April 8th, 1941, 7,30,p.m. <br />The Council met in adjourned session with Mayor Fourtne-r presiding -The <br />roll call showed the following Councilmen present:,'Chandler, Savagen, <br />Idalter Hansen., Clausen. and Jones. <br />The Oouncil took up the Union Oil Companys objection to the proposed <br />sewer on First Avenue. After due 'consideration, it was moved that wpQ <br />proseed with proposed improvement. The motion carried. <br />It was moved by Chandler and seconded by Jones that we peas Ordi- <br />nance No.534 as read. The vote was as follows:,`Chandler yes, Savage yes, <br />Hansen yes, Jones yes. Carried by unanimous vote of the Councilmen present. <br />"ORDINALCL 1'10.534" <br />" An Ordinance providing for the improvement of First Avenue in the City <br />og Edmonds, and a production suotherly of said Avenue to an intersection <br />with Dayton Street, in said city, from Bell'Street Southerly to an inter- <br />section with Dayton Street trunk sewer being a distance of 1460 feet, more <br />or less, by the construction of a combined 8-12 inch lateral sanitary and <br />storm sewer, together with the necessary drainage, manholes, catch.basine <br />and other appertenances necessary to make a complete improvement, all in <br />accordance with resolution No.109 of the City of Edmonds; creating an As- <br />sessment District; creating a Local Improvement District Fund therefor, and <br />providing that payment for such improvement, except for labor, be made by <br />specual assessment in said Distriee under the mode of payment py bonds. <br />WHEREAS , by resolution No.109, of -the City of Edmonds, the City Coun- <br />cil of said city has declared its intention to order the improvement as <br />above outlined and doing all other work necessary in connection therewith <br />to make a complete improvement in accordance with the plans and specifi- <br />cations perpared by the City Engineer, NOW, THEREFO'EP <br />THE CITY OF,11,DMOU S 'DOES ORDAIE: <br />SECTION 1: That First Avenue, in the City of Edmonds, and a Production <br />southerly of said Avenue to an intersection with Dayton Street, in said <br />city, from'Bell'Street Southerly to an intersection -with Dayton Street <br />trunk sewer being a distance of 1460 feet, more or less, by the construc- <br />tion of a combined 8-12 inch lateral sanitary and storm sewer, tofether <br />withe the necessary drainagw, manholes, catch basins and other appurtengn.- <br />ces necessary to make a complete improvement, all in accordance with the <br />plans and specifications prepared under the direction -0of the City.:rn.gineer, <br />which plans and specifications are hereby adopted and approvE.d. <br />SECTION 2: That the Cost and expenses of such improvement shall beborne <br />by and assessed against the property included in the .assessment District <br />herein created in accordance with law. <br />SECTIOF 3: There is hereby established a Local Improvement District to <br />he called Local Improvement District,llo.54, which District shall include <br />the folloing described property, to-wit:.,´┐ŻBeginning at the intersection of <br />the center line of Bell Street and Firste Avenue, thence Easterly along <br />the center line of Bell Street for."'150 feet, thence Southerly along the <br />Vilest line of the Alley in Block 12 in the Plat of Ledmonds and along the <br />Viest line of the alley of Block 2 in the Plat of Gepharts iddition and <br />along the West line of said alley Prduced southerly for 561 feet more or <br />less to an intersection with the Southerly line of Dayton'Street, thence <br />Westerly along the southerly line of Dayton Street for 172 feet to, an inter <br />sectionwith the center line of First Avenue produced southerly, thence <br />continue westerly on the southerly line of Dayton Street for 172 feet to a <br />point which is 150 feet westerly of measured at'right angkes from the cen- <br />ter line of First Avenue produced southerly, thence northerly to <br />parallel <br />and 150 feet westerly of the center line of First Avenue produced for 979 <br />feet to an intersection with the Easterly margin of Iliailroad Avenue, thence <br />northeasterly following Railroad Avenue and the Easterly margin the <br />of <br />Great Nothern Railroad Right of Itchy to Phe northweast corner of Lot 4 Block <br />13 in the Plat of Edmonds, thence easterly along the North line of said <br />lot 4 and said line <br />produced to the center line of First Avenue, thence <br />northerly alongthe center line og First Avenue fot,150 feet to the <br />of beginning. point <br />Si'EMON 4: A Special fund is heherby created to be called Local Improve- <br />ment District Fund No. 54, <br />which shall consist in the aggregate of the <br />several amounts assessed, levied and collected on the several lots and <br />Parcels of land in said Local Improvement District and the proceeds of the <br />sale of the bonds of the said District for the <br />purpose of defraying the <br />costs and expenses of such improvement. Out of said funds shall be paid <br />the <br />bonds, the interest thereon, and the entire cost of such improvement, <br />except the cost of labor as hereinafter provided. <br />PECTION 5: The costs and expenses of such improvement shall be defrayed <br />by special <br />assessment payable in ten equal, annual installments with inter- <br />est -thereon at the rate of 5 per cent., per annum under the mode of pay- <br />ment by lbQn.ds, as provided by law and the Ordinances <br />of said city.
