ord. 1111 § 6, 1965]. 3.05.070 Rental charges — Schedule. There shall be paid monthly into the equip- ment rental fund out of the monies available to the department using any such equipment, which has not been purchased by that depart- ment for its own use and out of its own funds, reasonable rental charges fixed by the city council of the city of Edmonds by approval of a schedule submitted at regular meetings of the city council by the administrative services director, which schedule shall be sufficient to cover the maintenance, operation and replace- ment of said equipment as set forth in ECC 3.05.010 herein, and which shall be revised from time to time to maintain the schedule so as to reflect the current and foreseeable needs of the equipment rental fund. [Ord. 2568, 1986; Ord. 1111 § 7, 1965]. 3.05.080 Accounts and records. There shall be kept, by those directed by the administrative services director, such books, accounts and records as are necessary to con- trol and report the financial operations of the equipment rental fund, and shall further subdi- (Revised 11/99) 3-8 vide the cash account thereof into two sepa- rately designated accounts as follows: A. Account "A", which shall be the "cur- rent operating account" into which shall be placed those portions of the charges made to the various departments or offices of the city of Edmonds, in accordance with the provisions of ECC 3.05.070 hereof, which are specifically billed to provide sufficient monies to pay the salaries and wages, materials, overhead and other costs necessary to operate and maintain all property rented thereto. There shall also be placed into Account "A" monies which may from time to time be specifically available thereto by action of the city council. B. Account `B", which shall be the "equip- ment reserve account" into which shall be placed those portions of the charges made to the various departments or offices of the city, in accordance with the provisions of ECC 3.05.070 thereof, which are specifically billed to provide sufficient monies, having first taken into consideration the necessary operating and maintenance costs billed under the preceding subsection A, to pay the costs of purchasing new equipment and replacing used equipment as required to carry out the purpose of the equipment rental fund. There shall also be placed in the Account "B" monies which are derived from the direct sale of any equipment or other capital assets of the fund and any mon- ies made specifically available thereto by action of the city council. [Ord. 2568, 1986; Ord. 1111 § 8, 1965]. 3.05.100 Manner of withdrawals and expenditures. Any withdrawals or expenditures from the equipment rental fund shall be made only in the following manner: A. Expenditures from Account "A" shall be made only upon duly approved payrolls and Edmonds City Code relating to his or her fitness to engage in the occupation of peddler, solicitor or street ven- dor and including, but not limited to, those misdemeanors and felonies involving moral turpitude, fraud or misrepresentation; 4. Been charged with a misdemeanor or felony of the type defined in the preceding sub- division (3) of this subsection, and disposition of that charge is still pending; 5. Been refused a license under the pro- visions of this chapter; provided, however, that any applicant denied a license under the provi- sions of this chapter may reapply if and when the reasons for denial no longer exist; and 6. Made any false or misleading state- ments in the application. E. Every peddler shall be required to carry the peddler's license and display it along with photo identification upon request by a pro- spective customer or law enforcement officer. F. The city clerk is authorized to promul- gate rules regarding the manner and method of payment, including a prohibition or regulation of payment by check, and the form of the appli- cation. It shall be the duty of the chief of police to investigate each applicant made under ECC 4.12.040, in which investigation the chief of police shall determine: A. The genuineness of all credentials pre- sented by the applicant and/or the individual solicitor, peddler or street vendor and the reli- ability of the product or services; B. If the applicant and/or its solicitor, ped- dler or street vendor has a criminal record; C. The truth of the facts set forth in the application; and D. If the applicant or solicitor, peddler or street vendor proposes to engage in a lawful and legitimate commercial or professional enterprise. 4.12.055 Such investigation must be completed within areasonable time. [Ord. 2536 § 1, 1985; Ord. 830 § 5, 1960]. 4.12.055 Street vendor requirements. Any person seeking a permit for a street ven- dor license under the definition of this chapter shall comply with the following requirements: A. Prior to issuance of any street vendor permit, the applicant shall submit and receive approval by the architectural design board for the design of the mobile vending cart and any signage. B. In addition to the licensing requirements of this chapter, any street vendor shall be required to obtain a street use permit. C. All advertising shall be placed on the mobile vending unit and will not be allowed on the street or sidewalk. Maximum sign area allowed shall be 10 square feet. D. The vending site shall be kept clean and orderly at all times, and the vendor must pro- vide a refuse container. No portion of a ven- dor's inventory, sales equipment, or any other structure or equipment used in the sales or solicitation process shall be left overnight upon any unenclosed portion of any lot or site within the city, nor upon any public street or right-of-way without the issuance of a street use permit for a mobile vending unit issued pursuant to ECC 4.12.030(B) and (C). E. The city reserves the right to limit the number of vending permit sites in any given area of the downtown. The community ser- vices director shall determine the allowable number of street vendors and shall exercise this discretion based upon the needs of the public, diversity of products offered for sale, the smooth flow of pedestrian and vehicular traffic and other similar considerations. F. If located on a sidewalk, a minimum clearance of five feet shall be maintained by any street vendor. G. If a street vendor locates on a street, the operation shall be oriented to the pedestrians on the sidewalk and not to vehicular traffic, if 4-9 (Revised 11/99) 4.12.060 such exposure would interfere with traffic flow. H. No mechanical audio or noise making devices, and no hawking is allowed. Hawking is the loud, repeated oral solicitation of busi- ness by the vendor or an assistant. I. Street vendors are prohibited in parks. J. All street vendors shall comply with all applicable Snohomish County Health District requirements. K. The applicant shall submit with his application a copy of the written approval for the vending site from the abutting property owner and/or tenant. In the event that the prop- erty owner or tenant shall disagree, the prop- erty owner's decision shall be final. 1. In the event that the proposed site abuts property owned by the city of Edmonds, the applicant shall be required to obtain the city's approval. Approvals relating to park property shall be handled as a request to let a concession under the terms of these ordi- nances. Request for sites abutting all other pub- lic land owned by the city shall be forwarded to the city council for their review and approval. 2. In the event that the site for which approval is sought abuts vacant land, the appli- cant shall make reasonable written attempts to secure the approval of the property owner. If the applicant is unable to do so, the city may accept written proof of such attempts and issue a conditional permit. If a complaint is later received from the owner of the land, the license shall be revoked. The granting of such a condi- tional license shall vest no right in the appli- cant. L. The maximum permissible size for any mobile vending unit shall be: 1. 30 square feet for sidewalk locations; and 2. 50 square feet for locations within the street or other public right-of-way or when located on private property. (Revised 11/99) 4-10 In no event shall any mobile vending unit exceed 10 feet in length. [Ord. 3270 § 1, 1999; Ord. 2536 § 1, 1985]. 4.12.060 Issuance of license — Expiration. The chief of police shall determine, within a reasonable time, from his investigation, that the facts set forth in the application are true, that the purpose of the applicant and its solici- tors, peddlers or street vendors is to engage in a lawful and legitimate commercial or profes- sional enterprise. Having determined these facts, he shall then approve the application and the city clerk may issue the license applied for. Such license shall expire on the 31 st day of December of the year in which such license has been issued. Except as hereinafter provided, no license shall be issued until the conclusion of the aforesaid investigation. [Ord. 2536 § 1, 1985; Ord. 830 § 6, 1960]. 4.12.065 Soliciting, peddling and street vending restrictions. All licenses issued pursuant to this chapter shall be subject to the following time and loca- tion restrictions: A. Fourth of July Fireworks Display. For the purpose of crowd and traffic control on the Fourth of July, all soliciting after 6:00 p.m. within one mile of the official fireworks dis- play shall take place only within the confines of the fireworks viewing area as designated by the chief of police on the Civic Center play - field. B. No peddler or solicitor shall engage or attempt to engage in the business of peddling at any home, residence, apartment complex or business that prominently displays a "No Ped- dlers" or "No Solicitors" sign or any other sim- ilar sign that communicates the occupants' desire to not be contacted by peddlers. C. No peddler or solicitor shall engage in the business of peddling between the hours of 8:00 p.m. and 9:00 a.m. [Ord. 2990 § 4, 1994; Ord. 2370 § 1, 1983]. Edmonds City Code 4.12.070 Carrying of license required. Such license shall be carried at all times by each solicitor, peddler or street vendor for whom issued, when soliciting, canvassing or street vending in the city of Edmonds, and shall be exhibited by any such solicitor, ped- dler or street vendor whenever and wherever he or she shall be requested to do so by any police officer or any person solicited. Such license may be revoked by the city of Edmonds for the violation by either the employer or the solicitor, peddler or street ven- dor of any of the ordinances of the city of Edmonds. It is the policy of the city of Edmonds to base salaries of elected officials on realistic stan- dards so that elected officials of the city may be paid according to the duties of their offices, and so that citizens of the highest quality may be attracted to public service. To effectuate this policy, the Edmonds citizens' commission on salaries of elected officials ("citizens' commis- sion") is hereby created consisting of seven members with duties and responsibilities as set forth below. [Ord. 3275 § 1, 19991. 10.80.020 Duties. The citizens' commission shall study the re- lationship of salaries for each respective posi- tion. Except as provided otherwise below, the citizens' commission shall be solely responsi- ble for its own organization, operation, and ac- tion and shall enjoy the fullest cooperation of all elected officials, departments and agencies of the city of Edmonds. [Ord. 3275 § 1, 1999]. 10.80.030 Eligibility. The citizens' commission shall consist of seven members, all of whom must be at least 21 years of age, registered to vote, and maintain personal residence within the boundaries of the city of Edmonds. No city of Edmonds official, or public employee, immediate family member of the official or employee shall be eligible for 10-25 (Revised 11/99) 10.80.040 membership on the citizens' commission. As used in this section, the phrase "immediate family" means parents, spouse, siblings, chil- dren, or dependent relative of the official or employee, whether or not they are living in the same household. [Ord. 3275 § 1, 1999]. 10.80.040 Appointment. Two members of the citizens' commission shall be appointed by the city council and one member shall be appointed by the mayor; the appointed three members shall select the other four members. The members of the commis- sion shall serve four-year terms beginning October 1, 1999, except that the first seven members shall be appointed for different terms as follows: (a) one member appointed by the city council for a period of four years; (b) one member appointed by the city council for a period of two years; (d) two of the members selected by those three members to serve for periods of four years; and (e) two of the mem- bers selected by those three members to serve for periods of two years. No person may serve more than two consecutive terms. Members of the commission may be removed by the mayor, with the approval of the council, only for cause of incapacity, incompetence, neglect of duty, malfeasance in office, or for a disqual- ifying change of eligibility. The unexcused absence of any member of the commission from two consecutive meetings of the commis- sion shall constitute relinquishment of that person's membership on the commission. Such relinquishment creates a vacancy in that person's position on the commission. Upon a vacancy in any position on the commission, a successor shall be selected and appointed to fill the unexpired term. The selection and appointment shall be concluded within 30 days of the date that position becomes vacant and shall be conducted in the same manner as orig- inally provided for that person's appointment. [Ord. 3275 § 1, 1999]. (Revised 11/99) 10-26 10.80.050 Operation. The members of the commission shall elect a chair from among their number. The commis- sion shall prepare a recommended schedule of salaries by an affirmative vote of not less than five members of the commission. Members of the commission shall receive no compensation for their services. [Ord. 3275 § 1, 1999]. 10.80.060 Salary schedule recommendation. The commission shall file its initial sched- ules of recommended salaries for elected offi- cials of the city with the city clerk no later than the first Monday in November, and shall file a recommended schedule on the same day every two years thereafter. The signature of the chair of the commission shall be affixed to each schedule submitted to the city clerk. The chair shall certify that the schedule has been adopted in accordance with the provisions of this char- ter and with the rules, if any, of the commis- sion. Such schedules shall become effective only upon adoption by the city council and in accord with state law. [Ord. 3275 § 1, 1999]. 10.80.070 Open meetings. All meetings, actions, hearings, and busi- ness of the commission shall be subject to the Open Public Meetings Act as set forth in Chap- ter 42.30 RCW. Prior to the filing of any salary schedule, the commission shall hold no fewer than two public hearings thereon within the two months immediately preceding the filing of its recommendation. [Ord. 3275 § 1, 1999]. 10.80.080 Referendum. Any ordinance enacting change of salary shall be subject to referendum petition by the citizens in accordance with city ordinance. Any ordinance which enacts a commission recommendation shall be subject to Section XI of the Washington State Constitution regard- ing increases of elected officials' salaries dur- ing their term of office. The mayor and council members shall receive reimbursement for their actual and nec- essary expenses incurred in the performance of the duties of their office, or the council by ordi- nance may provide for a per diem allowance.
