his/her own representation with respect to any
such claim or litigation, then all of the provi-
sions of this chapter shall be inapplicable, and
have no force or effect with respect to any such
claim or litigation. [Ord. 2535, 1985].
2.06.070 Reimbursement of incurred
expenses.
A. If the city determines that an official or
employee does not come within the provisions
of this chapter, and a court of competent juris-
diction later determines that such claim does
come within the provisions of this chapter, then
the city shall pay any judgment rendered
against the official or employee and reasonable
attorneys' fees incurred in defending against
the claim. The city shall pay any attorneys' fees
incurred in obtaining the determination that
such claim is covered by the provisions of this
chapter.
B. If the city determines that a claim against
a city official or employee does come within
the provisions of this chapter, and a court of
competent jurisdiction later finds that such
claim does not come within the provisions of
this chapter, then the city shall be reimbursed
for costs or expenses incurred in obtaining the
determination that such claim is not covered by
the provisions of this chapter. [Ord. 2535,

2.06.080 Conflict with provisions of
insurance policies.
Nothing contained in this chapter shall be
construed to modify or amend any provision of
any policy of insurance where any city official
or employee thereof is the named insured. In
the event of any conflict between this chapter
and the provisions of any such policy of insur-
ance, the policy provisions shall be controlling;
provided, however, that nothing contained in
this section shall be deemed to limit or restrict
any employee's or official's right to full cover-
age pursuant to this chapter, it being the intent
of this chapter and section to provide the cov-
erage detailed in this chapter outside and

beyond insurance policies which may be in
effect, while not compromising the terms and
conditions of such policies by any conflicting
provision contained in this chapter. [Ord. 2535,

2.06.090 Pending claims.
The provisions of this chapter shall apply to
any pending claim or lawsuit against an offi-
cial or employee, or any such claim or law suit
hereafter filed, irrespective of the date of the
events or circumstances which are the basis of

2.10.010 Confirmation process.
A. Whenever a vacancy occurs in one of the
positions listed in this section, the city council
will review the specifications of that position
and revise it as needed before the vacancy is
filled.
B. The mayor or his/her designee will
review all applications and determine the per-
sons with the highest qualifications. Any city
council member, upon request to the mayor,
may review the applications received for the
vacant position.
C. The mayor shall appoint, subject to city
council confirmation, the positions of judge
and hearing examiner. The hearing examiner
may be removed from his/her position for
cause, as determined by the mayor. The judge
may be removed from his/her office for cause,
as specified in RCW 3.50.095.
D. The mayor shall appoint, subject to
council confirmation, the department director
positions of police chief, fire chief, community
services director, administrative services
director, development services director, parks
and recreation director, public works director,
and human resources director. The city council
shall interview the top three candidates for
each position prior to the mayor's final selec-

2.10.020 Assignment of duties.
The department directors shall be responsi-
ble for carrying out all directives as assigned
by the mayor, including, but not limited to,
planning and directing the activities and staff
in their assigned department, supervising and
evaluating the work processes and assigned
staff, controlling the financial integrity of the
assigned budget, and insuring the delivery of
quality public services. All department direc-
tors shall serve at the pleasure of the mayor.

2.10.030 Police chief.
Pursuant to the authority of RCW
41.12.050, the position of police chief has been
removed from civil service. The police chief
shall be appointed by the mayor subject to con-
firmation by majority vote of the city council.

2.10.050 References to director of
community development.
Wherever references are made in the
Edmonds City Code or any ordinance of the
city to the director of community develop-
ment, said reference shall hereafter be con-
strued to mean the development services

2.10.060 Executive council assistant.
The executive council assistant shall be a
contract employee hired on an annual basis by
the city council. The terms and conditions of
employment for the executive council assistant
as well as all benefits shall be governed by the
provisions of the contract. The contract shall
provide for the delegation by the mayor of the
direction of this individual to the city council
president. In the event that the mayor elects in
his or her discretion not to delegate that func-

tion, the council reserves the right to immedi-

2.10.070 Mayor's executive assistant.
The position of mayor's executive assistant
shall be an at -will position with the executive
assistant serving at the pleasure of the mayor.
The salary for the position is established by the
annual salary ordinance. The terms and condi-

being set forth in a job description developed
by the mayor with the concurrence of the city

FIRE DEPARTMENT

Fire service is provided to the citizens of the
city of Edmonds by and through a contract
with Snohomish County Fire District No. 1.
Whenever any reference is made in the provi-
sions of the Edmonds City Code or Edmonds
Community Development Code to "fire
chief," "fire marshal," "fire department" or
any other reference to a fire fighter or fire ser-
vices, such term shall include, for the provi-
sion of administrative or other day to day fire
services, to reference the fire chief, fire mar-
shal and fire fighting services performed for
the city by contract by Snohomish County Fire
District No. 1.
A. The officials of the Snohomish County
Fire District No. 1 when performing services
by contract to the citizens of the city of
Edmonds and to the city in its corporate capac-
ity shall exercise any and all rights, duties,
obligations and responsibilities in accordance
with the provisions of this code to the same
extent and in the same manner as if performed
by an employee of the city.
B. Employees of the Snohomish County
Fire District No. 1 ("district") shall not be enti-
tled to any wage or benefit provision of this
code, including but not limited to Chapters
2.06 and 2.35 ECC. The Edmonds civil service
system shall remain in effect but no employee
of the district shall have recourse to the civil
service commission following the termination
date of fire department employees by the city.

2.12.020 Pre-existing rights and
obligations not impaired.
The city council's determination to contract
or not contract for fire services with Snohom-
ish County Fire District No. 1 and the provi-
sions of this chapter shall not impair any
existing vested right or vested obligation cre-
ated under the provisions of state law or under
Chapter 2.50 ECC, Firemen's Relief and Pen-
sion System, Chapter 2.60 ECC, Reserve Fire
Fighters' Relief and Pensions Act, Chapter
2.70 ECC, Retirement System, and Chapter
10.30 ECC, Disability Board, as well as the
MEBT plan of the city. The rights of any per-
son under such system vested prior to the
transfer of fire service responsibility by con-
tract shall remain in full force and effect and
are not impaired by either such or the adoption

2.15.010 Court established.
There is hereby established a municipal
court entitled "The Municipal Court of the city
of Edmonds," hereinafter referred to as
"municipal court," which court shall have
jurisdiction and shall exercise all powers enu-
merated herein and in Chapter 3.50 RCW
together with such other powers and jurisdic-
tion as are generally conferred upon such court
in this state either by common law or by
express statute. [Ord. 2538 § 2, 1985].
2.15.020 Jurisdiction.
The municipal court shall have exclusive
original jurisdiction over traffic infractions
arising under city ordinances and exclusive
original criminal jurisdiction of all violations
of city ordinances duly adopted by the city of
Edmonds. The municipal court shall have orig-
inal jurisdiction of all other actions brought to
enforce or recover license penalties or forfei-

tures declared or given by such ordinances or
by state statutes. The municipal court shall also
have the jurisdiction as conferred by statute.
The municipal court is empowered to forfeit
cash bail or bail bonds and issue execution
thereon; and in general to hear and determine
all causes, civil or criminal, including traffic
infractions, arising under such ordinances and
to pronounce judgment in accordance there-
with. [Ord. 2538 § 2, 1985].
2.15.030 Judges — Appointment —
Qualifications.
A. The municipal judge shall be appointed
by the mayor for a term of four years, subject
to the confirmation by the city council. The
first judicial appointment to the position of
mayor was effective on January 1, 1986, and
the municipal judge shall serve a four-year
term commencing upon the date of his or her
appointment. The mayor shall endeavor to
make his or her appointment 30 days prior to
the expiration of each judicial term; provided,
however, that if the city council fails to con-
firm a mayoral appointment, the mayor and
city council shall have 60 days commencing
upon either the expiration of the pending judi-
cial term or the failure of the city council to
confirm the mayoral appointment, whichever
shall later occur. In the event that for any rea-
son the mayoral appointment is not confirmed,
the incumbent municipal judge shall hold over
and continue in office until such time as a suc-
cessor is appointed.
B. The position of municipal judge shall be
filled by election for the term commencing on
January 1, 2010, and every four years thereaf-
ter. The municipal judge shall be elected in the
same manner as other elective city officials are
elected to office. The term of the municipal
judge shall be for four years. The mayor shall
not appoint a municipal judge pursuant to sub-
section A of this section for a term beyond
December 31, 2009. Nothing in this section
2.15.040
shall limit the mayor's authority to fill the
position of municipal judge pursuant to ECC
2.15.070 or 2.15.210.
C. A person elected or appointed as munic-
ipal judge shall be a citizen of the United
States of America and of the state of Washing-
ton and a resident of Snohomish County; and
an attorney admitted to practice law before the
courts of record of the state of Washington.

2.15.040 Salaries and costs.

tant chief of the Edmonds police department,
subject to the approval of the mayor, for the
purposes set forth herein. This fund shall be a
revolving fund in an amount not to exceed
$5,000 and shall be funded by transfer from
available funds by the city finance director sub-

There is hereby created and established a
special fund to be known as the "drug enforce-
ment fund" into which (1) all monies and pro-
ceeds from the sale of property seized during
drug investigations and forfeited pursuant to
RCW 69.50.505 and all other applicable state
and federal laws; and (2) all monies received
by the city pursuant to a court order prescrib-
ing that such monies be used for drug enforce-
ment shall be deposited after amounts are
deducted in accordance with state and federal
laws. [Ord. 2739 § 2, 1989].
3.08.020 Purposes — Expenditures.
This fund has been established for the pur-
pose of accumulating funds for drug enforce-
ment needs, drug awareness educational
purposes and the purchase, lease and mainte-
nance of equipment and other items necessary
for drug enforcement by the Edmonds police
department. The monies deposited in the drug
enforcement fund shall be expended only for
such purposes and for no other purpose when
appropriated by the city council.
3.08.030 Unexpended funds.
Any unexpended funds remaining in the
drug enforcement fund at the end of any bud-
get year shall not be transferred to the general
fund or otherwise lapse, rather said unex-
pended funds shall be carried forward from
year to year until expended for the purposes set
forth in ECC 3.08.020. [Ord. 2677, 1988].

The administrative services director is
hereby authorized to create and number a new
fund to be known as the parks trust fund for the
purpose of receiving donations from the city's
citizens for, or in aid of, the cost of operating,
maintaining and improving the city's parks
and other related beautification, aquatic, and
environmental protection programs such as the
city's flower program, the Beach Ranger pro-
gram and the Yost Pool. This fund is created
and shall be maintained to the end that such
donations shall be fully tax deductible and in
accordance with the laws of the United States
and the regulations of the Internal Revenue
Service. [Ord. 3466 § 1, 2003].
3.16.020 Administration of the fund.
The council shall endeavor to utilize the
interest earned by the fund in accord with the
donor's wishes for the flower beautification,
aquatics, environmental protection and other
parks related programs. The council shall use
its best efforts not to invade the principal of the
fund unless called upon by unforeseen budget-
ary needs. In the event that the principal of the
fund shall be invaded, the council shall first
attempt to utilize the principal for other similar
programs such as programs for the arts, com-
munity beautification, parks acquisition or
similar purposes. Ultimately, however, the
council shall maintain its absolute legislative
discretion to use all available funds in the best
interest of its citizens in accordance with the
council's powers and duties pursuant to state

business in the city of Edmonds shall apply for
a new business license pursuant to the proce-

ers, directors, managing agents, or partners of
any corporation, firm, partnership or other
organization or business violating or failing to

It is unlawful for any person, firm or corpo-
ration to engage in the business of pawnbroker
or secondhand dealer without first obtaining a
license pursuant to the provisions of this chap-

4.75.020 Exemption.
This chapter shall not apply to any bona fide
charitable or nonprofit organization, nor shall
it apply to any merchants or dealers whose
business is limited to used or secondhand
clothing, or to any merchant or dealer whose
business is limited to the sale of used or sec-

4.75.030 Definitions.
A. The term "pawnbroker" as used in this
chapter, means and includes every person who
takes or receives by way of pledge, pawn or
exchange, goods, wares, or merchandise or
any kind of personal property whatever, for the
repayment of security of any money loaned
thereon, or to loan money on deposit of per-
sonal property, or who makes public display of
any sign indicating that he has money to loan
on personal property on deposit or pledge.
B. The term "secondhand dealer" as used in
this chapter, means and includes every person
who as a business engages in the purchase,
sale, barter, auction, sale on consignment, or
otherwise exchanges secondhand goods, or
who keeps a store, shop, room or other place
where secondhand goods of any kind or
description are bought, sold, traded or bar-
tered, pledged, auctioned, sold on consign-
ment, or otherwise exchanged; provided,
however, that this term shall not apply to those
persons engaged in the business of selling used
or secondhand motor vehicles, boats and other
recreational vehicles. Secondhand dealer also
includes persons or entities conducting busi-
ness at flea markets or swap meets, more than
three times per year.
C. The term "secondhand goods" when
used in this chapter means and includes any
and all used, remanufactured, or secondhand
goods purchased or kept for sale by a dealer in
secondhand goods including metal, junk or
melted metals; provided, however, such term
shall not be construed to include used or sec-
ondhand motor vehicles, boats and other recre-
ational vehicles.
D. The term "item of interest" shall mean
and include items of property which are com-
monly stolen and fenced or offered for sale as
stolen goods, and which are therefore of inter-
est to the Edmonds police department. Such
items shall at a minimum include jewelry, pre-
cious metals, gem stones, electronic equip-
ment such as stereos and stereo components,
radios, televisions, CB radios, radar equipment

and microwave ovens; guns, coins, photo-
graphic equipment, tools, silverware, scrap
metal, musical instruments, bicycles, sporting
goods such as fishing tackle, camping gear,
scuba gear and other such sporting equipment;
marine equipment such as boats, outboard
motors, depth sounders and such other items of
personal property as are either deemed suspi-
cious or unusual by the licensee or which has
been identified as items of interest in accor-
dance with the provisions of ECC 4.75.035.
E. The term "melted metals" means metals
derived from metal junk or precious metals
that have been changed to a melted state from
other than ore or ingots which are produced
from ore which has previously been processed.
F. The term "metal junk" means any metal
that has previously been milled, shaped,
stamped or that is no longer useful in its origi-
nal form, except precious metal.
G. The term "nonmetal junk" means any
nonmetal commonly discarded item that is
worn out, or outlived its usefulness as intended
in its original form except nonmetal junk does
not mean an item made in a former period
which has enhanced value because of its age.
H. The term "precious metals" means gold,
silver, and platinum. [Ord. 2850 § 1, 1991;

4.75.035 Regulatory rule making — By
chief of police.
Whenever the chief of police shall determine
that an item of personal property is or has
become an item which is commonly stolen and
fenced or otherwise offered for sale as stolen
property, he may at his discretion add such item
to the list of "items of interest" established by
this chapter, specifically ECC 4.75.030(D) or
by previous rule making. The chief shall make
his determination in writing and shall notify
each holder of a license under this chapter that
a particular item of personal property has
become an "item of interest" in accordance
with the provisions of this chapter. He shall
cause such written notification to be deposited

5.60.060 Appeal, abatement and cost
recovery proceedings.
A. A party to whom the notice of violation
is issued may appeal the same as set forth in
ECDC 20.110.040(C). Written notice request-
ing an appeal hearing before the hearing exam-
iner shall be directed to the development
services director, and shall include the name of
the party requesting the appeal, the address of
the graffiti nuisance property, a statement indi-
cating standing to appeal, and a concise state-
ment as to reasons why the graffiti on the
property does not constitute a public nuisance.
B. Notice of Appeal Hearing. Upon a
timely written request for an appeal, the city
shall provide the appellant, notice of the appeal
hearing before the hearing examiner at least
five business days in advance of the same.
Notice shall be deemed served three business
days after the same is mailed to the parties by
certified U.S. mail.
C. Determination of Hearing Examiner.
The determination of the hearing examiner
after the due process hearing shall be final, and
there shall be no further administrative appeal.
If, after the due process hearing, the hearing
examiner determines that the property contains
graffiti viewable from a public or quasi -public
place, the hearing examiner shall declare the
same a nuisance and order the party to whom
the notice of violation is issued to abate it.
D. The hearing examiner shall issue a deci-
sion and order, if necessary, containing the fol-
lowing: findings of fact; conclusions in
support of the decision and order; type and
method of abatement action required; the date
by which said abatement must be completed;
and civil penalties to be assessed by the city
should appellant fail to abate the graffiti by the
date established in the decision and order.
Civil penalties shall range from $25.00 to
$250.00 based on appellant's appearance at the
hearing, frequency of offense, cooperation
with the city in efforts to abate the graffiti,
progress in abating the graffiti, and other rele-
vant factors. Each and every day or portion

thereof during which any violation is commit-
ted, continued, permitted or not corrected shall
be a violation for purposes of this chapter.
E. Abatement. The city may, pursuant to
Chapter 7.48 RCW, obtain a warrant of abate-
ment to enter upon the property, cause the
removal, painting over (in such color as shall
meet with the approval of the court), or such
other eradication thereof as the court deter-
mines appropriate, and shall provide the prop-
erty owner, or building owners association,
thereafter with an accounting of the costs of
the eradication effort on a full -cost -recovery
basis including reasonable legal fees and costs.

5.60.070 Trust fund.
A. The city council hereby creates the city
of Edmonds anti -graffiti trust fund. Penalties
assessed against violators of this chapter shall
be placed in the fund, along with any monetary
donations received from persons wishing to
contribute to the fund. The city council shall
direct the expenditures of monies in the fund.
Such expenditures shall be limited to the pay-
ment of the cost of graffiti removal from public
property, the payment of the cost of graffiti
removal from private property pursuant to sub-
section (B) of this section, the payment of
rewards for information leading to the convic-
tion of violation of this chapter, the costs of
administering this chapter, and such other pub-
lic purposes as may be approved by the council
by resolution.
B. The trust fund may be expended by the
city to abate graffiti from private property
without engaging in cost recovery proceedings
only upon approval by the council following a
recommendation of the hearing examiner upon
his or her finding that one of the following
conditions is met: (1) abating graffiti from the
private property in question accomplishes a
fundamental government purpose; (2) abating
graffiti from the private property in question
serves the public interest and there is no dona-
tive intent; or (3) abating graffiti from the pri-

vate property in question will assist the poor
and infirm. Recommendation from the hearing
examiner shall be submitted to the council for
consideration and decision. Approval shall be
by resolution. [Ord. 3677 § 1, 2008].
5.60.080 Remedies not exclusive.
The remedies for violation of this chapter
that are set forth in this chapter are not exclu-
sive. [Ord. 3677 § 1, 2008].
5.60.090 Severability.
If any provision of this chapter or its appli-
cation to any person or circumstance is held
invalid, the remainder of this chapter or the
application of the provision to other persons or
circumstances is not affected. [Ord. 3677 § 1,

The Edmonds fire department has been cre-
ated in order to provide fire protection services
and emergency medical services, as well as
disaster preparation and coordination in accor-
dance with Chapter 6.60 ECC and to otherwise
protect life and property and promote the
health, safety and welfare of the general pub-
lic. No provision of these ordinances and noth-
ing in the creation of the Edmonds fire
department shall be interpreted to create or
otherwise establish any particular class or
group of persons who will or would be espe-
cially protected or benefited by the creation of
said fire department by the provision of ser-
vices by its members or by the budgeting of

6.80.010 Definitions.
A. "Checkout bag" means a bag that is pro-
vided by a retail establishment at the check
stand, cash register, point of sale or other point
of departure for the purpose of transporting
food or merchandise out of the establishment.
Checkout bags do not include bags provided
solely for produce, bulk food or meat at a pro-
duce, bulk food or meat department within a
grocery store, supermarket, produce or meat
market, or other similar retail establishment, or
bags provided to carry out food cooked or pre-
pared at a restaurant or other similar food and
beverage establishment.
B. "Recyclable paper bag" or "recyclable
paper checkout bag" means a paper bag that
meets all of the following requirements: (1)
contains no old growth fiber, (2) is 100 percent
recyclable overall and contains a minimum of
40 percent post -consumer recycled content,
and (3) displays the word "Recyclable" on the
outside of the bag.
C. "Retail establishment" means any com-
mercial business facility engaged in the sale of
goods to consumers for ultimate consumption.
D. "Reusable bag" means a bag with han-
dles that is specifically designed and manufac-
tured for multiple reuse and is either (1) made
of cloth or other machine -washable fabric,
and/or (2) made of durable plastic that is at
least 2.25 mils thick and is suitable for reuse.

E. "Single -use plastic checkout bag" means
any checkout bag made from plastic, exclud-
ing reusable bags. [Ord. 3749 § 1, 2009].
6.80.020 Types of checkout bags
permitted at retail
establishments.
A. All retail establishments within the city
of Edmonds shall provide only the following
as checkout bags to customers: reusable bags
and/or recyclable paper bags.
B. Nothing in this chapter shall be read to
preclude retail establishments from making
reusable bags available for sale to customers.
C. The city of Edmonds shall work with
retailers, retail associations, unions and other
organizations to create educational elements
about the benefits of reusable bags. This may
include signage at store locations, informa-
tional literature, and employee training and
will take place before and after the operative
date. All retail establishments are strongly
encouraged to educate their staff to promote
reusable bags as the best option for checkout
bags and to post signs encouraging customers
to use reusable bags. [Ord. 3749 § 1, 2009].
6.80.040 Operative date.
All retail establishments shall comply with
the requirements of this chapter by the first
anniversary of the effective date of the ordi-
nance codified in this chapter, which is August
27, 2009. The purpose of this one-year imple-
mentation period is to (A) allow time for
affected retailers to prepare for and adapt to the
provisions of this chapter; (B) allow time for
the educational program to take effect and
encourage the use of reusable bags; and (C)
enable the city council to work with members
of the community and affected parties to eval-
uate alternatives or modifications needed to
address issues regarding provisions or imple-
mentation of this chapter. [Ord. 3749 § 1,
2009].

6.80.050 Exemptions.
The mayor, or his or her designee, may
exempt a retail establishment from the require-
ments of this chapter for a period of up to one
additional year after the operative date of the
ordinance codified in this chapter, upon suffi-
cient showing by the applicant that the provi-
sions of this chapter would cause undue
hardship. This request must be submitted in
writing to the city within 30 days of the effec-
tive date of this chapter. The phrase "undue
hardship" may include, but is not limited to,
the following:
A. Situations where there are no acceptable
alternatives to single -use plastic checkout bags
for reasons which are unique to the applicant
retail establishment.
B. Situations where compliance with the
requirements of this chapter would deprive a
person of a legally protected right. [Ord. 3749
§ 1, 2009].
6.80.060 Severability.
If any provision or clause of this chapter is
held to be unconstitutional or otherwise
invalid by any court of competent jurisdiction,
such invalidity shall not affect other provisions
of this chapter, and clauses of this chapter are
declared to be severable. [Ord. 3749 § 1,
2009] .
6.80.070 Enforcement officer and
penalties.
A. Prior to the "comply by date" in ECC
6.80.040, the mayor shall designate an existing
department in the city as the department
charged with enforcing the provisions of this
chapter. The head of the department and his or
her designees shall be the enforcement officers
with authority and powers to issue civil infrac-
tions for violations of provisions of this chap-
ter.
B. A violation of any provision of this
chapter shall constitute a Class I civil infrac-
tion pursuant to Chapter 7.80 RCW. Issuance
and disposition of infractions issued for viola -

tions of this chapter shall be in accordance
with Chapter 7.80 RCW. The penalty for vio-
lation of a provision of this chapter shall be
$100.00. The penalty for a second or subse-
quent offense in violation of the provision of
this chapter within two years shall be $250.00.
C. The remedies and penalties provided in
this section are cumulative and not exclusive.

director may establish new rates based upon
the cost of conveyance and treatment in the
POTW.
D. Billing. Sewer use service charges under
this chapter shall be billed monthly by the city
director of finance. The amount of the charge
will be determined by the director at the end of
each month and will be submitted to the city
director of finance after sufficient time has
been given for laboratory analysis of all sew-
age samples and/or computations. Charges
will be computed and billed based on records
of flow from the previous month and mean
waste strengths as determined in subsections
(B) and (C) of this section. The director may
check sewage strength as outlined in this chap-
ter and adjust charges where applicable at any
time in accordance with all the provisions of

7.102.020 Severability.
Should any chapter, subchapter, paragraph,
sentence, clause or phrase of Chapters 7.90
through 7.102 ECC or its application to any
person or situation be declared unconstitu-
tional or invalid for any reason, such decision
shall not affect the validity of the remaining
portions of Chapters 7.90 through 7.102 ECC
or its application to any other person or situa-
tion. The city council of the city of Edmonds
hereby declares that it would have adopted
Chapters 7.90 through 7.102 ECC and each
chapter, subchapter, sentence, clause, phrase
or portion thereof irrespective of the fact that
any one or more chapters, subchapters,
clauses, phrases or portions be declared invalid
or unconstitutional. [Ord. 3401 § 13, 20021.
7.102.030 Conflicts.
In the event of any inconsistency between
the provisions of Chapters 7.90 through 7.102
ECC and any other city regulation, the provi-
sions of Chapters 7.90 through 7.102 ECC
shall govern to the extent of such inconsis-
tency. [Ord. 3401 § 13, 2002].
7.102.050
7.102.040 Nonliability.
It is the specific intent of Chapters 7.90
through 7.102 ECC to place the obligation of
complying with these regulations upon the
applicant or user and no provision nor any term
used in Chapters 7.90 through 7.102 ECC is
intended to impose any duty whatsoever upon
the city or any of its officers, employees or
agents, except as provided under the Act or
other related statutes of the United States or the
State of Washington.
Nothing contained in Chapters 7.90 through
7.102 ECC is intended to be nor shall be con-
strued to create or form the basis for any tort
liability on the part of the city or its officers,
employees or agents, for any injury or damage
resulting from the failure of an applicant or
user to comply with the provisions of Chapters
7.90 through 7.102 ECC, or by reason or in
consequence of any inspection, notice, order,
certificate, permission or approval authorized
or issued or done in connection with the imple-
mentation or enforcement of Chapters 7.90
through 7.102 ECC, or inaction on the part of
the city related in any manner to the implemen-
tation or the enforcement of Chapters 7.90
through 7.102 ECC by its officers, employees

7.102.050 Savings.
The enactments of Chapters 7.90 through
7.102 ECC shall not affect any case, proceed-
ing, appeal or other matter currently pending in
any court or in any way modify any right or lia-
bility, civil or criminal, which may be in exist-

7.200.010 Purpose and intent.
The purposes of this chapter are:
A. To provide for the health, safety, and
general welfare of the citizens of the city of
Edmonds, Washington, through the regulation

of nonstormwater discharges to the city's
municipal separate storm sewer system (MS4),
as well as to all groundwaters and waterbodies,
to the maximum extent practicable as required
by federal and state law.
B. To establish methods for controlling the
introduction of pollutants into the city's MS4
in order to comply with the requirements of the
National Pollutant Discharge Elimination Sys-
tem (NPDES) permit process. Specifically:
1. To regulate the contribution of pollut-
ants to the MS4 by stormwater discharges
from any user.
2. To prohibit illicit connections and
illegal discharges to the MS4, as well as to all
groundwaters and waterbodies.
3. To define the city's legal authority to
carry out all inspection, surveillance and mon-
itoring necessary to effectuate said purposes.
C. To protect and enhance water quality
and aquatic wildlife and its habitat by prevent-
ing harmful discharges to local waterbodies.

7.200.020 Definitions.
For the purposes of this chapter, the follow-
ing shall mean:
A. "AKART" means all known, available,
and reasonable methods of prevention, control,
and treatment. See also the state Water Pollu-
tion Control Act, RCW 90.48.010 and
90.48.520.
B. "Best management practices (BMPs)"
means schedules of activities, prohibitions of
practices, maintenance procedures, and struc-
tural and/or managerial practices approved by
the Department of Ecology that, when used
singly or in combination, prevent or reduce the
release of pollutants and other adverse impacts
to waters of Washington State.
C. "City" means the city of Edmonds,
Washington.
D. "Clean Water Act (CWA)" means the
federal Clean Water Act (formerly referred to
as the federal Water Pollution Control Act or
Edmonds City Code
federal Water Pollution Control Act Amend-
ments of 1972), Pub. L. 92-500, as amended,
Pub. L. 95-217, Pub. L. 95-576, Pub. L. 96-483
and Pub. L. 97-117, 33 U.S.C. 1251 et seq.
E. "Director" means the city of Edmonds
public works director and/or designees.
F. "Groundwater" means water in a satu-
rated zone of stratum beneath the surface of the
land or below a surface waterbody.
G. "Hazardous materials" means any mate-
rial, including any substance, waste, or combi-
nation thereof, which because of its quantity,
concentration, or physical, chemical, or infec-
tious characteristics may cause, or signifi-
cantly contribute to, a substantial present or
potential hazard to human health, safety, prop-
erty or the environment when improperly
treated, stored, transported, disposed of, or
otherwise managed.
H. "Hyperchlorinated" means water that
contains more than 10 milligrams per liter
(mg/L) chlorine.
I. "Infeasible" means the action cannot be
accomplished with technologies and methods
that have been used in the past in similar cir-
cumstances and/or the action cannot provide a
reasonable likelihood of achieving its intended
purpose.
J. "Illicit connection" means any manmade
conveyance that is connected to a municipal
separate storm sewer or a waterbody without a
permit, excluding roof drains and other similar
type connections. Examples include sanitary
sewer connections, floor drains, channels,
pipelines, conduits, inlets, or outlets that are
connected directly to the municipal separate
storm sewer system or a waterbody.
K. "Illicit discharge" means any direct or
indirect nonstormwater discharge to the city's
storm drainage system, groundwaters, or a
water body, except as expressly allowed by
this chapter.
L. "Industrial or construction activity"
means manufacturing, processing or raw mate-
rials storage areas at an industrial plant; or

clearing, grading and/or excavation. These
activities are required to have NPDES permit
coverage in accordance with 40 CFR 122.26.
M. "Municipal separate storm sewer sys-
tem (MS4)" means a conveyance, or system of
conveyances (including roads with drainage
systems, municipal streets, catch basins, curbs,
gutters, ditches, manmade channels, or storm
drains):
1. Owned or operated by the city of
Edmonds;
2. Designed or used for collecting or
conveying stormwater;
3. Which is not a combined sewer as
defined by WAC 173-245-020; and
4. Which is not part of a publicly owned
treatment works (POTW) as defined at 40 CFR
122.2.
N. "National Pollutant Discharge Elimina-
tion System (NPDES) stormwater discharge
permit" means the national program for issu-
ing, modifying, revoking, and reissuing, termi-
nating, monitoring and enforcing permits, and
imposing and enforcing pretreatment require-
ments, under Sections 307, 402, 318, and 405
of the federal Clean Water Act, for the dis-
charge of pollutants to surface waters of the
state from point sources. These permits are
referred to as NPDES permits and, in Wash-
ington State, are administered by the Washing-
ton Department of Ecology.
O. "Nonstormwater discharge" means any
discharge to the MS4, groundwaters or a
waterbody that is not composed entirely of
stormwater.
P. "Person" means any individual, associa-
tion, organization, partnership, firm, corpora-
tion or other entity recognized by law and
acting as either the owner of a premises or as
the owner's agent.
Q. "Pollutant" means anything which
causes or contributes to pollution. Pollutants
may include, but are not limited to: paints, var-
nishes, and solvents; oil and other automotive
fluids; nonhazardous liquid and solid wastes
and yard wastes; refuse, rubbish, garbage, lit -

ter, or other discarded or abandoned objects
and accumulations, so that same may cause or
contribute to pollution; floatables; pesticides,
herbicides, and fertilizers; hazardous sub-
stances and wastes; sewage, fecal coliform and
pathogens; dissolved and particulate metals;
animal wastes; wastes and residues that result
from constructing a building or structure; and
noxious or offensive matter of any kind.
R. "Premises" means any building, lot, par-
cel of land, or portion of land, whether
improved or unimproved, including adjacent
sidewalks and parking strips.
S. "Storm drainage system" means publicly
owned facilities, including the city's munici-
pal separate storm sewer system, by which
stormwater is collected and/or conveyed,
including but not limited to any roads with
drainage systems, municipal streets, gutters,
curbs, inlets, piped storm drains, pumping
facilities, retention and detention basins, natu-
ral and human -made or altered drainage chan-
nels, reservoirs, and other drainage structures.
T. "Stormwater" means runoff during and
following precipitation and snowmelt events,
including surface runoff and drainage.
U. "Stormwater facility" means a device or
system constructed for stormwater runoff
quantity control or water quality improvement
including but not limited to: rain gardens or
other bioretention facilities; infiltration facili-
ties; detention pipes, vaults, or ponds; and
oil/water separators.
V. "Stormwater pollution prevention plan"
means a document which describes the best
management practices and activities to be
implemented by a person to identify sources of
pollution or contamination at a premises and
the actions to eliminate or reduce pollutant dis-
charges to stormwater, stormwater convey-
ance systems, and/or receiving waters to the
maximum extent practicable.
W. "Waters of the state" includes those
waters as defined as "waters of the United
States" in 40 CFR Subpart 122.2 within the
geographic boundaries of Washington State

and "waters of the state" as defined in Chapter
90.48 RCW which includes lakes, rivers,
ponds, streams, inland waters, underground
waters, salt waters and all other surface waters
and water courses within the jurisdiction of the
state of Washington.
X. "Waterbody" means a surface water fea-
ture, whether standing or flowing, including,
but not limited to, sounds, lakes, ponds, rivers,
streams, and creeks including waters of the

7.200.030 Applicability.
This chapter shall apply to all nonstormwa-
ter discharges entering the MS4, groundwa-
ters, or a waterbody from any developed or
undeveloped lands, unless explicitly exempted

7.200.040 Responsibility for
administration.
The public works director (hereafter "direc-
tor") shall administer, implement, and enforce
the provisions of this chapter. Any powers
granted or duties imposed upon the director
may be delegated in writing by the director to
persons or entities acting in the beneficial
interest of or in the employ of the city. [Ord.

7.200.050 Severability.
The provisions of this chapter are hereby
declared to be severable. If any provision,
clause, sentence, or paragraph of this chapter
or the application thereof to any person, estab-
lishment, or circumstances shall be held
invalid, such invalidity shall not affect the
other provisions or application of this chapter.

7.200.060 Ultimate responsibility.
The standards set forth herein and promul-
gated pursuant to this chapter represent mini-
mum standards. Compliance by any person
with the standards established under this chap-
ter does not relieve any person from any
responsibility or obligation imposed pursuant
to any other local, state or federal regulation.

7.200.070 Stormwater discharges.
A. Prohibition of Illicit Discharges. No per-
son shall discharge or cause to be discharged
into the city's storm drainage system, ground-
water, or a waterbody any materials (including
but not limited to pollutants or waters contain-
ing any pollutants that cause or contribute to a
violation of applicable State of Washington
Department of Ecology water quality stan-
dards) other than stormwater. This prohibition
of the discharge of pollutants shall include dis-
charges from a stormwater facility that is not
maintained by the owner per the city of
Edmonds maintenance standards. Pollutants
include but are not limited to the following:
I. Trash or debris;
2. Construction materials;
3. Petroleum products including but not
limited to oil, gasoline, grease, fuel oil and
heating oil;
4. Antifreeze and other automotive
products;
5. Metals in either particulate or dis-
solved form;
6. Flammable or explosive materials;
7. Radioactive material;
8. Batteries;
9. Acids, alkalis, or bases;
10. Paints, stains, resins, lacquers, or
varnishes;
11. Degreasers and/or solvents;
12. Drain cleaners;
13. Pesticides, herbicides, or fertilizers;
14. Steam cleaning wastes;
15. Soaps, detergents, or ammonia;

16. Swimming pool or spa filter back-
wash;
17. Chlorine, bromine, or other disinfec-
tants;
18. Heated water;
19. Domestic animal wastes;
20. Sewage;
21. Recreational vehicle waste;
22. Animal carcasses;
23. Food wastes;
24. Bark and other fibrous materials;
25. Lawn clippings, leaves, or branches;
26. Silt, sediment, concrete, cement or
gravel;
27. Dyes (except as described in subsec-
tion (C) of this section under "allowable dis-
charges");
28. Chemicals, including suspected
metals, not normally found in uncontaminated
water;
29. Any other process -associated dis-
charge except as otherwise allowed in this sec-
tion;
30. Any hazardous material or waste not
listed above.
B. Prohibition of Illicit Connections.
1. The construction, use, maintenance or
continued existence of illicit connections to
the storm drain system is prohibited.
2. This prohibition expressly includes,
without limitation, illicit connections made in
the past, regardless of whether the connection
was permissible under law or practices appli-
cable or prevailing at the time of connection.
3. A person is considered to be in viola-
tion of this chapter if the person connects a line
conveying sewage to the municipal separate
storm sewer system, or allows such a connec-
tion to continue.
C. Allowable Discharges. The following
types of discharges shall not be considered
illicit discharges for the purposes of this chap-
ter unless the director determines that the type
of discharge, whether singly or in combination
with others, is causing or is likely to cause pol-
lution of groundwater or a waterbody:

1. Diverted stream flows;
2. Rising groundwaters;
3. Uncontaminated groundwater infil-
tration (as defined in 40 CFR 35.2005(20));
4. Discharge from foundation drains;
5. Air conditioning condensation;
6. Irrigation water from agricultural
sources that is commingled with urban storm -
water;
7. Springs;
8. Water from crawl space pumps;
9. Water from footing drains;
10. Flows from riparian habitats and
wetlands;
11. Discharges resulting from dye test-
ing authorized by the director;
12. Nonstormwater discharges covered
by another NPDES permit;
13. Discharges from emergency fire-
fighting activities by a fire department or a fire
district.
D. Conditional Discharges. The following
types of discharges shall not be considered
illicit discharges for the purposes of this chap-
ter if they meet the stated conditions, or unless
the director determines that the type of dis-
charge, whether singly or in combination with
others, is causing or is likely to cause pollution
of surface water or groundwater:
1. Potable water, including water from
water line flushing, hyperchlorinated water
line flushing, fire hydrant system flushing, and
pipeline hydrostatic test water. Planned dis-
charges shall be dechlorinated to a concentra-
tion of 0.1 parts per million (ppm) or less, pH -
adjusted, if necessary, and in volumes and
velocities controlled to prevent resuspension
of sediments in the stormwater system.
2. Lawn watering and other irrigation
runoff are permitted but shall be minimized
through, at minimum, public education and
water conservation efforts.
3. Swimming pool/hot tub/spa dis-
charges. Any person discharging from a swim-
ming pool, hot tub, spa, or similar facility must
direct the flow to either the municipal sanitary

sewer system or, after treatment as described
below, to the MS4. Discharge to surface
waters or groundwater (including infiltrating
the discharge to the ground) is prohibited. A
permit is required for all discharges from these
facilities.
The preferred method of discharging the
contents of these facilities is to direct the flow
to the municipal sanitary sewer system. If this
is believed to be infeasible, a request may be
filed with the director to allow discharge to the
MS4 or a waterbody per the conditions of this
chapter; the determination of infeasibility shall
be at the discretion of the director.
Should it be determined infeasible by the
director, the discharge to the MS4 or a water -
body shall be dechlorinated to a concentration
of 0.1 ppm or less, pH -adjusted, if necessary,
and in volumes and velocities controlled to
prevent resuspension of sediments in the MS4.
4. Street and sidewalk wash water,
water used to control dust, and routine external
building wash down that does not use deter-
gents are permitted if the amount of street
wash and dust control water used is mini-
mized. At active construction sites, street
sweeping must be performed prior to washing
the street.
5. Nonstormwater discharges covered
by another NPDES permit; provided, that the
discharger is in full compliance with all
requirements of the permit, waiver, or order
and other applicable laws and regulations; and
provided, that written approval has been
granted for any discharge to the storm drain
system.
6. Other nonstormwater discharges. The
discharges shall be in compliance with the
requirements of a stormwater pollution pre-
vention plan (SWPPP) reviewed and approved
by the city which addresses control of such dis-
charges by applying AKART to prevent pol-
lutants from entering the municipal storm
drainage system, groundwaters, or a water -
body. A permit is required for all construction
site dewatering and may be required by the

director for other nonstormwater discharges
approved by the city in a SWPPP. [Ord. 3751

7.200.080 Suspension of water service,
sanitary sewer service and
municipal separate storm sewer
system access.
A. Suspension Due to Illicit Discharges in
Emergency Situations. The director may, with-
out prior notice, suspend water service, sani-
tary sewer service and/or municipal separate
storm sewer system discharge access to a per-
son when such suspension is necessary to stop
an actual or threatened discharge which pre-
sents or may present imminent and substantial
danger to the environment, or to the health or
welfare of persons, or to the municipal sepa-
rate storm sewer system or waters of the state
of Washington. If the violator fails to comply
with an emergency suspension order, the
director may take such steps as deemed neces-
sary to prevent or minimize damage to the
municipal separate storm sewer system or
waters of the state of Washington, or to mini-
mize danger to persons.
B. Suspension Due to the Detection of
Illicit Discharge. Any person discharging to
the municipal separate storm sewer system in
violation of this chapter may have his/her
water service, sanitary sewer service and/or
municipal separate storm sewer system access
terminated if such termination would abate or
reduce an illicit discharge. The director will
notify a violator of the proposed termination of
its municipal separate storm sewer system
access. The violator may petition the director
for a reconsideration and hearing as provided
in this chapter.
C. Unauthorized Reinstatement. A person
commits an offense and violates this chapter if
the person reinstates municipal separate storm
sewer system access to premises terminated
pursuant to this section, without the prior
approval of the director. [Ord. 3751 § 2 (Exh.

7.200.100
7.200.090 Industrial or construction
activity discharges.
Any person or activity subject to an NPDES
stormwater discharge permit, waiver, or waste
discharge order issued to the discharger and
administered under the authority of the federal
Environmental Protection Agency or Wash-
ington State Department of Ecology, shall
comply with all provisions of such permit.
Proof of compliance with said permit may be
required in a form acceptable to the city prior
to allowing discharges to the municipal sepa-
rate storm sewer system. [Ord. 3751 § 2 (Exh.
A), 2009; Ord. 3483 § 1, 2003].
7.200.100 Inspection and monitoring of
discharges.
A. Access to Facilities.
1. As a condition of service, all persons
and premises connected to the municipal storm
drainage system shall allow the city to:
a. Enter onto the person's property at
reasonable times after notice to and with the
permission of the property owner to inspect the
system and any connection made to the system
by the property owner or to install appropriate
monitoring equipment. This provision shall
not be interpreted to limit the city's rights
under any easement, license or right arising
from a public right-of-way.
b. Inspect records of the person relat-
ing to discharges to the city system upon
request and at reasonable times.
2. Failure to permit entry or inspection
may result in the following actions or conse-
quences:
a. The city may at its sole option seek
a search warrant from a court of competent
jurisdiction.
b. If it is later determined that a viola-
tion of this chapter has occurred, the violation
shall be assumed to have been occurring from
the date of the city's original request and to
have continued until discovered by the city.
Each and every day shall be a separate viola-
tion. This presumption may be overcome by

the presumed violator only by clear and con-
vincing evidence that the violation began at a
later date.
B. Confidential Information. Information
and data furnished to the city with respect to
the nature and frequency of discharge into the
stormwater system shall be available to the
public or to other governmental agencies with-
out restriction unless the person specifically
requests and is able to demonstrate to the satis-
faction of the director that the release of such
information would divulge information, pro-
cesses, or methods of production entitled to
protection as trade secrets or proprietary infor-
mation of the person. When requested by a
person furnishing a report, the portions of a
report or other information which may dis-
close trade secrets or secret processes shall not
be made available for inspection by the public
but shall be made available upon written
request to governmental agencies for uses
related to these regulations, the NPDES permit
and/or other programs as amended; however
such portions of a report or other information
shall be available for use by the city, the state,
or any other public agency in enforcement pro-
ceedings involving the person furnishing the
report. The constituents and characteristics of
the stormwater will not be recognized as con-
fidential information. Information accepted by
the city as confidential shall not be transmitted
to any governmental agency or to the general
public by the director until and unless a 10 -day
notification is given to the person to the extent
permitted by law. [Ord. 3751 § 2 (Exh. A),

7.200.110 Requirement to prevent, control,
and reduce stormwater
pollutants by the use of BMPs.
The city has adopted the Department of
Ecology's 2005 Stormwater Management
Manual for Western Washington, Volume IV,
Source Control BMPs, and Volume V, Runoff
Treatment BMPs (hereafter "manual"). The
manual outlines requirements identifying best

management practices, including pollutant
source control for any activity, operation, or
facility which may cause or contribute to pol-
lution or contamination of stormwater, the
storm drain system, or waters of the United
States. The owner or operator of a commercial
or industrial establishment shall provide, at its
own expense, reasonable protection from acci-
dental discharge of prohibited materials or
other wastes into the municipal storm drainage
system or waterbody through the use of these
structural and nonstructural BMPs. Further,
any person responsible for a premises which is,
or may be, the source of an illicit discharge
may be required to implement, at said person's
expense, additional structural and nonstruc-
tural BMPs to prevent the further discharge of
pollutants to the municipal separate storm
sewer system. Compliance with all terms and
conditions of a valid NPDES permit authoriz-
ing the discharge of stormwater associated
with industrial activity, to the extent practica-
ble, shall be deemed in compliance with the
provisions of this section. These BMPs shall
be part of a stormwater pollution prevention
plan (SWPPP) as necessary for compliance
with requirements of the NPDES permit.
Technical assistance materials and informa-
tion may be provided by the city upon reason-
able request. [Ord. 3751 § 2 (Exh. A), 2009;

7.200.120 Waterbody protection.
Every person owning property through
which a waterbody passes, or such person's
lessee, shall not pollute, contaminate, intro-
duce new vegetation into, or significantly
retard the flow of water through the water -
body, and must comply with all critical areas
protection requirements established in Chapter
23.40 ECDC. In addition, the owner or lessee
shall maintain existing privately owned struc-
tures within or adjacent to a waterbody, in a
manner that such structures will not become a

hazard to the use, function, or physical integ-
rity of the waterbody. [Ord. 3751 § 2 (Exh. A),

7.200.130 Notification of spills.
Notwithstanding other requirements of law,
as soon as any person responsible for a pre-
mises or operation, or responsible for emer-
gency response for a premises or operation,
has information of any known or suspected
release of materials which are resulting or may
result in illicit discharges or pollutants dis-
charging into stormwater, the storm drainage
system, or waterbodies, said person shall take
all necessary steps to ensure the discovery,
containment, and cleanup of such release. In
the event of such a release of hazardous mate-
rials said person shall immediately notify:
A. Emergency response agencies of the
occurrence via emergency dispatch services;
and
B. The city of Edmonds illicit discharge
hotline posted on the city's website.
In the event of a release of nonhazardous
materials, said person shall notify the director
in person or by phone or facsimile no later than
the next business day. Notifications in person
or by phone shall be confirmed by written
notice addressed and mailed to the city of
Edmonds within three business days of the
phone notice. If the discharge of prohibited
materials emanates from a commercial or
industrial establishment, the owner or operator
of such establishment shall also retain an on-
site written record of the discharge and the
actions taken to prevent its recurrence. Such
records shall be retained for at least three

7.200.140 Enforcement.
A. In applying the stormwater pollution
source control manual to prohibited discharges
from normal residential activities, the director
shall use public education and warnings as the
primary method of gaining compliance with

this chapter and shall not use citations, notice
and orders, assessment of civil penalties and
fines, or other compliance actions unless the
director determines: (1) the discharge from a
normal residential activity, whether singly or
in combination with other discharges, is caus-
ing a significant contribution of contaminants
to surface and stormwater or groundwater; or
(2) the discharge from a normal residential
activity poses a hazard to the public health,
safety or welfare, endangers any property or
adversely affects the safety and operation of
city rights-of-way, utilities or other city -
owned or maintained property.
B. Civil Penalties Process Adopted. Chap-
ter 20.110 ECDC enforcement procedures are
herein adopted in full with the proviso that
repeat offenders or violations deemed an
immediate public hazard shall be subject to a
compliance and appeal timeline as deemed
appropriate by the director based on the spe-
cific nature and extent of the violation.
C. Enforcement Orders. Whenever the
director finds that a person has violated a pro-
hibition or failed to meet a requirement of this
chapter, the director may order compliance by
written order to correct violation or notice of
civil violation to the responsible person. Such
notice may require without limitation:
1. The performance of monitoring, anal-
yses, and reporting;
2. The elimination of illicit connections
or illicit discharges;
3. That violating discharges, practices,
or operations shall cease and desist;
4. The abatement or remediation of
stormwater pollution or contamination hazards
and the restoration of any affected property;
5. Payment of a fine to cover adminis-
trative and remediation costs as provided
under ECC 7.200.150; and
6. The implementation of source control
or treatment BMPs.
D. Compliance Deadlines. If abatement of
a violation and/or restoration of affected prop-
erty is required, the notice shall set forth a

deadline within which such remediation or res-
toration must be completed. Said notice shall
further advise that, should the violator fail to
remediate or restore within the established
deadline, the work will be done by the city or
a contractor designated by the public works
director and the expense thereof shall be
charged to the violator. [Ord. 3751 § 2 (Exh.

7.200.150 Penalties and collection.
A. Civil Penalties. In addition to any other
penalties mentioned in this chapter, the direc-
tor may assess fines of no less than $100.00
nor more than $500.00 per day or portion of
day thereof of the offense, to any person who
fails to comply with the provisions of this
chapter. The violator shall also reimburse the
city for all costs associated with the enforce-
ment of each violation, including but not lim-
ited to administrative expenses, attorney's
fees, legal costs and disbursements.
B. Use of Collection Agency Authorized.
The city may also, in its sole and exclusive dis-
cretion, utilize a collection agency to collect
fines applicable to this chapter. When a collec-
tion agency is used, fines will be collected at a
rate of 150 percent pursuant to RCW
19.16.500. [Ord. 3751 § 2 (Exh. A), 2009;

7.200.160 Appeal of notice of violation.
Notwithstanding other provisions of this
chapter, any person receiving a notice of civil
violation under ECC 7.200.140 may appeal the
determination of the public works director to
the hearing examiner. The appeal process shall
be in accordance with ECDC 20.110.040(C).
The notice of appeal must be received by the
director within 10 days from the date of the
notice of civil violation. The decision of the
hearing examiner shall be final. [Ord. 3751 § 2

7.200.170 Enforcement measures after
appeal.
If the violation has not been corrected pur-
suant to the requirements set forth in the notice
of civil violation, or, in the event of an appeal,
within 10 days of the decision of the municipal
authority upholding the decision of the direc-
tor, representatives of the director may enter
upon the subject private property and are
authorized to take any and all measures neces-
sary to abate the violation and/or restore the
property. It shall be unlawful for any person,
owner, agent or person in possession of any
premises to refuse to allow the city or desig-
nated contractor to enter upon the premises for
the purposes set forth above. [Ord. 3751 § 2

7.200.180 Cost of abatement of the
violation.
A. Abatement by City. If the violation has
not been corrected pursuant to the require-
ments set forth in the notice of civil violation,
or, in the event of an appeal under ECC
7.200.160, within 10 days of the hearing exam-
iner ruling upholding the director's decision,
then the city or a contractor designated by the
director may enter upon the subject premises
and is authorized to take any and all measures
necessary to abate the violation and/or restore
the property. It shall be unlawful for any per-
son, owner, agent or person in possession of
any premises to refuse to allow the city or des-
ignated contractor to enter upon the premises
for the purposes set forth above and the city
may pursue any lawful remedy at its disposal,
including but not limited to the procedures and
consequences set forth in ECC 7.200.100.
B. Charging Cost of Abatement.
1. The city may recover against a prop-
erty owner in violation of this chapter all attor-
ney's fees, court costs and other administrative
expenses associated with enforcement hereof,
including but not limited to sampling and mon-
itoring expenses.

2. Within 30 days after abatement of the
violation by the city, the director may notify
the property owner of the cost of abatement,
including administrative costs. The property
owner may file a written protest objecting to
the amount of the assessment with the city
clerk within 15 days. The city clerk shall set
the matter for public hearing by the city coun-
cil. The decision of the city council shall be set
forth by resolution and shall be final.
C. Urgency Abatement. The director is
authorized to require immediate abatement of
any violation of this chapter that constitutes an
immediate threat to the health, safety or well-
being of the public. If any such violation is not
abated immediately as directed by the director,
the city of Edmonds is authorized to enter onto
private property and to take any and all mea-
sures required to remediate the violation. Any
expense related to such remediation under-
taken by the city shall be fully reimbursed by
the property owner and/or responsible party.
Any relief obtained under this section shall not
prevent the city from seeking other and further
relief authorized under this chapter. [Ord.

7.200.190 Violations of federal Clean
Water Act.
Any person who violates any provision of
this chapter, or any provision of any require-
ment issued pursuant to this chapter, may also
be in violation of tiie Clean Water Act and may
be subject to the sanctions of that act including
civil and criminal penalties. [Ord. 3751 § 2

7.200.200 Injunctive relief.
It shall be unlawful for any person to violate
any provision or fail to comply with any of the
requirements of this chapter. If a person has
violated or continues to violate the provisions
of this chapter, the director may petition any
court of competent jurisdiction for a prelimi-
nary or permanent injunction restraining the
person from activities which would create fur -

ther violations or compelling the person to per-
form abatement or remediation of the

7.200.210 Compensatory action.
In lieu of enforcement proceedings, penal-
ties, and remedies authorized by this chapter,
the director may impose upon a violator alter-
native compensatory actions, including but not
limited to storm drain stenciling, attendance at
compliance workshops, and waterbody reme-

7.200.220 Violations deemed a public
nuisance.
In addition to the enforcement processes
and penalties provided, any condition caused
or permitted to exist in violation of any of the
provisions of this chapter is a threat to public
health, safety, and welfare, and is declared and
deemed a public nuisance, and may be sum-
marily abated or restored at the violator's
expense, and/or a civil action to abate, enjoin,
or otherwise compel the cessation of such nui-

7.200.230 Criminal prosecution.
Any person that has violated or continues to
violate this chapter shall be liable to criminal
prosecution to the fullest extent of the law, and
shall be subject to a criminal penalty of
$250.00 per violation per day and/or imprison-
ment for a period of time not to exceed 30

7.200.240 Remedies not exclusive.
The remedies listed in this chapter are not
exclusive of any other remedies available
under any applicable federal, state or local law
and it is within the discretion of the director to

8.51.010 Purpose.
The purpose of this chapter is to provide
more parking to the general public in high
demand parking areas by encouraging
Edmonds' business owners and employees to
park in lower demand parking areas. [Ord.
3564 § 3, 2005].
8.51.020 Definitions.
A. "Employee parking permit" means a
permit that authorizes permit employees to
park for more than three hours in three-hour
parking areas if the parking is part of a com-
mute to work as required by this chapter. The
employee parking permit shall not guarantee a
parking space, nor shall it exempt the vehicle
or operator from observing zones where a
party is prohibited at all times, including, but
not limited to, no parking zones, load zones,
fire zones and all other applicable regulations
contained in the Edmonds City Code.
B. "Employee permit business" means a
business that is located within the city of
Edmonds.
C. "Permit employee" means an owner or
employee of an employee permit business.
8.51.030
D. "Temporary employee parking permit"
means a permit that authorizes jurors seated
for trial at the municipal court of the city of
Edmonds to park for more than three hours in
three-hour parking areas as provided in this
chapter. The temporary employee parking per-
mit shall not guarantee a parking space, nor
shall it exempt the vehicle or operator from
observing other applicable traffic regulations
in state and local laws. [Ord. 3633 § 1, 2007;

8.51.030 Commute exemption from three-
hour parking limits.
A. The three-hour parking time limits for
streets identified in subsection (B) of this sec-
tion shall not apply to motor vehicles that sat-
isfy the following criteria:
1. The motor vehicle displays a current
employee parking permit in either of the fol-
lowing ways: (a) hang the permit from the
rear-view mirror of the vehicle, or (b) place the
permit sticker on the outside of the rear win-
dow, upper corner of driver's side; and
2. The motor vehicle is parked in a
three-hour parking area identified in subsec-
tion (B) of this section; and
3. The motor vehicle initially driven to
the parking area was occupied by a person
who:
a. Is employed by a business that has
been issued employee parking permit(s); and
b. Is identified in ECC 8.51.040
(C)(1); and
4. The motor vehicle is parked while the
person identified in subsection (A)(3) of this
section is working for the employee permit
business that provided the employee parking
permit that is displayed in the vehicle; and
5. The motor vehicle is identified in
ECC 8.51.040(C)(1); and
6. The motor vehicle is parked in a
three-hour parking area between 7:00 a.m. and
6:00 p.m., Monday through Saturday, except
for parking in the parking lot for the Edmonds
public works division, identified by subsection

(B)(15) of this section, at which the motor
vehicle is parked between 7:00 a.m. and 6:00
p.m., Monday through Friday.
B. An employee parking permit shall be
effective in the three-hour parking areas
located along the following streets:
1. Both sides of Edmonds Street from
Sunset Avenue to Fifth Avenue North;
2. Both sides of Bell Street from Sunset
Avenue to Fifth Avenue North;
3. South side of Bell Street from Fifth
Avenue North to Sixth Avenue North;
4. North side of James Street from Sun-
set Avenue to Third Avenue South;
5. South side of James Street from Sun-
set Avenue to 250 feet east of Second Avenue
South;
6. Both sides of Dayton Street from
Sunset Avenue (State Route 104) to Fifth Ave-
nue South except the north side of Dayton
Street from Third Avenue South to 150 feet
east of Third Avenue South;
7. Both sides of Walnut Street from 120
feet west of Fifth Avenue South to 120 feet
east of Fifth Avenue South;
8. Both sides of Maple Street from Fifth
Avenue South to 120 feet east of Fifth Avenue
South;
9. Both sides of Alder Street from Fifth
Avenue South to 120 feet east of Fifth Avenue
South;
10. Both sides of Second Avenue North
from Bell Street to Edmonds Street;
11. Both sides of Third Avenue North
from Bell Street to a point 265.5 feet north of
its intersection with Edmonds Street;
12. Both sides of Fourth Avenue North
from Bell Street to Edmonds Street;
13. Both sides of Fifth Avenue North
from Bell Street to Edmonds Street;
14. West side of Sixth Avenue North
from Dayton Street to Bell Street;
15. East side of Sixth Avenue from Day-
ton Street to the alley between Main Street and
Bell Street;

16. Both sides of Fourth Avenue South
from Walnut Street to Dayton Street;
17. The 15 parking spaces located in the
northwest corner parking lot for the building
located at 200 Dayton Street. In addition,
beginning on January 1, 2010, except on
Wednesdays and Saturdays, the seven parking
stalls numbered one through seven in the
southwest corner parking lot for the building
located at 200 Dayton Street;
18. Both sides of Howell Way from
Fourth Avenue South to Fifth Avenue South;
19. Both sides of Second Avenue South
from Dayton Street to its dead end, located
south of Alder Street;
20. Both sides of Alder Street between
its intersections with Second Avenue South
and Third Avenue South; and
21. Both sides of Admiral Way from its
intersection with Dayton Street and south
thereof to the end of the public right-of-way
(approximately 2,300 feet). [Ord. 3758 § 2,

8.51.040 Issuance of employee parking
permits.
A. An owner or the lead supervisor in
employee permit business shall be the only
person(s) who may acquire employee parking
permits for himself or herself and their
employees from the Edmonds city clerk.
B. The owner or lead supervisor shall be
responsible for distribution of employee park-
ing permits to permit employees employed by
the employee permit business. Employee park-
ing permits may be transferred from one
employee or owner within an employee permit
business to another.
C. Applications for employee parking per-
mits shall be made upon forms provided by the
city of Edmonds and shall at a minimum con-
tain the following information:
1. Name and address of all persons who
will use the employee parking permits for the
Edmonds City Code
three-hour parking exemptions granted by this
chapter.
2. Name and address of the employee
permit business and the owner or lead supervi-
sor responsible for the application.
3. Employee permit business address.
4. Responses by each person who will
be using an employee parking permit to a park-
ing survey issued by the city clerk that will be
used to verify the assumptions used to justify
this chapter.
D. Employee parking permit application
forms shall be signed by the owner or lead
supervisor identified in subsection (C)(2) of
this section.
E. The issuance of employee parking per-
mits under this chapter shall be contingent
upon the payment of a $50.00 application fee
per permit for applications received through
June 29th of each calendar year. The applica-
tion fee for applications received on or after
June 30th of each calendar year shall be
reduced to $25.00. Application forms can be
updated to reflect changes in the information
required by this section so long as no addi-
tional employee parking permits are requested.
F. Employee parking permits shall be
effective for the calendar year for which they
are issued, except that permits applied for after
December 1st shall be effective through the
subsequent calendar year. [Ord. 3758 § 1,

8.51.042 Temporary employee parking
permit — Validation required.
A. The administrator of the municipal court
of the city of Edmonds shall issue, free of
charge, temporary employee parking permits
to potential jurors summoned for jury duty at
the court. Said permits shall not be valid until
they are validated by the administrator on the
day of jury duty. Permits shall be valid only for
the day on which they are validated.
B. The administrator shall validate only
temporary employee parking permits for jurors
seated for trial, and shall notify parking

enforcement which temporary employee park-
ing permits are validated on any given day
when the court is presiding over a jury trial.
C. Temporary employee parking permits
shall be valid only in spaces designated for
public parking in the public safety building
parking lot and in the three-hour parking areas
set forth in ECC 8.51.030(B). [Ord. 3633 § 2,

8.51.045 Employee permit parking fund
created.
There is hereby created a special fund to be
known as the "employee parking permit fund."
All application fees received by the city pursu-
ant to ECC 8.51.040(E) shall be deposited in
this fund. All monies in this fund shall be used
solely and exclusively for the administration
of the employee permit parking program cre-
ated by this chapter or for costs associated with
parking enforcement in the downtown area or
future parking inventories and studies in the

8.51.050 Unlawful employee permit
parking activities and
revocation.
A. It shall be unlawful for any person to
duplicate and use an employee parking permit
for purposes of parking more than three hours
in a three-hour parking area and it shall also be
unlawful to otherwise use an employee park-
ing permit for purposes of avoiding parking
restrictions in any manner not specified by this
chapter.
B. The city clerk may revoke the employee
parking permit of any person the clerk deter-
mines has abused the employee parking pro-
gram by engaging in unlawful activities
specified in subsection (A) of this section. The
city clerk's determination may be appealed by
the permit holder to the city council, which
shall grant a hearing for the appeal and issue
written findings of fact and conclusions of law
in support of its decision. A permit holder who
has had his or her permit revoked shall be inel-

igible for reissuance of the permit for a period
of one year from the date of revocation. [Ord.

8.51.060 Penalties.
A. Any person who both (1) parks a vehicle
for more than three hours in violation of ECC
8.64.060 or 8.64.065 or any other city ordi-
nance imposing a three-hour parking limit; and
(2) displays an employee parking permit as
required in ECC 8.51.030(A)(1) without using
the parking area as part of a commute to work
as specified in ECC 8.51.030(A)(2) to (5) shall
have committed a parking infraction subject to
the provisions of Chapter 8.48 ECC and shall
be fined at twice the civil penalty for overtime
parking levied under ECC 8.48.215.
B. Any person who parks a vehicle in a
three-hour parking area for more than three
hours with an employee parking permit that
the person knows has been duplicated or made
to appear to be an employee parking permit
shall have committed a parking infraction sub-
ject to the provisions of Chapter 8.48 ECC and
shall be fined a civil penalty of $50.00. [Ord.
