Edmonds City Code
for which both fire protection and other water
service for such uses as domestic, commercial,
industrial, or manufacturing purposes is sup-
plied, there may be two service installations
made to the premises: one for fire service only
and one for other water service. These service
functions may also be combined in a single
service connection with the approval of the
water division.
In the event two separate service connec-
tions are installed, the fire protection system so
served shall consist of an automatic sprinkler
system only, without additional outlets which
could normally be used for other than fire sup-
pression purposes. [Ord. 1561, 1971].
7.40.040 Fire service monthly service
charges.
A. The monthly rates for inspection and
maintenance of detector check systems are
fixed as follows:

Water used through the fire service line for
fire suppression purposes and limited testing
of the system will normally be furnished with-
out any charge in addition to the bimonthly
minimum charge set forth for fire service
meter or detector check meter.
B. If a detector check meter proves, or
proof is otherwise provided, leakage or unau-
thorized usage of water which is not for fire
suppression purposes, the customer shall pay
for all water used at the applicable metered
rate. The rates for water so used are fixed as
follows: at the time of first written notice from
the city water division the applicable rate shall
be the same as the domestic rate for compara-
ble size of domestic water meter for unautho-
rized use over 100 cubic feet per month; in the
event the unauthorized use again occurs after

the period of time specified in the written
notice from the water division, the rate shall be
double the domestic rate for a comparable size
domestic water for such unauthorized use over
100 cubic feet per month.
C. References made by this chapter as to
existing metered rates shall be to Chapter 7.30
ECC. [Ord. 3457 § 1, 2003; Ord. 1561, 1971].
7.40.050 Violation — Penalty.
In addition to all civil rights of collection,
liens, shut -offs and other remedies available to
the city of Edmonds as prescribed by statute
and ordinance for unauthorized use and/or
nonpayment of charges, any person, firm, cor-
poration or other organization, including any
officers, directors and managers thereof, who
violate any provision of this chapter shall be
guilty of a misdemeanor and subject to penal-
ties as set forth in ECC 5.50.020. [Ord. 1561,
1971].

created — Responsibilities.
There is hereby created and established, pur-
suant to Chapters 35A.80 and 35.67 RCW, a
storm and surface water utility to be known as
the "Edmonds Stormwater Management Util-
ity." All references to "the utility" in this chap-
ter refer to the Edmonds stormwater manage-
ment utility. The utility will have primary
authority and responsibility for carrying out the
city's comprehensive drainage and storm
sewer plan, including responsibilities for plan-
ning, design, construction, maintenance, ad-
ministration, and operation of all city storm and
surface water facilities, as well as establishing
standards for design, construction, and mainte-
nance of improvements on private property
where these may affect storm and surface water
management.
7.50.020 Administrator of utility.
The director of community services shall be
ex officio administrator of the utility.
7.50.030 System or plan of stormwater
management utility.
There is hereby specified and adopted the
original system or plan of the stormwater man-
agement utility, which shall include all proper-

ties, interests, and physical and intangible
rights of every nature owned or held by the city,
however acquired, insofar as they relate to or
concern storm or surface water sewage, further
including, without limitation, all properties,
interests and rights acquired by adverse posses-
sion or by prescription, directly or through
another, in and to the drainage or storage, or
both, of storm or surface waters, or both,
through, under, or over lands, watercourses,
sloughs, streams, ponds, lakes, and swamps, all
beginning in each instance at a point where
storm or surface waters first enter the storm and
surface water system of the city and ending in
each instance at a point where the storm or sur-
face waters exit from the storm and surface
water system of the city, and in width to the full
extent of inundation caused by storm or flood
conditions.
7.50.040 Transfer of property to
stormwater management utility.
The city council expressly finds the value of
the above-described original system or plan of
storm drainage and surface water facilities,
together with funds currently held in the water
and sewer fund in the amount of $690,000, is
equal to the value of release from primary
responsibility therefor insofar as it relates to or
concerns storm or surface waters within the
city. Accordingly, all of the city's above-men-
tioned facilities, including the rights and inter-
ests as a part thereof as they relate to or concern
storm or surface waters, and the funds in the
amount of $690,000 are, for purposes of RCW
43.09.210, hereby transferred to and subject to
the administration of the city's stormwater
management utility created by this chapter, and
all other institutions and departments of the
city having primary responsibility therefor
within the city are, to the same extent, released
from such primary responsibility. Inasmuch as
the city now owns all of those facilities, includ-
ing the rights and interests as a part thereof and
the original system or plan set forth in ECC
7.50.030, there is no estimated cost thereof.

10.15.010 Purpose.
The building board of appeals shall hear
appeals from the building official's interpreta-
tion of the Uniform Building Code, determina-
tions of suitable, alternative methods and
materials and any other appeal delegated to a
board of appeals pursuant to the State Building
Codes, including but not limited to the Uni-
form Building Code, the Uniform Fire Code,
the Uniform Code for Abatement of Danger-
ous Buildings, the Uniform Mechanical Code,
the Uniform Plumbing Code and any and all
other codes adopted pursuant to the direction
and authority of Chapter 19.27 RCW. [Ord.
3456 § 2, 2003].
10.15.020 Membership.
A. There is created a building board of
appeals consisting of members who are quali-
fied by experience and training to pass on mat-
ters pertaining to building construction and
who are not employees of the city of Edmonds.
The technical expertise of board members may
be supplied through training or experience as
an architect, builder, fire inspector, mechani-
cal or electrical expert, plumber, engineer, or
others with similar technical training. Four of
the board members shall be active, practicing
members of one of the prior listed disciplines
or professions and the fifth shall be a citizen
familiar with any of the previously referred to
disciplines or professions. The technical mem-
bers of the board with the required profes-

sional or technical expertise may be appointed,
regardless of where such individuals reside.
The lay person shall be a resident of the city of
Edmonds. Members of the board shall be
appointed by the mayor and confirmed by the
city council.
B. Alternative Members. In addition, up to
three alternative technical members and one
alternative lay member may be appointed by
the mayor subject to the confirmation of the
city council. Such alternates shall serve when
required in order to assure a five -member
panel consisting of four technical persons and
one lay representative.
C. Term. On the date of initial appointment
to the board, the mayor shall appoint two tech-
nical members to two-year terms, two techni-
cal members to four-year terms and the lay
member to a three-year term. Thereafter, mem-
bers, whether technical or lay, regular or alter-
native, shall be appointed to four-year terms.
D. The building official shall serve as an
ex -officio member of the board and act as the
secretary to said board, but shall have no vote
on any matter before the board; provided, how-
ever, that the fire chief shall serve as an ex offi-
cio member on appeals relating to the Uniform
Fire Code and act as secretary with respect to

10.15.030 Removal.
Members of the board of appeals shall serve
at the pleasure of the city and may be removed
at any time for any reason which the mayor,
with confirmation of the city council, deems to
be in the public interest. Any member who is
unavailable for three consecutive appeals shall
be automatically removed and a new member
or alternate appointed. [Ord. 3456 § 2, 2003].
10.15.040 Limitations of authority.
A. The building board of appeals shall have
no authority relative to the interpretation of the
administrative provisions of any of the State

Building Codes, nor shall the board be empow-
ered to waive any requirement of any such
code.
B. The provisions of the State Building
Code as adopted by the city are not intended to
prevent the use of any material, alternate
design or method of construction not specifi-
cally prescribed by this code, provided any
alternative has been approved and its use
authorized by the building official or on appeal
or request for review by the building board of
appeals.
C. The building board of appeals, on
review, may approve the use of any material,
alternate design or method of construction pro-
viding that it finds that the proposed design is
satisfactory and complies with the provisions
of this code and that the material, method or
work offered is, for the purpose intended, at
least the equivalent of that prescribed in the
applicable code in suitability, strength, effec-
tiveness, fire resistance, durability, safety and
sanitation.
D. The building board of appeals shall
require that sufficient evidence or proof be
submitted to substitute any claims that may be
made regarding its use. The details of any
action granting approval of alternate design or
method of construction shall be recorded and
entered in the written decision of the board.

10.15.050 Tests.
The appellant bears the burden of proof in
any proceeding before the board. If there is
insufficient evidence of compliance with any
of the provisions of this code or evidence that
any material or construction does not conform
to the requirements of this code, the appeal
from the decision of the building official shall
be denied. The board may also continue any
proceeding in order to permit the appellant or
applicant to provide proof of compliance
through tests conducted in accordance with
general engineering practice and best scientific
evidence. Such tests shall be made by the

applicant or appellant and at no expense to the
jurisdiction. Test methods shall be as specified
by the applicable building code or by other rec-
ognized testing standards. If there are not rec-
ognized and accepted test methods for the
proposed alternate, testing methods shall uti-
lize generally accepted engineering practice
and best scientific method. Reports of such
tests shall be retained and made a part of the
record of the proceeding. [Ord. 3456 § 2,

10.15.060 Landslide hazard and earth
subsidence areas.
Nothing herein shall be interpreted to permit
the board to hear any appeal, nor any request
for deviation of design or alternative methods
with respect to any property lying within a rec-
ognized landslide hazard and earth subsidence
area or which is otherwise subject to the
requirements of Chapter 19.05 ECDC. [Ord.

10.16.010 Cemetery board — Members and
their terms.
The cemetery board shall be composed of
seven community members, plus two addi-
tional persons to serve as alternates, as pro-
vided under ECC 10.16.070. Board members
and the alternates shall be appointed for four-
year terms terminating on December 31 st.

10.16.020 Vacancy — Removal.
Vacancies occurring other than through the
expiration of terms may be filled for the unex-
pired terms, and the persons serving as the
cemetery board alternates shall be given prior-
ity in filling a vacancy. Members may be
removed by the mayor, with approval of the
city council, after a public hearing before the
city council for inefficiency, neglect of duty or
malfeasance in office. Members shall also be
removed for failure to maintain attendance as
required by provisions of the Edmonds City
Code. The persons serving as the cemetery
board alternates shall be subject to the same
provisions for removal as for members. [Ord.

10.16.050
10.16.030 Powers of board.
The cemetery board shall have full power to
manage the operation of the municipal ceme-
tery and to that end shall have powers:
A. To establish rules and regulations to
carry out the provisions of this chapter.
B. To regulate the sale and location of
burial lots and/or to contract with persons to
provide such services.
C. To provide for the improvement and
maintenance of the cemetery. To that end the
board shall submit proposed maintenance and
capital improvement budgets to the city coun-
cil in conjunction with the budget process for
the city.
D. To determine the types of plantings,
monuments and markers that will be permitted
for the proper and most attractive development
of the cemetery.
E. To accept any gift of money or property
on behalf of the cemetery.
F. In carrying out duties and responsibili-
ties, the board shall have such staff assistance
as authorized by the mayor.
Provided that, the person serving as a ceme-
tery board alternate shall not possess any of the
preceding powers until such person becomes a
cemetery board member. [Ord. 3095 § 3, 1996;

10.16.040 Meetings — Annual report.
The board shall hold such meetings as are
necessary to perform the functions set forth
herein and as set forth in its rules and regula-
tions. The board shall report at least quarterly
to the council concerning the operations of the
cemetery, the short and long term goals of the
board concerning the cemetery and a report on
the activities of the board. [Ord. 2306, 1982].
10.16.050 Funds for improvement and
maintenance of the cemetery.
A. There are hereby created two special
funds of the city to be known as the cemetery
improvement fund and the cemetery mainte-
nance trust fund. The city council shall, each

year as a part of the budget process, allocate
revenue from lot sales, burial fees, and all
bequests, gifts and donations received with
respect to the cemetery on a percentage basis to
said funds.
1. The cemetery improvement fund
shall be used for special projects, special
events, capital improvements and other nonre-
curring needs of the cemetery. Expenditures
from this fund may be made from both princi-
pal and income and the entire amount of said
fund may be expended in any year when such
expenditures are within the annual budget
approved by the city council.
2. The cemetery maintenance fund shall
be expended solely for the purpose of main-
taining the cemetery and any capital improve-
ments or facilities located therein. Expendi-
tures from this fund shall be limited to the
income earned by said funds along with any
additional funds appropriated to this fund by
the council or donated by any party for the pur-
pose of annual maintenance. To the extent per-
mitted by law, the council hereby impresses the
current fund balance of this fund, any private
donations with a trust in favor of the estate of
any person buried therein and the descendants
of such persons along with the Hubbard Family
Foundation and any other persons or entities
donating funds to the cemetery maintenance
trust fund for the sole purpose of maintenance
of the cemetery and capital improvements.
3. The council shall consider the number
of unsold lots, the fair market value of unsold
lots and the probable earnings of the trust fund
when fully funded by the sale of all lots when
allocating revenue. The goal shall be to actuar-
ially fund the trust fund with sufficient monies
so that it may become and remain a self-suffi-
cient source of funding for all recurring main-
tenance of the cemetery.
B. Any monies in said funds, surplus and
available for investment, shall be managed in
accordance with RCW 68.12.060. This section
shall be considered approval of investments in
accordance with RCW 68.12.065 subject to
