RESOLUTION NO. 791
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDMONDS, WASHINGTON, AMENDING RESOLUTION
775 AND THE BOUNDARIES DEFINED THEREIN FOR AN
ANNEXATION PETITION FOR AN AREA COMMONLY KNOWN
AS THE AURORA MARKETPLACE ANNEXATION AREA,
DIRECTING THE CITY CLERK TO REVIEW SAID
PETITION TO DETERMINE WHETHER SIGNATURES
PREVIOUSLY CERTIFIED PROVIDE THE REQUISITE
PERCENTAGE REQUIRED BY RCW 35A.14.120 AND TO
MAKE HER REPORT REGARDING CERTIFICATION OF
SAID PETITION.
WHEREAS, on August 3, 1993 the Edmonds City Council
authorized the circulation of a petition for petition method
annexation within the Aurora Marketplace area in accordance with
RCW 35A.14.090 by establishing boundaries, calling for the
assumption of bonded indebtedness, if any, and zoning of the
property, and,
WHEREAS, in the midst of the petition drive at a date
after which the majority of signatures had gathered but prior to
submission of the petitions to the City Clerk and the establishment
of a terminal date, certain of the properties within said
annexation area were reassessed by Snohomish County, reducing the
value of the property represented by the petitioning signatures
from a percentage greater than 60 percent to 59.3 percent in value,
and

WHEREAS, the City Clerk has certified that the submitted
petitions represent 59.3 percent of the assessed valuation of the
property within the defined area, and
WHEREAS, the Snohomish County Boundary Review Board has
permitted boundary reduction to conform to authorizing property
owner's petition signatures, and
WHEREAS, the City Council has reviewed the boundaries and
finds that the purposes and intent of the annexation chapter would
be met by a reduced boundary, and
WHEREAS, the City Council wishes to forward such
boundaries to the City Clerk for consideration of the original
signatures as fixed at the previously established terminal date and
recertify said petition based upon the reduced boundary, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1. The boundaries for property commonly known as
the Aurora Marketplace annexation area previously established
pursuant to City Council action on Resolution 775 on August 3, 1993
are hereby amended as shown in a legal description attached Exhibit
A and a map shown as Exhibit B and incorporated herein by this
reference as if set forth in full.
Section 2. Such reduced and amended boundaries for said
petition are hereby forwarded to the City Clerk for a
redetermination of whether or not sufficient signatures exist, as

such signatures were established pursuant the terminal date of
February 10, 1994.
Section 3. The City Clerk is hereby directed to provide
to the City Council her certification of the signatures within said
reduced boundaries.
