1.01.005 Adoption of Edmonds City Code.
Pursuant to the provisions of RCW
35A.21.130 and 35.21.500 through 35.21.570,
there is hereby adopted the Edmonds City
Code as contained in that certain copy on file
in the office of the city clerk. [Ord. 2183 § 2,
1980].
1.01.010 Title — Citation — Reference.
This code shall be known as the Edmonds
City Code and it shall be sufficient to refer to
the code as the code in any prosecution for the
violation of any provisions thereof or in any
proceeding at law or equity. It shall also be suf-
ficient to designate any ordinance adding to,
amending, correcting or repealing all or any
part or portion thereof as an addition to,
amendment to, correction of, or repeal of the
Edmonds City Code. Further reference may be
had to the titles, chapters, sections and subsec-
tions of the Edmonds City Code and such ref-
erence shall apply to that numbered title,

chapter, section or subsection as it appears in

1.01.015 Reference applies to
amendments.
Whenever a reference is made to this code as
the Edmonds City Code or to any portion
thereof, or to any ordinance of the city, the ref-
erence shall apply to all amendments, correc-
tions and additions heretofore, now, or hereaf-
ter made. [Ord. 2183 § 2, 1980].
1.01.020 Codification authority.
This code consists of all of the regulatory
and penal ordinances and certain of the admin-
istrative ordinances of the city, codified pursu-
ant to RCW 35A.21.130 and 35.21.500
through 35.21.570. [Ord. 2183 § 2, 1980].
1.01.025 Definitions.
The following words and phrases whenever
used in this code shall be construed as defined
in this section unless from the context a differ-
ent meaning is intended, or unless a different
meaning is specifically defined and more par-
ticularly directed to the use of such words or
phrases:
A. "City" means the city of Edmonds,
Washington, or the area within the territorial
city limits of the city of Edmonds, Washington,
and such territory outside of this city over
which the city has jurisdiction or control by vir-
tue of the constitutional provision, or any law.
B. "City council" means the city council of
the city of Edmonds.
C. "County" means Snohomish County.
D. "Mayor" means the mayor of the city of
Edmonds.
E. "Oath" includes affirmation.
F. Office, Title of. The use of the title of
any officer, employee, or any office, or ordi-
nance means such officer, employee, office,
ordinance of the city, unless otherwise specifi-
cally designated.
G. "Person" means natural person, joint
venture, joint stock company, partnership,

association, club, company, corporation, busi-
ness trust, organization, including the manager,
lessee, agent, servant, officer or employee of
any of them.
H. "State" means the state of Washington.
I. "Shall" and "must" are each mandatory.
I "May" is permissive.
K. "Written" includes printed, typewritten,
mimeographed, multigraphed, or photocopied.

1.01.030 Grammatical interpretation.
The following grammatical rules shall apply
in this code:
A. Gender. Any gender includes the mascu-
line, feminine and neuter genders.
B. Singular and Plural. The singular num-
ber includes the plural and the plural includes
the singular.
C. Tenses. Words used in the present tense
include the past and the future tenses and vice -
versa.
D. Use of Words and Phrases. Words and
phrases used in this code and not specifically
defined shall be construed according to the
context and approved usage of the language.

1.01.035 Construction.
The provisions of this code and all proceed-
ings under it are to be construed with a view to
effect its objects and to promote justice. [Ord.
2183 § 2, 1980].
1.01.040 Title, chapter and section
headings.
Title, chapter and section headings con-
tained herein shall not be deemed to govern,
limit, modify or in any manner affect the
scope, meaning or intent of the provisions of
any title, chapter or section hereof. [Ord. 2183
§ 2, 19801.
1.01.050 Reference to specific ordinances.
The provisions of this code shall not in any
manner affect documents or other matters of

record which refer to, or are otherwise con-
nected with ordinances which are therein spe-
cifically designated by number or otherwise,
and which are included within this code, but
such reference shall be construed to apply to
the corresponding provisions contained within
this code. [Ord. 2183 § 2, 1980].
1.01.060 Effect of code on past actions and
obligations.
Neither the adoption of this code nor the
repeal or amendment hereby of any ordinance
or part or portion of any ordinance of the city
shall in any manner affect the prosecution for
violations of ordinances, which violations were
committed prior to the effective date hereof,
nor be construed as a waiver of any license, fee,
or penalty at the effective date and unpaid
under such ordinance, nor be construed as
affecting any of the provisions of such ordi-
nance relating to the collection of any such
license, fee, or penalty, or the penal provisions
applicable to any violation thereof, nor to affect
the validity of any bond or cash deposit in lieu
thereof required to be posted, filed, or depos-
ited pursuant to any ordinance, and all rights
and obligations thereunder appertaining shall
continue in full force and effect. [Ord. 2183 §

1.01.070 Repeal shall not revive any
ordinances.
The repeal of an ordinance shall not repeal
the repealing clause of such ordinance or
revive any ordinance which has been repealed
thereby. [Ord. 2183 § 2, 1980].
1.01.080 Supersedure.
All general ordinances of the city inconsis-
tent with this code are hereby superseded,
rather than repealed, and in the event any por-
tion of this code is for any reason found or held
to be invalid, the superseded ordinance shall be
revitalized and shall prevail. [Ord. 2183 § 2,
1980].

strued to apply to charges for accident reports
pursuant to RCW 46.52.085.
B. The city clerk may require a deposit in
an amount not to exceed 10 percent of the esti-
mated cost of providing copies for a request. If
public records are made available on a partial
or installment basis, the applicable fees shall
be due and payable for each part of the request
as it is provided. If an installment of a records
request is not claimed or reviewed, the city
shall not be obligated to fulfill the balance of

1.20.045 Index of public records —
Findings and order.
A. Findings.
1. The Public Records Act requires all
cities and public agencies to maintain and
make available a current index of all public
records.
2. RCW 42.56.070(4) provides that an
agency need not maintain such an index if to
do so would be unduly burdensome, but it
must issue and publish a formal order specify-
ing the reasons why and the extent to which
compliance would be unduly burdensome or
would interfere with agency operations.
3. The city is comprised of numerous
departments, their divisions and subdivisions,
many if not all of which maintain separate
databases and/or systems for the indexing of
records and information.
4. Because the city has records which
are diverse, complex and stored in multiple
locations and in multiple computer systems,
formats and/or databases, it is unduly burden-
some, if not physically impossible, to maintain
a current index of all records.
B. Order. Based upon the findings set forth
in subsection (A) of this section, and pursuant
to RCW 42.56.070(4), the city council orders
the following:
1. The city is not required to maintain an
all-inclusive index of public records due to the

undue burden and near -impossibility of main-
taining such an index.
2. The city will make available for
inspection and/or copying all public records,
including any indexes that are maintained by
the city, except to the extent that such records
are exempt from public disclosure. [Ord. 3641
§ 2, 2007].
1.20.050 Transcriptions.
The following procedures shall apply unless
inconsistent with an order of the Snohomish
County Superior Court:
A. When the city is required to prepare a
verbatim written transcript of any proceeding
of the city in response to a writ of review or
other action filed in the Superior Court or any
other state or federal court, the cost of prepar-
ing the same shall be born by the party filing
the action pursuant to rates and charges as pro-
posed by the city clerk and approved by the
city council. The party filing such action shall
pay to the city clerk the estimated costs, as
determined by the city clerk, of the preparation
of the transcript based on the aforementioned
rates and charges, including copying costs and
the city clerk shall thereafter have the tran-
script prepared.
B. Should the actual cost incurred by the
city in the preparation of the transcript exceed
the amount deposited with the city clerk, the
party making such deposit shall be required to
reimburse the city for such additional amount
within 10 days of notification that such amount
is due or prior to the time the transcript is
required to be filed with the court, whichever
occurs first. Should the actual cost incurred by
the city be less than the estimated cost depos-
ited, such credit due shall be reimbursed by the
city to the party making the deposit. [Ord.

1.20.060 Certification fees.
The city clerk shall establish fees for the cer-
tification of public records and such fees shall
be approved by resolution by the city council.

The city clerk shall determine the manner in
which, as consistent with applicable law,
records and groups of records are to be certi-
fied. [Ord. 3011 § 1, 1995].
1.20.070 Modifications to fees and
charges.
All fees and charges identified in this chap-
ter may be modified by the city clerk as
approved by resolution of the city council from
time to time as deemed necessary by the city
clerk to reflect increases in the costs of provid-
ing the services identified in this chapter. All
fees and charges established pursuant to this
chapter shall reflect the actual costs of the ser-
vices provided. [Ord. 3011 § 1, 1995].
1.20.080 Public disclosure forms.
A. Public officials of the city of Edmonds
shall file public disclosure forms in accor-
dance with the Washington State Public Dis-
closure Commission requirements.
B. Copies of the forms filed, maintained in
the offices of the Washington State Public Dis-
closure Commission and available for inspec-
tion over the Internet, shall be available on-line
at the public access computer in the City Hall
customer service area without charge.
C. One paper copy of each form shall be
provided to any member of the public at no
charge. Additional copies of any form
requested by an individual shall be subject to
the copying charges established by this chap-
ter.
D. While the Appearance of Fairness Doc-
trine, Chapter 42.36 RCW, does not require the
disclosure of campaign contributions properly
disclosed to the public disclosure commission,
a councilmember should make a good faith
effort to disclose in any quasi-judicial hearing
before the council campaign contributions in
excess of $250.00 received from a person or
entity identified in the record as a party of

1.99.010 Intent.
It is the public policy of the city that the peo-
ple shall be assured that the private financial
dealings of their public officials and of candi-
dates for those offices present no conflict of
interest between the public trust and private
interest. [Ord. 3785 § 1, 2010].
1.99.020 Definitions.
The terms used in this chapter shall be
afforded definitions found in RCW 42.17.020
or Chapter 390-05 WAC, as the same exists or
is hereafter amended, and are hereby adopted
by reference, except that the following terms
shall be given the meaning set forth below:
A. "Election cycle" means the combination
of the general or special election and the pri-
mary election to the office in question and
begins on the date an individual becomes a
candidate for such office as the term "candi-
date" is defined by RCW 42.17.020 and ends
on the date that the candidate files his or her
final report pursuant to RCW 42.17.180(2).
B. To "accept" or "receive" a contribution
means the receipt of a contribution, deposit of
funds with other campaign funds, and report of
the contribution to the public disclosure com-
mission, except when a candidate returns the
contribution to the contributor within five
business days of the date on which it is
received by the candidate or political commit-
tee acting on behalf of that candidate.
C. "Person" includes an individual, part-
nership, joint venture, public or private corpo-
ration, association, federal, state, or local

governmental entity or agency, however con-
stituted, candidate, committee, political com-
mittee, political party, executive committee
thereof or any other organization or group of
persons, however organized.
D. "Public Disclosure Commission" means
the Washington State Public Disclosure Com-
mission as established under RCW 42.17.350
as the same exists or is hereafter amended.

1.99.030 Application.
These limits shall apply to candidates in any
election for the Edmonds city council or for
mayor of the city of Edmonds. [Ord. 3785 § 1,
2010].
1.99.040 Contribution limits.
A. No candidate shall accept or receive dur-
ing the election cycle campaign contributions
totaling more than $500.00 from any one per-
son.
B. The limitations in this section shall
apply to all contributions except:
1. A campaign contribution of his/her
own resources to his/her own campaign;
2. The value of volunteer services; or
3. Publicly donated funds under provi-
sions authorizing public funding of local cam-
paigns. [Ord. 3785 § 1, 2010].
1.99.050 Civil violation.
Any person who shall commit any violation
of the provisions as set forth in this chapter
shall have committed a civil violation and
upon finding by the Edmonds municipal court
that such violation has been committed, shall
pay a monetary penalty to the city of Edmonds
equivalent to the monetary amount of contri-
butions above $500.00 received by the candi-
date, in the aggregate, from the source giving
rise to a violation during the election cycle.

3.04.010 Financial reporting.
The city's financial system shall assure that
the status and transactions of each account in a
relationship to budget authority is clear. The
form of the city's financial reporting system is
established by the State Auditor and the city
shall comply in all respects with state financial
reporting requirements. [Ord. 3789 § 1, 2010].
3.04.020 Quarterly reports.
The mayor and staff shall provide quarterly
reports showing the expenditures and liabili-
ties against each separate budget appropriation
incurred during the preceding reporting period
together with the unexpended balance of each
appropriation. The report shall also show the
receipts from all sources. [Ord. 3789 § 1,
2010].
3.04.030 Monthly updates.
The city council requests that the staff pro-
vide to the city council's finance committee
monthly revenue reports. At a minimum, the
following funds are requested to be provided:
REET 1 and 2, sales and use tax, gas utility tax,
telephone utility tax, electric utility tax. A
monthly general fund analysis of comparing
revenue budget to actual and expenditure bud-
get to actual with the net balance is requested.
After review by the finance committee, these
reports will be available on the city's website
under the finance area. All proposed budget
amendments or council -approved changes that
will be included in future budget amendments

are requested to be included in the monthly
report. Graphs are requested to be integrated
into a report to provide trend analyses. [Ord.

3.04.040 Quarterly summaries.
Quarterly summaries shall be provided
within a minimum of 30 days of quarter -end.
Reports should include an: overview, major
revenue projections, general revenue detail,
expenditure summary, expenditure detail by
fund and expenditure detail by department. A
narrative discussing the trends, the drivers and
assumptions should be included and after
finance committee review, these statements
will be made available on the website under
finance. [Ord. 3789 § 1, 2010].
3.04.050 Comprehensive annual financial
report.
The comprehensive annual financial report
(CAFR) shall be timely and meet or exceed
professional industry standards. A preliminary
CAFR summary will be required by the first
month subsequent to the first quarter.
A. Revenues and expenditures for the gen-
eral fund and all operating funds shall be pro-
jected for the ensuing biennium. Biennium
budget amendments shall be clearly labeled
identifying the report and date and if any ordi-
nance requires city council deliberations, those
items shall be highlighted.
B. The city's budget and biennial budget
documents shall provide for comparison with

special fund to be known and designated as the
"equipment rental fund," to be used as a
revolving fund to be expended for salaries,
wages, and operations required for the repair,
replacement, purchase, and operation of equip-
ment, and for the purchase of equipment,
materials and supplies to be used in the admin-

3.05.020 Administration.
The equipment rental fund shall be adminis-

Edmonds City Code
5.05.115 Nuisances defined.
A. All violations of this chapter are detri-
mental to the public health, safety and welfare
and are declared to be public nuisances.
B. Nuisances are hereby defined to include:
1. Any animal which chases, runs after
or jumps at vehicles using public streets and
alleys;
2. Any animal which habitually snaps,
growls, snarls, jumps upon or otherwise threat-
ens persons lawfully using the public side-
walks, streets, alleys or other public ways;
3. Any animal which has exhibited
vicious propensities and which constitutes a
danger to the safety of persons or property off
his premises or lawfully on his premises;
4. A vicious animal or animal with
vicious propensities which runs at large at any
time, or such an animal off the owner's pre-
mises not securely leashed on a line or con-
fined and in the control of a person of suitable
age and discretion to control or restrain such
animal;
5. Any animal which howls, yelps,
whines, barks or makes any noises in such a
manner as to disturb any person or neighbor-
hood to an unreasonable degree;
6. Animals kept, harbored or maintained
and known to have a contagious disease,
unless under the treatment of a licensed veter-
inarian;
7. Animals running in packs;
8. Any dog running at large within the
city;
9. A female animal, whether licensed or
not, while in season, accessible to other ani-
mals for purposes other than controlled and
planned breeding;
10. Any animal which causes damage to
property other than the property of the ani-
mal's owner or person having physical charge
and control of the animal; or
11. Any animal maintained in violation
of any provision of this chapter.
C. All nuisances under this chapter shall be
abated as provided in this chapter. In addition,

any owner or person having charge of any ani-
mal who fails to abate such nuisance shall be
guilty of a misdemeanor with a maximum pen-
alty of $1,000 fine and/or 90 days in jail. [Ord.

5.05.120 Nuisance — Notice and order to
abate.
A. Notice — When Required. Whenever it
shall be stated in writing by an animal control
officer or by three or more persons having sep-
arate residences or regularly employed in any
neighborhood that any animal is a nuisance as
defined in ECC 5.05.115, the animal control
authority shall serve a notice of violation and
order of abatement upon the owner of the ani-
mal directing that the nuisance be abated.
B. Notice — Final Determination Unless
Appealed. The service of a notice of violation
and order of abatement shall, unless timely
appealed, be a final determination that the ani-
mal is a nuisance and such nuisance must be
immediately abated.
C. Notice — Contents. The notice of viola-
tion and order to abate a nuisance shall con-
tain:
1. The name and address, if known, of
the owner or person having physical charge
and control of the animal if the identity of the
owner cannot be reasonably ascertained;
2. The license number, if available, and
description of the animal;
3. A statement that the animal control
authority has determined the animal to be a
nuisance and a description of the nuisance
activity;
4. A statement that the nuisance activity
must be immediately abated;
5. A statement that service of the notice
of violation and order of abatement is a final
determination unless appealed and that an
appeal must be filed within five days of service
of the notice of violation and order of abate-
ment;
6. A copy of ECC 5.05.123 regarding
appeal procedures;

D. Notice — Service. Service of the notice

F. Penalty. Any person who wilfully fails to
comply with an order to abate a nuisance is

tially dangerous dog as defined in ECC

5.05.122 Dangerous dogs.
A. Declaration. Upon declaration by the

ous dog as defined in ECC 5.05.010, the owner

dence of the owner or by certified mail to the
last known address of the owner.
E. Appeal. An appeal of a dangerous dog

Edmonds police chief within five days of ser-
vice of the dangerous dog declaration. Appeals

with ECC 5.05.123.
F. Requirements for Dangerous Dogs.
Strict compliance with each of the following
conditions is required to keep a dangerous dog
in the city of Edmonds:
1. In addition to any license required
under the provisions of this chapter, all dog
owners who are required to obtain a certificate
of registration, pursuant to the dangerous dog
provisions of Chapter 16.08 RCW, must
obtain a city of Edmonds dangerous dog certif-
icate of registration. The applicant shall apply
for such certificate upon forms supplied by the
city clerk and pay an annual fee of $100.00,
which shall not be prorated for any part of a
year. A copy of a valid certificate of registra-
tion issued pursuant to Chapter 16.08 RCW
shall be attached to the application. The city of
Edmonds dangerous dog certificate of registra-
tion shall be issued upon completing the
requirements of this section.
2. The owner of dangerous dog shall
provide for proper enclosure of a dangerous
dog. A dangerous dog may not be outside of
the dwelling of the owner or outside of a
proper enclosure of a dangerous dog unless
muzzled and restrained by a substantial chain
or leash and under the control of a responsible
person. The muzzle shall be made in a manner
that will not cause injury to the dog nor inter-
fere with its vision or respiration but shall pre-
vent it from biting any person or animal.
3. The owner of a dangerous dog shall
secure liability insurance coverage or a surety
bond as required by Chapter 16.08 RCW.
4. The owner of a dangerous dog shall
be required to post the premises with a clearly
visible warning sign that there is a dangerous
dog on the property. In addition, the owner
shall conspicuously display a sign with a warn-
ing symbol that informs children of the pres-
ence of a dangerous dog.
5.05.123
G. Failure to Comply with Dangerous Dog
Requirements. Any dangerous dog shall be
seized and removed by animal control officer
if:
1. The dog is not validly registered
under this chapter and Chapter 16.08 RCW;
2. The owner does not secure liability
insurance coverage or a surety bond as
required by Chapter 16.08 RCW;
3. The dog is not maintained in a proper
enclosure;
4. The dog is outside of the dwelling of
the owner or outside of a proper enclosure and
not muzzled and restrained by a substantial
chain or leash and under the control of a
responsible person; or
5. The owner has failed to post the prop-
erty with warning signs as required.
H. Penalty. Failing to comply with any dan-
gerous dog requirement is a gross misde-
meanor. A dangerous dog seized and removed
in violation of dangerous dog requirements
shall not be released during investigation of or
prosecution for failure to comply with danger-
ous dog requirements. Any person convicted
of failing to comply with dangerous dog
requirements shall make restitution to the city
of Edmonds for all costs incurred in boarding
and disposition of such dog and shall forfeit
any interest in such dog.
I. The provisions of this section shall not
apply to dogs used by law enforcement offi-
cials for police work. [Ord. 3451 § 1, 2003].
5.05.123 Appeal.
A. Filing. A notice of appeal, substantially
in the form prescribed, shall be filed with the
Edmonds municipal court and the chief of
police not more than five business days after
service of the order to abate a nuisance, poten-
tially dangerous dog declaration, or dangerous
dog declaration. Failure to timely file a notice
of appeal shall constitute a waiver of the right
to appeal the determination of the order to
abate a nuisance, potentially dangerous dog
declaration, or declaration of dangerous dog.

5.05.124
B. Form. An appeal pursuant to this chapter
shall be written and shall conform substan-
tially to the following requirements:
1. A caption reading: "Appeal of
giving the names of all appellants participating
in the appeal;
2. A brief statement setting forth the
legal interest of each of the appellants involved
in the notice and order;
3. A brief statement in concise language
of the specific order or action protested,
together with any material facts claimed to
support the contentions of the appellant;
4. A brief statement in concise language
of the relief sought, and the reasons why it is
claimed the protested order or action should be
reversed, modified or otherwise set aside;
5. Signatures of all parties named as
appellants, and their official mailing
addresses; and
6. Certification (by signature of the
appellant) that the appellant has read the
appeal, and that to the best of the appellant's
knowledge, information, and belief, the appeal
is well grounded in fact.
C. Scheduling of Hearing. Upon receipt of
a timely filed notice of appeal, a hearing shall
be scheduled not more than 60 days from the
date of the filing of the notice of appeal. Writ-
ten notice of the date of the hearing shall be
sent to the appellants at least 10 days prior to
the scheduled hearing date. The failure of the
appellant to appear at the hearing shall result in
a denial of the appeal and upholding of the
order to abate a nuisance, potentially danger-
ous dog declaration, or declaration of danger-
ous dog.
D. Enforcement Stayed During Pendency
of Appeal. Unless otherwise determined by the
judge of the Edmonds municipal court,
enforcement of the order to abate a nuisance or
declaration of dangerous dog shall be stayed
during the pendency of the appeal.
E. Presentation of Evidence. At the appeal
hearing, the judge shall take evidence relevant
to the order to abate a nuisance, potentially

dangerous dog declaration, or dangerous dog
declaration. Testimony may be provided in the
form of a signed written statement pursuant to
RCW 9A.72.085.
F. Decision of the Court. The judge of the
Edmonds municipal court may uphold, dis-
miss, or modify the order to abate a nuisance,
potentially dangerous dog declaration, or dec-
laration of dangerous dog. A written order
shall be prepared and signed by the judge. The
decision of the judge of the Edmonds munici-
pal court shall be a final administrative deci-
sion appealable to the Snohomish County
superior court within 30 days of the final writ-

2003].
5.05.124 Disposition of seized and
removed animals — Bond
requirements.
Any owner whose domestic animal is seized
and removed pursuant to ECC 5.05.128 (Ani-
mal cruelty) or ECC 5.05.122 (Dangerous
dogs) shall, upon a finding of probable cause
by the Edmonds municipal court, be required
to post a bond or security within five days of
such probable cause finding in an amount suf-
ficient to provide for the animal's care for a
minimum of 60 days from the seizure date.
Failure to post such bond or security shall
authorize the city of Edmonds or its agent to
euthanize the animal or find a responsible per-
son to adopt the animal. The city of Edmonds
may euthanize severely injured, diseased, or
suffering animals at any time. [Ord. 3451 § 1,
2003].
5.05.126 Impound procedures.
A. Authority. The animal control authority
and its authorized representatives are author-
ized to apprehend and impound any animals in
violation of this chapter.
B. Notice of Impound. When any licensed
animal is impounded, the officer or department
impounding such animal shall notify the
owner of the impoundment and the reason

therefor by mail, telephone or by leaving writ-
ten notice at the address contained in the
license application. It shall be the owner's
responsibility to take such measures for
redeeming such animal. Neither the city nor
any officer or agent of the city shall be legally
or financially responsible for failing to notify
an animal owner under this chapter.
C. Redemption of Animals by Owner.
Unless otherwise provided in this chapter, the
owner of an impounded animal may redeem
the animal at any time prior to the release for
adoption or disposal by the city and shall be
entitled to the possession thereof upon pay -

6.65.010 Creation — Purpose.
The Edmonds fire department has been cre-
ated in order to provide fire protection services
and emergency medical services, as well as
disaster preparation and coordination in accor-
dance with Chapter 6.60 ECC and to otherwise
protect life and property and promote the
health, safety and welfare of the general pub-
lic. No provision of these ordinances and noth-
ing in the creation of the Edmonds fire
department shall be interpreted to create or
otherwise establish any particular class or
group of persons who will or would be espe-
cially protected or benefited by the creation of
said fire department by the provision of ser-
vices by its members or by the budgeting of
services by the annual budget ordinance. [Ord.

6.65.020 Extension to contract services.
The statement and limitations contained in
ECC 6.65.010 shall extend to contract services
provided by the city in lieu of its fire depart-
ment through any interlocal agreement or
other arrangement approved by the Edmonds

6.80.010 Definitions.
A. "Checkout bag" means a bag that is pro-
vided by a retail establishment at the check
stand, cash register, point of sale or other point
of departure for the purpose of transporting
food or merchandise out of the establishment.
Checkout bags do not include bags provided
solely for produce, bulk food or meat at a pro-
duce, bulk food or meat department within a
grocery store, supermarket, produce or meat
market, or other similar retail establishment, or
bags provided to carry out food cooked or pre-
pared at a restaurant or other similar food and
beverage establishment.
B. "Recyclable paper bag" or "recyclable
paper checkout bag" means a paper bag that
meets all of the following requirements: (1)
contains no old growth fiber, (2) is 100 percent
recyclable overall and contains a minimum of
40 percent post -consumer recycled content,
and (3) displays the word "Recyclable" on the
outside of the bag.
C. "Retail establishment" means any com-
mercial business facility engaged in the sale of
goods to consumers for ultimate consumption.
D. "Reusable bag" means a bag with han-
dles that is specifically designed and manufac-
tured for multiple reuse and is either (1) made
of cloth or other machine -washable fabric,
and/or (2) made of durable plastic that is at
least 2.25 mils thick and is suitable for reuse.

E. "Single -use plastic checkout bag" means
any checkout bag made from plastic, exclud-
ing reusable bags. [Ord. 3749 § 1, 2009].
6.80.020 Types of checkout bags
permitted at retail
establishments.
A. All retail establishments within the city
of Edmonds shall provide only the following
as checkout bags to customers: reusable bags
and/or recyclable paper bags.
B. Nothing in this chapter shall be read to
preclude retail establishments from making
reusable bags available for sale to customers.
C. The city of Edmonds shall work with
retailers, retail associations, unions and other
organizations to create educational elements
about the benefits of reusable bags. This may
include signage at store locations, informa-
tional literature, and employee training and
will take place before and after the operative
date. All retail establishments are strongly
encouraged to educate their staff to promote
reusable bags as the best option for checkout
bags and to post signs encouraging customers
to use reusable bags. [Ord. 3749 § 1, 20091.
6.80.040 Operative date.
All retail establishments shall comply with
the requirements of this chapter by the first
anniversary of the effective date of the ordi-
nance codified in this chapter, which is August
27, 2009. The purpose of this one-year imple-
mentation period is to (A) allow time for
affected retailers to prepare for and adapt to the
provisions of this chapter; (B) allow time for
the educational program to take effect and
encourage the use of reusable bags; and (C)
enable the city council to work with members
of the community and affected parties to eval-
uate alternatives or modifications needed to
address issues regarding provisions or imple-
mentation of this chapter. [Ord. 3749 § 1,
2009].

ECDC 18.10.010 shall, upon connection to the
sewer system, pay the above established spe-
cial connection fee, increased based upon the
Department of Labor Bureau of Labor Statis-
tics Consumer Price Index for construction for
the Seattle -Bellevue -Everett area from the
effective date of the ordinance codified in this
section to the time of connection to the sewer
system.
C. Olympic View Drive Sewer Special
Connection Districts.
1. Properties legally described,
addressed and identified on the attached
Exhibit A (maintained on file in the city clerk's
office) as 7101, 7109, 7115, 7327, and 7333
Olympic View Drive, and 7530 184th Place

18.10.010 and ECC 7.30.040, defer connec-
tion to the same.
The owner of a property that defers con-
nection shall pay, upon initial connection to
the public sewer manhole and stub pipe, the
above established special connection fee,
increased by a cumulative multiple, to the
extent permitted under RCW 35.92.025, equal
to the Department of Labor Bureau of Labor
Statistics Consumer Price Index for construc-
tion for the Seattle -Bellevue -Everett area from
the expiration of the time limits to connect set
forth in ECDC 18.10.010 to the time of con-
nection; provided, that if the property with
deferred connection was undeveloped when
the public sewer manhole and stub pipe were
declared operational by the city, its owner shall

7.30.040 Utility charges — Sanitary sewer.
The utility charges for sanitary sewer service
set forth in this section shall be added to and
made a part of the bimonthly or monthly rates
for water supplied through the meters as set
forth in ECC 7.30.030:

B. For customers who are not served by city
waterlines but who are connected to city sew-
ers, the charges shall be the same as set forth in
subsection A of this section and its subpara-
graphs.
C. These rates do not apply to industries or
manufacturing concerns which have industrial
wastes. These, together with other activities
not covered in this chapter, shall be dealt with
on a special basis and have special rates set for
the particular business by the water/utility
administrative staff, subject to review and
approval by the city council.
D. All property owners within an area
served by a sanitary sewer system in the city of
Edmonds are hereby directed and compelled to
connect their private drains and sewers to the
Edmonds City Code
city system. Failure to do so within 30 days of
written notice to connect by the city shall sub-
ject the property owner to a monthly penalty
equal to that charge imposed by subsections A,
B, and/or C above. Said penalty shall be billed
to the property owner, and they shall be subject
to payment, collection and enforcement in all
respects as though they were utility customers
of the city. All penalties collected shall be con-
sidered revenues of the sewer utility system.

7.30.045 Special connection charge.
In addition to any other charges prescribed
by this chapter, a special connection charge
shall be paid by the owner of any property, res-
idential dwelling unit, or other structure that
may hereafter connect to the sanitary sewer
improvements constructed by any local
improvement district formed by the city and
for which no assessment was imposed or
charged under the said LID. The special con-
nection charge for each property, residential
dwelling unit, or other structure so connected
shall be equal to the amount of the assessment
that would have been levied against such prop-
erty, residential dwelling unit, or structure
under the final assessment roll of the appropri-
ate LID if the said property, residential dwell-
ing unit, or other structure had been so
assessed, together with interest thereon at the
rate established by the ordinance authorizing
issuance of the bonds for said LID, from the
time of such authorization until the time of
connection. The special connection charge
shall be paid in a lump sum prior to connection
to the sanitary sewer. The special connection
charge provided for in this section shall apply
7.30.050
only where the debt used to finance the local
improvements has not yet been fully retired
through assessment payments. If such debt has
been fully retired through payment of such
assessments, the special connection charge

7.30.050 Unauthorized use of water.
It is unlawful for any person, firm, corpora-
tion, or other organization of any type whatso-
ever to take, or allow to be taken, water from
the Edmonds water system without a valid per -
