B. Off-street parking facilities shall be illu-
minated by overhead lighting at a minimum
average of 20 footcandles. Lighting shall be
directed downward and away from external
property lines. [Ord. 3496 § 2, 2004].
17.50.090 Temporary parking lots.
A. Conditional Use. A conditional use per-
mit shall be required in order to construct or
maintain a temporary parking lot in any B
(business) or C (commercial) zone. The initial
permit shall be valid for a term of one year;
provided, however, that extensions may be
approved under the following conditions:
1. The applicant may apply to the com-
munity services director to have said permit
extended for a period of one year upon the fil-
ing of a written application stating the reasons
for said requests prior to the expiration of the
original permit.
2. The applicant may, in addition, apply
for an additional two-year extension through
the vehicle of a conditional use permit for a
temporary parking lot. In addition to satisfying
the criteria of ECDC 20.05.010, the applicant
shall be required to demonstrate that a public
benefit will result from the issuance of the two-
year extension. In no event shall a temporary
parking lot be permitted to continue beyond
four years from the date the initial conditional
use permit is granted.
3. Applications for a conditional use per-
mit, or an appeal of a staff decision approving or
denying a one-year extension thereof, shall be
reviewed by the hearing examiner under the same
terms and conditions as any conditional use per-
mit utilizing the criteria contained in Chapter
20.05 ECDC and under the procedural require-
ments contained in Chapter 20.06 ECDC. An
application for a two-year extension shall be pro-
cessed in the same manner as an initial applica-
tion for a conditional use permit for a temporary
parking lot and new or changed conditions may
be imposed in the course of that process.
B. Improvements. The hearing examiner
shall require the applicant to meet the public
improvement and dedication requirements for

permanent use of the director of community
services. The applicant shall also be required
to provide a durable, well -drained, dust -free
and hard surface for the parking lot.
C. Review by the Architectural Design
Board. If the conditional use permit is
approved, the applicant shall then submit the
proposal for review to the architectural design
board, and shall comply with any requirements
of the board as to signage, lighting, screening
and landscaping. Nothing herein shall be inter-
preted to prohibit an applicant from filing a
simultaneous request for review of his condi-
tional use permit application by the hearing
examiner and/or review of said lot by the
architectural design board. [Ord. 3783 § 3,

17.50.100 Commercial vehicle
regulations.
A. No person shall park or store more than
one commercial vehicle or any commercial vehi-
cle over 10,000 pounds licensed gross vehicle
weight per dwelling unit on any lot in any R
zoned district unless he/she has first obtained a
conditional use permit. For the purposes of this
section, "commercial vehicle" means any motor
vehicle, the principal use of which is the trans-
portation of commodities, merchandise, produce,
freight, vehicles, animals, passengers for hire, or
which is used primarily in construction or farm-
ing, including but not limited to bulldozers, back -
hoes, tractors and cranes.
B. The provisions of this section shall not
apply to commercial vehicles which are being
loaded or unloaded. [Ord. 3496 § 2, 2004].

17.60.000 Purpose.
The purpose of this chapter is to impose rea-
sonable limits on property performance stan-
dards the amount of noise, dust, vibration and
other similar emissions produced by a use
which are evident at the exterior boundaries of
the site of the use. [Ord. 3731 § 1, 2009].
17.60.005 Definitions.
For the purposes of this chapter, the follow-
ing definitions apply:
"Improved surface" means the outdoor area
covered by a permanent hard surface, includ-
ing concrete, asphalt, or pavers, whether pervi-
ous or impervious, which may be designed or
used for driving or parking motor vehicles on
any parcel of land, excluding public right-of-
way.
"Required front yard" means the entire lot
area between the street lot line and the mini-
mum street setback distance as identified in
ECDC 16.20.030. [Ord. 4016 § 2, 2016].
17.60.010 Proof of compliance.
If the city has a reasonable doubt that a busi-
ness or use is, or can be, conducted within the
limits of the performance standards of this
chapter, it may require that the user or pro-
posed user retain, at his expense, an indepen-
dent, qualified, testing laboratory to make an
analysis of the use to determine its compliance
with the standards and to make the results of
such analysis available to the city. In the event

the analysis discloses existing or impending
noncompliances, the city shall require the user
or proposed user to either institute remedial
measures to bring the use into compliance or to
cease operation. [Ord. 3731 § 1, 2009].
17.60.020 Applicability.
The standards of this chapter apply to all
uses. However, they do not apply to unusual
and isolated incidents, as determined by the
development services director. [Ord. 3731 § 1,
2009].
17.60.030 Standards.
A. Noise. Noise emanating from any use
shall be muffled so as to not become objection-
able due to intermittent beat, frequency or
shrillness, and where a use is within or adjoins
a residential district, the noise loudness mea-
sured at the boundary line shall not exceed 45
decibels between the hours of 11:30 p.m. and
6:00 a.m., and 60 decibels at other hours.
B. Lighting. External lights shall be
shielded, trained or directed in a manner which
minimizes glare onto adjacent property or
passing traffic. Arc welding, acetylene torch
cutting or similar processes shall be performed
so as not to be seen from any point beyond the
outside of the property. Any lighting on a
sports field or court shall be turned off by an
automatically timed mechanism no later than
10:15 p.m. Field or court lighting fixtures shall
minimize scattering of light beyond the field or
court being illuminated.
C. Fire Hazards. In terms of fire and safety
hazards, the storage and handling of flamma-
ble liquids, liquefied petroleum, gases and
explosives shall comply with rules and regula-
tions falling under the jurisdiction of the city
fire chief, the laws of the state and other local
ordinances.
D. Electrical Interference. Provisions must
be made for necessary shielding or other pre-
ventive measures against interferences occa-
sioned by mechanical, electrical, electronic

and nuclear equipment, uses or processes with
electrical apparatus in nearby buildings or land
uses.
E. Odors, Gases. The emission of obnox-
ious odors of any kind shall not be permitted
nor the emission of any toxic or corrosive
fumes or gases. Dust created by a use shall not
be exhausted or wasted directly into the atmo-
sphere.
F. Particulate Matter. Emissions shall com-
ply with the requirements of the state Depart-
ment of Ecology as set forth in Chapter 173-
400 WAC.
G. Waste Disposal. Liquid and solid waste,
storage of animal or vegetable waste which
attract insects or rodents or otherwise create a
health hazard shall be prohibited. No waste
products shall be exposed to view from eye
level from any property line.
H. Open Storage. All open storage shall be
located in either the side or rear yard and
screened by a solid fence or vegetative barrier
at least five feet in height.
I. Vibration. Vibration shall not exceed
three -thousandths of one inch displacement
applied to the frequency range of zero to 5,000
cycles per second, as measured at any point on
the boundary of the property from which the
vibration is produced. [Ord. 3731 § 1, 2009].
17.60.040 Vehicles in residential zones.
A. No more than four motor vehicles shall
be parked outdoors in the front yard of a resi-
dential lot. Each motor vehicle must be cur-
rently licensed and operable.
1. Exemptions.
a. This regulation does not apply to:
i. Motor vehicles when parked in
a completely enclosed building or carport, or
in a rear yard and screened from adjacent prop-
erties and the public right-of-way by a five-
foot opaque fence or by a vegetative barrier
that is between five feet and eight feet in height
and provides a visual barrier equivalent to an
opaque fence. Corner lots and flag lots which

have no rear yard may establish a screening
area which qualifies for this exemption in a
side yard;
ii. Temporary parking for a dura-
tion not to exceed 24 hours;
iii. Multifamily building or other
complex with an approved building and park-
ing plan;
iv. Permitted construction areas;
or
v. Motorcycles or mopeds.
B. No more than two recreational vehicles
of any kind may be parked outside an approved
enclosed structure anywhere on a property. If
the recreational vehicle cannot be stored as
described in subsection (D) of this section due
to site constraints, the recreational vehicle
shall be parked off site during those extended
times when not in use. Only one side yard may
be used for storage of recreational vehicles.
For the purposes of this chapter, "recreational
vehicle" means a vehicular -type unit primarily
designed for recreational camping or travel use
that has its own motive power or is mounted on
or towed by another vehicle. The units include
travel trailers, fifth -wheel trailers, folding
camping trailers, truck campers, and motor
homes.
C. Except for property specifically zoned
for and licensed by the city of Edmonds for
vehicle use, vehicle storage, repair, or sales,
the operating of a vehicle -oriented business is
prohibited.
D. An intact, appropriately licensed and
operable vehicle may be parked or stored out-
side a structure in the manner provided below:
1. In a front yard, up to four motor vehi-
cles, provided that the vehicle is on a driveway
or other improved parking surface. The
improved surface in the front yard shall not
exceed 50 percent of the required front yard
area and the driveway for a two -car garage
shall not be wider than 24 feet and for a three -
car garage shall not be wider than 30 feet,
unless otherwise approved by the city engineer
for public safety purposes.

2. In a side yard or rear yard; provided
all vehicle parts and accessories, including but
not limited to containers of oils and fluids,
shall be stored in a completely enclosed build-
ing and in compliance with all health regula-
tions and provisions of state and federal law.
E. No vehicle shall be left unattended on
blocks, jacks, or ramps or otherwise elevated
above the ground in an unstable manner.
F. The storage of any vehicle on any resi-
dentially zoned property which does not have
a dwelling unit is prohibited unless the prop-
erty is adjacent to a property with a dwelling
unit owned by the same person. Vehicles shall
be registered to that specific dwelling unit.
G. Vehicles shall not intrude into the
improved public right-of-way or obstruct sight
visibility from adjacent driveways, private
roads, or public rights-of-way.
H. Vehicles equipped with liquefied petro-
leum gas containers shall meet the standards of
the Interstate Commerce Commission. Valves
or gas containers shall be closed when the
vehicle is parked or stored. In the event of
leakage, immediate corrective action shall be
taken.
1. Vehicles shall not exceed the length
equal to one-half of the required minimum lot
width or 40 feet, whichever is less, in any res-
idential zone district.
J. Servicing, repairing, assembling, wreck-
ing, modifying, restoring or otherwise working
on vehicles outside a completely enclosed
building or a carport is prohibited unless meet-
ing the following criteria:
1. The maintenance or repair shall not
exceed 30 days in any 12 -month period and
shall be of a vehicle registered to a resident of
the property or family member.
2. Such work shall be conducted on no
more than one vehicle at any one time.
3. Such work shall be done only
between the hours of 8:00 a.m. and 10:00 p.m.
4. Such work shall not be done in the
public right-of-way.

5. Storage of parts, equipment, or other
supplies needed for the repair of the vehicle on
the premises must be kept within an enclosed
structure or in an area that is screened from
public view.
6. The repair is not in association with
any business use, whether licensed or not, such
as buying, selling, trading, repairing or restor-
ing of vehicles or parts thereof, unless the
property is zoned for and licensed by the city
of Edmonds for such business.
7. The repair is conducted in a manner
which complies with all property performance
standards and noise regulations.
8. The repair is conducted in a manner to
not allow any vehicle fluids to enter the ground
or enter any drainage system or body of water.
9. Disposal of all waste products shall
be done in accordance with Chapter 19.114
RCW.
10. Upon completion of any work
allowed by this section, the property shall be
cleaned of all debris, oil, grease, gasoline,
cloths, rags, and equipment or material used in
the work, and shall be left in such a condition
that no hazard to persons, storm drain system
or property shall remain. All hazardous waste
shall be appropriately handled and disposed.

17.60.050 Habitation uses prohibited.
No vehicle, recreational vehicle, or trailer
shall be used for habitation within the bound-
aries of the city.
A. Exceptions. A recreational vehicle that
is originally designed and used as temporary
living quarters may be occupied on private res-
idential property for a period not to exceed 60
days in any calendar year when the owner or
user of the vehicle is a nonresident of the city

Car wrecking means the collecting, disman-
tling, storage, salvaging, or sale of parts of
machinery or vehicles not in running condi-
tion.
21.15.012 Carport.
Carport means a legally permitted structure,
covered by a roof, for the sheltering of a motor
vehicle. [Ord. 4016 § 3, 2016].
21.15.015 Church.
Church means any community facility used
or dedicated for the legitimate exercise of rec-
ognized federal and state constitutional rights
for religious free worship. A neighborhood
church is a church of 22,000 square feet or less
of gross floor area. A community church is a
church of greater than 22,000 square feet of

gross floor area. Determination of gross floor
area shall be consistent with state building

21.15.020 City.
City means the city of Edmonds in the state
of Washington.
21.15.030 City council (or council).
City council (or council) means the city
council of the city of Edmonds.
21.15.032 Closed record appeal.
Closed record appeal for purposes of the
ECDC means an administrative appeal on the
record to a decisionmaking body, including the
city council, following an open record hearing
on a project permit application when the
appeal is on the record with no or limited new
evidence or information allowed to be submit-
ted and only appeal argument allowed. [Ord.
3112 § 35, 1996].
21.15.035 Co -location.
Repealed by Ord. 3845. [Ord. 3099 § 5,
1996].
21.15.040 Commercial parking lot.
Commercial parking lot means a site where
parking spaces are rented or leased to persons
other than those who live or work on the same
site. (See also, Off -Street Parking and Private
Parking.)
21.15.050 Commercial garage.
Commercial garage means a building used
for storage, repair, or servicing of motor vehi-
cles as a commercial use.
21.15.060 Commercial kennel.
Commercial kennel means a building in
which four or more domestic animals at least
four months of age are kept commercially for
board or breeding. [Ord. 2759 § 2, 1990].

21.15.070 Commercial use.
Commercial use means an activity with
goods, merchandise, or services for sale or rent.
21.15.071 Community facilities.
A. Community facilities mean any use,
structure, building, or development that:
1. Is primarily used or dedicated for use
by members of the general public for educa-
tional, religious, informational, recreational,
artistic, or social purposes; or
2. Serves members of the general public
by providing for utility, transportation, police,
fire, and parking services; or
3. Is primarily used or dedicated for use
by local, state, regional, or federal govern-
ments for the purpose of providing govern-
mental services.
B. Community facilities consist of
churches, local public facilities, parks, and
regional public facilities.
C. Community facilities do not include ani-
mal hospitals, boarding houses, congregate
care facilities, day care facilities, fraternities,
foster homes, halfway houses, home occupa-
tions, hospitals, rooming houses, retirement
homes, sororities, or similar medical, hospice,
or care uses. [Ord. 3353 § 14, 2001].
21.15.073 Community park.
Community park means a public recreation
facility primarily designed and located to pro-
vide active and structured recreation opportu-
nities for young people and adults in the
immediate community. The service area is at
least a one- to two-mile radius. In general,
community park facilities are designed for
organized activities and sports, although indi-
vidual and family activities are also encour-
aged. Community parks may provide indoor
facilities to meet a wider range of recreation
interests. Community parks serve a larger area
than neighborhood parks and offer more facil-
ities such as parking, restrooms, covered play
areas, etc. Community parks usually exceed 20
acres in size and often have sport fields, water

bodies, gardens, nature trails or similar facili-
ties as the central focus of the park. [Ord. 3353
§ 15, 2001].
21.15.075 Commuter parking lots.
Commuter parking lot means a parking lot
or portion of a parking lot composed of new or
existing parking spaces that are designated for
use by persons who travel to or from Edmonds
as part of a commute that includes a form of
transportation other than single occupant vehi-
cle, such as nor motorized transportation for
distances of more than a quarter of a mile, car-
pooling or transit. In determining the number
of parking spaces in a commuter parking lot,
all parking spaces within a lot as defined by
ECDC 21.55.010 shall be construed as part of
the same commuter parking lot as well as any
spaces within 300 feet of each other. [Ord.

21.15.080 Completely enclosed building.
Completely enclosed building means one
designed and constructed with all exterior
walls of the structure solid from the ground to
the roof line, and containing no openings
except for windows and doors which are
designed to be closed.
21.15.090 Conditional use.
Conditional use means a use allowed in one
or more zones as defined by the zoning code
but which, because of characteristics peculiar
to such use, because of size, hours of opera-
tion, technical processes or equipment, or
because of the exact location with reference to
surroundings and existing improvements or
demands upon public facilities, requires a spe-
cial permit in order to provide a particular
degree of control to make such uses consistent
with and compatible with other existing or per-
missible uses in the same zone or zones.
Multiple uses or any combination of uses,
any of which require a conditional use permit,
shall be allowed on a single lot only upon the
grant of a conditional use permit. [Ord. 2660 §
