Recommendation from Mayor and Staff Community/Development Services Committee endorse the 196th Street SW/88th Avenue West Intersection Engineering Study report and Staff recommendation for presentation to the full Council. Previous Council Action At the March 20, 2007 Council meeting, Council approved $20,000 from ending cash balance to begin the study of the intersection of 88th Avenue West and 196th Street SW in 2007. Narrative The City of Edmonds hired Gray and Osborne, Inc. to prepare an engineering study for the 196th Street SW / 88th Avenue West intersection. The purpose of the study was to evaluate the intersection and develop alternatives to improve its safety. The access onto 196th Street SW, from the 88th Avenue West north and south approaches, appears to be troublesome due to limited sight distance. 196th Street SW is a State Route and any improvements require Washington State Department of Transportation (WSDOT) approval. The analysis included: · Detail of accident history over the last three years · A speed study along 196th Street SW from the east and west approaches of 88th Avenue West · A comparison of existing sight distance with American Association of State Highway and Transportation Officials (AASHTO) standards along 88th Avenue West · Traffic counts for all approaches After evaluating the analysis, the consultant came up with seven different alternatives: · A. No Improvements · B. Limited Access – No Access from South leg, No Left Turn From North Leg · C. Four-Way Stop · D. Traffic Signal Packet Page 2 of 46 · E. Intersection Realignment · F. Roundabout · G. Limited-Access – Right Turn Only From South Leg of 88th Avenue West Option “B”, Limited Access from the south leg and north legs, is not recommended because it would significantly increase traffic to other residential streets and limits access to 88th Avenue West , an urban collector. There also appears to be adequate sight distance for some of the turning movements that would be restricted by this option. Options “C” – Four Way Stop and “D” – Traffic Signal, don’t meet Manual of Uniform Traffic Control Devices (MUTCD) warrants and would significantly reduce the Level of Service of the State Route. Option “E” – Intersection Realignment, and Option “F” –Roundabout, are not recommended due to the extremely high cost. Staff, with support from WSDOT, recommends restricting the movements on the 88th Avenue West South Leg to Right Turn Only with the installation of a raised island and signage (Option G). This will address the limited sight distance to the east. The estimated cost of this option is approximately $15,000. Staff does not recommend restricting movements for the north leg, which has adequate sight distance according to the Study. The straight and left turn movements from the south leg are also statistically much more dangerous than from the north leg (approximately 4.5 times more dangerous, from the ratios calculated in chart below). Recommendation from Mayor and Staff Previous Council Action Narrative In late October, a letter to Council President Olson was received from Myra Rintamaki, President of the Washington State Gold Star Mothers, requesting that the City Council place a bench near the Edmonds Museum to enhance the Veteran's Memorial. Ms. Rintamaki's son, Cpl. Steven Rintamaki, was killed in Iraq in 2004. A bench near the Memorial would give the public an opportunity to view the Memorial, and then sit and ponder the sacrifices made. Staff visited the site and recommends an area just north of the Memorial that could accommodate a bench. If City Council were to agree to purchase a bench, this area would require the removal of some vegetation. Bench requests are made through the Gifts Catalog Program which provides an opportunity for individuals or groups to donate funds for site specific items, such as benches and tables, for use in the City's park system. The majority of these donations have been made in memory of a loved one. A bench is $1,500 and includes a bronze plaque. At this time, we have a waiting list of over 40 individuals. I am proposing that the City Council approve a proposal to provide a park bench close to the memorial to allow citizens to view, honor and ponder the history and sacrifice of those military men and women from our neighborhoods, that while serving their patriotic duty, also made the ultimate sacrifice. In honor of my son, Cpl. Steven Rintamaki, a former student in the Edmond’s School District and a member of the United States Marine Corps, who fought and died in Iraq on September 16, 2004, I am requesting a plague be placed on the bench in his honor and in honor of all those from Snohomish County that have made the ultimate sacrifice. I had previously spoken to the Edmonds Park Department for a cost estimate on a park bench. I recall that the estimated cost was around $1,500. I appreciated your consideration of this proposal. I am indebted to Council Member, Richard Marin, for restoring the old memorial and having it moved to a location which provides an opportunity for the community to remember and honor those that have made the ultimate sacrifice. Recommendation from Mayor and Staff Proceed with scheduling a public hearing to inform and allow public input on measures to promote more efficient use of the regional water resources. Previous Council Action None Narrative Since the early 1990's, the City of Edmonds has promoted various programs to reduce water consumption. This has been accomplished primarily through programs offered by the City's water purchasing contracts with the City of Seattle and the City of Everett. For the past 10 years, staff has been an active participant in the City of Everett's regional water conservation program. In addition the Public Works Water Division regularly performs leak detection surveys and subsequent water main repairs and the Engineering Division has an annual water main replacement program to replace older pipelines that are prone to leakage. In July 2007, the State Department of Health (DOH) issued guidelines for all communities statewide to develop goals to make more efficient use of water resources. One of the DOH requirements is to establish these water use efficiency goals and include the opportunity for the public to provide input. Recommendation from Mayor and Staff It is recommended that this agreement be approved to be placed on the next available City Council Consent Agenda. Previous Council Action Narrative In 1997, the City of Edmonds entered into an interlocal agreement with the Town of Woodway to provide first response police services when a Woodway officer is not on duty or is unavailable to respond. Interlocal agreements between Edmonds and Woodway for police services have been in effect continuously since then. Edmonds Police Department and Woodway wish to sign a new two year interlocal agreement for police services effective January 1, 2008 through December 31, 2009. The last contract was three years in length, but we felt a two year time frame would enable us to realistically evaluate response costs. TERM THIS AGREEMENT shall have a two-year term commencing on January 1, 2008 and expiring on December 31, 2009. 1.1 This Agreement may be terminated by either party without cause by the provision of ninety days written notice addressed to the respective City or Town Clerk, at his/her regular business address. 1.2 This Agreement may be terminated by either party for cause if, but only if: 1.2.1 Prior written notice of an alleged breach of the terms of the Agreement is provided to City or Town Clerk; and 1.2.2 The breach is not cured within 48 hours of the actual receipt of the written notification of breach. 1.3 This Agreement may be extended for future calendar terms or such other terms as the parties may deem appropriate upon the approval of the parties. {WSS478377.DOC;1/00006.900000/} 1 Packet Page 15 of 46 II. SERVICES TO BE PROVIDED THIS AGREEMENT does not create a separate entity for the provision of services. Rather it is the intent of the parties that Edmonds shall provide back-up police services as described herein when a Woodway officer is not on duty or is otherwise unavailable to respond to the call. In such event, SNOCOM shall dispatch an Edmonds officer in or on an appropriate vehicle and with appropriate back-up when needed for: 2.1 All priority one (1) in-progress calls which currently includes abduction, bank alarm, robbery hold-up alarm, assault, assault with weapon, burglary, fight with weapon, hostage situation, prowler, rape, robbery and strong-arm robbery; and/or 2.2 Priority two (2) calls in progress which involve, but are not limited to, threats to life or property, including residential alarms, panic alarms, suspicious persons, suspicious circumstances, traffic accidents and 911 hang-up calls. 2.3 Priority one and priority two calls shall be defined in accordance with the definition established for such calls by SNOCOM, such definitions to be incorporated by this referenced as fully as if herein set forth. The determination of SNOCOM regarding the characterization of any call shall be final and determinative. 2.4 If a Woodway police officer is on regular scheduled duty and back-up is required, the Edmonds police department will continue to assist if an officer is available at no charge, in accordance with other existing mutual aid agreements. III. RESPONSIBILITIES OF THE PARTIES 3.1 The Edmonds Police Department shall: 3.1.1 Conduct an initial investigation of incidents; 3.1.2 Assist victims and witnesses at the crime scene; 3.1.3 Preserve crime scenes; 3.1.4 Take reports on minor incidents; 3.1.5 Provide a written report on every dispatched call; and 3.1.6 As required, attend and testify at any prosecution arising from the call. 3.2 The Woodway Police Department shall: 3.2.1 Provide any follow-up investigation, report or action required relative to an assault, burglary or crime with possible suspects by call-out of a Woodway police officer. {WSS478377.DOC;1/00006.900000/} 2 Packet Page 16 of 46 3.2.2 Woodway, through its police officers, shall provide crime scene investigation regarding burglaries, multiple property crimes, serious accidents, or similar events of a serious or felonious nature. 3.2.3 Woodway shall call out an officer to provide service in the event that arrest and booking of a suspect is required. Woodway police department citation forms shall be used and an "assist other agency" report and statement prepared. If no Woodway police department officer is reasonably available, an Edmonds citation form may be used. In such event, the Edmonds police department policy regarding issuance of citations on state charges shall be followed. 3.2.4 Evidence shall be retained by the Woodway police department. 3.2.5 Juvenile referrals will be referred to the Woodway police department for processing, including appropriate report and referral. 3.3 Report Process. 3.3.1 A written report shall be provided regarding all calls to which an Edmonds officer is dispatched. 3.3.2 The original shall remain with the Edmonds police department. 3.3.3 Copies shall be sent immediately to the Woodway police department. 3.3.4 A copy shall be provided to the Edmonds Assistant Chief for the Police Support Services division. 3.4 Emergency Situations; No Special Duty or Third Party Right Created. The parties understand and agree that in the event of an emergent situation in Edmonds, services under this Agreement may be delayed or suspended. Nothing herein shall be interpreted to create any third party right, nor is any special duty to any third party, private party, person or entity created as a result of this Agreement. IV. BILLING PROCESS Woodway shall pay to Edmonds $125 per dispatched call. Edmonds shall provide a detailed quarterly billing which shall include at a minimum the Edmonds police department case number and the date of the incident. Payment shall be remitted within 30 days of billing. In the event of a dispute regarding billing, the parties agree to submit the dispute to binding arbitration or such other form of alternative dispute resolution (mediation) as the parties shall approve. {WSS478377.DOC;1/00006.900000/} 3 Packet Page 17 of 46 V. SUPPLIES AND EQUIPMENT Edmonds shall provide services through use of its own vehicles and equipment and be responsible for all costs associated therewith, including but not limited to damage from any kind or nature and normal wear and tear. Edmonds shall also utilize its own reports and forms with the exception of citations as herein provided. Edmonds citations shall only be used when no Woodway citations are reasonably available. VI. LIABILITY AND INDEMNITY 6.1 Edmonds shall indemnify and hold harmless Woodway, its officers, agents and employees from any claim, cause or liability of any kind or nature whatsoever arising from or out of the negligence or wrongful tortious act of an Edmonds officer or employee in the provision of services under this Agreement by Edmonds officers. This promise to indemnify and hold harmless shall include a waiver of the immunity provided by Title 51 RCW, to, but only to the extent necessary to fully effectuate its promise. 6.2 Woodway shall indemnify and hold harmless Edmonds, its officers, agents and employees from any claim, cause or liability of any kind or nature whatsoever arising from or out of the negligence or wrongful tortious act of a Woodway officer or employee in the provision of services under this Agreement by Woodway officers. This promise to indemnify and hold harmless shall include a waiver of the immunity provided by Title 51 RCW, to, but only to the extent necessary to fully effectuate its promise. 6.3 In the event of a claim, loss or liability based upon the alleged concurrent or joint negligence or tortious act of the parties, the parties shall bear their respective liability, including cost, in accordance with an assignment of their respective liability established in accordance with the laws of the State of Washington. VII. ENTIRE AGREEMENT - AMENDMENT This is the entire agreement between the parties. Any prior understanding, written or oral, shall be deemed merged with its provision. This Agreement shall not be amended except in writing with the express written consent of the City Council and Town Council of the respective parties. Recommendation from Mayor and Staff Recommend approval. Previous Council Action Narrative We have had an agreement to provide part-time animal control service to the City of Mountlake Terrace since May 14, 1998. The current agreement for that service expires on December 31, 2007. Both the City of Mountlake Terrace and the Edmonds Police Department would like to renew the agreement. The new agreement provides service until December 31, 2010. The City of Mountlake Terrace will pay $2,652 per month for animal control service during the calendar year 2008. This monthly payment shall be increased beginning on January 1, 2009 by the percentage increase in the Seattle CPI-U for June 2008, and shall be increased beginning on January 1, 2010 by the percentage increase in the Seattle CPI-U for June 2009. We are requesting that the Public Safety Committee recommend that this matter be placed on the consent agenda for approval by the full City Council. NOW, THEREFORE, the City of Edmonds (hereinafter “Edmonds Animal Control”) and the City of Mountlake Terrace (hereinafter “Mountlake Terrace”) have entered into this Agreement under the terms and conditions set forth herein in light of the mutual benefits to be derived: I. TERM THIS AGREEMENT shall have a three-year term commencing on January 1, 2008 and shall terminate on December 31, 2010. 1.1 This Agreement may be terminated by either party without cause by the provision of 180 days written notice addressed to the respective City clerk, at his/her regular business address. 1.2 This Agreement may be terminated by either Party for cause if, but only if: 1.2.1 Prior written notice of an alleged breach of the terms of the Agreement is provided to the City Clerk; and 1.2.2 The breach is not cured within 48 hours of the actual receipt of the written notification of breach, provided however if the alleged breach is of such a nature that it is not possible to be cured within 48 hours, then in that event as long as the breaching party is exercising due diligence in attempting to cure the breach, the time to cure shall be extended to a maximum of 20 days. 1.3 This Agreement shall automatically expire, if, at the sole discretion of its City Council, either Party fails to appropriate funds sufficient to meet the Party’s Packet Page 22 of 46 obligation under this Agreement in its respective annual budget. In the event of such failure of appropriation, this Agreement shall expire at the close of the last calendar day for which available appropriation was made. 1.4 This Agreement may be extended for future calendar terms or such other terms as the Parties may deem appropriate upon the approval of the Parties. II. SERVICE TO BE PROVIDED 2.1 Edmonds Animal Control will provide 87 hours of animal control service a month. 2.1.1 Animal control service should average about 20 hours per week. 2.1.2 Hours not spent on calls in one week will be carried over to the following week, but in no event shall be carried longer than 30 days. 2.1.3 Calls for service will be during the normal hours of Edmonds Animal Control. Normal service shall be 7 days a week. 2.1.4 There will be no call outs for service after normal hours or when an Edmonds Animal Control Officer is off for vacation, holiday, sick leave, or any other approved time off, unless for an imminent emergency as approved by the Edmonds duty sergeant. III. RESPONSIBILITIES OF THE PARTIES 3.1 Edmonds Animal Control shall: 3.1.1 Listen to voice mail messages and read email in the AM and take appropriate action to resolve questions or complaints. 3.1.2 Conduct follow-up investigations on ongoing animal control complaints. 3.1.3 Prepare reports, affidavits, notices of violations, citations, and other paperwork as needed. 3.1.4 Prepare for and testify in court as required. 3.1.5 Conduct random patrols through the City of Mountlake Terrace, however, not to exceed more than 10 hours per month. Packet Page 23 of 46 3.1.6 Respond to calls concerning vicious animals; sick, injured or dead animals; dog bites; quarantine issues; or otherwise as requested by a supervisor. Nothing herein shall be interpreted to obligate Edmonds to respond to a caller or to prioritize any particular type of call. Edmonds’ determination regarding the prioritization or response to a call shall be at its sole discretion. Parties understand and acknowledge that the duties of an animal control officer are such that he/she may be required to respond to multiple calls or to prioritize calls and, as noted, such prioritization shall be the sole discretion of the City of Edmonds or its officers, agents or employees. 3.1.7 Prioritize calls in both Cities to insure appropriate response, see 3.1.6. 3.1.8 Provide a monthly activity report to include, but not limited to, hours spent in Mountlake Terrace, number of complaints and reports written, citations and warnings issued. 3.2 The Mountlake Terrace Police Department shall: 3.2.1 Pay to Edmonds the sum of $2,652.00 per month for animal control service during calendar year 2008. This monthly payment shall be increased beginning on January 1, 2009 by the percentage increase in the Seattle CPI-U for June 2008, and shall be increased beginning on January 1, 2010 by the percentage increase in the Seattle CPI-U for June 2009. Payment shall be due 10 days after proper invoice. 3.2.2 Contract with a locally agreed-upon animal shelter for animal shelter service. 3.2.3 Pay the full cost of euthanasia service and animal disposal service as billed. 3.2.4 Provide voice mail box and email address for animal control service. 3.2.5 The parties agree that by February 15 of each calendar year, commencing in year 2009, the actual number of hours of services performed by the City of Edmonds for the City of Mountlake Terrace for the preceding calendar year shall be computed. In the event the City of Edmonds has provided more than one thousand and forty-four (1,044) hours of service in the preceding calendar year, the City of Mountlake Terrace shall remit to the City of Edmonds, $33.20 per hour for each hour in excess of one thousand forty-four (1,044). In the event the City of Edmonds has provided less than one thousand forty-four (1,044) hours of service in the preceding calendar year, the City of Edmonds shall either offset and credit the City of Mountlake Terrace for future services to be provided for those hours less than one thousand forty-four (1,044) hours, or the City of Edmonds shall remit to the City of Mountlake Terrace at the rate of $33.20 for those hours less than one thousand forty-four (1,044) hours by March 15 of that year, as the parties may mutually agree. Packet Page 24 of 46 3.2.6 For subsequent years of this agreement, the hourly rate for services stipulated in paragraph 3.2.5 will be increased by the Seattle CPI-U in the same manner as detailed in paragraph 3.2.1. 3.2.7 Provide citation books and appropriate forms as needed. IV. SUPPLIES AND EQUIPMENT Edmonds Animal Control shall provide services solely through its own vehicles and equipment and be responsible for all costs associated therewith, including but not limited to damage from any kind of nature and normal wear and tear. Edmonds citations shall not be used. V. LIABILITY AND INDEMNITY 5.1 Edmonds shall indemnify and hold harmless Mountlake Terrace, its officers, agents and employees from any claim, cause or liability of any kind or nature arising from the wrongful, negligent or tortious act or failure to act in the provision of services under this agreement by the Edmonds animal control officers. This promise to indemnify and hold harmless shall include a waiver of the immunity provided by Title 51 RCW too, but only to the extent necessary to fully effectuate this promise. 5.2 Mountlake Terrace shall indemnify and hold harmless Edmonds, its officers, agents and employees from any claim, cause or liability of any kind or nature whatsoever arising from the wrongful, negligent or tortious act or failure to act of Mountlake Terrace, its officers, agents or employees. This promise to indemnify and hold harmless shall include a waiver of the immunity provided by Title 51 RCW, too, but only to the extent necessary to fully effectuate this promise. 5.3 In the event of a claim, loss or liability based upon the alleged concurrent or joint negligence of the parties, the parties shall bear their respective liability, including cost, in accordance with an assignment of their respective liability established in accordance with the laws of the State of Washington. VI. MISCELLANEOUS 6.1 This interlocal agreement shall not create any separate legal or administrative entity to which any power is delegated by the parties. 6.2 Financing for the responsibilities of parties shall be sole, individual and separate responsibility of each party to this interlocal agreement. 6.3 The administration of this interlocal agreement shall be the responsibility of each party’s Chief of Police. Packet Page 25 of 46 6.4 Other than as provided in this interlocal agreement, the parties shall not jointly acquire, hold or dispose of any real or personal property and no special fund shall be established during performance of this interlocal agreement. 6.5 Prior to its entry into force, Mountlake Terrace shall record with the Snohomish County Auditor a copy of this interlocal agreement executed by the parties. ENTIRE AGREEMENT – AMENDMENT This is the entire agreement between the parties. Any prior understanding, written or oral, shall be deemed merged with its provision. We have that as one of the stipulations for a vendor wishing to contract with EPD because it is often advantageous to send our members to the uniform store to be fitted, etc. We recently requested quotes from Blumenthal Uniforms and Krosen's Uniforms. The quotes returned and are similar in price. The Police Department is desirous of having more than a single source for uniform items. These two vendors exist as the only qualified uniform suppliers locally. The last RFP was sent out in 2003 and our research indicates, if another RFP is sent out, these two vendors would still be the only two qualified.
