19600503 City Council MinutesM • May 39 1960 Meeting was called to order by Mayor Maxwell with all councilmen present. Bids were opened on paving Dayton Street. They were: Joplin Paving Co. $3626,25 Lake City Gravel & Materials 3550oOO Washington Asphalt Co. 3818.25 A motion was made by Councilman Kincaid, seconded by Councilman Christensen that upon recommendation of the City Engineer, the bid of Joplin Paving Co. for $3626.25 be accepted, and the mayor be authorized to enter into contract with them. Motion carried. Bids were opened on LID #98, paving 101' Ave. from Elm to Pine. They were: Joplin Paving Co. $15,632.25 Lake City Gravel & Materials 12,676.25 Washington Asphalt Co. 13,064.75 A motion was made by Councilman Kincaid, seconded by Councilman Sorensen that the bid of Lake City Gravel & Materials be accepted for $12,676.25 and the mayor be authorized to enter into contract with them. Motion carried. Bids were opened on Waterworks fittings and valves. They were: Pacific States Cast Iron Pipe Co. $2274.49 Lot A not all items bid. 1718.00 it B Western Utilities Supply Co. $2332.80 Lot A all items bid. 2243.54 It B H. D. Fowler Co. $2770.00 Lot A 2377.42 B • Pacific Waterworks Supply $2148.00 Lot A 2480.00 to B all items bid. After recommendation by the City Engineer, a motion was made by Councilman Tuson, seconded by Councilman Lambe that the bid of Pacific Waterworks Supply for Lot A, for $2148.00 be accepted and a contract entered into with them. Motion carried. It was then moved by Councilman Tuson, seconded by Councilman Christensen that the bid of Western Utilities Supply Co. for 'Lot B, for $2243.00 be accepted, and a contract be entered into with them. Motion carried. Contracts were awarded on bids carried over from last meeting on Pipe, and a motion was made by Councilman Tuson, seconded by Councilman Lambe that the bid of U. S. Pipe and Foundry be accepted for $43,118.00 for Lots A and B on the cast iron pipe. Motion carried. Councilman Tuson made a motion, seconded by Councilman Lambe that the Andrew Miller Co. be awarded the primary bid for $1072.00 for Lot C, the steel pipe. Motion carried. Several property owners were present from Glen Street, and after discussion, a motion was made by Councilman Lambe, seconded by Councilman Simpson that the proposed LID for the paving of Glen Street between Olympic and 101' be dropped at this time. Motion carried. The Street Committee reported on the possibility of paving Molly Drive, and the property owners present decided to put in a road pavement privately, not under an LID, buth with the supervision of the City Engineer as to proper grade, etc. A motion was made by Councilman Lambe, seconded by Councilman Christensen that the action to fence the City Park property at the Poihter-Willamette area be amended to extend the time to • July 1514, but with the provision of a stop si#n there for the trucks, and the Park Board and other parties involved will meet and discuss the situation further. North Star Sand & Gravel, represented by Mr. Schriber, agreed not to operate their trucks on Saturdays, Sundays, or Holidays. Motion carried. A proposal for the private paving of 3rd Ave. from Alder to Walnut was referred to the Street Committee. A Parity Certificate, pertaining to the issuance of $150,000.00 Water -Sewer Revenue Bonds 1960, was filed with the City. A motion was made by Councilman Tuson, seconded by Councilman Christensen that the City accept the bill of sale with the Alderwood stater District and authorized the Mayor to sign it. Motion carried. A motion was made by Councilman Tuson, seconded by Councilman Kincaid to accept the proposal of Foster & Marshall for the purchase of $150,000.00 Water & Sewer Revenue Bonds with the interest rate as shown in the proposal, and with the addition that Foster & Marshall pay for the legal opinion and printing of the bonds. Motion carried. It was moved by Councilman Tuson, seconded by Councilman Simpson that Ordinance,#814 be passed, providing for a plan or system of additions and betterments to the Water -Sewer system and providing for the issuance of $150,00VOO Water -Sever Revenue Bonds. A roll -call vote showed the council unanimously in favor, and the motion carried. A Resolution from the Planning Commission was presented for the rezoning of the Marshall property, 61� and Glen , from R-6 to R-6A. A motion was made by Councilman Simpson to approve the Resolution,. but the motion died for lack of a second. It was then moved by Councilman Tuson, seconded by Councilman Lambe that the Resolution of • the Planning Commission recommending the rezoning not be approved. This motion was withdrawn. Councilman Kincaid made the motion, seconded by Councilman Harrison that the rezoning be tabled for consideration later on in the meeting. Motion carried. It was moved by Councilman Christensen, seconded by Councilman Kincaid that the regular monthly bills be paid and warrants drawn on the proper funds. Motion carried. A motion was made by Councilman Christensen, seconded by Councilman Kincaid that Estimate #2 on "Little Metro", (the water tank foundation) for Hale Construction, in the amount of $2132.00 be paid. Motion carried. It was moved by Councilman Christensen, seconded by Councilman Simpson tha t the bill on "Little Metro" from Joplin Paving for $1989.52 be paid. Motion carried. A motion wqs made by Councilman Christensen, seconded by Councilman Sorensen that the bill on "Little Metro" from Joplin Paving for $253.76 be paid. Motion carried. It was moved by Councilman Christensen, seconded by Councilman Lambe that the $500.00 to Great Northern Railway Co. under "Little Metro" be paid. Motion carried. It was moved by Councilman Christensen, seconded by Councilman Sorensen authorizing issuance of interest -bearing warrants #1 thiogh #16, totalling $15,072.46, on LID #99 to Southwick - Campbell Co., Inc. to cover contractor's estimate #1. Motion carried. It was moved by Councilman Kincaid, seconded by Jouneilman Sorensen to set June 714 as the date for opening of bids for LID #100, paving and curbs on 4th from Pine to Howell. Motion carried. A motion was made by Councilman Christensen, seconded by Councilman Simpson that the plat of Twin View Estates #2, with improvements as specified, be accepted after proper posting of bonds. Motion carried. A motion was made by Councilman Kincaid, seconded by Councilman Sorensen quthorizing the attorney to negotiate for the purchase of the Cole property on Juniper Street, at a negotiated price. Motion carried. It was moved by Councilman Tuson, seconded by Councilman Simpson that Ordinance #815 be passed, cash prepayment date on LID #95. Motion carried. Meeting was then recessed until Tuesday, May 101. flay 10, 1960 Recessed meeting was called to order with all councilmen present. The Street Committee gave its report on the paving of Third Ave., and a motion was made by Councilman Kincaid, seconded by Councilman Christensen that the east side of Third, from the south side of Alder to Walnut be permitted,to enter into a private agreement for surfacing F,,8 ft. width of the street on a temporary basis, as it does not conform to grade, and that such surfacing be done under the supervision of the City Engineer. Motion carried. A motion was made by Councilman Christensen, seconded by Councilman Sorensen that the application for a building permit by Associated Sand & Gravel for a concrete mixing plant in the Highway Border Zone is not a matter to be decided by the council, and should be referred to the Board of Adjustment. Motion carried with one no. A motion was then made by Councilman Christensen, seconded by Councilman Simpson to amend the previous motion and strike out that portion menti6ning the Board of Adjustment. This motion carried with one no. Paving of Glen Street was again brought up by the residents, who deposited the fee for the preliminary engineering with the city. A motion was ®,ade by Councilman Kincaid, seconded by Councilman Sorensen that Resolution of Intention #150 be passed, to improve Glen from 101' to Olympic with curbs and asphaltic concrete paving, and the engineer be instructed to proceed with the preliminary engineering on the project; the hearing on the preliminary assessment roll to be held June 71�. A roll -call vote resulted in one no, and the motion carried. It was moved by Councilman Simpson, seconded by Councilman Christensen that the rezoning of the Marshall property, from R-6 to R-6A as recommehded by the Planning Commission be accepted. Motion carried. In answer to a request, a motion was made by Councilman Kincaid, seconded by Councilman Tuson that the Jr. Chamber of Commerce , on approval of the Art Festival Committee, be grqnted permission to set up a booth on the Mall for selling soft drinks, coffee and popcorn during the Art Festival May 20, 21, 22. Motion carried. A Petition for Annexation was received, and a motion was made by Councilman Simpson, seconded by Councilman Sorensen that the city accept the petition for annexation of the following area: All of that portion of Tract 3, Fourtner's Homestead Plat, according to the plat thereof recorded in Volume 1 of Plats, page 979 records of Snohomish County, Washington, described as follows: Beginning at the Northwest Corner of said Tract 3; thence S. 88° 16' 40" E., along the North line of Tract 3, 302 feet; thence S. 24° 41, 07" W., 180.25 feet; thence N. 880 16' 50" W. 230 feet to the !Jest line of said Tract 3; thence N. 1° 08' 40" E. along the said West line of Tract 3, 165.99 feet to the point of beginning. and the necessary steps be accomplished for a hearing to be held June 141�.
