A RESOLUTION OF THE CITY OF EDMONDS,
WASHINGTON PURSUANT TO THE SHORELINE
MANAGEMENT ACT OF 1971 AUTHORIZING THE
MAYOR TO SET A PUBLIC HEARING IN THE
EVENT OF ADVERSE COMMENT ON THE PROPOSED
SUNSET BEACH DEVELOPMENT.
WHEREAS, the City of Edmonds contemplates the development
of Sunset Beach by providing certain open space improvements for the
betterment of public access to said waterfront park, and
WHEREAS, the Department of Ecology of the State of Washington
has promulgated Chapter 173-14 of the Washington Administrative Code
pursuant to the Shoreline Management Act of 1971, Chapter 286, Laws
of 1971, Ex. Sess. , which chapter provides for mandatory or optional
public hearings to precede the issuance or denial of permits in order to
allow members of the public to present their views, and
WHEREAS, the proposed City development of the Sunset Beath
Park is for the purpose of creating greater ease of access and utilization
of the shoreline abutting said park without significant change to said
shoreline, and specifically without detriment to the same, now, therefore,
IT IS HEREBY RESOLVED by the City Council of the City of
Edmonds that the Mayor be and the same is hereby authorized to set a
public hearing in order to allow members of the public to present their
views on the proposed development of the Sunset Beach Park by the City
of Edmonds in the event he finds noteworthy comment for or against said
proposed development following the mandatory publication of notice of
application, provided, however, in the event he finds a public hearing
unnecessary, said application may be approved by the Planning Director
upon compliance with all other applicable laws.
