On or before the tenth day following the close of the authorized travel period for which expenses have been advanced to any official or employee, that person shall submit to the finance director a fully itemized travel expense voucher for all reimbursable items legally expended and accompanied by the unex- pended portion of such advance, if any. Any advance accounted for in the time and manner specified herein shall bear interest at the rate of 10 percent per year from the date of default until paid. No advance of any kind shall be made to any officer or employee at any time when that person is delinquent in accounting for or repaying a prior advance authorized under this chapter. Billing. Sewer use service charges under this chapter shall be billed monthly by the city director of finance. The amount of the charge will be determined by the director at the end of each month and will be submitted to the city director of finance after sufficient time has been given for laboratory analysis of all sew- age samples and/or computations. Charges will be computed and billed based on records of flow from the previous month and mean waste strengths as determined in subsections B and C of this section. The director may check sewage strength as outlined in this chapter and adjust charges where applicable at any time in accordance with all the provisions of this chap- ter. Should any chapter, subchapter, paragraph, sentence, clause or phrase of Chapters 7.90 through 7.102 ECC or its application to any person or situation be declared unconstitu- tional or invalid for any reason, such decision shall not affect the validity of the remaining portions of Chapters 7.90 through 7.102 ECC or its application to any other person or situa- tion. The city council of the city of Edmonds hereby declares that it would have adopted Chapters 7.90 through 7.102 ECC and each chapter, subchapter, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more chapters, subchapters, clauses, phrases or portions be declared invalid or unconstitutional. The purposes of this chapter are: A. To provide for the health, safety, and general welfare of the citizens of the city of Edmonds, WA, through the regulation of non- (Revised 2/04) 7-58 stormwater discharges to the storm drainage system to the maximum extent practicable as required by federal and state law. B. To establish methods for controlling the introduction of pollutants into the municipal separate storm sewer system in order to com- ply with the requirements of the National Pol- lutant Discharge Elimination System (NPDES) permit process. Specifically: 1. To regulate the contribution of pollut- ants to the municipal separate storm sewer sys- tem by stormwater discharges from any user. 2. To prohibit illicit connections and illegal discharges to the city's municipal sepa- rate storm sewer system. 3. To define the city's legal authority to carry out all inspection, surveillance and mon- itoring necessary to effectuate said purposes. C. To protect and enhance water quality and aquatic wildlife and its habitat by prevent- ing harmful discharges to local watercourses. [Ord. 3483 § 1, 2003]. 7.200.020 Definitions. For the purposes of this chapter, the follow- ing shall mean: A. "Best management practices (BMPs)" mean schedules of activities, prohibitions of practices, general good housekeeping prac- tices, pollution prevention and educational practices, maintenance procedures, and other management practices to prevent or reduce the discharge of pollutants directly or indirectly to stormwater, receiving waters, or stormwater conveyance systems. BMPs also include treat- ment practices, operating procedures, and practices to control site runoff, spillage or leaks, sludge or water disposal, or drainage from raw materials storage. B. "City" means the city of Edmonds, Washington. C. "Clean Water Act" means the federal Water Pollution Control Act (33 U.S.C. Sec- tion 1251 et seq.), and any subsequent amend- ments thereto. Edmonds City Code D. "Director" means the city of Edmonds public works director and/or designees. E. "Hazardous materials" means any mate- rial, including any substance, waste, or combi- nation thereof, which because of its quantity, concentration, or physical, chemical, or infec- tious characteristics may cause, or signifi- cantly contribute to, a substantial present or potential hazard to human health, safety, prop- erty or the environment when improperly treated, stored, transported, disposed of, or otherwise managed. F. "Illegal discharge" means any direct or indirect nonstormwater discharge to the city's storm drain system, except as expressly exempted by this chapter. G. "Illicit connections" means either: (1) any drain or conveyance, whether on the sur- face or subsurface, which allows an illegal dis- charge to enter the city's storm drain system, watercourse or water body, including but not limited to conveyances allowing any non- stormwater discharge such as sewage, process wastewater, and wash water to enter the storm drain system and any connections thereto from indoor drains and sinks, regardless of whether said drain or connection was previously allowed, permitted, or approved by the city of Edmonds; or (2) any drain or conveyance con- nected from a commercial or industrial land use to the storm drain system which has not been documented in plans, maps, or equivalent records and approved by the city. H. "Industrial activity" means activities subject to NPDES industrial permits as defined in 40 CFR, Section 122.26(b)(14). I. "Municipal separate storm sewer system" means a conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains): 1. Owned or operated by a municipal corporation or other public entity with juris- diction over management and discharge of stormwater and which discharges to surface waters of the state; 7.200.020 2. Designed or used for collecting or conveying stormwater; 3. Which is not part of a publicly owned treatment works (POTW). "POTW" means any device or system used in treatment of municipal sewage or industrial wastes of a liq- uid nature which is publicly owned; and 4. Which is not a combined sewer. "Combined sewer" means a system that col- lects sanitary sewage, industrial wastewater and stormwater in a single sewer system. J. "National Pollutant Discharge Elimina- tion System (NPDES) Stormwater Discharge Permit" means a permit issued by the Environ- mental Protection Agency (EPA) (or by the state under authority delegated pursuant to 33 USC Section 1342(b)) that authorizes the dis- charge of pollutants to waters of the United States, whether the permit is applicable on an individual, group, or general area -wide basis. K. "Nonstormwater discharge" means any discharge to the storm drain system that is not composed entirely of stormwater. L. "Person" means any individual, associa- tion, organization, partnership, firm, corpora- tion or other entity recognized by law and acting as either the owner of a premises or as the owner's agent. M. "Pollutant" means anything which causes or contributes to pollution. Pollutants may include, but are not limited to: paints, var- nishes, and solvents; oil and other automotive fluids; nonhazardous liquid and solid wastes and yard wastes; refuse, rubbish, garbage, lit- ter, or other discarded or abandoned objects and accumulations, so that same may cause or contribute to pollution; floatables; pesticides, herbicides, and fertilizers; hazardous sub- stances and wastes; sewage, fecal coliform and pathogens; dissolved and particulate metals; animal wastes; wastes and residues that result from constructing a building or structure; and noxious or offensive matter of any kind. 7-59 (Revised 2/04) 7.200.030 N. "Premises" means any building, lot, par- cel of land, or portion of land, whether improved or unimproved, including adjacent sidewalks and parking strips. O. "Storm drainage system" means pub- licly owned facilities, including the city's municipal separate storm sewer system, by which stormwater is collected and/or con- veyed, including but not limited to any roads with drainage systems, municipal streets, gut- ters, curbs, inlets, piped storm drains, pumping facilities, retention and detention basins, natu- ral and human -made or altered drainage chan- nels, reservoirs, and other drainage structures. P. "Stormwater" means any surface flow, runoff, and drainage consisting entirely of water from any form of natural precipitation, and resulting from such precipitation. Q. "Stormwater pollution prevention plan" means a document which describes the best management practices and activities to be implemented by a person to identify sources of pollution or contamination at a premises and the actions to eliminate or reduce pollutant dis- charges to stormwater, stormwater convey- ance systems, and/or receiving waters to the maximum extent practicable. R. "Wastewater" means any water or other liquid, other than uncontaminated stormwater, discharged from a premises. S. "Water body" means any landscape fea- ture compromising any body of water, whether standing or flowing, including, but not limited to, Puget Sound, lakes, ponds, rivers, streams or creeks. T. "Watercourse" means a water body con- sisting of a natural or artificial channel through which water flows. [Ord. 3483 § 1, 2003]. 7.200.030 Applicability. This chapter shall apply to all nonstormwa- ter discharges entering the storm drain system generated on any developed or undeveloped lands, unless explicitly exempted by the city. [Ord. 3483 § 1, 2003]. (Revised 2/04) 7-60 7.200.040 Responsibility for administration. The public works director shall administer, implement, and enforce the provisions of this chapter. Any powers granted or duties imposed upon the director may be delegated in writing by the director to persons or entities acting in the beneficial interest of or in the employ of the city. [Ord. 3483 § 1, 2003]. 7.200.050 Severability. The provisions of this chapter are hereby declared to be severable. If any provision, clause, sentence, or paragraph of this chapter or the application thereof to any person, estab- lishment, or circumstances shall be held invalid, such invalidity shall not affect the other provisions or application of this chapter. [Ord. 3483 § 1, 2003]. 7.200.060 Ultimate responsibility. The standards set forth herein and promul- gated pursuant to this chapter represent mini- mum standards. Compliance by any person with the standards established under this chap- ter does not relieve any person from any responsibility or obligation imposed pursuant to any other local, state or federal regulation. [Ord. 3483 § 1, 2003]. 7.200.070 Discharge prohibitions. A. Prohibition of Illegal Discharges. No person shall discharge or cause to be dis- charged into the municipal storm drain system or any watercourse any materials (including but not limited to pollutants or waters contain- ing any pollutants that cause or contribute to a violation of applicable water quality stan- dards) other than stormwater. Contaminants include but are not limited to the following: 1. Trash or debris; 2. Construction materials; 3. Petroleum products including but not limited to oil, gasoline, grease, fuel oil and heating oil; Edmonds City Code 4. Antifreeze and other automotive products; 5. Metals in either particulate or dis- solved form; 6. Flammable or explosive materials; 7. Radioactive material; 8. Batteries; 9. Acids, alkalis, or bases; 10. Paints, stains, resins, lacquers, or varnishes; 11. Degreasers and/or solvents; 12. Drain cleaners; 13. Pesticides, herbicides, or fertilizers; 14. Steam cleaning wastes; 15. Soaps, detergents, or ammonia; 16. Swimming pool or spa filter back- wash; 17. Chlorine, bromine, or other disinfec- tants; 18. Heated water; 19. Domestic animal wastes; 20. Sewage; 21. Recreational vehicle waste; 22. Animal carcasses; 23. Food wastes; 24. Bark and other fibrous materials; 25. Lawn clippings, leaves, or branches; 26. Silt, sediment, concrete, cement or gravel; 27. Dyes (except as described below under "permissible discharges"); 28. Chemicals, including suspected metals, not normally found in uncontaminated water; 29. Any other process -associated dis- charge except as otherwise allowed in this sec- tion; 30. Any hazardous material or waste not listed above. B. Permissible Discharges. The following types of discharges shall not be considered illegal discharges for the purposes of this chap- ter unless the director determines that the type of discharge, whether singly or in combination with others, is causing or is likely to cause pol- lution of surface water or groundwater: 7.200.070 1. Potable water including water from water line flushing and hydrant maintenance; 2. Uncontaminated water from crawl space pumps or footing drains; 3. Yard watering; 4. Dechlorinated swimming pool water; 5. Materials placed as part of an approved habitat restoration or bank stabiliza- tion project; 6. Natural uncontaminated surface water, springs or groundwater; 7. Flows from riparian habitats and wet- lands; 8. Common practices for water well dis- infection; 9. Discharges resulting from diffuse or ubiquitous sources such as atmospheric depo- sition; 10. Discharges resulting from dye test- ing authorized by the director; 11. Discharges which result from emer- gency response activities or other actions that must be undertaken immediately or within a time too short to allow full compliance with this chapter so as to avoid an imminent threat to public health or safety. The director may further define qualifying activities in adminis- trative guidance. The person responsible for said emergency response activities shall take all necessary steps to ensure that the dis- charges resulting from such activities are min- imized and ensure that future incidents are prevented to the greatest extent possible; 12. Air conditioning condensation; 13. Discharges permitted under an NPDES permit, waiver, or waste discharge order issued to the discharger and adminis- tered under the authority of the federal Envi- ronmental Protection Agency; provided, that the discharger is in full compliance with all requirements of the permit, waiver, or order and other applicable laws and regulations; and provided, that written approval has been granted for any discharge to the storm drain system; 7-61 (Revised 2/04) 7.200.080 14. Other water sources not containing pollutants; 15. Other types of discharges as deter- mined by the director. C. Prohibition of Illicit Connections. 1. The construction, use, maintenance or continued existence of illicit connections to the storm drain system is prohibited. 2. This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices appli- cable or prevailing at the time of connection. 3. A person is considered to be in viola- tion of this chapter if the person connects a line conveying sewage to the municipal separate storm sewer system, or allows such a connec- tion to continue. [Ord. 3483 § 1, 2003]. 7.200.080 Suspension of water service, sanitary sewer service and municipal separate storm sewer system access. A. Suspension Due to Illegal Discharges in Emergency Situations. The director may, with- out prior notice, suspend water service, sani- tary sewer service and/or municipal separate storm sewer system discharge access to a per- son when such suspension is necessary to stop an actual or threatened discharge which pre- sents or may present imminent and substantial danger to the environment, or to the health or welfare of persons, or to the municipal sepa- rate storm sewer system or waters of the state of Washington. If the violator fails to comply with an emergency suspension order, the director may take such steps as deemed neces- sary to prevent or minimize damage to the municipal separate storm sewer system or waters of the state of Washington, or to mini- mize danger to persons. B. Suspension Due to the Detection of Ille- gal Discharge. Any person discharging to the municipal separate storm sewer system in vio- lation of this chapter may have his/her water service, sanitary sewer service and/or munici- (Revised 2/04) 7-62 pal separate storm sewer system access termi- nated if such termination would abate or reduce an illegal discharge. The director will notify a violator of the proposed termination of its municipal separate storm sewer system access. The violator may petition the director for a reconsideration and hearing as provided in this chapter. C. Unauthorized Reinstatement. A person commits an offense and violates this chapter if the person reinstates municipal separate storm sewer system access to premises terminated pursuant to this section, without the prior approval of the director. [Ord. 3483 § 1, 2003]. 7.200.090 Industrial or construction activity discharges. Any person or activity subject to an NPDES stormwater discharge permit, waiver, or waste discharge order issued to the discharger and administered under the authority of the federal Environmental Protection Agency, shall com- ply with all provisions of such permit. Proof of compliance with said permit may be required in a form acceptable to the city prior to allow- ing discharges to the municipal separate storm sewer system. [Ord. 3483 § 1, 2003]. 7.200.100 Monitoring of discharges. A. Applicability. This section applies to all facilities that have stormwater discharges associated with industrial activity, including but not limited to construction activity. B. Access to Facilities. 1. The city shall be permitted to enter and inspect facilities subject to regulation under this chapter as often as may be necessary to determine compliance with this chapter. If a discharger has security measures in force which require proper identification and clear- ance before entry into its premises, the dis- charger shall make the necessary arrangements to allow access to representatives of the direc- tor. 2. Premises owners, occupiers and their agents shall allow the city ready access to all Edmonds City Code parts of the premises for the purposes of inspection, sampling, examination and copy- ing of records that must be kept under the con- ditions of an NPDES permit to discharge stormwater, and the performance of any addi- tional duties as defined by state and federal law. 3. The city shall have the right to install on any permitted premises such devices as are necessary in the opinion of the director to con- duct monitoring and/or sampling of the pre- mises' stormwater discharge. 4. The city has the right to require the discharger to install monitoring equipment as necessary. The premises' sampling and moni- toring equipment shall be maintained at all times in a safe and proper operating condition by the discharger at its own expense. All devices used to measure stormwater flow and quality shall be calibrated to ensure their accu- racy. 5. Any temporary or permanent obstruc- tion to safe and easy access to the premises to be inspected and/or sampled shall be promptly removed by the operator at the written or oral request of the director and shall not be replaced. The costs of clearing such access shall be borne by the operator. 6. Unreasonable delays in allowing the city access to a permitted premises are viola- tions of a stormwater discharge permit and of this chapter. A person who is the owner or operator of a premises with an NPDES permit to discharge stormwater associated with indus- trial activity commits an offense and violates this chapter if the person denies the city rea- sonable access to the permitted premises for the purpose of conducting any activity autho- rized or required by this chapter. 7. If the director has been refused access to any part of the premises from which storm - water is discharged, and he/she is able to dem- onstrate probable cause to believe that there may be a violation of this chapter, or that there is a need to inspect and/or sample as part of a routine inspection and sampling program 7.200.110 designed to verify compliance with this chap- ter or any order issued hereunder, or to protect the overall public health, safety, and welfare of the community, then the director may seek issuance of a search warrant from any court of competent jurisdiction. 8. In addition, the director may sus- pend water, sanitary sewer and/or storm drain access or access to any party refusing to pro- vide or delaying access. [Ord. 3483 § 1, 2003]. 7.200.110 Requirement to prevent, control, and reduce stormwater pollutants by the use of BMPs. The city will adopt requirements identifying best management practices for any activity, operation, or facility which may cause or con- tribute to pollution or contamination of storm - water, the storm drain system, or waters of the United States. The owner or operator of a com- mercial or industrial establishment shall pro- vide, at its own expense, reasonable protection from accidental discharge of prohibited mate- rials or other wastes into the municipal storm drain system or watercourses through the use of these structural and nonstructural BMPs. Further, any person responsible for a premises which is, or may be, the source of an illegal discharge, may be required to implement, at said person's expense, additional structural and nonstructural BMPs to prevent the further discharge of pollutants to the municipal sepa- rate storm sewer system. Compliance with all terms and conditions of a valid NPDES permit authorizing the discharge of stormwater asso- ciated with industrial activity, to the extent practicable, shall be deemed compliance with the provisions of this section. These BMPs shall be part of a stormwater pollution preven- tion plan (SWPPP) as necessary for compli- ance with requirements of the NPDES permit. [Ord. 3483 § 1, 2003]. 7-63 (Revised 2/04) 7.200.120 7.200.120 Watercourse protection. Every person owning property through which a watercourse passes, or such person's lessee, shall not pollute, contaminate, intro- duce new vegetation into, or significantly retard the flow of water through the water- course, and must comply with all critical areas protection requirements established in Chapter 20.15B ECDC. In addition, the owner or lessee shall maintain existing privately owned struc- tures within or adjacent to a watercourse, in a manner that such structures will not become a hazard to the use, function, or physical integ- rity of the watercourse. [Ord. 3483 § 1, 2003]. 7.200.130 Notification of spills. Notwithstanding other requirements of law, as soon as any person responsible for a pre- mises or operation, or responsible for emer- gency response for a premises or operation has information of any known or suspected release of materials which are resulting or may result in illegal discharges or pollutants discharging into stormwater, the storm drain system, or watercourses, said person shall take all neces- sary steps to ensure the discovery, contain- ment, and cleanup of such release. In the event of such a release of hazardous materials said person shall immediately notify emergency response agencies of the occurrence via emer- gency dispatch services. In the event of a release of nonhazardous materials, said person shall notify the director in person or by phone or facsimile no later than the next business day. Notifications in person or by phone shall be confirmed by written notice addressed and mailed to the city of Edmonds within three business days of the phone notice. If the dis- charge of prohibited materials emanates from a commercial or industrial establishment, the owner or operator of such establishment shall also retain an on-site written record of the dis- charge and the actions taken to prevent its recurrence. Such records shall be retained for at least three years. [Ord. 3483 § 1, 2003]. (Revised 2/04) 7-64 7.200.140 Enforcement. A. Civil Penalties Process Adopted. Edmonds Community Development Code (ECDC) Chapter 20.110 enforcement proce- dures are herein adopted in full with the pro- viso that repeat offenders or violations deemed an immediate public hazard shall be subject to a compliance and appeal timeline as deemed appropriate by the director based on the spe- cific nature and extent of the violation. B. Enforcement Orders. Whenever the director finds that a person has violated a pro- hibition or failed to meet a requirement of this chapter, the director may order compliance by written order to correct violation or notice of civil violation to the responsible person. Such notice may require without limitation: 1. The performance of monitoring, anal- yses, and reporting; 2. The elimination of illicit connections or illegal discharges; 3. That violating discharges, practices, or operations shall cease and desist; 4. The abatement or remediation of stormwater pollution or contamination hazards and the restoration of any affected property; 5. Payment of a fine to cover adminis- trative and remediation costs as provided under ECC 7.200.150; and 6. The implementation of source control or treatment BMPs. C. Compliance Deadlines. If abatement of a violation and/or restoration of affected prop- erty is required, the notice shall set forth a deadline within which such remediation or res- toration must be completed. Said notice shall further advise that, should the violator fail to remediate or restore within the established deadline, the work will be done by the city or a contractor designated by the public works director and the expense thereof shall be charged to the violator. [Ord. 3483 § 1, 2003]. Edmonds City Code 7.200.150 Penalties and collection. A. Civil Penalties. In addition to any other penalties mentioned in this chapter, the direc- tor may assess fines of no less than $100.00 nor more than $500.00 per day or portion of day thereof of the offense, to any person who fails to comply with the provisions of this chapter. The violator shall also reimburse the city for all costs associated with the enforce- ment of each violation, including but not lim- ited to administrative expenses, attorney's fees, legal costs and disbursements. B. Use of Collection Agency Authorized. The city may also, in its sole and exclusive dis- cretion, utilize a collection agency to collect fines applicable to this chapter. When a collec- tion agency is used, fines will be collected at a rate of 150 percent pursuant to RCW 19.16.500. [Ord. 3483 § 1, 2003]. 7.200.160 Appeal of notice of violation. Notwithstanding other provisions of this chapter, any person receiving a notice of civil violation under ECC 7.200.140 may appeal the determination of the public works director to the hearing examiner. The appeal process shall be in accordance with ECDC 20.110.040(C). The notice of appeal must be received by the director within 10 days from the date of the notice of civil violation. The decision of the hearing examiner shall be final. [Ord. 3483 § 1, 2003]. 7.200.170 Enforcement measures after appeal. If the violation has not been corrected pur- suant to the requirements set forth in the notice of civil violation, or, in the event of an appeal, within 10 days of the decision of the municipal authority upholding the decision of the direc- tor, representatives of the director may enter upon the subject private property and are authorized to take any and all measures neces- sary to abate the violation and/or restore the property. It shall be unlawful for any person, owner, agent or person in possession of any 7.200.180 premises to refuse to allow the city or desig- nated contractor to enter upon the premises for the purposes set forth above. [Ord. 3483 § 1, 2003]. 7.200.180 Cost of abatement of the violation. A. Abatement by City. If the violation has not been corrected pursuant to the require- ments set forth in the notice of civil violation, or in the event of an appeal under ECC 7.200.160, within 10 days of the hearing exam- iner ruling upholding the director's decision, then the city or a contractor designated by the director may enter upon the subject premises and is authorized to take any and all measures necessary to abate the violation and/or restore the property. It shall be unlawful for any per- son, owner, agent or person in possession of any premises to refuse to allow the city or des- ignated contractor to enter upon the premises for the purposes set forth above. B. Charging Cost of Abatement. 1. The city may recover against a prop- erty owner in violation of this chapter all attor- ney's fees, court costs and other administrative expenses associated with enforcement hereof, including but not limited to sampling and mon- itoring expenses. 2. Within 30 days after abatement of the violation by the city, the director may notify the property owner of the cost of abatement, including administrative costs. The property owner may file a written protest objecting to the amount of the assessment with the city clerk within 15 days. The city clerk shall set the matter for public hearing by the city coun- cil. The decision of the city council shall be set forth by resolution and shall be final. C. Urgency Abatement. The director is authorized to require immediate abatement of any violation of this chapter that constitutes an immediate threat to the health, safety or well- being of the public. If any such violation is not abated immediately as directed by the director, the city of Edmonds is authorized to enter onto 7-65 (Revised 2/04) 7.200.190 private property and to take any and all mea- sures required to remediate the violation. Any expense related to such remediation under- taken by the city shall be fully reimbursed by the property owner and/or responsible party. Any relief obtained under this section shall not prevent the city from seeking other and further relief authorized under this chapter. [Ord. 3483 § 1, 2003]. 7.200.190 Violations of Federal Clean Water Act. Any person who violates any provision of this chapter or any provision of any require- ment issued pursuant to this chapter, may also be in violation of the Clean Water Act and may be subject to the sanctions of that act including civil and criminal penalties. [Ord. 3483 § 1, 2003]. 7.200.200 Injunctive relief. It shall be unlawful for any person to violate any provision or fail to comply with any of the requirements of this chapter. If a person has violated or continues to violate the provisions of this chapter, the director may petition any court of competent jurisdiction for a prelimi- nary or permanent injunction restraining the person from activities which would create fur- ther violations or compelling the person to per- form abatement or remediation of the violation. [Ord. 3483 § 1, 2003]. 7.200.210 Compensatory action. In lieu of enforcement proceedings, penal- ties, and remedies authorized by this chapter, the director may impose upon a violator alter- native compensatory actions, including but not limited to storm drain stenciling, attendance at compliance workshops, and watercourse remediation. [Ord. 3483 § 1, 2003]. (Revised 2/04) 7-66 7.200.220 Violations deemed a public nuisance. In addition to the enforcement processes and penalties provided, any condition caused or permitted to exist in violation of any of the provisions of this chapter is a threat to public health, safety, and welfare, and is declared and deemed a public nuisance, and may be sum- marily abated or restored at the violator's expense, and/or a civil action to abate, enjoin, or otherwise compel the cessation of such nui- sance may be pursued. [Ord. 3483 § 1, 2003]. 7.200.230 Criminal prosecution. Any person that has violated or continues to violate this chapter shall be liable to criminal prosecution to the fullest extent of the law, and shall be subject to a criminal penalty of $250.00 per violation per day and/or imprison- ment for a period of time not to exceed 30 days. [Ord. 3483 § 1, 2003]. 7.200.240 Remedies not exclusive. The remedies listed in this chapter are not exclusive of any other remedies available under any applicable federal, state or local law and it is within the discretion of the director to seek cumulative remedies. [Ord. 3483 § 1, 2003]. 7.200.250 Superseding effect. The provisions of this chapter shall super- sede the provisions of any other chapter of the Edmonds City Code or Edmonds Community Development Code to, but only to, the extent of such inconsistency.
