Resolution 014JRE HF 12-27-52 4 RESOLUTION NO. % A RESOLUTION of the City Council of the City of Edmonds, Washington, employing counsel for certain services in connection with the issuance of general obligation bonds of the city. WHEREAS, it is deemed necessary and advisable that the City of Edmonds, Washington, issue its general obligation bonds in the total principal sum of not to exceed $11,450, payable by unlimited tax levies, to pay part of the cost of purchasing a new firefighting truck; and WHEREAS, the proposition of whether or not such bonds should be issued was submitted to the qualified electors of the city on November 4, 1952, and at said election the number and pro- portion of the qualified electors of the city required by law voted in favor of said proposition; and WHEREAS, the wording of said proposition will require test litigation to determine whether or not taxes may be levied in excess of the 40-mill limit to pay the principal and interest of said bonds; and WHEREAS, it is deemed necessary and advisable that bond counsel skilled in such matters be employed to advise the city at- torney with respect to the conduct of said litigation and to draw the ordinances, notices, and other documents necessary for the issuance and sale of said bonds, and to give their opinion as to the validity of such bonds at the time of their sale; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edmonds, Washington, as follows: -37 That Preston, Thorgrimson & Horowitz, attorneys at law of Seattle, Washington, be and they hereby are employed to -perform the services above set forth, and as compensation therefor the city agrees to pay them the sum of Two Hundred Fifty Dollars ($250.00). In the event that said counsel are unable to give an opinion approving the validity of said bonds, then the city agrees to pay said counsel the sum of Two Hundred Dollars ($200), which shall be payment in full for their services rendered in this matter. In addition thereto, the city further agrees to reimburse said counsel for all out-of-pocket expenses, such as long distance telephone tolls, which they may incur in rendering said services, and to furnish said counsel at their office in Seattle, Washington, with a complete certified transcript of all proceedings taken in the matter of the issuance of said bonds, including a duplicate court file of the aforesaid test litigation.
