2.25.010 City auditing officer.
The administrative services director shall
serve as the city auditing officer and shall act
as auditor for the city for all claims, demands
and vouchers presented to the city council for
approval, except those claims, demands or
vouchers submitted pursuant to ECC 2.25.040.
Such claims, demands and vouchers shall be
prepared for audit and payment on a form pro-
viding for the authentication and certification
by the auditing officer that the materials have
been furnished, the services rendered or the
labor performed as described, and the claim,
demand or voucher is a just, true and unpaid
obligation against the city. [Ord. 2873 § 1,

2.25.020 Preparation of list of claims,
demands and vouchers.
The accounting manager shall prepare a list
of all claims, demands and vouchers presented
to the city and to be examined by the auditing
officer. [Ord. 2873 § 1, 1992].
2.25.030
2.25.030 Payment of claims, demands and
vouchers.
No claim, demand or voucher may be paid
until approved by the city council unless the
following conditions are met:
A. The mayor and the auditing officer who
are designated to sign the checks or warrants
shall each be furnished an official bond for the
faithful discharge of his or her duties in an
amount determined by the city council, but not
less than $50,000;
B. The city council has adopted contract-
ing, hiring, purchasing and disbursing policies
that implement effective internal control;
C. The council president shall be desig-
nated as the auditing committee for the city
council. The council president shall review the
documentation supporting claims paid and
review for approval by the city council at its
next regular public meeting all checks or war-
rants issued in payment of any claim, demand
or voucher. A list of each claim, demand or
voucher approved and each check or warrant
issued indicating the check or warrant number,
the amount paid and the vendor or payee shall
be filed in the city council office for review by
individual councilmembers prior to each regu-
larly scheduled public meeting; and
D. The city council shall require that if,
upon review, it disapproves a claim, demand
or voucher, the auditing officer and the officer
designated to sign the checks or warrants shall
jointly cause the disapproved claim, demand
or voucher to be recognized as a receivable of
the city and shall pursue collection diligently
until the amounts disapproved are collected or
until the city council is satisfied and approves
the claim, demand or voucher.
Notwithstanding the fact that all of the above
conditions are met, the city council may stipu-
late that certain kinds or amounts of claims,
demands or vouchers shall not be paid before
the city council has reviewed the supporting
documentation and approved the issue of
checks or warrants in payment of those claims,
demands or vouchers. [Ord. 2896 § 1, 1992;

2.25.040
2.25.040 Claims, demands and vouchers
presented by officers and
employees.
Certificates as to claims, demands and
vouchers of officers and employees of the city
for services rendered shall be made by the per-
son charged with the duty of preparing and sub-
mitting vouchers for the payment of services,
and that person shall certify that the claim,
demand or voucher is just, true and unpaid,
which certificate shall be part of the voucher.

2.25.050 Travel authorization and
expense reimbursement policies.
A. Policy. It is the city's policy to provide
payment for the reasonable accommodation of
travel required to conduct city business by city
officials and employees.
B. Applicability. This section and the poli-
cies contained herein shall be applicable to all
elected officials, members of boards and com-
missions and city employees unless otherwise
specifically exempted.
C. Authorization for Travel. All requests
for travel or training shall be submitted and
approved on an authorization to travel and
attend training form prior to the person's
departure date.
1. All anticipated costs should be listed
on the form, whether the costs are known or
reasonably estimated.
2. The mayor is authorized to approve
all employee's requests which are included
within the city's annual budget.
D. Travel and Training Request — City
Council Approval. City council president
approval must be obtained of all travel and
training requests for members of the city coun-
cil and members of city boards and commis-
sions.
E. Accommodations. Accommodations,
such as transportation, lodging and conference
registration shall normally be arranged in
advance by designated staff member and billed
directly to the city. Accommodations shall be

made at the lowest reasonable rate available,
such as coach fare for air transportation, use of
special discounts and single occupancy gov-
ernment rates for lodging. Air travel should be
used when other reasonable methods of trans-
port are not otherwise available and time
schedules require the additional expense.
F. Advance Payment of Expenses. Pursuant
to ECC 3.04.040*, advance payment of autho-
rized expenses in excess of $100.00, as listed
on the authorization to attend/travel form, will
be provided upon request. Request for an
advance payment must be made at least one
week prior to the departure date.
G. Reimbursement of Travel Expenses.
1. Travel expenses by city officials and
employees shall be paid by the city in accor-
dance with the rate schedule listed below.
Expense vouchers must be submitted for pay-
ment within 10 days following the individual's
return. Expense receipts and/or credit card
receipts must be submitted for city payment. If
a receipt has been lost or stolen, the employee
should submit a written statement to the
finance director explaining the circumstances
of the missing receipt. Reimbursements based
on this process may be issued. Reimbursement
for any expenses which exceed the limits set
forth in this policy shall require approval of the
city council.

2. The transportation allowance shall be
based upon the direct route round trip costs.
Other allowable costs shall include ferry tolls
and off-street parking. Taxis may be used if
they are the most reasonable means of trans-
portation available.
H. Nonallowable Expenses. Expenses not
approved for reimbursement include, but are
not limited to, alcoholic beverages, expenses
for family or guests, entertainment, travel
costs paid by another organization, mileage (if
traveling as a passenger in a nonowned car),
limousine services and personal travel insur-
ance. Only the normal, reasonable and actual
expenses will be reimbursed. Public officials
and employees utilize public funds for their
expenses and are admonished and requested to
limit expenditures to those reasonably neces-
sary to provide safe, clean and convenient
lodging and healthy meals in settings appropri-
ate to the public mission with which they have
been entrusted.
I. Use of Private Cars. Private cars should
be used by city officials and employees when-
ever a city vehicle is not available and/or the
time the official or employee will be absent
exceeds two or more days. Drivers must have
a valid operator's license, and the car must be
insured to the state's minimum liability stan-
dards. The mayor, members of the city council,
boards and commissions shall not be reim-
bursed for mileage expenses incurred within
the city limits of Edmonds. City employees
will be reimbursed for mileage when using a
private vehicle within the city limits when
such use is in furtherance of city business. The
city's mileage reimbursement rate is intended
to cover the cost of fuel, maintenance and
insurance costs. Persons using a private vehi-
cle and seeking reimbursement for mileage
must maintain a valid driver's license and indi-
vidual auto insurance, including public liabil-

ity, bodily injury and property damage, which
insurance shall be deemed to be primary as to
any other insurance available to the city. If a
private vehicle is used in lieu of air transporta-
tion, the total amount of reimbursement shall
not exceed the cost of air fare as established in
subsection (G) of this section. [Ord. 3917 § 1,

2.25.060 Compliance with state law for
damage claims.
Claims or demands for damages to persons
or property shall be presented to the city in
accordance with the provisions of Chapter
35A.31 RCW. [Ord. 2873 § 1, 1992].
2.25.070 Travel expenses supervision.
The administrative services director is
authorized, in accordance with the mayor's
administrative powers, to supervise travel
expenses in accordance with the rules and reg-
ulations established by the State Auditor's
Office. In addition, the administrative services
director is authorized to close such funds and
report any fund balances in the course of the

MUNICIPAL EMPLOYEES
BENEFIT PLAN

There is established for qualified city
employees a benefit plan to be provided by the
city in lieu of coverage under the Federal Old
Age Survivors Disability and Health Insurance
Act. The benefit plan shall be as set forth in
that certain document entitled, "City of
Edmonds Municipal Employees Benefit Trust
Plan," three copies of which are and have been
on file in the office of the city clerk for use and

2.30.020 Plan mandatory.
The terms of the plan shall be mandatory for
all present and future qualified city employees.

2.35.010 Definitions.
A. "Compensating time" is that period of
time that an employee may have away service
of the city due to service in excess of regular
hours.
B. "Continuous service" is continuous ser-
vice of an employee of the city and shall con-
tinue until resignation or involuntary dismissal.
Military leave of not to exceed 30 days in any
one calendar year, absence because of military
service in time of war, and permitted sick leave
shall not constitute an interruption of continu-
ous service.
C. "Contract employee" is an employee
whose terms and conditions of employment are
determined by an annual contract with the city.
Contract employees shall include but are not
limited to the council resource person; pro-
vided, however, that no person shall be deemed
a contract employee without the express autho-
rization of the city council. The provisions of
the contract shall govern and control and no
provision of any collective bargaining agree-
ment or this chapter shall be applicable to the
position unless specifically referenced in the
contract and the city ordinance. The employee
shall receive only those benefits provided by
the contract or specifically required pursuant to
state or federal law.
Edmonds City Code
D. "Day" means a standard eight-hour work
day. The vacation, sick leave and other accru-
als referenced in this chapter shall be converted
to a total of hours earned, based upon each day
of accrual equaling eight hours of accrual.
E. "Employee" means those persons em-
ployed in the service of the city on a full-time
basis and who are remunerated pursuant to the
annual salary ordinance, other than those per-
sons for whom the city has recognized a sole
collective bargaining agent.
F. "Service" is being present for and/or per-
forming the duty to which an employee of the
city has been assigned.
G. "Spouse" shall mean an individual who
is married to a city employee under the laws of
the state of Washington, or who is in a domes-
tic partnership which has been registered with
the state of Washington in accord with the pro-
visions of Chapter 43.07 RCW. [Ord. 3675

2.35.020 Holidays.
A. Each employee shall be entitled to one
day away from service for each of the follow-
ing holidays:
January 1 st (New Year's Day);
Third Monday of January (Martin Luther
King, Jr. Day);
Third Monday of February (President's
Day);
Last Monday of May (Memorial Day);
July 4th (Anniversary of Declaration of
Independence);
First Monday of September (Labor Day);
November 11th (Veteran's Day);
Fourth Thursday of November (Thanksgiv-
ing Day);
Day immediately following Thanksgiving
Day;
December 24th and 25th (Christmas Eve
and Christmas Day);

B. Each employee who, because of the
nature of his/her service, serves on a holiday,
shall be compensated in accordance with the
following provisions:
1. Employees classified as nonexempt
shall, at his/her option, be compensated for
work on that holiday either by payment for
such work at the overtime rate of pay or, may,
at his/her election receive an equivalent
amount of compensatory time off at a date con-
venient to the city. Such day away from ser-
vice shall be set at a date mutually agreed
upon, but shall be set within 12 months of the
holiday served. Such rate of pay shall not be
pyramided in the event that any hours worked
are subject to the overtime provisions of the
Fair Labor Standards Act.
2. Exempt employees shall be permitted
one full day away from service with full pay on
a day which he/she would otherwise have
served. Such day off shall be scheduled at a
date mutually agreed upon within 12 months
of the holiday served.
C. No employee shall be called to work on
any holiday for less than a full day of work.
When any of the aforementioned holidays falls
on a Sunday, the Monday following shall be
considered the holiday. If the holiday occurs
during an employee's vacation, he/she shall
receive the holiday pay in addition to his/her
vacation pay.
D. Nothing in this section shall be con-
strued to have the effect of adding or deleting
the number of paid holidays provided for in
any existing agreement between the city and
any group or groups of employees of the city.
If any of the legal holidays set forth in this
section are also federal legal holidays but
observed on different dates, only the holiday
occurring on the date specified shall be recog-
nized as a paid legal holiday. In no case shall
both be recognized as paid legal holidays for

2.35.030 Vacations.
A. Regular employees shall accrue the fol-
lowing amount of vacation leave with pay
based on the length of continuous service, as
that term is defined in the personnel policies:
1. Nonexempt, represented employees
shall receive vacation leave in accordance with
the applicable collective bargaining agree-
ment;
2. Nonexempt and exempt nonrepre-
sented employees below the level of supervi-
sor shall accrue annual vacation in accordance
with the following schedule:

. 4. The police chief and those individuals
designated on the annual salary ordinance as
directors shall initially accrue 22 days of vaca-
tion per year. Such accrual shall be credited on

a semi-monthly basis with each employee's
paycheck, except as provided above. The rate
of accrual shall be reflected by a credit equal to
the proportionate share of vacation earned for
the period.
B. Employees are encouraged to use their
accumulated vacation time within the year in
which it is accrued. Vacation accruals of up to
two years' accumulation may be carried over
from one year to the next.
C. Any employee whose service is honor-
ably terminated after the completion of six
months of continuous service shall be paid for
any vacation time accumulated prior to the
effective date of termination. [Ord. 3917 § 3,

2.35.040 Compensating time.
When work beyond regular hours is
required of an employee of the city (excluding
those employees designated as exempt from
this benefit on the annual salary schedule)
compensating time off may be allowed as city
requirements permit, subject to the following
requirements:
A. Nonexempt employees, on their request
and at the city's option, may be permitted to
take compensating time off at the overtime rate
of one and one-half times the actual overtime
worked in lieu of payment; provided, that such
employees may not accumulate more than 48
hours of compensating time and any compen-
sating time off must be used within the 12 -
month period following the date on which
overtime is earned.
B. All exempt employees other than those
excluded by the annual salary ordinance (see
subsection (E) of this section) shall receive
compensatory time for night meetings, emer-
gency call outs, and other similar periods for
which they are required by their supervisor to
work. Compensating time shall not be earned
for short extensions of regular work hours less
than one hour in length, such as staying late or

coming in early. Compensatory time for such
exempt employees shall be earned at the
straight time rate, one hour of compensatory
time earned for each hour worked. The mea-
surement of such time shall be in accordance
with the mayor's administrative policies. Such
exempt employees shall be allowed to accu-
mulate up to a maximum of 48 hours of com-
pensatory time during any calendar year. The
terms of use shall be as established by the
mayor's administrative policy. If an employee
earns additional compensatory time after he or
she has accumulated the maximum, then the
employee must either be paid for the additional
time or provided time off during the next pay
period.
C. Compensating time shall be taken at the
convenience of the city. All compensating
time must be recorded and then approved by
the employee's supervisor and/or department
head.
D. Upon termination no exempt employees
shall be paid for unused compensatory time.
Nonexempt .employees shall be paid for
unused compensating time at one and one-half
times the overtime worked. However, every
effort should be made to use compensating
time prior to termination.
E. Employees designated as exempt from
this compensating time provision shall receive
a monthly salary as designated on the annual
salary ordinance. Their presence or absence
from the regular work schedule shall be
reviewed in terms of the employee's overall
performance in accordance with the mayor's
administrative policies and the city personnel
policies.
F. To be more competitive in the market
place, the city will provide nonrepresented
employees who are ineligible for compensa-
tory time with 24 hours of management leave
annually. Management leave will have no
cash -out value and will not be carried over at
the end of the calendar year. [Ord. 3917 § 3,

2.35.045 Shared leave.
A. Intent. The purpose of shared leave is to
permit city employees, at no additional em-
ployee cost to the city other than the adminis-
trative cost of administering the program, to
come to the aid of a fellow employee who is
suffering from or has an immediate family
member suffering from illness, injury, impair-
ment, physical or mental conditions which has
caused, or is likely to cause, the employee to
take leave without pay or to terminate his or her
employment. "Immediate family" is defined as
spouse,' registered domestic partner, son,
daughter, mother, father, and in-laws of the
same degree. The city may, but has no obliga-
tion to, approve recognition of other, signifi-
cant relationshipssimilar in nature to that of the
immediate family, if the needs of the city per-
mit. In addition to these purposes, the shared
leave program may be used by employees who
have been involuntarily called to military ser-
vice.
B. A department director, with the mayor's
approval, may permit an employee to receive
shared leave under this section if.
1. The employee suffers, or has an
immediate family member suffering from an
illness, injury, impairment or physical or men-
tal condition, which has caused, or is likely to
cause, the employee to go on leave without pay
or to terminate his or her employment with the
city. In addition, the shared leave program may
be utilized by an employee who has been invol-
untarily called to active duty in the Washington
National Guard, or in the Army, Navy, Air
Force, Coast Guard or Marine Corps of the
United States. An employee seeking to utilize
the shared leave program due to an involuntary
call to military service need not establish com-
pliance with subsections (13)(2) through (4) of
this section.

2. The employee has depleted or will
shortly deplete his or her total of accrued vaca-
tion, sick leave, compensatory time, holiday
time, and/or other paid leave.
3. Prior to a request to use shared leave,
the employee has abided by the sick leave pol-
icy.
4. The employee has diligently pursued
and is found to be ineligible for state industrial
insurance benefits or such benefits have been
exhausted.
5. Use of shared leave will not signifi-
cantly increase the city's costs except for those
costs which would otherwise be incurred in the
administration of this program and which
would otherwise be incurred by the employee's
department.
C. The applicable department director, with
the concurrence of the mayor, shall determine
the amount of shared leave, if any, which an
employee may receive under this section. The
employee shall be required to provide appro-
priate medical justification and documentation
both of the necessity for the leave and the time
which the employee can reasonably be
expected to be absent due to the condition.
Shared leave shall be limited to no more than a
maximum of six continuous calendar months
or six months total in any five-year period and
cannot be used to extend the absence of the
employee beyond the post -leave time pre-
scribed by state statute, the applicable labor
agreement, or city policy.
D. Shared leave shall be funded through
voluntary transfers of accrued vacation and/or
sick leave from other city employees to the
employee approved for a shared leave. Both
vacation and sick leave can be donated for a
shared leave request, which has been approved
due to an extraordinary/catastrophic type ill-
ness or injury. Catastrophic illnesses or injuries
are those which are potentially career -ending
or life-threatening. For this type of request, all
donated vacation must be used prior to any use
of donated sick leave. For illnesses and injuries
which are noncatastrophic in nature, only vaca-

tion leave can be donated and used. Sick leave
donations are not allowed for this type of
request. Co-workers who donate leave must
retain a reasonable amount of accrued vacation
and sick leave to protect them from a wage loss
due to illness or injury and to enjoy a reason-
able vacation period. When reviewing police
employees, the police chief may consider hol-
iday and compensatory time for purposes of
approving shared leave requests and donations
of leave time. Department directors shall not
transfer any leave time in excess of the amount
specified in the request. All donations shall be
voluntary. The applicable department director
shall determine that no significant increase in
city costs will occur as a result of the transfer
of leave.
E. Leave may be transferred from em-
ployee(s) from one department to an employee
of the same department, or, with the concur-
rence of both department directors, to an em-
ployee of another department.
F. While an employee is on shared leave, he
or she will continue to be classified as a city
employee and shall receive the same treatment,
in respect to salary and benefits, as the em-
ployee would otherwise receive if using vaca-
tion leave.
1. All salary benefit payments made to
the employee on a shared leave shall be made
by the department employing the person using
the shared leave.
2. The employee's salary rate shall not
change as a result of being on shared leave nor,
under any circumstances, shall the total of the
employee's salary and other benefits, including
but not limited to state industrial insurance or
any other benefit received as a result of pay-
ments by the city to an insurer, health care pro-
vider, or pension system, exceed the total of
salary and benefits which the employee would
have received had he or she been in a regular
pay status.
G. Leave shall be transferred on a dollar -
for -dollar basis. The value of the leave shall be
determined at the current hourly wage of the

transferor and the leave available to the receiv-
ing employee shall be calculated at the receiv-
ing employee's wage.
H. The human resources department shall
be responsible for computing values of
donated leave and shared leave, and shall also
be responsible for adjusting the accrued leave
balances to show the transferred leave. The
human resources department shall determine
the appropriate fund transfers and budget
amendments as needed for city council action.
Records of all leave time transferred shall be
maintained in the event any unused time is
returned at a later date.
I. The value of any leave transferred which
remains unused shall be returned at its original
value to the employee or employees who
donated the leave. The human resources
department shall determine when shared leave
is no longer needed. To the extent administra-
tively feasible, the unused leave shall be
returned on a pro rata basis.
J. The human resources department shall
monitor the use of shared leave to ensure
equivalent treatment for all employees of the
city. Inappropriate use or treatment of the
shared leave provision may result in cancella-
tion of the donated leave or use of shared

1993; Ord. 2738 § 1, 1989].
2.35.050 Emergency service.
During an emergency all employees shall be
available for extra duty as required by the city.

2.35.060 Sick leave.
A. Represented employees accrue sick
leave at the rate of and to the maximum estab-
lished in the respective collective bargaining
agreements. Nonrepresented employees shall
accrue sick leave at the rate of one working day
for each full calendar month of the employee's

continuous service. The maximum amount of
accrued sick leave shall not exceed 1,000 hours
for such nonrepresented employees.
B. Upon honorable termination, unused
sick leave shall be paid to nonrepresented
employees at a rate equal to one-half of the reg-
ular rate of pay at the date of termination to a
maximum of 800 hours. In the event of the
death of an employee, the payment for unused
sick leave shall be paid to the surviving spouse
or to the estate of the decedent if there is no sur-
viving spouse. Honorable termination means
resignation or lay-off due to lack of work or
funding and shall not include any discharge for
cause. In the event that further or conflicting
terms are established by the provisions of col-
lective bargaining agreements, such provisions
shall control such payments to represented
employees in accordance with their respective
collective bargaining agreement.
C. An employee eligible for sick leave with
pay shall be granted such leave for:
1. Employee's own health condition (ill-
ness, injury, physical or mental disability,
including disability due to pregnancy or child-
birth);
2. The need to care for an ill family
member in accordance with the family care
policy;
3. Medical or dental appointments for
the employee or dependent child; provided,
that the employee must make a reasonable
effort to schedule such appointments at times
which have the least interference with the
work day;
4. Exposure to a contagious disease
where on-the-job presence of the employee
would jeopardize the health of others;
5. Use of a prescription drug, which
impairs job performance or safety;
6. Additional leave (maximum three
days) beyond bereavement leave for a death in
the immediate family to be authorized by the
department head.

D. The certificate of a physician and/or a
written report concerning the need for the sick
leave may be required by the city, and if so
required shall be supplied by the employee in
order to qualify for sick leave with pay.
E. As an incentive to the appropriate use of
sick leave, nonrepresented employees may
earn additional leave hours on an inverse basis
to the amount of sick leave used during the cal-
endar year, in accordance with the following
schedule:

Annual leave earned under this program shall
be used in the calendar year in which the leave
was earned. Absences compensated through
the state workers' compensation illness or
injury program shall not be taken into consid-
eration when applying the eligibility standards.
The leave earned shall be pro -rated to the near-
est full hour on the basis of sick leave used.
F. Nonrepresented employees who have
accrued in excess of 800 hours of sick leave
may convert the excess hours to a cash pay-
ment at the rate of three hours of sick leave for
one hour of compensation at the employee's
current rate of pay, up to a maximum of $1,000
per year. The human resources department
shall notify the employee of his or her accrued
sick leave hours with the last paycheck in
August of each year. The sick leave payout
shall be paid with the first paycheck in January.
Employees must request the optional sick leave
payout within 10 working days from the date
notice of accrued sick leave was provided.
G. Newly hired employees who are entitled
to transfer sick leave from their previous
employer to the city of Edmonds pursuant to
interlocal agreement, collective bargaining
agreement and/or state law may transfer such

sick leave banks subject to the rules set forth in
this section. In addition, a transferred
employee who would, under the provisions of
the city's personnel policies, be required to pay
back worker's compensation benefits
advanced by the city and thereby restore
his/her sick leave bank may exercise such
rights with respect to funds received from
Labor and Industries as worker's compensa-
tion within the first six months of their employ-
ment, thereby buying back sick leave which
otherwise could have been transferred. [Ord.

2.35.070 Transfer of position.
In the event an employee is transferred from
one position to another within the city, any
accrued vacation time and/or accrued sick
leave time and/or compensating time shall be
available to the employee in his new position.

2.35.075 Special duty pay.
A. The mayor is authorized to pay any man-
ager or director level employee special duty
pay in addition to that person's regular com-
pensation when the mayor has temporarily
assigned special duties to that person. No
employee may receive special duty pay for
longer than one year without city council
approval. "Special duties" are defined as those
duties not included as "primary duties and
responsibilities" in the employee's official job
description and not otherwise associated with
the employee's position.
B. Special duty pay shall consist of up to 10
percent of the employee's salary at the time the
special duties are assigned. The mayor is
authorized to grant to each such employee up
to five percent for special duty pay at the
mayor's discretion, and shall be based upon
the scope of the additional responsibilities
identified by the mayor. If the mayor deter -

mines that special duty pay above five percent
is warranted for a particular employee, the
mayor will be authorized to grant up to 10 per-
cent for special duty pay upon prior approval
by the city council. [Ord. 3917 § 4, 2013].
2.35.080 Extenuating circumstances.
The foregoing provisions of this chapter
shall be considered as minimum employee
privileges, which may be extended for extenu-
ating circumstances upon the approval of the
mayor. [Ord. 1168 § 8, 1966].
2.35.090 Conflict.
A. In the event that any provision of this
chapter or any provision of this title shall con-
flict with any provision of an employment con-
tract or collective bargaining agreement
approved by the city council, such contract or
agreement shall prevail. In no event shall any
employee be entitled to claim greater benefits
under this chapter than those provided for by a
collective bargaining agreement or employee
contract covering said individual's employ-
ment.
B. It is understood that in order to attract
experienced personnel, the city may be
required to authorize deviations from the ben-
efits established by this title or through the
city's personnel manual. During the course of
any budget year, the mayor or his designee is
authorized to extend offer letters to individuals
which provide for benefits greater than those
to which an entry-level employee would be
entitled. The purpose of this authorization is to
permit the city to attract persons with experi-
ence at comparable public agencies. When the
mayor, in his discretion, believes that it is nec-
essary to attract such individuals to the city,
benefits may be authorized which place an
individual at a higher level of benefits, such as
vacation accrual, than their hire date would
otherwise indicate. Such employment offers
shall be ratified by the city council. In the
event such ratification is not granted, the indi-
vidual shall retain those benefits only for the

budget year in which they are offered. The
mayor's offer shall not exceed the maximum
imposed for employees of the classification or
job status which has been established for such
benefit without the prior written consent of the
city council. All such offers shall be limited to
and within the funds budgeted for the budget
year in which the offer is made. [Ord. 3505

2.36.010 Annual leave for reservists.
Every city employee who is a member of the
Washington National Guard or of the Army,
Navy, Air Force, Coast Guard, or Marine
Corps Reserve of the United States, or of any
organized reserve or, armed forces of the
United States, shall be entitled to annual leave
as provided in RCW 38.40.060. [Ord. 3373 §
1, 2001].
2.36.020 Military service.
A. Subject to the provisions of subsections
(B) through (G) of this section, every city
employee who is called to active duty or enlists
for duty in the Washington National Guard, or
in the Army, Navy, Air Force, Coast Guard or
Marine Corps of the United States of America
shall be entitled to receive from the city, com-
mencing on the first day the employee reports
for active duty, or the first day of duty after
expiration of accrued leave (see subsection
(A)(4) of this section), and continuing for the
period specified below, or until the employee's
discharge from service, whichever first occurs:
1. For 60 days, the difference, if any,
between the employee's regular salary or
wages, fixed as of the last day of service ren-
dered to the city prior to reporting for active
duty, and the military compensation paid to the
employee for the employee's military service,
inclusive of housing and food allowances and
other similar expenses; and
2. For 90 days, following the expiration
of leave provided for in subsection (A)(1) of
(Revised 7113) 2-24.2b
this section: medical, dental and vision bene-
fits for the employee and the employee's
dependents, at the same level as provided to
the employee and the employee's dependents
as of the last day of service rendered to the city
prior to reporting for active duty. To the extent
consistent with plan documents, the employee
may continue to participate in the MEBT plan
for so long as the employee receives eligible
compensation salary under subsection (A)(1)
of this section or through the use of accrued
leave.
3. An employee shall be entitled to uti-
lize the total of the benefits set forth in this sec-
tion once within any five -calendar -year
period. The five-year period shall commence
on the first day such benefit(s) are used.
4. An employee may utilize vacation,
compensatory time and other forms of accrued
leave eligible for use in accordance with the
terms of, and limitations on the use of, such
accrued leave, prior to or in conjunction with
the use of military leave, in order to supple-
ment or extend the benefits created by this
chapter. Use of such benefits shall result in an
adjustment of time limits for military leave to
reflect the usage of accrued leave.
B. In order to qualify for the compensation
in benefits provided under subsection (A) of
this section, an employee who is involuntarily
called to or enlists in active military service
must execute an agreement obligating the
employee to return to, work at the city upon
completion of active duty and within the
employment rights period established by fed-
eral law. The agreement shall provide that if the
employee fails to return to city employment
during the time period prescribed by law, the
employee shall be obligated to reimburse the
city for all compensation and benefits that are
paid under this section.
C. In order to receive the compensation pro-
vided by subsection (A)(1) of this section, the
employee shall be required to submit copies of
his or her military pay stubs showing all com-
pensation received from the military during the

As authorized by Chapter 35.87A RCW,
there is hereby established an Edmonds down-
town business improvement district
("BDBID") within the following boundaries as
shown on the map attached to the ordinance
codified in this chapter as "Attachment A"
(when a street or alley is named, the area
boundary is the centerline of the right-of-way
including vacated portions unless otherwise
specified in the description). The EDBID
includes the parcels with the tax ID numbers
set forth in Attachment B to the ordinance cod-
ified in this chapter, which is incorporated
herein as if set forth in full (for additional
detail, please see the attached map). In case of
a conflict between the list of parcels (Attach-
ment B) and the map (Attachment A), the map
shall control. [Ord. 3909 § 1, 2013].
3.75.020 Levy of assessments.
To finance the programs authorized in ECC
3.75.030, the owners and operators of busi-
nesses (collectively, "members") in the
EDBID described in ECC 3.75.010 shall pay

and be subject to a special assessment in the
amount listed in Table 1 below. The assess-
ment shall be measured by the type and square
footage of the business, subject to calculations
and limitations in ECC 3.75.040. Residential
properties and the residential component of
mixed-use properties shall not be subject to the
special assessments. Commercial properties,
or the portions thereof, that are vacant (do not
contain a business) shall not be assessed. [Ord.

3.75.030 Programs.
Assessment revenues may be used for any
combination of the following component pro-
grams, but not for any other purpose:

3.75.040 Assessment methodology.
The special assessment amount shall be
based on the type of business multiplied by the
square footage of a business. There shall be
two business classifications for the purposes of
calculating the assessment: "open door" busi-
nesses (e.g., restaurants, retailers, banks, etc.);
and "by appointment" businesses (e.g., hair
salons, doctors, lawyers, nail salons, insurance
providers, counselors, financial advisors, etc.).
Open door establishments are assessed at a
higher rate than by appointment businesses
due to the relatively higher benefit that open
door businesses are expected to receive from
the programs. Table 1 shows the annual assess-
ment for both classifications of businesses
based on their square footage within the
EDBID.

The initial assessment calculation shall be
based on the city of Edmonds' business license
records for year 2012. Governmental entities,
public utilities, nonprofits operating under
Internal Revenue Code Section 501(c)(3) shall

3.75.050 Rate changes.
Changes in the assessment rate shall only be
made by ordinance and as authorized by state
law. [Ord. 3909 § 1, 2013].
3.75.060 Deposit of revenues.
The city of Edmonds will create a business
improvement district fund within the city of
Edmonds budget; a separate subaccount desig-
nated as the Edmonds downtown business
improvement district account (called "the
account"). The following monies shall be
deposited in the account:
A. All revenues from assessments levied
under this chapter;
B. Gifts, grants and donations;
C. Interest and all other income from the
investment of account deposits;
D. Reimbursements due to the account;
E. Interest and/or penalties from delinquent
accounts; and
F. Transfers from other city funds; pro-
vided, that liabilities of the EDBID shall not be
an obligation of the general fund or any other
special fund of the city. [Ord. 3909 § 1, 2013].
3.75.070 Collection schedule.
Assessments shall be paid and collected on
a quarterly basis; provided, that members may
opt to pay the full yearly assessment at the time
of the billing for the first quarter. [Ord. 3909
§ 1, 2013].
3.75.080 Delinquent payments.
If the assessment is not paid within 60 days
after its due date, a delinquency charge shall be
added at the rate of 12 percent per annum. The
finance director is authorized to use a city of
Edmonds approved collection agency to col-
lect any unpaid assessments. Use of a collec-
tion agency will result in a business paying the
agency's fee on top of the amount of the BID
assessment plus interest and penalties. [Ord.

3.75.090 Notices.
Notices of assessment, installment pay-
ments, or delinquency, and all other notices
contemplated by this chapter shall be sent to
the EDBID member by ordinary mail to the
mailing address shown on the business license
as maintained by the city clerk. Failure of the
member to receive any mailed notice shall not
release the member from the duty to pay the
assessment and any interest and delinquency
charges on the due date. [Ord. 3909 § 1, 2013].
3.75.100 Disputes.
Any member seeking to challenge the
amount of an assessment or delinquency
charge may submit additional information
concerning the classification and/or square
footage of the business to the finance director
or designee, who may adjust the assessment
based on Table 1 if he determines that the orig-
inal classification and/or square footage was
erroneous. The finance director shall provide a
written determination to the member, which
may be appealed to the city's hearing examiner
within 10 days of the finance director's deter-
mination by paying an appeal fee in the
amount of $250.00 and filing a notice of
appeal with the city clerk that sets forth the
alleged error in the finance director's determi-
nation. The member has the burden of proof
before the hearing examiner to show that the
assessment or delinquency fee is incorrect.

3.75.110 Expenditures.
Expenditures from the account shall be
made upon vouchers drawn by the finance
director and shall be used exclusively for the
purposes defined in ECC 3.75.030. [Ord. 3909

3.75.120 Members advisory board.
The mayor shall appoint, subject to confir-
mation by the city council, an interim members
advisory board comprised of members from
the EDBID within 60 days of the effective date

of the ordinance codified in this chapter. The
mayor shall appoint at least seven and no more
than 11 interim board members. The interim
board shall be composed of both open door and
by appointment EDBID members, respec-
tively, in rough proportion to the dollar value
of assessments to be levied on each classifica-
tion of businesses. In addition, the finance
director and the community services/economic
development director shall be nonvoting, ex
officio members of the interim board.
The interim members advisory board shall
be responsible for proposing bylaws and pol-
icy guidelines to the city council that will
address, among other matters, the composition
and method of appointing or electing future
board members. The initial member advisory
board shall submit their proposed bylaws to
the city council within 90 days of the city
council's confirmation of the mayor's initial
appointments. The interim members advisory
board shall also provide advice and consulta-
tion to the finance director, and to any individ-
ual or agency, that may be hired to manage the
day-to-day operations of the business
improvement district program, on all matters
related to the operation of the program.
The interim members advisory board shall
submit a proposed work program and budget
for 2013 to the city council within 90 days of
the city council's confirmation of the mayor's
initial appointments and shall recommend a
work program and budget for all subsequent
years no later than September I st of the year
before: The board shall address and discuss
member concerns and questions regarding the
EDBID and program; review all reports sub-
mitted to the finance department by the mem-
bers advisory board or program administrator,
if hired; and sponsor the initial annual mem-

3.75.130 Business improvement district
fund oversight.
The finance director shall administer the
BID fund for the city with authority to:
A. Consider adjusting the assessment
amount based on an erroneous classification or
square footage;
B. Collect the assessments; refund assess-
ments when overpaid or otherwise improperly
collected; extend the deadline for payment;
and waive delinquency charges and interest
whenever the delinquency results from exten-
uating circumstances beyond the member's
control, such as a casualty loss causing prema-
ture closure of the business, bankruptcy, or the
total principal payment due to the city (exclu-
sive of penalty and interest) is $10.00 or less;
C. Calculate and collect the interest for late
payments; and
D. Accept and deposit advance payment of
assessments by members; accept donations
from governmental agencies, the public, and
owners and operators of businesses. [Ord.

3.75.140 Contract for program
management.
The community services/economic devel-
opment director and/or finance director shall
serve as the program administrator until per-
manent provisions are made pursuant to

4.85.100 Driver's license — Application.
An applicant for a horse taxi driver's license
must submit:
A. A statement:
1. Of name, age and address(es) for the
last five years,
2. Of current and last preceding place of
employment,
3. Whether previously employed or
licensed as a horse taxi driver and, if so, the
reasons why not now so employed,
4. That he/she has been a licensed motor
vehicle driver for at least two years,
5. Of ability to read and speak the
English language,
6. That he/she is not and has not for two
years been addicted to the use of intoxicating
liquor or drugs.
B. Proof:
1. That he/she holds a current, valid
Washington State driver's license,
2. That he/she has not been convicted of
an offense involving moral turpitude, of a fel-
ony relating to fitness or ability to operate a
horse taxi within 10 years, or driving under the
influence of intoxicants or reckless driving
within one year, and
3. The certification of the applicant's
examining physician that the applicant is in
reasonable physical condition capable of
safely operating the horse taxi and handling
and caring for the horse.
C. Two recent photographs. [Ord. 2843 § 1,

4.85.125 License and other related fees.
A. The fee for a vehicle license issued
under ECC 4.85.030 shall be $50.00 annually.
B. The fee for a driver's license issued
under ECC 4.85. 100 shall be $25.00 annually.
C. The fee for establishing a standing, park-
ing or pick up zone shall be $175.00 per street

4.85.130 Issuance.
The city clerk or her/his designee causes one
of the applicant's photographs to be incorpo-
rated into the license along with licensee's
name and assigns a number to the license.

4.85.140 Display.
Every driver must display her/his license in
a conspicuous place inside the horse taxi
clearly visible from the passenger compart-
ment at all times when he or she is operating or
in charge of the vehicle. [Ord. 2843 § 1, 1991].
4.85.150 Violations.
It is a violation and ground for suspension or
revocation of a horse taxi driver's license, for
any horse taxi driver to:
A. Commit more than two traffic infrac-
tions in any 12 -month period;
B. Be guilty of a felony;
C. Be guilty of reckless driving or driving
offenses involving the use of alcohol;
D. Fail to deliver to the police department
within 24 hours any property of value left in a
vehicle;
E. Allow a person to enter or alight from
the vehicle while it is in motion or pick up or
discharge a passenger at any place other than
the curb or pavement edge;
F. Allow a passenger to consume intoxicat-
ing liquor or controlled substances in the vehi-
cle;
G. Pick up any additional passengers with-
out the express consent of the original passen-
ger;
H. Refuse to pick up as a passenger any
person of proper deportment when the vehicle
is available, or discriminate against any person
because of race, religion, national origin, sex,
marital status, age, or mental or sensory hand-
icap;

I. By reason of neglect or intent to cause or
allow any animal under his/her care to endure
pain, suffering or injury or to fail or neglect to
aid or attempt alleviation of pain, suffering or
injury he/she has so caused to any animal

4.90.010 Definitions.
A. "Public market" is defined in ECDC
21.80.103.
B. "Vendor" shall mean any person, associ-
ation, group, partnership, corporation or firm
who exhibits goods or services in a public mar-
ket provided through a duly licensed sponsor,
for the purpose of selling, bartering, trading,
exchanging or advertising such goods or ser-
vices for sale.
C. "Sponsor" shall mean any person, asso-
ciation, group, partnership, corporation or firm
engaged in the business of providing to any
vendor, directly or indirectly, sale spaces,
areas or structures within a site licensed for a
public market for the purpose of using such
location during the term of the market's
license. During the study phase in which the
ordinance codified in this chapter is effective,
the promoter shall be a nonprofit organization
as described in ECC 4.90.040. [Ord. 3922,

Edmonds City Code
4.90.020 Activities requiring a license.
It shall be unlawful for any person to own,
use or permit property to be used as a public
market until the market and site have been
licensed under this chapter. No person shall
then sell or offer for sale products at any loca-
tion in conjunction with a market activity until
sponsor has been duly licensed and each ven-
dor submitted to the city. Nothing in this chap-
ter shall be deemed to authorize activities to be
conducted in accordance with the market's
activities unless appropriately licensed as
required under another provision of this code;
provided, however, that business license
requirements are limited as provided in ECC
4.90.050. For example, pawnbrokers and deal-
ers of secondhand goods shall not conduct
activities in accordance with a market until
duly licensed in accordance with the provi-
sions of Chapter 4.75 ECC. Licensing under
the provisions of this chapter shall be an alter-
native to special event licensing under the
authority of the city council or a license for a
public amusement as required under Chapter
4.32 ECC.
A. It shall be unlawful for any person to sell
or offer for sale goods at a public market
unless such person has been listed on the appli-
cation fee of the licensee and paid the process-
ing requirement specified herein.
B. All structures employed on the site shall
comply with the requirements of the State
Building Code, including but not limited to the
Uniform Building and Fire Code elements.
C. The activities of the public market shall
be limited to daylight hours on Saturday and
Sunday of each week within public rights-of-
way, but extended hours are allowed up to
10:00 p.m. for any day of the week if the mar-
ket takes place outdoors on private property or
public property not located within public
rights-of-way. Operational hours related to
activities of the public market are not limited
when the market takes place within a fully
enclosed building. [Ord. 3922, 2013; Ord.

4.90.040
4.90.025 Exemptions.
The provisions of this chapter shall not be
applied to:
A. Require any farmer, gardener or other
person who sells any fruits, vegetables or other
farm produce or edibles produced by such per-
son within Snohomish County, Washington,
and exempt pursuant to RCW 36.71.090 from
paying any fee or application. Such persons are
exempt from the licensing and fee require-
ments of ECC 4.90.070 but may be listed by
the licensee as a vendor when sales are con-
ducted in conjunction with a public market.

4.90.030 Prohibited activities.
It shall be unlawful for any person to own,
use or permit property to be used for any of the
following prohibited acts in conjunction with
the market and unlawful for any person to con-
duct any of the following acts in conjunction
with the public market:
A. The sale of any raw meat, fish or poultry
product unless approved in writing for inclu-
sion by the Snohomish County health district;
B. The sale of any beverage or foodstuff
unless appropriately licensed from the Sno-
homish County health district; and
C. No sound amplification system shall be
used in conjunction with the market which
produces noise which is audible beyond the
boundaries of the area designated in the appli-

4.90.040 Licensees limited to nonprofit
community oriented
organizations.
Licenses to conduct public markets shall be
issued only to nonprofit community organiza-
tions. "Nonprofit community organizations"
are hereby defined to mean: bona fide non-
profit organizations recognized by the United
States Internal Revenue Service as a charitable
institution exempt from taxation under Section
503(C) of the Internal Revenue Code and
whose principal offices or meeting place is

4.90.050 Sponsor licensee — Business
license required when.
The issuance of a public market license to
the sponsor is intended to serve as a master
license authorizing limited business activities.
Vendors at the markets renting or leasing
space from the master licensee are not required
to have a city business license unless they
engage in other business activities subject to
licensing under the provisions of this title. By
way of illustration and not limitation, the fol-
lowing examples are offered:
A. Pawnbrokers and secondhand dealers
are required to have licenses as provided by
Chapter 4.75 ECC.
B. A business license shall be obtained by
any vendor who conducts business activities
beyond the premises licensed as a public mar-
ket and/or outside of the time for which the
license is issued. For example, a business oper-
ating from a booth on the premises licensed as
a public market during the days of approved
market operation shall not require a business
license to conduct such activities. If, however,
the vendor conducts other business activities
subject to the provisions of Chapter 4.72 ECC,
the person conducting such activities shall be
duly licensed in accordance with the provi-
sions of that chapter. [Ord. 3922, 2013; Ord.

4.90.060 Premises — Zoning and land use
requirements.

4.90.070 License fee.
An applicant for a license to operate a public
market shall pay a $100.00 fee. This fee is
based upon the cost to the city of reviewing
and processing the application and shall be
submitted in conjunction with the application.

Each participating vendor shall pay $5.00 for
its participation in the public market during
each calendar year. No application shall be
deemed complete until all fees have been paid.

4.90.080 Term of license.
Each license issued under this chapter shall
be limited to the number of days approved for
operation for the public market for which the
license was issued. [Ord. 3922, 2013; Ord.

4.90.090 Application for license.
Each applicant for a license to operate a
public market shall file an application with the
city clerk accompanied by the license fee pro-
vided for in ECC 4.90.070. The application
shall be in writing and submitted on a form
prepared by the city clerk and signed by the
applicant. The application shall give the appli-
cant's nonprofit organization's business
address and principal business location, a copy
of documents indicating its charitable non-
profit status as well as the residence address
and phone number of the applicant's agent. In
addition to such other information as the city
clerk shall require, the application shall be
accompanied by:
A. A plot plan showing the location of any
outdoor facilities or activities. Adequate park-
ing and ingress and egress shall be maintained
during the course of this temporary special
event. Adequate precautions shall be put in
place to prevent vehicular access to pedestrian
pathways within the confines of the activity.
Applications to utilize a site or lot already
occupied by an existing business shall show on
the plot plan the location of all parking
required to be provided under the provisions of
Chapter 17.50 ECDC for such business.
B. A list of each and every vendor partici-
pating or anticipated to participate in the mar-
ket for which the license is sought shall be
submitted to the city clerk. The listing shall

include the vendor's name, address and busi-
ness phone number together with a general
description of goods and/or services offered by
each vendor. Any changes in the list of ven-
dors shall be provided to the city clerk in a
minimum of three business days prior to the
date of the proposed change (i.e., the first date
at which the new vendor will participate in the
market).
C. Provisions for event management and
garbage control shall be addressed in a man-
agement plan. All tables, tents, booths, signs
and other structures associated with the market
shall be removed from public rights-of-way at
the end of each day; provided, however, that
approved outdoor storage may be provided
between the close of business the day a public
market is held and commencement of business
the following morning on public land not
located within public rights-of-way or on pri-
vate property.
D. Garbage receptacles shall be strategi-
cally located and have sufficient capacity to
accommodate the vendors and estimated mem-
bers of the public in attendance. In addition the
area shall be kept clean of rubbish, garbage,
junk, waste paper, plastic, styrofoam cups,
sacks, food and other waste. The city of
Edmonds encourages the use of recycling
receptacles and products whenever possible.
The license holder shall be responsible to keep
the area clean. The area to be kept clean shall
include the area immediately surrounding
sidewalks and public streets.
E. Temporary signage announcing the
event shall be approved on the site in the
licensing process in accordance with the
requirements of ECDC 20.60.080.
F. The fire marshal shall designate appro-
priate fire lanes through the licensed area on
the plot plan. These fire lanes are intended for
pedestrian use and shall be kept free of struc-
tures, debris or other blockage. Failure to
maintain appropriate fire lanes shall be cause
for immediate revocation of the license. The
police chief may, in his or her sole discretion,

require that security personnel be provided by
the public market during times and in a number

4.90.100 Records.
The named licensee sponsor of the public
market shall maintain a record of all vendors
participating in the event. Such record shall be
available for inspection by the city clerk or a
designated agent during normal business hours
of city offices (that is, 8:00 a.m. to 4:30 p.m.
Monday through Friday, excluding legal holi-
days). [Ord. 3922, 2013; Ord. 3015 § 3, 1995].
4.90.110 Administration.
The license for a public market may be
revoked at the discretion of the mayor or des-
ignee at any time for failure to comply with the
provisions of this chapter or for violation of
any other provision of the city code. Notice of
revocation shall be served personally 24 hours
prior to the date such revocation shall be effec-
tive. The licensee may request a hearing before
the Edmonds city council; provided, however,
that in the interim no activity shall be con-
ducted until such time as the Edmonds city
council has heard the appeal of the licensee
from the original determination of the mayor

4.90.120 Violation of the provisions of the

A. "Constitutionally protected events"
include any event, such as political or religious
activity, intended primarily for the communi-
cation or expression of ideas that is to be con-
ducted on public property or on a public right-
of-way; and, also, any such event held on pri-
vate property which would have a direct sig-
nificant impact on traffic congestion or traffic
flow to and from the event over public streets
or rights-of-way; or which would significantly
impact public streets or rights-of-way near the
event; or which would significantly impact the
need for city -provided emergency services,
such as police, fire or medical aid.
B. "Use" shall mean to construct, erect, or
maintain in, on, over or under any street, right-
of-way, park or other public place any build-
ing, structure, sign, equipment or scaffolding,
to deface any public right-of-way by painting,
spraying or writing on the surface thereof, or to
otherwise occupy in such a manner as to
obstruct the normal public use of any public
street, right-of-way, park or other public place
within the city, including a use related to spe-

5.10.090 Penalty where violation.
Unless otherwise provided for in this chap-
ter of the municipal code, or by state statute
adopted by reference, any person violating any
provision of this chapter shall have committed
a misdemeanor punishable only by a fine not to
exceed $100.00 per vessel for the first viola-
tion. Subsequent violations in the same year
are subject to the following fines:
A. For the second violation, a fine of
$200.00 per vessel;
B. For the third and successive violations, a
fine of $400.00 per vessel;
C. A violation designated as a civil infrac-
tion under this section shall constitute a misde-

sessing, and dispensing commercially pre-
packaged oral contraceptives prescribed by
authorized, licensed health care practitioners.
C. This section shall not prevent a Medi-
care -approved dialysis center or facility oper-
ating a Medicare -approved home dialysis
program from selling, delivering, possessing,
or dispensing directly to its dialysis patients, in
case or full shelf lots, if prescribed by a physi-
cian licensed under Chapter 18.57 or 18.71
RCW, those legend drugs determined by the
board pursuant to rule.

5.15.010 Definitions.
A. "Retailer" means any person, firm, asso-
ciation, company, partnership, or corporation
who operates a store, stand, booth, concession,
or other place at which sales are made to pur-
chasers for consumption or use of tobacco
products.
B. "Tobacco vending machine" means and
includes any machine or device designated for
or used for the vending of cigarettes, cigars,
tobacco, or tobacco products upon the inser-
tion of coins, trade checks, slugs or credit
cards.
C. "Minor" means an individual who is less
than 18 years of age.
D. "Sales conducted in person" means pay-
ment for which the purchase of the tobacco
item is received directly and in person from the
purchaser by the seller or his employee.
Tobacco vending machines which are located
in plain view of the seller or his employee and
controlled by an electronic device activated by
the seller or his employee, upon the buyer's
presentation of acceptable identification as
required in ECC 5.15.030, shall be deemed
"sales conducted in person." [Ord. 2702,

5.15.020 Tobacco vending machines.
It is unlawful to install, place or permit the
use of any tobacco vending machine in any
establishment or portion thereof which is open
to minors, except in a place therein where the

machine is not accessible to or cannot be used
by minors; provided however, that this section
shall not apply to the installation and use by
the proprietor, his agent or employees, of
tobacco vending machines behind a counter or
in some place in any such establishment or
portion thereof in which access by minors is
prohibited by law; provided, further, this regu-
lation shall not apply to the installation and use
of a tobacco vending machine in commercial
buildings or industrial plants or portions
thereof where the public is not usually admit-
ted and where such machines are intended for
the sole use of the employees employed
therein who are not minors. [Ord. 2702, 1989].
5.15.030 Requirement for production of
identification.
No retailer or employee of a retailer shall
sell or permit to be sold, by vending machine
or otherwise, cigarettes or other tobacco prod-
ucts to any individual suspected of being a
minor. If the retailer or the retailer's employee
suspects that a minor is attempting to purchase
a tobacco item, the retailer or retailer's
employee shall request and examine identifi-
cation from the purchaser and positively estab-
lish the purchaser's age as 18 years or greater
before allowing the purchase of the tobacco
item to occur. [Ord. 2702, 1989].
5.15.040 Posting of tobacco products
required.
No retailer shall sell or permit to be sold,
cigarettes or other tobacco products, unless the
tobacco vending machine or other location at
which the cigarettes or other tobacco products
are available for purchase is posted with a
notice which is clearly visible to anyone pur-
chasing the products, and which states:

The notice must be black letters at least one
inch in height on a white background, and will
be made available through the city clerk at the
request of any retailer. [Ord. 2702, 1989].
5.15.050 Penalty.
Unless otherwise provided in this chapter or
by state statute adopted by reference, any per-
son violating any provision of this chapter
shall be punished by a fine not to exceed
$5,000. [Ord. 2853 § 19, 1991; Ord. 2702,
