Subject Title
Approval of rules for the nomination/election process to fill the vacant City Council position
#2.
Recommendation from Mayor and Staff
Review and approve the proposed rules.
Previous Council Action
The proposed rules were last used on January 30, 2001, when the City Council made an
appointment to fill a Council vacancy. Attached is an excerpt from the minutes of this meeting for
review as an example of how the rules/process worked at that time.

RULES FOR NOMINATION/ELECTION
TO FILL COUNCIL VACANCY
Nominations
Each Councilmember may nominate one candidate from the list of applicants.
Nominations will be made on the form printed for that purpose by placing an “X” in the
box adjacent to the name of the applicant of their choice. Councilmembers will sign
their ballot so that a permanent vote record is maintained. The City Clerk will record all
votes and announce the results of each balloting.
The Election
Each Councilmember may vote for one candidate from the list of those nominated.
Votes will be accomplished on the form printed for that purpose by placing an “X” in the
box adjacent to the name of the nominee of their choice. Councilmembers will sign their
ballot so that a permanent vote record is maintained. The City Clerk will record all votes
and announce the results of each balloting.
A Deadlock
In the event the City Council should deadlock, then all nominations are declared null
and void and the Council may return to the list of the applicants and start over. A
deadlock is where every Councilmember votes exactly the same way on 5 consecutive
ballots.

4. APPOINTMENT TO FILL COUNCIL VACANCY
Mayor Haakenson read the rules for nomination and election to fill the Council vacancy.
COUNCIL PRESIDENT EARLING MOVED, SECONDED BY COUNCILMEMBER MILLER,
TO APPROVE THE RULES FOR THE NOMINATION/ELECTION PROCESS.
Councilmember Petso reiterated the view she voiced when a previous appointment was made, explaining
one of the options available to the Council was an Executive Session on a personnel matter to discuss the
qualifications of the candidates. She said some viewed this as a closed door meeting, therefore, the
Council has not done this.
MOTION CARRIED, COUNCILMEMBER PETSO OPPOSED.
City Clerk Sandy Chase distributed the first nomination ballot to Councilmembers. Those nominated
were: Deanna Dawson (Councilmember Petso), Lester Blume (Councilmember Orvis), Jeffrey Wilson
(Council President Earling and Councilmember Miller), Ted Smits (Councilmember Plunkett), and
Richard Marin (Councilmember Davis).
Vote No. 1 was taken. The results were: one vote for Lester Blume (Councilmember Orvis), one vote for
Deanna Dawson (Councilmember Petso), two votes for Jeffrey Wilson (Council President Earling and
Councilmember Miller), one vote for Ted Smits (Councilmember Plunkett), and one vote for Richard
Marin (Councilmember Davis).
Vote No. 2 was taken. The results were: one vote for Richard Marin (Councilmember Davis), one vote
for Ted Smits (Councilmember Plunkett), two votes for Jeffrey Wilson (Council President Earling and
Councilmember Miller), one vote for Deanna Dawson (Councilmember Petso), and one vote for Lester
Blume (Councilmember Orvis).
Vote No. 3 was taken. The results were: one vote for Richard Marin (Councilmember Davis), one vote
for Ted Smits (Councilmember Plunkett), two votes for Jeffrey Wilson (Council President Earling and
Councilmember Miller), one vote for Deanna Dawson (Councilmember Petso), and one vote for Lester
Blume (Councilmember Orvis).
Vote No. 4 was taken. The results were: one vote for Ted Smits (Councilmember Plunkett), one vote for
Deanna Dawson (Councilmember Petso), one vote for Lester Blume (Councilmember Orvis), two votes
for Jeffrey Wilson (Council President Earling and Councilmember Miller), and one vote for Richard
Marin (Councilmember Davis).
Vote No. 5 was taken. The results were: two votes for Richard Marin (Councilmembers Davis and
Petso), two votes for Jeffrey Wilson (Councilmember Miller and Council President Earling), one vote for
Ted Smits (Councilmember Plunkett), one vote for Lester Blume (Councilmember Orvis),
Vote No. 6 was taken. The results were: three votes for Richard Marin (Councilmembers Plunkett,
Davis, and Petso), two votes for Jeffrey Wilson (Councilmember Miller and Council President Earling),
and one vote for Lester Blume (Councilmember Orvis).

COUNCILMEMBER MILLER MOVED, SECONDED BY COUNCILMEMBER PLUNKETT,
FOR APPROVAL OF RICHARD MARIN AS THE NEW COUNCILMEMBER. MOTION
CARRIED UNANIMOUSLY.
Mayor Haakenson swore in Mr. Marin and Councilmember Marin took his seat on the dais.
