As authorized by Chapter 35.87A RCW, there is hereby established an Edmonds down- town business improvement district ("EDBID") within the following boundaries as shown on the map attached to the ordinance codified in this chapter as "Attachment A" (when a street or alley is named, the area boundary is the centerline of the right-of-way including vacated portions unless otherwise specified in the description). The EDBID includes the parcels with the tax ID numbers set forth in Attachment B to the ordinance cod- ified in this chapter, which is incorporated herein as if set forth in full (for additional detail, please see the attached map). In case of a conflict between the list of parcels (Attach- ment B) and the map (Attachment A), the map shall control. [Ord. 3909 § 1, 2013]. 3.75.020 Levy of assessments. To finance the programs authorized in ECC 3.75.030, the owners and operators of busi- nesses (collectively, "members") in the 3.75.030 EDBID described in ECC 3.75.010 shall pay and be subject to a special assessment in the amount listed in Table 1 below. The assess- ment shall be measured by the type and square footage of the business, subject to calculations and limitations in ECC 3.75.040. Residential properties and the residential component of mixed-use properties shall not be subject to the special assessments. Commercial properties, or the portions thereof, that are vacant (do not contain a business) shall not be assessed. [Ord. 3909 § 1, 2013]. 3.75.030 Programs. Assessment revenues may be used for any combination of the following component pro- grams, but not for any other purpose: A. Marketing and Hospitality. 1. Maps/brochures/kiosks/directories. 2. Web site. 3. Social media. 4. Marketing/advertising campaigns. 5. Holiday decorations. 6. Street performers/artists. 7. Historic education/heritage advo- cacy. 8. Special public events. B. Safety and Cleanliness. 1. Maintenance. 2. Security. 3. Pedestrian environment enhance- ments. C. Appearance and Environment. 1. Design enhancements. 2. Neighborhood advocacy and commu- nication. 3. [Ord. 3909 § 1, 2013]. 3.75.040 Assessment methodology. The special assessment amount shall be based on the type of business multiplied by the square footage of a business. There shall be two business classifications for the purposes of calculating the assessment: "open door" busi- nesses (e.g., restaurants, retailers, banks, etc.); and "by appointment" businesses (e.g., hair salons, doctors, lawyers, nail salons, insurance providers, counselors, financial advisors, etc.). Open door establishments are assessed at a higher rate than by appointment businesses due to the relatively higher benefit that open door businesses are expected to receive from the programs. Table 1 shows the annual assess- ment for both classifications of businesses based on their square footage within the EDBID. Changes in the assessment rate shall only be made by ordinance and as authorized by state law. [Ord. 3909 § 1, 2013]. 3.75.060 Deposit of revenues. The city of Edmonds will create a business improvement district fund within the city of Edmonds budget; a separate subaccount desig- nated as the Edmonds downtown business improvement district account (called "the account"). The following monies shall be deposited in the account: A. All revenues from assessments levied under this chapter; B. Gifts, grants and donations; C. Interest and all other income from the investment of account deposits; D. Reimbursements due to the account; E. Delinquency charges from delinquent accounts; and F. Transfers from other city funds; pro- vided, that liabilities of the EDBID shall not be an obligation of the general fund or any other special fund of the city. [Ord. 3929 § 1 (Att. Assessments shall be paid and collected on a quarterly basis; provided, that members may opt to pay the full yearly assessment at the time of the billing for the first quarter. [Ord. 3929 § 1 (Att. Businesses established after the effective date of April 22, 2014, and located within the Edmonds downtown business improvement district shall be exempt from special assess- ments imposed pursuant to this chapter for a period of one year from the date a business license is issued by the city of Edmonds. [Ord. 3965 § 1, 2014]. Edmonds City Code 3.75.080 Delinquent payments. If the assessment is not paid within 60 days after its due date, a delinquency charge shall be added and calculated at an interest rate of 12 percent per annum of the due amount. The finance director is authorized to use a city of Edmonds approved collection agency to col- lect any unpaid assessments. Use of a collec- tion agency will result in a business paying the agency's fee on top of the amount of the BID assessment plus delinquency charges. [Ord. 3929 § 1 (Att. No pool or billiard room license shall be granted under this chapter to any person, firm or corporation who has been convicted in the municipal court of the city of Edmonds of vio- lating any of the provisions of this chapter or of any ordinance of the city relating to disor- derly conduct or of any ordinance of the city relating to intoxicating liquors, drugs or con- trolled substances, or who has been convicted in any state or federal court relating to gam- bling or the manufacturing, possession, sale, barter, exchange, giving away, furnishing or otherwise disposing of or keeping intoxicating liquor, drugs or controlled substances. The license of any person, corporation, partnership, firm or other association may be cancelled and revoked by the city council upon any one or more of the following grounds: 1. Violation of any provision of this chapter, or other city ordinance having a direct relationship to public health or safety, or pro- tection of property, as may pertain to the activ- ity licensed herein. 2. In the event the licensed activity becomes a public nuisance or private nuisance affecting persons residing in or otherwise occupying property in the same general neigh- borhood. 3. False or misleading statements made in the application for license. 4. Conviction of any offense specified in ECC 4.24.040. B. Notice of the date, time and place of the meeting at which the council will consider revocation of the license shall be mailed by the city clerk to the licensee at least 10 days prior 4.24.100 to the meeting addressed to the licensee as shown on the license application form. Every person, firm or corporation found guilty of violating any of the terms of this chapter shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished as set forth in ECC 5.50.020. [Ord. 2173 § 1, 1980; Ord. 556 § 6, 1946]. 4-17 (Revised 6/14) 4.26.010 Chapter 4.26 MARIJUANA LICENSES ISSUED BY THE STATE Sections; 4.26.010 Processing of notices of pending marijuana licenses. 4.26.010 Processing of notices of pending marijuana licenses. A. Investigation by Mayor. Upon receipt by the city of a notice of a marijuana license application from the Washington State Liquor Control Board to produce, process, or sell mar- ijuana within the city of Edmonds, the mayor shall make such investigation of the applicant and location as he deems appropriate, includ- ing but not limited to directing an investigation by city employees such as the police depart- ment. B. Notification and Recommendation to City Council. The mayor shall transmit to the city council a recommendation of approval or objection regarding both the applicant and the proposed location. The recommendation shall be considered at the first available city council meeting following conclusion of the mayor's investigation, but in no event shall it be consid- ered by the city council later than 19 days after the date of the notice from the Liquor Control Board. The city council, sitting in public meet- ing, shall thereupon consider and vote upon the recommendation of the mayor. C. Approval/Acquiescence. In the event the city council finds the application acceptable, it shall instruct the mayor to transmit the city council's approval to the Liquor Control Board. D. Objection. In the event the city council finds the application objectionable, it shall instruct the mayor to transmit to the Liquor Control Board the objections had by the coun- cil against the applicant or against the premises for which the license is asked, and shall include in such instructions the facts upon which such objections are based. In the event the council has found objection to the application it shall also determine whether it would like to request an adjudicative hearing before final action is taken on the license by the Liquor Control Board. If the city council would like a hearing, it shall direct the city attorney to make the oral argument in support of such objections in the event the Liquor Control Board fixes a time for oral argument. F. Request for Extension of Time to Con- sider Application. In the event the city council may not have a public hearing scheduled within the 19 -day period following the trans- mittal of the notice from the Liquor Control Board, upon receipt of the notice from the Liquor Control Board the mayor shall immedi- ately request an extension of the 20 -day period from the Liquor Control Board to provide time for the council to register its approval or objec- tions. A. "Person" shall mean any individual, firm, corporation, partnership or unincorpo- rated association. B. "Police chief' and "fire chief' shall include his/her designee. C. "Public amusement" means circuses, carnivals, motion picture shows, exhibitions, concerts, side shows, vaudeville, amusement parks and any other form of diversion, pastime or recreation conducted for and open to the public regardless of whether an admission fee or other charge is made for attendance; pro- vided, however, that nothing herein shall require the licensing and inspection of an activity conducted under the auspices of a bona fide, accredited grade school, middle school, high school or college and conducted on the premises thereof in facilities previously inspected and approved for public assembly. [Ord. 2671, 1988; Ord. 2653 § 1, 1988; Ord. 2175 § 1, 1980]. 4.32.020 License required — Exceptions. A. No person shall conduct any public amusement within the city of Edmonds until he has first obtained a license therefor and has paid all fees required by this chapter. 4.32.040 B. No fee shall be required for the applica- tion of a nonprofit, charitable or religious com- munity organization. [Ord. 2671, 1988; Ord. 2175 § 1, 1980]. 4.32.030 Procedure. A. Persons required to obtain licenses shall make application to the city clerk on forms provided therefor. B. The application shall contain the follow- ing information: 1. The name, address and telephone number of the person requesting the license, and if other than a natural person, the names of all officers and/or partners. 2. The type of public amusement, dura- tion and hours of operation, and location. A sketch showing the location, size and arrange- ment of facilities shall be included with the application. 3. The number of employees and the number of expected customers. 4. Such other information as required by the city clerk in order to carry out the intent of this chapter (such as insurance) as may be required. C. Upon receipt of the license fee as pro- vided for in this chapter, the city clerk shall forward the completed application to the police chief and fire chief for their investiga- tion and review. [Ord. 2671, 1988; Ord. 2175 § 1, 1980]. 4.32.040 Police/fire investigation — Approval. A. Upon receipt of the application, the police chief shall investigate the applicant to determine the level of service required to assure public safety, and the financial and criminal background of the applicant, if any. The fire chief will investigate the proposed premises to insure that fire and life safety requirements are being met. Upon completion of the investigation, the police/fire chief shall either approve the license application, disap- prove the license application, or approve the 4-18.1 (Revised 6/14) This page left intentionally blank. (Revised 6/14) 4-18.2 Edmonds City Code or portions of streets where appropriate, con- sidering the following factors: 1. The number of vehicles using the street or portion of the street. 2. The speed of vehicles utilizing the street. 3. The width of the street. 4. The time of day the street has been utilized for play. 5. The number of people using the street for play. 6. The danger of accidents occurring as a result of play in the streets. [Ord. 2373, 1983]. 8.32.030 One-way streets and alleys. Upon those streets and parts of streets and in those alleys described in ECC 8.64.010, vehic- ular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and maintained at every intersection where movement in the opposite direction is prohibited, and a vehicle passing around a rotary traffic island shall be driven only to the right of such island. [Ord. 1169 § 31, 1966]. 8.32.040 Railroad trains not to block streets. It is unlawful for the directing officer or the operator of any railroad train to direct the oper- ation of or to operate the same in such a manner as to prevent the use of any street for purposes of travel for a period of time longer than five minutes, except that this provision shall not apply to trains or cars in motion other than those engaged in switching. [Ord. 1169 § 48, 1966]. 8.32.050 Compression brakes prohibited. No person shall use motor vehicle brakes which are in any way activated or operated by the compression of the engine of any such motor vehicle or any component part thereof. 8.32.060 A. It shall be an affirmative defense to pros- ecution under this section that compression brakes were applied in an emergency and were necessary for the protection of persons and/or property. B. Bona fide emergency vehicles owned by a public entity and equipped and licensed in compliance with state law shall be exempt from the provisions of this section. [Ord. 3186 § 1, 1998; Ord. 1986 § 1, 1978]. 8.32.060 Alcoholic beverages in vehicles. It is a traffic infraction: A. For any person to drink any alcoholic beverage in a motor vehicle when the vehicle is upon a highway; B. For any person to have in his possession while in a motor vehicle upon a highway, a bottle, can, or other receptacle containing alco- holic beverage if the container has been opened or a seal broken or the contents par- tially removed; or C. For the registered owner of a motor vehi- cle, or the driver if the registered owner is not then present in the vehicle, to keep in a motor vehicle when the vehicle is upon a highway, a bottle, can, or other receptacle containing an alcoholic beverage which has been opened or a seal broken or the contents partially removed, unless the container is kept in the trunk of the vehicle or in some other area of the vehicle not normally occupied by the driver or passengers if the vehicle does not have a trunk. A utility compartment or glove compartment is deemed to be within the area occupied by the driver and passengers. This section does not apply to a public con- veyance that has been commercially chartered for group use or to the living quarters of a motor home or camper or, except as otherwise provided by the Edmonds City Code, to any passenger for compensation in a for -hire vehi- cle licensed under city, county, or state law. [Ord. 2409 § 1, 1983]. 8-11 (Revised 6/14) 8.32.070 8.32.070 Avoiding compliance with traffic devices prohibited. A. No person shall drive a motor vehicle over private property in order to avoid compli- ance with a traffic -control device. B. Any person violating the provisions of this section shall have committed a traffic infraction, punishable as an unscheduled infraction pursuant to Infraction Rules for Courts of Limited Jurisdiction (IRLJ) Rule 6.2(b), plus all statutory assessments. [Ord. 3971 § 1, 2014; Ord. 2788 § 1, 1990]. 8.32.080 Penalty. Unless otherwise provided by state statute, adopted by reference, court rule or by this municipal code, any person violating any pro- vision of this chapter shall be guilty of a traffic infraction and shall be sentenced to a fine not to exceed $1,000 for each offense. (Revised 6/14) 8-12 Chapter 8.36 MOTORIZED FOOT SCOOTERS Sections: 8.36.010 Motorized foot scooters. 8.36.020 Seizure and forfeiture. 8.36.030 Penalty. 8.36.010 Motorized foot scooters. A. Definition. "Motorized foot scooter" means a device with no more than two 10 -inch or smaller diameter wheels that has handle- bars, is designed to be stood or sat upon by the operator, and is powered by an internal com- bustion engine that is capable of propelling the device with or without human propulsion. B. Duty to Obey Traffic Control Devices and Rules of the Road. Any person operating a motorized foot scooter shall obey all rules of the road applicable to vehicle or pedestrian traffic, as well as the instructions of official traffic -control signals, signs and other control devices applicable to vehicles, unless other- wise directed by a police officer. C. Unsafe Use Prohibited. No motorized foot scooter shall be ridden in a negligent or unsafe manner but shall be operated with rea- sonable regard for the safety of the operator and other persons. D. Prohibited Areas. Motorized foot scoot- ers are prohibited from being operated: 1. On sidewalks within the city limits; 2. In city parks; and 3. On multiple -use trails including bicy- cle paths, bikeways, equestrian trails, hiking trails and recreation trails, except where such trails are specifically marked stating that such use is permitted. E. Minimum Age Requirements. No motorized foot scooter shall be operated on streets, sidewalks or other public areas not oth- erwise prohibited by this section to motorized foot scooters unless the operator is at least 16 years of age. [Ord. 3166 § 3, 1997]. 10.75.010 Chapter 10.75 CITIZENS ECONOMIC DEVELOPMENT COMMISSION Sections: 10.75.010 Commission created — Membership — Term of appointments. 10.75.020 Officers of commission — Meetings — Forum. 10.75.030 Powers and duties. 10.75.010 Commission created — Membership — Term of appointments. A. There is hereby created a citizens eco- nomic development commission consisting of up to 17 members. The commission shall auto- matically expire December 31, 2015. B. The members of the commission shall be appointed in the following manner: 1. Each council member may appoint up to two members. 2. The mayor may appoint up to three members. 3. In the event that any commissioner resigns or fails to attend three consecutive commission meetings, that position may be deemed vacant by the holder of the office that appointed the commissioner (e.g., mayor or council member) and such office holder may appoint a replacement commissioner for the remainder of the unexpired term for that posi- tion. 4. Elected government officials shall not be eligible for appointment to the commission; provided, that the city council president may appoint up to two council members to serve as nonvoting, ex officio members of the commis- sion; and further provided, that the Edmonds port commission may also appoint one of its members to serve as a nonvoting, ex officio member of the commission. 5. Members of the commission must be residents of the city of Edmonds. 10-25 (Revised 6/14) 10.75.020 6. If a commissioner satisfied the eligi- bility criteria in effect upon his/her appoint- ment to the commission but fails to maintain his/her eligibility either through an amend- ment of the eligibility criteria or due to a change of circumstances surrounding the com- mission (e.g., change of residency) after his/her appointment, that commissioner shall lose his/her seat on the commission as a matter of law and the seat shall be deemed vacant. 7. Any vacancy on the commission will be advertised, and the new appointee will be selected from the applications received. C. Commissioner terms shall be staggered such that all members of the commission as of December 31, 2011, shall have their terms expire on December 31, 2012. All members appointed during 2012 shall have their terms expire on December 31, 2014. All members appointed during 2013 or later shall have their terms expire on December 31, 2015. Members of the commission shall meet and organize by electing from the members of the commission a chairman and vice-chairman and such other officers as may be determined by the commission. It shall be the duty of the chair- man to preside at all meetings. The vice-chair- man shall perform this duty in the absence of the chairman. A majority of the filled positions on the commission shall constitute a quorum for the transaction of business. A majority of the quorum may transact any particular busi- ness of the commission. The regular public meeting of the commission shall be held at such time or place as may be determined by the chairman or a majority of the members of the commission. The commission is empowered to advise and make recommendations to the mayor and city council, and as appropriate to the planning commission, architectural design board or other boards or commissions of the city on such matters as may be specifically referred to the commission by the mayor or city council, including but not limited to: 1. Determining new strategies for eco- nomic development within the city of Edmonds; 2. Identifying new sources of revenue as a direct result of economic development proj- ects for the consideration of the city council. B. The commission shall deliver an annual report to the city council in written and oral form on or about the first meeting in December of every year, and when appropriate, during other times as directed by the mayor or council. C. The Edmonds economic development commission may from time to time provide its reports and recommendations regarding strate- gies for economic development and other mat- ters that will improve commercial viability, tourist development and activity within the city. The planning board and economic devel- opment commission shall make joint recom- mendations on such subjects to the city council on or about the first meeting in December. [Ord. 3876 § 1 (Att. Edmonds City Code Chapter 10.80 CITIZENS' COMMISSION ON COMPENSATION OF ELECTED OFFICIALS Sections: 10.80.010 Purpose. 10.80.020 Duties. 10.80.030 Eligibility. 10.80.040 Appointment. 10.80.050 Operation. 10.80.060 Compensation schedule. 10.80.065 Effective date of salary increases and decreases. 10.80.070 Open meetings. 10.80.080 Referendum. 10.80.090 Reimbursement unaffected. 10.80.100 Waiver of compensation by city councilmembers and mayor. 10.80.010 Purpose. It is the policy of the city of Edmonds to base the compensation of the city's elected officials on realistic standards so that elected officials of the city may be compensated according to the duties of their offices, and so that citizens of the highest quality may be attracted in public service. To effectuate this policy, the Edmonds' citizens' commission on the compensation of elected officials ("com- pensation commission") is hereby created con- sisting of seven members with duties and responsibilities as set forth below. [Ord. 3967 § 1, 2014; Ord. 3508 § 1, 2004]. 10.80.020 Duties. The compensation commission shall study the relationship of compensation for each respective position. Except as provided other- wise below, the compensation commission shall be solely responsible for its own organi- zation, operation, and action and shall enjoy the fullest cooperation of all elected officials, departments and agencies of the city of Edmonds. For the purposes of this chapter, the term "compensation" shall include salary, 10.80.040 wages, health insurance, allowances, benefits, and other forms of remuneration commonly received in return for services. [Ord. 3967 § 2, 2014; Ord. 3508 § 1, 2004]. 10.80.030 Eligibility. The compensation commission shall consist of seven members, all of whom must be at least 21 years of age, registered to vote, and main- tain personal residence within the boundaries of the city of Edmonds. No city of Edmonds officer, official or employee, nor any immedi- ate family member of such officer, official or employee, shall be eligible for membership on the compensation commission. As used in this section, the phrase "immediate family" means parents, spouse, siblings, children, or depen- dent relative of the official or employee, whether or not they are living in the same household. [Ord. 3967 § 3, 2014; Ord. 3508 § 1, 2004]. 10.80.040 Appointment. All members of the compensation commis- sion shall be appointed by the mayor subject to city council confirmation. The members of the compensation commission shall serve four- year terms originally commencing on October 1, 1999, except that the first seven members shall be appointed for different terms as fol- lows: (A) one member appointed by the city council for a period of four years; (B) one member appointed by the city council for a period of two years; (C) two of the members selected by those three members to serve for periods of four years; and (D) two of the mem- bers elected by those three members to serve for periods of two years. No person may serve more than two consecutive terms. Members of the compensation commission may be removed by the mayor, with the approval of the council, only for cause of incapacity, incompetence, neglect of duty, malfeasance in office, or for a disqualifying change of eligibil- ity. The unexcused absence of any member of the commission from two consecutive meet - 10 -27 (Revised 6/14) 10.80.050 ings of the commission shall constitute relin- quishment of that person's membership on the commission. Such relinquishment creates a vacancy in that person's position on the com- mission. Upon a vacancy in any position on the commission, a successor shall be selected and appointed to fill the unexpired term. Notwith- standing the appointment provisions herein, commissioners that were appointed under a previous process shall be allowed to complete their terms. [Ord. 3967 § 4, 2014; Ord. 3508 § 1, 2004]. 10.80.050 Operation. The members of the compensation commis- sion shall elect a chair from among their num- ber. Except as provided below, the election of the chair and other decisions of the compensa- tion commission shall require an affirmative vote of a simple majority of the commission. The commission shall prepare and approve a compensation schedule by an affirmative vote of not less than a simple majority of the com- mission plus one member. Members of the commission shall receive no compensation for their services. If the commission is not able to approve the compensation schedule by an affirmative vote of a simple majority of the commission plus one member, then the previ- ous schedule, or the substantial equivalent thereof, shall be deemed to remain in effect. [Ord. 3967 § 5, 2014; Ord. 3508 § 1, 2004]. 10.80.060 Compensation schedule. Once approved, the commission shall file its compensation schedule for elected officials of the city with the city clerk no later than the first Monday in August of each even -numbered year. The signature of the chair of the commis- sion shall be affixed to each schedule submit- ted to the city clerk. The chair shall certify that the schedule has been adopted in accordance with the provisions of this chapter and with the rules, if any, of the commission. The clerk shall publish a notice on the city's website that the compensation schedule has been filed. (Revised 6/14) 10-28 Such schedules shall be incorporated into the city or town budget without further action of the city council or salary commission except that when the city council adopts the budget, it must do so without amending such schedules. [Ord. 3967 § 6, 2014; Ord. 3508 § 1, 2004]. 10.80.065 Effective date of salary increases and decreases. All salary increases established by the com- mission shall be effective on January 1 st of the year after the schedule was approved; pro- vided, however, that any compensation decreases approved by the compensation com- mission shall only become effective upon commencement of the subsequent term of the applicable office. [Ord. 3967 § 7, 2014]. 10.80.070 Open meetings. All meetings, actions, hearings, and busi- ness of the commission shall be subject to the Open Public Meetings Act as set forth in Chap- ter 42.30 RCW. Prior to the filing of any com- pensation schedule, the commission shall hold no fewer than two public hearings thereon within the four months immediately preceding the filing of its compensation schedule. Any ordinance enacting change in compen- sation shall be subject to referendum petition by the citizens in accordance with city ordi- nance. Any ordinance which enacts a compen- sation schedule shall be subject to Article XXX, Section 1 of the Washington State Con- stitution regarding increases in elected offi- cials' compensation during their term of office. City councilmembers and the mayor may voluntarily waive and elect not to be paid all or any portion of the compensation during his or her term of office. Notice of waiver must be: 1. In writing and delivered to the city treasurer prior to the effective date; and 2. Signed by the individual and his or her spouse, if married, as required by RCW 49.48.100. Signature(s) shall be before a notary public. B. Compensation waived under the notice of waiver is irrevocably donated to the city of Edmonds. Officials may not seek back pay to recover compensation waived under the notice of waiver. C. It shall be presumed that compensation or portions of compensation that are declined or waived pursuant to this section shall be unrestricted in its use by the city; provided, that this presumption may be rebutted by the councilmember or the mayor directing in writ- ing that his or her waived compensation be uti- lized for a specific city purpose. D. The waiver shall be effective for all compensation earned following the effective date and continue in effect until withdrawn by a writing signed by the individual or the indi- vidual's spouse delivered to the city treasurer. [Ord. 3967 § 11, 2014]. 10.90.020 Chapter 10.90 EDMONDS HISTORIC PRESERVATION COMMISSION Sections: 10.90.010 Creation and size. 10.90.020 Composition of the commission. 10.90.030 Terms. 10.90.040 Powers and duties. 10.90.050 Rules and officers. 10.90.060 Commission staff. 10.90.010 Creation and size. There is hereby established an Edmonds historic preservation commission, consisting of 12 voting members, as provided in ECC 10.90.020. Members of the Edmonds historic preservation commission shall be appointed by the mayor and approved by the city council. All appointments shall be residents of Edmonds, except as expressly provided in ECC 10.90.020(B). [Ord. 3870 § 1, 2012; Ord. 3669 § 1, 2007; Ord. 3392 § 1, 2002]. 10.90.020 Composition of the commission. A. All members of the commission must have a demonstrated interest or competence in historic preservation and possess qualities of impartiality and broad judgment. B. The commission shall consist of 12 vot- ing members and one nonvoting, ex officio position to be filled by Edmonds city council members. The commission shall include at least two professionals who have experience in identifying, evaluating, and protecting historic resources and are selected from among the dis- ciplines of history, architecture, architectural history, historic preservation, planning, cul- tural anthropology, archaeology, cultural geography, American studies, law, and/or real estate. Six positions shall be filled by citizens of Edmonds with demonstrated interest in his- toric preservation. One position shall be filled as recommended by the Edmonds South Sno- homish County Historical Society. A commis- sion action that would otherwise be valid shall 10-28.1 (Revised 6/14) 10.90.030 not be rendered invalid by the temporary vacancy of one or all of the professional posi- tions, unless the commission action is related to meeting certified local government (CLG) responsibilities cited in the certification agree- ment between the mayor and the historic pres- ervation officer. Furthermore, in special circumstances, exceptions to the residence requirement of commission members may be granted by the mayor and the city council in order to obtain representatives from those dis- ciplines. The original appointment of members to the commission shall be as follows: three for two years, two for three years, and two for four years. [Ord. 3392 § 1, 2002]. 10.90.040 Powers and duties. The major responsibility of the historic preservation commission is to identify and actively encourage the conservation of the city's historic resources by initiating and maintaining a register of historic places and reviewing proposed changes to register prop- erties; to raise community awareness of the city's history and historic resources; and to serve as the city's primary resource in matters of historic planning and preservation. In carrying out these responsibilities, the historic preservation commission shall engage in the following: A. Conduct and maintain a comprehensive inventory of historic resources within the boundaries of the city and known as the Edmonds historic inventory; publicize and periodically update inventory results. Proper- ties listed on the inventory shall be recorded on official zoning records with a "HI" (for his- (Revised 6/14) 10-28.2 toric inventory designation). This designation shall not change or modify the underlying zone classification. B. Initiate and maintain the Edmonds regis- ter of historic places. This official register shall be compiled of buildings, structures, sites, objects and districts identified by the commis- sion as having historic significance worthy of recognition and protection by the city and encouragement of efforts by owners to main- tain, rehabilitate and preserve properties. C. Review nominations to the Edmonds register of historic places according to criteria in ECDC 20.45.010 and adopt standards in its rules to be used to guide this review and the issuance of a certificate of appropriateness or waiver. D. Review proposals to construct, change, alter, modify, remodel, move, demolish or sig- nificantly affect properties or districts on the register as provided in Chapter 20.45 ECDC and adopt standards in its rules to be used to guide this review and the issuance of a certifi- cate of appropriateness or waiver. E. Provide for the review either by the com- mission or its staff of all applications for approvals, permits, environmental assess- ments or impact statements, and other similar documents pertaining to identified historic resources or adjacent properties. F. Conduct all commission meetings in compliance with Chapter 42.30 RCW, Open Public Meetings Act, to provide for adequate public participation and adopt standards in its rules to guide this action. G. Participate in, promote and conduct pub- lic information, educational and interpretive programs pertaining to historic and prehistoric resources. H. Establish liaison support, communica- tion and cooperation with federal, state and other local government entities which will fur- ther historic preservation objectives, including public education, within the city.
