[Ord. 2535, 1985]. 2.06.070 Reimbursement of incurred expenses. A. If the city determines that an official or employee does not come within the provisions of this chapter, and a court of competent juris- diction later determines that such claim does come within the provisions of this chapter, then the city shall pay any judgment rendered against the official or employee and reasonable attorneys' fees incurred in defending against the claim. The city shall pay any attorneys' fees incurred in obtaining the determination that such claim is covered by the provisions of this chapter. B. If the city determines that a claim against a city official or employee does come within the provisions of this chapter, and a court of competent jurisdiction later finds that such claim does not come within the provisions of this chapter, then the city shall be reimbursed for costs or expenses incurred in obtaining the determination that such claim is not covered by the provisions of this chapter. [Ord. 2535, 1985]. 2.06.080 Conflict with provisions of insurance policies. Nothing contained in this chapter shall be construed to modify or amend any provision of any policy of insurance where any city official or employee thereof is the named insured. In the event of any conflict between this chapter and the provisions of any such policy of insur- ance, the policy provisions shall be controlling; provided, however, that nothing contained in this section shall be deemed to limit or restrict any employee's or official's right to full cover- age pursuant to this chapter, it being the intent of this chapter and section to provide the cov- erage detailed in this chapter outside and 2.06.090 beyond insurance policies which may be in effect, while not compromising the terms and conditions of such policies by any conflicting provision contained in this chapter. [Ord. 2535, 1985]. 2.06.090 Pending claims. The provisions of this chapter shall apply to any pending claim or lawsuit against an offi- cial or employee, or any such claim or law suit hereafter filed, irrespective of the date of the events or circumstances which are the basis of such claim or law suit. [Ord. 2535, 1985]. 2-7 (Revised 2/00) 2.10.010 Chapter 2.10 CONFIRMATION AND DUTIES OF CITY OFFICERS Sections: 2.10.010 Confirmation process. 2.10.020 Assignment of duties. 2.10.030 Police chief. 2.10.040 Fire chief. 2.10.050 References to director of community development. 2.10.060 Executive council assistant. 2.10.070 Mayor's executive assistant. 2.10.010 Confirmation process. A. Whenever a vacancy occurs in one of the positions listed in this section, the city council will review the specifications of that position and revise it as needed before the vacancy is filled. B. The mayor or his/her designee will review all applications and determine the per- sons with the highest qualifications. Any city council member, upon request to the mayor, may review the applications received for the vacant position. C. The mayor shall appoint, subject to city council confirmation, the positions of judge and hearing examiner. The hearing examiner may be removed from his/her position for cause, as determined by the mayor. The judge may be removed from his/her office for cause, as specified in RCW 3.50.095. D. The mayor shall appoint, subject to council confirmation, the department director positions of police chief, fire chief, community services director, administrative services director, development services director, parks and recreation director, public works director, and human resources director. The city council shall interview the top three candidates for each position prior to the mayor's final selec- tion. [Ord. 3279 § 1, 1999]. (Revised 2/00) 2-8 2.10.020 Assignment of duties. The department directors shall be responsi- ble for carrying out all directives as assigned by the mayor, including, but not limited to, planning and directing the activities and staff in their assigned department, supervising and evaluating the work processes and assigned staff, controlling the financial integrity of the assigned budget, and insuring the delivery of quality public services. All department direc- tors shall serve at the pleasure of the mayor. [Ord. 3279 § 1, 1999]. 2.10.030 Police chief. Pursuant to the authority of RCW 41.12.050, the position of police chief has been removed from civil service. The police chief shall be appointed by the mayor subject to con- firmation by majority vote of the city council. [Ord. 3279 § 1, 1999]. 2.10.040 Fire chief. Pursuant to RCW 41.08.050, the position of fire chief has been removed from civil service. The fire chief shall be appointed by the mayor subject to confirmation by majority vote of the city council. [Ord. 3279 § 1, 1999]. 2.10.050 References to director of community development. Wherever references are made in the Edmonds City Code or any ordinance of the city to the director of community develop- ment, said reference shall hereafter be con- strued to mean the development services department director or designee. [Ord. 3279 § 1, 1999]. 2.10.060 Executive council assistant. The executive council assistant shall be a contract employee hired on an annual basis by the city council. The terms and conditions of employment for the executive council assistant as well as all benefits shall be governed by the provisions of the contract. The contract shall provide for the delegation by the mayor of the Edmonds City Code direction of this individual to the city council president. In the event that the mayor elects in his or her discretion not to delegate that func- tion, the council reserves the right to immedi- ately eliminate the position. [Ord. 3279 § 1, 1999]. 2.10.070 Mayor's executive assistant. The position of mayor's executive assistant shall be an at -will position with the executive assistant serving at the pleasure of the mayor. The salary for the position is established by the annual salary ordinance. The terms and condi- tions of employment as well as job duties being set forth in a job description developed by the mayor with the concurrence of the city council. [Ord. 3279 § 1, 1999]. 2.15.020 Chapter 2.15 MUNICIPAL COURT Sections: sentences. 2.15.010 Court established. 2.15.020 Jurisdiction. 2.15.030 Judges — Appointment — 2.15.200 Qualifications. 2.15.040 Salaries and costs. 2.15.050 Municipal court employees. 2.15.060 Judges pro tem. 2.15.070 Judicial vacancy. 2.15.080 Municipal court hours. 2.15.120 Deferral and suspension of 2.15.010 Court established. There is hereby established a municipal court entitled "The Municipal Court of the city of Edmonds," hereinafter referred to as "municipal court," which court shall have jurisdiction and shall exercise all powers enu- merated herein and in Chapter 3.50 RCW together with such other powers and jurisdic- tion as are generally conferred upon such court in this state either by common law or by express statute. [Ord. 2538 § 2, 1985]. 2.15.020 Jurisdiction. The municipal court shall have exclusive original jurisdiction over traffic infractions arising under city ordinances and exclusive original criminal jurisdiction of all violations of city ordinances duly adopted by the city of Edmonds. There is hereby established a municipal court entitled "The Municipal Court of the city of Edmonds," hereinafter referred to as "municipal court," which court shall have jurisdiction and shall exercise all powers enu- merated herein and in Chapter 3.50 RCW together with such other powers and jurisdic- tion as are generally conferred upon such court in this state either by common law or by express statute. [Ord. 2538 § 2, 1985]. 2.15.020 Jurisdiction. The municipal court shall have exclusive original jurisdiction over traffic infractions arising under city ordinances and exclusive original criminal jurisdiction of all violations of city ordinances duly adopted by the city of Edmonds. The municipal court shall have orig- inal jurisdiction of all other actions brought to enforce or recover license penalties or forfei- 2-9 (Revised 2/00) 2.15.030 tures declared or given by such ordinances or by state statutes. The municipal court shall also have the jurisdiction as conferred by statute. The municipal court is empowered to forfeit cash bail or bail bonds and issue execution thereon; and in general to hear and determine all causes, civil or criminal, including traffic infractions, arising under such ordinances and to pronounce judgment in accordance there- with. [Ord. 2538 § 2, 1985]. 2.15.030 Judges — Appointment — Qualifications. A. The municipal judge shall be appointed by the mayor for a term of four years, subject to the confirmation by the city council. The first judicial appointment to the position of mayor was effective on January 1, 1986, and the municipal judge shall serve a four-year term commencing upon the date of his or her appointment. The mayor shall endeavor to make his or her appointment 30 days prior to the expiration of each judicial term; provided, however, that if the city council fails to con- firm a mayoral appointment, the mayor and city council shall have 60 days commencing upon either the expiration of the pending judi- cial term or the failure of the city council to confirm the mayoral appointment, whichever shall later occur. In the event that for any rea- son the mayoral appointment is not confirmed, the incumbent municipal judge shall hold over and continue in office until such time as a suc- cessor is appointed. B. A person appointed as municipal judge shall be a citizen of the United States of Amer- ica and of the state of Washington; and an attorney admitted to practice law before the courts of record of the state of Washington. [Ord. 3170 § 1, 1997; Ord. 2538 § 2, 1985]. 2.15.040 Salaries and costs. The salary of the municipal court judge shall be fixed by ordinance. Division managers (consisting of the planning manager, assistant fire chief, fire marshal, assistant police chief(2), building official, court administrator, cultural and rec- reational manager, parks manager, facilities manager, street manager, water/sewer man- ager, treatment plant manager, fleet manager, city engineer, accounting manager, and the city clerk) shall accrue annual vacation in accordance with the following schedule: Years of Employment Days of Vacation After the first six months of continuous employment Eight days of credit Second six months Eight days additional Two years through five years 16 days per year Six years through 11 years 21 days per year 12 years and thereafter 22 days per year 4. The police chief, fire chief, adminis- trative services director, community services director, public works director, parks and rec- reation director, human resources director and development services director shall accrue 22 days per year. Such accruals shall be credited on a semi-monthly basis with each employee's paycheck, except as provided above. The rate of accrual shall be reflected by a credit equal to the proportionate share of vacation earned for the period. 2.35.040 B. Employees are encouraged to use their accumulated vacation time within the year in which it is earned. Vacation accruals of up to one year's accumulation may be carried over from one year to the next. Employees who give notice of retirement within 24 months are authorized to accumulate two years accrual at any time prior to retirement. C. Vacation schedules must be submitted by each department not later than March 1 st of each year. D. Any employee whose service is honor- ably terminated after the completion of six months of continuous service shall be paid for any vacation time accumulated prior to the effective date of termination. When work beyond regular hours is required of an employee of the city (excluding those employees listed in subsection A below), compensating time off may be allowed as city requirements permit, subject to the following requirements: A. The following policies shall not apply to the department directors and division manag- ers listed below: Accounting manager Administrative services director Assistant fire chief Assistant police chief(s) City clerk City engineer Community services director Fire chief Fire marshal Human resources director Parks and recreation director Planning manager Police chief Public works director Wastewater treatment plant manager Building official Cultural and recreation manager Parks manager 2-21 (Revised 2/00) 2.35.045 Street manager Facilities manager Water/sewer manager Fleet manager The above employees shall receive a normal monthly salary and their presence or absence from their regular work schedule shall be reviewed in accordance with the mayor's administrative policies. B. Nonexempt employees, on their request and at the city's option, may be permitted to take compensating time off at the overtime rate of one and one-half times the actual overtime worked in lieu of payment; provided, that such employees may not accumulate more than 40 hours of compensating time and any compen- sating time off must be used within the 12 - month period following the date on which overtime is earned. C. All exempt employees other than those excluded by subsection A shall receive com- pensatory time for night meetings, emergency call outs, and other similar periods for which they are required by their supervisor to work. Compensating time shall not be earned for short extensions of regular work hours less than one hour in length, such as staying late or coming in early. Compensatory time for such exempt employees shall be earned at the straight time rate, one hour of compensatory time earned for each hour worked. The mea- surement of such time shall be in accordance with the mayor's administrative policies. Com- mencing January 1, 1990, such exempt employees shall be allowed to accumulate up to a maximum of 40 hours of compensatory time during any calendar year. The terms of use shall be as established by the mayor's admin- istrative policy. If an employee earns addi- tional compensatory time after he or she has accumulated the maximum, then the employee must either be paid for the additional time or provided time off during the next pay period. D. Compensating time shall be taken at the convenience of the city. All compensating time must be recorded and then approved by (Revised 2/00) 2-22 the employee's supervisor and/or department head. E. Upon termination, no exempt employees shall be paid for unused compensatory time unless time has been earned in excess of the 40 - hour maximum. Nonexempt employees shall be paid for unused compensating time at one and one-half times the overtime worked. How- ever, every effort should be made to use com- pensating time prior to termination. Intent. The purpose of shared leave is to permit city employees, at no additional em- ployee cost to the city other than the adminis- trative costs of administering the program, to come to the aid of a fellow city employee who is suffering from or has an immediate family member suffering from an extraordinary or se- vere illness, injury, impairment, or physical or mental conditions which has caused or is likely to cause the employee to take leave without pay or to terminate his or her employment. B. A department director, with the mayor's approval, may permit an employee to receive shared leave under this ordinance if: 1. The employee suffers, or has an immediate family member suffering from, an illness, injury, impairment, or physical or men- tal condition which is of an extraordinary or severe nature and which has caused, or is likely to cause, the employee to go on leave without pay status or to terminate his or her employment with the city. 2. The employee has depleted or will shortly deplete his or her total of accrued vaca- tion, sick leave, compensatory time, holiday time, and/or other paid leave. 3. Prior to the use of shared leave, the employee has abided by the city's sick leave policy. Edmonds City Code 4. The employee has diligently pursued and is found to be ineligible for state industrial insurance benefits. 5. The use of shared leave will not sig- nificantly increase the city's costs, except for those costs which would otherwise be incurred in the administration of this program or which would otherwise be incurred by the employee's department. C. The department director, with the con- currence of the mayor, shall determine the amount of shared leave, if any, which an employee may receive under this ordinance. The employee shall be required to provide appropriate medical justification and docu- mentation both of the necessity for the leave and the time which the employee can reason- ably be expected to be absent due to the condi- tion. An employee shall not receive more than a total of 131 days of shared leave throughout the employee's employment. To the extent possible, shared leave should be used on a con- secutive basis. D. Employees may request their depart- ment director to approve the transfer of a spec- ified amount of accrued vacation leave to an employee who is authorized to receive shared leave as provided herein. In order to be eligible to donate vacation leave, an employee must have a total of more than 10 days of accrued vacation leave, have taken at least 10 days of vacation leave within the calendar year or have a total of accrued and used vacation leave of greater than 10 days for the calendar year. Transfers shall be in increments of one day of leave. In no event shall a transfer of leave be approved which would result in an employee reducing his or her total vacation leave in a cal- endar year to less than 10 days. When review- ing police employees, the police chief may also consider whether additional adequate time off will be provided through compensatory and/or holiday leave unique to the department. The department director shall not transfer vacation leave in excess of the amount specified in the request. All donations of leave shall be volun- 2.35.045 tary. The department director shall determine that no significant increase in city costs will occur as a result of a donation of leave. E. Leave may be transferred from em- ployee(s) from one department to an employee of the same department, or, with the concur- rence of both department directors, to an em- ployee of another department. F. While an employee is on shared leave, he or she will continue to be classified as a city employee and shall receive the same treat- ment, in respect to salary and benefits, as the employee would otherwise receive if using vacation leave. 1. All salary benefit payments made to the employee on a shared leave shall be made by the department employing the person using the shared leave. 2. The employee's salary rate shall not change as a result of being on shared leave nor, under any circumstances, shall the total of the employee's salary and other benefits, includ- ing but not limited to state industrial insurance or any other benefit received as a result of pay- ments by the city to an insurer, health care pro- vider, or pension system, exceed the total of salary and benefits which the employee would have received had he or she been in a regular pay status. G. Vacation leave shall be transferred on a dollar -for -dollar basis. The value of the leave shall be determined at the current hourly wage of the transferor and the leave available to the receiving employee shall be calculated at the receiving employee's wage. H. The personnel department shall be responsible for computing the values of donated leave and shared leave, and shall also be responsible for adjusting the accrued leave balances to show the transferred leave. The administrative services director shall deter- mine the appropriate fund transfers and budget amendments as needed for city council action. Records of all leave time transferred shall be maintained in the event any unused time is returned at a later date. 2-23 (Revised 2/00) 2.35.050 I. The value of any leave transferred which remains unused shall be returned at its original value to the employee or employees who donated the leave. The department director shall determine when shared leave is no longer needed. To the extent administratively feasi- ble, the unused leave shall be returned on a pro rata basis. J. The personnel department shall monitor the use of shared leave to insure equivalent treatment for all employees of the city. Inap- propriate use or treatment of the shared leave provision may result in the cancellation of the donated leave or use of shared leave. [Ord. 2910 § 1, 1993; Ord. 2738 § 1, 1989]. 2.35.050 Emergency service. During an emergency all employees shall be available for extra duty as required by the city. [Ord. 1168 § 5, 1966]. 2.35.060 Sick leave. A. Represented employees accrue sick leave at the rate of and to the maximum estab- lished in the respective collective bargaining agreements. Nonrepresented employees shall accrue sick leave at the rate of one working day for each full calendar month of the employee's continuous service. The maximum amount of accrued sick leave shall not exceed 1,000 hours for such nonrepresented employees. B. Upon honorable termination, unused sick leave shall be paid to nonrepresented employees at a rate equal to one-half of the reg- ular rate of pay at the date of termination to a maximum of 800 hours. In the event of the death of an employee, the payment for unused sick leave shall be paid to the surviving spouse or to the estate of the decedent if there is no sur- viving spouse. Honorable termination means resignation or lay-off due to lack of work or funding and shall not include any discharge for cause. In the event that further or conflicting terms are established by the provisions of col- lective bargaining agreements, such provisions shall control such payments to represented (Revised 2/00) 2-24 employees in accordance with their respective collective bargaining agreement. C. An employee eligible for sick leave with pay shall be granted such leave for: 1. Personal illness or physical incapac- ity resulting from a cause beyond the employee's control; 2. Forced quarantine of the employee; 3. Upon approval of the mayor, the death of a member of an employee's immedi- ate family. D. The certificate of a physician and/or a written report concerning the need for the sick leave may be required by the city, and if so required shall be supplied by the employee in order to qualify for sick leave with pay. E. As an incentive to the appropriate use of sick leave, nonrepresented employees may earn additional leave hours on an inverse basis to the amount of sick leave used during the cal- endar year, in accordance with the following schedule: Hours of Annual Leave Sick Leave Used Hours Earned 0 24 8 16 16 8 24 0 Annual leave earned under this program shall be in the calendar year in which the leave was earned. Absences compensated through the state workers' compensation illness or injury program shall not be taken into consideration when applying the eligibility standards. The leave earned shall be pro -rated to the nearest full hour on the basis of sick leave used. F. Nonrepresented employees who have accrued in excess of 800 hours of sick leave may convert the excess hours to a cash pay- ment at the rate of three hours of sick leave for one hour of compensation at the employee's current rate of pay, up to a maximum of $1,000 per year. The human resources department shall notify the employee of his or her accrued Edmonds City Code sick leave hours with the last paycheck in August of each year. The sick leave payout shall be paid with the first paycheck in January. Employees must request the optional sick leave payout within 10 working days from the date notice of accrued sick leave was provided. In the event an employee is transferred from one position to another within the city, any accrued vacation time and/or accrued sick leave time and/or compensating time shall be available to the employee in his new position. [Ord. 1168 § 7, 1966]. 2.35.080 Extenuating circumstances. The foregoing provisions of this chapter shall be considered as minimum employee privileges, which may be extended for extenu- ating circumstances upon the approval of the mayor. [Ord. 1168 § 8, 1966].2 2.35.090 Conflict. In the event that any provision of this Chap- ter 2.35 ECC or any provision of this ECC Title 2 shall conflict with any provision of an employment contract or collective bargaining agreement approved by the city council, such contract or agreement shall prevail. In no event shall any employee be entitled to claim greater benefits under this chapter than those provided for by a collective bargaining agreement or employee contract covering said individual's employment. [Ord. 2571 § 3, 1986]. 2-24.1 2.35.090 (Revised 2/00) This page left intentionally blank. (Revised 2/00) 2-24.2 Edmonds City Code A. Public Utility Districts. Upon every per- son, firm, corporation or other entity engaged in or carrying on the business of selling or fur- nishing electrical energy and power a fee or tax equal in the following percentages is levied upon the total gross income from such busi- ness within the city of Edmonds during the tax year for which the license is required: 1. A fee or tax equal to six percent. 2. Until December 31, 2013 an addi- tional three-quarters of one percent for a total of six percent shall be levied; provided, how- ever that the additional three-quarters of one percent shall automatically expire and be repealed on December 31, 2013. 3. Provided, however, that there shall be no tax or fee upon revenues derived from the sale of electricity for the purposes of resale. B. Natural or Manufactured Gas and Ser- vice. Upon every person, firm, corporation or other entity engaged in or carrying on the busi- ness of transmitting, distributing, selling and furnishing natural and/or manufactured gas, a tax equal to 5-3/4 percent of the total gross income from the sale of gas within the corpo- rate limits of the city during and for the term for which the occupation license is required. C. Brokered Natural Gas — Use Tax in Lieu of Occupations Tax. There is imposed under the authority of RCW 35.21.870 a use tax on the consumers of brokered natural gas. Such tax shall be in lieu of the tax imposed by sub- section B above when consumers receive nat- ural gas directly from a producer of manufac- tured natural gas outside of the state of Washington. Such tax shall be the same as that imposed on a natural manufactured gas utility by subsection B, equal to 5-3/4 percent of the customer's monthly purchases or other use charge by the broker of out-of-state natural gas. D. Telephone Business. A tax equal to 5- 3/4 percent of the gross subscribers' exchange monthly service charges billed to business and residence customers located within the corpo- rate limits of the city, together with 5-3/4 per- cent of gross income derived from intrastate 3.20.060 toll service provided to business and residen- tial customers located within the corporate limits of the city. E. Pursuant to Chapter 4.68 ECC, Commu- nity Antenna Television Systems, commonly known as cable television franchisees, pay a franchise tax of three percent. In addition thereto, a tax is hereby levied equal to two per- cent of the gross receipts collected by the fran- chisee from the sale of its services in the city of Edmonds. This additional two percent is intended, when combined with the franchise fee of three percent, to provide a total of fran- chise fees and utility tax equalization amounts equal to five percent of the gross revenues of the franchisee derived from the sale of its cable television services within the city of Edmonds. Services shall include the sale of all broadcast services to subscribers, but shall not include revenues derived from the sale of advertising or other minor miscellaneous, incidental reve- nue unrelated to the sale of subscriber services or equipment rental. F. City Sewer Utility. The city of Edmonds, as a seller of sewer services, shall be subject to the tax imposed by this chapter. The sewer utility shall pay a license fee or tax equal to six percent on the gross income from the city's sewer utility. [Ord. 3281 § 1, 1999; Ord. 2899 § 1, 1992; Ord. 2837 § 3, 1991; Ord. 2775-A § 1, 1990; Ord. 2413, 1983; Ord. 2339 § 1, 1982]. 3.20.060 Exceptions and deductions. A. Interstate or Foreign Commerce. There shall be excepted and deducted from the total gross income upon which the license fee or tax is computed, so much thereof as is derived from the transactions in interstate or foreign commerce, or from business done for the gov- ernment of the United States, its officers or agents, and any amount paid by the taxpayer to the United States, the state of Washington or the city of Edmonds as excise taxes levied or imposed upon the sale or distribution of prop- erty or service. 3-17 (Revised 2/00) 3.20.070 B. Bad Debts. There shall be excepted and deducted from the total gross income upon which the license fee or tax is computed, all bad debts for services incurred, rendered or charged for during the tax year, or for a preced- ing tax year if the charge-off is made in the current tax years. Debts shall be deemed bad and uncollectible when the same have been written off the books of said income shall be reported in the return for tax year in which said debts are collected and at the rate prevailing in the tax year when collected. C. Cash Discounts. There shall be excepted and deducted from the total gross income upon which the license fee or tax is computed, all cash discounts allowed and actually granted to customers of the taxpayer during the tax year. D. Burden on Interstate Commerce. Noth- ing in this chapter shall be construed as requir- ing a license, or the payment of a license fee or tax, or the doing of any act, which would con- stitute an unlawful burden or interference in violation of the Constitution or laws of the United States or which would not be consistent with the Constitution or laws of the state of Washington. E. Deduction Allowed. Any person subject to the payment of a license fee or tax under the provisions of any ordinance of the city other than this chapter, on account of engaging in any activity for which he is liable to tax here- under, may deduct the amount of such fee or tax from the amount of fee or tax imposed by this chapter on account of such activity, but such persons shall, nevertheless, in the manner herein provided for, apply for and procure an "occupation license." F. There shall be excluded and deducted from the total gross income upon which the license fee or tax for telephone businesses and telecommunications companies is computed, the following: 1. That portion of the gross income de- rived from charges to another telecommunica- tions company, as defined in RCW 80.04.010, for connecting fees, switching charges, or car- (Revised 2/00) 3-18 rier access charges relating to intrastate toll telephone services, or for access to, or charges for, interstate services. 2. Charges by a taxpayer engaging in a telephone business or to a telecommunications company, as defined in RCW 80.04.010, for telephone service that the purchaser buys for the purpose of resale. 3. Adjustments made to a billing or to a customer account or to a telecommunications company accrual account in order to reverse a billing or charge that had been made as a result of third -party fraud or other crime and was not properly a debt of a customer. 4. Charges to cellular telephone service subscribers passed on to compensate for the cost to the company of the tax imposed by this chapter. 5. There shall be allowed as a deduction as to cellular telephone companies which keep their regular books of account on an accrual basis, for credit losses actually sustained by the taxpayer as a result of the cellular telephone business. [Ord. 3006 § 2, 1995; Ord. 917 § 6, 1962]. 3.20.070 Application for occupation license. A. On or before the first day of each tax year, every taxpayer shall apply for an "occu- pation license" on forms provided by the city clerk. The application shall require such infor- mation as may be necessary to enable the city clerk to arrive at the lawful amount of tax imposed by this chapter. B. The application form shall be signed and acknowledged before a notary public by an authorized representative of the taxpayer. [Ord. 2048 § 2, 1979; Ord. 917 § 7, 1962]. 3.20.080 Monthly payment of tax. The taxpayer shall pay the tax in monthly installments during the life of the occupation license within 25 days after the end of each calendar month. [Ord. 2048 § 3, 1979; Ord. 917 § 8, 1962]. Edmonds City Code 3.20.090 Commencement of business during tax year. Taxpayers commencing any business, occu- pation pursuit or privilege during any tax year shall acquire an occupation license as provided in this chapter. (Revised 2/00) 3-18.2 Edmonds City Code 4.50 (Public Massage Parlors and Public Bathhouses); 4.56 (Sound Trucks); 4.60 (Taxicabs) 4.64 (Garbage Collection); (Obstructing Public Places); 4.68 (Community Antenna Television Systems); or by 4.75 (Pawnbrokers); and except nonbusiness activities carried on by a religious, charitable, benevolent, fra- ternal or social organization and persons leas- ing one rental unit or one private residence. C. Rental Unit. The term "rental unit" shall mean a separate room or apartment leased for human occupancy and contained within a sin- gle structure, and shall include the operations of rooming houses, boarders within private residences and the operation of bed and break- fast establishments which otherwise meet the criteria of the exception created in the subpara- graph above. D. Private Residence. The term "private residence" shall mean a separate, free-standing structure leased for residential purposes and human occupancy by one "family" as defined by ECDC 21.30.010. [Ord. 2562, 1986; Ord. 2536 § 2, 1985; Ord. 2315 § 1, 1982]. 4.72.020 Business license required. It shall be unlawful for any person to oper- ate, engage in or practice any business in the city of Edmonds without first having obtained a business license from the city. If more than one business is located on a single premises, a separate license shall be required for each sep- arate business conducted, operated, engaged in or practiced. [Ord. 3282 § 1, 1999; Ord. 1139 § 1, 19651. 4.72.023 Registration of transient accommodations. It shall be unlawful for any person, partner- ship or corporation to operate a bed and break- fast establishment or other form of transient 4.72.030 accommodation without first registering such accommodation with the city's fire marshal. "Transient accommodation" shall mean any hotel, motel, condominium, resort or other facility regardless of size which offers rental of one or more lodging units on a daily or weekly basis. It shall not include rooms let on month- to-month leases or longer tenancies. Applica- tion for a business license shall satisfy the requirements of this section; any transient accommodation exempt from the provisions of this chapter shall register in writing with the fire marshal on a form designated for use by the fire marshal. Violations of this section shall be punishable by a fine of $20.00; each and every day of violation shall constitute a separate offense. [Ord. 2566 § 1, 1986]. 4.72.030 Procedure. A. Application for the business license shall be made in writing to the city clerk upon a form provided by the city clerk, and the applicant shall at the same time deposit with the city clerk in advance the license fee herein required. The application shall state the nature and address or addresses of the business or businesses, or proposed business or busi- nesses, of the applicant, and such other infor- mation as requested by the city clerk. B. If the applicant be a partnership, the application must be made by one of the part- ners; if a corporation, by one of the officers thereof; if a foreign corporation, partnership or nonresident individual, by the resident agent or local manager of the corporation, partnership or individual. C. The city clerk shall present all applica- tions for licenses to the mayor. The mayor shall cause an investigation of the application to be made by the proper city officials and shall grant or refuse to grant the license within 15 days of the date of application. If an application is refused the reason for refusal shall be desig- nated on the application. The fee shall not be refunded. [Ord. 1139 § 1, 1965]. 4-54.3 (Revised 2/00) 4.72.040 4.72.040 Fee — Terms — Penalty. A. Commending January 1, 1977, business licenses required to be obtained pursuant to this chapter, shall be issued on a calendar year basis and shall expire on December 31 st of the year for which they are issued. B. Fees for an annual business license issued hereunder shall be as follows: 1. The fee for an application for a new business license for any business to be oper- ated from real estate within the city of Edmonds shall be $65.00; and 2. The fee for an application for a new business license for any other business con- ducted for, under contract with or by providing services to any person within the city shall be $25.00; and 3. The fee for an application for an annual renewal of a business license shall be $25.00 for any business operated within the city of Edmonds. C. All businesses required to obtain licenses hereunder shall obtain the same and pay all fees required on or before February 15th of each respective year; provided, how- ever, that for the year 1981 only, businesses shall be required to obtain the licenses before April 1. Any business which fails to obtain and pay the license fees within said period of time shall, in addition to any other penalties pro- vided in this chapter, be assessed an amount equal to 50 percent of the license fee for said business as a penalty for such late application and/or payment. Notwithstanding any provisions hereof to the contrary, a license hereunder may not be issued to any person who uses or occupies or proposes to use or occupy any real property or otherwise conducts or proposes to conduct any business in violation of the provisions of any (Revised 2/00) 4-54.4 ordinance of the city of Edmonds or the stat- utes of the state of Washington. The granting of a business license shall in no way be con- strued as permission or acquiescence in a pro- hibited activity or other violation of the law. [Ord. 1139 § 1, 1965]. 4.72.060 Revocation or suspension. The city council shall, at any time, suspend or revoke any license issued hereunder when- ever the licensee or officer or partner thereof has been convicted in any court of competent jurisdiction of violating any statute of the United States or the state of Washington or any ordinance of the city of Edmonds upon the business premises stated in the license or in connection with the business stated in the license; or where the place of business does not conform to the ordinances of the city of Edmonds; provided, a hearing thereon shall be had before such revocation or suspension, and the licensee shall be notified in writing by sending the same to the address stated in the license of the intention of the city council to revoke or suspend said license at a regular meeting of the city council at a time and date denominated in the notification giving the lic- ensee at least six days' notice prior to the date for the hearing. The licensee may appear at that time and be heard in opposition to such revocation or suspension. [Ord. 1139 § 1, 1965]. 4.72.065 Transfer or sale of business — New license required. Upon the sale or transfer of any business licensed by this chapter, the license issued to the prior owner or transferor shall automati- cally expire on the date of such sale or transfer and the new owner intending to continue such business in the city of Edmonds shall apply for a new business license pursuant to the proce- dures established by this chapter. [Ord. 2315 § 2, 1982]. Edmonds City Code 4.72.070 Penalty for violation. Any person, as defined herein, and the offic- ers, directors, managing agents, or partners of any corporation, firm, partnership or other organization or business violating or failing to comply with any provisions of this chapter shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine in any sum not exceeding $250.00 or by imprison- ment for a period not exceeding nine months, or both, and each day of violation shall consti- tute a separate offense. Businesses which are not family-oriented and which may have an adverse impact upon family commerce, recreation, education and worship should be encouraged to locate in other communities where their patronage would be more probable and profitable, and where their impact would be more acceptable. To identify such businesses before issuing a business license to the same, the city of Edmonds shall require a study and review of probable impact on the community of any pro- posed business activity oriented towards serv- ing or attracting a special population of cus- tomers, and not oriented toward activities reasonably related to the health, education, safety and welfare of the family. [Ord. 2167 § 1, 1980]. 4.74.020 Community impact statement required. (Revised 2/00) 4-54.6 Edmonds City Code northwest corner of the northern breakwater of the port of Edmonds marina, that line extend- ing northwesterly 275 feet to a marker buoy, thence northeasterly 1,050 feet to a marker buoy, thence southeasterly to the northeastern end of the city of Edmonds public beach. B. The Edmonds parks and recreation department shall place appropriate notices pro- hibiting scuba and skin diving in the area above. [Ord. 2531, 1985; Ord. 1991 § 5, 1978; Ord. 1908, 1977]. 5.32.090 Diving allowed by special permission. The activities relating to underwater parks enumerated in ECC 5.32.060 through 5.32.085 shall be specifically prohibited except when: A. Express permission is granted in writing by any one of the following officials for the purpose of research: 1. The mayor or any department head of the city of Edmonds; 2. Any commissioner of the port of Edmonds, or the port manager; 3. The State Department of Fisheries. B. Express permission is granted for emer- gency operations by the mayor, any depart- ment head, any port commissioner, any police officer or any firefighter. C. The department of parks and recreation conducts organized activities under its super- vision. D. A permit is issued by the director of parks and recreation for the purpose of allow- ing maintenance by scuba divers to clean debris and garbage accumulated around Edmonds fishing piers on the following condi- tions: 1. The names of each diver are listed on the permit; 2. A hold harmless agreement and release is obtained from each diver prior to the issuance of a permit; 3. Adequate precautions are required to protect divers from other activities on or in the vicinity of the fishing pier; 5.32.105 4. Permit states the dates and time period during which the maintenance opera- tion shall be conducted; and 5. No marine life shall be removed from the water if that marine life is otherwise pro- tected by this chapter. It shall be unlawful for any person to violate any of the following regulations on the Edmonds public fishing pier at the Edmonds boat harbor adjacent to Dayton Beach Park: A. No person shall permit any animal to enter or remain on the fishing pier; provided, however, that this section shall not apply to seeing eye dogs that are being used by blind persons for the purpose of aiding them going from place to place. B. No person shall use or operate any wheeled vehicle upon the fishing pier, includ- ing but not limited to any motor vehicle, bicy- cle, roller skates or skateboard; provided, however, this section shall not apply to autho- rized police, fire and public works vehicles, wheelchairs being used by handicapped per- sons and carriages for infants. C. No person shall cast fishing tackle of any kind or description, including but not limited to, hooks, lines and/or sinkers, from the fishing pier at any location where signs are posted to prohibit such casting. It shall be unlawful for any person to knowingly engage in any of the following activities on any public beach in the city of Edmonds without first obtaining a permit from the Edmonds parks and recreation director or designee: 1. To take, possess, injure, or destroy any bird, mollusk, crustacean, marine or inter- tidal algae or plant, or any other marine or intertidal organism of any kind whatsoever. 5-47 (Revised 2/00) 5.32.107 2. To possess any device intended for the taking of birds, mollusks, crustaceans, marine or intertidal algae or plants or any other marine or intertidal organisms, including but not limited to shovels, clam "guns", buckets, crab pots or traps, hooks, spears or spear guns of every kind and description, nets for captur- ing or retaining in one's possession marine life, gaffs, or any other similar device. B. The parks and recreation director may issue permits for the collection of any marine life from public beaches, other than the Brack- ett's Landing Shoreline Sanctuary, whenever the issuance of such permit will not materially jeopardize the continued viability of marine life on such Edmonds public beaches, or other- wise be contrary to the continued use and enjoyment of the city's public beaches. C. Brackett's Landing Shoreline Sanctuary, as otherwise regulated by this chapter, shall not be subject to the provisions of this section. Pursuant to RCW 75.10.010, all city of Edmonds commissioned police officers with the primary function of enforcing criminal laws in general shall be deemed "ex officio" fisheries patrol officers for the purpose of enforcement of adopted shellfish regulations. [Ord. 2911 § 2, 1993]. 5.32.110 Prohibited acts within Brackett's Landing Shoreline Sanctuary. It is unlawful for any person to knowingly commit any of the following acts within the Brackett's Landing Shoreline Sanctuary except when permitted by special permit obtained as provided below: A. To injure, destroy or otherwise contrib- ute to the physical degradation of the habitat of any fish, bird, mollusk, crustacean, marine or intertidal algae or plant, or any other marine or intertidal organism. B. To take, possess, injure, or destroy any bird, mollusk, crustacean, marine or intertidal Edmonds City Code algae or plant, or any other marine or intertidal organism of any kind whatsoever. C. To possess any device intended for the taking of birds, mollusks, crustaceans, marine or intertidal algae or plants or any other marine or intertidal organisms, including but not lim- ited to shovels, clam "guns," buckets, crab pots or traps, hooks, spears or spear guns of every kind and description, nets for capturing or retaining in one's possession marine life, gaffs, or any other similar device. D. To ignite, fuel, maintain or permit any fire except a fire in a facility specifically designed for open fires and expressly desig- nated as such by the parks and recreation direc- tor, or contained cooking stoves including but not limited to a charcoal, gas or propane stove or grill. E. To operate or permit to operate any motorized boat except a Washington State Ferry to the extent necessary for docking oper- ations. Any person may engage in an activity prohibited by ECC 5.32.110(A) through (C); provided such person obtains and possesses a "Shoreline Sanctuary permit" issued by the director of parks and recreation or designee. B. Such permit shall only be issued upon a showing to the satisfaction of the parks and recreation director or designee that such per- mit is necessary for scientific research, educa- tional endeavors or because of an emergency threatening the public health, safety and/or general welfare or the marine life of such sanc- tuary. The permit shall set forth: 1. The activity allowed. 2. The dates such permit shall be effec- tive. 3. The names of the person to whom the permit is issued. [Ord. 2531, 1985; Ord. 2284 § 3, 1982]. 5.32.140 5.32.130 Acts deemed a public nuisance. Any action which materially injures or threatens harm to any marine organism in the Brackett's Landing Shoreline Sanctuary or which materially degrades the physical habitat of such marine organisms, shall be deemed a public nuisance subject to injunctive relief and civil damages for any such harm. A. Assault Defined. 1. A touch- ing, striking or contact is offensive if the touching, striking or contact would offend an ordinary person who is not unduly sensitive. 2. An assault is also an act done with an intent to inflict bodily injury upon another, intending, but failing to accomplish it, and accompanied by the apparent present ability to inflict the bodily injury if not prevented. It is not necessary that bodily injury be inflicted. 3. An assault is also an act, with unlaw- ful force, done with an intent to create in another apprehension and fear of bodily injury, and which in fact creates in another a reason- able apprehension and imminent fear of bodily injury even though the actor did not actually intend to inflict bodily injury. B. Exclusions and Defenses. 1. An act is not an assault if it is done with the consent of the person alleged to be assaulted. 2. Self defense shall be a complete defense to the charge of assault in the fourth degree, if the action was committed in self defense or defense of another; provided, that any such defense must be reasonable and nec- essary.
