to said account. B. Expenditures from Account `B" shall be made only upon duly approved vouchers of the city for the purposes hereinbefore ascribed to said account. [Ord. 1111 § 10, 1965]. 3.05.110 Retention of monies. All monies in the equipment rental fund shall be retained there from year to year and shall not be transferred to any other fund or expended for any other purpose. However, due to the outsourcing of the city's fire services in January 2010, all monies associated with equipment and vehicles owned by the former city of Edmonds fire department may be trans- ferred to other funds at the discretion of the city council. There is hereby created and established a special fund to be known as the "drug enforce- ment fund" into which (1) all monies and pro- ceeds from the sale of property seized during drug investigations and forfeited pursuant to RCW 69.50.505 and all other applicable state and federal laws; and (2) all monies received by the city pursuant to a court order prescrib- ing that such monies be used for drug enforce- ment shall be deposited after amounts are deducted in accordance with state and federal laws. [Ord. 2739 § 2, 1989]. 3.08.020 Purposes — Expenditures. This fund has been established for the pur- pose of accumulating funds for drug enforce- ment needs, drug awareness educational purposes and the purchase, lease and mainte- nance of equipment and other items necessary for drug enforcement by the Edmonds police department. The monies deposited in the drug enforcement fund shall be expended only for such purposes and for no other purpose when appropriated by the city council. 3.08.030 Unexpended funds. Any unexpended funds remaining in the drug enforcement fund at the end of any bud- get year shall not be transferred to the general fund or otherwise lapse, rather said unex- pended funds shall be carried forward from year to year until expended for the purposes set forth in ECC 3.08.020. The administrative services director is hereby authorized to create and number a new fund to be known as the parks trust fund for the purpose of receiving donations from the city's citizens for, or in aid of, the cost of operating, maintaining and improving the city's parks and other related beautification, aquatic, and environmental protection programs such as the city's flower program, the Beach Ranger pro- gram and the Yost Pool. This fund is created and shall be maintained to the end that such donations shall be fully tax deductible and in accordance with the laws of the United States and the regulations of the Internal Revenue Service. [Ord. 3466 § 1, 2003]. 3.16.020 Administration of the fund. The council shall utilize the interest earned by the fund in accord with the donors' wishes for the flower beautification, aquatics, envi- ronmental protection and other parks related programs, within the powers granted by law. The council shall use its best efforts not to invade the principal of the fund. In the event that the principal of the fund is invaded, the council shall utilize the principal for the costs of operating, maintaining and improving the flower beautification, aquatics, environmental protection and other parks related programs. [Ord. 1918 § 3, 1977]. 4.11.030 Records to be kept. A. Every motor vehicle wrecker shall main- tain books or files in which he shall keep a record and a description of every vehicle wrecked, dismantled, disassembled or substan- tially altered by him, together with the name of the person, firm or corporation from whom he purchased the vehicle. Such record shall also contain: 1. The certificate of title number (if pre- viously titled in this or any other state); 2. Name of state where last registered; 3. Number of the last license number plate issued; 4. Name of vehicle; 5. Motor or identification number and serial number of the vehicle; 6. Date purchased; 7. Disposition of the motor and chassis, and such other information as the department may require. B. A motor vehicle wrecker shall also main- tain a similar record of all disabled vehicles that have been towed or transported to the motor vehicle wrecker's place of business or his representative. This record shall specify the name and description of the vehicle, name of the owner, number of license plate, condition of the vehicle, the place where it was picked up and the place to which it was towed or trans- ported. C. The abovementioned records and those records required by the department to be kept by a motor vehicle wrecker shall be subject to inspection at all times by members of the police department, sheriff's office and mem- bers of the Washington State Patrol. [Ord. 1918 § 4, 1977]. 4.11.060 4.11.040 Improper practices. A. No motor vehicle wrecker shall know- ingly buy, sell, receive, dispose of, conceal or have in his possession any motor vehicle or integral part thereof whose manufacturer's serial number or other identification mark has been removed, defaced, covered, altered or destroyed such that it would facilitate conceal- ing or misrepresenting the identity of such motor vehicle or trailer. B. No motor vehicle wrecker shall offer for sale or sell used parts unless he has complied with all the provisions of this chapter. C. No motor vehicle wrecker shall acquire a motor vehicle without first obtaining a certif- icate of title if the vehicle has been last regis- tered in a state which issued a certificate, or a record of registration if registered in a state which does not issue a certificate of title. [Ord. 1918 § 5, 1977]. 4.11.050 Location and appearance of place of business. No motor vehicle wrecker shall keep any motor vehicle or integral part thereof in any place other than the established place of busi- ness designated in the license issued by the department, without permission of the depart- ment. The activities of a motor vehicle wrecker shall be conducted entirely within his estab- lished place of business and such premises shall be enclosed by a wall or fence six feet high which will obscure from public view the nature of the business conducted on the pre- mises; provided, such wall or fence shall be kept in good repair. A living hedge of suffi- cient density and of equal height to prevent view of the confined area may be substituted for the wall or fence. [Ord. 1918 § 6, 1977]. 4.11.060 Penalties. Any motor vehicle wrecker who fails, neglects or refuses to comply with any of the provisions of this chapter shall upon conviction be punished by a fine or imprisonment as set forth in ECC 5.50.020. If any section, subsection, clause, phrase, or word of this chapter or any provision adopted by reference herein is for any reason held to be invalid or unconstitutional by a court of com- petent jurisdiction, such invalidity or unconsti- tutionality shall not affect the validity or constitutionality of the remaining portions of this chapter. A. "Solicitor" or "peddler" means any per- son who shall sell, offer for or expose for sale, or who shall trade, deal or traffic in any goods or services in the city by going from house to house or from place to place or by indiscrimi- nately approaching individuals. 1. Sales by sample or for future delivery, and executory contracts of sale by solicitors or peddlers are included; provided, however, that this section shall not be deemed applicable to any salesman or canvasser who solicits trade from wholesale or retail dealers in the city. 2. Any person who, while selling or offering for sale any goods, services or any- thing of value, stands in a doorway, any unen- closed vacant lot, parcel of land, or in any other place not used by such person as a per- manent place of business shall be deemed a solicitor or peddler within the meaning of this chapter, except as noted in subsection (B) of this section. Edmonds City Code B. "Street vendor" means any person who shall sell food, flowers, nonalcoholic bever- ages only, and/or other goods or services from either a motorized or nonmotorized mobile vending unit. C. "Motorized mobile vending unit" means a truck, van or other motorized vehicle that incorporates a kitchen or other food prepara- tion area from which prepared or prepackaged food may be sold. D. "Nonmotorized mobile vending unit" means a cart, kiosk or other device capable of being pushed by one person, with at least two functional wheels and positive wheel -locking devices. [Ord. 3902 § 1 (Att. A); Ord. 3513 § 1, 2004; Ord. 2536 § 1, 1985; Ord. 830 § 1, 1960]. 4.12.020 License required. A. It shall be unlawful for any person to act as solicitor, peddler or street vendor within the meaning and application of this chapter unless that person or his/her employer shall have first secured a license in the manner provided in this chapter. 1. Any person who shall sell, deliver or peddle any dairy product, meat, poultry, eel, fish, mollusk, or shellfish must first obtain a license pursuant to this chapter. 2. No licenses shall be issued or main- tained for the sale of poultry or poultry prod- ucts or meat or meat products which are adulterated or distributed under unsanitary conditions. 3. No licenses shall be issued for the sale of shellfish unless the vendor can produce a certificate of compliance as required by RCW 69.30.020. B. All persons acting as a solicitor, peddler or street vendor shall comply with all laws, ordinances and regulations, including all Sno- homish County health department require- ments. C. All solicitors, peddlers or street vendors must report any sales made within the city of Edmonds to the Department of Revenue as 4.12.030 sales that have occurred within the city. [Ord. 3902 § 1 (Att. A); Ord. 3513 § 2, 2004; Ord. 2990 § 1, 1994; Ord. 2536 § 1, 1985; Ord. 830 § 2, 1960]. 4.12.030 License fees. The license fees for solicitors, peddlers or street vendors shall be as follows: A. Investigation Fee. New applications for a solicitor, peddler or street vendor license shall be accompanied by a nonrefundable investigation fee of $10.00. Except as pro- vided in subsection (B) of this section, this investigation fee shall be tendered only with the initial application of any individual. B. Annual Fee. On January 1 st of each year all solicitor, peddler and street vendor licenses shall automatically expire and be null and void unless an annual fee of $25.00 is paid to the city clerk; provided, however, for licenses issued after June 30th of any year, only one- half of the annual fee shall be required. Any license renewed after June 30th of any year shall be treated as a new application and sub- ject to the investigation fee. For each mobile vending unit, there shall also be an annual fee of $200.00. Associated solicitors, peddlers and street vendors, and mobile vending units oper- ated as an adjunct to an existing licensed busi- ness shall pay any fee(s) set forth in subsection (C) of this section. C. Associated Solicitor, Peddler and Street Vendor, and Associated Mobile Vendor Fee. An annual fee of $8.00 per year per person or unit shall be paid by the following person or unit(s) licensed: 1. For each additional person soliciting, peddling or vending under a principal appli- cant's license issued pursuant to subsection (B) of this section; and/or 2. For each mobile vending unit oper- ated as an adjunct to an existing licensed busi- ness on a site immediately adjacent to the business and authorized for use pursuant to a street use permit. 4-7 (Revised 2/13) 4.12.040 The fees provided for by this section shall not be reduced after June 30th as provided for annual fees in subsection (B) of this section. D. Exemptions. The following persons shall be exempt from license fees and applica- tions required under this chapter: 1. Newspaper carriers; 2. Charitable, religious or nonprofit organizations or corporations which have received tax exempt status under 26 USC Sec- tion 501(c)(3) or other similar civic, charitable or nonprofit organizations; 3. Peddlers of fruits, vegetables, berries, eggs or any farm produce edibles raised, gath- ered, produced or manufactured by such per- son; 4. A person who, after having been spe- cifically requested by another to do so, calls upon that other person for the purpose of dis- playing goods, literature or giving information about any article, thing, product or service; 5. Notwithstanding the exemptions pro- vided herein, all exempt persons must provide proof of their exempt status along with photo identification upon request by a prospective customer or law enforcement officer; 6. Exempt persons are exempt only from city business licensing requirements and must comply with all provisions of law, ordinances and regulations and all applicable Snohomish County health district requirements. Any person, firm or other organization desiring to secure a solicitor's, peddler's or street vendor's license shall apply therefor in writing to the city clerk, on forms provided by the city, and such application shall set forth as to each solicitor, peddler or street vendor as the principal applicant as follows: (Revised 2/13) 4-8 1. The name, address and telephone number of the principal applicant, firm or other organization; 2. In the event the name or address of the applicant has changed within the last two years, each name and address over the last two-year period preceding the most recent; 3. The nature or character of the goods, wares, merchandise or services to be offered by each principal applicant; 4. A list of the persons originally con- templating solicitation, peddling or street vending within the city of Edmonds, and the information required in subsection (B) of this section as to each; 5. The name, address and telephone number (business and home) of the individual acting as manager of the principal applicant; 6. Written approval for the vending site from the abutting property owner and/or tenant in accordance with ECC 4.12.055(L); and 7. Such other information as reasonably required by city officials. B. For each person soliciting, peddling or street vending within the city of Edmonds pur- suant to a principal applicant and license as required herein, whether acting as an employee, independent contractor, or other- wise, the following information shall be pro- vided to the city clerk on forms provided by the city and shall set forth as to each such per- son the following: 1. His or her name, address and home telephone number; 2. The name, address and telephone number of the person, firm or other organiza- tion holding the principal license; 3. His or her age and general personal description as required by the city; 4. Any and all facts relating to any con- viction of crimes as such information may be required by the city in the application form; and 5. Such other information as reasonably required by city officials. Edmonds City Code C. The city clerk shall refer the application to the chief of police, who shall make a crimi- nal history background investigation of the applicant. Upon completion, the chief of police shall forward the results of the investi- gation to the city clerk. D. If, as a result of the investigation, the applicant is not found to have committed any of the acts requiring denial as listed below, the city clerk shall, upon payment of the pre- scribed fee, issue the license to the applicant. The city clerk shall deny the applicant the license if the applicant has: 1. Committed any act consisting of fraud or misrepresentation; 2. Committed any act which, if commit- ted by a licensee, would be grounds for sus- pension or revocation of a license; 3. Within the previous 10 years, been convicted of a misdemeanor or felony directly relating to his or her fitness to engage in the occupation of peddler, solicitor or street ven- dor and including, but not limited to, those misdemeanors and felonies involving moral turpitude, fraud or misrepresentation; 4. Been charged with a misdemeanor or felony of the type defined in subsection (D)(3) of this section, and disposition of that charge is still pending; 5. Been refused a license under the pro- visions of this chapter; provided, however, that any applicant denied a license under the provi- sions of this chapter may reapply if and when the reasons for denial no longer exist; and 6. Made any false or misleading state- ments in the application. E. Every peddler shall be required to carry the peddler's license and display it along with photo identification upon request by a pro- spective customer or law enforcement officer. F. The city clerk is authorized to promul- gate rules regarding the manner and method of payment, including a prohibition or regulation of payment by check, and the form of the application. It shall be the duty of the chief of police to investigate each applicant made under ECC 4.12.040, in which investigation the chief of police shall determine: A. The genuineness of all credentials pre- sented by the applicant and/or the individual solicitor, peddler or street vendor and the reli- ability of the product or services; B. If the applicant and/or its solicitor, ped- dler or street vendor has a criminal record; C. The truth of the facts set forth in the application; and D. If the applicant or solicitor, peddler or street vendor proposes to engage in a lawful and legitimate commercial or professional enterprise. Such investigation must be completed within a reasonable time. [Ord. 3902 § I (Att. A); Ord. 2536 § 1, 1985; Ord. 830 § 5, 1960]. 4.12.055 Street vendor requirements. Any person seeking a permit for a street vendor license under the definition of this chapter shall comply with the following requirements: A. Mobile vending units may be allowed to operate within the following commercially zoned areas including unzoned property or right-of-way adjacent to or abutting commer- cially zoned areas: 1. Motorized and nonmotorized mobile vending units: neighborhood business (BN), community business (BC), planned business (BP), downtown business zones (BDI, BD2, BD3, BD4 and BD5), commercial waterfront (CW), general commercial (CG, CG2), Firdale Village mixed-use (FVMU), medical use (MU) and public use (P). B. In addition to the licensing requirements of this chapter, any street vendor shall be required to obtain a street use permit. Applica- 4-9 (Revised 2/13) 4.12.055 tion fees for street use permits are those estab- lished by the city council by resolution in its sole legislative discretion. Application fees shall be paid to the city prior to issuance of any permit. C. All advertising shall be placed on the nonmotorized mobile vending unit and will not be allowed on the street or sidewalk. Max- imum sign area allowed shall be 10 square feet. D. The vending site shall be kept clean and orderly at all times, and the vendor must pro- vide a refuse container and is encouraged to provide containers for recycling. No portion of a vendor's inventory, sales equipment, or any other structure or equipment used in the sales or solicitation process shall be left overnight upon any unenclosed portion of any lot or site within the city, nor upon any public street or right-of-way. E. The city reserves the right to limit the number of vending permit sites in any given area of the city. When the number of permitted mobile vendors reaches 15, a review before the city council is triggered to determine if the number of mobile vendors should be limited. The city council review may consider the needs of the public, diversity of products offered for sale, the smooth flow of pedestrian and vehicular traffic, number of complaints, and locations where the vending units are located. F. If located on a sidewalk, a minimum clearance of five feet shall be maintained by any street vendor. G. Street vendors shall not locate within that portion of improved street right-of-way designed for vehicular traffic or parking. Street vendors seeking to locate in improved street rights-of-way or on sidewalks shall be oriented toward pedestrian traffic movement or safety. Any application to locate a street vendor in the street right-of-way shall require approval by the city traffic engineer and shall not interfere in any way with vehicular or pedestrian traffic or safety. (Revised 2/13) 4-10 H. No mechanical audio or noise making devices and no hawking is allowed. Hawking is the loud, repeated oral solicitation of busi- ness by the vendor or an assistant. I. Street vendors may operate in parks if they have a concession agreement with the city of Edmonds to operate on a specific park prop- erty. J. Street vendors are prohibited in residen- tially zoned areas, and unzoned property or right-of-way adjacent to or abutting the resi- dentially zoned areas. K. All street vendors shall comply with all applicable Snohomish County health district requirements. L. The applicant shall submit with his application a copy of the written approval for the vending site from the property owner when locating on private property. When locating on a sidewalk within the right-of-way, the appli- cant shall have written approval for the vend- ing site from the abutting property owner and/or tenant. In the event that the property owner or tenant shall disagree, the property owner's decision shall be final. 1. In the event that the proposed site is on or abuts property owned by the city of Edmonds, the applicant shall be required to obtain the city's approval. Approvals relating to park property shall be handled as a request to let a concession under the terms of this chapter. Request for sites abutting all other public land owned by the city shall be for- warded to the city council for their review and approval. 2. In the event that the proposed site is on or abuts publicly owned property not owned by the city of Edmonds, the applicant shall be required to obtain approval from the public entity that owns the property. 3. In the event that the site for which approval is sought abuts vacant land, the appli- cant shall make reasonable written attempts to secure the approval of the property owner. If the applicant is unable to do so, the city may accept written proof of such attempts and issue Edmonds City Code a conditional permit. If a complaint is later received from the owner of the land, the license shall be revoked. The granting of such a conditional license shall vest no right in the applicant. M. When locating within a parking lot of a private location, the applicant shall: 1. Identify the location the mobile vend- ing unit will be located and provide a circula- tion plan. The location and circulation plan shall require approval by the city traffic engi- neer to ensure the vending unit will not inter- fere in any way with vehicular or pedestrian traffic or safety. 2. Demonstrate that the site will meet the parking requirements of Chapter 17.50 ECDC excluding the parking space(s) occu- pied by the mobile vending unit. N. The maximum permissible size for any nonmotorized mobile vending unit shall be: 1. Thirty square feet for sidewalk loca- tions; and 2. Fifty square feet for locations within the street or other public right-of-way or when located on private property. 3. In no event shall any nonmotorized mobile vending unit exceed 10 feet in length. O. During special events held within the city where food providers are required to pay a fee to participate (such as the Edmonds Art Festival and Taste of Edmonds), no mobile vending units may be allowed to operate within one-quarter mile of the special event. The chief of police shall determine, within a reasonable time, from his investigation, that the facts set forth in the application are true, that the purpose of the applicant and its solici- tors, peddlers or street vendors is to engage in a lawful and legitimate commercial or profes- sional enterprise. 4.12.065 Having determined these facts, he shall then approve the application and the city clerk may issue the license applied for. Such license shall expire on the thirty-first day of December of the year in which such license has been issued. Except as hereinafter provided, no license shall be issued until the conclusion of the aforesaid investigation. [Ord. 3902 § 1 (Att. A); Ord. 2536 § 1, 1985; Ord. 830 § 6, 1960]. 4.12.065 Soliciting and peddling restrictions. All licenses issued pursuant to this chapter shall be subject to the following time and loca- tion restrictions: A. Fourth of July Fireworks Display. For the purpose of crowd and traffic control on the Fourth of July, all soliciting after 6:00 p.m. within one mile of the official fireworks dis- play shall take place only within the confines of the fireworks viewing area as designated by the chief.of police on the Civic Center play - field. B. No peddler or solicitor shall engage or attempt to engage in the business of peddling at any home, residence, apartment complex or business that prominently displays a "No Ped- dlers" or "No Solicitors" sign or any other sim- ilar sign that communicates the occupants' desire to not be contacted by peddlers. C. No peddler or solicitor shall engage in the business of peddling between the hours of 8:00 p.m. and 9:00 a.m. D. Motorized and nonmotorized mobile vending units which are located directly adja- cent to residentially zoned property may not operate between the hours of 9:00 p.m. and 8:00 a.m. Motorized and nonmotorized mobile vending units not located directly adjacent to residentially zoned property may not operate between the hours of 11:00 p.m. and 6:00 a.m. [Ord. 3902 § 1 (Att. Such license shall be carried at all times by each solicitor, peddler or street vendor for whom issued, when soliciting, canvassing or street vending in the city of Edmonds, and shall be exhibited by any such solicitor, ped- dler or street vendor whenever and wherever he or she shall be requested to do so by any police officer or any person solicited. [Ord. 3902 § 1 (Att. A); Ord. 2536 § 1, 1985; Ord. 830 § 7, 19603. 4.12.080 Revocation of license. Such license may be revoked by the city of Edmonds for the violation by either the employer or the solicitor, peddler or street ven- dor of any of the ordinances of the city of Edmonds. The city of Edmonds may also revoke a license for a street vendor under the following conditions: A. Failure to comply with the terms of this chapter; B. Misrepresentation of facts in the licensee's application for the necessary per- mits; C. Failure to comply with the terms of a valid street use permit; D. Creation of a hazard to the public health or safety; or E. As otherwise provided herein. [Ord. 3902 § 1 (Att. A); Ord. 2536 § 1, 1985; Ord. 830 § 8, 1960]. 4.12.085 Appeal procedure. A. Whenever the city clerk determines that there is cause for denying any license applica- tion or revoking any license issued pursuant to this chapter, the clerk shall notify the person holding the license using at least one of the fol- lowing methods: (1) registered or (2) certified mail, return receipt requested or (3) personal service on the licensee. Notice mailed to the address on the license shall be deemed received three days after mailing. The notice shall specify the grounds for the denial or revo- cation of a license. (Revised 2/13) 4-12 B. The applicant or licensee may appeal the decision of the city clerk to deny or revoke a license by filing a written notice of appeal to the city council within 48 hours of the city clerk's decision. C. Upon timely receipt of the notice of appeal, the city clerk shall set a date for hear- ing the appeal, which shall occur within 10 days of receipt of the appeal. The city clerk shall mail notice of the date of the hearing to the applicant or licensee at least five days prior to the hearing date. D. The hearing shall be de novo. The city council may affirm, reverse or modify the city clerk's decision. E. The decision of the city council shall be final. Any person desiring to appeal must file an appropriate action in Snohomish County superior court within 14 days of the city coun- cil's decision. [Ord. 3902 § 1 (Att. A); Ord. 2990 § 5, 1994]. 4.12.090 Purchase orders — Form and content. All orders taken by license solicitors, ped- dlers or street vendors shall be in writing, in duplicate, stating the name as it appears on the license, the address of both the solicitor, ped- dler or street vendor and his employer, the terms thereof, and the amount paid in advance, and one copy shall be given to the purchaser. Any person or persons who violate or fail to comply with any of the provisions of this chap- ter shall upon conviction of said violation be punished as provided in ECC 5.50.020. [Ord. 3902 § 1 (Att. A); Ord. 2536 § 1, 1985; Ord. 1619 § 3, 1972; Ord. 830 § 10, 1960]. 4.12.110 Severability. Should any section, clause or provision of this chapter be declared by the courts to be invalid, the same shall not affect the validity of Edmonds City Code the chapter as a whole, or any part thereof, other than the part declared to be invalid. A); Ord. 2536 § 1, 1985; Ord. 830 § 11, 19601. 4.20.010 Chapter 4.20 LIQUOR LICENSE — INVESTIGATIONS Sections: 4.20.010 Processing of notices of pending liquor licenses. 4.20.010 Processing of notices of pending liquor licenses. A. Upon receipt by the mayor of a notice of a pending application before the Liquor Con- trol Board of a liquor license within the city of Edmonds, the mayor shall make such investi- gations as he deems appropriate, including but not limited to city employees such as the police department, and at the first available council meeting state his recommendations as to objection or lack of objection against the appli- cant or the premises for which the license is asked. The city council, sitting in public meet- ing, shall thereupon vote upon the recommen- dation of the mayor and instruct the mayor to approve affirmatively or by acquiescence the recommendation of the city council to the Liquor Control Board. B. In the alternative, and in the event the council finds the application objectionable, it shall instruct the mayor to transmit to the Liquor Control Board the objections had by the council against the applicant or against the premises for which the license is asked, and shall include in such instructions the facts upon which such objections are based. In the event the council has found objection to the application it shall appoint one of its members so finding to make the oral argument in sup- port of such objections in the event the Liquor Control Board fixes a time for oral argument. C. In the event the city council may not have a public hearing scheduled within the 10 - day period following the transmittal of the notice from the Liquor Control Board, upon receipt of the notice from the Liquor Control Board the mayor shall immediately request an extension of the 10 -day period from the Liquor 4-12.1 (Revised 2/13) 4.20.010 Control Board to provide time for the council to register its approval or objections. In construing the provisions of this chapter, save when otherwise declared or clearly appar- ent from the context, the following definitions shall be applied: A. Person. The term "person" shall include one or more persons of either sex, corpora- tions, partnerships, associations, or other entity capable of having an action at law brought against such entity, but shall not include employees or persons licensed pursu- ant to this chapter. B. Business. The term "business" includes all services and activities engaged in with the object of pecuniary gain, benefit or advantage to the person, or to any other person or class, directly or indirectly, whether part-time or full-time, except those businesses or occupa- tions which are regulated pursuant to, or for which licenses or franchises are required by, the following chapters of the Edmonds City Code: 3.20 (Business License and Occupation Tax); 4.11 (Motor Vehicle Wreckers); 4.12 (Peddlers, Solicitors and Street Vendors); 4.20 (Liquor Licenses); 4.48 (Cabaret Dances); 4.72.020 4.50 (Licensing of Public Massage Parlors and Public Bathhouses); 4.56 (Sound Trucks); 4.60 (Taxicabs); 4.68 (Community Antenna Television Systems); 4.75 (Pawnbrokers); and except nonbusiness activities carried on by a religious, charitable, benevolent, fraternal or social organization. C. Rental Unit. The term "rental unit" shall mean a separate room or apartment leased for human occupancy and contained within a sin- gle structure, and shall include the operations of rooming houses, boarders within private residences and the operation of bed and break- fast establishments. D. Private Residence. The term "private residence" shall mean a separate, free-standing structure leased for residential purposes and human occupancy by one "family" as defined by ECDC 21.30.010. E. Day. The term "day" when used in this chapter shall refer to days on which the city of Edmonds City Hall is open for business. Any day which is defined as a holiday by ordinance and any day on which City Hall has been closed by executive order shall not constitute a "day." [Ord. 3900 § 2, 2012; Ord. 3834 § 3, 2011; Ord. 3439 § 1, 2003; Ord. 2562, 1986; Ord. 2536 § 2, 1985; Ord. 2315 § 1, 1982]. 4.72.020 Business license required. It shall be unlawful for any person to oper- ate, engage in or practice any business in the city of Edmonds without first having obtained a business license from the city. If more than one business is located on a single premises, a separate license shall be required for each sep- arate business conducted, operated, engaged in or practiced. [Ord. 3282 § 1, 1999; Ord. 1139 § 1, 1965]. 4-54.3 (Revised 2/13) 4.72.023 4.72.023 Registration of transient accommodations. Repealed by Ord. 3900. [Ord. 2566 § 1, 1986]. 4.72.030 Procedure. A. Application for the business license shall be made in writing to the city clerk upon a form provided by the city clerk, and the applicant shall at the same time deposit with the city clerk in advance the license fee herein required. The application shall state the nature and address or addresses of the business or businesses, or proposed business or busi- nesses, of the applicant, and such other infor- mation as requested by the city clerk. B. If the applicant be a partnership, the application must be made by one of the part- ners; if a corporation, by one of the officers thereof, if a foreign corporation, partnership or nonresident individual, by the resident agent or local manager of the corporation, partnership or individual. C. The city clerk shall present all applica- tions for licenses to the mayor. The mayor shall cause an investigation of the application to be made by the proper city officials and shall grant or refuse to grant the license within 15 days of the date of application. If an application is refused the reason for refusal shall be desig- nated on the application. The fee shall not be refunded. [Ord. 1139 § 1, 1965]. 4.72.040 Fee — Terms — Penalty. A. Commending January 1, 1977, business licenses required to be obtained pursuant to this chapter, shall be issued on a calendar year basis and shall expire on December 31 st of the year for which they are issued. B. Fees for an annual business license issued hereunder shall be as follows: 1. The fee for an application for a new business license for any business that is not a home occupation, as provided in Chapter 20.20 ECDC, to be operated from any real (Revised 2/13) 4-54.4 estate within the city of Edmonds shall be $125.00; 2. The fee for an application for a new business license for a new home occupation business, as provided in Chapter 20.20 ECDC, to be operated from any residential real estate within the city of Edmonds shall be $100.00; 3. The fee for an application for a new business license for any other business con- ducted for, under contract with or by providing services to any person within the city shall be $50.00; and 4. The fee for an application for an annual renewal of a business license shall be $50.00 for any business operated within the city of Edmonds. C. All businesses required to obtain licenses hereunder shall obtain the same and pay all fees required on or before February 15th of each respective year; provided, how- ever, that for the year 1981 only, businesses shall be required to obtain the licenses before April 1. Any business which fails to obtain and pay the license fees within said period of time shall, in addition to any other penalties pro- vided in this chapter, be assessed an amount equal to 50 percent of the license fee for said business as a penalty for such late application and/or payment. D. Repealed by Ord. 3036. [Ord. 3710 § 1, 2008; Ord. 3282 § 2, 1999; Ord. 3084 § 1, 1996; Ord. 3036 §§ 1, 2,1995; Ord. 2191 §§ 1, 2, 1981; Ord. 1828 § 1, 1976; Ord. 1139 § 1, 1965]. 4.72.050 Ineligible activities. Notwithstanding any provisions hereof to the contrary, a license hereunder may not be issued to any person who uses or occupies or proposes to use or occupy any real property or otherwise conducts or proposes to conduct any business in violation of the provisions of any ordinance of the city of Edmonds or the stat- utes of the state of Washington. The granting of a business license shall in no way be con - Edmonds City Code strued as permission or acquiescence in a pro- hibited activity or other violation of the law. [Ord. 1139 § 1, 1965]. 4.72.055 Denial of license — Hearing. In the event that a license is denied under this chapter based on the provisions of ECC 4.72.050, or for any other lawful reason, the applicant may request a hearing. Such request shall be in writing and filed within 10 days of the date of written denial by the city of a license application. A hearing shall be sched- uled within 30 days before the hearing exam- iner. The hearing shall proceed in the following format: A. The applicant/appellant shall present proof of the nature of the activities which it seeks to conduct pursuant to a business license in the city of Edmonds. B. The city shall have the burden of estab- lishing, by a preponderance of the evidence, that the activities are in violation of a provision of any ordinance of the city of Edmonds, or the general statutes of the state of Washington. C. The applicant/appellant may then pres- ent any rebuttal testimony which it wishes to present. The hearing examiner shall enter written findings of fact and conclusions of law. No motion for reconsideration shall be available to either party. Appeal of the final decision shall be to the Snohomish County superior court in accordance with the applicable laws of the state of Washington. [Ord. 3834 § 1, 2011]. 4.72.060 Revocation or suspension. The mayor or his designee may, at any time, suspend or revoke any license issued hereun- der whenever the licensee or officer or partner thereof has been convicted in any court of competent jurisdiction of violating any statute of the United States or the state of Washington or any ordinance of the city of Edmonds upon the business premises stated in the license or in connection with the business stated in the license; where the business activity violates 4.72.065 ECC 4.72.050; or where the place of business does not conform to the ordinances of the city of Edmonds. Prior to such suspension or revo- cation, the permittee shall be provided an opportunity for a hearing. The licensee shall be notified in writing by sending a written notice to the address stated on the license of the inten- tion of the city to revoke or suspend said license. The applicant may then appeal by fil- ing written notice with the city clerk within 10 days of the notice of revocation or suspension. The city clerk shall schedule a hearing within 20 days before the hearing examiner. The licensee may appear at that time and be heard in opposition to such revocation or suspension. Upon the sale or transfer of any business licensed by this chapter, the license issued to the prior owner or transferor shall automati- cally expire on the date of such sale or transfer 4-54.5 (Revised 2/13) This page left intentionally blank. Canidae, meaning and including any member of the dog family not customarily domesticated by man, or any hybrids thereof, but not including domestic dogs and wolf hybrids (cross between a wolf and a domestic dog). 2. Felidae, meaning and including any member of the cat family not customarily domesticated by man, or any hybrids thereof, but not including domestic cats. 3. Ursidae, meaning and including any member of the bear family, or any hybrids thereof. 4. Reptilia, meaning venomous and "devenomized" reptiles, including but not nec- essarily limited to all members of the follow- ing families: Helodermidae (gila monster), Viperidae (pit vipers), Crotalidae (rattle- snakes), Atractaspidae (mole vipers), Hydrophiidae (sea snakes), and Elapidae (coral snakes and cobras). 5. Colubridae snakes which are rear fanged, including, but not necessarily limited to dispholidus typus (boomslangs), thebtorms kirtlandii (African twig or vine snake), and rhabdophis (keelbacks). 6. Colubridae snakes which reach a length of 10 feet and over, including but not necessarily limited to green anaconda, reticu- lated pythons, Burmese python, albino Indian python, and African rock python. 7. Crocodilia, meaning and including crocodiles, alligators and caimans. L "Inhumane treatment" means every act or omission whereby unnecessary or unjustifi- able physical pain or suffering is caused or per- mitted. J. "Own" means owning, keeping, leasing, possessing or harboring any animal. "Owner" means any person having an interest or right of possession to an animal or any person having control, custody or possession of an animal or by reason of the animal being seen residing consistently at a location, shall be presumed to be the owner. 5.05.010 K. "Person" means any person, firm, cor- poration or association. L. "Pet" is a domestic animal owned and kept by an individual or family for enjoyment and pleasure rather than utility. The term "pet" includes all animals required to be licensed under the terms of this chapter when properly licensed. M. "Potentially dangerous dog" means: (1) any dog that when unprovoked: (a) inflicts a bite or bites on a human, pet or livestock either on public or private property; or (b) chases or approaches a person upon the streets, side- walks, or any other public grounds or private property in a menacing fashion or apparent attitude of attack; or (2) any dog with a known propensity, tendency, or disposition to attack unprovoked, to cause injury or otherwise to threaten the safety of humans, pets or livestock on any public or private property. N. "Poultry" means domestic fowl nor- mally raised for eggs or meat and includes, but is not limited to, chickens, turkeys, ducks, geese, pheasants, quail, guinea fowl, pea fowl and other similar domesticated birds. Nothing herein shall be interpreted to conflict with or eliminate any state wildlife licensing require- ment with relation to the keeping of any type of fowl. Large fowl over three feet in height or 30 pounds as mature adults, such as emus or ostriches, shall be considered "covered ani- mals" and regulated as such. O. "Proper enclosure of a dangerous dog" means, while on the owner's property, a dan- gerous dog shall be securely confined indoors or in a securely enclosed and locked pen or structure, suitable to prevent the entry of young children and designed to prevent the animal from escaping. Such pen or structure shall have secure sides and a secure top, and shall also provide protection from the elements for the dog. P. "Severe injury" means any physical injury that results in broken bones or disfigur- ing lacerations requiring multiple sutures or cosmetic surgery. 5-9 (Revised 2/13) 5.05.020 Q. "Vicious animal" means any animal other than a "dangerous dog" or "potentially dangerous dog" that endangers the safety of any person or domestic animal by biting or attacking without provocation. R. "Wild animal" means any animal living in its natural state and native to the United States and not normally domesticated, raised or bred by humans. [Ord. 3895 § 1, 2012; Ord. 3655 § 1, 2007; Ord. 3634 § 1, 2007; Ord. 3451 § 1, 20031. 5.05.020 Dog licensing. A. License Required. It is unlawful for any person to own any dog over the age of three months within the city unless the owner has first procured a license required by this chap- ter. B. Dogs Excluded from License Require- ments. The licensing provisions of this section shall not apply to the following dogs: 1. Dogs whose owners are nonresidents temporarily within the city; 2. Dogs brought into the city for the pur- pose of participating in any dog show; 3. Seeing -eye guide and service dogs properly trained to assist blind or impaired per- sons, when such dogs are actually being used by a blind or impaired person, for the purpose of aiding them from place to place. Blind or impaired persons include but are not necessar- ily limited to persons who are blind, deaf, have limited mobility, or have psychological impairment; or 4. Dogs whose owner maintains them for the sole purpose of commercial breeding and/or training, hunting, or boarding, so long as the dogs are restricted within a building or fenced enclosure intended and designed only for the purpose of kenneling dogs and are not permitted to run at large. C. License Tags Issued and Fees. The police department, or such other person, firm or entity authorized by the city council, shall issue a dog license upon the payment of a fee as provided for by this subsection. Upon issu- (Revised 2/13) 5-10 ance of a license, a metal tag corresponding to the number of the application shall be fur- nished to the applicant. 1. The applicant shall cause the same to be attached to the dog. Tags shall not be trans- ferable from one dog to another. 2. The following fees shall be paid for licenses required under this chapter: a. For spayed females or neutered males with a veterinarian certificate or signed affidavit: an annual license fee of $5.00; pro- vided, that a $3.00 fee shall be charged to per- sons over the age of 65; b. For dogs less than six months but over three months of age, temporary tags issued: a license fee of $5.00. Persons over the age of 65 shall receive a rebate of $2.00 at the time of relicensing, upon certification by a vet- erinarian that the dog has been spayed or neu- tered; c. Unspayed females and unneutered males over six months of age: $18.00; d. Replacement of metal tag: $1.00. 3. An owner of an animal previously licensed for which a "permanent" license has been issued under the provisions of this section as the same existed prior to December 16, 1986, shall not be required to relicense or renew said license for such animal. D. License Issuance — Nonresidents. Licenses shall be issued to nonresidents of the city of Edmonds who reside in proximity to the city and who desire to purchase an annual license for their dog for identification pur- poses. The annual fee shall be $10.00 per year per dog. Upon payment of said fee, a tag shall be issued which shall be consistent with the tags issued annually by the city of Edmonds for dogs required to be licensed under this chapter. The dogs permitted to be licensed by this section shall not be eligible for temporary licenses. Nothing in this chapter shall require the obtaining of such license nor shall failure to obtain such a license as provided by this sec- tion subject any dog owner to the penalties provided for in this section; provided further, Edmonds City Code 5.05.115 Nuisances defined. A. All violations of this chapter are detri- mental to the public health, safety and welfare and are declared to be public nuisances. B. Nuisances are hereby defined to include: 1. Any animal which chases, runs after or jumps at vehicles using public streets and alleys; 2. Any animal which habitually snaps, growls, snarls, jumps upon or otherwise threat- ens persons lawfully using the public side- walks, streets, alleys or other public ways; 3. Any animal which has exhibited vicious propensities and which constitutes a danger to the safety of persons or property off his premises or lawfully on his premises; 4. A vicious animal or animal with vicious propensities which runs at large at any time, or such an animal off the owner's prem- ises not securely leashed on a line or confined and in the control of a person of suitable age and discretion to control or restrain such ani- mal; 5. Any animal which howls, yelps, whines, barks or makes any noises in such a manner as to disturb any person or neighbor- hood to an unreasonable degree; 6. Animals kept, harbored or maintained and known to have a contagious disease, unless under the treatment of a licensed veter- inarian; 7. Animals running in packs; 8. Any dog running at large within the city; 9. A female animal, whether licensed or not, while in season, accessible to other ani- mals for purposes other than controlled and planned breeding; 10. Any animal which causes damage to property other than the property of the ani- mal's owner or person having physical charge and control of the animal; or 11. Any animal maintained in violation of any provision of this chapter. C. All nuisances under this chapter shall be abated as provided in this chapter. In addition, 5.05.120 any owner or person having charge of any ani- mal who fails to abate such nuisance shall be guilty of a misdemeanor with a maximum pen- alty of $1,000 fine and/or 90 days in jail. [Ord. 3451 § 1, 20031. 5.05.120 Nuisance — Notice and order to abate. A. Notice — When Required. Whenever it shall be stated in writing by an animal control officer or by three or more persons having sep- arate residences or regularly employed in any neighborhood that any animal is a nuisance as defined in ECC 5.05.115, the animal control authority shall serve a notice of violation and order of abatement upon the owner of the ani- mal directing that the nuisance be abated. B. Notice — Final Determination Unless Appealed. The service of a notice of violation and order of abatement shall, unless timely appealed, be a final determination that the ani- mal is a nuisance and such nuisance must be immediately abated. C. Notice — Contents. The notice of viola- tion and order to abate a nuisance shall con- tain: 1. The name and address, if known, of the owner or person having physical charge and control of the animal if the identity of the owner cannot be reasonably ascertained; 2. The license number, if available, and description of the animal; 3. A statement that the animal control authority has determined the animal to be a nuisance and a description of the nuisance activity; 4. A statement that the nuisance activity must be immediately abated; 5. A statement that service of the notice of violation and order of abatement is a final determination unless appealed and that an appeal must be filed within five days of service of the notice of violation and order of abate- ment; 6. A copy of ECC 5.05.123 regarding appeal procedures; 5-13 (Revised 2/13) 5.05.121 7. A copy of ECC 5.05.124 regarding disposition of seized and removed animals. D. Notice — Service. Service of the notice of violation and order of abatement upon the owner of the animal may be made either by personal service to the owner, by posting such notice at the residence of the owner or by cer- tified mail to the last known address of the owner. E. Appeal of Notice of Violation and Order of Abatement. An appeal of a notice of viola- tion and order of abatement must be served upon the city of Edmonds police chief within five days of service of the notice of violation and order of abatement. Appeals shall be heard by the judge of the Edmonds municipal court and conducted in accordance with ECC 5.05.123. F. Penalty. Any person who wilfully fails to comply with an order to abate a nuisance is guilty of a misdemeanor. [Ord. 3451 § 1, 2003]. 5.05.121 Potentially dangerous dogs. The provisions of this section apply to the extent they are not inconsistent with the provi- sions of Chapter 16.08 RCW. A. Declaration of a Dog as Potentially Dan- gerous. The animal control authority shall have the authority to declare a dog to be poten- tially dangerous, and place restrictions on such dog, if the animal control authority has proba- ble cause to believe that the dog falls within the definitions set forth in ECC 5.05.010(M). The declaration must be based upon: 1. The written complaint of a citizen who is willing to testify that the animal has acted in a manner which causes it to fall within the definition of ECC 5.05.010(M); 2. Animal bite report(s) filed with the animal control authority; 3. Action(s) of the animal witnessed by any employee of the animal control authority or law enforcement officer; or 4. Other substantial evidence. (Revised 2/13) 5-14 B. Exclusions. A dog shall not be declared potentially dangerous if the animal control authority determines, by a preponderance of the evidence, that the threat, injury, or bite alleged to have been committed by the dog was sustained by a person who was at the time committing a willful trespass or other tort upon the premises occupied by the owner of the dog, or who was tormenting, abusing, or assaulting the dog, or who had been in the past observed or reported to have tormented, abused, or assaulted the dog, or who was committing or attempting to commit a crime. C. Prohibited Ownership. No person(s) under the age(s) of 18 years old shall own a potentially dangerous dog, as defined in ECC 5.05.010(M.) D. Notice of Animal Control Authority Declaration. If the animal control authority receives a report of a potentially dangerous animal, it shall immediately initiate an investi- gation including, but not limited to, interview- ing the complainant(s), interviewing the owner of the animal, if known, and observing the ani- mal. Upon completion of its investigation, if the animal is declared potentially dangerous, the animal control authority shall prepare a written declaration. 1. The declaration shall be in writing and served on the owner in one of the follow- ing methods: a. Certified and regular mail to the owner's last known address; or b. Personally; or c. If the owner cannot be located by one of the first two methods, by publication in a newspaper of general circulation. 2. The declaration shall include, but is not limited to: a. A description of the dog; b. The name and address of the owner of the dog, if known; c. The whereabouts of the dog if not in custody of the owner; d. A brief summary of the facts upon which the declaration is based, if known, Edmonds City Code including the definition of potentially danger- ous under which the declaration is being made; e. A statement of any restrictions placed on the animal or owner as a result of the declaration; and f. The ability and process for appeal- ing the declaration by submitting a written request to the Edmonds municipal court clerk within five business days of receipt of the dec- laration. E. Appeal. Appeals shall be heard by the judge of the Edmonds municipal court and conducted in accordance with ECC 5.05.123. [Ord. 3895 § 1, 2012; Ord. 3786 § 1, 2010; Ord. 3451 § 1, 2003]. 5.05.122 Dangerous dogs. The provisions of this section apply to the extent they are not inconsistent with the provi- sions of Chapter 16.08 RCW. A. Declaration. Upon declaration by the animal control authority that a dog is a danger- ous dog as defined in ECC 5.05.010, the owner shall be served with a dangerous dog declara- tion. B. Declaration — Final Determination Unless Appealed. The service of a dangerous dog declaration shall, unless timely appealed, be a final determination that the dog is a dan- gerous dog. C. Notice — Contents of Dangerous Dog Declaration. A dangerous dog declaration shall contain: 1. The name and address, if known, of the owner of the animal; 2. The license number, if available, and description of the animal or dog; 3. A statement that the animal control authority has found the animal to be a danger- ous dog as defined in ECC 5.05.010 and a con- cise description explaining why the declara- tion has been made; 4. A statement that service of the dan- gerous dog declaration is a final determination unless appealed and that an appeal must be 5.05.122 filed within five days of service of the danger- ous dog declaration; 5. A copy of ECC 5.05.123 regarding appeal procedures; 6. A copy of ECC 5.05.124 regarding disposition of seized and removed animals. D. Notice — Service. Service of the danger- ous dog declaration upon the owner of the ani- mal may be made either by personal service to the owner, by posting such notice at the resi- dence of the owner or by certified mail to the last known address of the owner. E. Appeal. Appeals shall be heard by the judge of the Edmonds municipal court and conducted in accordance with ECC 5.05.123. F. Requirements for Dangerous Dogs. Strict compliance with each of the following conditions is required to keep a dangerous dog in the city of Edmonds: 1. In addition to any license required under the provisions of this chapter, all dog owners who are required to obtain a certificate of registration, pursuant to the dangerous dog provisions of Chapter 16.08 RCW, must obtain a city of Edmonds dangerous dog certif- icate of registration. The applicant shall apply for such certificate upon forms supplied by the city clerk and pay an annual fee of $100.00, which shall not be prorated for any part of a year. A copy of a valid certificate of registra- tion issued pursuant to Chapter 16.08 RCW shall be attached to the application. The city of Edmonds dangerous dog certificate of registra- tion shall be issued upon completing the requirements of this section. 2. The owner of dangerous dog shall provide for proper enclosure of a dangerous dog. A dangerous dog may not be outside of the dwelling of the owner or outside of a proper enclosure of a dangerous dog unless muzzled and restrained by a substantial chain or leash and under the control of a responsible person. The muzzle shall be made in a manner that will not cause injury to the dog nor inter- fere with its vision or respiration but shall pre- vent it from biting any person or animal. 5-15 (Revised 2/13) 5.05.123 3. The owner of a dangerous dog shall secure liability insurance coverage or a surety bond as required by Chapter 16.08 RCW. 4. The owner of a dangerous dog shall be required to post the premises with a clearly visible warning sign that there is a dangerous dog on the property. In addition, the owner shall conspicuously display a sign with a warn- ing symbol that informs children of the pres- ence of a dangerous dog. G. Failure to Comply with Dangerous Dog Requirements. Any dangerous dog shall be seized and removed by animal control officer if. 1. The dog is not validly registered under this chapter and Chapter 16.08 RCW; 2. The owner does not secure liability insurance coverage or a surety bond as required by Chapter 16.08 RCW; 3. The dog is not maintained in a proper enclosure; 4. The dog is outside of the dwelling of the owner or outside of a proper enclosure and not muzzled and restrained by a substantial chain or leash and under the control of a responsible person; or 5. The owner has failed to post the prop- erty with warning signs as required. H. Penalty. Failing to comply with any dan- gerous dog requirement is a gross misde- meanor. A dangerous dog seized and removed in violation of dangerous dog requirements shall not be released during investigation of or prosecution for failure to comply with danger- ous dog requirements. Any person convicted of failing to comply with dangerous dog requirements shall make restitution to the city of Edmonds for all costs incurred in boarding and disposition of such dog and shall forfeit any interest in such dog. 1. The provisions of this section shall not apply to dogs used by law enforcement offi- cials for police work. [Ord. 3895 § 1, 2012; Ord. 3451 § 1, 2003]. (Revised 2/13) 5-16 5.05.123 Appeal. A. Filing. A notice of appeal, substantially in the form prescribed, shall be filed with the Edmonds municipal court and the chief of police not more than five business days after service of the order to abate a nuisance, poten- tially dangerous dog declaration, or dangerous dog declaration. Failure to timely file a notice of appeal shall constitute a waiver of the right to appeal the determination of the order to abate a nuisance, potentially dangerous dog declaration, or declaration of dangerous dog. 1. If the owner or keeper does not file a timely written request for hearing, the restric- tions imposed in connection with the declara- tion shall remain in effect for the life of the animal, unless sooner lifted by action of the animal control authority or a court of compe- tent jurisdiction. B. Form. An appeal pursuant to this chapter shall be written and shall conform substan- tially to the following requirements: 1. A caption reading: "Appeal of giving the names of all appellants participating in the appeal; 2. A brief statement setting forth the legal interest of each of the appellants involved in the notice and order; 3. A brief statement in concise language of the specific order or action protested, together with any material facts claimed to support the contentions of the appellant; 4. A brief statement in concise language of the relief sought, and the reasons why it is claimed the protested order or action should be reversed, modified or otherwise set aside; 5. Signatures of all parties named as appellants, and their official mailing addresses; and 6. Certification (by signature of the appellant) that the appellant has read the appeal, and that to the best of the appellant's knowledge, information, and belief, the appeal is well grounded in fact. Edmonds City Code C. Scheduling of Hearing. Upon receipt of a timely filed notice of appeal, a hearing shall be scheduled not more than 60 days from the date of the filing of the notice of appeal. The clerk of the municipal court shall send written notice of the date of the hearing to the appel- lants at least 10 days prior to the scheduled hearing date. It shall be the responsibility of the parties to notify witnesses of the hearing date. The failure of the appellant to appear at the hearing shall result in a denial of the appeal and upholding of the order to abate a nuisance, potentially dangerous dog declaration, or dec- laration of dangerous dog. D. Enforcement Stayed During Pendency of Appeal. Unless otherwise determined by the judge of the Edmonds municipal court, enforcement of the order to abate a nuisance or declaration of dangerous dog shall be stayed during the pendency of the appeal. E. Appointment of the Hearing Examiner. The judge of the Edmonds municipal court is appointed as the hearing examiner. The judge may uphold, dismiss or modify the order to abate a nuisance, potentially dangerous dog declaration, or declaration of dangerous dog. A written order shall be prepared and signed by the judge. F. Presentation of Evidence. At the appeal hearing, the judge shall take evidence relevant to the order to abate a nuisance, potentially dangerous dog declaration, or dangerous dog declaration. Testimony may be provided in the form of a signed written statement pursuant to RCW 9A.72.085. Otherwise, parties are responsible for subpoenaing any witnesses they deem necessary to testify. G. Burden of Proof and Standard of Review. At the appeal hearing before the hear- ing examiner, the animal control authority shall have the burden of proving that the dog is potentially dangerous or dangerous by a pre- ponderance of the evidence. H. Hearing Before Municipal Court Hear- ing Examiner. The owner of the dog may pres- ent evidence in defense of the dog. The hearing 5.05.123 examiner shall weigh the evidence presented by both the animal control authority and the owner (if applicable), and shall issue a written decision to the appealing animal owner and animal control authority that either sustains or reverses the animal control authority's decla- ration. 1. Upon sustaining or reversing the dec- laration, the hearing examiner shall notify the nonprevailing party of the right to appeal the hearing examiner's decision. 2. If the declaration is reversed and an appeal is not timely filed by the animal control authority, any previously imposed restrictions on the dog shall be annulled. I. Decision of the Court. The judge of the Edmonds municipal court may uphold, dis- miss, or modify the order to abate a nuisance, potentially dangerous dog declaration, or dec- laration of dangerous dog. A written order shall be prepared and signed by the judge. The decision of the judge of the Edmonds munici- pal court shall be a final administrative deci- sion appealable to the Snohomish County superior court within 30 days of the final writ- ten order. J. Notification of Status, Change of Owner- ship, Custody and/or Residence. The owner of a potentially dangerous dog or dangerous dog shall notify the animal control authority, immediately upon discovery of such circum- stances, when the dog is loose or unconfined off the owner's property; or has bitten or injured a human being, pet or livestock; or is sold or given away or dies. If the owner moves such dog to another address or otherwise trans- fers the dog to the ownership, custody, or resi- dence of another individual, the owner shall, within 14 calendar days of the change, inform the animal control authority in writing of the name, address and telephone number of the new owner and/or the address of the new resi- dence where the dog is located. Such notice shall include the name, description and license number of the dog. 5-16.1 (Revised 2/13) 5.05.124 1. In the event the ownership and/or cus- tody of the dog changes, the owner shall notify the new owner in writing of the details of the dog's record relating to being declared poten- tially dangerous or dangerous and the terms and conditions of the declaration. 2. The owner shall also provide the ani- mal control authority with a copy of the written notification, which shall contain a notarized statement by the new owner acknowledging receipt of the notification. [Ord. 3895 § 1, 2012; Ord. 3786 § 1, 2010; Ord. 3451 § 1, 2003]. 5.05.124 Disposition of seized and removed animals — Bond requirements. Any owner whose domestic animal is seized and removed pursuant to ECC 5.05.128 (Ani- mal cruelty) or ECC 5.05.122 (Dangerous dogs) shall, upon a finding of probable cause by the Edmonds municipal court, be required to post a bond or security within five days of such probable cause finding in an amount suf- ficient to provide for the animal's care for a minimum of 60 days from the seizure date. Failure to post such bond or security shall authorize the city of Edmonds or its agent to euthanize the animal or find a responsible per- son to adopt the animal. The city of Edmonds may euthanize severely injured, diseased, or suffering animals at any time. [Ord. 3451 § 1, 2003]. 5.05.126 Impound procedures. A. Authority. The animal control authority and its authorized representatives are autho- rized to apprehend and impound any animals in violation of this chapter. B. Notice of Impound. When any licensed animal is impounded, the officer or department impounding such animal shall notify the owner of the impoundment and the reason therefor by mail, telephone or by leaving writ- ten notice at the address contained in the license application. It shall be the owner's (Revised 2/13) 5-16.2 responsibility to take such measures for redeeming such animal. Neither the city nor any officer or agent of the city shall be legally or financially responsible for failing to notify an animal owner under this chapter. C. Redemption of Animals by Owner. Unless otherwise provided in this chapter, the owner of an impounded animal may redeem the animal at any time prior to the release for adoption or disposal by the city and shall be entitled to the possession thereof upon pay - Edmonds City Code but not limited to architects, engineers, law- yers, doctors, dentists, real estate offices, etc. H. "Commercial" and "retail buildings" mean all types of retail and commercial busi- ness establishments other than office buildings and other than industrial or manufacturing, and each such business shall be considered as a sep- arate unit even though two or more may be in the same building. I. In the event there is more than one type of operation in the same building, i.e., a profes- sional office, a retail store, a restaurant, or an apartment, then in that case each separate cat- egory or type shall pay at the rate fixed under that particular category or type. J. "Equivalent residential unit" or "ERU" means a sewer connection charge based upon the winter standard water consumption of a 1. Single-family residence (per unit) 2. [Ord. 3339 § 1, 2000; Ord. 786 § 1, 1959]. 7.30.020 Separate single-family residence meters. Each single-family residence building or structure served by water shall be provided with its own separate water meter. Prior to the time when such additional separate meters can be installed, water rates shall be applicable on the same basis as if the separate meters were actually installed. [Ord. 1449, 1969]. 7.30.030 Water rates — Meter installation charges. A. C. Meter Installation Charges. 1. New service line and meter installa- tion charges are fixed as follows: a. 3/4" $550.00 b. 1" $800.00 2. The actual cost of street restoration (with regard to all surface streets) shall be added to any meter installation charge, if appli- cable. 3. When approved by the city engineer, new service lines installed by a developer on a plat shall be credited as follows: a. 3/4" $175.00 b. 1" $200.00 D. All rates set forth in this section shall be exclusive of any applicable taxes. E. Repealed by Ord. 3618. A general facilities charge (GFC) (formerly known as a "connection charge") shall be paid by each new customer connecting to the city's water or sewer system in accordance with the following requirements: A. Sewer System GFC. The sanitary sewer GFC shall be paid by the applicant at the time and according to the date of side sewer permit issuance in an amount per equivalent residen- tial unit (ERU) added as a result of the devel- opment as set forth in the table below; provided, that nonresidential building permit and business license applicants shall pay sewer system GFC when the proposed structure and/or business activity would generate addi- tional probable sewer usage. 2012 before 2012 effective 2014 and effective date date forward 2013 beyond Sewer GFC per ERU $730.00 $2,573.50 $3,495.25 $4,417.00 1. A single-family residential applicant shall pay a GFC equal to one ERU per dwell- ing unit. 2. A multifamily residential applicant shall pay a GFC equal to 0.67 ERU per dwell- ing unit. 3. Applicants for nonresidential devel- opment shall pay a GFC equal to the ERU determination that is made by the public works director. This determination shall be made by estimating the probable sewer usage of the proposed development. In estimating the prob- able sewer usage, the public works director may consider, among other factors, the aver- age winter water consumption for similar (Revised 2/13) 7-12 existing development in the city. If the appli- cant disagrees with the director's ERU deter- mination, the applicant may submit additional information and analysis from a qualified engineer, with an additional $200.00 review fee, in support of a request for an alternate ERU determination. The director shall review the request for an alternate ERU determination and may accept the alternate calculation, revise the earlier ERU determination based on the new information, or uphold the earlier ERU determination. Once the director has made a final ERU determination, the applicant Edmonds City Code may pay the GFC under protest and appeal the determination, along with the underlying per- mit, to the hearing examiner. 7.30.036 B. Water System GFC. The water system GFC shall be paid upon, and according to the date of, application for water service, and based upon the size of the meter to be installed, as set forth in the table below: C. No water connection charge shall be lev- ied for connections to water mains installed pursuant to Local Improvement District Nos. 115, 146 and 152 by properties which partici- pated in the establishment of said local improvement districts. A connection charge shall be paid by each new customer connecting to the city's sewer system within the following described district(s). This special connection charge is based upon the actual cost of constructing improvements which relate directly and exclu- sively to homes within the district(s) and which are, because of the special nature of the construction, separate and distinct from the overall costs of the system paid by a customer pursuant to ECC 7.30.035. These charges shall be in addition to the charges paid by a new cus- tomer pursuant to ECC 7.30.035 and do not duplicate any costs contained in the underlying sewer utility connection charge. B. 88th Avenue West Sewer Special Con- nection District. 1. Properties addressed as 21903, 21904, and 21911 88th Avenue West shown on Exhibit A attached to the ordinance codi- fied in this section maintained on file in the city clerk's office and any subdivision, lot line adjustment or reconfiguration of the lots or the property represented by such addresses shall pay a special connection fee, to be paid in full at the time of connection to the sewer system, of $2,941.39 per lot. 2. Due to the significant additional sewer system construction that will be required at the property owners' expense to connect these properties to the sewer system after completion of the sewer project by the city, these properties may defer connection and shall not be required to connect to the sewer system within the time limit require- ments of ECDC 18.10.010 and ECC 7.30.040. 3. Properties addressed as 21903, 21904, and 21911 88th Avenue West shown on Exhibit A attached to the ordinance codi- fied in this section maintained on file in the city clerk's office and any subdivision, lot line adjustment or reconfiguration of the lots or the property represented by such addresses shall pay a special connection fee, to be paid in full at the time of connection to the sewer system, of $2,941.39 per lot. 2. A single-fam- ily residential parcel is one ESU. For all other parcels, one ESU is equivalent to 3,000 square feet of impervious surface area. The city's public works director is hereby authorized to make adjustments to the city's stormwater utility rates as provided in this chapter in an amount up to 50 percent of the rate set in the preceding section in accordance with the following provisions: A. Upon written application to the public works director, a customer may request review of the city's stormwater management utility fee as applied to the specific developed prop- erty to which the fee has been charged. The applicant shall state the specific conditions and/or facilities on the site which the applicant feels warrants adjustment of the rate as applied to the property. B. On his own motion, the public works director may initiate review of a stormwater utility charge to any parcel. C. The public works director shall have the authority to increase or decrease rates up to 50 percent of the level set by the city council. The sole criteria for adjusting the rate shall be a determination that the physical characteristics of the site and in particular the stormwater detention, retention and/or treatment facilities as installed thereon by the owners, or lack thereof, have significantly increased the bur- den which the property places upon the city's stormwater utility (in the event of an increase) or significantly decreased the burden (in the event of a decrease) by providing additional benefits over and above those which the aver- age property places upon the utility through on-site improvements including but not lim- ited to on-site pollution control mechanisms or technologies which relate to water quality and the property's impact upon the city's stormwa- ter management system. Factors personal to the property owner, such as ability to pay, shall not be considered. D. The decision of the public works direc- tor shall be in writing. It may be appealed to the Edmonds city council for review. In that review process the determination of the direc- tor shall be given substantial weight and an applicant for decrease shall have the burden of proof. In the event the director has recom- mended an increase, the city staff shall have the burden of proof in the process. The deci- sion of the Edmonds city council shall be final and shall not be appealable. The city council may either increase or decrease the rates 7-17 (Revised 2/13) 7.50.070 within 50 percent of that set or may elect, in its sole discretion, to apply the rate as established by ordinance if the city council determined that such property does not differ substantially from other similarly situated ratepayers and their properties. [Ord. 3264 § 1, 1999]. 7.50.070 Stormwater management system general facilities charge. A. In addition to any other charge pre- scribed by this chapter, a stormwater manage- ment system general facilities charge (GFC) (formerly known as a development charge) shall be paid by the applicant at the time and according to the date of building permit issu- ance in an amount per equivalent service unit (ESU) added to or created by the development as set forth in the table below; provided, that stormwater permit applicants shall pay GFC at the time and according to the date of stormwa- ter permit issuance. 2012 before 2012 effective 2014 and effective date date forward 2013 beyond Storm GFC per ESU $428.00 $613.50 $706.25 $799.00 B. For the purposes of this section only, an ESU is hereby defined to be the impervious surface area estimated to contribute an amount of runoff which is approximately equal to that created by an average single-family residential development. A single-family residential development shall pay GFC equal to one ESU; provided, that a single-family residential development that includes 5,000 square feet of new, replaced, or new plus replaced impervi- ous surface area shall pay GFC pursuant to subsection (C) of this section. C. All development not meeting the criteria in subsesction (B) of this section shall pay GFC calculated according to a ratio of one ESU per 3,000 square feet of new, replaced, or new plus replaced impervious surface area. When the provisions of city ordinances require the confirmation by the city council of any mayoral appointment, whether to a board or commission established by ECC Title 10 or of a public officer in accordance with provi- sions of ECC Title 2, such confirmation shall be expressed by the affirmative vote of four members of the city council. [Ord. 2521, 1985]. 10.03.030 Chapter 10.03 STUDENT REPRESENTATIVES ON CITY'S BOARDS AND COMMISSIONS Sections: 10.03.010 Student representative authorized. 10.03.020 Qualifications. 10.03.030 Appointment process. 10.03.040 Term. 10.03.010 Student representative authorized. Any board or commission that derives its authority from the ordinances codified in this title may appoint a high school or college stu- dent to participate as a nonvoting member of the board or commission. This person shall be known as a student representative. Student representatives may not attend executive ses- sions of the body to which they have been appointed. [Ord. 3890 § 1, 2012]. 10.03.020 Qualifications. Student representatives must be residents of the city of Edmonds, but they need not attend school in Edmonds. [Ord. 3890 § 1, 2012]. 10.03.030 Appointment process. Vacancies should be publicized on the city's website and through outreach to local high schools and colleges when city resources allow for such publication and outreach. Each board or commission interested in appointing a student representative is authorized to prepare a short application form that is relevant to the charge of the board or commission. If more than one application is submitted, all applica- tions shall be forwarded to the board or com- mission for consideration. After the applications have been considered, nomina- tions shall be voted on by the board or com- mission in an open public meeting. [Ord. 3890 § 1, 2012]. 10-3 (Revised 2/13) 10.03.040 10.03.040 Term. Each student representative shall serve a one-year term that commences on September 1st of each year. Student representative atten- dance at board or commission meetings during the summer shall be optional and any absences during the summer shall be excused by the board or commission. A student representative may apply for reappointment to the same posi- tion for successive terms; provided, that the board or commission shall evaluate all appli- cants for the student representative position and any reappointment shall be voted on in an open public meeting. A student representative may be removed for cause prior to the end of the term on a super majority vote of the full board or commission. [Ord. 3890 § 1, 2012]. (Revised 2/13) 10-4 Chapter 10.05 ARCHITECTURAL DESIGN BOARD Sections: 10.05.010 Board created — Membership. 10.05.020 Terms of membership. 10.05.030 Officers of board — Meetings — Quorum. 10.05.040 Powers and duties. 10.05.010 Board created — Membership. A. There is created an architectural design board consisting of seven members. The mem- bership of said board shall be composed of one architect and/or building designer, one land- scaper and/or landscape architect, one builder or developer, one educated or having practical experience in planning, one person trained or having practical experience in any of the afore- mentioned categories or any related design sci- ence and two lay persons. The lay members shall reside within the city limits of the city of Edmonds. B. Voting members of said board shall be appointed by the mayor, subject to confirma- tion by the city council. Members shall be selected without respect to political affiliation and they shall serve without compensation. C. No person shall be appointed to serve more than two full terms on the board. An appointment to fill a vacancy for less than two years shall not constitute a full term for the purposes of this section. D. All references in the Edmonds City Code to "City Amenities Design Board," "Amenities Design Board" or "ADB" shall be deemed to refer to the architectural design board. In order to ensure that the fewest terms will expire in any one year, the terms of the appointed positions by position number shall Edmonds City Code expire on December 31 st of the year set oppo- site said position number as follows: Position No. 1 — 1991 Position No. 2 — 1988 Position No. 3 — 1989 Position No. 4 — 1990 Position No. 5 — 1990 Position No. 6 — 1991 Position No. 7 — 1988 Thereafter, the terms of membership for the members of the board shall be four years. No person shall serve more than two full consecu- tive terms; an appointment to fill a portion of an unexpired term less than two years in length shall not be considered a full term. Vacancies occurring otherwise than upon the expiration of terms may be filled for the unexpired terms. Members may be removed by the mayor fol- lowing a public hearing, with the approval of the city council, for inefficiency, neglect of duty, or misfeasance in office. Members shall be removed for failure to maintain attendance as required by the provisions of the Edmonds City Code. Members of the board shall meet and orga- nize by electing from the members of the board a chairman and a vice-chairman, and such other officers as may be determined by the board. It shall be the duty of the chairman to preside at all meetings. The vice-chairman shall perform this duty in the absence of the chairman. A majority of the board shall consti- tute a quorum for the transaction of business. A majority of a quorum may transact any par- ticular business of the board. The regular pub- lic meeting of the board shall be held on the first Wednesday of each respective month commencing at 7:00 p.m. at the Edmonds Civic Center; provided, however, that regular meetings may be held at such time or place as may be designated by the chairman or the 10.05.040 majority of the members of the board. The board is empowered to advise and make recommendations to the mayor, city council, planning commission and the planning depart- ment on matters hereinafter enumerated and on such matters as may be specifically referred to the board by the mayor, city council, plan- ning commission or the planning department: A. To study and prepare a recommendation for a comprehensive architectural design plan including the recommendation of establish- ment of specific design districts which shall be a part of the comprehensive plan. B. To review and study land use within the city of Edmonds from a design standpoint. C. To establish goals, objectives and poli- cies for design districts. D. To recommend legislation to effectuate the implementation of the comprehensive architectural design plan and the goals, objec- tives and policies for each established design district. E. And for such other matters as shall be referred to the board for review and recom- mendation by the mayor, city council, plan- ning commission or the planning department.
