2.25.040 Claims, demands and vouchers
presented by officers and
employees.
Certificates as to claims, demands and
vouchers of officers and employees of the city
for services rendered shall be made by the per-
son charged with the duty of preparing and sub-
mitting vouchers for the payment of services,
and that person shall certify that the claim,
demand or voucher is just, true and unpaid,
which certificate shall be part of the voucher.

2.25.050 Travel authorization and
expense reimbursement policies.
A. Policy. It is the city's policy to provide
payment for the reasonable accommodation of
travel required to conduct city business by city
officials and employees.
B. Applicability. This section and the poli-
cies contained herein shall be applicable to all
elected officials, members of boards and com-
missions and city employees unless otherwise
specifically exempted.
C. Authorization for Travel. All requests
for travel or training shall be submitted and
approved on an authorization to attend/travel
form prior to the person's departure date.
1. All anticipated costs should be listed
on the form, whether the costs are known or
reasonably estimated.
2. The mayor is authorized to approve
all employee's requests which are included
within the city's annual budget.
D. Travel and Training Request — City
Council Approval. City council approval must
be obtained of all travel and training requests
for members of the city council and members
of city boards and commissions.
E. Accommodations. Accommodations,
such as transportation, lodging and conference
registration shall normally be arranged in
advance by designated staff member and billed
directly to the city. Accommodations shall be
made at the lowest reasonable rate available,
such as coach fare for air transportation, use of

special discounts and single occupancy gov-
ernment rates for lodging. Air travel should be
used when other reasonable methods of trans-
port are not otherwise available and time
schedules require the additional expense.
F. Advance Payment of Expenses. Pursuant
to ECC 3.04.040, advance payment of autho-
rized expenses in excess of $100.00, as listed
on the authorization to attend/travel form, will
be provided upon request. Request for an
advance payment must be made at least one
week prior to the departure date.
G. Reimbursement of Travel Expenses.
1. Travel expenses by city officials and
employees shall be paid by the city in accor-
dance with the rate schedule listed below.
Expense vouchers must be submitted for pay-
ment within 10 days following the individual's
return. Expense receipts and/or credit card
receipts must be submitted for city payment. If
a receipt has been lost or stolen, the employee
should submit a written statement to the
administrative services director explaining the
circumstances of the missing receipt. Reim-
bursements based on this process may be
issued. Reimbursement for any expenses
which exceed the limits set forth in this policy
shall require approval of the city council.
Transportation:
Air travel — Coach rate
Private car — Current IRS rate
Rental car — Requires prior approval
Lodging:
Regular lodging — Government/commercial
rate
Conferences — Conference facility rate
Meals:
Actual reasonable cost of meals, subject to
review by department head and/or mayor
Communications:
Telephone — One personal call per day kept to
a reasonable amount

2. The transportation allowance shall be
based upon the direct route round trip costs.
Other allowable costs shall include ferry tolls
and off-street parking. Taxis may be used if
they are the most reasonable means of trans-
portation available.
H. Nonallowable Expenses. Expenses not
approved for reimbursement include, but are
not limited to, alcoholic beverages, expenses
for family or guests, entertainment, travel
costs paid by another organization, mileage (if
traveling as a passenger in a nonowned car),
limousine services and personal travel insur-
ance. Only the normal, reasonable and actual
expenses will be reimbursed. Public officials
and employees utilize public funds for their
expenses and are admonished and requested to
limit expenditures to those reasonably neces-
sary to provide safe, clean and convenient
lodging and healthy meals in settings appropri-
ate to the public mission with which they have
been entrusted.
I. Use of Private Cars. Private cars should
be used by city officials and employees when-
ever a city vehicle is not available and/or the
time the official or employee will be absent
exceeds two or more days. Drivers must have
a valid operator's license, and the car must be
insured to the state's minimum liability stan-
dards. The mayor, members of the city council,
boards and commissions shall not be reim-
bursed for mileage expenses incurred within
the city limits of Edmonds. City employees
will be reimbursed for mileage when using a
private vehicle within the city limits when
such use is in furtherance of city business. The
city's mileage reimbursement rate is intended
to cover the cost of fuel, maintenance and
insurance costs. Persons using a private vehi-
cle and seeking reimbursement for mileage
must maintain a valid driver's license and indi-
vidual auto insurance, including public liabil-
ity, bodily injury and property damage, which
insurance shall be deemed to be primary as to
any other insurance available to the city. If a
private vehicle is used in lieu of air transporta-

tion, the total amount of reimbursement shall
not exceed the cost of air fare as established in

2.25.060 Compliance with state law for

Claims or demands for damages to persons
or property shall be presented to the city in
accordance with the provisions of Chapter

3.04.070 Purposes of travel expense
advance.
A travel expense advance shall be consid-
ered as having been made to a city official or
employee to be expended as an agent of the
city and for the city's purposes only, and spe-
cifically to defray necessary cost in the perfor-
mance of official duties. No such advance shall
be considered as a personal loan to such offi-
cial or employee and any expenditure thereof,
other than for official business purposes, shall
be considered a misappropriation of public
funds. [Ord. 2188 § 1, 1980].
3.04.080 Credit cards.
In accordance with the provisions of RCW
43.09.2855 as the same exists or is hereafter
amended, authorizing political subdivisions to
use credit cards for official government busi-
ness, the administrative services director is
hereby authorized to obtain credit cards from
the city's designated official bank. The mayor
and his designee, the administrative services
director, shall establish rules and procedures
regarding the use of credit cards by city
employees for costs associated with official

3.04.090 Rules authorized.
The administrative services director is
authorized to adopt reasonable rules and regu-
lations for the operation and management of
the advance travel expense revolving fund and
to prepare appropriate forms for transactions

There is hereby created and established a
special fund to be known and designated as the
"equipment rental fund", to be used as a
revolving fund to be expended for salaries,
wages, and operations required for the repair,
replacement, purchase, and operation of equip-
ment, and for the purchase of equipment,
materials and supplies to be used in the admin-
istration and operation of the fund. [Ord. 2568,

3.05.020 Administration.
The equipment rental fund shall be adminis-
tered by the administrative services director
under the direction of the mayor. [Ord. 2568,

3.05.030 Transfer of departments.
All equipment of all offices and departments
of the city of Edmonds shall be transferred to
the equipment, rental fund, without charge.

3.05.040 Placement of money.
Money may be placed in the fund from time
to time by the Edmonds city council. [Ord.

3.05.050 Use of the fund.
The city of Edmonds shall purchase and sell
all equipment by the use of such fund, subject
to the laws governing the purchase and sale of
property. Such equipment shall be rented for
the use of the various offices and departments
of the city and may be rented by the city to
other governmental agencies. [Ord. 3524 § 2,
2004; Ord. 2568, 1986; Ord. 1111 § 5, 1965].
3.05.060 Disposition of sale proceeds and
purchases.
The proceeds received by the city from the
sale or rental of such equipment shall be placed
in the equipment rental fund, and the purchase
price of any such equipment or rental pay-
ments made by the city shall be made from
monies available in the fund. [Ord. 2568,
1986; Ord. 1111 § 6, 1965].
3.05.070 Rental charges — Schedule.
There shall be paid monthly into the equip-
ment rental fund out of the monies available to
the department using any such equipment,
which has not been purchased by that depart-
ment for its own use and out of its own funds,
reasonable rental charges fixed by the city
council of the city of Edmonds by approval of
a schedule submitted at regular meetings of the
city council by the administrative services
director, which schedule shall be sufficient to
cover the maintenance, operation and replace-
ment of said equipment as set forth in ECC
3.05.010 herein, and which shall be revised
from time to time to maintain the schedule so
as to reflect the current and foreseeable needs
of the equipment rental fund. [Ord. 2568,

3.05.080 Accounts and records.
There shall be kept, by those directed by the
administrative services director, such books,
accounts and records as are necessary to con-
trol and report the financial operations of the
equipment rental fund, and shall further subdi-
vide the cash account thereof into two sepa-
rately designated accounts as follows:

A. Account "A," which shall be the "cur-
rent operating account" into which shall be
placed those portions of the charges made to
the various departments or offices of the city of
Edmonds, in accordance with the provisions of
ECC 3.05.070 hereof, which are specifically
billed to provide sufficient monies to pay the
salaries and wages, materials, overhead and
other costs necessary to operate and maintain
all property rented thereto. There shall also be
placed into Account "A" monies which may
from time to time be specifically available
thereto by action of the city council.
B. Account "B," which shall be the "equip-
ment reserve account" into which shall be
placed those portions of the charges made to
the various departments or offices of the city,
in accordance with the provisions of ECC
3.05.070 thereof, which are specifically billed
to provide sufficient monies, having first taken
into consideration the necessary operating and
maintenance costs billed under the preceding
subsection A, to pay the costs of purchasing
new equipment and replacing used equipment
as required to carry out the purpose of the
equipment rental fund. There shall also be
placed in the Account `B" monies which are
derived from the direct sale of any equipment
or other capital assets of the fund and any mon-
ies made specifically available thereto by

3.05.100 Manner of withdrawals and
expenditures.
Any withdrawals or expenditures from the
equipment rental fund shall be made only in
the following manner:

3.29.010 One-quarter percent excise tax
on real estate sales.
A. Imposition. There is imposed an excise
tax on each sale of real property constituting a
taxable event as defined in Chapter 82.45 RCW
and occurring within the corporate limits of the
city of Edmonds. The tax imposed under this
section shall be collected from persons who are
taxable by the state under Chapter 82.45 RCW
and such tax shall comply with all applicable
rules, regulations, laws and court decisions
regarding real estate taxes as imposed by the
state under Chapter 82.45 RCW.
B. Rate of Tax. The rate of tax imposed
under this chapter shall be one-quarter of one
percent of the selling price of all real property
upon which this tax is imposed by subsection
A.
C. Use of Proceeds. All proceeds from the
tax imposed by this section shall be placed by
the city treasurer in a capital improvement fund
and shall be used for capital improvements,
including those listed in RCW 35.43.040. This
section shall not limit the existing authority of

this city to impose special assessments on
property benefited thereby in the manner pre-
scribed by law. [Ord. 2462, 1984].
3.29.013 Creation of special capital
improvement fund.
There is hereby created a special fund to be
known as the "special capital improvement
fund," into which shall be deposited all pro-
ceeds of the tax imposed by ECC 3.29.010.

3.29.015 Additional one-quarter percent
excise tax on real estate sales.
A. Pursuant to RCW 82.46.035, there is
imposed an additional excise tax on each sale
of real property constituting a taxable event as
defined in Chapter 82.45 RCW and occurring
within the corporate limits of the city of
Edmonds. The tax imposed under this section
shall be collected from persons who are tax-
able by the state under Chapter 82.45 RCW
and such tax shall comply with all applicable
rules, regulations, laws and court decisions
regarding real estate excise taxes as imposed
by the state under Chapter 82.45 RCW.
B. Rate of Tax. The rate of tax imposed by
this section pursuant to RCW 82.46.035 shall
be one-quarter of one percent of the selling
price of all real property upon which this tax is
imposed by subsection A.
C. Use of Proceeds. Revenues generated
from the tax imposed by this section shall be
used solely for the financing of projects speci-
fied in a capital facilities plan element of a
comprehensive plan approved by the city

3.29.017 Creation of real estate excise tax
2 parks improvement fund.
There is hereby created a special fund to be
known as the "real estate excise tax 2 parks
improvement fund," into which shall be depos-
ited all proceeds of the tax imposed by ECC
3.29.015. [Ord. 3524 § 3, 2004; Ord. 3160 § 2,
1997; Ord. 3031 § 2, 1995].

3.29.020 County to collect — Payment.
The county treasurer shall place one percent
of the proceeds of the taxes imposed herein in
the county current expense fund to defray costs
of collection. The remaining proceeds from
city taxes imposed herein shall be distributed
to the city monthly. [Ord. 2462, 1984].
3.29.030 Tax is obligation of seller.
The taxes imposed herein are the obligation
of the seller and may be enforced through the
action of debt against the seller or in the man-
ner prescribed for the foreclosure of mort-
gages. Resort to one course of enforcement is
not an election not to pursue the other. [Ord.
2462, 1984].
3.29.040 Tax lien on real property.
The taxes imposed herein and any interest or
penalties thereon are the specific lien upon
each piece of real property sold from the time
of sale or until the tax is paid, which lien may
be enforced in the manner prescribed for the
foreclosure of mortgages. [Ord. 2462, 1984].
3.29.050 Duties of county treasurer.
The taxes imposed herein shall be paid to
and collected by the treasurer of the county
within which is located the real property which
was sold. The county treasurer shall act as
agent for the city within the county imposing
the tax. The county treasurer shall cause a
stamp evidencing satisfaction of the lien to be
affixed to the instrument of sale or conveyance
prior to its recording or to the real estate excise
tax affidavit in the case of used mobile home
sales. A receipt issued by the county treasurer
for the payment of the tax imposed herein shall
be evidence of the satisfaction of the lien
imposed in ECC 3.29.040 and may be
recorded in the manner prescribed for record-
ing satisfactions or mortgages. No instrument
of sale or conveyance evidencing a sale subject
to the tax may be accepted by the county audi-
tor for filing or recording until the tax is paid
and the stamp affixed thereto; in case the tax is

not due on the transfer, the instrument shall not
be accepted until suitable notation of this fact
is made on the instrument by the county trea-
surer. [Ord. 2462, 1984].
3.29.060 Payment due.
The tax imposed hereunder shall become
due and payable immediately at the time of
sale and, if not so paid within 30 days thereaf-
ter, shall bear interest at the rate of one percent
per month from the time of sale until the date
of payment. [Ord. 2462, 1984].
3.29.070 Refunds.
If, upon written application by a taxpayer to
the county treasurer for a refund, it appears a
tax has been paid in excess of the amount actu-
ally due or upon a sale or other transfer
declared to be exempt, such excess amount or
improper payment shall be refunded by the
county treasurer to the taxpayer; provided, that
no refund shall be made unless the state has
first authorized the refund of an excessive
amount or an improper amount paid, unless
such improper amount was paid as a result of a
miscalculation. Any refund made shall be
withheld from the next monthly distribution to
the city. [Ord. 2462, 1984].
3.29.080 State law adopted by reference.
Chapter 82.45 RCW and any and all subse-
quent amendments to said statute are hereby
adopted by this reference as if set forth in full
herein. The city clerk is hereby directed to
maintain one copy of Chapter 82.45 RCW as
currently enacted or as subsequently amended
on file for public use and examination during
regular city business hours. Copies if said stat-
ute shall be attached to this ordinance and
authenticated by the city clerk. [Ord. 2462,

business where it may be inspected by an
investigating officer or police officer at any

4.11.030 Records to be kept.
A. Every motor vehicle wrecker shall main-
tain books or files in which he shall keep a
record and a description of every vehicle
wrecked, dismantled, disassembled or substan-
tially altered by him, together with the name of
the person, firm or corporation from whom he
purchased the vehicle. Such record shall also
contain:
1. The certificate of title number (if pre-
viously titled in this or any other state);
2. Name of state where last registered;
3. Number of the last license number
plate issued;
4. Name of vehicle;
5. Motor or identification number and
serial number of the vehicle;
6. Date purchased;
7. Disposition of the motor and chassis,
and such other information as the department
may require.
B. A motor vehicle wrecker shall also main-
tain a similar record of all disabled vehicles
that have been towed or transported to the
motor vehicle wrecker's place of business or
his representative. This record shall specify the
name and description of the vehicle, name of
the owner, number of license plate, condition
of the vehicle, the place where it was picked up
and the place to which it was towed or trans-
ported.
C. The abovementioned records and those
records required by the department to be kept
by a motor vehicle wrecker shall be subject to
inspection at all times by members of the
police department, sheriff's office and mem-
bers of the Washington State Patrol. [Ord.

4.11.060
4.11.040 Improper practices.
A. No motor vehicle wrecker shall know-
ingly buy, sell, receive, dispose of, conceal or
have in his possession any motor vehicle or
integral part thereof whose manufacturer's
serial number or other identification mark has
been removed, defaced, covered, altered or
destroyed such that it would facilitate conceal-
ing or misrepresenting the identity of such
motor vehicle or trailer.
B. No motor vehicle wrecker shall offer for
sale or sell used parts unless he has complied
with all the provisions of this chapter.
C. No motor vehicle wrecker shall acquire
a motor vehicle without first obtaining a certif-
icate of title if the vehicle has been last regis-
tered in a state which issued a certificate, or a
record of registration if registered in a state
which does not issue a certificate of title. [Ord.

4.11.050 Location and appearance of
place of business.
No motor vehicle wrecker shall keep any
motor vehicle or integral part thereof in any
place other than the established place of busi-
ness designated in the license issued by the
department, without permission of the depart-
ment. The activities of a motor vehicle wrecker
shall be conducted entirely within his estab-
lished place of business and such premises
shall be enclosed by a wall or fence six feet
high which will obscure from public view the
nature of the business conducted on the pre-
mises; provided, such wall or fence shall be
kept in good repair. A living hedge of suffi-
cient density and of equal height to prevent
view of the confined area may be substituted
for the wall or fence. [Ord. 1918 § 6, 1977].
4.11.060 Penalties.
Any motor vehicle wrecker who fails,
neglects or refuses to comply with any of the
provisions of this chapter shall upon conviction
be punished by a fine or imprisonment as set
forth in ECC 5.50.020. [Ord. 1918 § 7, 1977].

4.12.010 Definitions.
A. "Solicitor" or "peddler" means any per-
son who shall sell, offer for or expose for sale,
or who shall trade, deal or traffic in any goods
or services in the city by going from house to
house or from place to place or by indiscrimi-
nately approaching individuals.
1. Sales by sample or for future delivery,
and executory contracts of sale by solicitors or
peddlers are included; provided, however, that
this section shall not be deemed applicable to
any salesman or canvasser who solicits trade
from wholesale or retail dealers in the city.
2. Any person who, while selling or
offering for sale any goods, services or any-
thing of value, stands in a doorway, any unen-
closed vacant lot, parcel of land, or in any
other place not used by such person as a per-
manent place of business shall be deemed a
solicitor or peddler within the meaning of this
chapter, except as noted in subsection B of this
section.

B. "Street vendor" means any person who
shall sell food, flowers, nonalcoholic bever-
ages only, and/or other goods or services from
a nonmotorized mobile vending unit, in the
commercially zoned areas of the city of
Edmonds, including unzoned property or
right-of-way adjacent to or abutting on com-
mercially zoned areas, shall be deemed a street
vendor subject to the regulations contained in
this chapter. The commercially zoned areas are
those zoned Neighborhood Business (BN),
Community Business (BC), Planned Business
(BP), Commercial Waterfront (CW); and Gen-
eral Commercial (CC, CG2).
C. "Mobile vending unit" means a cart,
kiosk or other device capable of being pushed
by one person, with at least two functional
wheels and positive wheel -locking devices.

4.12.020 License required.
A. It shall be unlawful for any person to act
as solicitor, peddler or street vendor within the
meaning and application of this chapter unless
that person or his/her employer shall have first
secured a license in the manner provided in
this chapter.
1. Any person who shall sell, deliver or
peddle any dairy product, meat, poultry, eel,
fish, mollusk, or shellfish must first obtain a
license pursuant to this chapter.
2. No licenses shall be issued or main-
tained for the sale of poultry or poultry prod-
ucts or meat or meat products which are
adulterated or distributed under unsanitary
conditions.
3. No licenses shall be issued for the sale
of shellfish unless the vendor can produce a
certificate of compliance as required by RCW
69.30.020.
B. All persons acting as a solicitor, peddler
or street vendor shall comply with all laws,
ordinances and regulations, including all Sno-
homish County health department require -

4.12.030 License fees.
The license fees for solicitors, peddlers or
street vendors shall be as follows:
A. Investigation Fee. New applications for
a solicitor, peddler or street vendor license
shall be accompanied by a nonrefundable
investigation fee of $10.00. Except as provided
in section B hereof, this investigation fee shall
be tendered only with the initial application of
any individual.
B. Annual Fee. On January 1 st of each year
all solicitor, peddler and street vendor licenses
shall automatically expire and be null and void
unless an annual fee of $25.00 is paid to the city
clerk; provided, however, for licenses issued
after June 30th of any year, only one-half of the
annual fee shall be required. Any license
renewed after June 30th of any year shall be
treated as a new application and subject to the
investigation fee. For each mobile vending
unit, there shall also be an annual fee of
$200.00. Associated solicitor, peddlers and
street vendors, and mobile vending units oper-
ated as an adjunct to an existing licensed busi-
ness shall pay any fee(s) set forth in subsection
C of this section.
C. Associated Solicitor, Peddler and Street
Vendor, and Associated Mobile Vendor Fee.
An annual fee of $8.00 per year per person or
unit shall be paid by the following person or
unit(s) licensed:
1. For each additional person soliciting,
peddling or vending under a principal appli-
cant's license issued pursuant to subsection B
of this section; and/or
2. For each mobile vending unit oper-
ated as an adjunct to an existing licensed busi-
ness on a site immediately adjacent to the
business and authorized for use pursuant to a
street use permit.

The fees provided for by this section shall
not be reduced after June 30th as provided for
annual fees in subsection B of this section.
D. Exemptions. The following persons
shall be exempt from license fees and applica-
tions required under this chapter:
1. Newspaper carriers;
2. Charitable, religious or nonprofit
organizations or corporations which have
received tax exempt status under 26 USC Sec-
tion 501(c)(3) or other similar civic, charitable
or nonprofit organizations;
3. Peddlers of fruits, vegetables, berries,
eggs or any farm produce edibles raised, gath-
ered, produced or manufactured by such per-
son;
4. A person who, after having been spe-
cifically requested by another to do so, calls
upon that other person for the purpose of dis-
playing goods, literature or giving information
about any article, thing, product or service;
5. Notwithstanding the exemptions pro-
vided herein, all exempt persons must provide
proof of their exempt status along with photo
identification upon request by a prospective
customer or law enforcement officer;
6. Exempt persons are exempt only from
city business licensing requirements and must
comply with all provisions of law, ordinance
and regulations and all applicable Snohomish
County health district requirements. [Ord.

4.12.040 License application —
Information required.
A. Any person, firm or other organization
desiring to secure a solicitor's, peddler's or
street vendor's license shall apply therefor in
writing to the city clerk, on forms provided by
the city, and such application shall set forth as
to each solicitor, peddler or street vendor as the
principal applicant as follows:

1. The name, address and telephone
number of the principal applicant, firm or other
organization;
2. In the event the name or address of the
applicant has changed within the last two
years, each name and address over the last
two-year period preceding the most recent;
3. The nature or character of the goods,
wares, merchandise or services to be offered
by each principal applicant;
4. A list of the persons originally con-
templating solicitation, peddling or street
vending within the city of Edmonds, and the
information required in subsection B of this
section as to each;
5. The name, address and telephone
number (business and home) of the individual
acting as manager of the principal applicant;
6. Written approval for the vending site
from the abutting property owner and/or tenant
in accordance with ECC 4.12.055(L); and
7. Such other information as reasonably
required by city officials.
B. For each person soliciting, peddling or
street vending within the city of Edmonds pur-
suant to a principal applicant and license as
required herein, whether acting as an
employee, independent contractor, or other-
wise, the following information shall be pro-
vided to the city clerk on forms provided by
the city and shall set forth as to each such per-
son the following:
1. His or her name, address and home
telephone number;
2. The name, address and telephone
number of the person, firm or other organiza-
tion holding the principal license;
3. His or her age and general personal
description as required by the city;
4. Any and all facts relating to any con-
viction of crimes as such information may be
required by the city in the application form;
and
5. Such other information as reasonably
required by city officials.

C. The city clerk shall refer the application
to the chief of police, who shall make a crimi-
nal history background investigation of the
applicant. Upon completion, the chief of
police shall forward the results of the investi-
gation to the city clerk.
D. If, as a result of the investigation, the
applicant is not found to have committed any
of the acts requiring denial as listed below, the
city clerk shall, upon payment of the pre-
scribed fee, issue the license to the applicant.
The city clerk shall deny the applicant the
license if the applicant has:
1. Committed any act consisting of
fraud or misrepresentation;
2. Committed any act which, if commit-
ted by a licensee, would be grounds for sus-
pension or revocation of a license;
3. Within the previous 10 years, been
convicted of a misdemeanor or felony directly
relating to his or her fitness to engage in the
occupation of peddler, solicitor or street ven-
dor and including, but not limited to, those
misdemeanors and felonies involving moral
turpitude, fraud or misrepresentation;
4. Been charged with a misdemeanor or
felony of the type defined in subsection (D)(3)
of this section, and disposition of that charge is
still pending;
5. Been refused a license under the pro-
visions of this chapter; provided, however, that
any applicant denied a license under the provi-
sions of this chapter may reapply if and when
the reasons for denial no longer exist; and
6. Made any false or misleading state-
ments in the application.
E. Every peddler shall be required to carry
the peddler's license and display it along with
photo identification upon request by a pro-
spective customer or law enforcement officer.
F. The city clerk is authorized to promul-
gate rules regarding the manner and method of
payment, including a prohibition or regulation
of payment by check, and the form of the appli-

4.12.050 Investigation of applicants.
It shall be the duty of the chief of police to
investigate each applicant made under ECC
4.12.040, in which investigation the chief of
police shall determine:
A. The genuineness of all credentials pre-
sented by the applicant and/or the individual
solicitor, peddler or street vendor and the reli-
ability of the product or services;
B. If the applicant and/or its solicitor, ped-
dler or street vendor has a criminal record;
C. The truth of the facts set forth in the
application; and
D. If the applicant or solicitor, peddler or
street vendor proposes to engage in a lawful
and legitimate commercial or professional
enterprise.
Such investigation must be completed
within a reasonable time. [Ord. 2536 § 1, 1985;
Ord. 830 § 5, 1960].
4.12.055 Street vendor requirements.
Any person seeking a permit for a street
vendor license under the definition of this
chapter shall comply with the following
requirements:
A. Prior to issuance of any street vendor
permit, the applicant shall submit and receive
approval by the architectural design board for
the design of the mobile vending cart and any
signage.
B. In addition to the licensing requirements
of this chapter, any street vendor shall be
required to obtain a street use permit.
C. All advertising shall be placed on the
mobile vending unit and will not be allowed on
the street or sidewalk. Maximum sign area
allowed shall be 10 square feet.
D. The vending site shall be kept clean and
orderly at all times, and the vendor must pro-
vide a refuse container. No portion of a ven-
dor's inventory, sales equipment, or any other

structure or equipment used in the sales or
solicitation process shall be left overnight
upon any unenclosed portion of any lot or site
within the city, nor upon any public street or
right-of-way without the issuance of a street
use permit for a mobile vending unit issued
pursuant to ECC 4.12.030(B) and (C).
E. The city reserves the right to limit the
number of vending permit sites in any given
area of the downtown. The development ser-
vices director shall determine the allowable
number of street vendors and shall exercise
this discretion based upon the needs of the
public, diversity of products offered for sale,
the smooth flow of pedestrian and vehicular
traffic and other similar considerations.
F. If located on a sidewalk, a minimum
clearance of five feet shall be maintained by
any street vendor.
G. Street vendors shall not locate within
that portion of improved street right-of-way
designed for vehicular traffic or parking. Street
vendors seeking to locate in improved street
rights-of-way or on sidewalks shall be oriented
toward pedestrian traffic movement or safety.
Any application to locate a street vendor in the
street right-of-way shall require approval by
the city traffic engineer and shall not interfere
in any way with vehicular or pedestrian traffic
or safety.
H. No mechanical audio or noise making
devices and no hawking is allowed. Hawking
is the loud, repeated oral solicitation of busi-
ness by the vendor or an assistant.
I. Street vendors are prohibited in parks and
in residentially zoned areas.
J. Street vendors are prohibited from occu-
pying parking spaces on city property or in
improved city rights-of-way reserved for
vehicular traffic, parking or other transporta-
tion.
K. All street vendors shall comply with all
applicable Snohomish County health district
requirements.

L. The applicant shall submit with his
application a copy of the written approval for
the vending site from the abutting property
owner and/or tenant. In the event that the prop-
erty owner or tenant shall disagree, the prop-
erty owner's decision shall be final.
1. In the event that the proposed site
abuts property owned by the city of Edmonds,
the applicant shall be required to obtain the
city's approval. Approvals relating to park
property shall be handled as a request to let a
concession under the terms of this chapter.
Request for sites abutting all other public land
owned by the city shall be forwarded to the
city council for their review and approval.
2. In the event that the site for which
approval is sought abuts vacant land, the appli-
cant shall make reasonable written attempts to
secure the approval of the property owner. If
the applicant is unable to do so, the city may
accept written proof of such attempts and issue
a conditional permit. If a complaint is later
received from the owner of the land, the
license shall be revoked. The granting of such
a conditional license shall vest no right in the
applicant.
M. The maximum permissible size for any
mobile vending unit shall be:
1. Thirty square feet for sidewalk loca-
tions; and
2. Fifty square feet for locations within
the street or other public right-of-way or when
located on private property.
In no event shall any mobile vending unit
exceed 10 feet in length. [Ord. 3513 § 4, 2004;

4.12.060 Issuance of license — Expiration.
The chief of police shall determine, within a
reasonable time, from his investigation, that
the facts set forth in the application are true,
that the purpose of the applicant and its solici-
tors, peddlers or street vendors is to engage in
a lawful and legitimate commercial or profes-
sional enterprise.

Having determined these facts, he shall then
approve the application and the city clerk may
issue the license applied for. Such license shall
expire on the 31 st day of December of the year
in which such license has been issued. Except
as hereinafter provided, no license shall be
issued until the conclusion of the aforesaid
investigation. [Ord. 2536 § 1, 1985; Ord. 830
§ 6, 1960].
4.12.065 Soliciting and peddling
restrictions.
All licenses issued pursuant to this chapter
shall be subject to the following time and loca-
tion restrictions:
A. Fourth of July Fireworks Display. For
the purpose of crowd and traffic control on the
Fourth of July, all soliciting after 6:00 p.m.
within one mile of the official fireworks dis-
play shall take place only within the confines
of the fireworks viewing area as designated by
the chief of police on the Civic Center play -
field.
B. No peddler or solicitor shall engage or
attempt to engage in the business of peddling
at any home, residence, apartment complex or
business that prominently displays a "No Ped-
dlers" or "No Solicitors" sign or any other sim-
ilar sign that communicates the occupants'
desire to not be contacted by peddlers.
C. No peddler or solicitor shall engage in
the business of peddling between the hours of
8:00 p.m. and 9:00 a.m. [Ord. 3513 § 5, 2004;
Ord. 2990 § 4, 1994; Ord. 2370 § 1, 1983].
4.12.070 Carrying of license required.
Such license shall be carried at all times by
each solicitor, peddler or street vendor for
whom issued, when soliciting, canvassing or
street vending in the city of Edmonds, and
shall be exhibited by any such solicitor, ped-
dler or street vendor whenever and wherever
he or she shall be requested to do so by any
police officer or any person solicited. [Ord.

4.12.080
4.12.080 Revocation of license.
Such license may be revoked by the city of
Edmonds for the violation by either the
employer or the solicitor, peddler or street ven-
dor of any of the ordinances of the city of
Edmonds. The city of Edmonds may also
revoke a license for a street vendor under the
following conditions:

or portions of streets where appropriate, con-
sidering the following factors:
1. The number of vehicles using the
street or portion of the street.
2. The speed of vehicles utilizing the
street.
3. The width of the street.
4. The time of day the street has been
utilized for play.
5. The number of people using the street
for play.
6. The danger of accidents occurring as
a result of play in the streets. [Ord. 2373,
1983].
8.32.030 One-way streets and alleys.
Upon those streets and parts of streets and in
those alleys described in ECC 8.64.010, vehic-
ular traffic shall move only in the indicated
direction when signs indicating the direction
of traffic are erected and maintained at every
intersection where movement in the opposite
direction is prohibited, and a vehicle passing
around a rotary traffic island shall be driven
only to the right of such island. [Ord. 1169 §
31, 1966].
8.32.040 Railroad trains not to block
streets.
It is unlawful for the directing officer or the
operator of any railroad train to direct the oper-
ation of or to operate the same in such a manner
as to prevent the use of any street for purposes
of travel for a period of time longer than five
minutes, except that this provision shall not
apply to trains or cars in motion other than
those engaged in switching. [Ord. 1169 § 48,
1966].
8.32.050 Compression brakes prohibited.
No person shall use motor vehicle brakes
which are in any way activated or operated by
the compression of the engine of any such
motor vehicle or any component part thereof.
8.32.060
A. It shall be an affirmative defense to pros-
ecution under this section that compression
brakes were applied in an emergency and were
necessary for the protection of persons and/or
property.
B. Bona fide emergency vehicles owned by
a public entity and equipped and licensed in
compliance with state law shall be exempt
from the provisions of this section. [Ord. 3186
§ 1, 1998; Ord. 1986 § 1, 1978].
8.32.060 Alcoholic beverages in vehicles.
It is a traffic infraction:
A. For any person to drink any alcoholic
beverage in a motor vehicle when the vehicle
is upon a highway;
B. For any person to have in his possession
while in a motor vehicle upon a highway, a
bottle, can, or other receptacle containing alco-
holic beverage if the container has been
opened or a seal broken or the contents par-
tially removed; or
C. For the registered owner of a motor vehi-
cle, or the driver if the registered owner is not
then present in the vehicle, to keep in a motor
vehicle when the vehicle is upon a highway, a
bottle, can, or other receptacle containing an
alcoholic beverage which has been opened or a
seal broken or the contents partially removed,
unless the container is kept in the trunk of the
vehicle or in some other area of the vehicle not
normally occupied by the driver or passengers
if the vehicle does not have a trunk. A utility
compartment or glove compartment is deemed
to be within the area occupied by the driver
and passengers.
This section does not apply to a public con-
veyance that has been commercially chartered
for group use or to the living quarters of a
motor home or camper or, except as otherwise
provided by the Edmonds City Code, to any
passenger for compensation in a for -hire vehi-
cle licensed under city, county, or state law.

8.32.070
8.32.070 Avoiding compliance with traffic
devices prohibited.
A. No person shall drive a motor vehicle
over private property in order to avoid compli-
ance with a traffic -control device.
B. Any person violating the provisions of
this section shall have committed a traffic
infraction, punishable by a maximum fine of
$250.00. [Ord. 2788 § 1, 1990].
8.32.080 Penalty.
Unless otherwise provided by state statute,
adopted by reference, court rule or by this
municipal code, any person violating any pro-
vision of this chapter shall be guilty of a traffic
infraction and shall be sentenced to a fine not
to exceed $1,000 for each offense. [Ord. 2853

MOTORIZED FOOT SCOOTERS

8.36.010 Motorized foot scooters.

8.36.010 Motorized foot scooters.
A. Definition. "Motorized foot scooter"
means a device with no more than two 10 -inch
or smaller diameter wheels that has handle-
bars, is designed to be stood or sat upon by the
operator, and is powered by an internal com-
bustion engine that is capable of propelling the
device with or without human propulsion.
B. Duty to Obey Traffic Control Devices
and Rules of the Road. Any person operating a
motorized foot scooter shall obey all rules of
the road applicable to vehicle or pedestrian
traffic, as well as the instructions of official
traffic -control signals, signs and other control
devices applicable to vehicles, unless other-
wise directed by a police officer.
C. Unsafe Use Prohibited. No motorized
foot scooter shall be ridden in a negligent or
unsafe manner but shall be operated with rea-
sonable regard for the safety of the operator
and other persons.
D. Prohibited Areas. Motorized foot scoot-
ers are prohibited from being operated:
1. On sidewalks within the city limits;
2. In city parks; and
3. On multiple -use trails including bicy-
cle paths, bikeways, equestrian trails, hiking
trails and recreation trails, except where such
trails are specifically marked stating that such
use is permitted.
E. Minimum Age Requirements. No
motorized foot scooter shall be operated on
streets, sidewalks or other public areas not oth-
erwise prohibited by this section to motorized
foot scooters unless the operator is at least 16
years of age.

F. Helmets Required. Any person operating
a motorized foot scooter or riding as a passen-
ger on a motorized foot scooter upon any pub-
lic area in the city shall wear an approved
helmet designed for safety that meets or
exceeds the requirements of standard Z-90.4
set by the American National Standards Insti-
tute (ANSI) or the Snell Foundation, or a sub-
sequent nationally recognized standard for
helmet performance as the city may adopt. The
helmet shall be worn over the head and
equipped with either a neck- or chin -strap that
shall be fastened securely while the motorized
foot scooter is in motion. Nothing herein shall
be interpreted to permit a passenger other than
the operator (see subsection M of this section).
G. Lights Required. No motorized foot
scooter shall be operated in use during the
hours of darkness as defined in RCW
46.37.020.
H. Noise Restriction. Operation of motor-
ized foot scooters is subject to the provisions
of ECC 5.30.130, Public disturbance noises.
I. Peace Disturbance. No person shall oper-
ate a motorized foot scooter in or around
school property while school is in session so as
to disturb the peace.
J. Public Access. No person shall operate a
motorized foot scooter in places of public
access, such as malls, parking lots or other
places where the public has a right of access as
an invitee.
K. Parental Negligence. No parent or
guardian of a child or ward under the age of 16
shall through negligence or inattention permit
such child to operate a motorized foot scooter
in violation of the provisions of this section.
L. Parental Responsibility. No parent or
guardian of any child or ward under the age of
16 shall knowingly permit such child to oper-
ate a motorized foot scooter in violation of the
provisions of this section.
M. One Rider. No person shall operate a
motorized foot scooter with any passenger
other than the operator.
8.36.030
N. Muffler. Every motorized foot scooter
operator shall ensure that the motorized foot
scooter is at all times equipped with a muffler
in good working order so as to prevent exces-
sive or unusual noise. Use of any cutout,
bypass or similar muffler elimination device is
prohibited.
O. Cruising Prohibited. Cruising is the
repeated passage of a motorized foot scooter
on or across a portion of a street or way open
to the public. No person shall operate a motor-
ized foot scooter nor permit a motorized foot
scooter under his control to be operated on any
block or 100 -yard segment of a city street or
right-of-way more than one time in the same
direction in any one-hour period. [Ord. 3521
§ 1, 2004].
8.36.020 Seizure and forfeiture.
Whenever a law enforcement officer has
probable cause to believe that a motorized foot
scooter was used or is intended to be used in
violation of this chapter, such conveyance
shall be subject to seizure and forfeiture. In the
event of seizure pursuant to this section, pro-
ceedings for forfeiture shall be deemed com-
menced by the seizure and shall be conducted
as outlined in Chapter 69.50 RCW. [Ord. 3521
§ 1, 2004].
8.36.030 Penalty.
A violation of this chapter is a traffic infrac-
tion and shall be processed and administered
according to the procedures set forth in Chap-
ter 46.63 RCW. The penalty for any infraction
established under this chapter shall be as fol-
lows:
First offense: $30.00
Second offense: $60.00
Third and subsequent offenses: $100.00
The court may confiscate and order forfei-
ture of the offender's motorized foot scooter.
The court may defer for one year a finding
that the infraction has been committed on con-
