Resolution 488WDT /al 2/17/81 RESOLUTION NO. 488 A RESOLUTION DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY OF EDMONDS, WASH- INGTON, TO IMPROVE CERTAIN PROPERTY IN SAID CITY BY CONSTRUCTING, RECONSTRUCTING AND RE- PAIRING CONCRETE SIDEWALKS, RETAINING WALLS AND ROCKERIES, NECESSARY GRADING AND BASE PREPARATION AND RELATED WORK NECESSARY TO MAKE A COMPLETE IMPROVEMENT IN ACCORDANCE WITH CITY STANDARDS; REQUIRING THE ABUTTING PROPERTY OWNERS TO CONSTRUCT THE IMPROVE- MENTS AT THEIR OWN COST AND EXPENSE; SPECI- FYING THE TIME WITHIN WHICH THE CONSTRUCTION SHALL BE COMMENCED AND COMPLETED; PROVIDING THAT IF THE IMPROVEMENTS OR CONSTRUCTION ARE NOT UNDERTAKEN AND COMPLETED WITHIN THE TIME SPECIFIED, THAT THE CITY WILL PERFORM OR COMPLETE THE IMPROVEMENT AND ASSESS THE COST.... AGAINST THE ABUTTING OWNERS; CREATING A SIDE- WALK CONSTRUCTION FUND THEREFOR.;` AND PRO- VIDING THAT PAYMENT OF THE COST OF SAID IM- PROVEMENTS COMPLETED BY'',THE CITY WILL BE MADE BY SPECIAL ASSESSMENT ON THE SPECIALLY BENEFITED PROPERTY ABUTTING SAID IMPROVEMENT, BASED ON SPECIAL BENEFITS. THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. That it is the intention of the City Council of the City of Edmonds, Washington, to order the re- pair, construction and reconstruction of sidewalks and drive- ways across sidewalks and related work necessary to make a complete improvement in accordance with City standards on the list of streets set forth on Exhibit "A ", attached hereto and incorporated herein by this reference as if set forth in full. -1- r / R�. 1 Section 2. The abutting owner shall be required to construct the improvements at his own cost and expense including obtaining all necessary permits and approvals from-the City prior to construction. Construction shall be in accordance with City standards and shall be completed on or before September 1, 1981. Section 3. If the improvements or construction are not undertaken and-c,ompleted within the time specified above, the City will perform and complete the improvements. All costs of said improvement or construction shall be borne by the abutting property owner specially benefited thereby. Section 4. A sidewalk construction fund shall be created and the specially benefited abutting property assessed to pay the cost of such improvement in one payment or in in- stallments at the election of the specially benefited abutting property owner; the time, amounts and interest on said unpaid installments, if any, to be hereafter set by ordinance. Section 5-.1 All persons who may desire to appear for or against said improvement herein mentioned are hereby notified to appear at the Council chambers in the Civic Center in the City of Edmonds, Washington, at a meeting of said Council on the 21 day of April 1981, at the hour of 7:30 p.m., of said day, then and there to pre- sent their arguments for or against said improvement; if any they have. -2- RESOLVED this 17 day of February, 1981.
