3.20.050 Occupations subject to tax —
Amounts.
Sellers of electricity, gas, water, sewer,
cable television and telephone services shall be
subject to the taxes imposed by this chapter.
There are levied upon, and shall be collected
from, every person, firm, corporation or other
entity on account of the business activities,
license and occupation taxes in the amounts to
be determined by the application of the rates
against gross income as follows:
A. Public Utility Districts. Upon every per-
son, firm, corporation or other entity engaged
in or carrying on the business of selling or fur-
nishing electrical energy and power a fee or tax
equal in the following percentages is levied
upon the total gross income from such busi-
ness within the city of Edmonds during the tax
year for which the license is required:
1. A fee or tax equal to six percent.
2. Until December 31, 2013, an addi-
tional three-quarters of one percent for a total
of six percent shall be levied; provided, how-
ever that the additional three-quarters of one
percent shall automatically expire and be
repealed on December 31, 2013.
3. Provided, however, that there shall be
no tax or fee upon revenues derived from the
sale of electricity for the purposes of resale.
B. Natural or Manufactured Gas and Ser-
vice. Upon every person, firm, corporation or
other entity engaged in or carrying on the busi-
ness of transmitting, distributing, selling and
furnishing natural and/or manufactured gas, a
tax equal to six percent of the total gross
income from the sale of gas within the corpo-
rate limits of the city during and for the term
for which the occupation license is required.
C. Brokered Natural Gas — Use Tax in Lieu
of Occupations Tax. There is imposed under
the authority of RCW 35.21.870 a use tax on

the consumers of brokered natural gas. Such
tax shall be in lieu of the tax imposed by sub-
section B of this section when consumers
receive natural gas directly from a producer of
manufactured natural gas outside of the state
of Washington. Such tax shall be the same as
that imposed on a natural manufactured gas
utility by subsection B of this section, equal to
six percent of the customer's monthly pur-
chases or other use charge by the broker of out-
of-state natural gas.
D. Telephone Business. A tax equal to six
percent of the gross subscribers' exchange
monthly service charges billed to business and
residence customers located within the corpo-
rate limits of the city, together with six percent
of gross income derived from intrastate toll
service provided to business and residential
customers located within the corporate limits
of the city.
E. Cable Television. Pursuant to Chapter
4.68 ECC, community antenna television sys-
tems, commonly known as cable television
franchisees, pay a franchise tax of three per-
cent. In addition thereto, a tax is hereby levied
equal to three percent of the gross receipts col-
lected by the franchisee from the sale of its ser-
vices in the city of Edmonds. This additional
three percent is intended, when combined with
the franchise tax of three percent, to provide a
total of franchise fees and utility tax equaliza-
tion amounts equal to six percent of the gross
revenues of the franchisee derived from the
sale of its cable television services within the
city of Edmonds. Services shall include the
sale of all broadcast services to subscribers,
but shall not include revenues derived from the
sale of advertising or other minor miscella-
neous, incidental revenue unrelated to the sale
of subscriber services or equipment rental.
F. City Sewer Utility. The city of Edmonds,
as a seller of sewer services, shall be subject to
the tax imposed by this chapter. The sewer
utility shall pay a license fee or tax equal to six
percent on the gross income from the city's
sewer utility.

G. Solid Waste Haulers. Any solid waste
hauler shall be subject to the tax imposed by
this chapter. The solid waste hauler shall pay a
tax equal to six percent of the total gross
income from the charges derived from solid
waste disposal services within the corporate
limits of the city during and for the term for
which the occupation license is required.
H. City Water Utility. The city of
Edmonds, as the seller of water services, shall
be subject to the tax imposed by this chapter.
The water utility shall pay a license tax or fee
equal to six percent on the gross income from
the city's water utility.
I. City Stormwater Utility. The city of
Edmonds, as the seller of stormwater services,
shall be subject to the tax imposed by this
chapter. The stormwater utility shall pay a
license tax or fee equal to six percent on the
gross income from the city's stormwater util-

3.20.060 Exceptions and deductions.
A. Interstate or Foreign Commerce. There
shall be excepted and deducted from the total
gross income upon which the license fee or tax
is computed, so much thereof as is derived
from the transactions in interstate or foreign
commerce, or from business done for the gov-
ernment of the United States, its officers or
agents, and any amount paid by the taxpayer to
the United States, the state of Washington or
the city of Edmonds as excise taxes levied or
imposed upon the sale or distribution of prop-
erty or service.
B. Bad Debts. There shall be excepted and
deducted from the total gross income upon
which the license fee or tax is computed, all
bad debts for services incurred, rendered or
charged for during the tax year, or for a preced-
ing tax year if the charge-off is made in the
current tax year.

Debts shall be deemed bad and uncollectible
when the same have been written off the books
of the taxpayer. In the event debts are subse-
quently collected, said income shall be
reported in the return for tax year in which said
debts are collected and at the rate prevailing in
the tax year when collected.
C. Cash Discounts. There shall be excepted
and deducted from the total gross income upon
which the license fee or tax is computed, all
cash discounts allowed and actually granted to
customers of the taxpayer during the tax year.
D. Burden on Interstate Commerce. Noth-
ing in this chapter shall be construed as requir-
ing a license, or the payment of a license fee or
tax, or the doing of any act, which would con-
stitute an unlawful burden or interference in
violation of the Constitution or laws of the
United States or which would not be consistent
with the Constitution or laws of the state of
Washington.
E. Deduction Allowed. Any person subject
to the payment of a license fee or tax under the
provisions of any ordinance of the city other
than this chapter, on account of engaging in
any activity for which he is liable to tax here-
under, may deduct the amount of such fee or
tax from the amount of fee or tax imposed by
this chapter on account of such activity, but
such persons shall, nevertheless, in the manner
herein provided for, apply for and procure an
"occupation license."
F. There shall be excluded and deducted
from the total gross income upon which the
license fee or tax for telephone businesses and
telecommunications companies is computed,
the following:
1. That portion of the gross income de-
rived from charges to another telecommunica-
tions company, as defined in RCW 80.04.010,
for connecting fees, switching charges, or car-
rier access charges relating to intrastate toll
telephone services, or for access to, or charges
for, interstate services.
2. Charges by a taxpayer engaging in a
telephone business or to a telecommunications

but not limited to architects, engineers, law-
yers, doctors, dentists, real estate offices, etc.
H. "Commercial" and "retail buildings"
mean all types of retail and commercial busi-
ness establishments other than office buildings
and other than industrial or manufacturing, and
each such business shall be considered as a sep-
arate unit even though two or more may be in
the same building.
I. In the event there is more than one type of
operation in the same building, i.e., a profes-
sional office, a retail store, a restaurant, or an
apartment, then in that case each separate cat-
egory or type shall pay at the rate fixed under
that particular category or type.
J. "Equivalent residential unit" or " ERU"
means a sewer connection charge based upon
the winter standard water consumption of a
single-family residence of 7.07 per 100 cubic
feet of water. [Ord. 3339 § 1, 2000; Ord. 786 §

7.30.020 Separate single-family residence
meters.
Each single-family residence building or
structure served by water shall be provided
with its own separate water meter. Prior to the
time when such additional separate meters can
be installed, water rates shall be applicable on
the same basis as if the separate meters were
actually installed. [Ord. 1449, 1969].
7.30.030 Water rates - Meter installation
charges.
A. The bimonthly rates of water supplied
through meters shall be fixed at the following

B. Variable Rate. In addition to the base rate
set forth above, the customer shall be charged
the following rate per 100 cubic feet of water
consumed:

All water rate charges on water utility bills
mailed between January 1, 2007, and Decem-
ber 31, 2007, shall be based on rates as
reflected in this section corresponding with
said time period. Thereafter, all water rate
charges on water utility bills mailed on or after
January 1, 2008, shall be based on rates as
reflected in this section corresponding with
said time period until a new ordinance is
adopted amending the same.
C. Meter Installation Charges.
1. New service line and meter installa- -
tion charges are fixed as follows:
a. 3/4" $550.00
b. 1" $800.00
2. The actual cost of street restoration
(with regard to all surface streets) shall be
added to any meter installation charge, if appli-
cable.
3. When approved by the city engineer,
new service lines installed by a developer on a
plat shall be credited as follows:
a. 3/4" $175.00
b. 1" $200.00
D. All rates set forth in this section shall be
exclusive of any applicable taxes.

7.30.035 Water and sewer utility
connection charges.
A connection charge shall be paid by each
new customer connecting to the city's water or
sewer system in accordance with the following
requirements:
A. Sewer System. The sanitary sewer con-
nection charge shall be equivalent to $730.00
per ERU added as a result of the connection of
the development.
A multifamily residential unit shall be con-
sidered equivalent to 0.67 of an ERU and the
development services director shall estimate
the average winter water consumption for con-
nections of buildings, structures or uses other
than residences and prorate the connection rate
according to the equivalent number of ERUs
such building, structure or use represents and
establish an appropriate connection charge.
B. Water Connection Charge. The connec-
tion charge shall be based upon the size of the
meter installed:

C. No water connection charge shall be lev-
ied for connections to water mains installed
pursuant to Local Improvement District Nos.

7.30.040 Utility charges — Sanitary sewer.
The utility charges for sanitary sewer service
set forth in this section shall be added to and
made a part of the bimonthly or monthly rates
for water supplied through the meters as set
forth in ECC 7.30.030:
A. The following rates shall be charged on
all billings after the effective date shown with
respect to the following customers and/or ser-
vice:

B. For customers who are not served by city
waterlines but who are connected to city sew-
ers, the charges shall be the same as set forth in
subsection A of this section and its subpara-
graphs.
C. These rates do not apply to industries or
manufacturing concerns which have industrial
wastes. These, together with other activities
not covered in this chapter, shall be dealt with
on a special basis and have special rates set for
the particular business by the water/utility
administrative staff, subject to review and
approval by the city council.
D. All property owners within an area
served by a sanitary sewer system in the city of
Edmonds are hereby directed and compelled to
connect their private drains and sewers to the
city system. Failure to do so within 30 days of
written notice to connect by the city shall sub-
ject the property owner to a monthly penalty
equal to that charge imposed by subsections A,
B, and/or C above. Said penalty shall be billed
to the property owner, and they shall be subject
to payment, collection and enforcement in all
respects as though they were utility customers
of the city. All penalties collected shall be con-
sidered revenues of the sewer utility system.

7.30.045 Special connection charge.
In addition to any other charges prescribed
by this chapter, a special connection charge
shall be paid by the owner of any property, res-
idential dwelling unit, or other structure that
may hereafter connect to the sanitary sewer
improvements constructed by any local
improvement district formed by the city and
for which no assessment was imposed or
charged under the said LID. The special con-
nection charge for each property, residential
dwelling unit, or other structure so connected
shall be equal to the amount of the assessment
that would have been levied against such prop-
erty, residential dwelling unit, or structure
under the final assessment roll of the appropri-
ate LID if the said property, residential dwell-
ing unit, or other structure had been so
assessed, together with interest thereon at the
rate established by the ordinance authorizing
issuance of the bonds for said LID, from the
time of such authorization until the time of
connection. The special connection charge
shall be paid in a lump sum prior to connection
to the sanitary sewer. The special connection
charge provided for in this section shall apply
only where the debt used to finance the local
improvements has not yet been fully retired
through assessment payments. If such debt has
been fully retired through payment of such
assessments, the special connection charge

7.30.050 Unauthorized use of water.
It is unlawful for any person, firm, corpora-
tion, or other organization of any type whatso-
ever to take, or allow to be taken, water from
the Edmonds water system without a valid per -

the annual review of the city council in the
budget process. All investments shall be
reviewed and approved by the finance director.
C. Monies shall be paid out of said funds
only upon warrants drawn by the cemetery
board and approved in the manner set forth in
Chapter 2.25 ECC. All warrants shall be
endorsed by the mayor and attested by the city
finance director. In no event shall any monies
be expended from the cemetery maintenance
trust fund in excess of the annual income
earned nor shall any money be diverted from
such trust fund to any purpose other than pro-
vided in this chapter. To the extent permitted
by law, the council hereby prohibits itself and
future councils from diverting funds for the
cemetery maintenance trust fund, while reserv-
ing its right to budget monies to or approve
expenditures from the cemetery maintenance
trust fund in future budget years as it, in its sole
discretion, shall deem appropriate in order to
actuarially provide for the establishment of a
fund which will generate sufficient income to
meet the future foreseeable maintenance needs
of the cemetery. Expenditures of monies from
the cemetery improvement fund and the ceme-
tery maintenance trust fund shall be provided
for in the annual budget by the council subject
to the recommendation of the cemetery board.

10.16.060 Board subordinate to council.
The cemetery board shall, at all times, be
deemed subordinate to the city council and the
city council shall have power to settle all dis-
putes and regulate, modify and supervise the
exercise of the powers herein granted. [Ord.

10.16.070 Cemetery board alternates.
In addition to the seven board members, two
alternate persons shall be appointed to the
cemetery board and shall serve subject to the
following provisions:
A. In the absence of a regularly appointed
board member, an alternate shall exercise the

powers attributed to board members in ECC
10.16.030 and shall be subject to the same
requirements regarding attendance and other
attributes of the position. Between the two
alternate members, the alternate member who
has served upon the cemetery board for the
longest period of time shall be the first to serve
in a vacant regularly appointed board member
position.
B. When a vacancy upon the cemetery
board arises, the replacement member shall be
appointed to the open position, and in the event
that an alternate is appointed to the board as a
board member, a new person shall be appointed
to serve as the board alternate. [Ord. 3095 § 4,

10.16.200 Severability.
If any word, clause, phrase or other portion
of this chapter is held to be invalid or unconsti-
tutional by a court of competent jurisdiction,
the remaining words, clauses, phrases and
other portions of this chapter shall not be

commission — Number of

A. The purpose of the Edmonds arts com-
mission is to promote the arts as an integral part
of community life. The commission provides
quality experiences to increase public aware-
ness of the arts, assisting the work of students,
artists and local arts organizations, while pro-
viding public art that contributes to the com-
munity identity and establishing and pursuing
long range goals to benefit the arts and the
community.
B. There is established an Edmonds civic
arts commission which shall be composed of
seven members who shall be appointed by the
mayor subject to confirmation by the city coun-
cil. All members of the commission shall be
residents of the Edmonds community. At least
four members of the commission shall be
involved in the instruction of, or otherwise pro-
fessionally engaged in, the visual, literary
and/or performing arts. [Ord. 3626 § 1, 2007;

10.20.020 Terms of membership.
A. In order to ensure the fewest terms will
expire in any one year, the terms of the
appointed positions by position number shall

expire on December 31st of the year set oppo-
site said position number as follows:
Position No. 1: 1979;
Position No. 2: 1980;
Position No. 3: 1980;
Position No. 4: 1981;
Position No. 5: 1981;
Position No. 6: 1978;
Position No. 7: 1979.
Thereafter, the term of membership shall be
for four years.
B. Any appointment to a position vacated
other than by the expiration of the term of the
appointment shall be to fill the unexpired por-
tion of the term. Members may be removed by
the mayor with approval of the city council
after a public hearing before the city council
for inefficiency, neglect of duty, or malfea-
sance in office. Members shall be removed for
failure to maintain attendance as required by
provisions of the Edmonds City Code.
C. No person shall be appointed to serve
more than two full consecutive terms on the
commission. An appointment to fill a vacancy
for an unexpired term shall not constitute a full
term for the purposes of this section. A
vacancy for an unexpired term shall be filled in
the same manner as the original appointment.

10.20.030 Officers of commission —
Meetings — Quorum.
Members of the commission shall meet and
organize by electing from the members of the
commission a chairman and a vice-chairman,
and such other officers as may be determined
by the commission. It shall be the duty of the
chairman to preside at all meetings. The vice-
chairman shall perform this duty in the absence
of the chairman. A majority of the board shall
constitute a quorum for the transaction of busi-
ness. The commission shall set its own meeting
dates and shall give notice of such meeting in
compliance with the Open Public Meeting Act
of the state of Washington, as it now exists and
as it may be amended from time to time. Pro -
