Every special ordinance of this city govern- ing the following subject matter, whether con- tained in whole or in part within this code, is excluded from the operation and effect of ECC 1.01.080 and is not affected by the superseding provisions hereof. annexations; franchises; naming roads; streets and public places; acqui- sition or disposal of public property; vacation of streets, alleys, or public ways; acceptance of any gift, device, license or other benefit; pro- vided that the foregoing enumeration of excep- tions or exclusions shall not be deemed to be exclusive or exhaustive, it being the intent and purpose to exclude from repeal any and all ordinances not of a general nature. [Ord. 2183 § 2, 1980]. 1.01.100 Prohibited acts include causing, permitting, etc. Whenever in this code any act or omission is made unlawful it includes causing, allowing, permitting, aiding, abetting, suffering, or con- cealing the fact of such act or omission. [Ord. 2183 § 2, 1980]. 1.01.110 Severability. If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this code. The council declares that it would have passed this code and each sec- tion, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases had been declared invalid or uncon- stitutional, and if for any reason this code or any portion thereof should be declared invalid or unconstitutional, then the original ordinance or ordinances shall be in full force and effect. [Ord. 2183 § 2, 1980]. 1.02.030 Chapter 1.02 CITY CLASSIFICATION Sections, 1.02.010 Adoption of optional municipal code. 1.02.020 Effective date. 1.02.030 City council positions. 1.02.031 Council president. 1.02.035 Filling vacant council positions. 1.02.040 Existing city laws and regulations. 1.02.060 Mid -biennial budget review and modification. 1.02.010 Adoption of optional municipal code. There is adopted for the city of Edmonds, Washington, the classification of noncharter code city retaining the mayor -council plan of government under which the city of Edmonds is presently operated, as provided in Chapter 35A.12 RCW, endowed with all the applicable rights, powers, privileges, duties and obliga- tions of a noncharter code city as the same now exists, or may be provided hereafter, including any and all supplements, amendments or other modifications of said title hereafter at any time enacted. [Ord. 1513, 1970]. 1.02.020 Effective date. The city clerk is authorized and directed to forward to the secretary of state a certified copy of the ordinance codified herein for filing pursuant to RCW 35A.02.040, as amended, on the thirty-first day of December, 1970, and upon which filing the city of Edmonds shall thereafter be classified as a noncharter city as herein provided commencing with the first day of January, 1971. [Ord. 1513, 1970]. 1.02.030 City council positions. The city council shall continue to hold office until their successors are elected and qualified at the next biennial municipal elec- tions to be conducted as provided in Chapter 1-5 (Revised 10/15) 1.02.031 35A.29 RCW. The four existing city council positions which terms will expire January 10, 1972, shall be elected for four-year terms in the 1971 municipal elections. The three exist- ing city council positions which terms expire January 14, 1974, shall be elected for new four-year terms in the 1973 municipal elec- tions. Thereafter the requisite number of city council positions shall be filled by election biennially as the terms of their predecessors expire and shall serve for terms of four years. The positions to be filled on the city council shall be designated by consecutive numbers and shall be dealt with as separate offices for all election purposes as provided by Chapter 35A.29 RCW. [Ord. 1513, 1970]. 1.02.031 Council president. The council president shall be elected for a one-year term by the city council at the first council meeting of each year and shall serve until his or her successor is elected at the first council meeting of the next year. A. At the same time, the city council shall elect a council president pro tempore who shall serve in the absence of the council president. In the event that both the council president and president pro tempore are unavailable, the council president shall appoint a member of the council to fulfill his/her duties while both are unavailable. B. In addition to any other duties assigned by the city council, the council president shall have the following responsibilities: 1. Assign members of the city council as members and liaisons to boards, commissions, and committees, and otherwise supervise the committee system; 2. Formulate and prepare the agenda for city council meetings; and 3. Supervise and direct the activities of any staff whose primary responsibility is to support the city council. C. In addition to the salary as a member of the city council, the council president shall be entitled to receive additional compensation not (Revised 10/15) 1-6 to exceed $200.00 per month. In the event a vacancy or vacancies shall occur on the city council, such position(s) shall be filled until a successor to such position(s) can be elected for the remainder of the unex- pired term(s) at the next municipal election. Such election process shall comply with the requirements of RCW 35A.12.050 and Chap- ter 42.12 RCW. In addition the city council shall establish a process commensurate with the time available which includes, at a mini- mum, public notification by posting and publi- cation in the city's legal newspaper, the establishment of an application process with a clearly stated deadline for the submission of letters of interest, the development of ques- tionnaires to assist the city council in its pro- cess, a public interview process conducted by the city council and nominations and selection by the city council during an open public meet- ing. All portions of this process shall be open to the public unless the city council in its dis- cretion elects to discuss the qualifications of a candidate for public office in executive session as provided for by RCW 42.30.110(h). B. In the event that a council member shall resign or otherwise become ineligible to hold office after the date when the council position has been filled by election but prior to the date on which the newly elected council member is eligible to take office, the city council may in its sole discretion elect to dispense with the procedures established in subsection A of this section and appoint the newly elected succes- sor to fill the vacancy for the remainder of the unexpired term. [Ord. 3382 § 1, 2001; Ord. 3005 § 1, 1995; Ord. 1841 § 2, 1976]. Edmonds City Code 1.02.040 Existing city laws and regulations. All ordinances, resolutions and orders adopted under the third class city classification, where not in conflict with state law, shall con- tinue in force until repealed or amended by the city council under the newly adopted optional municipal code classification of noncharter code city under the mayor -council form of gov- ernment. [Ord. 1513, 1970]. 1.02.060 Mid -biennial budget review and modification. A review of the mid -biennial budget shall commence no sooner than eight months after the start nor later than conclusion of the first year of the fiscal biennium. The mayor shall prepare the proposed budget modification and shall provide for publication of notice of hear- ings consistent with publication of notices for adoption of other city ordinances. Public hear- ings on the proposed budget modification shall be heard prior to the adoption of the ordinance modifying the biennial budget. At least seven days before said hearings, the mayor shall dis- tribute the proposed budget modification to members of the city council, with copies avail- able to the public at City Hall. [Ord. 3671 § 1, 2007]. 1.03.030 Chapter 1.03 POSTING AND PUBLICATION OF ORDINANCES AND NOTICES Sections: 1.03.010 Designation of official newspaper. 1.03.020 Posting of notices. 1.03.030 Publication — Effective date of ordinances. 1.03.040 Affidavit of publication. 1.03.010 Designation of official newspaper. The Everett Herald is hereby designated as the city's official newspaper for the purpose of publishing ordinances and notices required by law to be published. [Ord. 2511, 1985]. 1.03.020 Posting of notices. Where allowed by law, the posting of notices required to be posted by any provision of this code or any applicable state law shall be at the following three public places, all of which are hereby designated as the official posting places for city notices: A. Public bulletin board in the Edmonds Civic Center, 250 Fifth Avenue North, Edmonds, Washington, 98020; B. Public bulletin board in the Edmonds Public Library, 650 Main Street, Edmonds, Washington, 98020; and C. Public bulletin board, Edmonds branch of the United States Post Office, 201 Main Street, Edmonds, Washington, 98020. [Ord. 2511, 1985; Ord. 2448, 1984]. 1.03.030 Publication — Effective date of ordinances. Promptly after adoption, every ordinance of the city of Edmonds shall be published at least in the official newspaper of the city; provided, that the city reserves the right to publish ordi- nance summaries as authorized by law. The effective date of ordinances published pursu- ant to this section shall be five days after the date of publication, unless otherwise provided 1-7 (Revised 10/15) 1.03.040 by statute, except that an ordinance passed by a majority plus one of the whole membership of the city council, designated therein as a pub- lic emergency ordinance necessary for the pro- tection of the public health, public safety, public property or the public peace, may be made effective upon adoption, but such ordi- nance may not levy taxes, grant, renew or extend a franchise or authorize the borrowing of money. In the event that an ordinance is not pub- lished within 14 calendar days of adoption, the city council, by individual notice to each coun- cil member, shall be advised by the city clerk of the reason for the delay and the expected date of publication. The city clerk shall obtain from the official newspaper an affidavit of publication for each ordinance or notice required to be published therein, which affidavit shall state the date of publication. The affidavit of publication shall be attached to the ordinance and filed for record in the official ordinance book. The date of publication of the ordinance shall be set forth at the foot of the ordinance following the indicated date of passage by the city council. [Ord. 2511, 1985]. The city clerk is hereby directed to post notice in accordance with ECC 1.03.020 of any special meeting or meeting date estab- lished by the council and of any change in a meeting date, time, place or the cancellation thereof. Posting of this notice is for informa- tional purposes only and shall be an addition to any other notice requirement established by Edmonds City Code state law or these ordinances. Any irregularity in the posting of this gratuitous notice shall not in and of itself affect the validity of any meet- ing held in accordance with such original or amended posting. [Ord. 2707, 1989]. 1.04.020 Recessed meetings and continuances. In the event the city council is unable to complete its agenda on any Tuesday, it may recess the meeting to the immediately follow- ing Wednesday at the same time and place as the commencement of the meeting for which the agenda was incomplete. Nothing herein shall be construed to prevent the city council from continuing any item before it in public meeting to a future regularly scheduled Tues- day meeting of the city council. In the event a regularly scheduled city coun- cil meeting falls on a recognized holiday, the meeting shall take place on the immediately following day at the same time and place as it would have were it not for the holiday. In the event that a quorum of the council will not be available for a meeting, insufficient business exists to justify a regularly scheduled meeting, an emergency such as inclement weather or other cause makes meeting atten- dance inappropriate or unreasonable, or other reasonable causes determined by the council president, the council president may cancel a meeting. A. In addition to being subject to removal for other particularized grounds as set forth in applicable provisions of the Edmonds City Code, members of all city boards, commissions and committees (hereinafter "members") except as set forth herein, shall be removed from office, and the position deemed vacant as set forth in ECC 1.05.020(C) if such member attends less than 70 percent of the regular meet- ings in any one calendar year, and/or is not in attendance at three or more consecutive regular meetings. B. The chairperson of the particular board, commission or committee may excuse any member from attendance at any particular meeting or meetings for reasons that are (1) work related, (2) due to illness or death in the family, or (3) extended vacations in excess of two weeks in length; provided, however, each such excused absence shall be so noted by the chairperson at the meeting from which the member is being excused and such fact shall be recorded in the minutes along with the reason given for the excused absence by the member. Excused absences shall not be counted for pur- poses of removal from office, but only if so noted in the minutes as set forth herein. In the absence of the chairperson, the member acting in the chairperson's behalf, such as vice -chair- person or pro tem, shall make the determina- tion of whether the absence is excused, and announce the same for recording in the minutes of the meeting from which the member is (Revised 10/15) 1-10 excused. [Ord. 2556, 1986; Ord. 2033 § 2, 1978; Ord. 2156 § 1, 1980]. 1.05.020 Attendance records. A. The city clerk shall keep a record of attendance of all board, commission and com- mittee meetings. Upon any member failing to attend three or more consecutive regular meet- ings without the chairperson's excuse being noted in the minutes, the city clerk shall certify said member's name in writing to the mayor and shall notify in writing the members, the chairperson, and the appropriate city depart- ment head. B. On or before January 15th of each calen- dar year, commencing in 1980, the city clerk shall compile a list of members, if any, who have attended less than 70 percent of the regu- lar meetings in the past calendar year without the chairperson's excuses being noted in the minutes, and shall certify this list to the mayor. The city clerk shall also notify in writing the members, the applicable chairperson and the appropriate city department head. C. The member shall be automatically removed from office and the position deemed vacant as of the date of the city clerk's written notification as set forth in subsections (A) and (B) of this section. Upon receipt from the city clerk of the names of members failing to maintain atten- dance as provided herein, the mayor shall, within 90 days thereof, submit new nomina- tions to the city council for confirmation. The city council shall confirm or reject the nomina- tions within 30 days after the mayor submits the nominations to the council for consider- ation. A member removed for failing to main- tain attendance as provided by this chapter may not be renominated or reappointed to a position on that or other city of Edmonds' board, com- Edmonds City Code 2.12.020 Pre-existing rights and obligations not impaired. The city council's determination to contract or not contract for fire services with Snohom- ish County Fire District No. 1 and the provi- sions of this chapter shall not impair any existing vested right or vested obligation cre- ated under the provisions of state law or under Chapter 2.50 ECC, Firemen's Relief and Pen- sion System, Chapter 2.60 ECC, Reserve Fire Fighters' Relief and Pensions Act, Chapter 2.70 ECC, Retirement System, and Chapter 10.30 ECC, Disability Board, as well as the MEBT plan of the city. The rights of any per- son under such system vested prior to the transfer of fire service responsibility by con- tract shall remain in full force and effect and are not impaired by either such or the adoption of this chapter. There is hereby established a municipal court entitled "The Municipal Court of the city of Edmonds," hereinafter referred to as "municipal court," which court shall have jurisdiction and shall exercise all powers enu- merated herein and in Chapter 3.50 RCW together with such other powers and jurisdic- tion as are generally conferred upon such court in this state either by common law or by express statute. [Ord. 2538 § 2, 1985]. 2.15.020 Jurisdiction. The municipal court shall have exclusive original jurisdiction over traffic infractions arising under city ordinances and exclusive original criminal jurisdiction of all violations of city ordinances duly adopted by the city of Edmonds. The municipal court shall have orig- inal jurisdiction of all other actions brought to enforce or recover license penalties or forfei- 2-11 (Revised 10/15) 2.15.030 tures declared or given by such ordinances or by state statutes. The municipal court shall also have the jurisdiction as conferred by statute. The municipal court is empowered to forfeit cash bail or bail bonds and issue execution thereon; and in general to hear and determine all causes, civil or criminal, including traffic infractions, arising under such ordinances and to pronounce judgment in accordance there- with. [Ord. 2538 § 2, 1985]. 2.15.030 Judges — Appointment — Qualifications. A. The municipal judge shall be appointed by the mayor for a term of four years, subject to the confirmation by the city council. The first judicial appointment to the position of mayor was effective on January 1, 1986, and the municipal judge shall serve a four-year term commencing upon the date of his or her appointment. The mayor shall endeavor to make his or her appointment 30 days prior to the expiration of each judicial term; provided, however, that if the city council fails to con- firm a mayoral appointment, the mayor and city council shall have 60 days commencing upon either the expiration of the pending judi- cial term or the failure of the city council to confirm the mayoral appointment, whichever shall later occur. In the event that for any rea- son the mayoral appointment is not confirmed, the incumbent municipal judge shall hold over and continue in office until such time as a suc- cessor is appointed. B. The position of municipal judge shall be filled by election for the term commencing on January 1, 2010, and every four years thereaf- ter. The municipal judge shall be elected in the same manner as other elective city officials are elected to office. The term of the municipal judge shall be for four years. The mayor shall not appoint a municipal judge pursuant to sub- section A of this section for a term beyond December 31, 2009. Nothing in this section (Revised 10/15) 2-12 shall limit the mayor's authority to fill the position of municipal judge pursuant to ECC 2.15.070 or 2.15.210. C. A person elected or appointed as munic- ipal judge shall be a citizen of the United States of America and of the state of Washing- ton and a resident of Snohomish County; and an attorney admitted to practice law before the courts of record of the state of Washington. [Ord. 3579 §§ 1, 2, 2006; Ord. 3170 § 1, 1997; Ord. 2538 § 2, 1985]. 2.15.040 Salaries and costs. The salary of the municipal court judge shall be determined according to a formula that mul- tiplies 95 percent of the district court judge's salary as fixed by the Washington Citizens' Commission on Salaries for Elected Officials times the FTE level that has been established for the municipal court judge by the city coun- cil (salary = district courtjudge salary x 95% x FTE level). The effective date of the municipal courtjudge salary increase shall be the same as that set for district court judges by the Wash- ington Citizens' Commission on Salaries for Elected Officials. All costs of operating the municipal court, including but not limited to salaries of judges and court employees, dock- ets, books of records, forms, furnishings and supplies, shall be paid wholly out of the funds of the city. The city shall provide a suitable place for holding court and pay all expenses of maintaining it. [Ord. 4005 § 1, 2015; Ord. 2538 § 2, 1985]. 2.15.050 Municipal court employees. All employees of the municipal court shall, for all purposes, be deemed employees of the city of Edmonds. They shall be appointed by and serve at the pleasure of the municipal judge. [Ord. 2538 § 2, 1985]. 2.15.060 Judges pro tem. The municipal court judge may designate one or more persons as judges pro tempore to serve in the absence or disability of the duly Edmonds City Code appointed judge of the court, subsequent to the filing of an affidavit of prejudice, or in addi- tion to the appointed judge when the adminis- tration of justice and accomplishment of the work of the court make it necessary. Qualifica- tions of the judges pro tempore shall be the same as for judges appointed pursuant to ECC 2.15.030. Judges pro tempore shall have all the powers of the duly appointed judge when serv- ing as judges pro tempore of the court. Before entering on his or her duties, each judge pro tempore shall take, subscribe and file an oath as is taken by the duly appointed judge. Judges pro tempore shall receive such compensation as shall be fixed by ordinance. [Ord. 3384 § 1, 2001; Ord. 3170 § 2, 1997; Ord. 2538 § 2, 1985]. 2.15.070 Judicial vacancy. Any vacancy in the municipal court due to a death, disability, or resignation of a municipal court judge shall be filled by the mayor for the remainder of the unexpired term. The appoint- ment shall be subject to confirmation of the city council. The appointed judge shall be qualified to hold the position of judge of the municipal court as provided in this chapter. [Ord. 2538 § 2, 1985]. 2.15.080 Municipal court hours. The municipal court shall be open and shall hold such regular and special sessions as may be prescribed by the municipal court judge; provided, that the municipal court shall not be open on nonjudicial days. [Ord. 2538 § 2, 1985]. 2.15.120 Deferral and suspension of sentences. Unless otherwise provided by state law, the court shall have the following sentencing authority: A. After a conviction, the court may defer sentencing and place the defendant on proba- tion and prescribe the conditions thereof, but in no case shall it extend for more than two years 2.15.160 from the date of conviction. During the time of the deferral, the court may, for good cause shown, permit a defendant to withdraw the plea of guilty, permit the defendant to enter a plea of not guilty, and dismiss the charges. B. For a period not to exceed two years after imposition of sentence, the court shall have continuing jurisdiction and authority to suspend the execution of all or any part of the sentence upon stated terms, including install- ment payment of fines. C. Deferral of sentence and suspension of execution of sentence may be revoked if the defendant violates or fails to carry out any of the conditions of the deferral or suspension. Upon the revocation of the deferral or suspen- sion, the court shall impose the sentence previ- ously suspended or any unexecuted portion thereof. In no case shall the court impose a sen- tence greater than the original sentence, with credit given for time served and money paid on fine and costs. D. Any time before entering an order termi- nating probation, the court may revoke or modify its order suspending the imposition or execution of the sentence. If the ends of justice will be served and when warranted by the ref- ormation of the probationer, the court may ter- minate the period of probation and discharge the person so held. [Ord. 2538 § 2, 1985]. 2.15.140 Complaints. All criminal prosecutions for the violation of a city ordinance shall be conducted in the name of the city and may be upon the com- plaint of any person. [Ord. 2538 § 2, 1985]. 2.15.160 Pleadings, practice and procedure. Pleadings, practice and procedure in cases not governed by statutes or rules specifically applicable to municipal courts shall, insofar as applicable, be governed by the statutes and rules now existing or hereafter adopted gov- 2-13 (Revised 10/15) 2.15.180 erning pleadings, practice and procedure applicable to district courts. [Ord. 2538 § 2, 1985]. 2.15.180 Case transfers. A transfer of a case from the municipal court to either another municipal judge of the same city or to a judge pro tempore appointed in the manner prescribed by this chapter shall be allowed in accordance with RCW 3.66.090 in all civil and criminal proceedings. [Ord. 2538 § 2, 1985]. 2.15.200 Court seal. The municipal court shall have a seal which shall be the vignette of George Washington, with the words "Seal of The Municipal Court of Edmonds, State of Washington," surround- ing the vignette. [Ord. 2538 § 2, 1985]. 2.15.210 Removal of judge. A municipal judge shall be removed only upon conviction of misconduct or malfeasance in office, or because of physical or mental dis- ability rendering the judge incapable of per- forming the duties of the office. Any vacancy in the municipal court due to death, disability or resignation of the municipal court judge shall be filled by the mayor, for the remainder of the unexpired term. The appointment shall be subject to confirmation by the city council. The appointed judge shall be qualified to hold the position of judge of the municipal court as provided in this ordinance and Chapter 3.50 RCW. [Ord. 2538 § 2, 1985]. 2.15.220 Civil jury trials. In all civil cases, the plaintiff or defendant may demand a jury, which shall consist of six citizens of the state who shall be impaneled and sworn as in cases before district courts, or the trial may be by a judge of the municipal court; provided, that no jury trial may be held on a proceeding involving a traffic infraction. A party requesting a jury shall pay to the court a fee which shall be the same as that for a jury (Revised 10/15) 2-14 in district court. If more than one party requests a jury, only one jury fee shall be col- lected by the court. The fee shall be appor- tioned among the requesting parties. Each juror shall receive $10.00 for each day in atten- dance upon the municipal court, and in addi- tion thereto shall receive mileage at the rate determined under RCW 43.03.060. [Ord. 2538 § 2, 1985]. 2.15.240 Criminal process. All criminal process issued by the municipal court shall be in the name of the state of Wash- ington and run throughout the state, and be directed to and served by the chief of police, marshal, or other police officer of any city or to a sheriff in the state. [Ord. 2538 § 2, 1985]. 2.15.260 Revenue — Disposition. A. Costs in civil and criminal actions may be imposed as provided in district court. The owner shall be notified by mail at the address on the account, and the occupant shall be notified by mail, door hanger or other form at the property. Mailed notices shall be deemed received three business days after mailing. All notices shall contain the following: 1. Reason for water shut off, 2. Delinquent amount that needs to be paid to avert interruption in water service; 3. Instructions on scheduling a hearing to show that the account is not delinquent; and 4. The day on or after which water will be shut off. C. After notification, the owner and the occupant shall be afforded the opportunity to present to the administrative services director, or a designated official, evidence that the delin- quent charges have been paid. Such opportu- nity shall be afforded before the water is shut off, provided, that the owner or the occupant make a request for the same to the administra- tive services director, or a designated official, within three days of presumptive receipt of the notice. The owner and the occupant shall be notified of the decision, and this decision shall not be sub- ject to further appeal. If the account is found to be delinquent and water has not been shut off, water will be shut off as previously scheduled or three days after final decision, whichever date is later. If the account is not found to be delinquent and water has been shut off, water will be turned on without being subject to turn on and turn off charges in ECC 7.10.070. A charge equal to $25.00 shall be added as a fee to each delinquent utility bill, except in cases of extraordinary hardship as determined by the finance director or his/her designee. The decision of the finance director can be appealed to the Edmonds city council by filing an appeal with the city clerk no later than 14 days after the director's decision was mailed. The account shall be considered delinquent if full payment is not made within 35 days after the sending of the regular billing. Such delin- quency notice and billing will be provided 35 days following the mailing of a regular utility bill. This charge shall be applicable to all delin- quent utility billing accounts. In order to be considered delinquent the outstanding princi- pal balance of an account must total at least $40.00, and no delinquency charge shall be levied against any account balance under $40.00. This delinquency charge shall be paid prior to the application of any payment against the fee or charge initially assessed and nothing herein shall be interpreted to limit the city's (Revised 10/15) 7-4 collection of its attorneys' fees and other rea- sonable costs and charges in the event it is forced to seek judicial remedy for collection. Nothing herein shall be interpreted to limit the city's ability to enforce a sewerage lien on properties for delinquent and unpaid sewerage utility bills, as authorized by RCW 35.67.200 through 35.67.290, including terminating water service until charges are paid and/or pur- suing sewerage lien foreclosure. [Ord. 4000 § 1, 2015; Ord. 3629 § 4, 2007]. 7.10.030 Suspension of water use — Procedure. Should a customer desire to discontinue the use of water for a period of time, notice thereof must be given in writing to the utility billing department. The water will then be shut off and turned on again upon notice to the utility billing department. The customer shall be required to pay charges as set forth in ECC 7.10.070. [Ord. 3629 § 5, 2007; Ord. 1942 § 2, 1977; Ord. 1448, 1969; Ord. 413 § 17, 1929]. 7.10.040 Access to buildings. Employees of the water division shall have access during business hours to all parts of buildings to which water may be delivered from the city mains for the purpose of ascer- taining the number of rooms and families in the house or inspecting the conditions of the pipes and fixtures and the manner in which water is used. [Ord. 413 § 19, 1929]. 7.10.050 Access to curb cocks and meter covers. The water division shall have free access to curb cocks and water meter covers. All persons are prohibited from piling rubbish, building, or other materials thereon. [Ord. 413 § 20, 1929]. 7.10.060 Limitation on water use. In the event that a supplier notifies the city of a shortage of water or the director reason- ably determines such a shortage to be immi- nent, the community services director or Edmonds City Code his/her designee is authorized to implement the water shortage response plan in order to effi- ciently safeguard the safety and health of the general public or to provide for the public con- venience. The use of water in the city, or in any portion thereof, for irrigation, cooling, sprin- kling or other uses may be forbidden, re- stricted, or regulated and such regulations may be made effective as to all customers or as to 7-4.1 7.10.060 (Revised 10/15) This page left intentionally blank. (Revised 10/15) 7-4.2 Edmonds City Code nection shall not be completed until such time such assessed costs are paid. In the event that the owner or owners believe that the reconnec- tion charges are in excess of the amount actu- ally incurred or which reasonably may be incurred the city, the owner or owners may appeal the set fee or additionally designated fee to the hearing examiner in the same manner as if it were a Type II decision (see Chapter 20.01 ECDC). [Ord. 3736 § 6, 2009; Ord. 2676 § 1, 19881. 7.10.070 Turn on and turn off charges. The charge for turning off the water at the main shall be $20.00 and the charge for turning on the water at the main shall be $20.00 if done during regular working hours. If the water is turned on or off at any time other than during regular working hours, there shall be an addi- tional charge of $125.00. The water division, upon the request of any water user, shall inspect the water meter on the user's premises. A deposit of $20.00 shall be made with such request to cover the cost of such inspection. In the event such meter is found to be overregistering, such deposit shall be returned to the depositor; otherwise, said deposit shall be retained by the city. The administrative services director, or such authorized representative as he may designate, is authorized to make adjustments or correc- tions to billings for any charge for water ser- vice, including but not limited to connection charges, minimum monthly billings, meter charges, penalty and special charges, improp- erly charged rates, and, subject to the city coun- 7.10.120 cil's approval, the cancellation of uncollectible bills and accounts. All tapping of mains, installation of cor- poration cock, service pipe leading from the mains to the property line, as well as the turn- ing on and off of the water shall be performed by the water division. All connections inside of the premises shall be made by the owner and at his expense. B. In case of application for water service on premises not abutting upon a street upon which there is a city water main, the city will lay its connection from the main toward the premises for a distance equal to the distance from the main to the curbline, the distance in no case to exceed 40 feet, and permit connec- tion therewith by means of a union, or may, at the discretion of the director of public works, upon advance payment of the estimated cost thereof, extend the service to the premises of 7-6.1 (Revised 10/15) This page left intentionally blank. (Revised 10/15) 7-6.2 Edmonds City Code immediate reinstatement or reemployment of such person in the office, place, position or em- ployment from which such person was re- moved, suspended, demoted or discharged; which reinstatement shall, if the commission so provides in its discretion, be retroactive, and entitle such person to pay or compensation from the time of such removal, suspension, de- motion or discharge. The commission, upon such investigation in lieu of affirming the re- moval, suspension, demotion or discharge by directing a suspension, without pay, for a given period, and subsequent restoration to duty, or demotion in classification grade, or pay; the findings of the commission shall be certified in writing to the appointing power and shall be forthwith enforced by such officer. All investigations made by the commission pursuant to the provisions of this section shall be had by public hearing, after reasonable notice to the accused of the time and place of such hearing, at which hearing the accused shall be afforded an opportunity of appearing in person and by counsel and presenting his/her defense. If such judgment or order be con- curred in by the commission or a majority thereof, the accused may appeal therefrom to the court of original and unlimited jurisdiction in civil suits of the county wherein he resides. Such appeal shall be taken by serving the com- mission, within 30 days after the entry of such judgment or order, a written notice of appeal, stating the grounds thereof and demanding that a certified transcript of the record and all papers on file in the office of the commission affecting or relating to such judgment or order, be filed by the commission with such court. The commission shall, within 10 days after the filing of such notice, make, certify and file such transcript with such court. The court of original and unlimited jurisdiction in civil suits shall thereupon proceed to hear and determine such appeal in a summary manner; provided, how- ever, that such hearing shall be confined to the determination of whether the judgment or order of removal, discharge, demotion or sus - 10.25.090 pension made by the commission was or was not made in good faith for cause, and no appeal to such court shall be taken except upon such ground or grounds. 10.25.090 Filling of vacancies — Probationary period. A. Original Appointment to Department. Whenever a vacancy exists, or upon the request of the appointing authority, the com- mission shall certify the names of the persons highest on the applicable eligibility list for the class who are willing to accept appointments in the following numbers: 1. For lists developed through internal testing on an annual basis, or more frequently as requested by the appointing authority, the names of the top five candidates in rank order based upon their final examination scores, including veteran's preference, if applicable. 2. In the continuing testing process, the names of no more than the top 20 candidates in rank order based upon their final examination scores, including veterans' preference, if applicable. B. Promotion Appointments. Whenever the appointing authority determines that a vacancy shall be filled by a promotional appointment, the commission shall certify from the appro- priate eligibility list names as follows: 1. For each and every police officer position above the rank of second class police officer, the commission shall certify the three highest names on such list, from which the appointing authority may appoint any one. 2. For all other employee and noncom- missioned positions covered by civil service, the commission shall certify the three highest names on the eligibility list, from which the appointing authority may appoint any one. 3. Nothing herein shall obligate the appointment authority to fill any position. C. Procedure to Fill Vacancies. If more than one vacancy is to be filled, an additional name shall be certified for each additional vacancy. The appointing authority shall after review of 10-15 (Revised 10/15) 10.25.100 the person so certified appoint one person to each such vacant position. If any person certi- fied by the commission is removed from the list or otherwise requests not to be considered for appointment, the commission shall forthwith certify the next highest person on the list to re- place those removed. The commission in their rules shall establish a procedure for removal of names from the eligibility list either prior to or subsequent to certification to the appointment authority. Whenever requisition is to be made or whenever a position is held by a temporary appointee and an eligible list for the class of such position exists, the commission shall forthwith certify the names of the persons eli- gible for appointment to the appointing power and the appointing power shall appoint one person so certified; provided they are found to be in fact qualified, to the position. D. Probation — Extensions. To enable the appointing authority to exercise a choice in the filling of promotions, no appointment, employ- ment or promotion in any position in the clas- sified service shall be deemed complete until after the completion of a satisfactorily served probationary period. The probationary period for new employees shall be 12 months. The probationary period for persons promoted or transferred to positions with different job descriptions shall be six months. Persons re- employed who have formerly acquired perma- nent status in the class shall not be subject to probation. During such probationary periods the appointing power may terminate the employment of the person certified, if during the performance test thus afforded, upon obser- vation or consideration of the performance of duty, the appointing authority shall designate one of the persons certified as standing within the next three persons highest on the list. Such person shall likewise enter upon the duties until some person is found who is deemed fit for appointment, employment or promotion for the probationary period provided therefor, where- upon the appointment, employment or promo- tion shall be deemed to be complete. The (Revised 10/15) 10-16 commission shall provide a procedure in their rules for extending probationary period of any employee for up to an additional six months if requested by the appointing authority. All offices, places, classifications, job descriptions, positions and employments com- ing within the purview of this chapter shall be created by the mayor and city council or mayor or whoever otherwise is vested with power and authority to select, appoint, or employ any per- son coming within the purview of this chapter, and nothing contained in this section shall infringe upon the power and authority of any such person or group of persons, or appointing authority, to fix the salaries and compensation of all employees employed hereunder. 10.25.110 Enforcement by civil action — Legal counsel. It shall be the duty of the commission to begin and conduct all civil suits which may be necessary for the proper enforcement of this chapter and of the rules of the commission. The commission shall be represented in such suits by the chief legal officer of the city, or his/her designee, but the commission may in any case be represented by special counsel appointed by it. 10.25.120 Deceptive practices — False marks, etc., prohibited.
