poses hereinbefore ascribed to said account.
B. Expenditures from Account "B" shall be
made only upon duly approved vouchers of the
city for the purposes hereinbefore ascribed to

All monies in the equipment rental fund
shall be retained there from year to year and
shall not be transferred to any other fund or
expended for any other purpose. [Ord. 1111 §

CRIMINAL INVESTIGATION
CONTINGENCY FUND

There is created a revolving contingency
fund to provide monies for the purpose of sur-
veillance, prevention and investigation of vio-
lations of law, including the illicit sale, distri-
bution and use of narcotics, dangerous drugs or
controlled substances. Expenditures from the
fund shall be upon request of the chief or assis-
tant chief of the Edmonds police department,
subject to the approval of the mayor, for the
purposes set forth herein. This fund shall be a
revolving fund in an amount not to exceed
$5,000 and shall be funded by transfer from
available funds by the city finance director sub-
ject to the approval of the mayor. [Ord. 2739 §

DRUG ENFORCEMENT FUND

There is hereby created and established a
special fund to be known as the "drug enforce-
ment fund" into which (1) all monies and pro-
ceeds from the sale of property seized during
drug investigations and forfeited pursuant to
RCW 69.50.505 and all other applicable state
and federal laws; and (2) all monies received
by the city pursuant to a court order prescrib-
ing that such monies be used for drug enforce-
ment shall be deposited after amounts are
deducted in accordance with state and federal
laws. [Ord. 2739 § 2, 1989].
3.08.020 Purposes — Expenditures.
This fund has been established for the pur-
pose of accumulating funds for drug enforce-
ment needs, drug awareness educational
purposes and the purchase, lease and mainte-
nance of equipment and other items necessary
for drug enforcement by the Edmonds police
department. The monies deposited in the drug
enforcement fund shall be expended only for
such purposes and for no other purpose when
appropriated by the city council.
3.08.030 Unexpended funds.
Any unexpended funds remaining in the
drug enforcement fund at the end of any bud-

CUMULATIVE RESERVE FUND FOR

A. There is created a special cumulative
reserve fund, fire apparatus, to provide monies
for the maintenance, operation and acquiring of
apparatus used within the city and to further
provide for the training of personnel perform-
ing emergency aid services in aid of the opera-
tion of such fire apparatus.
B. Into such fund shall be paid all monies
presently in the custody or control of the
Edmonds Firefighters Association which have
been received by them as donations by virtue
of the services performed in connection with
the operation of the emergency aid cars and
other fire apparatus. Further, all such monies
transferred to the fund by the city or donations
from whatever source paid to the city or any
agency connected or affiliated with the city in
any way, and intended to be a donation arising
out of the use of the emergency aid car or fire
apparatus, or for the purpose of the continued
maintenance, operation or improvement of
such type of emergency vehicle services,
together with the training of personnel in con-
nection with the use thereof, by the city of
Edmonds, shall be held and utilized as pro-
vided below.
C. Expenditures from the fund shall be
solely for the purposes enunciated herein and
for no other purposes. All monies in the fund
shall be retained there from year to year and
shall not be transferred to any other fund or

3.14.010 Created.
There is hereby created a special fund enti-
tled the "enterprise fund" to be used as a
revolving fund for the expenditure of funds for
and from any and all expenses required to pur-
chase, design, imprint, promote and sell mer-
chandise with the city's name or emblem and
to be used in the administration and operation
of the fund and for the retention, investment or
reinvestment of principal and revenues
derived. [Ord. 3229 § 1, 1998].
3.14.020 Administration.
The enterprise fund shall be administered
under the direction of the mayor. [Ord. 3229 §
1, 1998].
3.14.030 Placement of money.
The Edmonds city council may, from time
to time, appropriate to the enterprise fund from
monies available for purposes for which the
fund has been authorized. [Ord. 3229 § 1,
1998].
3.14.040 Use of the fund.
The city shall sell licensed merchandise
bearing the city's name, emblem or other
devices which encourage economic develop-
ment and promote tourism, by the use of the
enterprise fund, subject to the laws governing
the purchase and sale of property. [Ord. 3229
§ 1, 1998].
3.14.070
3.14.050 Disposition of sale proceeds.
Proceeds received by the city from the sale
or distribution of licensed merchandise shall
be returned to the enterprise fund; provided,
however, that at the sole discretion of the city
council its original appropriation for the pur-
chase price of such merchandise or the cre-
ation of any emblem or device made by the
city may be withdrawn from money available
in the fund. The city council may, at its discre-
tion, withdraw surpluses for return to the gen-
eral fund or to terminate the fund. [Ord. 3229
§ 1, 1998].
3.14.060 Account and records.
The finance director shall cause to be kept
books, accounts and records as are necessary
to control and report the financial operations of
the enterprise fund, and shall further subdivide
the cash account into the following separate
accounts:
A. Account A, which shall be the "current
operating account" into which shall be placed
those portions of the charges made in accor-
dance with the provisions of ECC 3.14.070,
which shall be specifically used to purchase,
design, imprint, promote and sell city mer-
chandise and to administer and operate the
enterprise fund.
B. Account B, which shall be the "enter-
prise reserve account" into which shall be
placed those portions of charges made in accor-
dance with the provisions of ECC 3.14.070,
which are specifically billed to provide suffi-
cient money, having first taken into consider-
ation the necessary operating and administra-
tive costs billed under subsection A of this
section, to pay the costs of purchasing, design-
ing, imprinting, promoting and selling city
merchandise as required to carry out the pur-
pose of the enterprise fund. [Ord. 3229 § 1,

3.14.070 Charges — Schedule.
There shall be paid monthly into the enter-
prise fund money collected from the sale or

distribution of city merchandise. The charges
for city merchandise shall be sufficient to
cover the purchase, design, imprint, promote
and sell city merchandise and the administra-
tion and operation of the enterprise fund, and
may allow for a reasonable profit to permit the
city to keep a reserve account for times when
the enterprise account is not self-sufficient. All
profit collected shall be placed in the enter-
prise reserve account to carry out the purpose
of the enterprise fund. At its discretion, the city
council or mayor may authorize distribution of
merchandise at prices at or below cost of pro-
duction without charge in order to further law-
ful purposes, such as the encouragement of
economic development or promotion of tour-

a new fund for the purpose of receiving dona-
tions for or in aid of the cost of operating,

For the purposes of this chapter, the words
and terms used herein shall have the same
meaning given to each pursuant to Chapter
9.46 RCW as same exists or may from time to
time be amended; and as set forth under the
Rules of the Washington State Gambling
Commission, WAC Title 230 as the same
exists or may hereafter be amended, unless

3.24.015 Cardrooms as commercial stimulants
— Prohibited.
House -banked cardrooms as established under
RCW 9.46.0282 and social card games conducted
as commercial stimulants shall be prohibited with
the city of Edmonds. The terms "cardroom" and
"commercial stimulant" shall be defined as pro-
vided in ECC 3.24.010.
Section 2 of Ordinance 3330 provides as follows:
Section 2. A version of this ordinance was enacted
by Ordinance No. 3319 with a sunset date. Said
sunset date is hereby repealed. The provisions of
Section 1 shall be and remain in full force and effect
but shall not be implemented unless and until a sim-
ilar provision enacted by Ordinance No. 3328 in
accord with an initiative petition is struck down by
action of a court of competent jurisdiction.
Please consult the office of the city clerk to determine
the current status of the provisions regarding commer-
cial cardrooms.
3.24.016 Legal nonconforming uses.
All land uses operating social card games
which are currently in existence with the city,
which were legally established under land use
regulations in effect at the time of the estab-
lishment, and which have current gambling
licenses issued by the State Gambling Com-
mission may continue to operate at a current
level; provided, that such level is authorized by
the current gambling license. All such land
uses operating social card games:
A. Shall be considered legal nonconform-
ing uses under this act.
B. Shall not be expanded or intensified by
the addition of tables at which social card
games are played beyond the numbers autho-
rized by current gambling license.
C. Shall permanently cease operation upon
revocation or failure to renew license issued by
the Washington State Gambling Commission.

D. Shall permanently cease operation of
any table for social card games where opera-
tion is discontinued for more than 30 days.
E. Shall permanently cease operation if site
or tables for social card games are relocated,
reconstructed or redeveloped.
F. Shall permanently cease operation five
years after the ordinance codified in this sec-
tion is enacted. [Ord. 3328 § 2, 2000].
3.24.020 Persons subject to tax— Tax rate.
There is hereby levied upon all persons,
associations and organizations conducting or
operating within this jurisdiction any of the
activities listed below a tax to be paid to the city
of Edmonds in the amount hereafter specified:
A. Bingo and Raffles. A tax in an amount
equal to five percent of the gross receipts from
a bingo game or raffle less the amount awarded
as cash or merchandise prizes;
B. Amusement games shall not be subject to
the levy of a tax; provided, however, that such
games are authorized for operation pursuant to
the provisions of the Washington Administra-
tive Code, and shall be subject to the levy of a
fee in the amount of two percent of the gross
receipts from the amusement game, less the
amount awarded as prizes for the purpose of
providing for the city's actual costs of enforce-
ment of the laws of the state of Washington and
the ordinances of the city of Edmonds;
C. Punchboards or Pulltabs.
1. Bona fide charitable or nonprofit
organizations shall pay a tax in an amount
equal to 10 percent of the gross receipts from
the operation of the games, less the amount
awarded as prizes or merchandise; and
2. Commercial stimulant operators shall
pay a tax in an amount equal to five percent of
the gross receipts from the operation of punch -
boards and pulltabs;
D. Card Playing. Operators shall pay a tax
equal to the maximum tax rate allowed by the
Revised Code of Washington including RCW
9.46.110;

E. Exemptions.
1. Bingo and amusement games con-
ducted by a bona fide charitable or nonprofit
organization shall be exempt from the tax
imposed by subsections A and B of this sec-
tion, when such organization has no paid oper-
ating or management personnel, and gross
receipt from bingo or amusement games or a
combination thereof does not exceed $5,000
per year less the amount awarded as cash or
merchandise;
2. No tax may be imposed on the first
$10,000 of gross receipts, less the amount
awarded as cash or merchandise prizes, from
raffles conducted by any bona fide charitable
or nonprofit organization. [Ord. 3328 § 4,

3.24.030 Tax to be computed and paid
quarterly — Exceptions.
A. Each of the various taxes imposed by
this chapter shall be computed on the basis of
activity during each calendar quarter year, be
due and payable in quarterly installments and
remittance therefor, together with the return
forms, and be made to the city on or before the
last day of the next month succeeding the quar-
terly period in which the tax accrued. Such
payments shall be due on January 31st, April
30th, July 31st and October 31st of each
respective year.
B. Whenever any person, association or
organization taxed under this chapter quits
business, sells out or otherwise disposes of its
business, or terminates the business, any tax
due shall become due and payable immedi-
ately, and such taxpayer shall, within 10 days
thereafter, make a return and pay the tax due.
C. Whenever it appears to the city clerk that
the collection of taxes from any person, asso-
ciation or organization may be in jeopardy, the
clerk, after not less than 10 days' notice to the
taxpayer, is authorized to require that the tax -

payer remit taxes due and returns at such
shorter intervals than otherwise provided, as
the clerk deems appropriate under the circum-

3.24.040 Administration and collection of
tax.
A. Administration and collection of the
various taxes imposed by this chapter shall be
the responsibility of the city clerk. Remittance
of the amount due shall be accompanied by a
completed return form prescribed and pro-
vided by the clerk. The taxpayer shall be
required to swear and affirm that the informa-
tion given in the return is true, accurate and
complete.
B. The clerk is authorized, but not required,
to mail to taxpayers forms for returns. Failure
of the taxpayer to receive such a form shall not
excuse the taxpayer from making the return
and timely paying all taxes due. The clerk shall
have forms available to the public in reason-
able numbers at the civic center during regular
business hours.
C. In addition to the return form, a copy of
the taxpayer's quarterly report to the Washing-
ton State Gambling Commission required by
Chapter 230-08 WAC for the period in which
the tax accrued, shall accompany remittance of
the tax amount due. [Ord. 1766 § 5, 1975].
3.24.050 Method of payment.
Taxes payable hereunder shall be remitted
to the city clerk on or before the time required
by bank draft, certified check, cashier's check,
personal check, money order or in cash. If pay-
ment is made by draft or check, the tax shall
not be deemed paid until the draft or check is
honored in the usual course of business, nor
shall the acceptance of any sum by the clerk be
an acquittance or discharge of the tax unless
the amount paid is the full amount due. The
return and copy of the quarterly report to the
Washington State Gambling Commission
shall be filed in the office of the city clerk after

amount actually received from the taxpayer.

3.24.140 Limitation on right of recovery.
The right of recovery by the city from the
taxpayer for any tax provided hereunder shall
be outlawed after the expiration of three calen-
dar years from the date the tax became due.
The right of recovery against the city because
of overpayment of tax by any taxpayer shall be
outlawed after the expiration of three calendar
years from the date such payment was made.

3.24.200 Violation — Penalties.
A. Any person violating or failing to com-
ply with any of the provisions of this chapter,
except ECC 3.24.015, or any lawful rule or reg-
ulation adopted by the city clerk pursuant
thereto, upon conviction thereof, shall be sub-
ject to being punished by a fine in a sum not to
exceed $250.00, or by imprisonment in jail for
a term not exceeding 90 days or by both such
fine and imprisonment. Any taxpayer who en-
gages in or carries on in a gambling activity
subject to a tax hereunder without having com-
plied with the provisions of this chapter is
guilty of a violation of this chapter for each day
during which the gambling activity is con-
ducted.
B. Any person violating ECC 3.24.015 shall
have committed a gross misdemeanor and,
upon conviction thereof, shall be punished by
fine in an amount not to exceed $5,000 or
imprisonment for a term not to exceed one
year, or both such fine and imprisonment. [Ord.

3.24.300 Severability.
If any provision or section of this chapter is
held void or unconstitutional for any reason,
all other parts, provisions and sections of this
chapter not expressly so held to be void or
unconstitutional shall continue in full force

The city of Edmonds finds that mass public
transportation is essential and necessary for
the proper protection of the health, welfare and
safety of the citizens of Edmonds. In order to
provide the necessary services, the city has
contracted with the municipality of metropoli-
tan Seattle to provide the necessary services
for the citizens of Edmonds. The city council
of the city of Edmonds specifically finds that
the levying and collection of excise taxes
authorized by RCW 35.58.273 is essential to
provide adequate mass transportation services.

3.26.020 Levy of tax.
From and after January 1, 1976, there is lev-
ied a special excise tax of one percent on the
fair market value of every motor vehicle
owned by a resident of the city of Edmonds for
the privilege of using such motor vehicle in the
city of Edmonds; provided that in no event
shall said tax be less than $1.00. Subject to the
provisions of RCW 82.44.150(2), the amount
of such tax shall be credited against the amount
of the excise tax levied by the state of Wash -

ington pursuant to the provisions of RCW

3.26.030 Exemption.
Any vehicle for which an excise tax is pay-
able under RCW 82.44.030 and RCW
82.44.070 shall be exempt from the tax im-
posed by this chapter. [Ord. 1832 § 4, 1976].
3.26.040 Schedule and basis for tax.
The schedule and basis for the excise tax
imposed under the terms of this chapter shall
be as provided in RCW 82.44.040 through
82.44.050. Penalties, receipts, abatements,
refunds and all other similar matters relating to
the tax shall be as provided in Chapter 82.44
RCW. [Ord. 1832 § 5, 1976].
3.26.050 Procedure for collection.
The excise tax levied pursuant to this chap-
ter shall be due and payable as set forth in
RCW 82.44.060 and shall be collected by the
county auditor of Snohomish County and
remitted to the state at no cost to the city of
Edmonds. [Ord. 1832 § 6, 1976].
3.26.060 Purposes and uses of money.
All taxes levied and collected pursuant to
the provisions of this chapter shall be credited
to the city of Edmonds and shall be used solely
for the purpose of paying all or any part of the
cost of acquiring, constructing, equipping or
operating a publicly owned mass transporta-
tion system and related facilities or contracting
for the services thereof, or to pay to secure the
payment of all or part of the principal or inter-
est on any general obligation bonds or revenue
bonds issued for public transportation capital
purposes and until withdrawn for use the mon-
ies accumulated in such fund or funds may be
invested by the treasurer of the city of
Edmonds in the manner authorized by the city
council of the city of Edmonds, all pursuant to
RCW 35.58.279 as now exists or may hereaf-
ter be amended. [Ord. 1832 § 7, 1976].

3.26.070 Limitation on internal
combustion engines.
No new internal combustion powered equip-
ment shall be acquired with funds derived from
the taxes levied and collected herein or with
funds derived from general obligation bonds
wholly or partly secured by the taxes levied and
collected herein, unless it meets the standards
for control of pollutants emitted by internal
combustion engines as determined by the State
Air Pollution Control Board which standards
shall not be less than those required by similar
federal standards, all pursuant to RCW
35.58.2971 as now exists or may hereafter be
amended. [Ord. 1832 § 8, 1976].
3.26.080 Parking facilities.
The construction of parking facilities to be
wholly or partially financed with funds
derived from the taxes levied and collected
under this chapter or with funds derived from
the general obligation bonds wholly or par-
tially secured by taxes collected under this
chapter shall be in conjunction with and adja-
cent to public transportation stations or trans-
fer facilities, all pursuant to the provisions of
RCW 35.58.2792 as now exists or may hereaf-
ter be amended. [Ord. 1832 § 9, 1976].
3.26.090 Right-of-way limitations.
Before utilizing any excise tax money col-
lected pursuant to this chapter for the acquisi-
tion of right-of-way or construction of a mass
transit facility on a separate right-of-way, the
city council of the city of Edmonds shall adopt
rules, regulations and conduct hearings as pro-
vided in RCW 35.58.273 as now exists or may

3.26.100 Severability.
If any section, subsection, sentence, clause,
phrase or portion of the ordinance codified
herein is for any reason held invalid or uncon-
stitutional by any court of competent jurisdic-
tion, such portion shall be deemed a separate,

5.05.001 Introduction and purpose.
The purpose of this chapter is to provide for
the reasonable regulation of animals as well as
promote the public's health, safety and wel-
fare. It is the specific intent of this chapter to
place the responsibility and obligation of com-
plying with its requirements upon the owners
and keepers of animals. [Ord. 3322 § 1, 2000;

5.05.002 Penalties — Infraction unless
otherwise designated.
Unless otherwise set forth in this chapter, a
violation of any provision of this chapter shall
constitute a Class I civil infraction pursuant to
Chapter 7.80 RCW. Issuance and disposition
of infractions issued for violations of this chap-
ter shall be in accordance with Chapter 7.80
RCW. The penalty for violation of a provision
of this chapter shall be $40.00. The penalty for
a second or subsequent offense in violation of
the provision of this chapter within two years
shall be $100.00. [Ord. 3322 § 2, 2000; Ord.

5.05.010 Definitions.
A. "Animal control authority" means the
person, association or corporation, appointed
or authorized by the city of Edmonds and/or the
chief of police or his designee to enforce the
provisions of this chapter and all other ordi-
nances of the city pertaining to animal control.
B. "Animal control officers" means offic-
ers employed by the animal control authority
and includes police officers.
C. "At large" means off the premises of the
owner and not under the immediate control of
the owner, member of the owner's immediate
family, or person authorized by the owner, by

means of a leash, cord or chain no longer than
eight feet.
D. "Covered animal" means hoofed ani-
mals usually found on farms, such as horses,
ponies, mules, donkeys, bovine animal, sheep,
goats and/or swine.
E. "Dangerous dog" means any dog that,
according to the records of the animal control
authority, has: (1) inflicted severe injury on a
human being without provocation on public or
private property; (2) killed a domestic animal
without provocation while off the owner's
property; or (3) been previously found to be
potentially dangerous, the owner having
received notice of such and the dog again
aggressively bites, attacks, or endangers the
safety of humans or domestic animals; pro-
vided, however, that an animal shall not be
considered a "dangerous dog" if the threat,
injury, or damage was sustained by a person
who, at the time, was committing a willful tres-
pass or other tort upon the premises occupied
by the owner of the dog, or was tormenting,
abusing, or assaulting the dog or has, in the
past, been observed or reported to have tor-
mented, abused, or assaulted the dog or was
committing or attempting to commit a crime.
F. "Domestic animal" means any animal
that is usually tamed and bred by humans.
G. "Guard dog" means any member of the
dog family which has been trained or repre-
sented as trained to protect persons and/or
property by virtue of exhibiting hostile propen-
sities and aggressiveness to unauthorized per-
sons.
H. "Inherently dangerous animal" means
any live member of the canidae, felidae,
ursidae, and reptilia families, including hybrids
thereof, which, due to its inherent nature, may
be considered dangerous to humans. Inherently
dangerous animals include but are not neces-
sarily limited to:
1. Canidae, meaning and including any
member of the dog family not customarily
domesticated by man, or any hybrids thereof,
but not including domestic dogs and wolf

hybrids (cross between a wolf and a domestic
dog).
2. Felidae, meaning and including any
member of the cat family not customarily
domesticated by man, or any hybrids thereof,
but not including domestic cats.
3. Ursidae, meaning and including any
member of the bear family, or any hybrids
thereof.
4. Reptilia, meaning venomous and
"devenomized" reptiles, including but not nec-
essarily limited to all members of the follow-
ing families: helodermidae (gila monster),
viperidae (pit vipers), crotalidae (rattlesnakes),
atractaspidae (mole vipers), hydrophiidae (sea
snakes), and elapidae (coral snakes and
cobras).
5. Colubridae snakes which are rear
fanged, including, but not necessarily limited
to dispholidus typus (boomslangs), thebtorms
kirtlandii (African twig or vine snake), and
rhabdophis (keelbacks).
6. Colubridae snakes which reach a
length of 10 feet and over, including but not
necessarily limited to green anaconda, reticu-
lated pythons, Burmese python, albino Indian
python, and African rock python.
7. Crocodilia, meaning and including
crocodiles, alligators and caimans.
I. "Inhumane treatment" means every act or
omission whereby unnecessary or unjustifiable
physical pain or suffering is caused or permit-
ted.
J. "Own" means owning, keeping, leasing,
possessing or harboring any animal. "Owner"
means any person having an interest or right of
possession to an animal or any person having
control, custody or possession of an animal, or
by reason of the animal being seen residing
consistently at a location, shall be presumed to
be the owner.
K. "Person" means any person, firm, cor-
poration or association.
L. "Potentially dangerous dog" means any
dog that when unprovoked: (1) inflicts bites on
a human or a domestic animal either on public

or private property; or (2) chases or
approaches a person upon the streets, side-
walks, or any public grounds in a menacing
fashion or apparent attitude of attack, or any
dog with a known propensity, tendency, or dis-
position to attack unprovoked, to cause injury
or otherwise to threaten the safety of humans
or domestic animals.
M. "Poultry" means domestic fowl nor-
mally raised for eggs or meat, and includes
chickens, turkeys, ducks and geese.
N. "Proper enclosure of a dangerous dog"
means, while on the owner's property, a dan-
gerous dog shall be securely confined indoors
or in a securely enclosed and locked pen or
structure, suitable to prevent the entry of
young children and designed to prevent the
animal from escaping. Such pen or structure
shall have secure sides and a secure top, and
shall also provide protection from the elements
for the dog.
O. "Severe injury" means any physical
injury that results in broken bones or disfigur-
ing lacerations requiring multiple sutures or
cosmetic surgery.
P. "Vicious animal" means any animal
other than a "dangerous dog" or "potentially
dangerous dog" that endangers the safety of
any person, or domestic animal by biting or
attacking without provocation.
Q. "Wild animal" means any animal living
in its natural state and native to the United
States and not normally domesticated, raised
or bred by humans. [Ord. 3322 § 3, 2000; Ord.

5.05.020 Dog licensing.
A. License Required. It is unlawful for any
person to own any dog over the age of three
months within the city unless the owner has
first procured a license required by this chapter.
B. Dogs Excluded from License Require-
ments. The licensing provisions of this section
shall not apply to the following dogs:
1. Dogs whose owners are nonresidents
temporarily within the city;

2. Dogs brought into the city for the pur-
pose of participating in any dog show;
3. Seeing -eye guide and service dogs
properly trained to assist blind or impaired per-
sons, when such dogs are actually being used
by a blind or impaired person, for the purpose
of aiding them from place to place. Blind or
impaired persons include but are not necessar-
ily limited to persons who are blind, deaf, have
limited mobility, or have psychological impair-
ment; or
4. Dogs whose owner maintains them
for the sole purpose of commercial breeding
and/or training, hunting, or boarding, so long
as the dogs are restricted within a building or
fenced enclosure intended and designed only
for the purpose of kenneling dogs and are not
permitted to run at large.
C. License Tags Issued and Fees. The
police department, or such other person, firm
or entity authorized by the city council, shall
issue a dog license upon the payment of a fee
as provided for by this subsection. Upon issu-
ance of a license, a metal tag corresponding to
the number of the application shall be fur-
nished to the applicant.
1. The applicant shall cause the same to
be attached to the dog. Tags shall not be trans-
ferable from one dog to another.
2. The following fees shall be paid for
licenses required under this chapter:
a. For spayed females or neutered
males with a veterinarian certificate or signed
affidavit — an annual license fee of $5.00; pro-
vided, that a $3.00 fee shall be charged to per-
sons over the age of 65;
b. For dogs less than six months but
over three months of age, temporary tags
issued — a license fee of $5.00. Persons over
the age of 65 shall receive a rebate of $2.00 at
the time of relicensing, upon certification by a
veterinarian that the dog has been spayed or
neutered;
c. Unspayed females and unneutered
males over six months of age — $18.00;
d. Replacement of metal tag — $1.00.

3. An owner of an animal previously
licensed for which a "permanent" license has
been issued under the provisions of this section
as the same existed prior to December 16,
1986, shall not be required to relicense or
renew said license for such animal.
D. License Issuance — Nonresidents. Li-
censes shall be issued to nonresidents of the
city of Edmonds who reside in proximity to the
city and who desire to purchase an annual li-
cense for their dog for identification purposes.
The annual fee shall be $10.00 per year per
dog. Upon payment of said fee, a tag shall be
issued which shall be consistent with the tags
issued annually by the city of Edmonds for
dogs required to be licensed under this chapter.
The dogs permitted to be licensed by this sec-
tion shall not be eligible for temporary li-
censes. Nothing in this chapter shall require
the obtaining of such license nor shall failure
to obtain such a license as provided by this sec-
tion subject any dog owner to the penalties
provided for in this section; provided further,
that nothing in this section shall be construed
to relieve or otherwise excuse the owner of any
dog from complying with all applicable rules
and regulations imposed by any county, city or
town having jurisdiction over the residence
where the dog is harbored or maintained.
E. Fee Due Dates — Penalty.
1. All license fees shall be due and pay-
able on or before the first business day of Jan-
uary in each year. If the license fees are not
paid on or before March 1 st of each year, the
applicant shall pay the following late fees in
addition to the regular fee set forth in subsec-
tion C of this section:
a. Unspayed and unneutered dogs:
$18.00;
b. Spayed and neutered dogs: $10.00.
2. Whenever any person shall come into
charge, care or control of any dog, the original
license application and fee therefor shall
become due and payable within 30 days of said
date, and the late fee provided above shall be

imposed 60 days after the date said license fee
and application become due and payable.
F. Fee Waiver — Blind and Disabled. Guide
and service dogs, as defined in subsection
(B)(3) of this section, certified to assist the
impaired, and service dogs certified to assist
the disabled may be issued a permanent license
at no charge upon the request of a blind or oth-
erwise impaired owner.
G. Enforcement Procedure. All dogs not
licensed under this section, or who do not
exhibit the metal identification tag provided
for in subsection C of this section are declared
to be public nuisances and shall be impounded
as provided in ECC 5.05.126. [Ord. 3322 § 4,

5.05.025 Cat licensing.
A nonmandatory lifetime cat license is
available, upon request of the owner, for pur-
poses of identification. The fee for such license
shall be $5.00. [Ord. 3322 § 5, 2000].
5.05.030 Fees authorized.
In addition to the costs of publication of any
notice as required by this chapter, the animal
control authority shall be entitled to charge fees
under this chapter as follows:
A. Impound fees: $15.00;
B. Board and room per day: $11.00 or the
actual costs incurred, whichever is greater;
C. All other services: costs incurred. [Ord.

5.05.040 Animal bites to be reported.
Every animal which bites a person shall be
promptly reported to the animal control author-
ity and shall thereupon be securely quarantined
at the direction of the animal control authority
for a period of 10 days. At the discretion of the
animal control authority, such quarantine may
be on the premises of the owner, at the shelter
designated as the city's animal shelter or, at the
owner's option and expense, in a veterinary
hospital of the owner's choice. When an ani-
mal's owner is unknown, such quarantine shall

be at the shelter designated as a city animal
shelter or at a veterinary hospital. [Ord. 2711,
1989].
5.05.050 Running at large prohibited.
It shall be unlawful for the owner or person
having charge, care, custody or control of any
animal, with the exception of cats, to allow
such animal to run at large during any hours of
the day or night. This section shall not apply to
dogs owned by the city or other law enforce-
ment agencies and maintained as police K-9
units while under the custody and control of
the trainer or keeper. [Ord. 3322 § 7, 2000;

5.05.060 Dogs on public grounds.
A. It shall be unlawful for an owner to allow
any dog to stray and/or enter with or without a
leash or other means of restraint upon any
school ground, playfield, park, beach, water-
front or other public property.
B. Notwithstanding the restrictions set forth
in subsection A of this section, dogs accompa-
nied by their owners may be walked or exer-
cised while on leash in the following areas:
1. The Inner Trails of Yost Park, in the
area commonly known as the Shell Valley
area; and
2. Marina Beach Park, in the area south
of the Union Oil loading terminal, such area
being further described to be a walking strip of
50 feet in width at the entrance of and along the
east end of Marina Beach Park South; and
3. The asphalted pathways in Sierra
Park; and
4. The inner trails of Pine Ridge Park;
and
5. All trails in Maplewood Park; and
6. The southeast wooded area of City
Park; and
7. The turf area of Mathay-Ballinger
Park; and
8. The asphalted pathways of Seaview
Park.

C. All dogs permitted in the areas desig-
nated in subsection B of this section shall be on
a leash except for dogs permitted in Marina
Beach Park South.
D. Nothing herein shall be determined to
require the posting of notices to exclude ani-
mals; provided, however, that such postings
may be undertaken at the discretion of the man-
ager of parks and recreation.
E. The regulations under ECC 5.05.070
relating to animal waste and the removal and
proper disposal of said waste, will be strictly
enforced. [Ord. 3073 § 1, 1996; Ord. 3033 § 1,

5.05.070 Animal waste.
A. It shall be unlawful for the owner or per-
son having charge of any animal to permit,
either willfully or by failure to exercise due
care, such animal to commit a public nuisance
by defecating in any area of the city other than
the premises of the owner or person having
charge or control of the animal, unless said
owner or person having charge takes immedi-
ate steps to remove and properly dispose of
said feces.
B. It shall be unlawful for the owner or per-
son having charge of any animal to take said
animal off of the private property of said per-
son without having in the possession of the
owner or person having charge of the animal,
a proper means of disposal for the feces of the
animal.
C. Disposal is defined, for the purposes of
this section, as the removal of feces by means
of a bag, scoop or other device and an eventual
disposal in a trash receptacle, by burying or by
other means of lawful disposal. [Ord. 3322 § 8,

5.05.080 Confining dogs in season.
The owner or person having charge of any
unspayed female dog shall confine such dog in
a building or enclosed area during the period
such dog is in season. [Ord. 2711, 1989].

5.05.090 Rabies notice.
A. If an animal is believed to have rabies or
has been bitten by an animal suspected of hav-
ing rabies, such animal shall be confined on the
owner's premises and shall be subject to exam-
ination and observation of a veterinarian at the
expense of the owner for a period of 10 days.
The owner shall notify the city of the fact that
his animal has been exposed to rabies and the
animal control authority is empowered to have
such animal removed from the owner's pre-
mises to a veterinary hospital for observation
for a period of up to 10 days at the owner's
expense.
B. It is unlawful for any person knowing or
suspecting an animal has rabies to allow such
animal to be taken off the owner's premises
without the written permission of the animal
control authority. Every owner or other per-
son, upon ascertaining an animal is rabid, shall
immediately notify the animal control author-
ity or a police officer, who shall either remove
the animal to the designated shelter or sum-
marily destroy it. [Ord. 3322 § 9, 2000; Ord.
2711, 1989].
5.05.095 Notice of "dangerous dog"
declaration.
Upon declaration by the animal control
authority that a dog is a "dangerous dog" under
Chapter 16.08 RCW, the owner, or person hav-
ing physical charge and control of the dog if
the identity of the owner cannot be reasonably
ascertained, shall be supplied with written
notice of said declaration as set forth in ECC
5.05.120. [Ord. 3322 § 10, 2000].
5.05.100 Dangerous dogs — Registration,
prohibitions, etc.
A. Licensing. In addition to any license
required under the provisions of this chapter,
all dog owners who are required to obtain a
"certificate of registration" pursuant to the dan-
gerous dog provisions of Chapter 16.08 RCW,
must obtain a "City of Edmonds Dangerous
Dog Certificate of Registration." The applicant

shall apply for such certificate upon forms sup-
plied by the city clerk and pay an annual fee of
$100.00, which shall not be prorated for any
part of a year. A copy of a valid "certificate of
registration" issued pursuant to Chapter 16.08
RCW shall be attached to the application. The
"City of Edmonds Dangerous Dog Certificate
of Registration" shall be issued upon complet-
ing the requirements of this section.
B. It is unlawful for an owner to have a dan-
gerous dog in the city of Edmonds without a
"certificate of registration" as required by
Chapter 16.08 RCW and a "City of Edmonds
Dangerous Dog Certificate of Registration" as
required by this section.
C. It is unlawful for an owner of a danger-
ous dog to permit the dog to be outside the
"proper enclosure" as defined in ECC
5.05.010, unless the dog is muzzled and re-
strained by a substantial chain or leash and un-
der physical restraint of a responsible person.
The muzzle shall be made in a manner that will
not cause injury to the dog nor interfere with its
vision or respiration but shall prevent it from
biting any person or animal. The owner of a
dangerous dog shall further be required to post
the premises with a clearly visible warning sign
that there is a dangerous dog on the property.
In addition, the owner shall conspicuously dis-
play a sign with a warning symbol that informs
children of the presence of a dangerous dog.
D. Any dangerous dog shall be immedi-
ately confiscated by the animal control author-
ity if:
1. The dog is not validly registered
under this section and Chapter 16.08 RCW;
2. The owner does not secure liability
insurance coverage or a surety bond as
required by Chapter 16.08 RCW;
3. The dog is not maintained in a proper
enclosure; or
4. The dog is outside of the dwelling of
the owner or outside of a proper enclosure and
not under physical restraint of a responsible
person.
5.05.100
The dog shall not thereafter be released to
the owner except as provided for in subsec-
tions (F) and (G)(5) of this section
E. The provisions of this section shall not
apply to dogs used by law enforcement offi-
cials for police work.
F. It shall constitute a gross misdemeanor
for the owner or, if the owner does not have
physical charge of the dog, the person who has
physical charge of a dog to be criminally neg-
ligent in permitting any of the conditions in
subsection D of this section to occur. "Criminal
negligence" shall apply as defined in RCW
9A.08.010(1)(d) and RCW 9A.08.010(2) as
now or hereafter amended. In its ruling on the
criminal culpability of the owner or person in
charge of the animal, the hearing examiner
shall also determine if any of the conditions of
subsection D of this section has occurred. If the
hearing examiner finds that any of the condi-
tions for confiscation of subsection D has
occurred, the dog shall be destroyed upon the
expiration of any applicable appeals period
unless the hearing examiner rules otherwise or
unless the decision of the hearing examiner is
appealed. In the case of an appeal the dog shall
only be destroyed upon the exhaustion of all
appeals and a final ruling that one or more of
the conditions for confiscation of subsection D
has occurred. If it is found that none of the con-
ditions of subsection D has occurred and the
hearing has not been appealed by the city of
Edmonds, the dog shall be released to the
owner or person having physical charge of the
dog if the identity of the owner cannot be rea-
sonably ascertained, unless otherwise ordered
by the hearing examiner The dog shall be
destroyed if no request is made for the dog
within 14 days of the date a finding is made that
the none of the conditions for confiscation of
subsection D has occurred.
G. 1. Upon the confiscation of a dog under
the provisions of subsection D of this section
the owner or person having physical charge
and control of the dog if the identity of the
owner cannot be reasonably ascertained shall

be supplied with written notice of said confis-
cation with the following contents:
a. The name and address, if known,
of the owner or, if the identity of the owner
cannot be reasonably ascertained, the person
having physical charge and control of the dog;
b. The license number, if available,
and description of the dog;
c. A statement that the animal control
authority has confiscated the dog under the
provisions of subsection D of this section and
a brief, concise statement as to why this provi-
sion of the Edmonds City Code applied in this
situation; and
d. Statements advising that:
i. Persons having a legal interest
in the dog may appeal the confiscation to the
hearing examiner; provided the appeal is made
in writing as provided by this chapter and filed
with the head of the animal control authority
within 14 days from the date of service of such
notice; and
ii. Failure to appeal will constitute
a waiver to all right to administrative hearing
and appeal of the confiscation;
iii. Nothing herein shall be
deemed to limit the authority of any police
officer or animal control officer to take up and
impound the dog as otherwise allowed.
2. Notice shall be served in accordance
with ECC 5.05.121(C) except that if the iden-
tity of the owner cannot be reasonably ascer-
tained, the person having physical charge and
control of the dog shall be served instead.
3. The designated hearing examiner
under the provisions of this section shall be the
Judge of the Edmonds Municipal Court. Such
hearing examiner is to hear appeals by parties
aggrieved by actions of the animal control
authority pursuant to the provisions of this sec-
tion. All decisions and findings of the hearing
examiner shall be in writing, with a copy to the
chief of police as head of the animal control
authority.
4. The appeal form and procedures shall
be governed by ECC 5.05.123 and 5.05.124.

5. If the owner or person who was
served with notice as required herein does not
file an appeal within the time required by sub-
section (G)(1)(d)(i) of this section, the dog
shall be immediately destroyed. If an appeal is
filed and the hearing examiner finds that any of
the conditions for confiscation of subsection D
of this section have occurred, the dog shall be
destroyed upon the expiration of any applica-
ble appeals period unless the hearing examiner
rules otherwise or unless the decision of the
hearing examiner is appealed. In the case of an
appeal the dog shall only be destroyed upon the
exhaustion of all appeals and a final ruling that
one or more of the conditions for confiscation
of subsection D has occurred. If it is found that
none of the provisions of subsection D have
been violated and the hearing has not been
appealed by the city of Edmonds, the dog shall
be released to the owner or person having phys-
ical charge of the dog if the identity of the
owner cannot be reasonably ascertained, unless
otherwise ordered by the hearing examiner.
The dog shall be destroyed if the owner or per-
son having physical charge of the dog does not
acquire the dog within 14 days of the date a
finding is made that none of the conditions for
confiscation of subsection D have occurred,
unless the animal control authority determines
that good cause exists to extend this 14 -day
period.
6. Notice need not be served and this sub-
section will not apply if the owner of the con-
fiscated dog or person having physical charge
of the dog is charged with a gross misde-
meanor as provided in subsection F of this sec-
tion. All proceedings under this subsection
shall be terminated if the dog owner is subse-
quently charged with a gross misdemeanor
under subsection F. [Ord. 3040 § § 1— 3, 1995;

5.05.105 Appeal to determination of
"dangerous dog".

5.05.110 Enforcement power.
A. The animal control authority and its of-
ficers are authorized to take such lawful action
as may be required to enforce the provisions of
this chapter and the laws of the state of Wash-
ington as they pertain to animal cruelty, shelter,
welfare and enforcement of animal control.
B. No person shall fail or neglect, after a
proper warrant has been presented, to promptly
permit the director or his authorized animal
control officer or city law enforcement officer
to enter private property to perform any duty
imposed by this chapter. [Ord. 2711, 1989].
5.05.115 Nuisances defined.
A. All violations of this chapter are detri-
mental to the public health, safety and welfare
and are declared to be public nuisances.
B. Nuisances are hereby defined to include:
1. Any animal which chases, runs after
or jumps at vehicles using public streets and
alleys;
2. Any animal which habitually snaps,
growls, snarls, jumps upon or otherwise threat-
ens persons lawfully using the public side-
walks, streets, alleys or other public ways;
3. Any animal which has exhibited vi-
cious propensities and which constitutes a dan-
ger to the safety of persons or property off his
premises or lawfully on his premises;
4. A vicious animal or animal with
vicious propensities which runs at large at any
time, or such an animal off the owner's pre-
mises not securely leashed on a line or con-
fined and in the control of a person of suitable
age and discretion to control or restrain such
animal;
5. Any animal which howls, yelps,
whines, barks or makes any noises in such a
manner as to disturb any person or neighbor-
hood to an unreasonable degree;
6. Animals kept, harbored or maintained
and known to have a contagious disease,
unless under the treatment of a licensed veter-
inarian;
7. Animals running in packs;

8. Any dog running at large within the
city;
9. A female animal, whether licensed or
not, while in season, accessible to other ani-
mals for purposes other than controlled and
planned breeding;
10. Any animal which causes damage to
property other than the property of the ani-
mal's owner or person having physical charge
and control of the animal; or
11. Any animal maintained in violation
of any provision of this chapter.
C. All nuisances under this chapter shall be
abated as provided in this chapter. In addition,
any owner or person having charge of any ani-
mal who fails to abate such nuisance shall be
guilty of a misdemeanor with a maximum pen-
alty of $1,000 fine and/or 90 days in jail. [Ord.

5.05.120 Nuisance — Notice and order to
abate.
A. Notices — When Required. Whenever
it shall be stated in writing by an animal con-
trol officer or by three or more persons having
separate residences or regularly employed in
any neighborhood that any animal is a nui-
sance as defined in EMC 5.05.115, the animal
control authority shall serve a notice of viola-
tion and order as set forth in EMC 5.05.121
upon the owner or person having physical
charge and control of the animal directing that
the nuisance be abated. This section shall not
apply to enforcement of Chapter 16.08 RCW
relating to dangerous dogs. Appeal of a nui-
sance order shall be governed by EMC
5.05.123 and 5.05.124. [Ord. 3322 § 13, 2000;

5.05.121 Contents of declaration of
"dangerous dog" notice and
order — Service thereof.
A. The notice and order, or declaration of
dangerous dog, shall contain:

1. The name and address, if known, of
the owner or person having physical charge
and control of the animal if the identity of the
owner cannot be reasonably ascertained;
2. The license number, if available, and
description of the animal or dog;
3. A statement that the animal control
authority has found:
a. The animal to be a "dangerous
dog" as defined in Chapter 16.08 RCW and a
brief concise statement as to why the declara-
tion has been made; or
b. The animal maintained illegally,
with a brief and concise description of the con-
ditions found to render the owner in violation
of this chapter;
4. A statement of the action required to
be taken, as determined by the chief of police
as head of the animal control authority:
a. If the animal control authority has
determined the nuisance must be abated, the
order shall require that the abatement shall be
completed within a certain time from the date
of the order, as determined by the chief of
police to be reasonable;
b. If the hearing examiner has
assessed a civil penalty, the order shall require
that the penalty shall be paid within 14 days
from the date of the order; and
5. Statements advising that, if any
required abatement is not commenced within
the time specified, the animal control authority
will proceed to cause abatement and charge the
costs thereof against the owner.
B. Nothing herein shall be deemed to limit
the authority of any police officer or animal
control officer to take up and impound an ani-
mal or dog as otherwise allowed.
C. Service of Notice. Notice shall be served
in accordance with the following provisions:
1. The notice and order shall be served
on the owner or presumed owner of the animal
in violation or declared a "dangerous dog." If
the identity of the owner cannot be reasonably
ascertained, the person having physical cus-

tody of the animal or dog shall be served
instead.
2. Service of the order shall be made
upon all persons entitled thereto, either person-
ally or by mailing a copy of such notice by cer-
tified mail, postage prepaid, return receipt
requested, to each person at his/her last known
address;
3. Proof of service of any declaration of
"dangerous dog," or notice and order shall be
made at the time of service by a written decla-
ration under penalty of perjury executed by the
person affecting service, declaring the time,
date and manner in which service was made.
D. The appeal form and appeal procedures
for this section shall be governed by ECC
5.05.123 and 5.05.124. [Ord. 3322 § 14, 2000].
5.05.122 Appeal — Authority.
The designated hearing examiner under the
provisions of this chapter shall be the judge of
the Edmonds municipal court or his or her des-
ignee. The hearing examiner shall hear any ap-
peal from an order to abate a nuisance issued
pursuant to ECC 5.05.120 and declarations of
dangerous dogs issued pursuant to EMC
5.05.121. [Ord. 3322 § 15, 2000; Ord. 2711,

5.05.123 Appeal — Form.
Any person entitled to service under ECC
5.05.121 may appeal from any declaration of
"dangerous dog," any notice and order, or any
action of the animal control authority by filing
within 10 days from the date of the service of
such notice of declaration or notice and order,
a written appeal at the office of the chief of
police, containing:
A. A caption reading: "Appeal of
giving the names of all appellants participating
in the appeal;
B. A brief statement setting forth the legal
interest of each of the appellants involved in
the notice and order;
C. A brief statement in concise language of
the specific order or action protested, together

with any material facts claimed to support the
contentions of the appellant;
D. A brief statement in concise language of
the relief sought, and the reasons why it is
claimed the protested order or action should be
reversed, modified or otherwise set aside;
E. Signatures of all parties' named as appel-
lants, and their official mailing addresses; and
F. Verification (by declaration under pen-
alty of perjury) of at least one appellant as to
the truth of the matter stated in the appeal.

5.05.124 Appeal — Procedures.
A. Filing. A notice of appeal, substantially
in the form prescribed in EMC 5.05.123, shall
be filed with the Edmonds municipal court and
the chief of police not more than 10 days after
service of the order to abate a nuisance or dec-
laration of a dangerous dog is appealed. Fail-
ure to timely file a notice of appeal shall
constitute a waiver of the right to appeal the
determination of the order to abate a nuisance
or declaration of dangerous dog.
B. Scheduling of Hearing. Upon receipt of
a timely filed notice of appeal, a hearing shall
be scheduled not more than 60 days from the
date of the filing of the notice of appeal. Writ-
ten notice of the date of the hearing shall be
sent to the appellants at least 10 days prior to
the scheduled hearing date. The failure of the
appellant to appear at the hearing shall result in
a denial of the appeal and upholding of the
order to abate a nuisance or declaration of dan-
gerous dog.
C. Enforcement Stayed During Pendency
of Appeal. Unless otherwise determined by the
hearing examiner, enforcement of the order to
abate a nuisance or declaration of dangerous
dog shall be stayed during the pendency of the
appeal.
D. Presentation of Evidence. At the appeal
hearing, the hearing examiner shall take evi-
dence relevant to the order to abate a nuisance
or dangerous dog declaration. The testimony
may be provided in the form of a signed written

statement pursuant to RCW 9A.72.085. A
party requesting the presence of any witness at
the hearing in lieu of that witnesses' written
statement under oath shall make a written re-
quest to the city of Edmonds prosecuting attor-
ney to subpoena such witness not later than 10
days after the filing of the notice of appeal.
E. Decision of the Hearing Examiner. The
hearing examiner may uphold, dismiss, or
modify the order to abate nuisance or declara-
tion of dangerous dog. A written order shall be
prepared and signed by the hearing examiner.
The decision of the hearing examiner shall be
a final administrative decision appealable to
the Snohomish County superior court within
30 days of the written order of the hearing
examiner.
F. A copy of EMC 5.05.123 and this section
shall be served on any person receiving an
order to abate a nuisance pursuant to EMC
5.05.120 or declaration of dangerous dog
issued pursuant to EMC 5.05.121 at the time
such order or declaration is served. [Ord. 3322

5.05.125 Failure to abate a nuisance —
Penalty.
Any person who willfully fails to comply
with an order to abate a nuisance shall be
guilty of a misdemeanor, punishable by up to
90 days in jail and up to a $1,000 fine or both.

5.05.126 Impoundment.
A. The animal control authority and its
authorized representatives are authorized to
apprehend and impound any animals found
doing any of the acts defined as a public nui-
sance and/or being subjected to cruel treat-
ment. The animal shall be impounded and held
for a minimum of 72 hours.
B. Persons other than authorized animal
control officers and their representatives who
take into their possession any stray animal, not
owned by them or not placed into their posses-
sion by the person having the lawful custody

and control thereof, shall be required to notify
the animal control authority or police within
24 hours, and to release such animal to said
city officer or deliver such animal to a shelter
designated as the city's animal shelter. [Ord.
3322 § 19, 2000; Ord. 2711, 1989].
5.05.127 Impound procedures.
A. Notice of Impounding. When any
licensed animal is impounded, the officer or
department impounding such animal shall
notify the owner of the impoundment and the
reason therefor by mail, telephone or by leav-
ing written notice at the address contained in
the license application. It shall be the owner's
responsibility to take such measures for
redeeming such animal. Neither the city nor
any officer or agent of the city shall be legally
or financially responsible for failing to notify
an animal owner under this chapter.
B. Redemption of Animals by Owner.
Unless otherwise provided in this chapter, the
owner of an impounded animal may claim the
same, at any time prior to the release for adop-
tion or disposal by the city and shall be entitled
to the possession thereof upon payment of all
legal charges and expenses incidental to such
taking up and keeping of said animal.
C. Adoption of Impounded Animals. At the
expiration of 72 hours as provided in ECC
5.05.126(A), the animal control authority shall
release ownership of the animal to the city's
designated animal shelter for adoption.
D. Disposition. Any animal not redeemed
or adopted may be destroyed or otherwise dis-
posed of by the animal control authority. The
mayor is authorized to enter into contracts for
disposal with appropriate agencies, not includ-
ing vivisectionists.
E. Disposal of Certain Animals. It is lawful
for any police officer or animal control officer
to kill any dangerous or vicious dog or other
animal found at large which cannot, in their
judgment, be safely taken up and impounded.
F. Impounding Sick or Injured Animals.
When in the judgment of a licensed veterinar-

ian or the animal control authority, an animal
should be destroyed for humane reasons, such
animal may not be redeemed. The animal con-
trol authority or its agents shall not be held lia-
ble for the destruction of said animal.
G. Hindrance to Impounding. No person
shall willfully:
1. Prevent or hinder the impounding of
any animal found in violation of this chapter;
2. Remove the animal from the desig-
nated shelter without the authority of the chief
of police, the animal control authority or the
officer in charge of the designated shelter;
3. Remove the animal from the desig-
nated shelter without paying all lawful charges
against the animal; or
4. Resist or obstruct the animal control
authority or its officers in the performance of
its duties. [Ord. 3322 § 20, 2000; Ord. 2711,

5.05.128 Cruelty violations declared
unlawful.
A. It is unlawful for any person to:
1. Willfully and cruelly injure or kill any
animal by any means;
2. By reason of neglect or intent to cause
or allow any animal to endure pain, suffering
or injury or to fail or neglect to aid or attempt
alleviation of pain, suffering or injury he has
so caused to any animal;
3. Lay out or expose any kind of poison,
or to leave exposed any poisoned food or drink
for man, animal or fowl, or any substance or
fluid whatever, whereon or wherein there is or
shall be deposited or mingled, any kind of poi-
son or poisonous or deadly substance or fluid
whatever, on any premises, or on any unen-
closed place, or to aid or abet any person in so
doing, unless in accordance with the provi-
sions of RCW 16.52.190;
4. Abandon any animal by dropping off
or leaving such animal on the street, road or
highway, or in any other public place, or on the
private property of another; or

5. Confine any animal without adequate
water, air and/or food or in a confinement in
which the animal is subject to extremes of heat
or cold; for example, but not limited to, con-
finement within an automobile without ade-
quate ventilation or protection from extremes
of temperature.
B. Any person who violates any provision
of this section shall be deemed to have com-
mitted a gross misdemeanor punishable by
maximum sentence of $5,000 fine and/or one
year in jail. [Ord. 3322 § 21, 2000; Ord. 2853

5.05.128.1 Use of domestic dogs and cats as
bait.
Chapter 226, Section 1, Laws of 1990,
including all future amendments, is hereby
adopted by reference. [Ord. 2782 § 1, 1990].
5.05.129 Guard dogs.
Guard dogs shall be kept contained within a
building or on a leash under the control of a
person, or enclosed within a solid or chain-link
fence of sufficient height to prevent the dog
from reaching persons off the property. The
owner shall restrain the guard dog in such a
manner that the dog is unable to reach those
persons using the normal ingress and egress to
and from the property. The owner shall post
signs in two conspicuous places on the prop-
erty, warning that a guard dog is on the pre-
mises. The owner must indicate at the time of
obtaining a dog license that the dog is a guard
dog. [Ord. 2711, 1989].
5.05.130 Covered animal regulations.
A. Required Open Space and Minimum Di-
mensional Requirements for Pasturing. There
shall be not less than 12,000 square feet of open
space for maintaining and pasturing the first
covered animal on any parcel of property, and
an additional 8,000 square feet shall be re-
quired for each additional covered animal. In
addition, the following minimum dimensional

requirements for open space and pasturing pur-
poses shall be provided:
1. The pasture area shall have a mini-
mum width of 80 feet.
2. The stable housing the covered ani-
mal shall be set back at least 30 feet from any
side, rear and front property lines.
3. In the event the covered animal gives
birth, thereby exceeding the number of cov-
ered animals allowed by the minimum set forth
in this subsection, the owner of said animals
and/or the occupier of the premises shall con-
form to the number of said animals or the
dimensional requirements within one year of
the birth of said animals.
B. Fencing. The owner and/or tenant or
other occupier of the premises upon which any
covered animal is maintained for more than
seven consecutive days within the city limits
shall provide adequate fencing in a good state
of repair to guarantee the confinement of said
animal within said fence, which fence shall
completely enclose an area describing at least
the minimum area of open space and pasturing,
including the minimum dimensional require-
ments.
C. Waste Disposal. The owner of each cov-
ered animal and the owner and/or occupier of
the premises upon which said animal is main-
tained within the city limits shall guarantee
and, at all times, maintain the premises upon
which the covered animal is maintained in a
sanitary and neat condition, including, but not
limited to, disposal of manure or other waste
material from said animal. An unreasonable
accumulation of flies or other insects or pests
within the property on which said animal is
maintained, and/or noxious or offensive odors,
or the unreasonable accumulation of flies,
insects or other pests transcending into neigh-
boring or vicinal real property, shall be pre-
sumed to be inadequate sanitary conditions.
D. Riding on Sidewalks. It is unlawful for
any person to ride or lead a covered animal on
any sidewalk within the city limits, unless oth-
erwise specifically designated by the city's

engineer for such use. No person shall ride or
lead two or more covered animals abreast on
any city street.
E. Public Parks, Beaches and/or Play-
grounds. Unless otherwise directed by the
director of parks and recreation, it is unlawful
for any person to ride, lead or otherwise permit
any covered animal to be within or on any pub-
lic park, beach or playground within the city of
Edmonds, whether owned by, leased or other-
wise under the direct supervision of the city, or
to ride, lead or permit any said animal to be
within or on the private property of another,
without the consent of the owner of said prop-
erty; provided, however, the director of parks
and recreation is authorized to post a notice or
notices of specific areas in any particular pub-
lic park, beach or playground within the city of
Edmonds where said animals may be permitted
under such circumstances as may be required
by the director of parks and recreation. Said
notices shall be placed in a conspicuous place
or places at each drive-in or pedestrian access
provided by the city to such public parks,
beaches and/or playgrounds. In the event the
director of parks and recreation so determines
and posts notices as provided in this subsec-
tion, he shall maintain a list of said parks,
beaches and/or playgrounds, shall file a copy of
the same with the city clerk, and said list shall
be open and available for public inspection at
all business hours of the office of the city clerk.
F. Business Area. No person shall leave any
covered animal unattended, whether tethered
or untethered within any area of the city zoned
for commercial use by the city zoning code.
G. Areas of Maintenance — Zoning and
Related Ordinances. Areas wherein covered
animals may be maintained or pastured within
the city limits are those set forth by the zoning
code. In the event of conflict between any
dimensional requirements set forth in this sec-
tion and the requirements set forth in the zon-
ing code, the regulation requiring the greatest
open space or other dimensional requirement
shall prevail. In the event any other provision

of Edmonds City Code is in conflict with this
section relative to said animals, the terms of
this section shall prevail.
H. Variances. Where there may be struc-
tures of less than the minimum dimensional
requirements which existed prior to September
6, 1977, the owner of the premises may apply
to the planning/zoning departments' hearing
examiner for a variance from the strict require-
ments of this section. [Ord. 3322 § 22, 2000;

5.05.131 Wild animals.
No person shall own any wild animal unless
he has obtained a permit from the State Game
Department and/or Federal Fish and Wildlife
Service; provided, that the animal control
authority may allow a person to temporarily
care for an infant or injured wild animal native
to this area which is homeless while the person
acquires the necessary state and/or federal per-
mits. Any person who violates this section shall
be guilty of a misdemeanor, punishable by up
to 90 days in jail and up to a $1,000 fine or both.

5.05.132 Inherently dangerous animal.
It is unlawful for any person to possess or
maintain an inherently dangerous animal
within the city of Edmonds. Any person who
violates this section shall be guilty of a misde-
meanor, punishable by up to 90 days in jail and
up to a $1,000 fine or both. [Ord. 3322 § 24,
2000; Ord. 2711, 1989].
5.05.133 Miscellaneous regulations.
A. Duty When Striking Domestic Animal
with Motor Vehicle. Any person who, while
operating a motor vehicle, strikes a domestic
animal shall stop at once, render reasonable as-
sistance, and shall immediately report such in-
jury or death to the animal's owner. In the event
the owner of said animal cannot be ascertained
and located, such person shall at once report the
accident to the animal control authority. This
subsection shall in no way be construed as re -

quiring the person striking the animal with a
motor vehicle to be financially responsible for
any injury or death of the animal.
B. Animal Pens — When Prohibited. Who-
ever shall keep, use or maintain, within the
city, any pens, stable, lot, place or premises in
which any animal or fowl may be confined, in
such manner as to be nauseous, foul or offen-
sive, or which shall from any cause become an
annoyance to any person, family or commu-
nity, shall be deemed to be maintained a nui-
sance and be subject to the penalties prescribed
in ECC 5.50.020.
C. Slaughtering of Animals. It should be
unlawful for any person to kill or slaughter,
within the city, any animal or animals, the
flesh of which is intended to be sold or offered
for sale. [Ord. 2711, 1989].
5.05.134 Stay of enforcement.
Enforcement of any notice and order issued
by the animal control authority issued under
this chapter shall be stayed during the pending
of an appeal except impoundment of an animal
which is:
A. Vicious or dangerous, or
B. Cruelly treated. [Ord. 3322 § 25, 2000;
Ord. 2711, 1989].
5.05.135 No duty created.
Nothing contained in this chapter is intended
to be, nor shall be construed to create or form
any special duties or relationships with specific
individuals or otherwise constitute the basis for
any liability on the part of the city or its offic-
ers, employees or agents, for any injury or
damage resulting from the failure of any person
to comply with the terms of this chapter, or by
reason or in consequence of any commission
with the implementation or enforcement of this
chapter on the part of the city by its officers,
employees, or agents. This chapter has been
enacted for the welfare of the public as a whole,
and not for any specific group or class. [Ord.

5.05.140 Penalties.

5.05.141 Additional enforcement.
Notwithstanding the existence or use of any
other remedy, the director of the animal con-
trol authority may seek legal or equitable relief
to enjoin any acts or practices and abate any
conditions which constitute a violation of this
code or other regulations herein adopted. [Ord.

5.05.142 Severability.
If any section, subsection, clause, phrase or
word of this chapter, or any provision adopted
by reference in this chapter is for any reason
held to be invalid or unconstitutional by a court
of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity
or constitutionality of the remaining portions

5.10.010 Control of waters — City.
The city in the exercise of its police power,
hereby assumes control and jurisdiction over
all waters within its limits as extended by Laws
of 1965 Chapter 7, RCW 35.21.160. [Ord.

5.10.020 Definitions.
A. "Owner" for the purpose of this chapter
includes the owner of private property, or any
lawful tenant or other occupant having been
given lawful possession of such private prop-
erty, or in the case of publicly owned property,
any officer or otherwise delegated official hav-
ing control over said publicly owned property
who has rented or leased all or a portion of such
publicly owned property, and any employee of
such publicly owned property or facility.
B. "Watercraft" means any contrivance
used or capable of being used as a means of
transportation on water specifically including
but not limited to any boat, yacht, or house -

boat, whether powered by engine, sail, motor

5.10.030 Application and justification.
The provisions of this chapter shall be appli-
cable to all watercraft, and shall be construed
to supplement United States laws and state
laws and regulations when not expressly
inconsistent therewith. [Ord. 2531, 1985; Ord.

5.10.040 Negligent operation.
It is unlawful for any person to operate a
vessel in a negligent manner. For the purposes
of this section, to "operate in a negligent man-
ner" means operating a vessel in disregard of
careful and prudent operation, or in disregard
of careful and prudent rates of speed that are
no greater than is reasonable and proper under
the conditions existing at the point of opera-
tion, taking into account the amount and char-
acter of traffic, size of the body or water,
freedom from obstruction to view ahead,
effects of vessel wake, and so as not to unduly
or unreasonably endanger life, limb, property
or other rights of any person entitled to the use

5.10.050 Reckless operation.
It is unlawful for any person to operate any
watercraft in a reckless manner, meaning in a
manner acting carelessly and heedlessly in a
willful and wanton disregard of the rights,
safety or property of another. Any person vio-
lating this section is guilty of a misdemeanor,
punishable as provided by ECC 5.50.020. In
addition, the court may order the defendant to
pay restitution for any damages or injuries

10.80.010 Purpose.
It is the policy of the city of Edmonds to base
salaries of elected officials on realistic stan-
dards so that elected officials of the city may be
paid according to the duties of their offices, and
so that citizens of the highest quality may be
attracted to public service. To effectuate this
policy, the Edmonds citizens' commission on
salaries of elected officials ("citizens' commis-
sion") is hereby created consisting of seven
members with duties and responsibilities as set
forth below. [Ord. 3275 § 1, 19991.
10.80.020 Duties.
The citizens' commission shall study the re-
lationship of salaries for each respective posi-
tion. Except as provided otherwise below, the
citizens' commission shall be solely responsi-
ble for its own organization, operation, and ac-
tion and shall enjoy the fullest cooperation of
all elected officials, departments and agencies
of the city of Edmonds. [Ord. 3275 § 1, 1999].
10.80.030 Eligibility.
The citizens' commission shall consist of
seven members, all of whom must be at least 21
years of age, registered to vote, and maintain
personal residence within the boundaries of the
city of Edmonds. No city of Edmonds official,
or public employee, immediate family member
of the official or employee shall be eligible for

membership on the citizens' commission. As
used in this section, the phrase "immediate
family" means parents, spouse, siblings, chil-
dren, or dependent relative of the official or
employee, whether or not they are living in the
same household. [Ord. 3275 § 1, 1999].
10.80.040 Appointment.
Two members of the citizens' commission
shall be appointed by the city council and one
member shall be appointed by the mayor; the
appointed three members shall select the other
four members. The members of the commis-
sion shall serve four-year terms beginning
October 1, 1999, except that the first seven
members shall be appointed for different terms
as follows: (a) one member appointed by the
city council for a period of four years; (b) one
member appointed by the city council for a
period of two years; (c) two of the members
selected by those three members to serve for
periods of four years; and (d) two of the mem-
bers selected by those three members to serve
for periods of two years. No person may serve
more than two consecutive terms. Members of
the commission may be removed by the mayor,
with the approval of the council, only for cause
of incapacity, incompetence, neglect of duty,
malfeasance in office, or for a disqualifying
change of eligibility. The unexcused absence
of any member of the commission from two
consecutive meetings of the commission shall
constitute relinquishment of that person's
membership on the commission. Such relin-
quishment creates a vacancy in that person's
position on the commission. Upon a vacancy in
any position on the commission, a successor
shall be selected and appointed to fill the unex-
pired term. The selection and appointment
shall be concluded within 30 days of the date
that position becomes vacant and shall be con-
ducted in the same manner as originally pro-
vided for that person's appointment. [Ord.

10.80.050 Operation.
The members of the commission shall elect
a chair from among their number. The commis-
sion shall prepare a recommended schedule of
salaries by an affirmative vote of not less than
five members of the commission. Members of
the commission shall receive no compensation
for their services. [Ord. 3275 § 1, 1999].
10.80.060 Salary schedule
recommendation.
The commission shall file its initial sched-
ules of recommended salaries for elected offi-
cials of the city with the city clerk no later than
the first Monday in May of each odd -num-
bered year. The signature of the chair of the
commission shall be affixed to each schedule
submitted to the city clerk. The chair shall cer-
tify that the schedule has been adopted in
accordance with the provisions of this chapter
and with the rules, if any, of the commission.
Such schedules shall become effective only
upon adoption by the city council and in accor-
dance with state law. [Ord. 3325 § 1, 2000;

10.80.070 Open meetings.
All meetings, actions, hearings, and busi-
ness of the commission shall be subject to the
Open Public Meetings Act as set forth in Chap-
ter 42.30 RCW. Prior to the filing of any salary
schedule, the commission shall hold no fewer
than two public hearings thereon within the
two months immediately preceding the filing
of its recommendation. [Ord. 3275 § 1, 1999].
10.80.080 Referendum.
Any ordinance enacting change of salary
shall be subject to referendum petition by the
citizens in accordance with city ordinance.
Any ordinance which enacts a commission
recommendation shall be subject to Section XI
of the Washington State Constitution regard-
ing increases of elected officials' salaries dur-
