sick leave hours with the last paycheck in
August of each year. The sick leave payout
shall be paid with the first paycheck in January.
Employees must request the optional sick leave
payout within 10 working days from the date
notice of accrued sick leave was provided.
G. Newly hired employees who are entitled
to transfer sick leave from their previous
employer to the city of Edmonds pursuant to
interlocal agreement, collective bargaining
agreement and/or state law may transfer such
sick leave banks subject to the rules set forth in
this section. In addition, a transferred
employee who would, under the provisions of
the city's personnel policies, be required to pay
back worker's compensation benefits
advanced by the city and thereby restore
his/her sick leave bank may exercise such
rights with respect to funds received from
Labor and Industries as worker's compensa-
tion within the first six months of their employ-
ment, thereby buying back sick leave which
otherwise could have been transferred. [Ord.

2.35.070 Transfer of position.
In the event an employee is transferred from
one position to another within the city, any
accrued vacation time and/or accrued sick
leave time and/or compensating time shall be
available to the employee in his new position.

2.35.080 Extenuating circumstances.
The foregoing provisions of this chapter
shall be considered as minimum employee
privileges, which may be extended for extenu-
ating circumstances upon the approval of the
mayor. [Ord. 1168 § 8, 1966].
2.35.090 Conflict.
A. In the event that any provision of this
chapter or any provision of this title shall con-
flict with any provision of an employment con -

tract or collective bargaining agreement
approved by the city council, such contract or
agreement shall prevail. In no event shall any
employee be entitled to claim greater benefits
under this chapter than those provided for by a
collective bargaining agreement or employee
contract covering said individual's employ-
ment.
B. It is understood that in order to attract
experienced personnel, the city may be
required to authorize deviations from the ben-
efits established by this title or through the
city's personnel manual. During the course of
any budget year, the mayor or his designee is
authorized to extend offer letters to individuals
which provide for benefits greater than those
to which an entry-level employee would be
entitled. The purpose of this authorization is to
permit the city to attract persons with experi-
ence at comparable public agencies. When the
mayor, in his discretion, believes that it is nec-
essary to attract such individuals to the city,
benefits may be authorized which place an
individual at a higher level of benefits, such as
vacation accrual, than their hire date would
otherwise indicate. Such employment offers
shall be ratified by the city council. In the
event such ratification is not granted, the indi-
vidual shall retain those benefits only for the
budget year in which they are offered. The
mayor's offer shall not exceed the maximum
imposed for employees of the classification or
job status which has been established for such
benefit without the prior written consent of the
city council. All such offers shall be limited to
and within the funds budgeted for the budget
year in which the offer is made. [Ord. 3505

2.36.010 Annual leave for reservists.
Every city employee who is a member of the
Washington National Guard or of the Army,
Navy, Air Force, Coast Guard, or Marine
Corps Reserve of the United States, or of any
organized reserve or armed forces of the
United States, shall be entitled to annual leave
as provided in RCW 38.40.060. [Ord. 3373 §
1, 2001].
2.36.020 Military service.
A. Subject to the provisions of subsections
(B) through (G) of this section, every city
employee who is called to active duty or enlists
for duty in the Washington National Guard, or
in the Army, Navy, Air Force, Coast Guard or
Marine Corps of the United States of America
shall be entitled to receive from the city, com-
mencing on the first day the employee reports
for active duty, or the first day of duty after
expiration of accrued leave (see subsection
(A)(4) of this section), and continuing for the
period specified below, or until the employee's
discharge from service, whichever first occurs:
1. For 60 days, the difference, if any,
between the employee's regular salary or
wages, fixed as of the last day of service ren-
dered to the city prior to reporting for active
duty, and the military compensation paid to the
employee for the employee's military service,
inclusive of housing and food allowances and
other similar expenses; and
2. For 90 days, following the expiration
of leave provided for in subsection (A)(1) of

this section: medical, dental and vision bene-
fits for the employee and the employee's
dependents, at the same level as provided to
the employee and the employee's dependents
as of the last day of service rendered to the city
prior to reporting for active duty. To the extent
consistent with plan documents, the employee
may continue to participate in the MEBT plan
for so long as the employee receives eligible
compensation salary under subsection (A)(1)
of this section or through the use of accrued
leave.
3. An employee shall be entitled to uti-
lize the total of the benefits set forth in this sec-
tion once within any five -calendar -year
period. The five-year period shall commence
on the first day such benefit(s) are used.
4. An employee may utilize vacation,
compensatory time and other forms of accrued
leave eligible for use in accordance with the
terms of, and limitations on the use of, such
accrued leave, prior to or in conjunction with
the use of military leave, in order to supple-
ment or extend the benefits created by this
chapter. Use of such benefits shall result in an
adjustment of time limits for military leave to
reflect the usage of accrued leave.
B. In order to qualify for the compensation
in benefits provided under subsection (A) of
this section, an employee who is involuntarily
called to or enlists in active military service
must execute an agreement obligating the
employee to return to work at the city upon
completion of active duty and within the
employment rights period established by fed-
eral law. The agreement shall provide that if the
employee fails to return to city employment
during the time period prescribed by law, the
employee shall be obligated to reimburse the
city for all compensation and benefits that are
paid under this section.
C. In order to receive the compensation pro-
vided by subsection (A)(1) of this section, the
employee shall be required to submit copies of
his or her military pay stubs showing all com-
pensation received from the military during the

period of active service. The employee may
submit such stubs once per pay period but no
more frequently than once every two weeks.
The city shall pay the compensation amount
due under subsection (A)(1) of this section, if
any, at the time of the city's next regularly
scheduled payroll.
D. City employees who have already been
involuntarily called to military service or
enlisted in military service prior to the effective
date of the amendment of this section (January
19, 2009) may qualify for the compensation
and benefits provided herein by signing an
agreement to return as provided in subsection
(B) of this section. In such case, the 60 days of
compensation and benefits and the 90 days of
insurance continuation shall commence on the
date the agreement is signed.
E. During the period of military leave, the
employee shall not accrue or receive any other
compensation, benefits, seniority or any other
rights whatsoever from the city except those
specifically provided for in this section and
those specifically required by state and federal
law, except to the extent that additional leave
accrues through the use of accrued leave under
subsection (A)(4) of this section.
F. Use of the term "employee" in this sec-
tion in order to describe those called to military
service is for convenience only and is not
intended to imply that such persons remain city
employees during the period of active duty.
Upon completion of the last day of service for
the city prior to reporting for active military
service, such person is no longer a city
employee for any purpose, unless and until
reemployed by the city as provided under state
and federal law.
G. Nothing herein shall be interpreted to
expand the rights of employees to return to the
city beyond those granted by state and federal
law. By way of illustration and not limitation,
the city reserves its right to determine whether
an employee can be reasonably accommodated
in the event that he/she becomes disabled, to
refuse to employ an individual who is dishon-

orably discharged or otherwise to exercise its
statutory or common law discretion as a public

2.36.030 Other military leave and
obligations.
The city will comply with all provisions of
state and federal law relating to military leaves
and benefits, including, but not limited to, 38

A. Pursuant to the provisions of WAC 296-
126-001(4), the city of Edmonds hereby
exempts its employees from the provisions of
Chapter 296-126 WAC. By way of illustration
and not limitation, the city's employees shall
not be governed by the provisions of WAC
296-126-092 relating to meal periods and rest
periods.
B. This exemption shall be interpreted in
accordance with the city's bargaining obliga-
tions pursuant to the provisions of Washington
law. Nothing herein shall be interpreted to
abrogate past practice or to permit the alter-
ation of any term or condition of employment
which is a mandatory subject of bargaining,
without notice to and, where appropriate, bar-
gaining with the appropriate collective bar-

3.20.050 Occupations subject to tax —
Amounts.
Sellers of electricity, gas, water, sewer,
cable television and telephone services shall be
subject to the taxes imposed by this chapter.
There are levied upon, and shall be collected
from, every person, firm, corporation or other
entity on account of the business activities,
license and occupation taxes in the amounts to
be determined by the application of the rates
against gross income as follows:
A. Public Utility Districts. Upon every per-
son, firm, corporation or other entity engaged
in or carrying on the business of selling or fur-
nishing electrical energy and power a fee or tax
equal in the following percentages is levied
upon the total gross income from such busi-
ness within the city of Edmonds during the tax
year for which the license is required:
1. A fee or tax equal to six percent.
2. Until December 31, 2013, an addi-
tional three-quarters of one percent for a total
of six percent shall be levied; provided, how-
ever that the additional three-quarters of one
percent shall automatically expire and be
repealed on December 31, 2013.
3. Provided, however, that there shall be
no tax or fee upon revenues derived from the
sale of electricity for the purposes of resale.
B. Natural or Manufactured Gas and Ser-
vice. Upon every person, firm, corporation or
other entity engaged in or carrying on the busi-
ness of transmitting, distributing, selling and
furnishing natural and/or manufactured gas, a
tax equal to six percent of the total gross
income from the sale of gas within the corpo-
rate limits of the city during and for the term
for which the occupation license is required.
C. Brokered Natural Gas — Use Tax in Lieu
of Occupations Tax. There is imposed under
the authority of RCW 35.21.870 a use tax on

the consumers of brokered natural gas. Such
tax shall be in lieu of the tax imposed by sub-
section B of this section when consumers
receive natural gas directly from a producer of
manufactured natural gas outside of the state
of Washington. Such tax shall be the same as
that imposed on a natural manufactured gas
utility by subsection B of this section, equal to
six percent of the customer's monthly pur-
chases or other use charge by the broker of out-
of-state natural gas.
D. Telephone Business. A tax equal to six
percent of the gross subscribers' exchange
monthly service charges billed to business and
residence customers located within the corpo-
rate limits of the city, together with six percent
of gross income derived from intrastate toll
service provided to business and residential
customers located within the corporate limits
of the city.
E. Cable Television. Pursuant to Chapter
4.68 ECC, community antenna television sys-
tems, commonly known as cable television
franchisees, are hereby levied a franchise fee
of five percent, as authorized by 47 U.S.C.
Section 542(a) and RCW 35.21.860, on all
gross revenues derived from any source of rev-
enue by cable television franchisees from their
cable television operations in the city of
Edmonds. In addition thereto, a business
license tax, as authorized in part by 47 U.S.C.
Section 542(g)(2)(A), is hereby levied equal to
six percent on all gross revenues derived from
any source of revenue by cable television fran-
chisees from their cable television operations
in the city of Edmonds.
F. City Sewer Utility. The city of Edmonds,
as a seller of sewer services, shall be subject to
the tax imposed by this chapter. The sewer
utility shall pay a license fee or tax equal to 10
percent of the gross income from the city's
sewer utility.
G. Solid Waste Haulers. Any solid waste
hauler shall be subject to the tax imposed by
this chapter. The solid waste hauler shall pay a
tax equal to six percent of the total gross

income from the charges derived from solid
waste disposal services within the corporate
limits of the city during and for the term for
which the occupation license is required.
H. City Water Utility. The city of
Edmonds, as the seller of water services, shall
be subject to the tax imposed by this chapter.
The water utility shall pay a license tax or fee
equal to 10 percent on the gross income from
the city's water utility.
I. City Storm Water Utility. The city of
Edmonds, as the seller of storm water services,
shall be subject to the tax imposed by this
chapter. The storm water utility shall pay a
license tax or fee equal to 10 percent on the
gross income from the city's storm water util-

3.20.060 Exceptions and deductions.
A. Interstate or Foreign Commerce. There
shall be excepted and deducted from the total
gross income upon which the license fee or tax
is computed, so much thereof as is derived
from the transactions in interstate or foreign
commerce, or from business done for the gov-
ernment of the United States, its officers or
agents, and any amount paid by the taxpayer to
the United States, the state of Washington or
the city of Edmonds as excise taxes levied or
imposed upon the sale or distribution of prop-
erty or service.
B. Bad Debts. There shall be excepted and
deducted from the total gross income upon
which the license fee or tax is computed, all
bad debts for services incurred, rendered or
charged for during the tax year, or for a preced-
ing tax year if the charge-off is made in the
current tax year.
Debts shall be deemed bad and uncollectible
when the same have been written off the books
of the taxpayer. In the event debts are subse-

quently collected, said income shall be
reported in the return for tax year in which said
debts are collected and at the rate prevailing in
the tax year when collected.
C. Cash Discounts. There shall be excepted
and deducted from the total gross income upon
which the license fee or tax is computed, all
cash discounts allowed and actually granted to
customers of the taxpayer during the tax year.
D. Burden on Interstate Commerce. Noth-
ing in this chapter shall be construed as requir-
ing a license, or the payment of a license fee or
tax, or the doing of any act, which would con-
stitute an unlawful burden or interference in
violation of the Constitution or laws of the
United States or which would not be consistent
with the Constitution or laws of the state of
Washington.
E. Deduction Allowed. Any person subject
to the payment of a license fee or tax under the
provisions of any ordinance of the city other
than this chapter, on account of engaging in
any activity for which he is liable to tax here-
under, may deduct the amount of such fee or
tax from the amount of fee or tax imposed by
this chapter on account of such activity, but
such persons shall, nevertheless, in the manner
herein provided for, apply for and procure an
"occupation license."
F. There shall be excluded and deducted
from the total gross income upon which the
license fee or tax for telephone businesses and
telecommunications companies is computed,
the following:
1. That portion of the gross income de-
rived from charges to another telecommunica-
tions company, as defined in RCW 80.04.010,
for connecting fees, switching charges, or car-
rier access charges relating to intrastate toll
telephone services, or for access to, or charges
for, interstate services.
2. Charges by a taxpayer engaging in a
telephone business or to a telecommunications

scribe a rate lower than that permitted in the
FCC Benchmark Rate Tables or more than 10
percent less than the cable company's Septem-
ber 30, 1992 per channel rate, whichever is
hi gher.
D. The cable company shall first make its
presentation, followed by the presentation of
the city staff entering its analysis and recom-
mendations, if any. Then all interested parties
who have filed an objection to the rate increase
shall be heard. Finally, members of the public
shall be heard. The staff should be given a brief
opportunity to respond and the company may
conclude with rebuttal, addressing new infor-
mation raised by the staff, interested parties or
the public. The mayor shall set reasonable time
limits for the presentation of the respective
parties; provided, that the time established for
individual public comments may by limited to
three minutes per person. [Ord. 2968, 1994].
3.60.110 Notice and hearing procedures —
Cost of service showing.
The general hearing procedures outlined in
ECC 3.60.100 shall apply to an application by
the company for a basic service rate above the
benchmark rate provided that:
A. The company shall submit a cost -of -ser-
vice showing prepared in accordance with
FCC regulations sufficient to support a finding
that the rates are reasonable. It shall make 10
copies available in conjunction with its initial
application for public inspection and use at the
hearing.
B. If the cable company submits a cost -of -
service showing, that showing supersedes any
benchmark/rollback provisions established by
the FCC. The city council may prescribe what-
ever rate it finds justified by the cost -of -ser-
vice showing, utilizing generally accepted
accounting principles, utility rate regulation
principles, and the review of criteria in 47 CFR
§§ 76.922 to 76.925 as the same exist or are
hereafter amended, even if that rate is below
the system's benchmark and more than 10 per -

cent below the system's September 30, 1992
rates. [Ord. 2968, 1994].
3.60.120 Refunds.
The city may order the company to refund to
subscribers that portion of previously paid
rates determined to be unreasonable. However,
the company's liability for refunds is generally
limited to a one-year period and shall not go
beyond September 1, 1993, the effective date
of the FCC rules. [Ord. 2968, 1994].
3.60.130 Use of administrative hearing
officer.
The city council may, in its sole discretion,
elect to have its hearing conducted by its hear-
ing examiner. In the event that a hearing is
conducted by the hearing examiner, the hear-
ing examiner shall present his or her proposed
findings of fact, conclusions and recommenda-
tions to the city council. Prior to adoption of
such findings, the city council shall hold a pub-
lic hearing at which the company, any inter-
ested parties who filed an objection to the rate
increase, and any member of the public may be
heard. The purpose of this public hearing will
be for the company, interested parties and the
public to comment on the proposed findings
and recommendations and shall not itself be an
evidentiary hearing. Having heard the com-
ments of the company, interested parties and
the public, the city council may adopt the rec-
ommendations of the hearing examiner,
reverse or modify the hearing examiner's
determination based upon the record before
the hearing examiner, or remand the matter
back to the hearing examiner for the taking of
further evidence and testimony. [Ord. 2968,

3.60.140 Appeals.
An appeal from any order or decision of the
city council regarding any rate increase shall
be solely to the FCC pursuant to 47 CFR §
76.944 as the same exists or is hereafter
amended. Such appeal shall be filed within 30

There is created a transportation benefit dis-
trict, to be known as the Edmonds transporta-
tion benefit district or "district," with
geographical boundaries comprised of the cor-
porate limits of the city as they currently exist
or as they may exist following future annex-
ations. [Ord. 3707 § 2, 2008].
3.65.020 Governing board.
A. The governing board of the transporta-
tion benefit district shall be the Edmonds city
council acting in an ex officio and independent
capacity, which shall have the authority to
exercise the statutory powers set forth in Chap-
ter 36.73 RCW.
B. The treasurer of the transportation bene-
fit district shall be the city finance director.
C. The board shall develop a material
change policy to address major plan changes
that affect project delivery or the ability to
finance the plan, pursuant to the requirements
set forth in RCW 36.73.160(1). At a minimum,
if a transportation improvement exceeds its
original cost by more than 20 percent, as iden-
tified in the district's original plan, a public
hearing shall be held to solicit public comment
regarding how the cost change should be
resolved.
D. The board shall issue an annual report,
pursuant to the requirements of RCW
36.73.160(2). [Ord. 3707 § 2, 2008].

3.65.030 Functions of the district.
A. The district board may authorize a vehi-
cle tax fee of up to $20.00 per vehicle as pro-
vided for by RCW 82.80.140. Any expansion
of the authorized purposes of the district shall
be undertaken only after notice, hearing and
adoption of an ordinance in accordance with
RCW 36.73.050(2)(b) or a vote of the people
pursuant to RCW 36.73.065(3).
B. When authorized by the voters pursuant
to the requirements of Chapter 36.73 RCW,
other taxes, fees, charges and tolls or increases
in these revenue services may be assessed for
the preservation, maintenance and operations
of city streets. Additional transportation
improvements may be added to the functions
of the district upon compliance with the
requirements of said chapter.
C. The board shall have and exercise all
powers and functions provided by Chapter
36.73 RCW to fulfill the functions of the dis-

3.65.040 Transportation improvements

benefit district shall be used for transportation
improvements that preserve, maintain and
operate the existing transportation infrastruc-
ture of the city, consistent with the require-
ments of Chapter 36.73 RCW. The funds may
be utilized for any lawful purpose under the
chapter; but all funds raised through the TBD
shall be expended only for such preservation,
maintenance and operation in accordance with
the provisions of Chapter 36.73 RCW as the
same exists or is hereafter amended. The funds
expended by the district shall preserve, main-
tain and operate the city's previous invest-
ments in the transportation infrastructure,
reduce the risk of transportation facility fail-
ure, improve safety, continue the cost-effec-
tiveness of the city's infrastructure invest-
ments, and continue the optimal performance
of the transportation system. Additional trans-
portation improvement projects may be funded

only after compliance with the provisions of
RCW 36.73.050(b) following notice, public
hearing and enactment of an authorizing ordi-
nance. [Ord. 3707 § 2, 2008].
3.65.050 Dissolution of district.
The transportation benefit district shall be
automatically dissolved when all indebtedness
of the district has been retired and when all of
the district's anticipated responsibilities have
been satisfied. Street preservation, mainte-
nance and operation are ongoing, long-term
obligations of the city. In order to comply with
the dissolution requirement of RCW
36.73.050, the Washington State Transporta-
tion Plan 2007-2026 timeframe is hereby
adopted and the district shall automatically be
dissolved 18 years from the effective date of
the ordinance codified in this chapter. [Ord.

C. Rental Unit. The term "rental unit" shall
mean a separate room or apartment leased for
human occupancy and contained within a sin-
gle structure, and shall include the operations
of rooming houses, boarders within private
residences and the operation of bed and break-
fast establishments which otherwise meet the
criteria of the exception created in the subpara-
graph above.
D. Private Residence. The term "private
residence" shall mean a separate, free-standing
structure leased for residential purposes and
human occupancy by one "family" as defined
by ECDC 21.30.010. [Ord. 3439 § 1, 2003;
Ord. 2562, 1986; Ord. 2536 § 2, 1985; Ord.
2315 § 1, 19821.
4.72.020 Business license required.
It shall be unlawful for any person to oper-
ate, engage in or practice any business in the
city of Edmonds without first having obtained
a business license from the city. If more than
one business is located on a single premises, a
separate license shall be required for each sep-
arate business conducted, operated, engaged in
or practiced. [Ord. 3282 § 1, 1999; Ord. 1139
§ 1, 1965].
4.72.023 Registration of transient
accommodations.
It shall be unlawful for any person, partner-
ship or corporation to operate a bed and break-
fast establishment or other form of transient
accommodation without first registering such
accommodation with the city's fire marshal.
4.72.030
"Transient accommodation" shall mean any
hotel, motel, condominium, resort or other
facility regardless of size which offers rental of
one or more lodging units on a daily or weekly
basis. It shall not include rooms let on month-
to-month leases or longer tenancies. Applica-
tion for a business license shall satisfy the
requirements of this section; any transient
accommodation exempt from the provisions of
this chapter shall register in writing with the
fire marshal on a form designated for use by the
fire marshal. Violations of this section shall be
punishable by a fine of $20.00; each and every
day of violation shall constitute a separate
offense. [Ord. 2566 § 1, 1986].
4.72.030 Procedure.
A. Application for the business license
shall be made in writing to the city clerk upon
a form provided by the city clerk, and the
applicant shall at the same time deposit with
the city clerk in advance the license fee herein
required. The application shall state the nature
and address or addresses of the business or
businesses, or proposed business or busi-
nesses, of the applicant, and such other infor-
mation as requested by the city clerk.
B. If the applicant be a partnership, the
application must be made by one of the part-
ners; if a corporation, by one of the officers
thereof; if a foreign corporation, partnership or
nonresident individual, by the resident agent or
local manager of the corporation, partnership
or individual.
C. The city clerk shall present all applica-
tions for licenses to the mayor. The mayor shall
cause an investigation of the application to be
made by the proper city officials and shall grant
or refuse to grant the license within 15 days of
the date of application. If an application is
refused the reason for refusal shall be desig-
nated on the application. The fee shall not be
refunded. [Ord. 1139 § 1, 1965].

4.72.040
4.72.040 Fee — Terms — Penalty.
A. Commending January 1, 1977, business
licenses required to be obtained pursuant to
this chapter, shall be issued on a calendar year
basis and shall expire on December 31st of the
year for which they are issued.
B. Fees for an annual business license
issued hereunder shall be as follows:
1. The fee for an application for a new
business license for any business that is not a
home occupation, as provided in Chapter
20.20 ECDC, to be operated from any real
estate within the city of Edmonds shall be
$125.00;
2. The fee for an application for a new
business license for a new home occupation
business, as provided in Chapter 20.20 ECDC,
to be operated from any residential real estate
within the city of Edmonds shall be $100.00;
3. The fee for an application for a new
business license for any other business con-
ducted for, under contract with or by providing
services to any person within the city shall be
$50.00; and
4. The fee for an application for an
annual renewal of a business license shall be
$50.00 for any business operated within the
city of Edmonds.
C. All businesses required to obtain
licenses hereunder shall obtain the same and
pay all fees required on or before February
15th of each respective year; provided, how-
ever, that for the year 1981 only, businesses
shall be required to obtain the licenses before
April 1. Any business which fails to obtain and
pay the license fees within said period of time
shall, in addition to any other penalties pro-
vided in this chapter, be assessed an amount
equal to 50 percent of the license fee for said
business as a penalty for such late application
and/or payment.

4.72.050 Ineligible activities.
Notwithstanding any provisions hereof to
the contrary, a license hereunder may not be
issued to any person who uses or occupies or
proposes to use or occupy any real property or
otherwise conducts or proposes to conduct any
business in violation of the provisions of any
ordinance of the city of Edmonds or the stat-
utes of the state of Washington. The granting
of a business license shall in no way be con-
strued as permission or acquiescence in a pro-
hibited activity or other violation of the law.

4.72.060 Revocation or suspension.
The city council shall, at any time, suspend
or revoke any license issued hereunder when-
ever the licensee or officer or partner thereof
has been convicted in any court of competent
jurisdiction of violating any statute of the
United States or the state of Washington or any
ordinance of the city of Edmonds upon the
business premises stated in the license or in
connection with the business stated in the
license; or where the place of business does not
conform to the ordinances of the city of
Edmonds; provided, a hearing thereon shall be
had before such revocation or suspension, and
the licensee shall be notified in writing by
sending the same to the address stated in the
license of the intention of the city council to
revoke or suspend said license at a regular
meeting of the city council at a time and date
denominated in the notification giving the lic-
ensee at least six days' notice prior to the date
for the hearing. The licensee may appear at
that time and be heard in opposition to such
revocation or suspension. [Ord. 1139 § 1,

4.72.065 Transfer or sale of business —
New license required.
Upon the sale or transfer of any business
licensed by this chapter, the license issued to
the prior owner or transferor shall automati-
cally expire on the date of such sale or transfer

and the new owner intending to continue such
business in the city of Edmonds shall apply for
a new business license pursuant to the proce-
dures established by this chapter. [Ord. 2315 §

4.72.070 Penalty for violation.
Any person, as defined herein, and the offic-
ers, directors, managing agents, or partners of
any corporation, firm, partnership or other
organization or business violating or failing to
comply with any provisions of this chapter
shall be guilty of a misdemeanor and, upon
conviction, shall be punished by a fine in any
sum not exceeding $250.00 or by imprison-
ment for a period not exceeding nine months,
or both, and each day of violation shall consti-

Businesses which are not family-oriented
and which may have an adverse impact upon
family commerce, recreation, education and
worship should be encouraged to locate in
other communities where their patronage
would be more probable and profitable, and
where their impact would be more acceptable.
To identify such businesses before issuing a
business license to the same, the city of
Edmonds shall require a study and review of
probable impact on the community of any pro-
posed business activity oriented towards serv-
ing or attracting a special population of cus-
tomers, and not oriented toward activities
reasonably related to the health, education,
safety and welfare of the family. [Ord. 2167 §

5.60.060 Appeal, abatement and cost
recovery proceedings.
A. A party to whom the notice of violation
is issued may appeal the same as set forth in
ECDC 20.110.040(C). Written notice request-
ing an appeal hearing before the hearing exam-
iner shall be directed to the development
services director, and shall include the name of
the party requesting the appeal, the address of
the graffiti nuisance property, a statement indi-
cating standing to appeal, and a concise state-
ment as to reasons why the graffiti on the
property does not constitute a public nuisance.
B. Notice of Appeal Hearing. Upon a
timely written request for an appeal, the city
shall provide the appellant, notice of the appeal
hearing before the hearing examiner at least
five business days in advance of the same.
Notice shall be deemed served three business
days after the same is mailed to the parties by
certified U.S. mail.
C. Determination of Hearing Examiner.
The determination of the hearing examiner
after the due process hearing shall be final, and
there shall be no further administrative appeal.
If, after the due process hearing, the hearing
examiner determines that the property contains
graffiti viewable from a public or quasi -public
place, the hearing examiner shall declare the
same a nuisance and order the party to whom
the notice of violation is issued to abate it.
D. The hearing examiner shall issue a deci-
sion and order, if necessary, containing the fol-
lowing: findings of fact; conclusions in
support of the decision and order; type and
method of abatement action required; the date
by which said abatement must be completed;
and civil penalties to be assessed by the city
should appellant fail to abate the graffiti by the
date established in the decision and order.
Civil penalties shall range from $25.00 to
$250.00 based on appellant's appearance at the
hearing, frequency of offense, cooperation
with the city in efforts to abate the graffiti,
progress in abating the graffiti, and other rele-
vant factors. Each and every day or portion

thereof during which any violation is commit-
ted, continued, permitted or not corrected shall
be a violation for purposes of this chapter.
E. Abatement. The city may, pursuant to
Chapter 7.48 RCW, obtain a warrant of abate-
ment to enter upon the property, cause the
removal, painting over (in such color as shall
meet with the approval of the court), or such
other eradication thereof as the court deter-
mines appropriate, and shall provide the prop-
erty owner, or building owners association,
thereafter with an accounting of the costs of
the eradication effort on a full -cost -recovery
basis including reasonable legal fees and costs.

5.60.070 Trust fund.
A. The city council hereby creates the city
of Edmonds anti -graffiti trust fund. Penalties
assessed against violators of this chapter shall
be placed in the fund, along with any monetary
donations received from persons wishing to
contribute to the fund. The city council shall
direct the expenditures of monies in the fund.
Such expenditures shall be limited to the pay-
ment of the cost of graffiti removal from public
property, the payment of the cost of graffiti
removal from private property pursuant to sub-
section (B) of this section, the payment of
rewards for information leading to the convic-
tion of violation of this chapter, the costs of
administering this chapter, and such other pub-
lic purposes as may be approved by the council
by resolution.
B. The trust fund may be expended by the
city to abate graffiti from private property
without engaging in cost recovery proceedings
only upon approval by the council following a
recommendation of the hearing examiner upon
his or her finding that one of the following
conditions is met: (1) abating graffiti from the
private property in question accomplishes a
fundamental government purpose; (2) abating
graffiti from the private property in question
serves the public interest and there is no dona-
tive intent; or (3) abating graffiti from the pri-

vate property in question will assist the poor
and infirm. Recommendation from the hearing
examiner shall be submitted to the council for
consideration and decision. Approval shall be
by resolution. [Ord. 3677 § 1, 2008].
5.60.080 Remedies not exclusive.
The remedies for violation of this chapter
that are set forth in this chapter are not exclu-
sive. [Ord. 3677 § 1, 2008].
5.60.090 Severability.
If any provision of this chapter or its appli-
cation to any person or circumstance is held
invalid, the remainder of this chapter or the
application of the provision to other persons or

A. All persons transported for emergency
medical service (EMS) by the city's fire
department emergency aid and paramedic
units after December 31, 2008, shall be
charged and billed by the city at rates set and
adjusted as necessary by resolution of the city
council. The mayor or designee shall establish
a procedure to bill and collect EMS transport
charges. The city may contract with a billing
service and/or collection agency to bill and
collect the same.
B. A resident of the city, or a resident of a
jurisdiction that contracts with the city for
EMS, or an employee at, and transported from,
a business within the city or a jurisdiction that
contracts with the city for EMS, who supplies
the city with information and documentation
of his medical insurance policy necessary to
bill his insurance provider for EMS transport
charges, and who assigns his insurance bene-
fits for the same to the city, shall not be billed
for that portion of the EMS transport charges
that is in excess of amounts paid by his
insurer(s).
C. A person who does not meet the criteria
set forth above in subsection (B) of this sec-
tion, who supplies the city with information
and documentation of his medical insurance
policy necessary to bill his insurance provider
for EMS transport charges, and who assigns

his insurance benefits for the same to the city,
shall be billed for that portion of the EMS
transport charges that is in excess of amounts
paid by his insurer(s).
D. A person, regardless of residence, who
does not supply the city with information and
documentation of his medical insurance policy
necessary to bill his insurance provider for
EMS transport charges because he is unable or
unwilling, or because he does not have any
type of insurance coverage for such charges, or
who fails to assign his insurance benefits for
the same to the city, shall be billed for the
entire EMS transport charges.
E. The EMS transport charges herein
imposed shall not apply to persons transported
by the city's fire department emergency aid
and paramedic units from geographical bound-
aries of the cities of Lynnwood, Mountlake
Terrace, Brier and Shoreline or the unincorpo-
rated areas of Snohomish County other than
Esperance served by Fire District No. 1, unless
specifically authorized by interlocal agree-
ment.
F. The use of the term "insurance" or any
variation thereof in this section shall include
Medicare and Medicaid. [Ord. 3706 § 1,

5.65.020 Categories of EMS transport
charge.
EMS transport charges shall consist of one
of the following, in addition to a charge for
each mile, or fraction thereof, that the patient
is transported: Basic Life Support, Advanced
Life Support Level 1, or Advanced Life Sup-
port Level 2. Such additional charges shall be
established by resolution (see ECC
5.65.010(A)). [Ord. 3706 § 1, 2008].
5.65.030 Medicare and Medicaid.
Charges for the EMS transport authorized
by this chapter shall be construed and imple-
mented in a manner consistent with applicable
Medicare and Medicaid requirements, when
applicable. If any method or procedures autho-

rized by this chapter for the purpose of estab-
lishing, implementing, imposing or collection
of charges for EMS transport is found to con-
flict with Medicare and/or Medicaid require-
ments, the conflicting part of this chapter shall
be inoperative to the extent the same applies to
Medicare and/or Medicaid. The operation of
the remainder of this chapter shall remain
unaffected. [Ord. 3706 § 1, 2008].
5.65.040 Policy and financial assistance.
A. It is the city of Edmonds' policy that
ability to pay is never a condition of service.
All aspects of pre -hospital service shall be pro-
vided to all patients without discrimination
toward those with no ability or inadequate
means to pay.
B. The mayor or designee shall establish a
program consistent with criteria and rules set
forth in WAC 246-453-001 through 246-453-
060 to provide financial assistance and debt
forgiveness to persons who do not have the
ability to pay in full for EMS transport charges
imposed in this chapter. [Ord. 3706 § 1, 2008].

The health officer for the Snohomish Health

of Edmonds.
6.10.020 General duties.
The health officer of the city of Edmonds
shall look after and superintend all matters per-

6.10.050 Quarantine requirements.
Whenever any case of smallpox, varioloid,
or contagious disease, within the city limits,

such afflicted person or persons to be quaran-

6.10.060 Leaving place of quarantine
without permission prohibited.
Any person who is quarantined in any place
or residence because of smallpox or any other
contagious disease that comes under the quar-
antine regulations of the State Board of Health
or health officer, and leaves the same without
permission of the health officer, is guilty of a
misdemeanor. [Ord. 110 § 1, 1902].
6.10.070 Notice requirements.
All notices required by this chapter shall be
in writing and signed by the health officer or
his or her designee. The notice shall be served
by the police on the offender personally or by
leaving a copy at the place of the offender's
usual abode with a person of suitable age and

6.20.010 Purpose.
The purpose of this chapter is to protect and
serve the public health, safety and welfare by
deterring and preventing conditions which
constitute public nuisances, and providing for
the prompt, efficient and permanent abatement
of public nuisances. It is also the purpose of
this chapter to ensure that the persons respon-
sible for creating, maintaining and/or allowing
such nuisances bear the costs of any necessary
enforcement and abatement action to the full-
est extent legally permissible. The provisions
of this chapter shall be reasonably construed in
furtherance of these purposes. [Ord. 3720 § 4,
2008].
6.20.020 Definitions.
The following definitions shall apply for
purposes of this chapter:
A. "Antique vehicle" means a vehicle that
is at least 40 years old and is qualified pursuant
to WAC 308-96A-073.
B. "Driveway" means an improved surface
per city engineering standards designed and
used for accessing a parking area and/or for
vehicle parking.
C. "Emergency" means a situation in which
the community services director reasonably
determines that immediate abatement or other

action is necessary in order to prevent, reduce
or eliminate an immediate threat to health,
safety or property.
D. "Front yard" means a space on the same
lot as a principal building, extending the full
width of the lot, and situated between the street
right-of-way and the front line of the building
projected to the side lines of the lot. In the case
of a double frontage lot, both spaces with street
frontage shall be considered front yards.
E. "Junk vehicle" means a vehicle meeting
any two of the following criteria:
1. Is extensively damaged, including but
not limited to any of the following conditions:
a broken or missing windshield or missing
wheels, tires, motor or transmission;
2. Is apparently inoperable;
3. Is without valid current registration
plates;
4. Has an approximate fair market value
equal only to the approximate value of the
scrap in it.
F. "Inoperable" with respect to a vehicle
means that the vehicle is incapable of being
legally operated on a public roadway due to the
condition of the vehicle or the status of the
ownership, registration, or license of the vehi-
cle.
G. "Junk" means discarded, broken or dis-
abled material including but not limited to
household items, house or lawn furniture,
appliances, toys, construction items, hot tubs,
trampolines, vehicle parts, or other items that
are not neatly stored or in a functioning condi-
tion.
H. "Litter" means discarded waste materi-
als, including but not limited to paper, wrap-
pings, packaging material and discarded or
used containers.
I. "Motor vehicle" means a vehicle that is
self-propelled but not operated upon rails, and
includes neighborhood electric vehicles as
defined in RCW 46.04.357. An electric per-
sonal assistive mobility device is not consid-
ered a motor vehicle. A power wheelchair is
not considered a motor vehicle.

J. "Operable" with respect to a vehicle
means that the vehicle is a licensed motorized
or nonmotorized vehicle which in its current
condition is legally and physically capable of
being operated on a public roadway.
K. "Rear yard" means a space on the same
lot with a principal building, extending the full
width of the lot and situated between the rear
line of the lot and the rear line of the building
projected to the side lines of the lot.
L. "Salvage" means an item that would oth-
erwise be destroyed, rejected or discarded but
is or may be recycled or put to further use.
M. "Side yard" means a space on the same
lot with a principal building, situated between
the building and the side lot line and extending
from the rear line of the front yard to the front
line of the rear yard.
N. "Stagnant" means water or liquid that
has become foul, stale or impure through lack
of agitation, flow or movement.
O. "Trash" means waste food products and
other household garbage.
P. "Vehicle" means any motorized or non -
motorized conveyance that includes, but is not
limited to, an automobile, recreational vehicle,
truck, any type of trailer, van, motorcycle,
watercraft, farm equipment, construction
equipment and antique vehicles (i.e., cars,
trucks, vans, motorcycles, carriages, or motor-
ized buggies). [Ord. 3720 § 4, 2008].
6.20.040 Types of nuisances.
The actions and/or conditions enumerated
as public nuisances pursuant to Chapter 7.48
RCW are hereby designated as public nui-
sances for purposes of this chapter. Each of the
actions and conditions enumerated in ECC
6.20.041 and 6.20.042 are additionally desig-
nated as public nuisances for enforcement
under the provisions of this chapter. [Ord.

6.20.041
6.20.041 Aesthetic nuisances.
The following nuisances are aesthetic in
nature and can negatively impact neighbor-
hood property values and foster blight. The
following actions and/or conditions shall be a
public nuisance when located in any front, side
or rear yard or vacant lot:
A. Any junk, trash, or litter.
B. Salvage materials or lumber not neatly
stacked.
C. Any broken, soiled or discarded furni-
ture, household equipment or furnishings.
D. Any vehicle parts or other articles of
personal property which are stored, discarded
or left in a state of partial construction or
repair.
E. Any accumulation, stack or pile of build-
ing, landscaping or construction materials
which are exposed to the elements or are in
disarray and which are not directly associated
with a project on the premises for which a cur-
rent building permit has been obtained; or,
with respect to a project which does not require
a permit, that is in progress or which is sched-
uled to begin within 10 business days. Con-
struction materials include but are not limited
to metal, wood, wire, drywall, electrical com-
ponents, and any supplies, equipment or other
items utilized for painting, landscaping, log-
ging, roofing, masonry or plumbing.
F. Any shopping carts, except where such
shopping carts are owned and/or utilized for
their designated purpose upon the underlying
premises.
G. Exceptions. The nuisances enumerated
in subsections (A) through (D) of this section
shall not apply to items or materials when:
1. Wholly enclosed within a building; or
2. Located in a rear yard and screened
from adjacent properties and the public right-
of-way by a six-foot opaque fence or by a veg-
etative barrier that is between six feet and eight
feet in height and provides a visual barrier
equivalent to an opaque fence. Corner lots
which have no rear yard may establish a

screening area which qualifies for this excep-
tion in a side yard. [Ord. 3720 § 4, 2008].
6.20.042 Health and safety nuisances.
The following actions or conditions have a
direct impact on public health and are declared
to be public nuisances.
A. Vegetation. The following actions
and/or conditions shall be public nuisances:
1. Any dead, dying or other hazardous
tree which is in danger of falling and endan-
gers the traveling public on a street, alley, side-
walk or other public right-of-way. The word
"tree" shall have the same meaning as is pro-
vided in ECDC 18.45.040.
2. Any violation of the noxious weed
provisions of Chapter 6.30 ECC and/or any
uncultivated berry vines and Class B or Class
C noxious weeds (as classified by the Wash-
ington State Noxious Weed Control Board)
which exceed an average of three feet in height
and any portion of which are located within
five feet of an adjacent property.
B. Attractive Nuisances. Any attractive
nuisances dangerous to children are declared
to be public nuisances, including but not lim-
ited to the following items when located out-
side of a fully enclosed building:
1. Abandoned, broken or neglected
equipment;
2. Jagged, sharp or otherwise potentially
dangerous machinery;
3. Household or commercial appliances,
including but not limited to refrigerators,
freezers, washers, dryers, dishwashers, ovens,
hot water tanks, or toilets;
4. Unpermitted excavations; and/or
5. Unprotected or open wells or shafts.
C. Breeding Grounds for Vermin or
Insects. The following actions and/or condi-
tions are public nuisances:
1. Any accumulations of perishable
matter, including but not limited to foodstuffs,
that may harbor or attract the infestation of
mold, insects and/or vermin; provided, how-
ever, that this provision shall not apply to com-

post heaps or facilities which are maintained in
accordance with standards recommended by
the U.S. Composting Council.
2. Any stagnant, pooled water in which
mosquitoes, flies or other insects may repro-
duce.
3. Any stacks or accumulations of news-
papers, cardboard, or other paper, cloth, plas-
tic, or rubber left or stored in a manner which
poses a substantial risk of combustion, a threat
of fire, or that may harbor, serve as an attrac-
tion for or promote the infestation of mold,
insects and/or vermin.
D. Hazardous Conditions, Substances or
Materials. The following conditions or actions
are declared to be public nuisances:
1. Any structure or other constructed
object not governed by the International Build-
ing Code that is decayed, damaged, or in disre-
pair and poses a substantial threat of collapse,
structural failure or falling.
2. Any unstable embankment, fill or
other accumulation of rock and/or soil which
poses a substantial threat of collapse.
3. Any storage or keeping of any toxic,
flammable, or caustic substance or material
except in compliance with applicable require-
ments of state or federal law.
4. Any unpermitted obstruction of any
street, alley, crossing or sidewalk, and any
unpermitted excavation therein or thereunder.

6.20.043 Protective coverings.
Except as otherwise expressly provided by
applicable city ordinance or a valid regulatory
permit, any condition enumerated in ECC
6.20.040 shall constitute a public nuisance
irrespective of whether such condition is cov-
ered in whole or in part by a tarpaulin, vapor
barrier, canvas or plastic sheeting, or other
temporary covering. [Ord. 3720 § 4, 2008].

6.20.050 Enforcement and abatement.
A. Responsibility for Enforcement. The
provisions of this chapter shall be enforced by
the community services director or his/her des-
ignee.
B. Responsibility for Violation. The provi-
sions of this chapter shall be enforceable
against any person who causes, permits, cre-
ates, maintains or allows upon any premises,
any of the actions or conditions designated as
public nuisances under ECC 6.20.040, includ-
ing but not limited to any person or entity own-
ing, leasing, renting, occupying, or possessing
the underlying premises.
C. Penalties. Any person violating this
chapter shall be subject to civil enforcement
proceedings pursuant to Chapter 20.110
ECDC and/or criminal misdemeanor prosecu-
tion.
D. Abatement. The city may seek a warrant
of abatement from Snohomish County Supe-
rior Court authorizing city personnel and/or
contractors to enter any premises containing a
public nuisance and abate said nuisance at the
violator's expense. Prior to obtaining such a
warrant, the city shall provide written notice to
the responsible party by posting upon the sub-
ject premises, mailing and/or personal deliv-
ery. Such notice may be combined with a
notice of civil violation issued pursuant to
Chapter 20.110 ECDC, and shall contain: (1) a
description of the public nuisance; (2) a rea-
sonable deadline by which the responsible
party must eliminate the public nuisance; (3) a
warning that the city may abate the nuisance at
the responsible party's expense; and (4) a
statement that the notice shall become a final
order of the city if not appealed to the hearing
examiner within the time period specified in
Chapter 20.110 ECDC. All costs incurred by
the city in abating a public nuisance, including
but not limited to attorneys' fees, staff time
and contractor expenses, shall be recovered
from the responsible party. Abatement may be

exercised concurrently with or alternatively to
the imposition of civil and/or criminal penal-
ties pursuant to subsection (C) of this section.
E. Summary Abatement. Notwithstanding
any other provision of this chapter, the city
may, to the fullest extent legally permissible,
summarily abate and/or take any action neces-
sary to eliminate any condition constituting an
immediate threat to public health or safety.
F. Mediation. Notwithstanding any provi-
sion of this code, when the development ser-
vices director determines, in his discretion,
that significant risk to any person exists and
the best interests of the neighborhood would
be better served, the director may decline to
proceed with prosecution or abatement until
the complainant(s) and alleged violator(s)
have attempted to resolve their conflict
through mediation.
G. Frivolous Complaint. Any person mak-
ing a frivolous complaint under the provisions
of this chapter shall be guilty of a civil infrac-
tion punishable by a fine of not more than
$500.00. [Ord. 3720 § 4, 2008].

B. Administrative Hearing Officer. All
abatement hearings required under this section
shall be conducted by the hearing examiner. A
decision made by the hearing examiner under
this section regarding abatement shall be final
as to abatement. Any abatement hearing under
this section shall be considered a separate mat-
ter from any hearing regarding the underlying
violation outlined in the previous sections of
this chapter. Provided, however, that the hear-
ing examiner may in his/her discretion com-
bine such hearings if two separate rulings are
issued.
C. Abatement and Removal of Unautho-
rized Junk Motor Vehicles or Parts Thereof
from Private Property.
1. The storage or retention of an unau-
thorized junk motor vehicle or parts thereof, as
defined herein, on private property is hereby
declared a public nuisance subject to removal
and impoundment. The community services
director shall inspect and investigate com-
plaints relative to unauthorized junk motor
vehicles or parts thereof on private property.
Upon discovery of such nuisance, the commu-
nity services director shall give notice in writ-
ing to the last registered owner of record, if
identifiable, and the property owner of the vio-
lation of the nuisance provisions and demand
that both abate the nuisance or the vehicle will
be removed and costs will be assessed against
them. The notice shall also inform both that a
hearing before the hearing examiner may be
requested in writing, directed to the city clerk
within 10 days of said notice, and that if no
hearing is requested within 10 days, the vehi-
cle will be removed at their expense.
2. If a request for a hearing is received,
a notice giving the time, location, and date of
the hearing on the question of abatement and
removal of the vehicle or parts thereof as a
public nuisance shall be mailed, by certified

mail with a five-day return receipt requested,
to the owner of the land as shown on the last
equalized assessment roll and to the last regis-
tered and legal owner of record unless the
vehicle is in such condition that the identifica-
tion numbers are not available to determine
ownership.
3. The owner of the land on which the
vehicle is located may appear in person at the
hearing or present a written statement in time
for consideration at the hearing, and deny
responsibility for the presence of the vehicle
on the land, with reasons for the denial and that
she/he has not given consent for the vehicle to
be located there. If it is determined at the hear-
ing that the vehicle was placed on the land
without the consent of the landowner and that
she/he has not subsequently acquiesced in its
presence, then the hearing examiner shall not
assess costs of administration or removal of
the vehicle against the owner of the property
upon which the vehicle is located or otherwise
order recoupment of such costs from the owner
of the property.
4. Costs of removal of vehicles or parts
thereof under this section shall be assessed
against the last registered owner of the vehicle
or automobile hulk if the identity of the owner
can be determined, unless the owner in the
transfer of ownership of the vehicle or automo-
bile hulk complied with RCW 46.12.101, or
the costs may be assessed against the owner of
the property on which the vehicle is stored,
unless the property owner establishes the facts
set forth in subsection (C)(3) of this section.
5. This section shall not apply to:
a. A vehicle or part thereof that is
completely enclosed within a building in a
lawful manner where it is not visible from the
street or other public or private property; or
b. A vehicle or part thereof that is
stored or parked in a lawful manner on private
property in connection with the business of a
licensed dismantler or licensed vehicle dealer
and is screened according to RCW 46.80.130.

6. After notice has been given of the
city's intent to dispose of the vehicle and after
a hearing, if requested, has been held, the vehi-
cle or parts thereof shall be removed at the
request of the community services director and
disposed of to a licensed motor vehicle
wrecker or hulk hauler with written notice
being provided to the Washington State Patrol
and the Department of Licensing that the vehi-
cle has been wrecked or otherwise lawfully
disposed of.
D. Owner of Record Presumed Liable for
Costs When Vehicle Abandoned — Exceptions.
1. The abandonment of any junk vehicle
or hulk shall constitute a prima facie presump-
tion that the last owner of record is responsible
for such junk vehicle and thus liable for any
costs incurred in removing, storing and dispos-
ing of said vehicle.
2. A registered owner transferring a
vehicle shall be relieved from personal liabil-
ity under this chapter if within five days of the
transfer she/he transmits to the planning divi-
sion a seller's report of sale on a form pre-
scribed by the planning manager to show that
the vehicle had been transferred prior to the
date notice was given to him/her of the need to
abate.
E. Owner or Agent Required to Pay
Charges — Lien.
1. Any costs incurred in the removal and
storage of an impounded vehicle shall be a lien
upon the vehicle. All towing and storage
charges on such vehicle impounded shall be
paid by the owner or his/her agent if the vehi-
cle is redeemed. In the case of abandoned vehi-
cles, all costs of removal and storage shall be
paid by the owner or his/her agent if the vehi-
cle is redeemed, but if not redeemed, such
costs shall be received from the proceeds of
sale.
2. Either a registered or legal owner may
claim an impounded vehicle by payment of all
charges that have accrued to the time of recla-
mation. If the vehicle was impounded at the
direction of a law enforcement agency, the per -

son in possession of the vehicle prior to the
time of reclamation shall notify such agency of
the fact that the vehicle has been claimed, and
by whom.
F. Written Impound Authorization Form.
Whenever the community services director
impounds a vehicle pursuant to the provisions
of this chapter, the director shall complete an
authorization form approved by the chief of
police which specifies the section of this chap-
ter or Chapter 46.55 RCW authorizing the
impound. In the alternative, a law enforcement
notice of infraction or citation for an offense
which authorized the impound may be substi-
tuted at the director's discretion. [Ord. 3720

It shall be unlawful for any owner, lessee,
occupant, agent or other person having the care
or charge of any lot, lots or parcel of land
within the city limits of the city of Edmonds to
suffer or permit any noxious weeds, thistles or
nettles to grow thereon or on any street, alley
or highway bordering on such property, to the
center thereof. [Ord. 285 § 1, 1916].
6.30.020 Inspection by director of public
works — Notice to abate.
It shall be the duty of the director of public
works to inspect all lots and parcels of land and
the streets, alleys and highways of the city of
Edmonds, and when said noxious weeds, this-
tles and the like are found, either on private
property or on the bordering streets, alleys or
highways, the director of public works shall
cause notice to be given to the owner, lessee,
occupant, agent or other person having care,
custody and/or control of such property, or
abutting property, to destroy the same; and
specifying a time for such person to do so.

6.30.030 Service of notice.
Notices shall be in writing and be served by
the police upon the owner, lessee, occupant,
agent or other persons in charge of such prop-
erty on which noxious weeds, thistles or nettles
are found, in person or by leaving the same
with a person of suitable age and discretion

residing at the owner's usual place of abode. If
the person is a nonresident, the police shall
mail a copy of the notice to his last known
address, or if his address be unknown, by post-
ing a copy of the notice on the property. [Ord.

6.30.040 Refusal or failure to abate —
Penalties.
If the owner, lessee, occupant, agent or other
person in charge of property on which noxious
weeds, thistles or nettles exist fails or refuses
to destroy the same within the time set forth in
the notice, said person shall be subject to the
penalties and remedies for public nuisances set

6.40.020 Definitions.
As used in this Uniform Litter Control
Code, unless the context clearly indicates oth-
erwise, the following terms have the following
meanings. All words used in the present tense
include the past tense, all words in the plural
number include the singular number, all words
in the singular number include the plural num-
ber and references to the masculine gender
shall include references to the feminine and
neuter. The word "shall" is always mandatory
and not merely discretionary.
A. "City" means the city of Edmonds,
Washington.
B. "Commercial handbill" is any printed or
written matter, any sample or device, dodger,
circular, leaflet, pamphlet, paper, booklet, or
any other printed or otherwise reproduced
original or copies of any matter of literature,
excluding newspapers:
1. Which advertises for sale any mer-
chandise, product, commodity, or thing, or
2. Which directs attention to any busi-
ness or mercantile or commercial establish-
ment, or other activity, for the purpose of
either directly or indirectly promoting the
interest thereof by sales, or
3. Which directs attention to or adver-
tises any meeting, theatrical performance,
exhibition or event of any kind for which an
admission fee is charged for the purpose of pri-
vate gain or profit; but the terms of this clause
shall not apply where an admission fee is
charged or a collection is taken up for the pur-
pose of defraying the expenses incident to such
meeting, theatrical performance, exhibition or
event of any kind when either of the same is
held, given or takes place in connection with
the dissemination of information which is not
restricted under the ordinary rules of decency,
good morals, public peace, safety and good

order; provided, that nothing contained in this
clause shall be deemed to authorize the hold-
ing, giving or taking place of any meeting, the-
atrical performance, exhibition, or event of
any kind, without a license, where such license
is or may be required by any law of this state,
or under any ordinance of this city, or
4. Which, while containing reading mat-
ter other than advertising matter, is predomi-
nantly and essentially an advertisement, and is
distributed or circulated for advertising pur-
poses or for the private benefit and gain of any
person so engaged as advertiser or distributor.
C. "Highway" for the purpose of this chap-
ter is synonymous with and includes street,
road and alley.
D. "Litter" means all solid wastes including
but not limited to containers, packages, wrap-
ping, printed matter or other material thrown
or deposited as herein prohibited, but not
including the wastes of the primary processes
of mining, logging, sawmilling, farming or
manufacturing.
E. "Litter bag" means a bag, sack or other
container made of any material which is large
enough to serve as a receptacle for litter inside
the vehicle or watercraft of any person.
F. "Litter receptacle" means those contain-
ers meeting minimum requirements of state
regulations of the State Department of Ecol-
ogy.
G. "Newspaper" is any newspaper of gen-
eral circulation as defined by general law, any
newspaper duly entered with the Post Office
Department of the United States in accordance
with the federal statute or regulation, and any
newspaper filed and recorded with any record-
ing officer as provided by general law; and, in
addition thereto, means and includes any peri-
odical or current magazine regularly published
with not less than four issues per year, and sold
to the public.
H. "Noncommercial handbill" is any
printed or written matter, any sample, or de-
vice, dodger, circular, leaflet, pamphlet, news-
paper, magazine, paper, booklet or any other

8.48.320 Pay parking stall defined.
As used in this chapter, "pay parking stall"
means a space in a pay parking lot designated
by appropriate markings as a parking space.

8.48.330 Monthly parking permits.
Monthly parking permits shall be obtained
from the city clerk upon payment of the appli-
cable fee. The monthly fee for the public park-
ing lot located near the intersection of Fourth
Avenue and Main Street known as "the Fourth
Avenue lot" shall be $100.00 per space. The
permit shall contain a permit number and the
expiration date when issued by the city clerk.
The monthly parking permit shall authorize a
vehicle to park in a pay parking lot space in
accordance with the following provisions:
A. Permits issued on the first day of each
month, for the one-month period ending on the
expiration date set forth on the permit; or
B. Individual monthly parking permits, for
a 30 -day period ending on the expiration date
set forth on the permit. [Ord. 3704 § 1, 2008;

8.48.340 Permit required.
No person shall park a vehicle in a pay park-
ing stall unless a monthly parking permit is
obtained from the city clerk and the monthly
parking permit is placed on the windshield of
the vehicle on the passenger side. [Ord. 3564

8.48.350 Overtime parking prohibited.
No person shall park a vehicle in a pay park-
ing space for a period of time longer than the
period authorized by the monthly parking per-
mit as specified in this chapter.
Each subsequent two-hour period of time
lapsing following affixing of a notice of over-
time parking to a vehicle shall constitute a fur-
ther violation of this section. [Ord. 3564 § 1,

8.48.500
8.48.380 Designation of pay parking lots.
The superintendent of public works is
authorized to designate pay parking lots, des-
ignate certain pay parking stalls for monthly
parking permit only, and erect suitable signs
advising the public of the requirements of pur-
chasing monthly parking permits from the city
clerk. [Ord. 3564 § 1, 2005].
8.48.390 Placement of parking permits.
Monthly parking permits shall be valid only
when placed on the windshield of the vehicle
on the passenger side. Failure to place a
monthly parking permit in the manner speci-
fied in this section shall invalidate the authori-
zation to park for the time otherwise
designated on the parking permit. [Ord. 3564

8.48.400 Reserved parking spaces.
Vehicles displaying valid monthly parking
permits shall be entitled to park in pay parking
stalls specially designated by the superinten-
dent of public works for permit parking only.
No person shall park a vehicle in a pay park-

ing only unless a valid monthly parking permit

8.48.410 Alteration prohibited.
It is unlawful for any person to alter a
monthly parking permit in any way, such as to
extend the period of parking time authorized,
or to place a fictitious monthly parking permit
in place of or as a substitute for a monthly
parking permit as specified in this chapter.

8.48.500 Parking in fishing pier parking
lot.
A. "Fishing pier parking lot" means that
parking lot owned jointly by the city of
Edmonds and the port of Edmonds and located
immediately adjacent to the Edmonds fishing

pier at the western end of Dayton Street, on
Railroad Avenue in the Edmonds waterfront
district.
B. Except when parking is prohibited dur-
ing the hours specified in subsection (C) of this
section, no person shall park an automobile in
excess of three consecutive hours in the fishing
pier parking lot; provided, however, that vehi-
cles displaying a valid permit issued by the city
to the senior center staff shall be exempt from
this three-hour restriction.
C. When signs are erected giving notice
thereof, no person shall park a vehicle in the
fishing pier parking lot on Friday of each week
between the hours of 4:00 a.m. and 7:00 a.m.
Vehicles displaying a valid senior center staff
permit are not exempt from this requirement.
D. Any vehicle parked in violation of this
section may be towed from the fishing pier
parking lot when signs are posted in a conspic-
uous location within the fishing pier parking
lot giving the name of the agency at whose
direction vehicles are towed for violation of
this section and the phone number and address
where information regarding the recovery of
such vehicles may be obtained. The owner of
any vehicle towed from the fishing pier park-
ing lot for violation of this section shall be lia-
ble for the entire cost of such towing. Neither
the city of Edmonds, nor any of its agents,
shall be liable for any damage to any vehicle
towed pursuant to this section.
E. Violation of the subsections of this sec-
tion shall constitute a parking infraction pun-
ishable as set forth in ECC 8.48.215. [Ord.

8.48.600 Authority to impound.
The Edmonds police department is hereby
authorized to impound vehicles parked in vio-
lation of this chapter; provided, that proper
notice is given pursuant to ECC 8.48.170 or
8.48.604. The police department is authorized
to impound vehicles without notice as pro-
vided under ECC 8.48.603. [Ord. 3564 § 1,

8.48.601 Impoundment defined.
"Impoundment" means removal of a vehicle
to a storage facility either by an officer or
authorized agent of the Edmonds police
department or by a contractor for towing and
storage in response to a request from an officer
or authorized agent of the Edmonds police

8.48.602 Applicable state law adopted by
reference.
All applicable provisions of Chapter 46.55
RCW*, as now or hereafter amended, are
hereby incorporated into this chapter by this
reference. In the event that any provision of
this chapter may conflict with any provision of
Chapter 46.55 RCW or other applicable state
law, the state law provision will control. [Ord.

8.48.603 Impound without prior notice.
A. A vehicle may be impounded with or
without citation and without giving prior
notice to its owner as otherwise required by
this chapter under the following circum-
stances:
1. When the vehicle is impeding or is
likely to impede the normal flow of vehicular
or pedestrian traffic; or
2. When the vehicle is illegally occupy-
ing a truck, commercial load, bus, loading, or
other similar zone where, by order of the direc-
tor of engineering or chiefs of police or fire,
parking is limited to designated classes of
vehicles or is prohibited during certain hours,
or designated days, or at all times, and where
such vehicle is interfering with the proper and
intended use of such zones; or
3. When a vehicle without a special
license plate, card, or decal indicating that the
vehicle is being used to transport a disabled
person as defined under RCW 46.16.381, as
now or hereafter amended, is parked in a stall
