forcement officer, to enter onto this
premises while carrying any of the fol-
lowing weapons or instruments,
whether a license or permit to carry
said weapon is possessed or not, and
whether said weapon or instrument is
concealed or not: Rifle, shotgun, pistol,
knife, sword, dagger or any other cut-
ting or stabbing instrument, having a
blade longer than three inches; or any
razor with an unguarded blade; or any
explosive; or any poison or injurious
gas; or any sling shot, taser, throwing
star, bow, sand club, blackjack, metal
knuckles, stick, chain, metal pipe, bar,
club or combination thereof, including
a device having the same or similar
components or parts; or any weapon
or instrument apparently capable of
producing bodily harm. ECC 5.24.040.
D. Upon conviction said weapon or instru-
ment involved may be confiscated by order of
the presiding judge, and shall thereafter be dis-
posed of in accordance with statutes or ordi-
nances governing the disposal of confiscated
or found property. [Ord. 2531, 1985].
5.24.050 Weapons prohibited in restricted
areas of court facilities.
A. Weapons are prohibited in restricted
areas of court facilities. As provided in RCW
9.41.300, and adopted herein, restricted areas
are those which are used in connection with
court proceedings, including courtrooms, jury
rooms, judge's chambers, offices and areas
used to conduct court business, waiting areas,
and corridors adjacent to areas used in connec-
tion with court proceedings.
B. Weapons are defined in Chapter 5.24
ECC which adopts RCW 9.41.250.
C. The municipal judge shall designate and
clearly mark areas in municipal court where
weapons are prohibited, and shall post notices
at entrances to the court facility stating that
weapons are prohibited in restricted areas.
D. The city shall provide a stationary
locked box, sufficient in size for short fire-
arms, and key to the weapon owner for weapon

storage, or shall designate an official to within
the court facility to receive weapons for safe-
keeping, during the owner's visit to restricted
areas of the court facility. [Ord. 2942 § 1,
1993].
5.24.060 Destruction, trade or sale of
forfeited firearms.
A. Firearms that are (i) Judicially forfeited
and no longer needed for evidence; or (ii) for-
feited due to a failure to make a claim under
RCW 63.32.010 or 63.40.010; may be dis-
posed of by the city of Edmonds.
B. The city of Edmonds may destroy,
retain, trade, auction or arrange for an auction
of forfeited firearms obtained on or after June
30, 1993 pursuant to ECC 5.24.010(I) adopt-
ing by reference RCW 9.41.098.
C. The city of Edmonds may retain the pro-
ceeds of any trade or auction of forfeited fire-

5.27.010 Definitions.
The definitions of Chapter 70.77 RCW as
now stated or hereafter amended shall govern
the construction of this chapter, when applica-
ble. RCW 70.77.120 through and including
RCW 70.77.230 as now stated or hereafter
amended are adopted by this reference and a
copy or the same shall be kept on file in the
Edmonds City Code
office of the city clerk for public use and
inspection. In addition, the following term(s)
are defined:
A. "Dangerous fireworks" means any fire-
work not defined as a "common firework"
under the provisions of RCW 70.77.136.
5.27.020 Sale, possession, use and
discharge of fireworks unlawful.
It is unlawful for any person to sell, possess,
use, transfer, discharge, ignite or explode any
fireworks within the city; provided that this
prohibition shall not apply to the following
activities, when authorized by a state license
and city permit:
A. Duly authorized public displays, as pro-
vided in RCW 70.77.260; and
B. Duly authorized use by religious organi-
zations or private organizations or persons for
religious or other specific purposes on an
approved date and in an approved location, as
provided in RCW 70.77.311(2). [Ord. 2888 §
1, 1993].
5.27.030 Repealed by Ord. 2888.
5.27.040 Permit required for public
display.
It is unlawful for any person to hold, con-
duct or engage in a public display of fireworks
within the city without first having obtained
and being the holder of a valid permit issued
pursuant to the provisions of this chapter.

5.27.050 Repealed by Ord. 2888.
5.27.060 Permit fees.
The fee for a "public display permit" for the
public display of fireworks shall be $10.00,
payable in advance. [Ord. 2888 § 2, 1993].
5.27.120
5.27.070 Issuance — Nontransferable —
Voiding.
Each public display permit issued pursuant
to this chapter shall be valid for the specific
authorized public display event only, shall be
used only by the designated permittee and
shall be nontransferable. Any transfer or unau-
thorized use of a permit is a violation of this
chapter and shall void the permit granted in
addition to all other sanctions provided in this
code. [Ord. 2888 § 2, 1993].
5.27.080 Application for public display
permit.
Applications for a permit to hold, conduct or
operate a public display of fireworks shall be
made to the Edmonds fire marshal at least 14
days prior to the scheduled event. Applicants
shall meet all qualifications and requirements
of state law regarding public display of fire-
works and all fire and safety requirements as
set forth in the standards for public display.

5.27.120 Standards for public fireworks
displays.
All public fireworks displays shall conform
to the following minimum standards and con-
ditions:
A. All public fireworks displays must be
planned, organized and discharged by a state -
licensed pyrotechnician.
B. A permit must be obtained from the city
and approved by the fire marshal or designee
prior to any display of public fireworks. The
permit shall include the name of the applicant
and his address, the name of the pyrotechni-
cian and his address; the exact location, date
and time of the proposed display; the number,
type and class of fireworks to be displayed, the

manner in which the fireworks are being stored
prior to the public fireworks display; and shall
include the name and address of the insurance
company providing the bond required.
C. A drawing shall be submitted to the fire
marshal showing a plan view of the fireworks
discharge site and the surrounding area within
a 500 -foot radius. The drawing shall include
all structures, ' fences, barricades, streets,
fields, streams and any other significant fac-
tors that may be subjected to ignition or that
may inhibit firefighting capabilities.
D. When, in the discretion of the fire chief,
such requirement is necessary to preserve the
public health, safety and welfare, the permit
may require that a city fire department pumper
and a minimum of two trained city firefighters
shall be on site 30 minutes prior to and after the
shooting of the event. Firefighters shall receive
a minimum compensation as per the Washing-
ton State Chiefs Association's fee schedule.
All compensation for fire department appara-
tus will be as per the Washington State Chiefs
Association's fee schedule and shall be desig-
nated to the Edmonds General Fund.
E. All combustible debris and trash shall be
removed from the area of discharge for a dis-
tance of 300 feet in all directions.
F. All unfired or "dud" fireworks shall be
disposed of in a safe manner.
G. A minimum of two 2A -rated pressurized
water fire extinguishers and one fire blanket
shall be required to be at the fireworks dis-
charge site.
H. The permit may be immediately revoked
at any time deemed necessary by the fire mar-
shal or designee due to any noncompliance,
weather conditions such as extremely low
humidity or wind factor. The display may also
be cancelled by accidental ignition of any form
of combustible or flammable material in the
vicinity due to falling debris from the display.
I. Areas of public access shall be deter-
mined by the fire marshal or designee and
maintained in an approved manner.

5.27.130 Repealed by Ord. 2888.
5.27.140 Special effects for entertainment
media.
This chapter does not prohibit the assem-
bling, compounding, use and display of special
effects of whatever nature by any person
engaged in the production of motion pictures,
radio, or television productions, theatricals or
operas when such use and display is a neces-
sary part of the production and such person
possesses a valid permit issued by the city of
Edmonds to purchase, possess, transport or use
such fireworks.
5.27.150 Nonprohibited acts — Signal
purposes, forest protection.
This chapter does not prohibit the use of
flares or fuses in connection with the operation
of motor vehicles, railroads, or other transpor-
tation agencies for signal purposes or illumina-
tion or for use in forest protection activities.
5.27.160 Applicability.
The provisions of this chapter shall be appli-
cable to the sales and use of all fireworks
except toy paper caps containing not more than
25/100 grain of explosive compound for each
cap and trick or novelty device not classified as
common fireworks.
5.27.170 Chapter in connection with state
law.
This chapter is intended to implement Chap-
ter 70.77 RCW, and shall be construed in con-
nection with that law and any and all rules or
regulations issued pursuant thereto.
5.27.175 Prohibition effective in
December 2002.
Notwithstanding any other provision of law,
the prohibitions of this chapter regarding the
sale, possession, use, transfer, discharge, igni-
tion or explosion of fireworks apply with full

force to the period of December 27, 2002,
through December 31, 2002. [Ord. 3413 § 1,

5.27.180 Enforcement.
The fire chief, or designee, is authorized to
enforce all provisions of this chapter and, in
addition to criminal sanctions or civil reme-
dies, he may revoke any permit issued pursu-
ant to this chapter upon any failure or refusal
of the permittee to comply with the orders and
directives of the fire chief or designee, and/or
to comply with any provisions of this chapter
or the requirements of the community devel-
opment code relating to temporary structures.

Chapter 10.40
PLANNING BOARD

10.40.010 Purpose.
10.40.020 Planning board.
10.40.010 Purpose.
The purpose of this chapter is to provide for
the creation of a planning board pursuant to
Chapter 35A.63 RCW, and provide for its
membership, organization, operation, and ex-
penses. The planning board shall generally
serve in an advisory capacity to the city in re-
gional and local planning and specifically as-
sist in the development of the comprehensive
plan and zoning ordinance and their successive
review and amendment from time to time. The
board shall have the additional duties specifi-
cally set forth in this chapter and such ad hoc
duties as the city council may from time to time
assign to it. [Ord. 2342, 1983; Ord. 2170 § 2,
1980].
10.40.020 Planning board.
A. Appointment. There is created the plan-
ning board, consisting of seven members.
Each member shall be appointed by the mayor,
subject to confirmation by the city council.
1. Members of the board must be resi-
dents of the city of Edmonds.
2. Although the city of Edmonds is not
divided into political or geographical wards, it
is the intent of this section that said board
membership shall maintain a reasonable bal-
ance of geographical distribution throughout
the city of Edmonds.
3. It is the intent of this section to main-
tain a diversified representation of occupations
and experience on the planning board. To this
end each appointee shall be considered for
board membership according to his/her field of
experience, among other factors.
4. An alternative member shall be
appointed to serve in the event any regular

member is absent or disqualified for any rea-
son. In the event a regular member is absent or
disqualified for any reason, the alternate shall
have all the powers of a regular member,
including the right to vote on board decisions.
The alternate shall be subject to the same atten-
dance requirements as regular board members.
In the event that a regular position on the board
shall be declared vacant, the alternate shall be
deemed to fill such vacancy for the remainder
of the unexpired term.
B. Term. In order to provide for continuity
of membership, members shall be assigned a
position number. The initial term of each posi-
tion shall expire as set forth below, with subse-
quent terms being for four years each, and until
the successor is appointed and confirmed:
Position One -1982 Position Five - 1984
Position Two -1982 Position Six - 1984
Position Three -1983 Position Seven - 1985
Position Four -1983 Alternate - 1985
C. Powers and Duties. The planning board
shall serve in an advisory capacity to the
mayor and the city council in the following
matters:
1. The board shall advise on all amend-
ments to the comprehensive plan contained in
ECDC Title 15 (except fees). This includes
reviewing all elements of the plan on a peri-
odic basis and reporting to the mayor and city
council on the need for changes in the plan. It
also includes holding public hearings and
making recommendations to the mayor and
city council on proposed changes to the plan,
to the text of the zoning regulations, and also
to the zoning map in the case of rezones, as
provided in ECDC Title 20. Review of and
recommendations for the plan may be pre-
pared as a whole or in successive parts.
2. The board shall advise the mayor and
city council on all parking matters that involve
an amendment or other modification to any
city ordinance or code section within the juris-
diction of the board.
3. The board shall serve as an ongoing
park board and advise the mayor and city

council on all matters relating to the acquisi-
tion and development of all city parks and rec-
reation facilities.
4. The board shall do research and
investigation on specific projects assigned to it
by the mayor and city council. The board will
analyze data collected, arrange for public par-
ticipation, and organize its findings. The board
will then present its findings to the mayor and
city council detailing a summary of pertinent
data, public contribution, alternatives avail-
able, and may, if appropriate, recommend a
course of action, giving reasons for such rec-
ommendation.
5. The board shall have such other pow-
ers and duties as contained in Chapter 35A.63
RCW, as may be amended from time to time,
that are not otherwise specifically delegated to
the hearing examiner or other specific staff or
agency of the city.
D. Operation.
1. The city planning division shall pro-
vide regular staff services to the planning
board. Other city departments shall provide
staff services as requested by the planning
board.
2. The city council shall establish an
annual budget for planning board operations
for services in addition to regular staff ser-
vices. Should the planning board and planning
staff determine that a particular project
requires services in addition to those normally
provided by the city staff, then an estimate of
needs detailing the type of assistance and fund-
ing required shall be presented to the city
council for approval before that project is
undertaken.
3. Four members of the board shall be
the minimum number necessary to constitute a
quorum for the transaction of business; pro-
vided that the vote of not less than three mem-
bers shall be necessary to take action on any
particular item before it.
4. The board shall hold regular meetings
on the second and/or fourth Wednesdays of
each month at 7:00 p.m. at the Edmonds city

council chambers. Cancellation of a regular
meeting, or a different location for a regular
meeting, shall be announced at the last regular
meeting preceding the affected meeting, if
possible, otherwise the change will be adver-
tised in the regular manner.
5. The city council shall meet periodi-
cally with the planning board at a city council
meeting in order to review and update plan-
ning board agendas. The intent of this section
is to stimulate continuing communication
between mayor, city council and the planning
board in an effort to identify and solve the
problems facing the city of Edmonds. Nothing
herein shall be construed to limit the manner in
which items are placed on a planning board
agenda nor the topics that may be considered
by the planning board.
6. The board shall adopt rules of proce-
dure and rules governing election and duties of
officers of the board; provided, however, said
rules shall pertain only to the internal proce-
dures of the members and said rules and proce-
dures may be questioned only by members of
the board and do not give standing to question
said procedures to nonmembers or other par-
