B. The Edmonds parks and recreation department shall place appropriate notices pro- hibiting scuba and skin diving in the area above. [Ord. 2531, 1985; Ord. 1991 § 5, 1978; Ord. 1908, 1977]. 5.32.090 Diving allowed by special permission. The activities relating to underwater parks enumerated in ECC 5.32.060 through 5.32.085 shall be specifically prohibited except when: A. Express permission is granted in writing by any one of the following officials for the purpose of research: 1. The mayor or any department head of the city of Edmonds; 2. Any commissioner of the port of Edmonds, or the port manager; 3. The State Department of Fisheries. B. Express permission is granted for emer- gency operations by the mayor, any depart- ment head, any port commissioner, any police officer or any firefighter. C. The department of parks and recreation conducts organized activities under its super- vision. D. A permit is issued by the director of parks and recreation for the purpose of allow- ing maintenance by scuba divers to clean debris and garbage accumulated around Edmonds fishing piers on the following condi- tions: 1. The names of each diver are listed on the permit; 2. A hold harmless agreement and release is obtained from each diver prior to the issuance of a permit; 3. Adequate precautions are required to protect divers from other activities on or in the vicinity of the fishing pier; 5.32.105 4. Permit states the dates and time period during which the maintenance opera- tion shall be conducted; and 5. No marine life shall be removed from the water if that marine life is otherwise pro- tected by this chapter. [Ord. 2531, 1985; Ord. 2425, 1984; Ord. 1507 § 1, 1970]. 5.32.100 Fishing pier regulations. It shall be unlawful for any person to violate any of the following regulations on the Edmonds public fishing pier at the Edmonds boat harbor adjacent to Dayton Beach Park: A. No person shall permit any animal to enter or remain on the fishing pier; provided, however, that this section shall not apply to seeing eye dogs that are being used by blind persons for the purpose of aiding them going from place to place. B. No person shall use or operate any wheeled vehicle upon the fishing pier, includ- ing but not limited to any motor vehicle, bicy- cle, roller skates or skateboard; provided, however, this section shall not apply to autho- rized police, fire and public works vehicles, wheelchairs being used by handicapped per- sons and carriages for infants. C. No person shall cast fishing tackle of any kind or description, including but not limited to, hooks, lines and/or sinkers, from the fishing pier at any location where signs are posted to prohibit such casting. [Ord. 2531, 1985; Ord. 2337 § 1, 1982; Ord. 2065 § 1, 19791. 5.32.105 For collection of marine life on city beaches — Permit required. A. It shall be unlawful for any person to knowingly engage in any of the following activities on any public beach in the city of Edmonds without first obtaining a permit from the Edmonds parks and recreation director or designee: 1. To take, possess, injure, or destroy any bird, mollusk, crustacean, marine or inter- tidal algae or plant, or any other marine or intertidal organism of any kind whatsoever. 5-47 (Revised 2/16) 5.32.107 2. To possess any device intended for the taking of birds, mollusks, crustaceans, marine or intertidal algae or plants or any other marine or intertidal organisms, including but not limited to shovels, clam "guns", buckets, crab pots or traps, hooks, spears or spear guns of every kind and description, nets for captur- ing or retaining in one's possession marine life, gaffs, or any other similar device. B. The parks and recreation director may issue permits for the collection of any marine life from public beaches, other than the Brack- ett's Landing Shoreline Sanctuary, whenever the issuance of such permit will not materially jeopardize the continued viability of marine life on such Edmonds public beaches, or other- wise be contrary to the continued use and enjoyment of the city's public beaches. C. Brackett's Landing Shoreline Sanctuary, as otherwise regulated by this chapter, shall not be subject to the provisions of this section. [Ord. 2531, 1985; Ord. 2402 § 2, 1983]. 5.32.107 State regulations on taking and possession of shellfish adopted by reference. The following sections of the Washington Administrative Code and the Revised Code of Washington regulating the taking of and pos- session of shellfish are hereby adopted by this reference as fully as if herein set forth: A. Chapter 77.32 RCW in its entirety — Licenses. [Ord. 4012 § 1, 2015; Ord. 2918 § 1, 1993; Ord. 2911 § 1, 1993]. 5.32.108 Duties of police officers to enforce shellfish violations. Pursuant to RCW 77.08.010(18), all city of Edmonds commissioned police officers with the primary function of enforcing criminal laws in general shall be deemed "ex officio fish and wildlife officers" for the purpose of enforcement of adopted shellfish regulations. [Ord. 4012 § 2, 2015; Ord. 2911 § 2, 1993]. 5.32.110 Prohibited acts within Brackett's Landing Shoreline Sanctuary. It is unlawful for any person to knowingly commit any of the following acts within the Brackett's Landing Shoreline Sanctuary except when permitted by special permit obtained as provided below: Edmonds City Code A. The provisions of ECC 8.48.110 through 8.48.170 prohibiting the standing or parking of a vehicle shall apply at all times or at those times herein specified or as indicated on offi- cial signs except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police offi- cer or official traffic control device. [Ord. 3564 § 1, 20051. 8.48.137 8.48.120 Regulations not exclusive. The provisions of ECC 8.48.110 through 8.48.170 imposing a time limit on parking shall not relieve any person from the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing, or parking of vehicles in specified places or at specified times. [Ord. 3564 § 1, 2005]. 8.48.125 Parking within 30 feet of private driveway prohibited. The traffic engineer is authorized to prohibit parking within 30 feet on either side of private driveways entering onto any street. The "no parking zone" shall be designated by appropri- ate yellow markings on the curb on either side of the driveway. [Ord. 3564 § 1, 2005]. 8.48.130 Parking prohibited at all times on certain streets. When signs are erected giving notice thereof, no person shall park a vehicle at any time upon any of the streets described in ECC 8.64.030. [Ord. 3564 § 1, 2005]. 8.48.135 Angle parking required — Designation of affected streets. In accordance with the provisions of RCW 46.61.575(3) and 46.90.270(4), angle parking is permitted and required on the following streets in the designated areas and locations: A. The west side of Sunset Avenue from Edmonds Street, north for a distance of 330 feet; B. The north side of Bell Street from Fifth Avenue North, east for a distance of 150 feet; and C. The south side of Bell Street from Fifth Avenue North, east for a distance of 150 feet. [Ord. 3564 § 1, 2005]. 8.48.137 Other than angle parking prohibited. When the city council by ordinance has des- ignated that angle parking is required along any street or portion thereof, and when signs 8-15 (Revised 2/16) 8.48.140 are erected in each block of said street or por- tion thereof, giving notice of such require- ment, no person shall stop, stand or park any vehicle except in conformance with angle parking requirements and the markings estab- lished by the traffic engineer to regulate said parking. [Ord. 3564 § 1, 2005]. 8.48.140 Parking prohibited during certain hours on certain streets. When signs are erected in each block giving notice thereof, no person shall park a vehicle between the hours specified in ECC 8.64.040 on any day except Sundays and public holi- days within the district or upon any of the streets described in ECC 8.64.040. "Public holidays" within the meaning of this chapter and Chapter 8.64 ECC embrace only days for the observance of the following: January 1st (New Year's Day); February 12th (Lincoln's Birthday); third Monday of February (Washington's Birthday); last Mon- day of May (Memorial Day); July 4th (anni- versary of Declaration of Independence); first Monday of September (Labor Day); second Monday of October (Columbus Day); Novem- ber 11th (Veteran's Day); fourth Thursday of November (Thanksgiving Day); and Decem- ber 25th (Christmas Day). If any of these public holidays falls upon any Sunday, the day next following such date shall be the holiday therefor. [Ord. 4008 § 1, 2015; Ord. 3564 § 1, 2005]. 8.48.145 Stopping, standing or parking prohibited during certain hours on certain streets. When signs are erected in each block giving notice thereof, no person shall stop, stand or park a vehicle between the hours specified in ECC 8.64.045 on any Friday, Saturday or Sun- day, or the day immediately preceding those public holidays set forth in ECC 8.48.140 or on public holidays as set forth in ECC 8.48.140 (Revised 2116) 8-16 within the district or upon any of the streets described in ECC 8.64.045. [Ord. 3564 § 1, 2005]. 8.48.150 Stopping, standing or parking prohibited during certain hours on certain streets. A. When signs are erected in each block giving notice thereof, no person shall stop, stand or park a vehicle between the hours spec- ified in ECC 8.64.050(A) on any day except Saturdays, Sundays and the public holidays specified in ECC 8.48.140, within the district or upon any of the streets described in ECC 8.64.050(A). B. When signs are erected in each block giving notice thereof, no person shall stop, stand or park a vehicle between the hours spec- ified in ECC 8.64.050(B) on any day whatso- ever within the district or upon any of the streets described in ECC 8.64.050(B). [Ord. 3564 § 1, 2005]. 8.48.155 Parking time limited on certain streets for certain time periods. When signs are erected on any streets or roads or portions thereof giving notice of a limitation of a period of time for parking, no person shall stop, stand or park a vehicle for longer than the designated period of time pre- scribed, or between the hours designated in such sign or signs, if any, upon any of the roads or streets described in ECC 8.64.065. [Ord. 3564 § 1, 2005]. 8.48.160 Parking time limited on certain streets. When signs are erected in each block giving notice thereof, no person shall park a vehicle on the streets between the hours or on the days specified in ECC 8.64.060. [Ord. 3564 § 1, 2005]. Any monies arising from the disposal of abandoned junk motor vehicles shall be depos- ited in the city's general fund. [Ord. 2076 § 1, 1979]. 8.50.060 Stolen and abandoned vehicles — Reports of notice — Disposition. A. It shall be the duty of the chief of police to report immediately to the chief of the Wash- ington State Patrol all motor vehicles reported to him as stolen or recovered upon forms to be provided by the chief of the Washington State Patrol. B. In the event that any motor vehicle reported as stolen has been recovered, the per- son so reporting the same as stolen shall be guilty of a misdemeanor unless he shall report the recovery thereof to the chief of police to whom such motor vehicle was reported stolen. C. It shall be the duty of the chief of police to report to the chief of the Washington State Patrol all vehicles or automobile hulks found abandoned on a highway or at any other place and the same shall at the direction of a law enforcement officer be placed in the custody of a registered disposer. [Ord. 2076 § 1, 1979]. 8.50.070 Owner of record presumed liable for costs when vehicle abandoned — Exceptions. A. The abandonment of any vehicle or automobile hulk shall constitute a prima facie presumption that the last owner of record is responsible for such abandonment and thus liable for any costs incurred in removing, stor- ing and disposing of any abandoned vehicle. B. A registered owner transferring a vehi- cle shall be relieved from personal liability under this chapter if within five days of the transfer he transmits to the department a seller's report of sale on a form prescribed by the director. [Ord. 2076 § 1, 1979]. 8.50.100 8.50.080 Owner or agent required to pay charges — Lien. A. Any costs incurred in the removal and storage of an impounded vehicle shall be a lien upon the vehicle. All towing and storage charges on such vehicle impounded shall be paid by the owner or his agent if the vehicle is redeemed. In the case of abandoned vehicles, all costs of removal and storage shall be paid by the owner or his agent if the vehicle is redeemed, but if not redeemed, such costs shall be received from the proceeds of sale. B. Either a registered or legal owner may claim an impounded vehicle by payment of all charges that have accrued to the time of recla- mation. If the vehicle was impounded at the direction of a law enforcement agency, the per- son in possession of the vehicle prior to the time of reclamation shall notify such agency of the fact that the vehicle has been claimed, and by whom. [Ord. 2076 § 1, 1979]. 8.50.090 Impounding not to prevent prosecution. The impounding of a vehicle shall not pre- clude charging the violator with any violation of the law on account of which such vehicle was impounded. [Ord. 2076 § 1, 1979]. 8.50.100 Contract with registered disposer to dispose of vehicles and hulks — Compliance required. A. The city may contract with any tow truck operator who is engaged in removing and stor- ing of vehicles and who is registered as a reg- istered disposer by the department for the purpose of disposing of certain automobile hulks, abandoned junk motor vehicles and abandoned vehicles. B. Any registered disposer under contract to the city for the removing and storing of vehicles or hulks shall comply with the admin- istrative regulations relative to the handling and disposing of vehicles or hulks as may be 8-21 (Revised 2116) 8.50.110 promulgated by the police chief or the director [Ord. 2076 § 1, 1979]. 8.50.110 Unlawful to abandon junk motor vehicles. No person shall wilfully leave an abandoned junk motor vehicle on private property for more than 24 hours without the permission of the person having the right to possession of the property, or upon or within the right-of-way of any highway or other property open to the pub- lic for purposes of vehicular travel or parking for 24 hours or longer without notification to the chief of police of the reasons for leaving the motor vehicle in such a place. For the pur- poses of this section, the fact that a motor vehi- cle has been so left without permission or notification is prima facie evidence of aban- donment. Any person convicted of abandoning a junk motor vehicle shall be assessed any costs incurred by the city in disposing of such abandoned junk motor vehicle less any monies accrued to the city from such disposal. [Ord. 2083 § 1, 1979; Ord. 2076 § 1, 1979]. 8.50.120 Abandoning vehicles unlawful. A. No person shall leave or permit a vehicle to remain on any highway or private property without the permission of the owner longer than 24 hours; provided, however, said vehi- cles may remain on the highway for a period not to exceed 72 hours if it is lawfully parked. B. Up to two vehicles registered to a dwell- ing unit may be parked within 1,000 feet of the dwelling unit on the public right-of-way for a period of up to 72 hours. In no case may more than two cars registered to a dwelling unit park on the public right-of-way within 1,000 feet of the dwelling unit. [Ord. 4015 § 1, 2016; Ord. 2076 § 1, 1979]. 8.50.125 Written impound authorization form. Whenever an officer impounds a vehicle pursuant to the provisions of this chapter, the officer shall complete an authorization form (Revised 2116) 8-22 approved by the chief of police which specifies the section of this chapter or Chapter 46.55 RCW authorizing the impound. In the alterna- tive, a law enforcement notice of infraction or citation for an offense which authorizes the impound may be substituted at the officer's discretion. [Ord. 2736, 1989]. 8.50.200 Penalties. Any person violating any provision of this chapter shall be guilty of an infraction and shall be punished by a maximum penalty of $250.00. If any section, subsection, clause or phrase or word of this chapter is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this chapter.
