RESOLUTION NO. 986
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDMONDS, WASHINGTON, AMENDING THE FEE
SCHEDULE ADOPTED BY RESOLUTION NO. 967
ESTABLISHING FEES FOR THE CITY'S PLANNING,
PUBLIC WORKS, BUILDING, AND OTHER FEE
STRUCTURES, INCLUDING A SAVINGS CLAUSE.
WHEREAS, the City of Edmonds has previously established a fee schedule
setting costs, charges and fees for the City's planning, public works, building and other fee
structures, and,
WHEREAS, the purpose of this resolution is not to establish a new fee, but rather
to continue its current policy that applicants pay the actual costs associated with peer review or
independent review of an application for development in a geologically hazardous area or
seismic hazard area; now, therefore
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
as follows:
Section 1. The City Council of the City of Edmonds Washington hereby resolves
Resolution No. 967 and the fee schedule attached thereto as
Exhibit A is hereby amended by the addition of the following note,
following item 25 Critical Areas Review to be shown as item 28A
to read as follows:
Geologically hazardous areas and /or seismic hazard areas —
applicants shall deposit an amount estimated by the staff to be
sufficient to pay the full cost of peer review and/or independent
review of the technical analysis of site conditions. Applicant shall
supplement the deposit when necessary to ensure full payment of
all reasonable fees associated with such review.

Section 2. If any section, sentence, clause or phrase of this resolution or any

regulation adopted or amended hereby shall be held to be invalid or unconstitutional by a court
of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase of this resolution or any
regulation adopted or amended hereby, provided, however, that if any tax rate, fee level or
structure thereof established by this resolution is declared invalid or illegal, or which is otherwise
struck down, the tax rate, fee level or structure thereof in effect prior to the effective date of this
resolution shall be restored, revised and brought to full force and effect.
