Resolution 9850006.900120 CDI 8/14/00 Cemetery, and RESOLUTION NO. 985 A RESOLUTION OF THE CEMETERY BOARD OF THE CITY OF EDMONDS, WASHINGTON, DECLARING CERTAIN CEMETERY SPACES AS UNOCCUPIED AND SUBJECT TO FORFEITURE UNDER CHAPTER 68.36 RCW; AUTHORIZING POSTING OF NOTICES PURSUANT TO THE ABANDONMENT PROCEDURE IN CHAPTER 68.36 RCW AND AUTHORIZING CONTINUED IDENTIFICATION OF UNOCCUPIED CEMETERY SPACES SUBJECT TO FORFEITURE. . WHEREAS, the City of Edmonds ( "City ") owns the Edmonds Memorial WHEREAS, pursuant to Ordinance No. 2306, the City established the Cemetery Board ( "Board ") to operate, maintain and manage the Edmonds Memorial Cemetery, and WHEREAS, under Chapter RCW 68.36, cemeteries, including municipal cemeteries, may declare unoccupied cemetery spaces as abandoned and subject to forfeiture if no member of the immediate family of the identified owner has been interred in the space in the last 20 years, and WHEREAS, the Board has identified certain cemetery spaces where no member of the immediate family of the identified owner has been interred between 1891 and 1955, and WHEREAS, the Board will continue to identify unoccupied cemetery spaces subject to forfeiture, now, therefore, THE CEMETERY BOARD OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: {CDI444739.DOC;2/00006.900120/} - I - Section 1. The Board finds that the cemetery spaces identified in attached Exhibit A have been unoccupied for a period of at least 20 years. Section 2. The Board finds that there is no evidence in its records that the cemetery spaces in Exhibit A have been transferred through testamentary disposition, gift or sale. Section 3. The Board finds that 'the cemetery spaces in Exhibit A are subject to forfeiture and the City intends to cause such forfeiture after notices have been posted pursuant to Chapter 68.36 RCW. Section 4. The Board recommends that the Parks Department cause notices to be erected and maintained, for a period of at least five years, on each unoccupied cemetery lot, unoccupied part of lot, unoccupied lots or parts of lots in Exhibit A. Section 5. The notices referenced in Section 4 of this Resolution shall be in the form(s) attached as Exhibit B. Section 6. The Board presents its findings and recommendations to the City Counsel.
