2-1 (Revised 2/14) Edmonds City Code Chapter 2.01 MAYOR Sections: 2.01.010 Duties. 2.01.020 Mayor's executive assistant. 2.01.030 Repealed. 2.01.040 Full-time position. 2.01.050 Salary. 2.01.010 Duties. The mayor shall be the chief executive and administrative officer of the city, in charge of all departments and employees, with authority to designate assistants and department heads. The mayor shall see that all laws and ordi- nances are faithfully enforced and that law and order is maintained in the city, and shall have general supervision of the administration of city government and all city interest. [Ord. 2349 § 2, 1983]. 2.01.020 Mayor's executive assistant. The position of mayor's executive assistant shall be an at -will position with the executive assistant serving at the pleasure of the mayor. [Ord. 3959 § 3, 2014; Ord. 2303, 1982]. 2.01.030 Term limitation. Repealed by Ord. 3223. [Ord. 2349 § 3, 1983]. 2.01.040 Full-time position. The mayor shall devote full time to execu- tion of the duties of the office of mayor and shall not engage in any occupation or profes- sional inconsistent with the full-time perfor- mance of the duties of mayor. [Ord. 2349 § 4, 1983]. 2.01.050 Salary. The mayor shall receive a salary in such amount as the city council may from time to time establish by ordinance. [Ord. 2349 § 5, 1983]. 2.03.010 Chapter 2.03 CITY COUNCIL Sections: 2.03.010 Executive assistant to council. 2.03.010 Executive assistant to council. The executive assistant to council shall be a contract employee hired on an annual basis by the city council. The terms and conditions of employment for the executive assistant to council as well as all benefits shall be gov- erned by the provisions of the contract. Depending on the experience level of the par- ticular person serving in this role, the prefix of "senior" may be added to the title. The contract shall provide for the delegation by the mayor of the direction of this individual to the city council president. In the event that the mayor elects in his or her discretion not to delegate that function, the city council reserves the right to immediately eliminate the position. [Ord. 3959 § 2, 2014]. 2-3 (Revised 2/14) 2.05.010 Chapter 2.05 CITY ATTORNEY Sections: 2.05.010 Legal counsel — Professional services contract. 2.05.020 Duties. 2.05.030 Compensation. 2.05.010 Legal counsel — Professional services contract. Legal counsel services for the city of Edmonds, Snohomish County, Washington pursuant to the provisions of RCW 35A.12.020 shall be provided through a professional ser- vices contract. The professional services con- tract shall be let on such basis as a majority of the Edmonds city council shall determine. The city council shall utilize the consultant selec- tion process established by Chapter 2.80 ECC provided that the mayor shall participate with the city council consultant selection committee in the selection of up to three candidates for presentation to the city council for its final approval. A. By its contract, the city council shall approve an individual or firm to be designated as city attorney. [Ord. 3000 § 1, 1994; Ord. 2996 § 1, 1994; Ord. 926 § 1, 1962]. 2.05.020 Duties. A. The city attorney shall advise the city authorities and officers on all legal matters pertaining to the business of the city and shall approve all ordinances as to form. He shall represent the city in all actions brought by or against the city or against city officials in their official capacities. B. In addition to the duties prescribed by the laws of the state of Washington as herein- above set forth, the city attorney shall: 1. Attend all regular and special council meetings; provided, however, that the city attorney shall be required to attend work meet- (Revised 2/14) 2-4 ings of the council only at the request and direction of the council; 2. Draft or approve all ordinances, leases and conveyances, and such other instru- ments as may be required by the business of the city; 3. Attend all regular and work meetings of the planning advisory board of the city of Edmonds as requested; 4. Attend all sessions of the Edmonds Municipal Court. [Ord. 2430, 1984; Ord. 1107, 1965; Ord. 926 § 2, 1962]. 2.05.030 Compensation. The city attorney shall be paid for services rendered in accordance with an annual autho- rization for services as contained in the city council's budget. Such authorization shall pro- vide for hourly fees and expenses. The city council may in its discretion contract for the services of more than one firm or individual to provide different legal services to the city and the mayor and city council may assign the duties set forth in the preceding section accordingly. [Ord. 2967 § 1, 1994; Ord. 2319 § 1, 1982]. Edmonds City Code his/her own representation with respect to any such claim or litigation, then all of the provi- sions of this chapter shall be inapplicable, and have no force or effect with respect to any such claim or litigation. [Ord. 2535, 1985]. 2.06.070 Reimbursement of incurred expenses. A. If the city determines that an official or employee does not come within the provisions of this chapter, and a court of competent juris- diction later determines that such claim does come within the provisions of this chapter, then the city shall pay any judgment rendered against the official or employee and reasonable attorneys' fees incurred in defending against the claim. The city shall pay any attorneys' fees incurred in obtaining the determination that such claim is covered by the provisions of this chapter. B. If the city determines that a claim against a city official or employee does come within the provisions of this chapter, and a court of competent jurisdiction later finds that such claim does not come within the provisions of this chapter, then the city shall be reimbursed for costs or expenses incurred in obtaining the determination that such claim is not covered by the provisions of this chapter. [Ord. 2535, 1985]. 2.06.080 Conflict with provisions of insurance policies. Nothing contained in this chapter shall be construed to modify or amend any provision of any policy of insurance where any city official or employee thereof is the named insured. In the event of any conflict between this chapter and the provisions of any such policy of insur- ance, the policy provisions shall be controlling; provided, however, that nothing contained in this section shall be deemed to limit or restrict any employee's or official's right to full cover- age pursuant to this chapter, it being the intent of this chapter and section to provide the cov- erage detailed in this chapter outside and 2.06.090 beyond insurance policies which may be in effect, while not compromising the terms and conditions of such policies by any conflicting provision contained in this chapter. [Ord. 2535, 1985]. 2.06.090 Pending claims. The provisions of this chapter shall apply to any pending claim or lawsuit against an offi- cial or employee, or any such claim or law suit hereafter filed, irrespective of the date of the events or circumstances which are the basis of such claim or law suit. [Ord. 2535, 1985]. 2-7 (Revised 2/14) 2.10.005 Chapter 2.10 CONFIRMATION AND DUTIES OF APPOINTIVE OFFICERS Sections: 2.10.005 Definitions. 2.10.010 Review of vacancies, appointment authority and confirmation process. 2.10.020 Assignment of duties. 2.10.030 Police chief. 2.10.040 Terms and extension of terms. 2.10.050 References. 2.10.005 Definitions. A. Appointive Officer. For the purposes of this chapter, "appointive officer" means the following city officers that are appointed by the mayor and subject to city council confir- mation: all director -level positions in the city's adopted budget, including the police chief. B. Specifications. For the purposes of this chapter, "specifications" means the functions, powers, duties, compensation, and working conditions of the city's appointive officers. [Ord. 3959 § 1 (Att. A), 2014]. 2.10.010 Review of vacancies, appointment authority and confirmation process. A. Periodically, when the city conducts a salary survey regarding its nonrepresented employees, and whenever a vacancy occurs in one of the positions listed in this chapter, the city council may review the specifications for the appointive officer position(s) and revise them as needed before acting to confirm a per- manent appointment. Nothing in this subsec- tion shall be construed to prevent the city council from reviewing such specifications at other times. The council's revising of a speci- fication will not have any effect on a previ- ously confirmed permanent appointment. Recruitment to fill a vacant appointive office may be postponed until after the city council (Revised 2/14) 2-8 acts to revise the specifications or determines them not to be in need of revision. B. The mayor or his/her designee will review all applications and determine the per- sons with the highest qualifications. Any city council member, upon request to the mayor, may review the applications received for a vacant position. Additionally and/or alterna- tively, the city council may evaluate the quali- fications of an applicant for public employment in executive session pursuant to RCW 42.30.110(1)(g). C. If, on occasion of a vacant appointive office, the mayor elects to propose a reorgani- zation of the appointive offices which would alter the specifications of the vacant appoint- ive office, he shall have 60 days from the date of the vacancy to introduce a reorganization proposal to the city council along with any necessary accompanying budget amendment. If reorganization is proposed, recruitment to fill the vacant appointive office may be post- poned until after the city council acts upon the reorganization proposal. D. The mayor shall appoint, subject to council confirmation, the appointive officers. The city council shall interview the top three candidates for each position prior to the mayor's appointment; provided, that the city council may waive the three -interview require- ment by motion adopted by a majority plus one of the full council and may opt to interview as few as two candidates for any vacant appoint- ive office; and further provided, that when an appointive office becomes vacant, or is about to become vacant, again within nine months of the city council's confirmation of the last may- oral appointment to that office, the city council may waive an additional round of interviews, by motion adopted by a majority plus one of the full council, and proceed immediately to confirming the appointment of a candidate interviewed by the city council during the most recent recruitment for that appointive office. The mayor's appointments to all other Edmonds City Code employee positions shall not be subject to city council confirmation. E. The mayor shall have the authority to appoint, without city council confirmation, an acting director to perform the functions and duties of a vacant appointive office, subject to the term limitations described in ECC 2.10.040(B); provided, that there is budgetary authority to fill the position. The city council shall be given written notice about any such acting appointments including the effective date of the appointment. Acting directors shall be compensated pursuant to applicable ordi- nances and personnel policies regarding acting pay. F. The mayor shall begin recruitment of candidates to fill vacant appointive offices no later than 30 days after the latter of the two city council actions described in subsections (A) and (C) of this section; provided, that such recruitment shall not be necessary where the city council opts to make an immediate confir- mation pursuant to a prior round of interviews as set forth in subsection (D) of this section. [Ord. 3959 § 1 (Att. A), 2014; Ord. 3279 § 1, 1999]. 2.10.020 Assignment of duties. The city council shall define the functions, powers and duties of the city's appointive offi- cers and employees. The mayor shall direct, supervise, and be in charge of all appointive officers and employees in the performance of their functions, powers, and duties, except for employees hired pursuant to Chapter 2.03 ECC. Appointive officers shall be responsible for carrying out all directives as assigned by the mayor, including, but not limited to, plan- ning and directing the activities and staff in their respective assigned departments, super- vising and evaluating the work processes and assigned staff, controlling the financial integ- rity of the departmental budget, and insuring the delivery of quality public services. All 2.10.050 department directors shall serve at the pleasure of the mayor. [Ord. 3959 § 1 (Att. A), 2014; Ord. 3279 § 1, 1999]. 2.10.030 Police chief. Pursuant to the authority of RCW 41.12.050(2), the position of police chief has been exempted from civil service. [Ord. 3959 § 1 (Att. A), 2014; Ord. 3279 § 1, 1999]. 2.10.040 Terms and extensions of terms. A. Permanent appointive officers shall serve without a definite term. B. The authority to hold an appointive office on an acting basis (an acting director- ship) shall expire and be deemed vacant six months after the date of the acting appoint- ment. If, during that six-month period, the administration has not been able to generate sufficient interest from suitable candidates to satisfy the city council interview requirement (see ECC 2.10.010(D)), the mayor may request an extension of acting directorship authority from the city council, in increments of no more than six months at a time, to allow the recruiting process to continue. After the initial six-month term, each extension of the acting directorship shall be subject to city council confirmation. C. Both permanent and acting appointive officers shall be at -will positions serving at the pleasure of the mayor. [Ord. 3959 § 1 (Att. A), 2014]. 2.10.050 References. Wherever references are made in the Edmonds City Code, the Edmonds Commu- nity Development Code or any ordinance of the city to the community development direc- tor, said reference shall hereafter be construed to mean the development services director. Wherever references are made in the Edmonds City Code, the Edmonds Community Devel- opment Code, or any ordinance of the city to the administrative services director, said refer- ence shall hereafter be construed to mean the 2-9 (Revised 2/14) 2.12.010 finance director. With the exception of ECC Title 3, wherever references are made in the Edmonds City Code or Edmonds Community Development Code to the community services director, said references shall hereafter be con- strued to mean development services director; provided, that references to the community services director in ECC Titles 7, 9 and 18 and Chapter 4.68 ECC and Chapter 17.95 ECDC shall hereafter be construed to mean public works director. [Ord. 3959 § 1 (Att. A), 2014; Ord. 3279 § 1, 1999]. (Revised 2/14) 2-10 Chapter 2.12 FIRE DEPARTMENT Sections: 2.12.010 Fire service. 2.12.020 Pre-existing rights and obligations not impaired. 2.12.010 Fire service. Fire service is provided to the citizens of the city of Edmonds by and through a contract with Snohomish County Fire District No. 1. Whenever any reference is made in the provi- sions of the Edmonds City Code or Edmonds Community Development Code to "fire chief," "fire marshal," "fire department" or any other reference to a fire fighter or fire ser- vices, such term shall include, for the provi- sion of administrative or other day to day fire services, to reference the fire chief, fire mar- shal and fire fighting services performed for the city by contract by Snohomish County Fire District No. 1. A. The officials of the Snohomish County Fire District No. 1 when performing services by contract to the citizens of the city of Edmonds and to the city in its corporate capac- ity shall exercise any and all rights, duties, obligations and responsibilities in accordance with the provisions of this code to the same extent and in the same manner as if performed by an employee of the city. B. Employees of the Snohomish County Fire District No. 1 ("district") shall not be enti- tled to any wage or benefit provision of this code, including but not limited to Chapters 2.06 and 2.35 ECC. The Edmonds civil service system shall remain in effect but no employee of the district shall have recourse to the civil service commission following the termination date of fire department employees by the city. [Ord. 3762 § 2, 2009]. Edmonds City Code 2.12.020 Pre-existing rights and obligations not impaired. The city council's determination to contract or not contract for fire services with Snohom- ish County Fire District No. 1 and the provi- sions of this chapter shall not impair any existing vested right or vested obligation cre- ated under the provisions of state law or under Chapter 2.50 ECC, Firemen's Relief and Pen- sion System, Chapter 2.60 ECC, Reserve Fire Fighters' Relief and Pensions Act, Chapter 2.70 ECC, Retirement System, and Chapter 10.30 ECC, Disability Board, as well as the MEBT plan of the city. The rights of any per- son under such system vested prior to the transfer of fire service responsibility by con- tract shall remain in full force and effect and are not impaired by either such or the adoption of this chapter. There is hereby established a municipal court entitled "The Municipal Court of the city of Edmonds," hereinafter referred to as "municipal court," which court shall have jurisdiction and shall exercise all powers enu- merated herein and in Chapter 3.50 RCW together with such other powers and jurisdic- tion as are generally conferred upon such court in this state either by common law or by express statute. [Ord. 2538 § 2, 1985]. 2.15.020 Jurisdiction. The municipal court shall have exclusive original jurisdiction over traffic infractions arising under city ordinances and exclusive original criminal jurisdiction of all violations of city ordinances duly adopted by the city of Edmonds. The municipal court shall have orig- inal jurisdiction of all other actions brought to enforce or recover license penalties or forfei- 2-11 (Revised 2114) 2.15.030 tures declared or given by such ordinances or by state statutes. The municipal court shall also have the jurisdiction as conferred by statute. The municipal court is empowered to forfeit cash bail or bail bonds and issue execution thereon; and in general to hear and determine all causes, civil or criminal, including traffic infractions, arising under such ordinances and to pronounce judgment in accordance there- with. [Ord. 2538 § 2, 1985]. 2.15.030 Judges — Appointment — Qualifications. A. The municipal judge shall be appointed by the mayor for a term of four years, subject to the confirmation by the city council. The first judicial appointment to the position of mayor was effective on January 1, 1986, and the municipal judge shall serve a four-year term commencing upon the date of his or her appointment. The mayor shall endeavor to make his or her appointment 30 days prior to the expiration of each judicial term; provided, however, that if the city council fails to con- firm a mayoral appointment, the mayor and city council shall have 60 days commencing upon either the expiration of the pending judi- cial term or the failure of the city council to confirm the mayoral appointment, whichever shall later occur. In the event that for any rea- son the mayoral appointment is not confirmed, the incumbent municipal judge shall hold over and continue in office until such time as a suc- cessor is appointed. B. The position of municipal judge shall be filled by election for the term commencing on January 1, 2010, and every four years thereaf- ter. The municipal judge shall be elected in the same manner as other elective city officials are elected to office. The term of the municipal judge shall be for four years. The mayor shall not appoint a municipal judge pursuant to sub- section A of this section for a term beyond December 31, 2009. Nothing in this section (Revised 2/14) 2-12 shall limit the mayor's authority to fill the position of municipal judge pursuant to ECC 2.15.070 or 2.15.210. C. A person elected or appointed as munic- ipal judge shall be a citizen of the United States of America and of the state of Washing- ton and a resident of Snohomish County; and an attorney admitted to practice law before the courts of record of the state of Washington. [Ord. 3579 §§ 1, 2,2006; Ord. 3170 § 1, 1997; Ord. 2538 § 2, 1985]. 2.15.040 Salaries and costs. The salary of the municipal courtjudge shall be fixed by ordinance. All costs of operating the municipal court; including but not limited to salaries of judges and court employees, Edmonds City Code provisions of this chapter. Any partial con- cluding year shall be similarly prorated. [Ord. 2837 § 2, 1991; Ord. 2210 § 1, 1981; Ord. 917 § 4, 1962]. 3.20.050 Occupations subject to tax — Amounts. Sellers of electricity, gas, water, sewer, cable television and telephone services shall be subject to the taxes imposed by this chapter. There are levied upon, and shall be collected from, every person, firm, corporation or other entity on account of the business activities, license and occupation taxes in the amounts to be determined by the application of the rates against gross income as follows: A. Public Utility Districts. Upon every per- son, firm, corporation or other entity engaged in or carrying on the business of selling or fur- nishing electrical energy and power a tax equal to six percent is levied upon the total gross income from the sale of electricity within the corporate limits of the city during and for the term for which the occupation license is required; provided, however, that there shall be no tax or fee upon revenues derived from the sale of electricity for the purposes of resale. B. Natural or Manufactured Gas and Ser- vice. Upon every person, firm, corporation or other entity engaged in or carrying on the busi- ness of transmitting, distributing, selling and furnishing natural and/or manufactured gas, a tax equal to six percent of the total gross income from the sale of gas within the corpo- rate limits of the city during and for the term for which the occupation license is required. C. Brokered Natural Gas — Use Tax in Lieu of Occupations Tax. There is imposed under the authority of RCW 35.21.870 a use tax on the consumers of brokered natural gas. Such tax shall be in lieu of the tax imposed by sub- section (B) of this section when consumers receive natural gas directly from a producer of manufactured natural gas outside of the state of Washington. Such tax shall be the same as that imposed on a natural manufactured gas 3.20.050 utility by subsection (B) of this section, equal to six percent of the customer's monthly pur- chases or other use charge by the broker of out- of-state natural gas. D. Telephone Business. A tax equal to six percent of the gross subscribers' exchange monthly service charges billed to business and residence customers located within the corpo- rate limits of the city, together with six percent of gross income derived from intrastate toll service provided to business and residential customers located within the corporate limits of the city. E. Cable Television. Pursuant to Chapter 4.68 ECC, community antenna television sys- tems, commonly known as cable television franchisees, are hereby levied a franchise fee of five percent, as authorized by 47 U.S.C. Section 542(a) and RCW 35.21.860, on all gross revenues derived from any source of revenue by cable television franchisees from their cable television operations in the city of Edmonds. In addition thereto, a busi- ness license tax, as authorized in part by 47 U.S.C. Section 542(g)(2)(A), is hereby levied equal to six percent on all gross revenues derived from any source of revenue by cable television franchisees from their cable televi- sion operations in the city of Edmonds. F. City Sewer Utility. The city of Edmonds, as a seller of sewer services, shall be subject to the tax imposed by this chapter. The sewer utility shall pay a license fee or tax equal to 10 percent of the gross income from the city's sewer utility. G. Solid Waste Haulers. Any solid waste hauler shall be subject to the tax imposed by this chapter. The solid waste hauler shall pay a tax equal to six percent of the total gross income from the charges derived from solid waste disposal services within the corporate limits of the city during and for the term for which the occupation license is required. H. City Water Utility. The city of Edmonds, as the seller of water services, shall 3-17 (Revised 2/14) 3.20.060 be subject to the tax imposed by this chapter. The water utility shall pay a license tax or fee equal to 18.7 percent on the gross income from the city's water utility. I. City Storm Water Utility. The city of Edmonds, as the seller of storm water services, shall be subject to the tax imposed by this chapter. The storm water utility shall pay a license tax or fee equal to 10 percent on the gross income from the city's storm water util- ity. A. Interstate or Foreign Commerce. There shall be excepted and deducted from the total gross income upon which the license fee or tax is computed, so much thereof as is derived from the transactions in interstate or foreign commerce, or from business done for the gov- ernment of the United States, its officers or agents, and any amount paid by the taxpayer to the United States, the state of Washington or the city of Edmonds as excise taxes levied or imposed upon the sale or distribution of prop- erty or service. B. Bad Debts. There shall be excepted and deducted from the total gross income upon which the license fee or tax is computed, all bad debts for services incurred, rendered or charged for during the tax year, or for a preced- ing tax year if the charge-off is made in the current tax year. Debts shall be deemed bad and uncollectible when the same have been written off the books of the taxpayer. In the event debts are subse- quently collected, said income shall be reported in the return for tax year in which said debts are collected and at the rate prevailing in the tax year when collected. (Revised 2/14) 3-18 C. Cash Discounts. There shall be excepted and deducted from the total gross income upon which the license fee or tax is computed, all cash discounts allowed and actually granted to customers of the taxpayer during the tax year. D. Burden on Interstate Commerce. Noth- ing in this chapter shall be construed as requir- ing a license, or the payment of a license fee or tax, or the doing of any act, which would con- stitute an unlawful burden or interference in violation of the Constitution or laws of the United States or which would not be consistent with the Constitution or laws of the state of Washington. E. Deduction Allowed. Any person subject to the payment of a license fee or tax under the provisions of any ordinance of the city other than this chapter, on account of engaging in any activity for which he is liable to tax here- under, may deduct the amount of such fee or tax from the amount of fee or tax imposed by this chapter on account of such activity, but such persons shall, nevertheless, in the manner herein provided for, apply for and procure an "occupation license." F. There shall be excluded and deducted from the total gross income upon which the license fee or tax for telephone businesses and telecommunications companies is computed, the following: 1. That portion of the gross income de- rived from charges to another telecommunica- tions company, as defined in RCW 80.04.010, for connecting fees, switching charges, or car- rier access charges relating to intrastate toll telephone services, or for access to, or charges for, interstate services. 2. Charges by a taxpayer engaging in a telephone business or to a telecommunications Edmonds City Code 1. Canidae, meaning and including any member of the dog family not customarily domesticated by man, or any hybrids thereof, but not including domestic dogs and wolf hybrids (cross between a wolf and a domestic dog). 2. Felidae, meaning and including any member of the cat family not customarily domesticated by man, or any hybrids thereof, but not including domestic cats. 3. Ursidae, meaning and including any member of the bear family, or any hybrids thereof. 4. Reptilia, meaning venomous and "devenomized" reptiles, including but not nec- essarily limited to all members of the follow- ing families: Helodermidae (gila monster), Viperidae (pit vipers), Crotalidae (rattle- snakes), Atractaspidae (mole vipers), Hydrophiidae (sea snakes), and Elapidae (coral snakes and cobras). 5. Colubridae snakes which are rear fanged, including, but not necessarily limited to dispholidus typus (boomslangs), thebtornis kirtlandii (African twig or vine snake), and rhabdophis (keelbacks). 6. Colubridae snakes which reach a length of 10 feet and over, including but not necessarily limited to green anaconda, reticu- lated pythons, Burmese python, albino Indian python, and African rock python. 7. Crocodilia, meaning and including crocodiles, alligators and caimans. I. "Inhumane treatment" means every act or omission whereby unnecessary or unjustifi- able physical pain or suffering is caused or per- mitted. J. "Own" means owning, keeping, leasing, possessing or harboring any animal. "Owner" means any person having an interest or right of possession to an animal or any person having control, custody or possession of an animal or by reason of the animal being seen residing consistently at a location, shall be presumed to be the owner. 5.05.010 K. "Person" means any person, firm, cor- poration or association. L. "Pet" is a domestic animal owned and kept by an individual or family for enjoyment and pleasure rather than utility. The term "pet" includes all animals required to be licensed under the terms of this chapter when properly licensed. M. "Potentially dangerous dog" means: (1) any dog that when unprovoked: (a) inflicts a bite or bites on a human, pet or livestock either on public or private property; or (b) chases or approaches a person upon the streets, side- walks, or any other public grounds or private property in a menacing fashion or apparent attitude of attack; or (2) any dog with a known propensity, tendency, or disposition to attack unprovoked, to cause injury or otherwise to threaten the safety of humans, pets or livestock on any public or private property. N. "Poultry" means domestic fowl nor- mally raised for eggs or meat and includes, but is not limited to, chickens, turkeys, ducks, geese, pheasants, quail, guinea fowl, pea fowl and other similar domesticated birds. Nothing herein shall be interpreted to conflict with or eliminate any state wildlife licensing require- ment with relation to the keeping of any type of fowl. Large fowl over three feet in height or 30 pounds as mature adults, such as emus or ostriches, shall be considered "covered ani- mals" and regulated as such. O. "Proper enclosure of a dangerous dog" means, while on the owner's property, a dan- gerous dog shall be securely confined indoors or in a securely enclosed and locked pen or structure, suitable to prevent the entry of young children and designed to prevent the animal from escaping. Such pen or structure shall have secure sides and a secure top, and shall also provide protection from the elements for the dog. P. "Severe injury" means any physical injury that results in broken bones or disfigur- ing lacerations requiring multiple sutures or cosmetic surgery. 5-9 (Revised 2/14) 5.05.020 Q. "Vicious animal" means any animal other than a "dangerous dog" or "potentially dangerous dog" that endangers the safety of any person or domestic animal by biting or attacking without provocation. R. "Wild animal" means any animal living in its natural state and native to the United States and not normally domesticated, raised or bred by humans. [Ord. 3895 § 1, 2012; Ord. 3655 § 1, 2007; Ord. 3634 § 1, 2007; Ord. 3451 § 1, 2003]. 5.05.020 Dog licensing. A. License Required. It is unlawful for any person to own any dog over the age of three months within the city unless the owner has first procured a license required by this chap- ter. B. Dogs Excluded from License Require- ments. The licensing provisions of this section shall not apply to the following dogs: 1. Dogs whose owners are nonresidents temporarily within the city; 2. Dogs brought into the city for the pur- pose of participating in any dog show; 3. Seeing -eye guide and service dogs properly trained to assist blind or impaired per- sons, when such dogs are actually being used by a blind or impaired person, for the purpose of aiding them from place to place. Blind or impaired persons include but are not necessar- ily limited to persons who are blind, deaf, have limited mobility, or have psychological impairment; or 4. Dogs whose owner maintains them for the sole purpose of commercial breeding and/or training, hunting, or boarding, so long as the dogs are restricted within a building or fenced enclosure intended and designed only for the purpose of kenneling dogs and are not permitted to run at large. C. License Tags Issued and Fees. The police department, or such other person, firm or entity authorized by the city council, shall issue a dog license upon the payment of a fee (Revised 2/14) 5-10 as provided for by this subsection. Upon issu- ance of a license, a metal tag corresponding to the number of the application shall be fur- nished to the applicant. 1. The applicant shall cause the same to be attached to the dog. Tags shall not be trans- ferable from one dog to another. 2. The following fees shall be paid for licenses required under this chapter: a. For spayed females or neutered males with a veterinarian certificate or signed affidavit: an annual license fee of $15.00; pro- vided, that a $5.00 fee shall be charged to per- sons over the age of 65; b. For dogs less than six months but over three months of age, temporary tags issued: a license fee of $5.00. Persons over the age of 65 shall receive a rebate of $2.00 at the time of relicensing, upon certification by a vet- erinarian that the dog has been spayed or neu- tered; c. Unspayed females and unneutered males over six months of age: $40.00; d. Replacement of metal tag: $4.00. 3. An owner of an animal previously licensed for which a "permanent" license has been issued under the provisions of this section as the same existed prior to December 16, 1986, shall not be required to relicense or renew said license for such animal. D. License Issuance — Nonresidents. Licenses shall be issued to nonresidents of the city of Edmonds who reside in proximity to the city and who desire to purchase an annual license for their dog for identification pur- poses. The annual fee shall be $10.00 per year per dog. Upon payment of said fee, a tag shall be issued which shall be consistent with the tags issued annually by the city of Edmonds for dogs required to be licensed under this chapter. The dogs permitted to be licensed by this section shall not be eligible for temporary licenses. Nothing in this chapter shall require the obtaining of such license nor shall failure to obtain such a license as provided by this sec- tion subject any dog owner to the penalties Edmonds City Code provided for in this section; provided further, that nothing in this section shall be construed to relieve or otherwise excuse the owner of any dog from complying with all applicable rules and regulations imposed by any county, city or town having jurisdiction over the residence where the dog is harbored or maintained. E. Fee Due Dates — Penalty. 1. All license fees shall be due and pay- able on or before the first business day of Jan- uary in each year. If the license fees are not paid on or before March 1 st of each year, the applicant shall pay the following late fees in addition to the regular fee set forth in subsec- tion C of this section: a. Unspayed and unneutered dogs: $18.00; b. Spayed and neutered dogs: $10.00. 2. Whenever any person shall come into charge, care or control of any dog, the original license application and fee therefor shall become due and payable within 30 days of said date, and the late fee provided above shall be imposed 60 days after the date said license fee and application become due and payable. F. Fee Waiver — Blind and Disabled. Guide and service dogs, as defined in subsection (13)(3) of this section, certified to assist the impaired, and service dogs certified to assist the disabled, may be issued a permanent license at no charge upon the request of a blind or otherwise impaired owner. G. Enforcement Procedure. All dogs not licensed under this section, or who do not exhibit the metal identification tag provided for in subsection C of this section, are declared to be public nuisances and shall be impounded as provided in ECC 5.05.126. [Ord. 3957 § 1, 2014; Ord. 3451 § 1, 2003]. 5.05.025 Cat licensing. A nonmandatory lifetime cat license is available, upon request of the owner, for pur- poses of identification. The fee for such license shall be $5.00. [Ord. 3451 § 1, 2003]. 5.05.040 5.05.030 Fees authorized. A. In addition to the cost of publication of any notices required by this chapter, prior to the release of animals, animals in the custody of the animal control authority or its agents, to the registered owners of said animals, the ani- mal control authority shall charge fees under this chapter as follows: 1. Impound: $20.00. 2. Impound and room fees: $15.00/day for the first 72 hours of custody (or the actual cost incurred, whichever is greater). 3. All other services: cost incurred. B. Prior to the adoption of animals in the custody of the animal control authority or its agent, the animal control authority shall charge fees under this section as follows: 1. Veterinary exam and spay/neuter fees for male or female canines or felines which have not been spayed or neutered: $50.00 (deposit only, shall be refundable as provided in ECC 5.05.127. 1 (13)). 2. Adoption administration: $15.00 fee. C. In addition, the contracted animal shelter provider shall be entitled to collect a reason- able room and board fee. [Ord. 3486 § 1, 2004; Ord. 3471 § 1, 2003; Ord. 3451 § 1, 2003]. 5.05.040 Animal bites to be reported. Every animal which bites a person shall be promptly reported to the animal control authority and shall thereupon be securely quar- antined at the direction of the animal control authority for a period of 10 days. At the discre- tion of the animal control authority, such quar- antine may be on the premises of the owner, at the shelter designated as the city's animal shel- ter or, at the owner's option and expense, in a veterinary hospital of the owner's choice. When an animal's owner is unknown, such quarantine shall be at the shelter designated as a city animal shelter or at a veterinary hospital. [Ord. 3486 § 1, 2004; Ord. 3451 § 1, 2003]. 5-11 (Revised 2/14) 5.05.050 5.05.050 Running at large prohibited. A. Except as provided in subsection (C) of this section, it shall be a civil violation for the owner or person having charge, care, custody or control of any animal to allow such animal to run at large during any hours of the day or night; provided however that fourth and subse- quent violations shall be misdemeanor offenses. This section shall not apply to seeing eye or hearing ear dogs or dogs owned by the city or other law enforcement agencies and maintained as police K-9 units while under the custody and control of the trainer or handler. Any animal found running at large may be seized and impounded. B. It shall be the duty of a person who takes into their possession any stray animal not owned by them or not placed in their posses- sion by the person having the lawful custody and control thereof, to notify the animal con- trol authority or police within 24 hours and to release such animal to the city officer upon demand and without charge. C. Dogs may be allowed to run at large only in the marked, fenced Puget Sound area gener- ally described as the Marina Beach Off -Leash Area, located at 498 Admiral Way, south of the Marina Beach Park. This designated off -leash dog park area shall be open daily from dawn until dusk unless otherwise posted. D. All dogs that enter into the designated off -leash dog park area shall be licensed, cur- rent with all shots, healthy, and wearing a col- lar and identification at all times. Dogs that are ill or injured, in heat, or that have been declared dangerous or potentially dangerous are not permitted to use the designated off - leash dog park area. E. Any person or persons who take a dog into the designated off -leash dog park area shall: 1. Have physical control of the dog by means of an adequate leash when entering and leaving the off -leash area. 2. Keep the dog in view and maintain voice control at all times. (Revised 2/14) 5-12 3. Immediately remove the dog upon the first sign of aggression. 4. Discourage the dog from digging, and fill any holes created by the dog. 5. Be responsible and liable for the behavior and actions of the dog and any inju- ries caused by the dog. 6. Carry equipment/bags for removing feces, and place feces deposited by the dog(s) in an appropriate waste receptacle. 7. Have no more than three dogs in the off -leash area in his or her possession or con- trol. 8. Supervise your children below 12 years of age. 9. Comply with Edmonds park rules and regulations, including no food, beverages, smoking, alcohol use, picnicking or camping, which are expressly prohibited in the desig- nated off -leash dog park area. Firearms and fireworks are not permitted. [Ord. 3937 § 1, 2013; Ord. 3887 § 1, 2012; Ord. 3645 § 1, 2007; Ord. 3451 § 1, 2003]. 5.05.060 Dogs on public grounds. A. It shall be unlawful for an owner to allow any dog to stray and/or enter with or without a leash or other means of restraint upon any school ground, playfield, park, beach, waterfront or other public property. B. Notwithstanding the restrictions set forth in subsection (A) of this section, dogs accompanied by their owners may be walked or exercised while on leash in the following areas. The phrase "on leash" and references to pathways or walkways shall be interpreted to mean on a leash restricting the dog to an area on or within six feet of the pathway surface. 1. The inner trails of Yost Park, in the area commonly known as the Shell Valley area; and 2. Marina Beach Park, in the area south of the Union Oil loading terminal, such area being further described to be a walking strip of Edmonds City Code but not limited to architects, engineers, law- yers, doctors, dentists, real estate offices, etc. H. "Commercial" and "retail buildings" mean all types of retail and commercial busi- ness establishments other than office buildings and other than industrial or manufacturing, and each such business shall be considered as a sep- arate unit even though two or more may be in the same building. I. In the event there is more than one type of operation in the same building, i.e., a profes- sional office, a retail store, a restaurant, or an apartment, then in that case each separate cat- egory or type shall pay at the rate fixed under that particular category or type. J. "Equivalent residential unit" or "ERU" means a sewer connection charge based upon the winter standard water consumption of a 1. Single-family residence (per unit) 2. Duplex, apartment houses, condominiums and other multi -unit residences (per unit) 3. All other customers: 7.30.030 single-family residence of 7.07 per 100 cubic feet of water. [Ord. 3339 § 1, 2000; Ord. 786 § 1, 1959]. 7.30.020 Separate single-family residence meters. Each single-family residence building or structure served by water shall be provided with its own separate water meter. Prior to the time when such additional separate meters can be installed, water rates shall be applicable on the same basis as if the separate meters were actually installed. [Ord. 1449, 1969]. 7.30.030 Water rates - Meter installation charges. A. Base Rate. Variable Rate. In addition to the base rate set forth above, the customer shall be charged the following rate per 100 cubic feet of water consumed: Effective Dates 1/1/2014 1/1/2015 1/1/2016 $2.51 $2.74 $2.99 7-11 (Revised 2/14) 7.30.035 All water base rate and variable rate charges on water utility bills mailed on or after January 1st of each year shall be based on rates as reflected in this section corresponding with said time period. C. Meter Installation Charges. 1. New service line and meter installa- tion charges are fixed as follows: a. 3/4" $550.00 b. 1" $800.00 2. The actual cost of street restoration (with regard to all surface streets) shall be added to any meter installation charge, if appli- cable. 3. When approved by the city engineer, new service lines installed by a developer on a plat shall be credited as follows: a. 3/4" $175.00 b. 1" $200.00 D. All rates set forth in this section shall be exclusive of any applicable taxes. E. Repealed by Ord. 3618. A general facilities charge (GFC) (formerly known as a "connection charge") shall be paid by each new customer connecting to the city's water or sewer system in accordance with the following requirements: A. Sewer System GFC. The sanitary sewer GFC shall be paid by the applicant at the time and according to the date of side sewer permit issuance in an amount per equivalent residen- tial unit (ERU) added as a result of the devel- opment as set forth in the table below; provided, that nonresidential building permit and business license applicants shall pay sewer system GFC when the proposed structure and/or business activity would generate addi- tional probable sewer usage. 2012 before 2012 effective 2014 and effective date date forward 2013 beyond Sewer GFC per ERU $730.00 $2,573.50 $3,495.25 $4,417.00 1. A single-family residential applicant shall pay a GFC equal to one ERU per dwell- ing unit. 2. A multifamily residential applicant shall pay a GFC equal to 0.67 ERU per dwell- ing unit. 3. Applicants for nonresidential devel- opment shall pay a GFC equal to the ERU determination that is made by the public works director. This determination shall be made by estimating the probable sewer usage of the proposed development. In estimating the prob- able sewer usage, the public works director may consider, among other factors, the aver- (Revised 2/14) 7-12 age winter water consumption for similar existing development in the city. If the appli- cant disagrees with the director's ERU deter- mination, the applicant may submit additional information and analysis from a qualified engineer, with an additional $200.00 review fee, in support of a request for an alternate ERU determination. The director shall review the request for an alternate ERU determination and may accept the alternate calculation, revise the earlier ERU determination based on the new information, or uphold the earlier ERU determination. Once the director has made a final ERU determination, the applicant Edmonds City Code within the time limits in accordance with ECDC 18.10.010 shall, upon connection to the sewer system, pay the above established spe- cial connection fee, increased based upon the Department of Labor Bureau of Labor Statis- tics Consumer Price Index for construction for the Seattle -Bellevue -Everett area from the effective date of the ordinance codified in this section to the time of connection to the sewer system. C. Olympic View Drive Sewer Special Connection Districts. 1. Properties legally described, addressed and identified on the attached Exhibit A (maintained on file in the city clerk's office) as 7101, 7109, 7115, 7327, and 7333 Olympic View Drive, and 7530 184th Place SW/Olympic View Drive, or any subdivision, lot line adjustment, reconfiguration, or modifi- cation (including but not limited to legal description, address and other identification) of the lots or the property represented by those addresses shall pay, in addition to other con- nection charges and/or permit fees required by ordinance and/or resolution, a special connec- tion fee, to be paid in full at the time of initial connection to the sewer laterals constructed in Olympic View Drive as identified on sheets 72-78 of the city of Lynnwood's construction drawings for the Olympic View Drive Phase 2 — 76th Ave W to 178th Place SW, as follows: Special Connection Address Fee 7101 Olympic View Drive $4,015.85 7109 Olympic View Drive $3,720.56 7115 Olympic View Drive $3,569.45 7327 Olympic View Drive $3,009.26 7333 Olympic View Drive $2,939.29 7530 184th Place SW $3,798.31 Upon declaration by the city that the aforementioned sewer laterals constructed in Olympic View Drive are operational, the prop - 7.30.036 erties in Exhibit A shall connect to the sewer system in accordance with the requirements of ECDC 18.10.010 and ECC 7.30.040; pro- vided, that a four-month extension to connect shall be granted to any of said properties that is developed upon payment, before the expira- tion of the time limit to connect set forth in ECDC 18.10.010, of one-third of the respec- tive special connection fee charged above. Any of said properties that is undevel- oped at the time the sewer laterals are declared operational shall be allowed to defer connec- tion to the public sewer system until the time when the property is developed. The owner of a property with deferred connection shall pay, upon initial connection to sewer laterals in Olympic View Drive, the special connection fee as set forth above, increased by a cumula- tive multiple, to the extent permitted under RCW 35.92.025, equal to the Department of Labor Bureau of Labor Statistics Consumer Price Index for construction for the Seattle - Bellevue -Everett area from the expiration of the time limits to connect set forth in ECDC 18.10.010, which would then have applied had the property not been undeveloped, to the time of initial connection. 2. Properties legally described, addressed and identified on the attached Exhibit B (maintained on file in the city clerk's office) as 17632, 17708, 17626, 17806, 17810, 17910, and certain unaddressed property located between 17810 and 17910 Olympic View Drive and any subdivision, lot line adjustment, reconfiguration, or modification (including but not limited to legal description, address and other identification) of the lots or the property represented by such addresses shall pay, in addition to other connection charges and/or permit fees required by ordi- nance and/or resolution, a special connection fee, to be paid in full at the time of initial con- nection to the public sewer manhole and stub pipe located at the northwest corner of 180th St. SW and Olympic View Drive as identified on sheet 60 of the city of Lynnwood's con - 7 -12.1 (Revised 2/14) 7.30.040 struction drawings for the Olympic View Drive Phase 1 — 178th Place SW to 168th St. SW (public sewer manhole), of $4,932.85 per lot. Due to the significant additional sewer system construction that will be required at the property owners' expense to connect to the above referenced public sewer manhole and stub pipe, the properties in Exhibit B, regard- less of whether they are developed or not, may, notwithstanding the requirements of ECDC 18.10.010 and ECC 7.30.040, defer connec- tion to the same. The owner of a property that defers con- nection shall pay, upon initial connection to the public sewer manhole and stub pipe, the above established special connection fee, increased by a cumulative multiple, to the extent permitted under RCW 35.92.025, equal to the Department of Labor Bureau of Labor Statistics Consumer Price Index for construc- tion for the Seattle -Bellevue -Everett area from the expiration of the time limits to connect set forth in ECDC 18.10.010 to the time of con- nection; provided, that if the property with deferred connection was undeveloped when the public sewer manhole and stub pipe were declared operational by the city, its owner shall pay, upon initial connection to the same, the above established special connection fee, increased to the extent permitted under RCW 35.92.025 by the aforementioned index from the expiration of the time limits to connect set forth in ECDC 18.10.010, which would then have applied had the property not been unde- veloped, to the time of connection. [Ord. 3777 § 1, 2010; Ord. 3657 § 1, 2007]. 7.30.040 Utility charges — Sanitary sewer. The utility charges for sanitary sewer service set forth in this section shall be added to and made a part of the bimonthly or monthly rates for water supplied through the meters as set forth in ECC 7.30.030: A. The following rates shall be charged on all billings after the effective date shown with respect to the following customers and/or ser- vice: B. For customers who are not served by city waterlines but who are connected to city sewers, the charges shall be the same as set forth in subsection A of this section and its subparagraphs. (Revised 2/14) 7-12.2 Edmonds City Code C. These rates do not apply to industries or manufacturing concerns which have industrial wastes. These, together with other activities not covered in this chapter, shall be dealt with on a special basis and have special rates set for the particular business by the water/utility administrative staff, subject to review and approval by the city council. D. All property owners within an area served by a sanitary sewer system in the city of Edmonds are hereby directed and compelled to connect their private drains and sewers to the city system. Failure to do so within 30 days of written notice to connect by the city shall sub- ject the property owner to a monthly penalty equal to that charge imposed by subsections A, B, and/or C above. Said penalty shall be billed to the property owner, and they shall be subject to payment, collection and enforcement in all respects as though they were utility customers of the city. All penalties collected shall be con- sidered revenues of the sewer utility system. In addition to any other charges prescribed by this chapter, a special connection charge shall be paid by the owner of any property, res- idential dwelling unit, or other structure that may hereafter connect to the sanitary sewer improvements constructed by any local improvement district formed by the city and for which no assessment was imposed or charged under the said LID. The special con- nection charge for each property, residential dwelling unit, or other structure so connected shall be equal to the amount of the assessment 7.30.050 that would have been levied against such prop- erty, residential dwelling unit, or structure under the final assessment roll of the appropri- ate LID if the said property, residential dwell- ing unit, or other structure had been so assessed, together with interest thereon at the rate established by the ordinance authorizing issuance of the bonds for said LID, from the time of such authorization until the time of connection. The special connection charge shall be paid in a lump sum prior to connection to the sanitary sewer. The special connection charge provided for in this section shall apply only where the debt used to finance the local improvements has not yet been fully retired through assessment payments. If such debt has been fully retired through payment of such assessments, the special connection charge shall not apply. [Ord. 3332 § 1, 2000]. 7.30.050 Unauthorized use of water. It is unlawful for any person, firm, corpora- tion, or other organization of any type whatso- ever to take, or allow to be taken, water from the Edmonds water system without a valid per - 7 -12.3 (Revised 2/14) This page left intentionally blank. (Revised 2/14) 7-12.4 Edmonds City Code 7.50.060 7.50.050 Stormwater rates and charges. A. The city's public works director is hereby authorized to make adjustments to the city's stormwater utility rates as provided in this chapter in an amount up to 50 percent of the rate set in the preceding section in accordance with the following provisions: A. Upon written application to the public works director, a customer may request review of the city's stormwater management utility fee as applied to the specific developed prop- erty to which the fee has been charged. The applicant shall state the specific conditions and/or facilities on the site which the applicant feels warrants adjustment of the rate as applied to the property. B. On his own motion, the public works director may initiate review of a stormwater utility charge to any parcel. The public works director shall have the authority to increase or decrease rates up to 50 percent of the level set by the city council. The sole criteria for adjusting the rate shall be a determination that the physical characteristics of the site and in particular the stormwater detention, retention and/or treatment facilities as installed thereon by the owners, or lack thereof, have significantly increased the bur- den which the property places upon the city's stormwater utility (in the event of an increase) or significantly decreased the burden (in the event of a decrease) by providing additional benefits over and above those which the aver- age property places upon the utility through on-site improvements including but not lim- ited to on-site pollution control mechanisms or technologies which relate to water quality and the property's impact upon the city's stormwa- ter management system. Factors personal to the property owner, such as ability to pay, shall not be considered. D. The decision of the public works direc- tor shall be in writing. It may be appealed to the Edmonds city council for review. In that review process the determination of the direc- tor shall be given substantial weight and an applicant for decrease shall have the burden of proof. In the event the director has recom- mended an increase, the city staff shall have the burden of proof in the process. The deci- sion of the Edmonds city council shall be final and shall not be appealable. The city council 7-17 (Revised 2/14) 7.50.070 may either increase or decrease the rates within 50 percent of that set or may elect, in its sole discretion, to apply the rate as established by ordinance if the city council determined that such property does not differ substantially from other similarly situated ratepayers and their properties. In addition to any other charge pre- scribed by this chapter, a stormwater manage- ment system general facilities charge (GFC) (formerly known as a development charge) shall be paid by the applicant at the time and according to the date of building permit issu- ance in an amount per equivalent service unit (ESU) added to or created by the development as set forth in the table below; provided, that stormwater permit applicants shall pay GFC at the time and according to the date of stormwa- ter permit issuance. 2012 before 2012 effective 2014 and effective date date forward 2013 beyond Storm GFC per ESU $428.00 $613.50 $706.25 $799.00 B. All development not meeting the criteria in subsesction (B) of this section shall pay GFC calculated according to a ratio of one ESU per 3,000 square feet of new, replaced, or new plus replaced impervious surface area. When properly issued and displayed, a resi- dential parking permit (permit) shall exempt a specified vehicle, while parked within a spe- cific limited parking zone for which the permit was issued, from citation for parking longer than the posted time limit for that particular zone and no other; provided, that the permit shall not authorize parking for more than 72 consecutive hours in any one location or as specified specifically in this chapter. The per- mit shall not guarantee a parking space, nor shall it exempt the vehicle or operator from observing zones where parking is prohibited at all times, including but not limited to no park- ing zones, load zones, fire zones and all other applicable regulations contained in ECC Title 8. [Ord. 3606 § 1, 2006]. 8.52.020 8.52.015 Limitation on issuance. No permit authorized to be issued under this chapter shall be issued with respect to any commercial or recreational vehicle over 10,000 pounds licensed gross vehicle weight or 22 feet in length except as specifically allowed in this chapter. [Ord. 3606 § 1, 2006]. 8.52.020 Eligibility for residential parking permits. A. Eligibility. Permits may be issued only to persons who reside within the permit zone for which the permit is issued, who own and/or have legal control of a motor vehicle and only for those motor vehicles owned by or under the legal control of the resident. Permits may be issued to eligible persons who have insuffi- cient off-street parking spaces for the number of cars they own and/or control. For the pur- poses of this chapter, "residence" shall be defined as the street address of the structure in which the applicant resides as determined by the U.S. Postal Service or such other street upon which the residence fronts and for which the applicant can present adequate evidence that the proposed alternative frontage ade- quately reflects the actual orientation and loca- tion of the structure in which the applicant resides. B. The Proof of Residence. Proof of resi- dence shall be established by: 1. Display of a valid driver's license reflecting a current address within the zone for which the permit is issued; or 2. Display of a deed, lease, rental agree- ment or other acceptable document showing residency within the zone for which the permit is issued. C. Ownership of Motor Vehicle. Proof of ownership and/or control of a motor vehicle may be established by possession of a valid registration in the applicant's name, or by dis- play of a valid registration accompanied by proof that the applicant has legal use and con- trol of the vehicle. 8-27 (Revised 2/14) 8.52.030 D. Fees. 1. Fees for the permit shall be $25.00 for the first vehicle, $25.00 for the second vehicle and $25.00 for the third vehicle. No fee will be required for limited recreational vehicle per- mits. 2. Fees shall be collected prior to issu- ance of the permit. 3. No more than three permits shall be issued to any one residence. [Ord. 3958 § 1, 2014; Ord. 3606 § 1, 2006]. 8.52.030 Applications for permits. A. Authorization of City Clerk. The city clerk is hereby authorized to issue permits to qualified residents who own or have control of a motor vehicle, and who have insufficient off- street parking spaces. B. Application Form. Application shall be made on forms provided by the city clerk which shall include: 1. The name, address, telephone number and license number of the applicant; 2. Make, model, color and year of the registration of the vehicle for which the permit is sought; 3. The type of document used to estab- lish eligibility for the permit as required in ECC 8.52.020; 4. The number of off-street parking spaces available to the applicant; 5. License plate number (and state) of vehicle; 6. The number of visitor's permits requested and issued; and 7. A statement immediately above where the applicant is to sign stating that the applicant has been provided with an opportu- nity to examine this chapter and is familiar with the terms thereof. All applications shall be signed by the appli- cant and notarized. C. Limited Parking Zone Determination. The limited parking zone for which the permit is valid shall be the designated zone in which the permit holder resides but is prohibited on (Revised 2/14) 8-28 Main Street from Third Avenue to Sixth Ave- nue and Fifth Avenue from Bell Street to Wal- nut Street except between the hours of 6:00 p.m. and 9:00 a.m. Monday through Saturday. Three zones have been created and are as fol- lows: Red Zone — Caspers Street to Edmonds Street and Sunset Avenue to Sixth Avenue; Blue Zone — Edmonds Street to Dayton Street and Railroad Avenue to Sixth Avenue; Yellow Zone — Dayton Street to Pine Street and SR 104 to Sixth Avenue. D. Fees. 1. Fees for the permit shall be $25.00 for the first vehicle, $25.00 for the second vehicle and $25.00 for the third vehicle. No fee will be required for limited recreational vehicle per- mits. 2. Fees shall be collected prior to issu- ance of the permit. 3. No more than three permits shall be issued to any one residence. [Ord. 3958 § 1, 2014; Ord. 3885 § 1, 2012; Ord. 3606 § 1, 2006]. 8.52.040 Residential parking permits description. The permit shall contain the following information: A. The residential permit number; B. The expiration date of the permit; and C. Color of permit will designate limited parking zone, as set forth in ECC 8.52.030(C). [Ord. 3885 § 1, 2012; Ord. 3606 § 1, 2006]. 8.52.050 Use and validity of permits. A. Display. Residential permits shall be displayed in the upper left-hand corner of the vehicle's rear window on the outside of the glass. Visitor's permits shall be displayed face -up on the vehicle's dashboard. B. Validity. Permits shall be valid only for the vehicle for which they are issued, only in the zone designated and only so long as the permit holder retains the vehicle and resides at the address specified in his or her application. Edmonds City Code C. Expiration. Permits shall expire one year from the date of issue, so long as the permit holder retains the permit vehicle and resides at the address specified in his/her permit applica- tion. Permits issued for a recreational vehicle are limited to a period of 36 hours and no more than six permits may be issued for an individ- ual recreational vehicle in any one-year period. [Ord. 3885 § 1, 2012; Ord. 3606 § 1, 2006]. 8.52.060 Visitor's permits. A. The city clerk is hereby authorized to issue up to two visitor's permits per residential address, which shall be valid for a period of up to one year. Only one resident per residential address who can provide the proof of residence required by ECC 8.52.020(B) is eligible to receive the two visitor's permits. A "visitor" is defined as a guest of a person who resides within the permit zone; provided, that the guest is not a resident of the residential address for which the permit was issued. Only the visitor's vehicle is allowed to display the visitor's per- mit. B. The fee for visitor permits shall be: 1. Ten dollars per visitor's permit for an individual holding a valid residential parking permit; or 2. Twenty-five dollars per visitor's per- mit for persons who do not hold a valid resi- dential parking permit. Visitor's permits shall be issued in conjunc- tion with the issuance or renewal of a residen- tial parking permit for those individuals who hold a valid residential parking permit or for the calendar year or any unexpired portion thereof for other qualified applicants. Visitor's permits shall be issued by the city clerk to residents of Sunset Avenue, and the portion of 75th Place West, north of North Meadowdale Road, without showing a lack of off-street parking or vehicle ownership. Such 8.52.080 visitor's permits shall be issued at no cost to the applicant. Such visitor's permits shall be limited to two permits per household or resi- dence. These permits shall only be valid for parking after the posted hours on the west side of Sunset Avenue from Bell Street to Caspers Street. Such permits shall be valid on either side of 75th Place West, north of North Mea- dowdale Road. All other provisions of this chapter, where not inconsistent with this sec- tion, and the adopted parking regulations of the Revised Code of Washington shall apply. [Ord. 3606 § 1, 2006]. 8.52.070 Unlawful acts. It shall be unlawful for any person to do any of the following: A. To make any false or misleading state- ment in application for a permit; B. To transfer the permit to another person or vehicle; C. To fraudulently alter a permit or visitor's permit in any respect whatsoever; D. To improperly display the permit or vis- itor's permit or to violate any terms or condi- tions under which the permit or visitor's permit was issued; E. Use or place the permit on any other vehicle than that for which the permit is issued; or F. To use or permit to be used a revoked or suspended permit. [Ord. 3606 § 1, 2006]. 8.52.080 Revocation of permits. Permits and/or visitor's permits may be revoked by the city clerk for any of the follow- ing reasons: A. The permit holder has made any false, misleading or incomplete statement in the application; B. Violation of any of the provisions of this chapter; or C. Overissuance of permits; provided, however, that in the event of revocation for overissuance, priority shall be given to provid- ing one permit per dwelling unit. [Ord. 3606 § 1, 2006]. 8-29 (Revised 2/14) 8.52.090 8.52.090 Revocation — City clerk's duties. If the city clerk finds that a permit and/or visitor's permit should be revoked for any of the reasons set forth in ECC 8.52.080, the clerk shall send a written notice to the permit holder at the address contained on the application. The notice shall contain the following infor- mation: A. Advise the permit holder that the permit and/or visitor's permit will be revoked on a specified date which shall be not fewer than 10 nor more than 13 days from the date of the let- ter; B. Advise the permit holder that unless a written notice of appeal setting forth the rea- sons for the appeal is filed with the city clerk not later than the date set forth in subsection (A) of this section, the permit will be deemed revoked; C. Advise the permit holder that if a written notice of appeal is filed within the required time, the date, time and place of the hearing will be set; and D. The reasons for the revocation. [Ord. 3606 § 1, 2006]. 8.52.100 Appeal. Upon receipt of the appeal, the mayor or his designee shall set a date for hearing within 30 days of receipt of the notice of appeal and notify the appellant of the date, time and place of hearing. The mayor or his designee shall render the decision within 10 days after the hearing is closed, reduce the decision to writ- ing and include a statement of reasons for the decision. The mayor or his designee may affirm or reverse the revocation decision or order suspension for a specified period. [Ord. 3606 § 1, 2006]. 8.52.200 Penalties. Any person violating any of the provisions of this chapter shall be guilty of a misde- meanor and upon conviction thereof may be punished as set forth in ECC 5.50.020. [Ord. 3885 § 1, 2012; Ord. 3606 § 1, 2006]. (Revised 2/14) 8-30 8.52.300 Severability. If any section, subsection, clause, phrase or word of this chapter, or any provision adopted by reference in this chapter is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this chapter. Edmonds City Code Chapter 8.56 REGULATING TRAFFIC ON CERTAIN HIGHWAYS Sections: 8.56.010 Regulated truck ban. 8.56.020 Repealed. 8.56.030 Restrictions upon use of streets by certain vehicles. 8.56.010 Regulated truck ban. A. A regulated truck is any vehicle over 10,000 pounds gross vehicle weight the princi- pal use of which is the transportation of com- modities, merchandise, produce, freight, ani- mals, or passengers for hire excluding school buses, emergency vehicles, duly franchised solid waste disposal and recycling vehicles and public transit vehicles. All regulated trucks are prohibited from all city streets and alleys except upon the designated truck routes set forth below and except that such vehicles may be operated on other streets and alleys only for the purpose of pick up and delivery of materials and then only by entering such street at the intersection nearest the designation of the vehi- cle and proceeding thereon no further than the next intersection thereafter. B. The following streets or routes are hereby designated as the exclusive truck routes in the city of Edmonds: 1. SR -104; 2. Highway 99; and 3. 76th Street south of 196th Street to Highway 99. [Ord. 2849 § 1, 1991; Ord. 2377 § 1, 1983; Ord. 1169 § 91, 1966]. 8.56.020 Certain vehicles prohibited from use of certain streets. Repealed by Ord. 2849. 8.56.030 Restrictions upon use of streets by certain vehicles. The city traffic engineer is authorized to determine and designate those heavily traveled streets upon which shall be prohibited the use 8.56.030 of the roadway by motor -driven cycles, bicy- cles, horsedrawn vehicles or other nonmotor- ized traffic and shall erect appropriate signs giving notice thereof. When signs are so erected giving notice thereof, no person shall disobey the restric- tions stated on such signs. [Ord. 1169 § 93, 1966]. 8-30.1 (Revised 2/14) 8.60.010 Chapter 8.60 ENFORCEMENT Sections: 8.60.010 Penalties. 8.60.020 Disposition of traffic fines and forfeitures. 8.60.030 Official misconduct. 8.60.090 When warrant to be issued. 8.60.010 Penalties. Any person who has been found to have committed a traffic infraction, as defined by this code or any state statute adopted by refer- ence herein shall pay a monetary fine only not to exceed $1,000 for each violation. Unless otherwise provided in this municipal code, or by state statute adopted by reference, any per- son violating a criminal provision of this title shall be guilty of a misdemeanor with a maxi- mum sentence of $1,000 fine and/or 90 days in jail. [Ord. 2853 § 52, 1991; Ord. 2393, 1983; Ord. 1865 § 4, 1976; Ord. 1169 § 94, 1966]. 8.60.020 Disposition of traffic fines and forfeitures. All fines or forfeitures collected upon con- viction or upon forfeiture of bail of any person charged with the violation of any of the provi- sions of this title shall be paid to the general fund of the city. [Ord. 1865 § 5, 1976; Ord. 1169 § 95, 1966]. 8.60.030 Official misconduct. Failure, refusal, or neglect on the part of any judicial or other officer or employee receiving or having custody of any such fine or forfeiture or bail, either before or after a deposit in the general fund, to comply with the provisions of ECC 8.60.020 shall constitute misconduct in office and shall be grounds for removal there- from; provided appropriate action is taken pur- suant to state law relating to removal of public officials. Any ordinance which enacts a commis- sion recommendation shall be subject to Arti- cle XXX, Section 1 of the Washington State Constitution regarding increases in elected officials' compensation during their term of office. The mayor and councilmembers shall receive reimbursement for their action and necessary expenses incurred in the perfor- mance of the duties of their office, or the coun- cil by ordinance may provide for a per diem allowance. Procedure for approval of claims for expenses shall be as provided by ordinance, consistent with state law. There is hereby established an Edmonds historic preservation commission, consisting of 12 voting members, as provided in ECC 10.90.020. Members of the Edmonds historic preservation commission shall be appointed by the mayor and approved by the city council. All appointments shall be residents of Edmonds, except as expressly provided in ECC 10.90.020(B). [Ord. 3870 § 1, 2012; Ord. 3669 § 1, 2007; Ord. 3392 § 1, 2002]. 10.90.020 Composition of the commission. A. All members of the commission must have a demonstrated interest or competence in historic preservation and possess qualities of impartiality and broad judgment. B. The commission shall consist of 12 vot- ing members and one nonvoting, ex officio position to be filled by Edmonds city council members. The commission shall include at least two professionals who have experience in identifying, evaluating, and protecting historic resources and are selected from among the dis- ciplines of history, architecture, architectural history, historic preservation, planning, cul- tural anthropology, archaeology, cultural geography, American studies, law, and/or real estate. Six positions shall be filled by citizens of Edmonds with demonstrated interest in his- toric preservation. One position shall be filled as recommended by the Edmonds South Sno- homish County Historical Society. A commis- sion action that would otherwise be valid shall 10-27 (Revised 2/14) 10.90.030 not be rendered invalid by the temporary vacancy of one or all of the professional posi- tions, unless the commission action is related to meeting certified local government (CLG) responsibilities cited in the certification agree- ment between the mayor and the historic pres- ervation officer. Furthermore, in special circumstances, exceptions to the residence requirement of commission members may be granted by the mayor and the city council in order to obtain representatives from those dis- ciplines. The original appointment of members to the commission shall be as follows: three for two years, two for three years, and two for four years. Thereafter, appointments shall be made for a three-year term. Vacancies shall be filled by the mayor for the unexpired term in the same manner as the original appointment. [Ord. 3392 § 1, 2002]. 10.90.040 Powers and duties. The major responsibility of the historic preservation commission is to identify and actively encourage the conservation of the city's historic resources by initiating and maintaining a register of historic places and reviewing proposed changes to register prop- erties; to raise community awareness of the city's history and historic resources; and to serve as the city's primary resource in matters of historic planning and preservation. In carrying out these responsibilities, the historic preservation commission shall engage in the following: A. Conduct and maintain a comprehensive inventory of historic resources within the boundaries of the city and known as the Edmonds historic inventory; publicize and periodically update inventory results. Proper- ties listed on the inventory shall be recorded on official zoning records with a "HI" (for his- (Revised 2/14) 10-28 toric inventory designation). This designation shall not change or modify the underlying zone classification. B. Initiate and maintain the Edmonds regis- ter of historic places. This official register shall be compiled of buildings, structures, sites, objects and districts identified by the commis- sion as having historic significance worthy of recognition and protection by the city and encouragement of efforts by owners to main- tain, rehabilitate and preserve properties. C. Review nominations to the Edmonds register of historic places according to criteria in ECDC 20.45.010 and adopt standards in its rules to be used to guide this review and the issuance of a certificate of appropriateness or waiver. D. Review proposals to construct, change, alter, modify, remodel, move, demolish or sig- nificantly affect properties or districts on the register as provided in Chapter 20.45 ECDC and adopt standards in its rules to be used to guide this review and the issuance of a certifi- cate of appropriateness or waiver. E. Provide for the review either by the com- mission or its staff of all applications for approvals, permits, environmental assess- ments or impact statements, and other similar documents pertaining to identified historic resources or adjacent properties. F. Conduct all commission meetings in compliance with Chapter 42.30 RCW, Open Public Meetings Act, to provide for adequate public participation and adopt standards in its rules to guide this action. G. Participate in, promote and conduct pub- lic information, educational and interpretive programs pertaining to historic and prehistoric resources. H. Establish liaison support, communica- tion and cooperation with federal, state and other local government entities which will fur- ther historic preservation objectives, including public education, within the city. I. Review and comment to the city council on land use, housing and redevelopment, Edmonds City Code municipal improvement and other types of planning and programs undertaken by any agency of the city, other neighboring commu- nities, Snohomish County, the state or federal governments, as they relate to historic resources of the city. J. Advise the city council and chief local elected official generally on matters of historic planning and preservation. K. Perform other related functions assigned to the commission by the city council or chief local elected official. L. Provide information to the public on methods of maintaining and rehabilitating his- toric properties. This may take the form of pamphlets, newsletters, workshops or similar activities. M. Officially recognize excellence in the rehabilitation of historic buildings, structures, sites and districts, and new construction in his- toric areas; and encourage appropriate mea- sures for such recognition. N. Be informed about and provide informa- tion to the public and city departments on incentives for preservation of historic resources including legislation, regulations and codes which encourage the use of adaptive reuse of historic properties. O. Review nominations to the State and National Registers of Historic Places. P. Investigate and report to the city council on the use of various federal, state, local or pri- vate funding sources available to promote his- toric resource preservation in the city. Q. Serve as the local review board for spe- cial valuation and: 1. Make determinations concerning the eligibility of historic properties for special val- uation; 2. Verify that the improvements are con- sistent with the Washington State Advisory Council's standards for rehabilitation and maintenance; 3. Enter into agreements with property owners for the duration of the special valuation period as required under WAC 254-20-070(2); 10.90.060 4. Approve or deny applications for spe- cial valuation; 5. Monitor the property for continued compliance with the agreement and statutory eligibility requirements during the 10 -year special valuation period; and 6. Adopt bylaws and/or administrative rules and comply with all other local review board responsibilities identified in Chapter 84.26 RCW. R. The commission shall adopt rules of pro- cedure to address subsections (C), (D), (F), (0) and (Q) of this section. [Ord. 3951 § 1, 2013; Ord. 3392 § 1, 2002]. 10.90.050 Rules and officers. The commission shall establish and adopt its own rules of procedure, and shall select from among its membership a chairperson and such other officers as may be necessary to con- duct the commission's business. Commission and professional staff assis- tance shall be designated by the mayor with additional assistance and information to be provided by other city departments as may be necessary to aid the commission in carrying out its duties and responsibilities under this chapter. [Ord. 3392 § 1, 2002]. 10-29 (Revised 2/14) 10.95.010 Chapter 10.95 CITIZENS' TREE BOARD Sections: 10.95.010 Board created —Membership. 10.95.020 Officers of board — Meetings — Forum. 10.95.030 Powers and duties. 10.95.010 Board created — Membership. A. There is hereby created a citizens' tree board consisting of up to seven members plus one alternate and one nonvoting, ex officio position to be filled by an Edmonds city coun- cil member. Citizens must be Edmonds resi- dents. It is recommended the board include citizens from throughout the city (representing different watersheds and neighborhoods). Additionally, those with professional or hob- byist interest/experience in urban forestry, horticulture, and habitat enviroscaping are pre- ferred; these may include arborists, botanists, horticulturists, native plant experts, master gardeners, wildlife experts, and related. The members shall be appointed in the following manner: Within 30 days after the ordinance codified in this chapter is passed, the city shall draft and publish an announcement seeking applicants for board membership. The stan- dard city of Edmonds citizen board and com- mission application will be used. Prospective board members will have 30 days to submit their application. Initially, each councilmem- ber will appoint one tree board member within 30 days following the close of the application period. The alternate member shall be appointed by the council president or mayor (as determined by the council). The selections shall be made based on the qualifications described per the applications; councilmem- bers may also interview applicants at their dis- cretion. Subsequent to the initial appointments, recommendations for renewal/replacements, when required, will be made by the full council. (Revised 2/14) 10-30 B. The term of appointment shall be four years. However, initially, to ensure transitional consistency three members shall be appointed to four-year terms and four members (plus the alternate) shall be appointed to two-year terms. Councilmembers whose terms expire in 2011 shall appoint members to initial two-year terms. Councilmembers whose terms expire in 2013 shall appoint members to initial four- year terms. Thereafter, appointments shall coincide with the terms of newly elected coun- cilmembers. Each member, at his or her discre- tion, may seek renewal for one additional term. Should a vacancy occur, a new member shall be appointed for the duration of the term he or she is fulfilling. Members of the commission shall meet and organize by election, from the members of the board, a chair and vice chair and other officers as may be determined by the board. It shall be the duty of the chair to preside at all meetings. The vice chair shall perform this duty in the absence of the chair. A majority of the filled positions on the board shall constitute a quo- rum for the transaction of business. The board is expected to meet monthly or as otherwise agreed to by the board. The regular public meeting of the board shall be held at such time or place as may be determined by the chair or a majority of the members of the board.
