Edmonds City Code
mittees of the commission are not city commit-
tees and shall not transact public business, and
their meetings shall not be considered public
meetings for the purposes of the Open Meeting
and Record Act. Such subcommittees shall
make recommendations only to the sister city
commission. This statement of purpose is not
intended to avoid any requirement of state law
but rather to recognize that such subcommit-
tees and their membership may shift from time
to time, and are groups of interested citizens
working together to promote the activities of
the commission, subject to its approval.
10.60.030 Formal commission structure.
Only those commission members appointed
by the mayor and confirmed by the city council
shall be covered by the city's indemnification
ordinance. One purpose of the commission will
be to promote its activities through broad citi-
zen participation; provided, however, that sub-
committee members and other citizens partici-
pating in the commission functions shall not be
covered by the city's indemnification ordi-
nance nor the city's liability insurance cover-
age. Official activities of the sister city com-
mission shall comply with established city
ordinance procedures and accounting proce-
dures.
10.60.040 Contributions of private funds.
The administrative services director is
hereby authorized and directed to work with
the commission to establish a fund or appropri-
ate subfund or accounting category in order to
segregate private monies contributed to the
city for the purpose of assisting or promoting
the sister city commission effort. The purpose
of this segregation will be to keep and maintain
the private character of these funds in order
that they may be used to entertain and host vis-
iting dignitaries and to do other things which
the city would be otherwise prohibited from
doing with public funds. In all other respects,
the funding of the commission shall be on such
basis as the council shall determine in accor-

dance with its annual budget; provided, how-
ever, it is the intention of the city council that
staff support be provided through the office of
the mayor and that special projects of the com-
mission be funded through its applications to
other interested bodies. For example, the pro-
motion of tourism through Japanese tourists
may trigger application for tourism funds, an
art project may result in applications to the
Edmonds arts commission, and other similar
projects will be funded in accordance with
their merit and the purposes for which other
available funds are provided. The commission
is urged and expected to continue its fund rais-
ing efforts in order to provide a separate source
of private funding for its projects.
10.60.050 Expenditures and other financial
procedures.
Expenditure of all funds shall be expended
in accordance with generally accepted ac-
counting procedures and those procedures es-
tablished by the administrative services direc-
tor and the state auditor; provided, however,
that private funds donated for the purpose of
hosting shall be segregated from public funds.
The commission shall maintain a proper audit
trail for all expenditures and carefully differen-
tiate between public and private funds to the
end that no public monies of the city are spent
on promotional hosting or visiting dignitaries
except in conjunction with public celebrations
and events approved for public expenditure by
the opinion of the State Auditor and Attorney

the commission.
A. There is hereby created an Edmonds
diversity commission consisting of nine mem-
bers.
B. The mission of the Edmonds diversity
commission is to promote and embrace diver-
sity through action, education, and guidance.
The commission seeks to foster an understand-
ing that includes, accepts, respects and appre-
ciates each individual member of our
community. [Ord. 3994 § 1 (Exh. A), 2015].
10.65.020 Appointment, membership and
terms of appointment.
A. The Edmonds diversity commission will
seek to attract members that are interested in
diversity issues, can respect different view-
points, are action -oriented, and have personal
experience that will provide empathy and
community understanding regarding issues of
diversity and will contribute to a diverse com-
mission. The mayor, city council and commis-
sion will consider the EEOC goals in selecting
the initial slate of commission members.
Members of the commission must be residents
of the city of Edmonds.
B. The first slate of commissioners seated
will be selected by the mayor and city council.
The mayor will appoint two members, and
each of the seven councilmembers will appoint
one member to the commission. Subsequent

appointments will be made by the seated com-
mission and will be subject to council confir-
mation.
C. Terms of the commission members will
be three years, except as set forth below. There
will be no term limits.
D. In the event that any commissioner
resigns or fails to attend three consecutive
commission meetings, that position will be
deemed vacant, and a subsequent appointment
will be made by a vote of the seated commis-
sion, subject to council confirmation.
E. In order to ensure the fewest terms will
expire in any one year, the initial terms of the
appointed positions will be staggered in the
following manner:
1. Position No. 1: expires after one year;
appointed by the mayor.
2. Position No. 2: expires after one year;
appointed by council seat No. 1.
3. Position No. 3: expires after one year;
appointed by council seat No. 2.
4. Position No. 4: expires after two years;
appointed by council seat No. 3.
5. Position No. 5: expires after two years;
appointed by council seat No. 4.
6. Position No. 6: expires after two years;
appointed by council seat No. 5.
7. Position No. 7: expires after three
years; appointed by council seat No. 6.
8. Position No. 8: expires after three
years; appointed by council seat No. 7.
9. Position No. 9: expires after three
years; appointed by the mayor.
F. Members may be removed by the mayor
with the approval of city council after a public
hearing before the city council, for ineffi-
ciency, neglect of duty, or malfeasance in
office. Any vacancy on the commission shall
be advertised, and the new appointee shall be
selected from the applications received. Any
appointment to a position vacated other than
by the expiration of the term of the appoint-
ment shall be to fill the unexpired portion of
the term.

G. The seated commission will adhere to
the code of conduct adopted by city council
and pertinent to boards and commissions. Vio-
lations of the code of conduct shall constitute
malfeasance in office.
H. The city council president may appoint
one councilmember to serve as a nonvoting, ex
officio member of the commission.
I. In accordance with Chapter 10.03 ECC,
the commission may appoint a high school or
college student to participate as a nonvoting
member of the commission. [Ord. 3994 § 1

10.65.030 Officers of commission —
Meetings — Quorum.
Members of the commission shall meet and
organize by electing from the members of the
commission a chair, vice chair, and such other
officers as may be determined by the commis-
sion. It shall be the duty of the chair to preside
at all meetings. The vice chair shall perform
this duty in the absence of the chair. Five mem-
bers shall constitute a quorum for the transac-
tion of business. A majority of the quorum
may transact any particular business of the
commission. The commission shall set its own
meeting dates and the city shall give notice of
such meeting in compliance with the Open
Public Meetings Act of the state of Washing-
ton, as it now exists and as it may be amended
from time to time. Professional and general
staff will be provided at the discretion of the

10.65.040 Powers and duties.
The commission is empowered to advise
and make recommendations to the mayor and
city council, and as appropriate to other boards
and commissions on such matters as may be
specifically referred to the commission by the
mayor or city council, including, but not lim-
ited to:

A. Serve as a commission for city govern-
ment and the community by providing infor-
mation, education, and communication that
facilitates understanding of diversity and to
celebrate and respect individual differences.
B. Recommend to the mayor and city coun-
cil diversity opportunities to promote pro-
grams, and provide guidance to assure an
accessible, safe, welcoming and inclusive gov-
ernment and community.
C. Support, challenge, and guide govern-
ment and the community to eliminate and pre-
vent all forms of discrimination.
D. The commission shall deliver an annual
report to the city council in written and oral
form each year, when appropriate, to begin at
least one year after the commission begins its
work, and during other times as directed by the

A lodging tax advisory committee is hereby
created pursuant to the provisions of Chapter
67.28 RCW. The duties and structure of the
advisory committee shall be interpreted and
applied pursuant to the requirements of Chap-
ter 67.28 RCW as the same exists or is
amended, and, in the event of conflict between
the provisions of this chapter and Chapter 3.34
ECC, and Chapter 67.28 RCW, the state stat-
ute shall control. In the event of ambiguity, all
ambiguity shall be resolved in favor of and in
conformance with the provisions of the state

10.70.020 Membership.
The lodging tax advisory committee shall
consist of five members appointed by the city
council. Committee membership shall consist
of:
A. Two members of representatives of
businesses required to collect tax under this
chapter;
B. Two members who are persons involved
in activities authorized to be funded or sup-
ported by revenues received under this chap-
ter;
C. A fifth representative who shall be an
elected official of the city and who shall chair
the commission;
D. The committee may be enlarged at the
discretion of the city council recognizing there
must always be equal representation from the
tax providers and the tax users as required by
RCW 67.28.1817, as now or hereafter
amended;

E. In addition, the city council may appoint
an additional nonvoting member who is an
elected official of the city and a nonvoting
member who is an elected official of Snohom-
ish County.
Persons eligible for appointment under sub-
section A of this section are not eligible for
appointment under subsection B, and persons
who are eligible under subsection B of this sec-
tion are not eligible for appointment under
subsection A. [Ord. 3166 § 3, 1997].
10.70.030 Duties.
The committee shall provide advice and rec-
ommendations in accordance with the provi-
sions of Chapter 67.28 RCW as the same exists
or is hereafter amended. The city council shall
submit for review and recommendation an
imposition of taxes under this chapter, an
increase in the rate of tax imposed under this
chapter, repeal of an exemption from the tax
imposed under this chapter, or a change in the
use of revenue received under this chapter. The
city council shall submit such items for consid-
eration at least 45 days before its final action
on a passage of a proposal by the city council.
The advisory committee shall receive public
comment on the proposal in accordance with
the provisions of Chapter 3.34 ECC. The fail-
ure of the advisory committee to timely submit
comments before final action on or passage of
the proposal shall not prevent the city council
from acting on such a proposal. In the event
that the city council determines it appropriate
in its sole discretion to amend a proposal fol-
lowing the receipt of comment by the advisory
committee, it is not required to resubmit such
proposal to the advisory committee before act-

10.70.040 Expiration of appointment.
An appointment of each member of the
committee shall expire annually on December
31 st. The city council shall review member-
ship annually and shall make such changes as
