Resolution 236RESOLUTION NO.� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS TO THE CITY COUNCIL OF THE CITY OF LYNNWOOD EXPRESSING THE FORMER'S DESIRE TO ANNEX A PROPOSED ROADWAY PRESENTLY WITHIN THE CITY OF LYNNWOOD, CONTIGUOUS TO THE CITY OF EDMONDS, AND UNDER THE OWNERSHIP OF SAID CITY OF EDMONDS, WASHINGTON. WHEREAS the City of Edmonds is empowered by virtue of RCW 35A.14.300 to make annexations for municipal purposes as follows: "Legislative bodies of code cities may by a majority vote annex territory outside the limits of such city whether contiguous or non- contiguous for any municipal purpose.", and, the annexation by one municipal corporation of a portion of another city wherein both cities are contiguous, and WHEREAS, RCW 35.10.217 (2) provides the procedure as follows: "Three other methods are available for the annexation of all or a part of a city or town to another city or town: *** (2) The legislative body of a city or town may on its own initiative by resolution indicate its desire to be annexed to a city or town either in whole or in part. In case such resolution is passed, such resolution shall be transmitted to the city or town to which it desires to be annexed, and the legislative body of such city or town shall be resolution indicate whether it will accept the proposed annexation, and if so, on what terms." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON RESOLVES AS FOLLOWS: Section 1. Legal description. The following legally described property is owned in fee title by the City of Edmonds, but is situate within the city limits of the City of Lynnwood, being legally described as follows: That portion of Section 19, T27N, R4E, W.M., described as follows: Commencing at the NE corner of the NE 1/4 of NE 1/4 of said section, thence West 30 feet along centerline of Edmonds - 102 - Alderwood Manor Road; thence South along the West line of County road running North and South along the East line of said NE 1/4 of NE 1/4 for 660 feet; thence West parallel to the North line of said NE 1/4 of NE 1/4 for 257 feet to the true point of beginning; thence continue West 43 feet; thence North 33 feet; thence East 15 feet; thence South easterly to a point 10 feet North of the true point of beginning; thence south 10 feet, and That portion of Section 19, Township 27 N, Range 4 East, W.M. described as follows: The west 30.0' of the East 127.0 feet of the West 1143.0 feet of the North one-half of the South one-half of the Northeast quarter of the Northeast quarter less the south 30.0 feet for road. Section 2. Configuration and purpose of Cit -r of Edmonds Ownership. The real property has been acquired by the City of Edmonds to provide access primarily for fire protection service to substantial apartment complexes situate on narrow lots in which there are located seventy- six living units. Said apartments have access only to State Highway No. 524 a/k/a 196th Street S.W., which in the event of a fire to the apartment units along with the heavy traffic load of said 196th S.W. could endanger the occupants of said dwelling units by reason of limited access frontage on said 196th S.W. The property legally described in Section 1 above consists of unoccupied real property, unimproved except for vegitation, and consists of a proposed roadway approxi- mately 320 feet in length and 30 feet in width. Section 3. Proposed improvement. The City of Edmonds proposes to improve said legally described property at the sole cost of the City of Edmonds and abutting property within the City limits of the City of Edmonds and at no cost in any way to property situated within the City of Lynnwood or the City of Lynnwood itself. Further, in the event of annexation, coupled with the existing ownership of the legally described property by the City -2- of Edmonds, it is the intent of the City of Edmonds to be solely responsible for all maintenance and upkeep of said proposed roadway. Section 4_ Tnvitatinn to cnn.qic9er annPxatinn_ There being no qualified electors residing within the above referenced area proposed for annexation, and pur- suant to the Revised Code of Washington as hereinabove set forth, the City of Edmonds hereby indicates its desire that the above legally described property be annexed to the City of Edmonds and hereby invites the City of Lynnwood to transmit to the City of Edmonds by Resolution its reciprocal desire for annexation of said property.
