5.05.001 Introduction and purpose.
The purpose of this chapter is to provide for
the reasonable regulation of animals as well as
promote the public's health, safety and wel-
fare. It is the specific intent of this chapter to
place the responsibility and obligation of com-
plying with its requirements upon the owners
and keepers of animals. [Ord. 3451 § 1, 2003].
5.05.002 Penalties — Infraction unless
otherwise designated.
Unless otherwise set forth in this chapter, a
violation of any provision of this chapter shall
constitute a Class I civil infraction pursuant to
Chapter 7.80 RCW. Issuance and disposition
of infractions issued for violations of this
chapter shall be in accordance with Chapter
7.80 RCW. The penalty for violation of a pro-
vision of this chapter shall be $100.00. The
penalty for a second or subsequent offense in
violation of the provision of this chapter within
two years shall be $250.00. [Ord. 3451 § 1,

5.05.010 Definitions.
A. "Animal control authority" means the
person, association or corporation, appointed
or authorized by the city of Edmonds and/or
the chief of police or his designee, to enforce
the provisions of this chapter and all other
ordinances of the city pertaining to animal
control.

B. "Animal control officers" means offi-
cers employed by the animal control authority
and includes police officers.
C. "At large" means off the premises of the
owner and not under the immediate control of
the owner, member of the owner's immediate
family, or person authorized by the owner, by
means of a leash, cord or chain no longer than
eight feet.
D. "Covered animal" means hoofed ani-
mals usually found on farms, such as horses,
ponies, mules, donkeys, bovine animal, sheep,
goats and/or swine.
E. "Dangerous dog" means any dog that,
according to the records of the animal control
authority, has: (1) inflicted severe injury on a
human being without provocation on public or
private property; (2) killed a domestic animal
without provocation while off the owner's
property; or (3) been previously found to be
potentially dangerous, the owner having
received notice of such and the dog again
aggressively bites, attacks, or endangers the
safety of humans or domestic animals; pro-
vided, however, that an animal shall not be
considered a "dangerous dog" if the threat,
injury, or damage was sustained by a person
who, at the time, was committing a willful tres-
pass or other tort upon the premises occupied
by the owner of the dog, or was tormenting,
abusing, or assaulting the dog or has, in the
past, been observed or reported to have tor-
mented, abused, or assaulted the dog or was
committing or attempting to commit a crime.
F. "Domestic animal" means any animal
that is usually tamed and bred by humans.
G. "Guard dog" means any member of the
dog family which has been trained or repre-
sented as trained to protect persons and/or
property by virtue of exhibiting hostile pro-
pensities and aggressiveness to unauthorized
persons.
H. "Inherently dangerous animal" means
any live member of the Canidae, Felidae, Ursi-
dae, and Reptilia families, including hybrids
thereof, which, due to its inherent nature, may

be considered dangerous to humans. Inher-
ently dangerous animals include but are not
necessarily limited to:
1. Canidae, meaning and including any
member of the dog family not customarily
domesticated by man, or any hybrids thereof,
but not including domestic dogs and wolf
hybrids (cross between a wolf and a domestic
dog).
2. Felidae, meaning and including any
member of the cat family not customarily
domesticated by man, or any hybrids thereof,
but not including domestic cats.
3. Ursidae, meaning and including any
member of the bear family, or any hybrids
thereof.
4. Reptilia, meaning venomous and
"devenomized" reptiles, including but not nec-
essarily limited to all members of the follow-
ing families: Helodermidae (gila monster),
Viperidae (pit vipers), Crotalidae (rattle-
snakes), Atractaspidae (mole vipers),
Hydrophiidae (sea snakes), and Elapidae
(coral snakes and cobras).
5. Colubridae snakes which are rear
fanged, including, but not necessarily limited
to dispholidus typus (boomslangs), thebtornis
kirtlandii (African twig or vine snake), and
rhabdophis (keelbacks).
6. Colubridae snakes which reach a
length of 10 feet and over, including but not
necessarily limited to green anaconda, reticu-
lated pythons, Burmese python, albino Indian
python, and African rock python.
7. Crocodilia, meaning and including
crocodiles, alligators and caimans.
I. "Inhumane treatment" means every act or
omission whereby unnecessary or unjustifi-
able physical pain or suffering is caused or per-
mitted.
J. "Own" means owning, keeping, leasing,
possessing or harboring any animal. "Owner"
means any person having an interest or right of
possession to an animal or any person having
control, custody or possession of an animal or

by reason of the animal being seen residing
consistently at a location, shall be presumed to
be the owner.
K. "Person" means any person, firm, cor-
poration or association.
L. "Pet" is a domestic animal owned and
kept by an individual or family for enjoyment
and pleasure rather than utility. The term "pet"
includes all animals required to be licensed
under the terms of this chapter when properly
licensed.
M. "Potentially dangerous dog" means: (1)
any dog that when unprovoked: (a) inflicts a
bite or bites on a human, pet or livestock either
on public or private property; or (b) chases or
approaches a person upon the streets, side-
walks, or any other public grounds or private
property in a menacing fashion or apparent
attitude of attack; or (2) any dog with a known
propensity, tendency, or disposition to attack
unprovoked, to cause injury or otherwise to
threaten the safety of humans, pets or livestock
on any public or private property.
N. "Poultry" means domestic fowl nor-
mally raised for eggs or meat and includes, but
is not limited to, chickens, turkeys, ducks,
geese, pheasants, quail, guinea fowl, pea fowl
and other similar domesticated birds. Nothing
herein shall be interpreted to conflict with or
eliminate any state wildlife licensing require-
ment with relation to the keeping of any type
of fowl. Large fowl over three feet in height or
30 pounds as mature adults, such as emus or
ostriches, shall be considered "covered ani-
mals" and regulated as such.
O. "Proper enclosure of a dangerous dog"
means, while on the owner's property, a dan-
gerous dog shall be securely confined indoors
or in a securely enclosed and locked pen or
structure, suitable to prevent the entry of
young children and designed to prevent the
animal from escaping. Such pen or structure
shall have secure sides and a secure top, and
shall also provide protection from the elements
for the dog.

P. "Severe injury" means any physical
injury that results in broken bones or disfigur-
ing lacerations requiring multiple sutures or
cosmetic surgery.
Q. "Vicious animal" means any animal
other than a "dangerous dog" or "potentially
dangerous dog" that endangers the safety of
any person or domestic animal by biting or
attacking without provocation.
R. "Wild animal" means any animal living
in its natural state and native to the United
States and not normally domesticated, raised
or bred by humans. [Ord. 3895 § 1, 2012; Ord.

3451 § 1, 2003].
5.05.015 Keeping of domesticated
animals in residential zones.
For each residential dwelling unit, regard-
less of the number of occupants residing
within each dwelling unit, the following maxi-
mum number of domestic animals may be kept
or owned within the dwelling unit upon the lot
or premises associated with such dwelling
unit:
A. Household pets in numbers normally
and commonly associated with the primary
residential use of the dwelling unit. "House-
hold pets" are animals commonly or normally
kept or owned in association with a residential
dwelling unit and which are generally kept or
housed within the interior of the dwelling unit,
including such animals as hamsters, mice, ger-
bils, guinea pigs, nonvenomous snakes, para-
keets, canaries, finches, other songbirds, small
nonvenomous reptiles and amphibians, and
fish;
B. Five or fewer domestic animals;
C. One unweaned litter produced by any
domestic animal permitted to be kept by this
chapter; provided, that the total number of
domestic animals kept shall not exceed that
number provided in subsection (B) of this sec-
tion more than 180 days following the birth of

5.05.020 Dog licensing.
A. License Required. It is unlawful for any
person to own any dog over the age of three
months within the city unless the owner has
first procured a license required by this chap-
ter.
B. Dogs Excluded from License Require-
ments. The licensing provisions of this section
shall not apply to the following dogs:
1. Dogs whose owners are nonresidents
temporarily within the city;
2. Dogs brought into the city for the pur-
pose of participating in any dog show;
3. Seeing -eye guide and service dogs
properly trained to assist blind or impaired per-
sons, when such dogs are actually being used
by a blind or impaired person, for the purpose
of aiding them from place to place. Blind or
impaired persons include but are not necessar-
ily limited to persons who are blind, deaf, have
limited mobility, or have psychological
impairment; or
4. Dogs whose owner maintains them
for the sole purpose of commercial breeding
and/or training, hunting, or boarding, so long
as the dogs are restricted within a building or
fenced enclosure intended and designed only
for the purpose of kenneling dogs and are not
permitted to run at large.
C. License Tags Issued and Fees. The
police department, or such other person, firm
or entity authorized by the city council, shall
issue a dog license upon the payment of a fee
as provided for by this subsection. Upon issu-
ance of a license, a metal tag corresponding to
the number of the application shall be fur-
nished to the applicant.
1. The applicant shall cause the same to
be attached to the dog. Tags shall not be trans-
ferable from one dog to another.
2. The following fees shall be paid for
licenses required under this chapter:

a. For spayed females or neutered
males with a veterinarian certificate or signed
affidavit: an annual license fee of $15.00; pro-
vided, that a $5.00 fee shall be charged to per-
sons over the age of 65;
b. For dogs less than six months but
over three months of age, temporary tags
issued: a license fee of $5.00. Persons over the
age of 65 shall receive a rebate of $2.00 at the
time of relicensing, upon certification by a vet-
erinarian that the dog has been spayed or neu-
tered;
c. Unspayed females and unneutered
males over six months of age: $40.00;
d. Replacement of metal tag: $4.00.
3. An owner of an animal previously
licensed for which a "permanent" license has
been issued under the provisions of this section
as the same existed prior to December 16,
1986, shall not be required to relicense or
renew said license for such animal.
D. License Issuance — Nonresidents.
Licenses shall be issued to nonresidents of the
city of Edmonds who reside in proximity to the
city and who desire to purchase an annual
license for their dog for identification pur-
poses. The annual fee shall be $10.00 per year
per dog. Upon payment of said fee, a tag shall
be issued which shall be consistent with the
tags issued annually by the city of Edmonds
for dogs required to be licensed under this
chapter. The dogs permitted to be licensed by
this section shall not be eligible for temporary
licenses. Nothing in this chapter shall require
the obtaining of such license nor shall failure
to obtain such a license as provided by this sec-
tion subject any dog owner to the penalties

5.05.115 Nuisances defined.
A. All violations of this section are detri-
mental to the public health, safety and welfare
and are declared to be public nuisances.
B. Nuisances are hereby defined to include,
but are not limited to, the following:
1. Any animal which chases, runs after
or jumps at vehicles using public streets and
alleys;
2. Any animal which habitually snaps,
growls, snarls, jumps upon or otherwise threat-
ens persons lawfully using the public side-
walks, streets, alleys or other public ways;
3. Any animal which has exhibited
vicious propensities and which constitutes a
danger to the safety of persons or property off
his premises or lawfully on his premises;
4. A vicious animal or animal with
vicious propensities which runs at large at any
time, or such an animal off the owner's prem-
ises not securely leashed on a line or confined
and in the control of a person of suitable age
and discretion to control or restrain such ani-
mal;
5. Any animal which howls, yelps,
whines, barks or makes any noises in such a
manner as to disturb any person or neighbor-
hood to an unreasonable degree, taken to be
continuous noise for a period of 10 or more
minutes or intermittent noise that totals a
period of 20 or more minutes, except that such
sounds made indoors in animal shelters or in
commercial kennels duly licensed shall be
exempt;
6. Animals kept, harbored or maintained
and known to have a contagious disease,
unless under the treatment of a licensed veter-
marian;
7. Animals running in packs;
8. Any dog running at large within the
city;
9. A female animal, whether licensed or
not, while in season, accessible to other ani-
mals for purposes other than controlled and
planned breeding;

10. Any animal which causes damage to
property other than the property of the ani-
mal's owner or person having physical charge
and control of the animal; or
11. Any animal maintained in violation
of any provision of this chapter.
C. All nuisances under this section shall be
abated as provided in this chapter. In addition,
any owner or person having charge of any ani-
mal who fails to abate such nuisance shall be
subject to the following penalties:
1. Any person violating any provision of
this section shall be guilty of a civil infraction,
which shall be punishable by a fine of $100.00.
2. Any person committing a second vio-
lation of any provision of this section within
one calendar year shall be guilty of a civil
infraction, which shall be punishable by a fine
of $250.00.
3. Any person committing a third viola-
tion of any provision of this section within one
calendar year shall be guilty of a misdemeanor
and, upon conviction thereof, be sentenced to
a fine not to exceed $1,000 and/or 90 days in

5.05.120 Nuisance — Notice and order to
abate.
A. Notice — When Required. Whenever it
shall be stated in writing by an animal control
officer or by three or more persons having sep-
arate residences or regularly employed in any
neighborhood that any animal is a nuisance as
defined in ECC 5.05.115, the animal control
authority shall serve a notice of violation and
order of abatement upon the owner of the ani-
mal directing that the nuisance be abated.
B. Notice — Final Determination Unless
Appealed. The service of a notice of violation
and order of abatement shall, unless timely
appealed, be a final determination that the ani-
mal is a nuisance and such nuisance must be
immediately abated.

C. Notice — Contents. The notice of viola-
tion and order to abate a nuisance shall con-
tain:
1. The name and address, if known, of
the owner or person having physical charge
and control of the animal if the identity of the
owner cannot be reasonably ascertained;
2. The license number, if available, and
description of the animal;
3. A statement that the animal control
authority has determined the animal to be a
nuisance and a description of the nuisance
activity;
4. A statement that the nuisance activity
must be immediately abated;
5. A statement that service of the notice
of violation and order of abatement is a final
determination unless appealed and that an
appeal must be filed within five days of service
of the notice of violation and order of abate-
ment;
6. A copy of ECC 5.05.123 regarding
appeal procedures;
7. A copy of ECC 5.05.124 regarding
disposition of seized and removed animals.
D. Notice — Service. Service of the notice
of violation and order of abatement upon the
owner of the animal may be made either by
personal service to the owner, by posting such
notice at the residence of the owner or by cer-
tified mail to the last known address of the
owner.
E. Appeal of Notice of Violation and Order
of Abatement. An appeal of a notice of viola-
tion and order of abatement must be served
upon the city of Edmonds police chief within
five days of service of the notice of violation
and order of abatement. Appeals shall be heard
by the judge of the Edmonds municipal court
and conducted in accordance with ECC
5.05.123.
F. Penalty. Any person who wilfully fails to
comply with an order to abate a nuisance is
guilty of a misdemeanor. [Ord. 3451 § 1,

5.05.121 Potentially dangerous dogs.
The provisions of this section apply to the
extent they are not inconsistent with the provi-
sions of Chapter 16.08 RCW.
A. Declaration of a Dog as Potentially Dan-
gerous. The animal control authority shall
have the authority to declare a dog to be poten-
tially dangerous, and place restrictions on such
dog, if the animal control authority has proba-
ble cause to believe that the dog falls within
the definitions set forth in ECC 5.05.010(M).
The declaration must be based upon:
1. The written complaint of a citizen
who is willing to testify that the animal has
acted in a manner which causes it to fall within
the definition of ECC 5.05.010(M);
2. Animal bite report(s) filed with the
animal control authority;
3. Action(s) of the animal witnessed by
any employee of the animal control authority
or law enforcement officer; or
4. Other substantial evidence.
B. Exclusions. A dog shall not be declared
potentially dangerous if the animal control
authority determines, by a preponderance of
the evidence, that the threat, injury, or bite
alleged to have been committed by the dog was
sustained by a person who was at the time
committing a willful trespass or other tort upon
the premises occupied by the owner of the dog,
or who was tormenting, abusing, or assaulting
the dog, or who had been in the past observed
or reported to have tormented, abused, or
assaulted the dog, or who was committing or
attempting to commit a crime.
C. Prohibited Ownership. No person(s)
under the age(s) of 18 years old shall own a
potentially dangerous dog, as defined in ECC
5.05.010(M.)
D. Notice of Animal Control Authority
Declaration. If the animal control authority
receives a report of a potentially dangerous
animal, it shall immediately initiate an investi-
gation including, but not limited to, interview-
ing the complainant(s), interviewing the owner
of the animal, if known, and observing the ani -

mal. Upon completion of its investigation, if
the animal is declared potentially dangerous,
the animal control authority shall prepare a
written declaration.
1. The declaration shall be in writing
and served on the owner in one of the follow-
ing methods:
a. Certified and regular mail to the
owner's last known address; or
b. Personally; or
c. If the owner cannot be located by
one of the first two methods, by publication in
a newspaper of general circulation.
2. The declaration shall include, but is
not limited to:
a. A description of the dog;
b. The name and address of the
owner of the dog, if known;
c. The whereabouts of the dog if not
in custody of the owner;
d. A brief summary of the facts upon
which the declaration is based, if known,

and/or the occupier of the premises shall con-
form to the number of said animals or the
dimensional requirements within one year of
the birth of said animals.
B. Fencing. The owner and/or tenant or
other occupier of the premises upon which any
covered animal is maintained for more than
seven consecutive days within the city limits
shall provide adequate fencing in a good state
of repair to guarantee the confinement of said
animal within said fence, which fence shall
completely enclose an area describing at least
the minimum area of open space and pasturing,
including the minimum dimensional require-
ments.
C. Waste Disposal. The owner of each cov-
ered animal and the owner and/or occupier of
the premises upon which said animal is main-
tained within the city limits shall guarantee
and, at all times, maintain the premises upon
which the covered animal is maintained in a
sanitary and neat condition, including, but not
limited to, disposal of manure or other waste
material from said animal. An unreasonable
accumulation of flies or other insects or pests
within the property on which said animal is
maintained, and/or noxious or offensive odors,
or the unreasonable accumulation of flies,
insects or other pests transcending into neigh-
boring or vicinal real property, shall be pre-
sumed to be inadequate sanitary conditions.
D. Riding on Sidewalks. It is unlawful for
any person to ride or lead a covered animal on
any sidewalk within the city limits, unless oth-
erwise specifically designated by the city's
engineer for such use. No person shall ride or
lead two or more covered animals abreast on
any city street.
E. Public Parks, Beaches and/or Play-
grounds. Unless otherwise directed by the
director of parks and recreation, it is unlawful
for any person to ride, lead or otherwise permit
any covered animal to be within or on any pub-
lic park, beach or playground within the city of
Edmonds, whether owned by, leased or other-
wise under the direct supervision of the city, or

to ride, lead or permit any said animal to be
within or on the private property of another,
without the consent of the owner of said prop-
erty; provided, however, the director of parks
and recreation is authorized to post a notice or
notices of specific areas in any particular pub-
lic park, beach or playground within the city of
Edmonds where said animals may be permit-
ted under such circumstances as may be
required by the director of parks and recre-
ation. Said notices shall be placed in a conspic-
uous place or places at each drive-in or
pedestrian access provided by the city to such
public parks, beaches and/or playgrounds. In
the event the director of parks and recreation
so determines and posts notices as provided in
this subsection, he shall maintain a list of said
parks, beaches and/or playgrounds, shall file a
copy of the same with the city clerk, and said
list shall be open and available for public
inspection at all business hours of the office of
the city clerk.
F. Business Area. No person shall leave
any covered animal unattended, whether teth-
ered or untethered, within any area of the city
zoned for commercial use by the city zoning
code.
G. Areas of Maintenance — Zoning and
Related Ordinances. Areas wherein covered
animals may be maintained or pastured within
the city limits are those set forth by the zoning
code. In the event of conflict between any
dimensional requirements set forth in this sec-
tion and the requirements set forth in the zon-
ing code, the regulation requiring the greatest
open space or other dimensional requirement
shall prevail. In the event any other provision
of Edmonds City Code is in conflict with this
section relative to said animals, the terms of
this section shall prevail.
H. Variances. Where there may be struc-
tures of less than the minimum dimensional
requirements which existed prior to September
6, 1977, the owner of the premises may apply

to the planning/zoning departments' hearing
examiner for a variance from the strict require-
ments of this section. [Ord. 3451 § 1, 2003].
5.05.130.1 Keeping of poultry and covered
animals in residential zones.
A. The keeping of poultry or covered ani-
mals within a residential dwelling unit, or upon
the premises connected therewith, shall be pro-
hibited except as provided in this chapter.
B. Up to three domestic female chickens
may be kept on a lot(s) or premises associated
with a single-family residential dwelling unit.
A chicken coop or other pen or enclosure is an
accessory structure and subject to all require-
ments of the applicable zone. An accessory
dwelling unit shall not be considered as a sep-
arate dwelling unit when determining the num-
ber of chickens that may be kept on a single-
family lot or lots (when a single-family resi-
dence is located on more than one lot).
C. Covered animals are permitted to be
kept on residential property zoned for single-
family use (R zones) so long as they meet the
requirements of ECC 5.05.130. [Ord. 3988

5.05.131 Wild animals.
No person shall own any wild animal unless
he has obtained a permit from the State Game
Department and/or Federal Fish and Wildlife
Service; provided, that the animal control
authority may allow a person to temporarily
care for an infant or injured wild animal native
to this area which is homeless while the person
acquires the necessary state and/or federal per-
mits. Any person who violates this section
shall be guilty of a misdemeanor, punishable
by up to 90 days in jail and up to a $1,000 fine
or both. [Ord. 3451 § 1, 2003].
5.05.132 Inherently dangerous animal.
It is unlawful for any person to possess or
maintain an inherently dangerous animal

within the city of Edmonds. Any person who
violates this section shall be guilty of a misde-
meanor, punishable by up to 90 days in jail and
up to a $1,000 fine or both. [Ord. 3451 § 1,
2003].
5.05.133 Miscellaneous regulations.
A. Duty When Striking Domestic Animal
with Motor Vehicle. Any person who, while
operating a motor vehicle, strikes a domestic
animal shall stop at once, render reasonable
assistance, and shall immediately report such
injury or death to the animal's owner. In the
event the owner of said animal cannot be
ascertained and located, such person shall at
once report the accident to the animal control
authority. This subsection shall in no way be
construed as requiring the person striking the
animal with a motor vehicle to be financially
responsible for any injury or death of the ani-
mal.
B. Animal Pens — When Prohibited. Who-
ever shall keep, use or maintain, within the
city, any pens, stable, lot, place or premises in
which any animal or fowl may be confined, in
such manner as to be nauseous, foul or offen-
sive, or which shall from any cause become an
annoyance to any person, family or commu-
nity, shall be deemed to be maintained a nui-
sance and be subject to the penalties prescribed
in ECC 5.50.020.
C. Slaughtering of Animals. It should be
unlawful for any person to kill or slaughter,
within the city, any animal or animals, the
flesh of which is intended to be sold or offered
for sale. [Ord. 3451 § 1, 2003].
5.05.135 No duty created.
Nothing contained in this chapter is
intended to be, nor shall be, construed to create
or form any special duties or relationships with
specific individuals or otherwise constitute the
basis for any liability on the part of the city or
its officers, employees or agents, for any injury
or damage resulting from the failure of any
person to comply with the terms of this chap -

ter, or by reason or in consequence of any com-
mission with the implementation or enforce-
ment of this chapter on the part of the city by
its officers, employees, or agents. This chapter
has been enacted for the welfare of the public
as a whole, and not for any specific group or

5.05.140 Penalties.
Repealed by Ord. 2853. [Ord. 3451 § 1,

5.05.141 Additional enforcement.
Notwithstanding the existence or use of any
other remedy, the director of the animal con-
trol authority may seek legal or equitable relief
to enjoin any acts or practices and abate any
conditions which constitute a violation of this
code or other regulations herein adopted. [Ord.
3451 § 1, 2003].
5.05.142 Severability.
If any section, subsection, clause, phrase or
word of this chapter, or any provision adopted
by reference in this chapter, is for any reason
held to be invalid or unconstitutional by a court
of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity
or constitutionality of the remaining portions

shall have the following meanings. All techni-
cal terminology used in this chapter and not
defined specifically herein shall be interpreted
in conformance with American National Stan-
dards Institute's Specifications.
A. "dB(A)" means the sound level mea-
sured in decibels, using the "A" weighting net-
work on a sound level meter.
B. "District" means the land use zone to
which the provisions of this chapter are
applied. For the purposes of this chapter:
1. "Residential district" includes all R
classified zones and includes the Open Space
zone.
2. "Business" zone means all zones des-
ignated BN or BC.
3. "Commercial" zones include all
zones classified CW or CG.
C. "Emergency work" means work
required to restore property to a safe condition
following a public calamity, work required to
protect persons or property from an immediate
exposure to danger, or work by private or pub-
lic utilities for providing or restoring immedi-
ately necessary utility services.
D. "Equipment" means any stationary or
portable device or any part thereof capable of
generating sound.
E. "Frequent, repetitive or intermittently
continuous sounds" means sounds that are
continuous for a period of 10 or more minutes
or intermittent for a period totaling 20 or more
minutes.
F. "Gross vehicle weight rating (GVWR)"
means the value specified by the manufacturer
as the recommended maximum loaded weight
of a single vehicle.
G. "Motor vehicle" means any vehicle
which is self-propelled, used primarily for
transporting persons or property upon public
highways. Aircraft, watercraft, and vehicles
used exclusively on stationary rails or track are
not motor vehicles as that term is used herein.
It includes motorcycles unless distinction is
made in the context of use.
5.30.030
H. "Motorcycle" means any motor vehicle
having a saddle for the use of the rider and
designed to travel on not more than three
wheels in contact with the ground; except that
farm tractors and vehicles powered by engines
of less than five horsepower shall not be
included.
I. "Muffler" means a device consisting of a
series of chambers or other mechanical
designs for the purpose of receiving exhaust
gas from an internal combustion engine and
effective in reducing sound resulting there-
from.
J. "Noise control administrator" means the
person designated by the mayor to enforce the
provisions of this chapter. In addition to the
noise control administrator, any police officer
may enforce the provisions of this chapter.
K. "Person" means any individual, firm,
association, partnership, corporation or any
other entity, public or private.
L. "Property boundary" means the sur-
veyed line at ground surface which separates
the real property owned, rented or leased by
one or more persons from that owned, rented
or leased by another or others, and its vertical
extension.
M. "Receiving property" means the real
property within which sound originating from
outside the property is received.
N. "Race vehicle" means a motor vehicle
not licensed for use on the public streets and/or
which is used primarily for sanctioned or
unsanctioned racing events. Race vehicle shall
also include power boats used primarily for
racing events.
O. "Sound level meter" means a sound
level measuring device either type I or type II
certified special use meters as defined by
American National Standards Institute's Spec-
ifications. [Ord. 3989 § 1, 2015; Ord. 2531,

5.30.030 Unlawful sounds.
It is unlawful for any person to cause sound,
or for any person in possession of property to

permit sound originating from such property,
to intrude into the real property of another per-
son whenever such sound exceeds the maxi-
mum permissible sound level established in
this chapter. [Ord. 2531, 1985; Ord. 2193 § 4,

5.30.040 Maximum permissible sound

The maximum permissible sound level as
measured at the property line or anywhere
within the receiving property shall be as set
forth in the following table:

5.30.050 Modification to maximum
permissible sound levels.
The maximum permissible sound levels
established by this chapter shall be reduced or
increased by the sum of the following:
A. Between the hours of 10:00 p.m. and
7:00 a.m. the noise levels shall be reduced by
10 dB(A) for receiving property within resi-
dential districts, except for noise from electri-
cal substations and existing stationary equip-
ment used in conveyance of water by a utility.
B. At any hour of the day or night, the
applicable noise levels may be exceeded for
any receiving property by no more than:
1. 5 dB(A) for a total of 15 minutes in
any one hour period, or
2. 10 dB(A) fora total of five minutes in
any one hour period, or
3. 15 dB(A) for a total of 1.5 minutes in

5.30.060 Motor vehicle noises — Stationary
test.
It is unlawful for any person to operate any
motor vehicle upon any public highway or
easement road if the vehicle exhaust system
exceeds the maximum permissible sound lev-
els for the category of vehicle as measured at a
distance of 20 inches (.5 meter) from the
exhaust outlet under procedures set forth in
WAC 204-56, as now exists or as hereafter
adopted or amended.

5.30.070 Motor vehicle noises — Road test.
It is unlawful for any person to operate any
motor vehicle or any combination of motor
vehicles upon any public highway or easement
road under any conditions of grade, load, accel-
eration or deceleration in such a manner as to
exceed the maximum permissible sound levels
for the category of vehicle as measured at a dis-
tance of 50 feet from the center of the lane of
travel within the speed limit specified under
procedures set forth in WAC 204-56, as now
exists or as may hereafter be amended or mod-
ified:

exceed the maximum permissible sounds as
specified herein for other than motor vehicles.

5.30.080 Mufflers.
It is unlawful for any person to operate, or
for any owner to permit any person to operate,
any motor vehicle upon the public highways or
easement roads which is not equipped with a
muffler in good working order, in constant
operation, and which meets the requirements
established by RCW 46.37.390 as now exists
or as may hereafter be amended. [Ord. 2531,
1985; Ord. 2193 § 9, 1981].
5.30.090 Tire noise.
It is unlawful for any person to operate a
motor vehicle in such a manner as to cause or
allow to be emitted squealing, screeching or
other such sound from the tires in contact with
the ground or other roadway surface because of
rapid acceleration or excessive speed around
corners or other such reason; provided, that the
sounds resulting from emergency braking to
avoid imminent danger shall be exempt from
this section. [Ord. 2531, 1985; Ord. 2193 § 10,

5.30.100 Exemptions.
The following sounds are exempt from the
provisions of this chapter at all times:
A. Noises caused by motor vehicles used
for highway maintenance or noises caused in
the performance of emergency work for the
immediate safety, health or welfare of the
community or of individuals of the commu-
nity, or to restore property in a safe condition
following a public calamity.
5.30.110
B. Sounds created by bells, chimes or caril-
lons not operating for more than five minutes
in any one hour.
C. Sounds originating from aircraft in
flight, and from watercraft.
D. Sounds created by safety and protective
devices, such as relief valves, where noise sup-
pression would defeat the safety release pur-
pose of the device.
E. Sounds created by fire alarms and emer-
gency equipment operated by law enforce-
ment, fire fighters and aid personnel.
F. Sounds created by the operation of
equipment or facilities of surface carriers
engaged in commerce by railroad.
G. Sounds originating from officially sanc-
tioned parades and other events to which the
general public is solicited to attend without
charge and sounds originating from league or
school sponsored athletic events.
H. Sounds caused by natural phenomena
and unamplified human voices, except for pub-
lic disturbance noises as set forth in ECC
5.30.130. [Ord. 2531, 1985; Ord. 2193 § 11,

5.30.110 Sounds exempt during daytime
hours.
A. The following sounds are exempt from
the provisions of this chapter between the
hours of 7:00 a.m. to 10:00 p.m.:
1. Sounds originating from residential
property relating to homeowner -sponsored
temporary projects for the maintenance and
repair of existing homes and grounds, includ-
ing but not limited to lawn mowers, saws,
hammering and gardening. This exemption
applies to the construction of such incidental
appurtenances for existing homes as fences,
decks, patios, carports, swimming pools,
ponds, walkways and private kennels. This
exemption excludes sounds from race vehi-
cles.
2. Sounds created by blasting.

5.30.120
3. Sounds created by the installation or
repair of essential utility services or public
road projects.
B. Sounds originating from temporary con-
struction sites as a result of construction activ-
ity are exempt from the provisions of this
chapter, but only during the hours of 7:00 a.m.
to 6:00 p.m. on weekdays and 10:00 a.m. to
6:00 p.m. on Saturdays, excluding Sundays
and federal holidays. [Ord. 3469 § 1, 2003;

5.30.120 Variances.
A. Variances may be granted to any person
from any requirement of ECC 5.30.040 or
5.30.110 if findings are made that immediate
compliance with such requirement cannot be
achieved because of special circumstances ren-
dering immediate compliance unreasonable in
light of economic or physical factors,
encroachment upon an existing noise source or
because of nonavailability of feasible technol-
ogy or control methods.
B. Any such variance or renewal thereof
shall be granted only for the minimum time
period found to be necessary under the facts
and circumstances.
C. Variances shall be processed in the fol-
lowing manner:
1. The mayor or his/her designee may
grant no more than two administrative vari-
ances during any six-month period for no more
than two consecutive days in those cases
where unplanned, unusual physical or eco-
nomic circumstances arise which make it nec-
essary to complete immediate construction
work and notice to adjacent property owners is
not feasible. Notice of the administrative vari-
ance shall be given to the police department
and posting the subject property by the appli-
cant. Variances shall be applied for and
granted in advance. Any period of violation
shall be deducted from the two-day maximum.
2. In circumstances where it is not possi-
ble to meet the normal variance process, the
mayor or his/her designee may also grant no

more than one administrative variance of lon-
ger than two days but no longer than seven
days during any six-month period pursuant to
this section. Notice shall be mailed to all prop-
erty owners within 300 feet stating the admin-
istrative variance allowed, any variance
conditions and the duration of such adminis-
trative variance. Notice shall also be given to
the police department and posting the subject
property by the applicant.
3. In those circumstances where vari-
ances to the noise standards are anticipated, the
variance must be processed in the same man-
ner provided for in ECDC 20.85.020 utilizing
the criteria found in this section.
D. The grant of a variance shall not relieve
any person from the requirements of ECC
5.30.130 relating to public disturbance noises.
E. Variances granted pursuant to this sec-
tion are subject to review under ECDC

5.30.130 Public disturbance noises.
It is unlawful for any person knowingly to
cause or make, or for any person in possession
of property knowingly to allow to originate
from the property, unreasonable noise which
disturbs another, and to refuse or intentionally
fail to cease the unreasonable noise when
ordered to do so by a police officer. Public dis-
turbance noises shall include, but shall not be
limited to, the following sounds or combina-
tions of sounds:
A. Frequent, repetitive or intermittently
continuous sounds made by any horn or siren
attached to a motor vehicle except such sounds
that are made to warn of danger or that are spe-
cifically permitted or required by law.
B. Frequent, repetitive or intermittently
continuous sounds made in connection with
the starting, operation, repair, rebuilding or
testing of any motor vehicle, motorcycle, race
vehicle, off-highway vehicle or internal com-
bustion engine.

C. Loud and frequent, repetitive or inter-
mittently continuous sounds made by the use
of a musical instrument or instruments or other
device capable of producing sound when
struck by an object, of a whistle, or of a sound
amplifier or other device capable of producing,
amplifying or reproducing sounds.
D. Loud and frequent, repetitive or inter-
mittently continuous sounds made by the
unamplified human voice or voices between
the hours of 10:00 p.m. and 7:00 a.m.
E. Sounds made for any duration or fre-
quency from the starting and/or running of the
engine of a race vehicle. [Ord. 3988 § 1, 2015;

5.30.140 Citizen complaints.
Whenever it is stated in writing by three or
more persons having separate residences in a
neighborhood that any person is violating any
of the provisions of this chapter, the noise con-
trol administrator or his/her designee shall
review such complaints. After the noise con-
trol administrator or his/her designee deter-
mines that a violation has occurred, the
administrator or his/her designee shall advise
the owner of the complaint and that such vio-
lation is a nuisance and must cease. Failure of
any person to cease any violation of this chap-
ter shall be subject to penalties as established

5.30.150 Penalties.
A. Any person violating any provision of
this chapter shall be guilty of a civil infraction,
which shall be punishable by a fine of $100.00.
B. Any person committing a second viola-
tion of any provision of this chapter within one
calendar year shall be guilty of a civil infrac-
tion, which shall be punishable by a fine of
$250.00.
C. Any person committing a third violation
of any provision of this chapter within one cal-
endar year shall be guilty of a misdemeanor

and, upon conviction thereof, be sentenced to
a fine not to exceed $1,000 and/or 90 days in

5.30.160 Severability.
If any word, phrase or other portion of this
chapter is for any reason held invalid, the
remaining portions of this chapter shall not be

5.30.200 Quiet zones — Establishment.
The city council shall conduct a public hear-
ing to consider the establishment of a quiet
zone when:
A. Five or more persons from different res-
idences within the same neighborhood sign a
petition requesting the establishment of a quiet
zone, and file the same with the planning
department; and
B. Notice of such hearing is given in the
manner prescribed for hearing a proposed

10.16.020 Vacancy — Removal.
Vacancies occurring other than through the

inefficiency, neglect of duty or malfeasance in
office. Members shall also be removed for fail-
ure to maintain attendance as required by pro-

A. The purpose of the Edmonds arts com-
lission is to promote the arts as an integral part
f community life. The commission provides
uality experiences to increase public aware-
ess of the arts, assisting the work of students,
rtists and local arts organizations, while pro-
iding public art that contributes to the com-
-tunity identity and establishing and pursuing
ung range goals to benefit the arts and the
ommunity.
B. There is established an Edmonds civic
its commission which shall be composed of
even members who shall be appointed by the
payor subject to confirmation by the city coun-
il. All members of the commission shall be
esidents of the Edmonds community. At least
our members of the commission shall be
evolved in the instruction of, or otherwise pro-
essionally engaged in, the visual, literary

A. In order to ensure the fewest terms will
expire in any one year, the terms of the

Thereafter, the term of membership shall be

B. Any appointment to a position vacated
other than by the expiration of the term of the
appointment shall be to fill the unexpired por-

10.20.030 Officers of commission —
Meetings — Quorum.
Members of the commission shall meet and
organize by electing from the members of the
commission a chairman and a vice-chairman,
and such other officers as may be determined

chairman to preside at all meetings. The vice-
chairman shall perform this duty in the absence
of the chairman. A majority of the board shall
constitute a quorum for the transaction of busi-
ness. The commission shall set its own meeting
dates and shall give notice of such meeting in
compliance with the Open Public Meeting Act
of the state of Washington, as it now exists and
